Zusammenfassung Hintergrund Advance Care Planning (ACP) wird auch in Deutschland zunehmend praktiziert. Aus klinisch-ethischer Perspektive bietet ACP eine Möglichkeit, Vorausverfügungen zu konkretisieren und auf diese Weise die Entscheidungsfindung bei fehlender Selbstbestimmungsfähigkeit von Patient:innen zu unterstützen. Während es für Gesprächsangebote im Sinne des ACP in Pflegeeinrichtungen und Einrichtungen der Eingliederungshilfe seit 2015 Finanzierungsmöglichkeiten gibt und erste Studien zu Angeboten veröffentlich wurden, fehlt es in Deutschland bisher an publizierten Evaluationsstudien zu ACP-Angeboten im Krankenhaus. Intervention und Methoden Im vorliegenden Beitrag erfolgt die strukturierte (...) Darstellung von ACP als ein Element des klinisch-ethischen Unterstützungsangebotes am Universitätsklinikum Halle (Saale) (UKH). Es erfolgte eine quantitative Inhaltsanalyse der schriftlichen Dokumentation von durchgeführten ACP-Gesprächsprozessen für den Zeitraum der Pilotphase von 01/2020 bis 08/2021 (20 Monate). Ergebnisse Im Zeitraum wurden 93 ACP-Gespräche angefragt. Mit 79 Patient:innen konnten 110 Gespräche geführt werden. 46 % der Anfragen kamen von Palliative Care betreuten Patient:innen. Im Durchschnitt dauerten die Beratungen 45 min. Der Gesprächsprozess zur Erstellung einer Patientenverfügung benötigte durchschnittlich 122 min und 2,5 Gespräche. Bei 23 % der Patient:innen endete der ACP-Prozess nach dem Erstgespräch. Die Inhalte der ACP-Prozesse tangierten verschiedene Bereiche anderer Professionen im Krankenhaus, insbesondere die Entscheidungsfindung über aktuelle Diagnostik und Therapie zwischen Ärzt:innen und Patient:innen. Diskussion Die Einführung eines ACP-Angebotes im Krankenhaus zeigt neben einer Vielzahl an Chancen auch Herausforderungen auf, welche es im gemeinsamen Diskurs zu bewältigen gilt. Bei der Einbettung eines ACP-Angebots im Krankenhaus müssen die Besonderheiten der Klinik und insbesondere die Abgrenzung von ACP zu anderen Arbeitsfeldern der Ethikberatung, wie beispielsweise die Ethikfallberatung, bedacht werden. The effort to identify the neural substrate of episodic recall, though ambitious, lacks experimental support. By considering the data on c-fos activation by novel and familiar stimuli in recognition studies, we illustrate how inadequate experimental designs permit alternative interpretations. We stress that interpretation of c-fos expression changes should be supported by adequate recognition tests.

This article offers a revision of Gilles Deleuze’s “Postscript on the Societies of Control.” Departing from recent shifts empowered by the digital transformation and AI, we argue that Deleuze’s “dividual” has been replaced by the “user” (reducing the human being to predictable behavior), putting in crisis those institutions that were paramount for the now traditional societies of control in the age of globalization and the end of history (Fukuyama): We witness a crisis of democracies, the legal system, the epistemological system, (...) the civic society, even capitalism itself. The development of an ethics program is a method frequently used for organising responsible behaviour within organisations. For such a program, certain preconditions have to be created in the structure, culture and strategy. In this organisational context, managers have to take their decisions in a responsible way. This process of decision-making, embedded in an ethics program, is the main focus of this article. Ethics programs often influence decision-making in a formal way; certain norms and types of behaviour are formalised and (...) controlled within the organisation. Subsequently, individual managers have to infer the meaning of responsible behaviour from the demands laid down in the ethics program. Such a formal ethics program has some important advantages but the dangers of such an approach are often ignored. This article discusses both the advantages and disadvantages of a formal ethics program and adds two alternative ways of stimulating responsible behaviour in the organisation. In a monological approach the reflections of the decision makers on their own values are central in differentiating between right and wrong. In a dialogical approach, the communications between decision makers and other stakeholders involved are the foundations for determining a responsible solution. Because each approach is appropriate for certain issues, a well-chosen combination is justified. Such an ethics program should be strict on certain issues but leave room for reflection and interaction on other issues. (shrink)

