La première partie, " Sociologie de Jean-Michel Berthelot ", rassemble les contributions restituant des traits de son œuvre à l'aide d'études de cas précis ou de panoramas plus larges, et balise des domaines de recherche dans lesquels il s'est illustré : sociologie de l'éducation, du corps, des sciences, épistémologie des sciences sociales. La deuxième partie rend compte des perspectives ouvertes par ses travaux et de la (...) manière dont des chercheurs ont mis en œuvre ses réflexions pour leurs propres recherches. Il s'agit donc de restituer la façon dont on peut faire de la sociologie " avec " Jean-Michel Berthelot - à l'aide de ses travaux et des jalons qu'ils posent. La troisième partie est biographique en restituant l'itinéraire académique, intellectuel et humain de Berthelot, que ce soit son parcours universitaire et social, notamment à l'ENS durant mai 68, ou encore sa période " toulousaine " où sa carrière universitaire a débuté et qui en constitue une partie essentielle. In contrast to the traditional view of Kant as apure retributivist, the recent interpretations ofKant's theory of punishment (for instance Byrd's)propose a mixed theory of retributivism and generalprevention. Although both elements are literallyright, I try to show the shortcomings of each. I thenargue that Kant's theory of punishment is notconsistent with his own concept of law. Thus I proposeanother justification for punishment: specialdeterrence and rehabilitation. Kant's critique ofutilitarianism does not affect this alternative, whichmoreover has textual support in Kant and is (...) fullyconsistent with his concept of law. (shrink)

Sense of Agency (SoA) is the subject of growing attention. It corresponds to the capacity to claim authorship over an action, associate specific consequences with a specific action, and it has been claimed to be a key point in the development of consciousness. It can be measured using the Sense of Agency Scale (SoAS), originally proposed by Tapal et al. (2017), who distinguished it into two-factor: Sense of Positive Agency (SoPA) and Sense of Negative Agency (SoNA). This study reports on (...) the first adaptation of the SoAS into another language, French. For this French version of the Sense of Agency Scale (F-SoAS), we analyzed responses from a sample of 517 native French-speakers. Our results indicate that the scale has good psychometric properties. Factor analysis confirm the same two-factor model as Tapal et al. (2017). However, some items were removed due to insufficient loadings with factors, leading to a short version of the scale (7-item). Furthermore, we observed gender differences that are consistent with findings in the literature. Specifically, women report higher SoNA scores and lower SoPA scores than men. We conclude by discussing possible uses and future directions for the scale. (shrink)

Little consensus exists about the effectiveness of transnational private governance in domains such as labor, the environment, or human rights. The paper builds on recent scholarship on labor standards to emphasize the role of labor agency in transnational private governance. It argues that the relationship between transnational private regulatory initiatives and labor agency depends on three competences: first, the ability of workers’ organizations to gain access to processes of employment regulation, implementation, and monitoring; second, their ability to insist on the (...) inclusion of employers and state agencies within such processes; and third, the ability of workers to effectively exercise leverage in pursuit of particular goals. The paper develops a framework, called hybrid production regime, for examining how workers’ capacity to act at the local level depends on how these three collective competences are addressed in the institutionalization of capital–labor relations between the transnational and national levels. À partir de la critique formulée par Husserl, selon laquelle Kant se montrerait coupable, en dépit de ses percées transcendantales, d’une forme de relativisme anthropologique, il s’agit plus précisément de clarifier la fonction limitative de l’incise « pour nous hommes » qui ponctue le texte de la première Critique. En dépit des apparences qui (...) ont pu mener Husserl à soutenir que Kant cherche à expliquer par cette clause la validité universelle des jugements synthétiques a priori, mais se trouve par le fait même à limiter cette validité, il est possible de soutenir que l’humanité de notre pouvoir de connaître n’est jamais présupposée par Kant et constitue en réalité une découverte de la raison à son propre sujet. Even if the term bioethics is used all over the world, its meanings are multiple and different, especially between American and European countries, depending on local cultural and medical contexts. These differences concern the issues discussed or the institutional form bioethics takes. In France, bioethics was used from the end of the 1970s and focused on research ethics and issues at the beginning of life. At the national level, a permanent commission, the was created by President François Mitterrand in 1983. (...) Archival data processing consists of cleaning and formatting data between the moment a dataset is deposited and its publication on the archive’s website. In this article, I approach data processing by combining scholarship on invisible labor in knowledge infrastructures with a Marxian framework and show the relevance of considering data processing as factory labor. Using this perspective to analyze ethnographic data collected during a six-month participatory observation at a U.S. data archive, I generate a taxonomy of the forms of alienation (...) that data processing generates, but also the types of resistance that processors develop, across four categories: routine, speed, skill, and meaning. This synthetic approach demonstrates, first, that data processing reproduces typical forms of factory worker’s alienation: processors are asked to work along a strict standardized pipeline, at a fast pace, without acquiring substantive skills or having a meaningful involvement in their work. It reveals, second, how data processors resist the alienating nature of this workflow by developing multiple tactics along the same four categories. Seen through this dual lens, data processors are therefore not only invisible workers, but also factory workers who follow and subvert a workflow organized as an assembly line. I conclude by proposing a four-step framework to better value the social contribution of data workers beyond the archive. (shrink)

