How are we to understand advanced information technologies at a time where their use is becoming more and more widespread? To address this question, the author analyses the discourse of cooperative design. In doing this she draws on recent feminist thinking and her own experiences from a research project. She discusses the meaning of concepts such as experience, users, computers and politics in this discourse. She particularly stresses alternative ways of understanding the political nature of design and that multiple perspectives, (...) including descriptive and historical ones, are relevant to both developing the technology and to deepening our understanding of the politics of intervention in design. Scandals involving celebrities’ moral transgressions are common in both Western and Eastern cultures. Existing literature, however, has been primarily based on Western cultures. We examine differences between South Korea and the United States in consumers’ support for celebrities engaged in moral transgressions and for the brands they endorse. Across six studies, we find that Korean consumers show lower support for celebrities who engaged in moral transgressions. This effect occurs because Korean consumers have a stronger belief that an individual’s competence and (...) morality are interconnected. Thus, Korean consumers are less likely to separate their judgments of celebrities’ morality and competence in professional performance, thereby lowering support for the celebrities. Building on the proposed mechanism, we identify the moderating role of transgression relevance. When a moral transgression is relevant to the domain of the celebrity’s professional competence, the difference in celebrity support between the two countries is attenuated. This difference extends to the support for a brand endorsed by the celebrity transgressor when the brand retains the celebrity endorser, but not when the brand dismisses the endorser. (shrink)

In the contemporary intellectual scene, one prominent question is this, what made science and its success possible? One tempting strategy for dealing with this question as a philosopher of science is to use science (or more broadly, empirical inquiry) and its methods to investigate the nature of science and its success. This strategy is what used to be called naturalism. For a philosopher of science, it amounts to naturalizing her philosophical inquiry for understanding the nature of science and its success. (...) The project of naturalizing philosophy of science has not been without its own problems. Some of the concerns are as follows. Willphilosophy of science maintain its traditional normative character after going through the process of naturalization? If it does, what form(s) will its normative content take? Can that normative content be secured without appealing to methods other than those usually used in empirical inquiries? In this essay, I will call these issues collectively the problem of normativity. First of all, I’ll look into the two most representative attempts to naturalize philosophy of science, namely L. Laudan’s and R. Giere’s attempts, focusing on the views that could be taken as their answers to the questions constituting the problem of normativity. Then I’ll examine these views in the light of some prominent criticisms and potential problems, and argue that some of those views could be defended by developing one or other additional conceptual arsenals but still others need to be curbed down admitting the apparent weaknesses of their supporting arguments. This reevaluative process will give us a better idea about what have been achieved by the attempts to naturalize philosophy of science and what their limitations are. (shrink)

This paper presents its author's famous distinction between globalization, as the process or vehicle by which ideas, habits and worldviews travel from one culture to another and are transformed in the process, and mundialization, as the taking in of the outside world into our own lifeworlds, a process by which the ideas and customs of other cultures are transported into our homeworlds. In this process, what was once strange and unfamiliar is transformed into something comfortable and familiar. This is the (...) process that is generally known as cultural assimilation, and by virtue of which the boundaries of our individual homeworlds become constantly widened. Examining this phenomenon, which he calls the 'mundialization of home', leads the author to sketch the main features of a possible transcultural moral world. (shrink)