Previous research has found that populist attitudes and conspiracy mentality – here summarised as anti-establishment attitudes – increase when people feel threatened. Two types of intergroup threat have been distinguished, namely realistic threats (pertaining to socio-economic resources, climate, or health), and symbolic threats (pertaining to cultural values). However, there is no agreement on which types of threat and corresponding appraisals would be most important in predicting anti-establishment attitudes. We hypothesise that it is the threat itself, irrespective of its cause, that (...) predicts anti-establishment attitudes. In the current paper, we conducted new (multilevel) regression analyses on previously collected data from four high-powered studies with multiple time points (Study 1) or collected in multiple nations (Studies 2–4). All studies included a populist attitudes scale, a conspiracy mentality scale, and different types of threat and emotion measures, reflecting both realistic and symbolic threats. Across studies, both realistic and symbolic threats positively predicted anti-establishment attitudes. The results support an emotional appraisal approach to anti-establishment attitudes, which highlights the importance of anxiety and feeling threatened regardless of what type of event elicits the threat. Concepts that include the participation and empowerment of workers are becoming increasingly important nowadays. In many of these concepts, the formal responsibility is delegated to teams. Does this imply that the normative responsibility for the actions of teams is also delegated? In this article we will reflect on the difference between holding a person accountable and bearing responsibility. A framework is elaborated in order to analyse the accountability and responsibility of teams. In this framework, the emergence of a collective mind, (...) and the organisational factors that influence the extent to which teams have the possibility of acting in a responsible way play an important role. It shows that teams can bear responsibilities that could never be carried by a group of individuals. The framework is used to analyse two sample cases with self-managing teams in production facilities. The authors discuss the implications for the theory and practice of self-managing teams and the allocation of responsibility between individuals, teams and the organisation. (shrink)

Nous entendrons montrer, au contraire, que les kinesthèses ne permettent pas de rendre compte du mouvement vécu parce qu’elles le transforment en un vécu de mouvement demeurant extérieur au sujet qui le vit. Cette critique nous amènera ensuite à repenser conjointement (...) le mouvement dansé comme véritable sujet de la danse et le corps dansant comme déposé par ce mouvement en lequel il est pris. BackgroundClinical ethics case consultations (CECCs) provide a structured approach in situations of ethical uncertainty or conflicts. There have been increasing calls in recent years to assess the quality of CECCs by means of empirical research. This study provides detailed data of a descriptive quantitative and qualitative evaluation of a CECC service in a department of cardiology and intensive care at a German university hospital.MethodsSemi-structured document analysis of CECCs was conducted in the period of November 1, 2018, to May 31, 2020. All documents were analysed by two researchers independently.ResultsTwenty-four CECCs were requested within the study period, of which most (n = 22; 92%) had been initiated by physicians of the department. The patients were an average of 79 years old (R: 43–96), and 14 (58%) patients were female. The median length of stay prior to request was 12.5 days (R: 1–65 days). The most frequent diagnoses (several diagnoses possible) were cardiology-related (n = 29), followed by sepsis (n = 11) and cancer (n = 6). Twenty patients lacked decisional capacity. The main reason for a CECC request was uncertainty about the balancing of potential benefit and harm related to the medically indicated treatment (n = 18). Further reasons included differing views regarding the best individual treatment option between health professionals and patients (n = 3) or between different team members (n = 3). Consensus between participants could be reached in 18 (75%) consultations. The implementation of a disease specific treatment intervention was recommended in five cases. Palliative care and limitation of further disease specific interventions was recommended in 12 cases.ConclusionsTo the best of our knowledge, this is the first in-depth evaluation of a CECC service set up for an academic department of cardiology and intensive medical care. Patient characteristics and the issues deliberated during CECC provide a starting point for the development and testing of more tailored clinical ethics support services and research on CECC outcomes. An infinite binary sequence X is Kolmogorov–Loveland random if there is no computable non-monotonic betting strategy that succeeds on X in the sense of having an unbounded gain in the limit while betting successively on bits of X. A sequence X is KL-stochastic if there is no computable non-monotonic selection rule that selects from X an infinite, biased sequence.One of the major open problems in the field of effective randomness is whether Martin-Löf randomness is the same as KL-randomness. Our first (...) main result states that KL-random sequences are close to Martin-Löf random sequences in so far as every KL-random sequence has arbitrarily dense subsequences that are Martin-Löf random. A key lemma in the proof of this result is that for every effective split of a KL-random sequence at least one of the halves is Martin-Löf random. However, this splitting property does not characterize KL-randomness; we construct a sequence that is not even computably random such that every effective split yields two subsequences that are 2-random. Furthermore, we show for any KL-random sequence A that is computable in the halting problem that, first, for any effective split of A both halves are Martin-Löf random and, second, for any computable, nondecreasing, and unbounded function g and almost all n, the prefix of A of length n has prefix-free Kolmogorov complexity at least n−g. Again, the latter property does not characterize KL-randomness, even when restricted to left-r.e. sequences; we construct a left-r.e. sequence that has this property but is not KL-stochastic and, in fact, is not even Mises–Wald–Church stochastic.Turning our attention to KL-stochasticity, we construct a non-empty class of KL-stochastic sequences that are not weakly 1-random; by the usual basis theorems we obtain such sequences that in addition are left-r.e., are low, or are of hyperimmune-free degree.Our second main result asserts that every KL-stochastic sequence has effective dimension 1, or equivalently, a sequence cannot be KL-stochastic if it has infinitely many prefixes that can be compressed by a factor of α<1. This improves on a result by Muchnik, who has shown that were they to exist, such compressible prefixes could not be found effectively. (shrink)