The author argues the following hypothesis: the medical clinic is an experimental practice, in the sense given to this term by Claude Bernard, and the clinic is its specific laboratory. Its object is not the disease, but the patient. Careful examination of the clinic attests to its very close proximity to the experimental method, and the comparison also raises a number of difficulties. The main obstacle arises from the specificity of medicine, which involves treating individual human subjects whose words cannot (...) be suppressed. La philosophie de Fichte est une philosophie du moi. Est-ce à dire qu'il faut y voir une philosophie de La subjectivité finie, achevant en système l'idéalisme kantien? Ou bien faut-il s'inquiéter de ce que le moi y soit aussi dit " absolu ", et chercher chez Fichte Les prémices des philosophies schettingienne et hégélienne de l'absolu? Le but de ce volume est de convaincre que la philosophie de Fichte est plutôt une pensée originale de la construction duale, contradictoire, du moi (...) humain en lequel sont à la fois opposées et réunies finitude et absoluité. Or le médium de cette synthèse vivante du fini et de l'absolu dans le moi humain, c'est la liberté comme libre choix d'elle-même. De sorte que, confondant volonté d'être soi et volonté d'être libre, la philosophie de Fichte est, comme philosophie du moi, philosophie de la liberté. Philosophie de la liberté, elle reste au double sens d'une pensée de l'autodétermination pratique du sujet fini et d'une pensée de l'absolu comme agir pur. C'est pourquoi l'intention de ce volume est de mettre en relief la valeur émancipatrice de la philosophie de Fichte tant sur le plan de l'action que celui de la spéculation. (shrink)

Against the background of early modernism - a period that justified punishment by general deterrence - Kant is usually thought to represent a radical turn towards retributivism. For Kant, and later for Fichte and Hegel, a just punishment respects the humanity inherent in the criminal, and serves no external ends - it is instituted only because the criminal deserves it. In this original study, Jean-Christophe Merle uses close analysis of texts to show that these philosophers did not in (...) fact hold a retributivist position, or even a mixed position; instead he traces in their work the gradual emergence of views in favour of deterrence and resocialisation. He also examines Nietzsche's view that morality rests on the rejection of retribution. His final chapter offers a challenge to the retributivist position, and a defence of resocialisation, in the context of current legal theory and practice concerning the punishment of crimes against humanity. This paper seeks to determine the relationship between anarchy and democracy in Proudhon’s thought, considering the place of the conflict in this autor. The first part exposes what Proudhon names antagonism and antinomy in his social ontology and the different sorts of conflicts this ontology takes into account. The second part focuses on a case of antinomy, that is at the same time a basic and a borderline case : sexual difference, that Proudhon considers as an antinomy, but not as (...) a conflict. The last part shows how this theory of conflictuality leads to a criticism of democracy and to a positive federalist project. (shrink)

: La contribution de Berkeley à l'histoire de la métaphysique n'a que rarement été étudiée par ses commentateurs français ou anglo-saxons. La présente étude se propose de revenir sur la définition berkeleyenne de la métaphysique, sur la place qu'elle occupe dans l'économie de sa pensée, et tente ainsi d'éclairer la contribution de Berkeley à l'histoire de la notion de métaphysique à l'époque moderne. Nous montrons que la critique berkeleyenne de la métaphysique n'empêche pas Berkeley de maintenir sa pertinence théorique, si (...) l'on rapporte sa conception de la métaphysique à la transformation qui affecte celle-ci après Descartes, et qui en fait la science des principes de la connaissance humaine. Cette étude entend donc réévaluer la place de la métaphysique dans l'oeuvre de Berkeley, et, simultanément, de mesurer l'apport de Berkeley à l'histoire de la métaphysique. (shrink)

