The constitution of Pakistan contains wide range of provisions for the protection of labour rights. Pakistan has been bestowed with 70 labour laws along with 90 rules and regulations thereunder. In spite of these labour laws along with rules and regulations, labour force is facing multifarious challenges that posit direct threat to their legal recognised rights. In this regard this study was carried out to study the main hurdles that labour rights encountered in historical perspective. Moreover, in the wake of (...) devolution plan through 18th amendment to the constitution of Pakistan, what problems in respect of enforceability and legality have arisen? Labour laws promulgated in various Pakistani regimes have been discussed to figure out what really prevented successive governments to ensure minimum protection to labour strata of the nations. The article concludes with some recommendation that are sin-qua-non in current globalization where rights have emerged as the most sacred instruments in the hands of weaker portion of a society. Since the late 1980s, in defiance of Sri Lanka’s major monastic fraternities and the government, Buddhist women and men have begun to organize across distinctions of national boundary and Buddhist tradition to reinstate a defunct bhikkhun? ordination lineage for renunciant women. Drawing on fieldwork from the winter of 2015–16, this article considers some of the strategies by which Sri Lanka’s bhikkhun?s and their supporters constitute the burgeoning lineage as both legitimate and necessary for the continued health and vitality of an (...) otherwise ailing Buddhist s?sana. I argue that Sri Lanka’s bhikkhun?s engage in highly-visible forms of adherence to vinaya rules and social expectations for ideal monastic behavior set against a popular discourse about the laxity of male renunciants. Such engagement is both political and soteriological; while it is aimed at fulfilling legitimizing gendered expectations of women’s piety, it is expressed primarily in terms of the eradication of personal and societal suffering through forms of practice that accord with the ideal of a pious monastic. Thus, in contrast to discourses which locate bhikkhun?s as subjects whose presence weakens the s?sana’s duration and strength, in this new discourse Sri Lanka’s bhikkhun?s become virtuous agents of social service and moral restoration. The article concludes by identifying emerging connections between this discourse and an alreadygendered xenophobic Buddhist nationalism. (shrink)

Business ethicists should examine not only business practices but whether a particular type of business is even prima facie ethical. To illustrate how this might be done I here examine the contemporary U.S. defense industry. In the past the U.S. military has engaged in missions that arguably satisfied the just war self-defense rationale, thereby implying that its suppliers of equipment and services were ethical as well. Some recent U.S. military missions, however, arguably fail the self-defense rationale. At issue, then, is (...) whether a business supporting these latter missions may not be circumstantially unethical. No it is not, say defense industry advocates, for two principal reasons. For one, this business benefits society at large in numerous ways. And, for another, the organizer of these military missions is a superpower which by its very nature is not subject to the ethical constraints of the self-defense rationale. I dispute both reasons, argue against the second, and conclude that the U.S. military-industrial complex (MIC) is circumstantially unethical. (shrink)

Within the research field of computer-mediated communication, extensive attention has been paid to the differences between CMC and spoken conversation, particularly in terms of sequential structure. In this study, the aim is to analyse how participants maintain continuity and handle discontinuities in institutionally arranged, computer-mediated communication. The empirical material consists of chat log files from in-service training courses for professionals in the food production industry. In the chat sessions we analysed, participants initially had some problems in co-ordinating their postings, that (...) is, keeping track of the discussion’s threading.We also found, however, that methods for co-ordinating postings rather quickly were established among the participants. Two methods for making recognizable how postings were to be read were common in the material: 1) the use of personal names to address a specific participant, and 2) recycling part of the content of a previous posting or reformulating the content in the posting addressed in recognizable ways. We also found an emerging norm in their interaction: that of waiting for one’s turn. (shrink)

There has been increasing interest in the relevance of virtue approaches to ethics over the past 15 years. However, debate surrounding the virtue approach in the business, management and organisational studies literature has lacked progress. First, this literature focuses on a narrow range of philosophers, and, second, it has failed to analyse properly the consequences of virtue theory for action in practical settings other than in abstract terms. In order to begin addressing these issues, this paper compares what two virtue (...) frameworks—one focused on virtue in the context of community and the other on individuals as virtuous agents—lead to when evaluating the actions of parties to the 2002–2004 UK Fire Service dispute. The analysis argues that the virtue frameworks proposed by MacIntyre and Slote offer different but complimentary evaluations. Both not only point to potential problems with industrial disputes, but also recognise the legitimacy of action that is based in good motivations and carried out with regard for the virtues. It seems that fire fighters and their immediate supervisors, on the whole, met the conditions of virtue, but that it is open to question if the leaders of the Fire Brigades Union and the Government did the same. The analysis goes on to suggest which modes of negotiation would be acceptable under the virtue frameworks, and the implications for those involved in industrial dispute. (shrink)

There are three main types of number used in modern, industrialized societies. Cardinals count sets (e.g., people, objects) and quantify elements of conventional scales (e.g., money, distance), ordinals index positions in ordered sequences (e.g., years, pages), and nominals serve as unique identifiers (e.g., telephone numbers, player numbers). Many studies that have cited number frequencies in support of claims about numerical cognition and mathematical cognition hinge on the assumption that most numbers analyzed are cardinal. This paper is the first to investigate (...) the relative frequencies of different number types, presenting a corpus analysis of morphologically unmarked numbers (not, e.g., “eighth” or “21st”) in which we manually annotated 3,600 concordances in the Corpus of Contemporary American English. Overall, cardinals are dominant—both pure cardinals (sets) and measurements (scales)—except in the range 1,000–10,000, which is dominated by ordinal years, like 1996 and 2004. Ordinals occur less often overall, and nominals even less so. Only for cardinals do round numbers, associated with approximation, dominate overall and increase with magnitude. In comparison with other registers, academic writing contains a lower proportion of measurements as well as a higher proportion of ordinals and, to some extent, nominals. In writing, pure cardinals and measurements are usually represented as number words, but measurements—especially larger, unround ones—are more likely to be numerals. Ordinals and nominals are mostly represented as numerals. Altogether, this paper reveals how numbers are used in American English, establishing an initial baseline for any analyses of number frequencies and shedding new light on the cognitive and psychological study of number. A metaphysics of the world described by contemporary science faces the problem of the relative ontological status of microphysical constituents (e.g. elementary particles), ultimate mathematical structures (e.g. of the Standard Model and General Relativity), and complex macroscopic systems with their arguably emergent properties. Justus Buchler's ordinal metaphysics, which provides a "view from anywhere" by analyzing whatever is under consideration through its location in an order of relationships, refusing to privilege any type of being, contributes a fresh perspective to this discussion. While Buchler's metaphysics of natural complexes might seem too pluralistic to be compatible