In this dissertation, I examine Socrates' defense of justice in Plato's Republic. I contend that recognizing the problematic character of Socrates' defense of justice in the Republic is a key to understanding his teaching regarding justice. In response to the request made by Glaucon and Adeimantus at the beginning of Book Two, Socrates tries to show, in the bulk of the Republic, that justice is intrinsically good and that it is better than injustice. In doing so, he relies especially on (...) the definition of the justice of the individual that he provides at the end of Book Four, i.e., allowing each of the parts of the soul to mind its own business. But this definition is paradoxical and appears to have little link with justice as ordinarily understood. It contrasts with the more commonsensical definitions of justice offered in Book One, e.g., that justice is giving to each what is owed and telling the truth. In Book Five through Book Ten, Socrates continues his defense of justice by equating the just man and the philosopher--indeed, by making clear that the philosopher is just more or less in the sense outlined in Book Four. But Socrates implicitly points to the problematic character of the equation of the just man and the philosopher by revealing, among other things, that the philosophers must be compelled to rule in the best regime even though it would be a matter of justice for them to rule willingly. I attempt to comprehend why Socrates provides such a problematic defense of the justice of the individual in the Republic. So too, I explore Socrates' equally problematic defense of the justice of the city. In particular, I consider the possibility and goodness of Socrates' three paradoxical proposals aimed at bringing about the greatest justice attainable within a city--namely, the community of women and children, the equality of the sexes, and the philosopher-kings. The life-world is a central topic of Husserl’s phenomenology. He addresses this issue in some of the works published during his lifetime and attempts to analyze the life-world extensively in many of his works and posthumously published research manuscripts. The life-world is one of the topics that have been discussed most extensively in phenomenology. However, there are many misunderstandings of Husserl’s phenomenology of the life-world. One misunderstanding concerns the variety of concepts of the life-world in Husserl and the possibility of (...) developing various fields of the phenomenology of the life-world. It is the aim of this paper to show that Husserl has a pluralistic concept of the life-world, which makes it possible to develop various fields of the phenomenology of the life-world. I will introduce the monistic view and the pluralistic view of the concept of the life-world in Husserl and will clarify what the life-world is, thereby showing that the monistic view of the concept of the life-world in Husserl is not legitimate. However, even though Husserl has a pluralistic concept of the life-world, nowhere does he systematically clarify the various concepts of the life-world. Hence I will sort out and clarify various concepts of the life-world such as the narrower concept and the wider concept, the general concept and the particular concept, the natural concept and the transcendental concept, and the empirical concept and the eidetic concept. Based on the discussion of the various concepts of the life-world in Husserl, I will assess the monistic view and the pluralistic view of Husserl’s concept of the life-world so that we can better understand his various concepts of the life-world. The greatest wish of the Baeda l people, or South Koreans, living in the Korean Peninsula is the unification of Korea. However, even when it has been 70 years since the outbreak of the Korean War, the two Koreas that used to be one nation are still in conflict. There have been many discourses on unification over the past 70 years, but these discourses still fail to create clear rules and a framework for unification. Discourses from the perspective of biblical (...) theology offer insight regarding the problems at stake as well as alternatives, but they do not offer perspectives on a definite solution. This article, in line with its statement on biblical theology, does not pretend to contribute to a clear-cut solution to meet the challenge of Korea’s unification. Rather, this article intends to contribute to the formation of an emotional consensus that can contribute to the unification of Korea by looking at the teachings about peace in the Gospel of Matthew. The article explores whether the notion of embracement, forgiveness and love written during the conflict between the Matthean community and Formative Judaism can be applied to help create an emotional bond between the two Koreas. The terms embracement, forgiveness and love found in the Gospel of Matthew are upheld as symbolising peace derived from opposition and conflict. Jesus taught us to overcome situations of opposition and conflict through embracement, forgiveness and love.Contribution: The purpose and contribution of this article was to discuss if the notions of embracement, forgiveness and love found in the Gospel of Matthew can be helpful for the emotional preparation of the peaceful unification of the Korean Peninsula by comparing the situations reflected in the Gospel of Matthew and that of the Korean Peninsula. Biobanking in Europe has made major steps towards harmonization and shared standards for the collection and processing of data and samples stored in biobanks. Still, biobanks and researchers face substantial legal difficulties in the field of data protection and sample management. Data protection law was harmonized almost 15 years ago while rights in samples fall under the competence of the Member States of the EU. Despite the Data Protection Directive the field of data protection shows a substantial degree of deviation (...) as public health was excluded from the harmonization. Biobanks seem to have substantially fewer difficulties to cope with in terms of the legal requirements in the field of sample management. This paper discusses the legal framework, experiences of different biobanks in Europe and potential ways forward. It also highlights the need for a health economic analysis of the costs and benefits of privacy protection in Europe. At the moment, policymakers seem to build their decisions on an insufficient evidence base which underestimates the potential value of biobanks for European public health. Within the past few years little progress has been achieved with regards to the development of a unified legal framework in Europe, The diversity in the legal system is also reflected in the different approaches of ethics committees towards biobanking. To secure the responsible and effective use of data and samples, more efforts are needed to come up with pathways for a solution. (shrink)