GoalThis paper presents an immersive Virtual Reality system to analyze and train Executive Functions of soccer players. EFs are important cognitive functions for athletes. They are a relevant quality that distinguishes amateurs from professionals.MethodThe system is based on immersive technology, hence, the user interacts naturally and experiences a training session in a virtual world. The proposed system has a modular design supporting the extension of various so-called game modes. Game modes combine selected game mechanics with specific simulation content to target (...) particular training aspects. The system architecture decouples selection/parameterization and analysis of training sessions via a coaching app from an Unity3D-based VR simulation core. Monitoring of user performance and progress is recorded by a database that sends the necessary feedback to the coaching app for analysis.ResultsThe system is tested for VR-critical performance criteria to reveal the usefulness of a new interaction paradigm in the cognitive training and analysis of EFs. Subjective ratings for overall usability show that the design as VR application enhances the user experience compared to a traditional desktop app; whereas the new, unfamiliar interaction paradigm does not negatively impact the effort for using the application.ConclusionThe system can provide immersive training of EF in a fully virtual environment, eliminating potential distraction. It further provides an easy-to-use analyzes tool to compare user but also an automatic, adaptive training mode. (shrink)

Dette kapitel fokuserer på ’etik og patientinddragelse’, men søger med afsæt i devisen ‘sapere aude’ også at skabe interesse for filosofi og etik blandt sygeplejestuderende. Kapitlet er en opfordring til sygeplejestuderende om at betjene sig af egen forstand og finde mod til at filosofere over problematikker i forbindelse med patientinddragelse frem for at falde tilbage i umyndighedens bekvemmelighed og vente på at andre træder til. Kapitlet starter med at se nærmere på, hvordan patientinddragelse italesættes i vor tid efterfulgt af en (...) kort eksposition af to af oplysningstidens vigtigste libera- le filosoffer, herunder pligtetikeren Immanuel Kant og nytteetikeren John Stuart Mill, hvis syn på henholdsvis autonomi og frihed influerer debatten om patientinddragelse. Efterfølgende præsenteres og diskuteres to eksempler, hvor patientinddragelse og etik er i rampelyset. Mere specifikt rettes fokus på 1) etik, patientinddragelse og den psykiatriske patient og 2) etik, patientinddragelse og unge mennesker. Eksemplerne er udvalgte med henblik på at belyse, hvad der kan komme på spil i sundhedsfaglige situationer udspændt mellem individuel frihed, herunder også ideen om autonomi; sygehusvæsenet, inklusive personale, som autoritær vi- dens-institution/aktør og det etiske, herunder ideen om ’det gode’ eller efterstræbelsesværdige. Gentzen writes in the published version of his doctoral thesis Untersuchungen über das logische Schliessen that he was able to prove the normalization theorem only for intuitionistic natural deduction, but not for classical. To cover the latter, he developed classical sequent calculus and proved a corresponding theorem, the famous cut elimination result. Its proof was organized so that a cut elimination result for an intuitionistic sequent calculus came out as a special case, namely the one in which the sequents have (...) at most one formula in the right, succedent part. Thus, there was no need for a direct proof of normalization for intuitionistic natural