with physicalism—since the latter grants metaphysical priority to the physical and to science's claims about it—a physicalist account can be conceived inside his ordinal metaphysics. Like the Aristotelian "metaphysics of the middle," such an approach avoids both the Democritean metaphysics of Simples and the Platonist metaphysics of the Whole. In so doing it provides special resources for conceiving the status of wholes and components commonly disputed by reductionists and emergentists, e.g. complex material systems, organisms, and minds. Out-of-court proceedings or alternative dispute resolution (ADR) is a peaceful, voluntary alternative method for settling disputes without litigation in the court. ADR institutions usually use a third party to help the consumer and the trader to reach a solution. The main purpose of this article is to share the main insights and experience about the out-of-court proceedings in various countries and European Union Member States, to discuss the most important problems concerning ADR and propose possible solutions of these problems. (...) First of all, in this article, ADR is presented and its main advantages are outlined. For example, ADR institutions are indeed a low-cost and quick alternative for consumers for settling disputes with businesses. ADR mechanisms are highly diverse. There are public and private institutions as well as institutions established on the basis of cooperation between the public sector and the industry or consumer organizations and the industry. Although there is a high correlation between the nature of the institution and the funding, i.e. private institutions are usually financed by the industry and public institutions by public funds, ADR bodies established by public law can also be financed by the industry (especially in highly regulated markets). In the majority of the institutions, the participation of the industry in the ADR procedure is voluntary. (shrink)

The late twentieth and early twenty-first centuries have seen the rise of a new phenomenon - online ordination. It can be accepted that much of this burgeoning industry is a financial scam, but is that the whole story? The very existence of online ordination raises questions. Why do people feel the need for a “minister” to officiate at weddings? If they are sufficiently estranged from the religious sphere that no bona fide minister of religion will marry them, and if secular (...) alternatives are readily available, why make use of this service? This article presents an overview and typology of online ordination services and places them in the context of the development of religion in contemporary society, and the development of society itself. Freedom of association for trade union has been generally accepted as part of basic human rights in Islam. Freedom of association, which include the right to join and participate in trade union activities, can be susceptible to disputes between employers and employees as well as trade unions. Islam provides freedom of association in labour relations and also mechanisms to settle disputes pertaining to such freedom. Conciliation (sulh) and arbitration (tahkim) are both used methods in the inception of Islam, (...) which have similarities with the modern sense. We shall discuss in this article the right to dispute resolution between employers and trade unions in the context of freedom of association in labour relations as based on Shari’ah law and using modern legal systems of Islamic countries such as Iran, Malaysia and Saudi Arabia as examples. This article explores the concept of cultural competence and its relevance as an organizational resource in ethical disputes. Empirically, we aim to reveal the cultural competences that a global forest industry company, StoraEnso, and a global environmental nongovernmental organization (NGO), Greenpeace, utilized in forestry conflicts during 1985–2001. Our study is based on data which were collected from corporate and NGO communication outlets and which have gone through a detailed discourse-semiotic analysis. Our reinterpretation of the discourses identified three cultural competences: (...) (1) the ability to understand changing consumer preferences and values, (2) the ability to utilize culturally determined positions of expertise, and (3) the ability to maintain trust and credibility in the community through open communicative practices. We argue that these competences are relevant in industry–NGO disputes for both parties. However, maintaining them all simultaneously is a difficult task, since various discourses which aim at upholding them can sometimes have contradictory effects. (shrink)

The term “industrial action” includes any noncooperation with management, such as strict “working to rule,” refusal of certain duties, going slow, and ultimately withdrawal of labor. The latter form of action, striking, has posed particular problems for professional ethics, especially in those professions that provide healthcare, because of the potential impact on patients' well-being. Examination of the issues, however, displays a difference in response between the healthcare professions, in particular between doctors and nurses. In considering the ethics of (...) class='Hi'>industrial (especially strike) action there are various aspects of professional ethics to consider: (1) whether there is a tension between industrial action and the very notion of professional ethics; (2) what specific issues arise in the case of healthcare professions; (3) what, if anything, can explain and/or justify different responses from the medical and nursing professions? The dynamic nature and increasing complexity of the construction industry have led to increased conflicts in construction projects. An accurate prediction of the outcome of a dispute resolution in courts could effectively reduce the number of disputes that would otherwise conclude by spending more money through litigation. This study aims to introduce a two-layered fuzzy logic model for predicting court decisions in construction contract disputes. 100 cases of construction contract disputes are selected from the courts of Iran. (...) A questionnaire survey is then conducted to extract a set of fuzzy rules for identifying important decision parameters and expert knowledge. Accordingly, a two-layered fuzzy logic-based decision-making architecture is proposed for the prediction model. Furthermore, the fuzzy system is trained based on 10-fold cross-validation. Analysis of results indicates that 51 out of the 100 cases are filed after the dissolution and termination of the contract show a significant impact of these clauses as the root cause in construction contract disputes. Our results present a proposed hierarchical fuzzy system that can correctly predict nearly 60% of the test data. Also, we demonstrate a methodology of using argument before ML to establish interpretable AI models. Based on our findings, a fuzzy model with a hierarchical structure may be used as a simple and efficient method for predicting court decisions in construction contract disputes. (shrink)

In keeping with the focus of this special section, we concentrate initially on some of the problems of autonomist Marxist concepts such as `immaterial labour', `affective labour' and `precarity' for understanding work in the cultural industries. We then briefly review some relevant media theory (John Thompson's notion of mediated quasi-interaction) and some key recent sociological research on cultural labour (especially work by Andrew Ross and Laura Grindstaff, the latter drawing on Hochschild's concept of emotional labour), which we believe may be (...) more useful than autonomist concepts in developing empirically informed critique. The main body of the article then consists of an ethnographic account of working on one particular television programme, an account that aims to build on these theoretical debates. We analyse how the power to provide exposure or not to individuals in the talent show genre in contemporary television (a feature that derives from the symbolic power of producers to make texts that are then circulated to massive numbers of people) and disputes between commissioners and independent producers about how best to go about doing so (an organizational issue) are registered in the form of stress, anxiety and sometimes poor working relations among project teams of young television researchers (a matter of working conditions and experiences). We especially focus on how additional pressures are borne by these workers because of the requirements to undertake emotional labour, involving the handling of strong emotions on the part of talent show