In the past 20 years, the concept of instinct has been discussed in respect to various disciplines such as evolutionary biology, evolutionary psychology, linguistics, ethics, aesthetics, and phenomenology, etc. However, the meaning of instinct still remains unclarified in many respects. In order to overcome this situation, it is necessary to elucidate the genuine meaning of instinct so that the discussion of instinct in these disciplines can be carried out systematically. The objective of this paper is to establish the genuine concept (...) of instinct on the basis of a phenomenological criticism of A. Gehlen’s theory of instinct-reduction. Moreover, it seeks to show that this concept is the genetic origin of the embodied consciousness. According to Gehlen, instinct is defined as Instinkthandlung. However, this definition of instinct is problematic in the formal logical sense, since the definiendum is already included in the definiens. Moreover, it faces different kinds of serious material problems. Criticizing Gehlen’s theory of instinct systematically, I will show that instinct should be redefined as “the innate living force that urges a species of living being to pursue a certain kind of object,” and I will attempt to clarify this definition of instinct in a more detailed manner by offering 11 points. Thereafter, I will argue that Gehlen’s theory of instinct-reduction has to be replaced by the theory of instinct-enlargement in human beings. Finally, I will point out that the genuine concept of instinct is nothing other than the genetic origin of the embodied consciousness. (shrink)

Companies are increasingly engaging in corporate activism, defined as taking a public stance on controversial sociopolitical issues. Whereas prior research focuses on consumers’ brand perceptions, attitudes, and purchase behavior, we identify a novel consumer response to activism, unethical consumer behavior. Unethical behavior, such as lying or cheating a company, is prevalent and costly. Across five studies, we show that the effect of corporate activism on unethical behavior is moderated by consumers’ political ideology and mediated by desire for punishment. When the (...) company’s activism stand is [incongruent/congruent] with the consumer’s political ideology, consumers experience [increased/decreased] desire to punish the company, thereby [increasing/decreasing] unethical behavior toward the company. More importantly, we identify two moderators of this process. The effect is attenuated when the company’s current stance is inconsistent with its political reputation and when the immorality of the unethical behavior is high. (shrink)

After the French Revolution, the codification movement led to the introduction of the Dutch Civil Code and the Commercial Code of 1838. These codifications were generally regarded as the bedrock of a dogmatic system in which little space was left for customs and customary law. Mercantile jurists, such as Holtius and Levy, were opponents of the legalistic approach of the new codifications. They tried to separate mercantile law from civil law in order to protect mercantile law from excessive legalistic influences. (...) According to them, mercantile law was characterised by internationality, custom as its main source of law, continuity through an extended mercantile legal history and by good faith and mutual trust between the merchants. Out of these, the historicity and homogeneity of a strong community of merchants are particularly in line with a traditional and conservative view on society. Holtius and Levy, however, had little in common with their Christian-conservative contemporaries. On the one hand, they rather seemed to foreshadow the kind of liberal-conservatism as expressed by Hayek during the 20th century. On the other hand, their ideas have much in common with different lex mercatoria –traditions developed by authors as Goldman and Schmitthoff. On the aspects of historicity and internationality Holtius and Levy seem to have much in common with Hayek whereas concerning communality and the legal nature of customary law there are more similarities with the lex mercatoria-traditions. Based on in-depth interviews with 18 Korean immigrant working couples, this study explores Korean immigrant working wives' ongoing challenge to male dominance at home and to the unequal division of family work. A main factor in wives' being less obedient to their husbands is their psychological resources such as pride, competence, and honor, which they gain from awareness of their contribution to the family economy. Under immigrant family circumstances in which working for family survival is prioritized, wives feel that their (...) negligence of family work, rejection of the superwoman ideal, and perceived right to demand their husbands' help with family work is legitimized. However, Confucian patriarchal beliefs lead these wives to place limits on the degree of challenge. The findings highlight the interplay of wives' psychological resources, gender norms, and the social standing of being immigrant families in affecting wives' challenge to gender inequality at home. Differences in effects among Korean immigrant families are explored. (shrink)