deduction. The only traces of such a proof in the published thesis are some convertibilities, such as when an implication introduction is followed by an implication elimination [1934–35, II.5.13]. It remained to Dag Prawitz in 1965 to work out a proof of normalization. Another, less known proof was given also in 1965 by Andres Raggio.We found in February 2005 an early handwritten version of Gentzen's thesis, with exactly the above title, but with rather different contents: Most remarkably, it contains a detailed proof of normalization for what became the standard system of natural deduction. The manuscript is located in the Paul Bernays collection at the ETH-Zurichwith the signum Hs. 974: 271. Bernays must have gotten it well before the time of his being expelled from Göttingen on the basis of the racial laws in April 1933. (shrink)

Kafka's work has exercised immense influence on cinema and his reflections on diminished human agency in modernity and the dominance of oppressive institutions that perpetuate individual or social alienation and political repression have been the subject of debates by philosophers such as Theodor Adorno, Walter Benjamin, Gilles Deleuze, Félix Guattari, and Alexander Kluge. Informed by a world-systems approach and taking a cue from Jorge Luis Borges’ point that Kafka has modified our conception of the future, and André Bazin's suggestion that (...) literary concepts, characters and styles can exceed “novels from which they emanate”, I understand the Kafkaesque as an elastic term that can refer to diverse films that might share thematic preoccupations, but also aesthetic and formal differences. In this article, I explore the politics of humour in Kafkaesque cinema with reference to the following films: The Overcoat ( Шинель, 1926, Gregor Koznitzev and Leo Trauberg), The Shop on Main Street ( Obchod na korze, 1965, Ján Kadár), and Death of a Bureaucrat ( La muerte de un burócrata, 1966, Tomás Gutiérrez Alea). I draw attention to the dialectics of humour and the connection between the Kafkaesque and slapstick so as to show how humour is deployed as a means of political critique. (shrink)

Johann Christoph Gottsched gehört unbestritten zu den zentralen Figuren der deutschen Frühaufklärung. Wie wohl kein anderer vor und nach ihm hat er die Entwicklung der deutschsprachigen Sprach-, Rede-, Dicht- und Bühnenkunst geprägt, geleitet von der festen Absicht, diesen Künsten wo möglich eine wissenschaftliche Begründung, eine überschaubare kritische Historie sowie eine klare und elegante Darstellung zu verleihen. Über diese Bemühungen hinaus, hat sich insbesondere die neuere Forschung weiteren Facetten seines riesigen Werkes zugewendet. So erscheint Gottsched als Vorbild zahlreicher Zeitschriftenprojekte, als wichtiger (...) Popularisator der Leibnizschen und Wolffschen Philosophie, als zentraler Reformer der zeitgenössischen Homiletik, als Drehscheibe bei der Vermittlung europäischer Dichtung und Gelehrsamkeit. Die Beiträge des vorliegenden Bandes tragen der gesamten Breite der Gottsched-Forschung Rechnung, prüfen alte Erkenntnisse und stellen neue Einschätzungen zur Diskussion. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. Moreover, that, in this particular process of reasoning, (...) doctrinal topics must follow a certain order. Thus, in particular, I argue that the distinction between essence and act of being in every creature cannot be argued before arguing the existence of God. I touch upon the notion of separation in metaphysics and I compare Aquinas' notion of resolution with Fabro's notion. (shrink)