contributors, and to maintain good working relations in short-term project work, requirements generated by the need to ensure future employment. Ultimately, then, we support the view that creative work is `precarious' — but we go beyond the generalizations involved in concepts such as immaterial labour and affective labour to show the specific ways in which precariousness is registered and negotiated in the lives of young workers in one industry. Globally active companies are involved in the discursive construction of moral legitimacy. Establishing normative conformance is problematic given the plurality of norms and values worldwide, and is particularly difficult for companies operating in morally controversial industries. In this paper, we investigate how organizations publicly legitimize the trade of human tissue for private profit when this practice runs counter to deep-seated and widespread moral beliefs. To do so, we use inductive, qualitative methods to analyze the website discourse of three types of (...) organizations that trade in human tissue and are associated with different degrees of moral controversy with respect to tissue procurement and use. Our analysis reveals an object-oriented approach to moral legitimizing centered on the human tissue as a morally disputed good. We find that the website discourse translates human tissue into technology, constructs normative meaning around a dominant instrumental value associated with human-tissue-as-technology, and reproduces and stabilizes this meaning by six discursive mechanisms that amplify and anchor it. Moreover, the use of amplifying and anchoring discourse was greater in organizations associated with greater controversy. The results are consistent with an object-oriented sociality. (shrink)

In contemporary societies there is a continuous process of creation and destruction of ethics. Shared norms are fuzzy, as actors tend to share core principles but interpret them differently. In this paper we analyse three cases of ethical dispute in the agri-food sector by employing the distinction between matters of fact and matters of concern proposed by Bruno Latour. We further suggest that ethics in the agri-food industry should be considered in relation to collective goals such as sustainability and social (...) justice. To expand the role of ethics it is necessary to broaden the view on who is responsible and how for the manifold challenges faced in food production, distribution and consumption. We contend that reflections on the relationship between ethics and sustainability must go beyond an anthropocentric approach and also consider the welfare of non-human nature. Our study suggests that the boundary between politics and ethics is fluid and governing institutions have a role to play in ethicisation of food systems along with industry and civil society. Any resolution of matters of concern is neither innocent, nor impartial. Ethical responses to food system challenges are rather to be established through dialogue and alignment of ethical practices. International differences in how market exchanges are conducted (e.g., the mode of entry, level of ownership, and conflict resolution) have been attributed mainly to national culture and cultural distance. However, the cultural arguments cannot explain why economies/countries with similar cultural backgrounds (e.g., Hong Kong and China) exhibit differences in exchange arrangements. Thus, the cultural arguments provide little strategic guidance to multinational corporations (MNCs) in international marketing. We propose that in addition to culture, the governance environment in a country, namely, the (...) political, economic, and social institutions that facilitate or constrain the choice of governance mechanisms, influences the way organizations conduct market exchanges. This important factor heretofore has been ignored. Specifically, we introduce a typology of rule-based and relation-based governance environment to explain how the environment affects marketing channel behaviors, such as barriers to entry, channel exclusivity, information access, trust, and dispute resolution. We analyze the diamond industry in the rule-based governance environment in the U.S. and in the relation-based governance environment in China, and using the diamond industry in Hong Kong as a validation, to develop theoretical propositions and strategic implications for MNCs. Despite being a common phenomenon with significant consequences on our everyday life, strikes (and direct actions in general) are still relatively undertheorized in the philosophical literature. Our paper has a specific focus that is best encapsulated in a question: What is the relationship between liberalism and the right to strike? Liberalism’s cornerstone is the idea that rights and liberties of individuals are of supreme political importance. Rights and liberties, however, are not created equal. The basic liberties are those that are (...) so politically important that legal restrictions upon them are unjustified unless to protect other basic liberties within an overall scheme of liberties, such as under a bill of rights. So, our question becomes: Is the right to strike a basic liberty? Two ongoing disputes are relevant here. The ‘older’ debate concerns the status of economic liberties and their relation to the right to strike. We will focus on a ‘newer’ discussion because it poses a challenge to liberalism itself. Namely, some ‘radical’ critics of liberalism (Gourevitch, Raekstad and Rossi) have argued that there are rights that involve coercing others, exercised during strikes or engagement in other direct action, that do not qualify as liberal basic liberties and that can sometimes take normative precedence over the liberal basic liberties. This criticism, if correct, defeats liberalism. Notice, though: since the weighing of different particular basic liberties against each other in an overall scheme of liberty is integral to high liberalism, the genuine threat that the radical critique poses stems not from the second conjunct (which its proponents have defended) but from its first (which they have merely assumed). For, if (contrary to what the radical work assumes) the right to engage in coercive strike action is a liberal basic liberty then it can, at least in principle, win out over other basic liberties, within an overall scheme of liberties, in situations of prima facie moral conflict. Raekstad and Rossi extend the radical critique, beyond the case of coercive strikes, to other forms of direct action (outside of industrial disputes) that have avowedly moral or political goals. These could include workplace occupations, street blockades, hacktivism, counter-economics, tax resistance and more. In the paper we argue that the ‘radicals’ are not entitled to the assumption that the right to strike is not a liberal basic liberty. Moreover, we suggest, high liberalism has the resources to accommodate not only a general right to engage in non-coercive strike action, but also the right to engage in some forms of coercive direct action, whether as part of an industrial dispute or not. More precisely, we show that liberalism has the resources to accommodate not only (i) a general right to engage in non-coercive strike action, but also (ii) the right to engage in some forms of coercive direct action, whether (iii) as part of an industrial dispute or (iv) not. This paper is sadly opportune. The general public is angry and bewildered if not hurt by the variety of strikes which are brought more or less forcibly to their attention. People used to understand what lay behind a strike - a demand for more pay, better conditions - but today a political element often intrudes, and it is this that worries those who ask themselves whether this or that dispute is either lawful or morally acceptable. Professor Dworkin, a lawyer, first (...) sets out the legal issues surrounding strikes and then advances the ethical arguments, closely relating them to the legal framework. The most interesting part of the paper, however, may well be that devoted to the moral obligation of example, in particular the example to be set by members of the medical profession and by all those caring for the sick. As public attitudes to industrial disputes `become dulled and quiescent' it is absolutely necessary that there should be a reappraisal of the moral standards of the past which coincide with a respect for the law. In the last century the term `anomie' was used to describe a `society which has shaken off its former restraints such as religion, respect for law and order and a definite moral code as to what is right and wrong'. We are living in that sort of society today, and one need not be a professional `ethicist' to recognize the signs, and hopefully, to work for the return of `ethical' values. (shrink)