이 논문은 현대 사회의 절망이라는 현상에 주목하면서 실존적 의미에서의 인간의 절망이란 무엇이고 절망의 근본 원인이 무엇인지 살펴보고, 이를 통하여 이러한 절망을 어떻게 극복할 수 있는가에 대하여 논의한다. 불안과 절망이라는 중요한 철학적 심리학의 주제에 관하여 키에르케고어는 그의 저서인 『불안의 개념』과 『죽음에 이르는 병』에서 인간이 근본 조건으로서의 불안과 절망을 경험할 수밖에 없는 근거를 해명하고자 했다. 본 연구에서는 키에르케고어의 이해에 바탕한 불안과 절망에 대한 이론적 고찰로부터 현대 사회에서 인간이 겪는 구체적인 형태의 절망을 철학적으로 어떻게 바라볼 수 있는지를 논의한다. 나아가 현대 사회에서 인간이 경험하는 (...) 절망을 철학상담의 관점에서 재해석하고, 이를 토대로 ‘공감적 대화’와 ‘초월’이라는 철학상담의 기법을 통해 이들이 자신이 마주한 절망을 극복하도록 도울 수 있는 가능성을 제시한다. Trotz aller Rationalisierungsbemühungen werden sich Leistungseinschränkungen im deutschen Gesundheitswesen nicht vermeiden lassen. Zwar sollten diese so weit möglich oberhalb der individuellen Arzt-Patient-Beziehung erfolgen, aus pragmatischen Gründen wird es sich aber nicht vermeiden lassen, dass Ärzte auch im Einzelfall Verantwortung für die Kosten ihrer Entscheidungen übernehmen, wie es bereits heute häufig der Fall ist. Der vorliegende Beitrag widmet sich deshalb der Frage, wie Ärzte in einer medizinisch rationalen und ethisch vertretbaren Art und Weise Kostenerwägungen in ihren Entscheidungen berücksichtigen können. Vorgeschlagen wird (...) ein vierstufiges Modell eines „ethischen Kostenbewusstseins“: 1) Unterlassung ineffektiver Maßnahmen im Sinne einer evidenzbasierten Medizin; 2) konsequente Berücksichtigung individueller Patientenpräferenzen; 3) Minimierung des diagnostischen und therapeutischen Aufwands für die Erreichung eines bestimmten Therapieziels; und 4) Verzicht auf teure Maßnahmen mit einem geringen/fraglichen Nutzengewinn für den Patienten. Stufen (1–3) sind durch die Prinzipien Wohltun, Nichtschaden und Respekt der Autonomie ethisch begründet, Stufe (4) durch das Prinzip der Gerechtigkeit. Für Entscheidungen auf der vierten Stufe sollten nach Möglichkeit lokale explizite Vorgaben wie z. B. kostensensible Leitlinien erarbeitet werden. Prozedurale Mindeststandards sind zu berücksichtigen, regelmäßige Kosten-Fallbesprechungen oder klinische Ethikberatung sollten zur Entscheidungsunterstützung verfügbar sein. Abschließend wird ein ethischer Algorithmus zur Abklärung des Einsatzes einer kostspieligen medizinischen Maßnahme vorgestellt. (shrink)