Explanation and understanding are intimately connected notions, but the nature of that connection has generally not been considered a topic worthy of serious philosophical investigation. Most authors have avoided making reference to the notion of understanding in their accounts of explanation because they fear that any mention of the epistemic states of the individuals involved compromises the objectivity of explanation. Understanding is a pragmatic notion, they argue, and pragmatics should be kept at a safe distance from the universal features of (...) explanation. My main contention in this dissertation is that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize this notion it is necessary to formulate an account of objective explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. ;My account of explanation is based on the belief-doubt model of inquiry first proposed by Peirce. Using the tools provided by decision theory, and the models of belief revision developed by Isaac Levi and by Alchourron, Gardenfors, and Makinson, I analyze the objective and pragmatic conditions that a piece of information must fulfill to be both explanatory and epistemically useful to an inquiring agent. The objective basis for an explanation is provided by the relation of probabilistic relevance that the fact described by the explanans bares to the fact described by the explanandum. But an explanation is much more than its foundation. As an epistemological notion, a potential explanation can only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate an explanation in terms of its credibility, its content, and its explanatory value. I argue that although an objective measure of the credibility and content of an explanation can be established, in many cases a complete determination of its explanatory value will ultimately depend on the interests and goals of the individual inquirers. Morally progressive social changes seem to have taken place with the onset of democratic governance, the abolition of slavery, the rise of gender equality, and other developments. This essay attempts to demonstrate that natural and objective moral facts are a plausible cause of some morally progressive social changes. Since this hypothesis is a version of naturalistic moral realism, I call it the Naturalist-Realist Hypothesis. To support the NRH, I argue that objective moral facts are natural facts pertaining to the impartial (...) promotion of well-being within a population of agents facing a social dilemma. I then describe a mechanism to explain how natural and objective moral facts so construed may cause some morally progressive social changes. I suggest that the NRH is a credible hypothesis because it is compatible with empirical findings from research on the evolution of moral cognition and on the sociology of mass political movements. This article is part of the period of methodological expansion, proposed by the philosopher Arturo Roig (1922-2012), in the 70's and 80's. Although the analysis of categories is rooted in the philosophical field, this expansion is made in the direction of social categories. More specifically to the categories of “civilization” and “barbarism”, both in the field of the history of ideas and in the philosophical history of Latin American liberation. First, we give different definitions and their multiple uses of category (...) in philosophy. Subsequently, we analyze the category of “human dignity”, one of the arms of the very broad anthropological a priori category, systematized by the thinker from Mendoza. Then we disaggregate the proposal of a categorical rearmament, which has among its multiple functions: the rescue, criticism, replacement, reworking and integration of categories that have been forgotten, distorted, dehistoricized and decontextualized. The categories of “civilization” and “barbarism” have generated a semantic ordering of the discursive universe in Latin America. We review different theses proposed by Roig, in the historicization of the assessment -both negative and positive- of the category “barbarism” that different thinkers in Latin America have expressed. Among them: Juan Montalvo, Domingo Faustino Sarmiento, José Hernández, Juan Bautista Alberdi, Ezequiel Martínez Estrada, among the main ones. (shrink)

Uno de los principios éticos mencionados más frecuentemente en los lineamientos para el desarrollo de la inteligencia artificial (IA) es la transparencia algorítmica. Sin embargo, no existe una definición estándar de qué es un algoritmo transparente ni tampoco es evidente por qué la opacidad algorítmica representa un reto para el desarrollo ético de la IA. También se afirma a menudo que la transparencia algorítmica fomenta la confianza en la IA, pero esta aseveración es más una suposición a priori que una (...) tesis basada en evidencia empírica. Tampoco se discute mucho hasta qué punto es técnicamente posible volver transparente la caja negra de la IA a través de los métodos de explicabilidad. En este capítulo haré un análisis de la interrelación entre los conceptos de transparencia, explicabilidad y confianza. Inicialmente, analizaré los diferentes tipos de opacidad algorítmica para entender mejor cuál es el problema al que nos enfrentamos. En las secciones subsiguientes trazaré la relación entre explicabilidad y transparencia, y presentaré los límites de los métodos actuales de explicabilidad. En la sección final, examinaré la evidencia empírica acerca de la relación entre transparencia y confianza en las decisiones automatizadas basadas en sistemas de IA. (shrink)