In 2022’s “summer of discontent,” we’ve (...) seen our rail, maritime and transport workers, airport staff, bus drivers, telecommunications workers, postal workers, nurses, refuse workers, and higher and further education staff engage in ongoing industrial disputes with intractable bosses. Even criminal barristers continue with an indefinite, uninterrupted strike after years of government cuts and chronic underinvestment. Everywhere you look, there is a palpable sense of a country on its knees. It’s nearly 100 years since the last General Strike of 1926 and in the UK it’s looking increasingly likely that we will have another General Strike on our hands soon. In “Two Cheers for Blueprints, or, Negative Reasons for Positive Utopianism” Antonis Balasopoulos contextualizes this within the longer economic durée of the shift from Fordist production to so-called flexible accumulation after 1972, writing in this issue that “the turn of capital to the faster and higher [End Page 554] profits involved in financialization rather than infrastructural and industrial investment, form much of the objective, structural ground for what can only be described as the rapid rise of a dystopian structure of feeling in western societies since the early 1970s.” Antonis’s brilliant summary reminds us of the monumental scale of the challenges facing utopian thought and praxis in our current moment. Make no mistake—the “crisis ordinariness” of everyday life under late capitalism that Lauren Berlant identified in Cruel Optimism (2011) has intensified in the years following the Global Financial Crisis (2007–8), the wave of Occupy protests in 2011, and, more recently, the COVID-19 pandemic (2020–). “For some time now,” as Antonis writes, the utopian goals of “happiness, fulfilment, [and] emancipation... have been out of the question altogether.”It’s hard not to agree with this assessment, given the current chaos of life in the UK. Adam Stock’s roundtable contribution “Funding Utopia: Utopian Studies and the Discourse of Academic Excellence” focuses on the academy’s complicity with the neoliberal financialization of what were previously protected as public goods (education, our health service, transport infrastructure, and so on) over the past three decades. As Adam notes, the rhetoric of “excellence” that has come to dominate all areas of university life—teaching, research, public engagement, and the quantifiable “impact” of university research beyond the academy—is really just another way of using competition to mask the market logic of scarcity. Swingeing cuts to publicly funded research have led to a scarcity of resources in scholarly knowledge production, which is legitimated through the discourse of “excellence” and “prestige.” Only a handful of elite research leaders are granted awards and the value of all research becomes judged by its proximity to this distribution (concentration) of wealth within a small number of institutions. Defending education as a public good has long given way to the desperate, existential struggle for survival at UK universities. Numerous institutions are on the brink of bankruptcy, which was the goal all along for the ideologically driven Office for Students (OfS). Market exit, as they euphemistically term it, proves market efficiency.At my own institution, Birkbeck, University of London, the challenge to utopian thinking is all too violently clear. Birkbeck has a special place in the UK higher education system—a university founded nearly 200 years ago in the Crown and Anchor Tavern on the Strand (it was called the London Mechanics’ Institution back then) to offer education to working-class Londoners that [End Page 555] fitted around their busy working lives. As my colleague Joanna Bourke writes in Birkbeck: 200 Years of Radical Learning for Working People (2022), life expectancy in the poorest parts of London was just twenty-nine years; cholera, typhoid, and typhus were major killers; and illiteracy was widespread. This article analyses the beginning, continuation, and demise of The Great Trough, contrasting a supply-and-demand framework derived from economic theory with a power-sensitive approach focusing on long-term positive-sum conflicts involving major interest and reflected in unemployment, inflation, industrial disputes, and the functional distribution of national income. Many in the informal logic tradition distinguish convergent from linked argument structure. The pragma-dialectical tradition distinguishes multiple from co-ordinatively compound argumentation. Although these two distinctions may appear to coincide, constituting only a terminological difference, we argue that they are distinct, indeed expressing different disciplinary perspectives on argumentation. From a logical point of view, where the primary evaluative issue concerns sufficient strength of support, the unit of analysis is the individual argument, the particular premises put forward to support a given conclusion. (...) Structure is internal to this unit. From a dialectical point of view, where the focus concerns how well a critical discussion comes to a reasoned conclusion of some disputed question, the argumentation need not constitute a single unit of argument. The unit of dialectical analysis will be the entire argumentation made up of these several arguments. The multiple/co-ordinatively compound distinction is dialectical, while the linked/convergent distinction is logical. Keeping these two pairs of distinctions separate allows us to see certain attempts to characterize convergent versus linked arguments as rather characterizing multiple versus co-ordinatively compound arguments, in particular attempts of Thomas, Nolt, and Yanal, and to resolve straightforwardly conflicts, tensions, or anomalies in their accounts. Walton's preferred Suspension/Insufficient Proof test to identify linked argument structure correctly identifies co-ordinatively compound structure. His objection to using the concept of relevance to explicate the distinction between linked and convergent structure within co-ordinatively compound argumentation can be met through explicating relevance in terms of inference licenses. His counterexample to the Suspension/No Support test for identifying linked structure which this approach supports can itself be straightforwardly dealt with when the test is explicated through inference licenses. In the current era, governments are playing smaller roles in regulating workers’ rights internationally, and transnational corporations (TNCs), non-governmental organisations (NGOs) involved in the struggle for workers’ rights, and labour/trade unions have started to fill this governance gap. This paper focuses on the least researched of the relationships among these three actors, the union–NGO relationship, by analysing the ways in which it affects definitions of TNC responsibility for workers’ rights at their suppliers’ factories. Based on a qualitative study of the (...) union–NGO relationship in the Swedish garment industry between 1996 and 2005, we propose that there are six main configurations of union–NGO relationships. By linking these configurations to their effects on TNC responsibility, we propose that co-ordination relationships between unions and NGOs, particularly high-commitment co-ordination relationships, are likely to result in a broadening of the definition of TNC responsibility, while conflictual relationships, both high and low commitment, result in a narrowing of the definition of TNC responsibility. The study indicates that co-operation is generally more beneficial for both unions and NGOs than is any form of conflictual relationship, in terms of broadening the definition of TNC responsibility. Disputes regarding the ethics of work by children have intensified in recent years, with little resolution. The impasses stem from failure to recognize the diverse forms of child work and a lack of empirical research regarding its causes and consequences. We report on data gathered in Brazil’s export-oriented shoe industry, which is notorious for the employment of children. Central findings are: 1) the causes of child work have less to do with backwardness and more to do with how shoe (...) workers are integrated into the global order; 2) local employers and children regard this work as benign, but the U.S. government sees it as hazardous to children and unfair to U.S. producers; 3) efforts to remove children from the shoe industry have been frustrated by local resistance and raise ethical questions; and 4) in certain circumstances, efforts to eliminate hazards from the workplace are morally superior to campaigns to remove childworkers from employment. Measurement practices are central to most sciences. In the human sciences, however, it remains controversial whether the measurement of human attributes—depression, happiness, intelligence, etc.