Within the political lexicon of the European Middle Ages, tyranny (along with related terms such as tyrant and tyrannical) constituted one of its most ubiquitous and flexibly applied discursive fields. Moreover, once Aristotle’s Ethics and Politics began to circulate in the West after their translation into Latin in the mid-1200s, a closely related term for tyranny emerged: despotism. Yet when we turn to Marsiglio of Padua, the fourteenth-century political theorist who is often regarded to be the quintessential medieval exponent of (...) Aristotelian political ideas, we find remarkably few references to either tyranny or despotism. The present article examines how Marsiglio deploys the languages of tyranny and despotism in his major work, the Defensor pacis (completed in 1324). Three intertwined theses are proposed. First, the occasions on which Marsiglio invokes tyranny and despotism reveal a great deal about his intellectual connection to his supposed source, Aristotle. Second, unacknowledged dimensions of Marsiglio’s highly critical attitude toward the papacy, especially the doctrine of the papal plenitude of power (plenitudo potestatas), may be illuminated. Third, examination of the languages of tyranny and despotism reveals additional insights into Marsiglio’s signature theory of political consent espoused in the first discourse of the Defensor pacis. Kant's epistemology and the Buddhist philosophy are an idealism. But these two different philosophies have in themselves the contradictory element, namely the element of the outer sense of bodies and of the inner mind. Although Kant's transcendental idealism and the school Vijnanavadin (唯識學派) acknowledge only the representations and the consciousnesses., the mind need to be affected by the outer part. In Kant's theoretical philosophy the outer sense of bodies plays an alien role. It stands outside the subject. In spite of (...) this, the subject have to relate itself to the outer element. And in the Buddhism, in order to have consciousnesses, the subject have to be transformed from the fundamental ground, the Alayavijnana (第8 識). But the Alyavijnana need to have a certain moment in order to be transformed. In my paper I have concentrated myself on the problem of relation of the mind to the matter. I have tried to see into the way in which these two philosophies develop this relation. Moreover I am also interested in the problem in relation to the theoretical, practical, and aesthetical fields. Veröffentlicht werden Studien, die einen innovativen Charakter haben und ausdrückliche Desiderate der Forschung erfüllen. Die Publikationen repräsentieren damit den aktuellsten Stand der Forschung.

In this work, I attempt to develop what I call a co-evolutionary model of scientific change, which I expect to afford a more balanced view on both the continuous and discontinuous aspects of scientific change. Supposing that scientific goals, methods and theories constitute the main components of scientific inquiry, I focus on the relationships among these components and their changing patterns. First of all, I identify explanatory power and empirical adequacy as primary goals of science and explore the possibility of (...) evaluating scientific goals. Then I try to bring out the major features of how the main components of science are related to each other. One major feature is that they mutually constrain each other, and as such each main component operates as a selective force on the other components. Another major feature is that the main components of science induce changes reciprocally, but with certain intervals. Other important features are the modes and tempos of changes in the main components of scientific inquiry. All these features together, I conclude, suggest that scientific change is evolutionary, as well as co-evolutionary. Finally I argue that this co-evolutionary model of scientific change does not yield to what I call the problems of circularity and scientific progress. (shrink)

This paper argues that solicitors are required to lawyer relationally when delivering independent legal advice (ILA) to (predominantly) women set to provide suretyship for their intimate partner’s debts. Case law tells us that women providing suretyship may be entering the transaction under the coercion of their partner. Coerced debt is a form of economic abuse, which in turn is a form of domestic abuse. ILA in this context therefore provides an important intervention to potentially assist victims of abuse before entering (...) (potentially more) debt at the hands of their abuser. To make ILA purposeful, solicitors must prioritise relational values/dynamics such as consultation, care, judgement, and empowerment; the anti-thesis of market-exchange lawyering which is characterised by the values such as objectivity and detachment. Market-exchange lawyering is also associated with ethical apathy as lawyers prioritise their client’s means-ends above all else, therefore failing to consider the broader implications of those ends (in terms of their client’s best interests and/or the public interest). Drawing on interview data with 22 solicitors, it is demonstrated that most interviewees provide tick-box ILA prioritising completion. That is, most interviewees prioritised values of commerce over values of care when acting for women who may be experiencing economic abuse. (shrink)