I defend the view that circular definitions can be useful and illuminating by focusing on the fitting-attitudes analysis of value. This definition states that an item has value if and only if it is a fitting target of attitudes. Good items are the fitting targets of positive attitudes, and bad items are the fitting targets of negative ones. I shall argue that a circular version of this definition, defended by Rabinowicz and Rønnow-Rasmussen (2006), is preferable to its non-circular counterpart and (...) upholds reasonable standards of acceptability. The standards I will be discussing come from Humberstone (1997), who claims that definitions cannot be informative as long as they are inferentially circular. (shrink)

Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. In this essay, I deal with the problem of the attribution of psychological predicates to non-human animals. The first section illustrates three research topics where it has become scientifically legitimate to explain the conduct of non-human animals by means of the attribution of psychological predicates. The second section discusses several philosophical objections to the legitimacy of such attributions provided by central thinkers from the last decades. I try to show that these objections —which are related among other questions to the (...) holism of the mental, the indeterminacy of the attributions, and the strangeness of animal concepts— can be alleviated. In the third section, I propose to adopt a literalist view of the attributions in the sense articulated by Figdor. At the same time, I argue that one must draw limits to the conceptual change forwarded by her literalist view, taking into account holistic considerations and the fact that the psychological concepts must retain their core notes. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

Some versions of moral naturalism are faulted for implausibly denying that moral obligations and prescriptions entail categorical reasons for action. Categorical reasons for action are normative reasons that exist and apply to agents independently of whatever desires they have. I argue that several defenses of moral naturalism against this charge are unsuccessful. To be a tenable meta-ethical theory, moral naturalism must accommodate the proposition that, necessarily, if anyone morally ought to do something, then s/he has a categorical reason to do (...) it. Versions of moral naturalism that deny this claim would, if widely believed, disable some crucial practical uses of moral concepts. In particular, if the existence of normative reasons for action is taken to be dependent on agents’ desires, it would breed profound skepticism about the legitimacy of evaluating others’ actions from a moral point of view. Also, it would raise doubts about whether people ought to correct their own behavior in light of moral considerations. Following Richard Joyce, I take these consequences to indicate that the concept of a categorical reason is a “non-negotiable” part of moral concepts. (shrink)

In this paper I examine the notion of ‘artifact’ and related notions in the dominant version of extended cognition theory grounded on extended functionalism. Although the term is ubiquitous in the literature, it is far from clear what ECT means by it. How are artifacts conceptualized in ECT? Is ‘artifact’ a meaningful and useful category for ECT? If the answer to the previous question is negative, should we worry? Is it important for ECT to have a coherent theory of artifacts? (...) And what are the demands and constraints that ECT imposes on this theory? I distinguish between two aspects of ECT, one narrow, aligned with extended functionalism ; and one broad or pluralistic, in which EF is combined with other theoretical resources in the context of diverse research programs. I begin by determining the problems in conceptualizing artifacts from EF. Then I address the question of why a concept of artifact may be relevant to ECT. Next, I examine the efforts of Richard Heersmink to combine ECT with dominant theories of artifacts in the philosophy of technology. I argue that both approaches fail to yield a meaningful notion of artifact, let alone one of ‘cognitive’ artifact. Finally, I argue that narrow ECT places rather strong constraints on a theory of artifacts, since it locates the specificity of ‘artifact’ in material aspects of realization that are, by definition, outside its theoretical purview. I examine, then discard, the possibility that a materialist and objectivist theory of artifacts may be of help. And finally I briefly explore some ways in which a broad, pluralistic ECT may address some of these shortcomings. (shrink)