—has been successful. Are, say, widely used depression questionnaires valid measuring instruments? Can we trust self-reported happiness scales to deliver quantitative measurements as it is sometimes claimed? These and related questions are till today hotly disputed. There are two main frameworks under which human measurements are studied and criticized. One is the so-called construct validity framework. Here, criticisms (...) to human measurements are typically of the form “this instrument is not valid: it does not actually measure the attribute we set out to measure”. The second framework is the standard typology of measurement scales (nominal, ordinal, interval, and ratio). Human measurements are commonly challenged for being merely ordinal—not quantitative: interval or ratio—despite the fact that many researchers use measurement results as if they were quantitative. The first part of the dissertation studies how adequate these frameworks are for evaluating measuring instruments and the inferences they afford. Regarding the concept of validity, it is commonly understood unconditionally, that is, without restricting validity judgments about measuring instruments to context-specific situations. Instruments are said to be (in)valid simpliciter. In Chapter 2, I argue against this conception of validity and in favor of a contextual one. Regarding the second main framework, the standard typology of scales is typically linked to a set of prescriptions regarding (un)justified measurement inferences. I call this classification-cum-prescriptions the “received view” on measurement scales. In chapters 3 and 4, I question the idea that the received view is an impeccable guide for clarifying the kinds of inferences we are licensed to make from measurement results in human science contexts. I motivate general doubts about the adequacy of the received view in Chapter 3, and I articulate these doubts in detail for the specific case of average group comparisons in Chapter 4. The upshot of this first part of the dissertation is a deeper awareness of the complexity surrounding which inferences can legitimately be made from measuring instruments. The first part of the dissertation is largely framed under the assumption that some human attributes are indeed quantitative, even if they are not currently being measured quantitatively. The second part addresses two important issues raised by that assumption. Chapter 5 tackles the so-called “quantity objection”: that human science attributes are themselves not quantitative, thus they cannot be quantitatively measured. This objection has been deployed to argue against optimistic positions regarding human quantification. I argue that the quantity objection is not successful in this sense—it begs the question to these optimistic human scientists that, just like their colleagues in the physical sciences have done, postulate theoretical quantitative attributes as working hypotheses. But what does treating human attributes quantitatively as working hypotheses amount to? And what are, or can be, “amounts” of depression, happiness, etc.? Chapter 6 argues that there is not one but various approaches for quantitatively conceiving of human attributes, each with its own success conditions. This chapter offers a conceptual framework for making progress on debates about controversial human measurements. (shrink)

To fight climate change, firms must adopt effective and feasible carbon management practices that promote collaboration within supply chains. Engaging suppliers and customers on carbon management reduces vulnerability to climate-related risks and increases resilience and adaptability in supply chains. Therefore, it is important to understand the motives and preconditions for pursuing supply chain engagement from companies that actively engage with supply chain members in carbon management. In this study, a relational view is applied to operationalize the supply chain engagement concept (...) to reflect the different levels of supplier and customer engagement. Based on a sample of 345 companies from the Carbon Disclosure Project’s supply chain program, the determinants of engagement were hypothesized and tested using multinomial and ordinal logistic estimation methods. The results indicate that companies that integrate climate change into their strategies and are involved in developing environmental public policy are driven by moral motives to engage their suppliers and customers in carbon management. All these factors make a stronger impact on supplier engagement than on customer engagement. Moreover, companies operating in greenhouse gas-intensive industries are driven by instrumental motives to engage their suppliers and customers because increasing greenhouse gas intensity positively influences engagement level. Company profitability appears to increase supplier engagement, but not customer engagement. Interestingly, operating in a country with stringent environmental regulations does not appear to influence supply chain engagement. By utilizing relational capabilities and collaboration, buyers can increase their suppliers’ engagement to disclose emissions, which ultimately will lead to better results in carbon management. This essay concerns the relationship between the image of the book and how it reads. It begins from the observation that only the change of the readers during the humanistic age has transformed the widespread perception of the book in the Middle Ages. The new layout of the page, neater and more readable, became well established in the following centuries, and that image of the book in the modern publishing industry has remained unchanged, in spite of innovations. New digital technologies have proposed a new image, that however is neither clearly defined nor well established. The essay underlines the observations of those who believe that the hypertext form is the new book, even readable on the old pc, and the observations of those that think of e-book as a new image, that can be read only on the e-reader. Holography exploded on the scientific world in 1964, but its slow fuse had been burning much longer. Over the next four decades, the echoes of that explosion reached scientists, engineers, artists and popular culture. Emerging from classified military research, holography evolved to represent the power of post-war physics, an aesthetic union of art and science, the countercultural meanderings of holism, a cottage industry for waves of would-be entrepreneurs and a fertile plot device for science fiction. New working cultures sprang up (...) to mutate holography, redefining its products, reshaping its audiences and reconceiving its applications. The outcomes included ever more sublime holograms and exquisitely sensitive measuring techniques - but also priority disputes, prurience and poisonous business rivalries. New subjects cross intellectual borders, and so do their explanations. This book draws on the history and philosophy of science and technology, social studies, politics and cultural history to trace the trajectory of holography. The result is an in-depth account of how new science emerges. This article addresses the growing industry of retail socially responsible investment (SRI) profiled mutual funds. Very few previous studies have examined the final consumer of SRI profiled mutual funds. Therefore, the purpose of this study was to, in an exploratory manner, examine the impact of a number of pro-social, financial performance, and socio-demographic variables on SRI behavior in order to explain why investors choose to invest different proportions of their investment portfolio in SRI profiled funds. An ordinal logistic regression analysis (...) on 528 private investors revealed that two of the three pro-social variables had a positive impact on how much the consumer invested in SRI profiled funds. Moreover, there was proof of a non-altruistic motive for investing in SRI as consumers who perceive that financial return of SRI is equal or better than "regular" mutual funds, invested a greater proportion of their portfolio in SRI profiled mutual funds. Furthermore, the results showed that women and better-educated investors were more likely to invest a greater proportion of their investment portfolio in SRI. Overall, the findings indicate that both financial perceptions and pro-social attitudes are connected to consumer investment in SRI. (shrink)

In few other areas of bioethical inquiry exists as close a connection between bioethical professional advice and policy development as is the case with HIV and AIDS. Historically, the reasons for this have much to do with one of the groups initially affected most severely by HIV and AIDS, namely well-educated middle-class gay men in developed countries. This particular group of people, highly sophisticated and used to political activism in its pursuit of civil rights-related objectives, engaged the medical profession as (...) well as regulatory agencies such as the US Food and Drug Administration, and legislators (more so in the USA than in other countries) in a number of bioethically interesting policy areas. Many of the controversies of the times were framed as civil rights and/or ethical disputes. The initial areas of concern and inquiry focused on: informed consent to HIV testing and trial participation, the confidentiality of HIV test results, access to trials as a means of access to experimental drugs, the length of time it took to get an experimental drug to the market approval stage, and end-of-life decision-making. This line-up of issues explains why AIDS has become such an interesting topic for bioethicists. Bioethicists concerned about the traditional breadand- butter themes of medical ethics themes of the doctor - patient relationship (e.g., Daniels, 1991; Boyd, 1992), as well as bioethicists more concerned about policy and regulatory issues in the drug research and approval process (e.g., Edgar & Rothman, 1990; Salisbury & Schechter, 1990), found research topics worthy of vigorous pursuit. No surprise, then, that HIV/AIDS led to a probably unprecedented number of books and articles in professional journals (Manuel et al., 1990). HIV/AIDS has become a permanent fixture in all major mainstream bioethics textbooks (e.g., Kuhse & Singer, 1998; Arras & Steinbock, 1999). Reference series in medicine, ethics and law provide for dedicated volumes on AIDS.1 Even specialist bioethics textbooks, for instance those directed at dentistry students, carry chapters on HIV/AIDS (Ozar & Sokol, 2002). 128 Udo Schuklenk AIDS, designated by the medical profession a pandemic lives up to its classification. It did not stop at the borders of developed countries. As one would expect of a primarily sexually transmitted illness in the age of globalisation, it spread rapidly across the globe. Indeed, in many countries it has become one of the main causes of death, as in sub- Saharan Africa (Shisana & Simbayi, 2002). Dramatic increases in the number of AIDS cases are predicted for many Eastern European countries as well as for the two most populous nations on earth, India and China. Some of the HIV/AIDS-related bioethical and policy issues of concern to developed countries remain the same for developing countries. However, in ethically important ways they are dwarfed by concerns over drug prices, intellectual property rights, and affordable access to essential AIDS drugs for the impoverished masses of infected people in such countries. Of increasing importance have become ethical issues pertaining to the ever-growing research industry associated with clinical trials undertaken in developing countries. Indeed, major funding initiatives both in the USA and UK have brought clinical research in developing countries into focus. Some have questioned whether this attention is appropriate, considering other bioethical problems of arguably greater importance to developing countries (Chadwick & Schuklenk, 2003). Standards of clinical care in a study, and after a trial has concluded, as well as community benefits and access to the trial regime after the trial’s conclusion remain contentious issues. It is worth noting that more often than not it was an AIDS-related trial or policy decision that led to a great deal of bioethical analysis, yet the issues discussed almost always have ramifications far beyond AIDS. For instance, decisions about the question of what (if any) standards of care failures in preventive trials (of HIV vaccines or microbicides) ought to receive have important implications for non-AIDS prevention trials. Many governments and corporations have embraced information disclosure as an alternative to conventional environmental and public health regulation. Public policy research on transparency has examined the effects of particular disclosure policies, but there is limited research on how the construction of disclosure policies relates to social movements, or how transparency and ignorance are related. As a first step toward filling this theoretical gap, this study seeks to conceptualize disclosure conflicts, the social processes through which secrecy is challenged, defended, and mobilized (...) in public technoscientific controversies. In the case of shale oil and gas development in the United States, activists and policy makers have demanded information about the contents of fluids used in the extraction process and the routes of oil shipments by rail. Drilling and railroad companies have resisted both demands. Studies of such disputes reveal the dynamic and conflictual nature of information disclosure. In both cases, disclosure conflicts unfold dynamically over time, reflecting power disparities between industry groups and their challengers and requiring coalitions of activists to pursue multiple tactics. When a disclosure policy is established, it does not resolve social conflict but shifts the focus of struggle to the design of information systems, the quality of disclosed data, and the knowledge gaps that are now illuminated. Economists have long treated technological phenomena as events transpiring inside a black box and, on the whole, have adhered rather strictly to a self-imposed ordinance not to inquire too seriously into what transpires inside that box. The purpose of Professor Rosenberg's work is to break open and examine the contents of the black box. In so doing, a number of important economic problems be powerfully illuminated. The author clearly shows how specific features of individual technologies have shaped a number (...) of variables of great concern to economists: the rate of productivity improvement, the nature of learning processes underlying technological change itself, the speed of technology transfer, and the effectiveness of government policies that are intended to influence technologies in particular ways. The separate chapters of this book reflect a primary concern with some of the distinctive aspects of industrial technologies in the twentieth century, such as the increasing reliance upon science, but also the considerable subtlety and complexity of the dialectic between science and technology. Other concerns include the rapid growth in the development of costs associated with new technologies as well as the difficulty of predicting the eventual performance characteristics of newly emerging technologies. At several places in this paper we have made use of a well-known rhetorical device: an argument was made; a character —dubbed “fictional reader” — was then evoked who voiced some objections against that particular argument; and finally, we answered those objections, thus bringing to a close, at least temporarily, our argument. The use of this device raises a question: “How is the presence of the ‘fictional reader” to be understood?” Is it a “mere” rhetorical tool, or does this character (...) designate some particular target? For instance, depending on the context, it could be seen as aimed at different straw men: traditionally minded sociologists, Whiggish historians, well-intentioned philosophers of science. Actually, none of these characters is behind the “fictional reader”. Rather, it refers, potentially, to any of the scientific actors (Milstein, Schwaber, Koprowski, Cohn, and so on) who inhabit our set of narratives. In other words, the “fictional reader” is an icon for the “native” reader/writer who simultaneously produces and questions the products of that particular literary activity known as scientific texts, by explicitly and implicitly raising the issue of the distinction between fact and technique.By following actors in their disputes about the novelty of K & M's contribution, it became apparent that it is not exactly clear which of the different elements of “hybridoma technology” should be regarded as “novel.” Was it the use of the P3 myeloma line? Was it the theoretical framework related to the notion of allelic exclusion? Was it ...? In each and every case, arguments can be made for or against the existence of a certain continuity or discontinuity with previous work. And in each case, the determination of novelty, as translated through the continuity/discontinuity issue, appeared to be hanging on the previous attribution of an epistemological status to the object that had allegedly been discovered: was it a fact or a technique?If one focuses on the relatively narrow network of immunogenetics, it could be argued that within that particular evidential context a series of “facts” had been established which, when transferred to other fields, such as the virological research being pursued in Koprowski's institute, were translated into a technique. However, as we have seen, even from an immunogenetic point of view the production of monoclonal antibodies can be viewed as being simultaneously a fact and a technique to establish that fact. Not only, as he himself noted,139 was Milstein not seeking to develop a technique for the production of monoclonal antibodies when the original experiments were carried out, but the significance later imputed to those experiments was not immediately attributed to them. The paper was seen as one among other papers that used cell fusion techniques to dissect the genetic control of antibody diversity. Distinctions that now appear crucial (e.g.: were the fusion partners two myelomas or a myeloma and a spleen cell?) were easily overlooked. At some point, around 1977, the production of monoclonal antibodies became a goal in itself, no longer linked to the initial immunogenetic network. The transformation of [MILSTEIN 75] into the foundational event of “hybridoma technology” was thus achieved. This transformation did not flow naturally from the original experiments. Rather, it involved specific investments which mobilized the activity of a large number of other scientific and industrial actors.140A tentative generalization can be deduced from our case study. The dichotomy between fact and technique that underlines much of contemporary science studies seem to be fundamentally misconceived, insofar as the determination of what counts as a fact and what counts as a technique is not possible on a priori grounds. Historians and sociologists of science are confronted with a field of heterogeneous interventions where particular pieces of work are constituted as discrete entities and simultaneously attributed a technical or a factual identity. “Novelty” and “innovation” are precisely the result of such polymorphic attributional processes. Environmental politics needs more than piecemeal institutional efforts and more than calls for a set of 'new' values. It needs a realistic, comprehensive, and effective policy programme. Such a programme can be derived from a conjunction of Hardin's work on the 'tragedy of the commons' and Beck's analysis of the 'risk society', and involves exploiting the possibilities for the internalisation of risk provided by the insurance and reinsurance industries. Such exploitation requires tailored changes to the politico-legal environment, enforcing strict liability (...) for the production of risk, permitting any and all agents adversely effected by such negative externalities to initiate action for damages. The aim is not to clog up social and economic life with endless legal disputation, but through such a threat to ensure that environmentally significant investment and productive strategies are actively constrained by actuarially calculated strategies for risk internalisation. Elite U.S.-based global law firms concentrate in the costliest districts of superstar cities, especially two neighborhoods in Manhattan. This pattern has persisted despite both the dispersal of Biglaw clients across less-dense, lower-cost U.S. geographies and the development of telework capacity. It suggests a puzzle: law is among the occupations most conducive to remote work, yet Biglaw prior to the coronavirus pandemic required in-person work in the priciest places—meaning it paid a premium on both of its biggest expenses, wages and real (...) estate. How might this equilibrium be explained, and what might lead it to change? This Article contends that Biglaw clustering reflects a management preference for the exploitation of proven strategies over the exploration of novel and uncertain ones—but that the pandemic telework experience is eroding this dichotomy. This analysis has direct implications for private international law practice, where large-scale transactions and disputes are handled by Biglaw firms and involve significant international travel. This Article contributes to a growing literature on telework’s impacts on cities, labor markets, and industries, and is the first to extend that focus to Biglaw and PIL. A post-pandemic Biglaw embrace of dispersal via telework would destabilize standard accounts of collaboration in agglomeration economies. While the Article expresses skepticism about that outcome, it identifies a mechanism by which it might plausibly come about. Crucially, this mechanism—the replacement of an exploit vs. explore choice with two different exploit options—posits as the key driver not technology but management learning and innovation that quickened during the pandemic. Whether or not capitalism is compatible with ethics is a long standing dispute. We take up an approach to virtue ethics inspired by Adam Smith and consider how market competition influences the virtues most associated with modern commercial society. Up to a point, competition nurtures and supports such virtues as prudence, temperance, civility, industriousness and honesty. But there are also various mechanisms by which competition can have deleterious effects on the institutions and incentives necessary for sustaining even these most commercially (...) friendly of virtues. It is often supposed that if competitive markets are good, more competition must always be better. However, in the long run competition enhancing policies that neglect the nurturing and support of the bourgeois virtues may undermine the continued flourishing of modern commercial society. (shrink)

Advancements in computing, instrumentation, robotics, digital imaging, and simulation modeling have changed science into a technology-driven institution. Government, industry, and society increasingly exert their influence over science, raising questions of values and objectivity. Este artigo destina-se a introduzir a conferência de Heisenberg "A doutrina goethiana e newtoniana das cores à luz da física moderna", proferida em 1941, cuja tradução é aqui publicada. Analisa-se primeiramente o projeto filosófico de uma ordenação da realidade, desenvolvido pelo físico no início da década de 1940, o qual subjaz à discussão sobre as doutrinas das cores em Goethe e Newton. No segundo momento, faz-se uma exposição de algumas das implicações filosóficas da teoria quântica, com ênfase na interpretação da (...) assim denominada escola de Copenhague. Por fim, procura-se mostrar como a querela entre Goethe e Newton é utilizada para defender as abstrações da física teórica dos ataques da assim denominada "física ariana" e, ao mesmo tempo, preservar o valor das considerações intuitivas de Goethe. This paper aims at exposing the Heisenberg's conference "The teachings of Goethe and Newton on colors in the light of modern physics", presented in 1941, whose translation is presented here. In the first place the paper analyzes the philosophical project of an ordination of the reality, developed by the physicist in the early 1940s and which is the basis for the discussion of the "Teachings of Goethe and Newton on colors". Secondly it exposes some philosophical implications of the quantum theory by emphasizing the point of view of the Copenhagen school. Finally, it shows how the dispute between Goethe and Newton is exploited to defend the abstractions of the theoretical physics against the attacks of the so called "German physicists" and, at the same time, to preserve the worth of the Goethe's intuitive analysis. By Sanitsuda Ekachai. Edited by Nick Wilgus. Bangkok: Post Books, 2001. 192 pp. Sanitsuda Ekachai, editorial columnist and features section editor of the Bangkok Post, writes this book in the Menckanian tradition of muckraking journalism. A collection of columns from the past decade, the book has an angry goal—the reform of a (...) corrupt Thai Buddhist sangha. Somehow, however, the author manages to accomplish the task without an angry or bitter tone. One suspects that this is because she has the goods. In thirty-six short features and twenty-one even shorter editorials, Ekachai paints a damning picture of a corrupt Theravada Buddhist sangha that has lost touch with both its religious tradition and its lay constituency.She presents overwhelming evidence of the corruption. She tells several well-publicized stories of sexual scandals involving bhikkhus and mentions a dozen more. She carefully tallies the possessions of rich bhikkhus and richer temples. She makes clear the unrepentant patriarchy of the authoritarian Buddhist hierarchy and reminds us of the un-Buddhist character of a sangha that will not allow the ordination of bhikkhunis. And she argues that the root cause of much of this drifting from Buddhist ideals is a buying into the consumerism that has gripped much of modern Thai culture.This last point—consumerism—is important. If the book has a theme—always a tall order for a collection of articles—it is the economic enslavement of Thai culture and the sangha to capitalistic values. Of course, the West is the culprit here. Since Thailand, strictly speaking, has never been colonialized, the West managed to corrupt Thailand (or Siam as some prefer) simply by being in the area. As one of Ekachai's key informants, Sulak Sivaraksha succinctly put it, "Siam is culturally and intellectually colonized because the country identifies itself closely with the West" (161). [End Page 181]A close second as a theme, however, is patriarchy. Patriarchy, not Buddhism, is the root of the gender imbalance in the sangha. The Buddha embraced (a bit reluctantly to be sure) the order of bhikkhunis and made it clear his reluctance was an upayic or strategic matter, not a question of the spiritual status of women. Women are as able as men when Enlightenment is the question. Patriarchy is also at the root of Thailand's shameful sex industry—one in thirty women in Thailand is a prostitute. The culture is at fault here, a culture that sees women as objects rather than persons.Sivaraksha ties consumerism and patriarchy together when he says, "In a consumer society, the seeking for endless sensory pleasures and possessions has become the ultimate quest while Buddhism teaches about letting go" (75). The combination of testosterone-blocking celibacy and baht- driven greed has been too much for the modern bhikkhus of Thailand.Not all bhikkhus, however. Ekachai's book rises above the level of pure muckraking through the simple expedient of offering hope. She tells a dozen or more stories of enlightened (small "e") bhikkhus who are taking steps at reform. By "ordaining" (and thereby protecting) endangered trees in a forest. By teaching the dhamma instead of occultism. By showing economic restraint in the face of runaway rapaciousness. These are inspiring stories of bhikkhus named Buddhadasa, Dhammapitika, Udompatanakorn, Kutajitto, Supajarawat,Visalo, and Kabilsingh. Hope is personalized in these reformers.Reading between the lines, one can imagine a response to Ekachai's overwhelming case: the traditional Thai sangha is organized to serve rural village folk. Although the traditional village still exists in Thailand, it is becoming an endangered species in the face of the urbanized juggernaut. The sangha simply hasn't discovered the keys to reaching a changed constituency. Reading between the lines, one suspects that the author would wholeheartedly agree with this defense. Only she wouldn't consider it a defense but a reason, and a well-known reason at that. Her rejoinder would be that the current leadership must know it is out of touch, but still refuses any move... This empirical study examines how practitioners from the organizational functions of human resources, occupational safety and occupational health services within a Finnish industrial organization view the challenges that production supervisors face in their daily work. The article presents a formative intervention, which focuses on supervisors’ changing work and how these organizational support functions could collaboratively serve supervisors better, especially in their task of promoting well-being at work. The article approaches this collective learning effort from the framework of the Cultural (...) Historical Activity Theory , by examining how crossfunctional collaboration evolves and the transitions through which it develops in an intervention process. The development of collaboration is analysed through a process of collective concept and tool formation by following a cross-meeting trajectory of specific annual clock episodes. An annual clock, a co-ordinating tool used in organizations to assist the yearly planning and management of specific operations, emerged in the intervention as the practitioners’ attempt to synchronize overlapping and inconsistent well-being related practices assigned to supervisors. The article presents a framework that can be applied in this kind of combined empirical analysis of tool development and the evolving collaboration. The analysis shows how the idea of the annual clock grew through multifaceted conceptualizations, in which it first had the status of a conceptual object, then a collaborative tool, and eventually a script for becoming a novel cross-functional practice. Simultaneously, the mode of interaction expanded from a function-based co-ordination to task-oriented co-operation, and finally to communication. (shrink)

Saichō 最澄, one of the most prominent of Japanese Buddhist innovators, is the renowned ninth-century founder of the Tendai School, the first Japanese Buddhist sect with its own system of temples and monasteries, ordinations, practices and philosophy. It was in the goal of founding and maintaining an authentic Buddhist monastic institution that, for better or worse, influenced his thinking, and structured his philosophy. Although Saichō’s identity as founder is beyond dispute, this accomplishment was initially made possible through what we might (...) call modes of self-displacement, essentially establishing his legitimacy as founder by tracing the origins of Tendai beyond himself to founders even more prominent in the minds of his contemporaries. It is through our participation in this initial displacement of Saichō that the meaning of his contributions to Japanese Buddhism will begin to unfold. (shrink)

Abstract:San Diego, California, is the eighth largest city in the United States and one of the least affordable cities in the world. Many people in San Diego experience significant ramifications from competition for space. Currently, the southern side of downtown San Diego is the hottest area for development in San Diego county. This article examines the redevelopment of Barrio Logan, a small Latino community that borders downtown San Diego. Barrio Logan is a part of San Diego's third oldest community. The (...) study interviewed ten planning board members who participated in redevelopment and rezoning processes and provided thematic data. In addition, ten U-T San Diego newspaper articles also provided data on a referendum initiated by the marine industry to repeal adopted zoning ordinances. The data are used to discuss the construction of personal, group, and institutional social reality that influenced the outcome of the redevelopment and rezoning processes. The successful Barrio Logan Redevelopment Project Area process was about both the restoration and the sociopolitical empowerment of the community. Due to that redevelopment process, Barrio Logan has begun to emerge as a vibrant, exciting community. A subsequent redevelopment effort, the Barrio Logan Community Plan Update (BLCPU), focused on instituting new zoning ordinances to address the incompatible land uses and toxins in Barrio Logan. Industry in the community has resisted these types of changes to the zoning ordinances for decades. This resistance culminated with a referendum that repealed the BLCPU, which had been passed by the San Diego City Council. The marine industry's central selling vision of jobs influenced a majority of San Diego City voters outside of Barrio Logan to reject the Plan 1A version of the BLCPU. The reasons for and ramifications of the rejection of Plan 1A are discussed and steps Barrio Logan and the other San Diego redevelopment districts could take to improve their chances of winning a future referendum election are recommended. Born in 1891 in Sardinia, Gramsci studied in Turin and in 1919 founded, together with Palmiro Togliatti, the Ordine Nuovo, a journal which tried to give expression to the aims of the council movement, which developed during those years in the industrial cities of northern Italy. In 1921 he was a founding member of the Italian Communist Party and, after the fall of the ultra‐leftist leadership headed by Bordiga, became in 1924 the Party's general secretary. Imprisoned by the Fascist (...) regime in 1926, he spent the rest of his life in jail. He was freed in 1937, a few days before his death. (shrink)