The Animal Side is a manifesto on the importance of animals for human thought. It attempts to characterize the importance, for human beings, of the fact that animals exist. Adopting a philosophical and poetic approach, the book seeks to show that animals' ways of inhabiting the earth are, for human consciousness, an expansion and an exploration of what philosophers and poets have tried to name by speaking of the Open. Beginning with the story of an encounter with a deer on (...) a road at night, the book proceeds by showing that, beyond the diversity of animal life and the ways animals differ from human beings, there is a "layer of the perceptible" on which we all draw, humans and animals alike, in our own ways. At present, however, this layer itself is at risk. Thus the book can also be read as a defense and illustration of animals' modes of being, and as a plea for their survival. (shrink)

Sans interroger la signification de cette équivalence, la présente étude examine la manière dont la postérité, de Locke et Malebranche jusqu’aux Lumières, récuse les principales affirmations qu’implique le dire cartésien. L’ ego se libère d’une substance devenue inutile autant qu’invisible. Les nouvelles figures du moi incarnent à leur manière la (...) mutation, si ce n’est la crise de la métaphysique. Un motif originairement cartésien (le fait que la substance ne nous affecte pas immédiatement), explique paradoxalement la récusation du cartésianisme lui-même. (shrink)

Résumé Cette étude se propose de confronter les pensées de Schelling et de Nicolas de Cues, bien que rien n’atteste que le premier ait connu le second. L’intérêt de cette confrontation réside alors dans la manière dont chacun traite, avec les moyens qui lui sont propres, une même problématique, celle de l’articulation entre unité, posée comme principe ontologique suprême, et totalité. Il apparaît que tous deux, pour y répondre, mettent en œuvre une conception « itérative » de l’identité, et mobilisent (...) le paradigme de l’image pour penser le statut des choses finies. Cette comparaison permet de constater que ces deux pensées de l’unité n’ont pas pour conséquence d’annuler toute multiplicité, mais réservent au contraire à la singularité une place centrale. Contra os atuais intérpretes de Kant, neste artigo tenta-se mostrar que Kant abandona a concepção tradicional de amizade como uma relação dentro de um grupo aberto, e o seu ideal é a amizade em relação a toda a humanidade. Para mostrar isso, é preciso diferenciar acuradamente os elementos psicológicos da amizade, que Kant assume das teorias da amizade anteriores e simplesmente desenvolve, dos elementos genuinamente morais (...) da amizade, de cujo tratamento Kant é o pioneiro. The concept of structure, operation, and functionality, as they may be understood by clinicians or researchers using neural transplantation techniques, are briefly defined. Following Stein & Glasier, we emphasize that the question of whether an intracerebral graft is really functional should be addressed not only in terms of what such a graft does in a given brain structure, but also in terms of what it does at the level of the organism.

It is time to challenge the issue of pleasure associated with the core of medical practice. Its importance is made clear through its opposite: unhappiness—something which affects doctors in a rather worrying way. The paper aims to provide a discussion on pleasure on reliable grounds. Plato’s conception of techne is a convenient model that offers insights into the unique practice of medicine, which embraces in a single purposive action several heterogeneous dimensions. In Aristotle’s Ethics, pleasure appears to play a central (...) role for action’s assessment and intensification. Pleasure is also tightly associated with the Kantian faculty of reflective judgment, which operates at the heart of clinical reasoning. Indeed, practicing medicine means to deal with the particular and the manifold, requiring clinical judgment, but also relying on embodied habitus . With Bourdieu’s notion of habitus , pleasure is the mark of a happy practice, which presupposes a deep involvement in one’s field. Throughout our inquiry, the question of pleasure comes to offer a critical reappraisal of real medical practice and leads to consider ethics more as a component of techne than as a separate realm of concern. This volume presents an extended version of the contributions presented at the workshop "Kant's Concept of Law" held at the 26th World Congress of the International Association for Philosophy of Law and Social Philosophy (IVR) in 2013. It handles issues of applied legal philosophy in Kant's Doctrine of Right such as ownership, the alleged right of necessity, the right of resistance and the right of revolution. With each of these applied issues, the focus lies, on the one hand, on the (...) relationship between the principles a priori of law and of the duties of rights, as well as their normative requirements - for instance, the duty of independence from the coercion by others - and, on the other hand, empirical situations and their pressing demands. Thus, this volume illustrates how Kant concretely conceives of the doctrine of "first metaphysical of the doctrine of right" as supplying "the immutable principles for any giving of positive law". Each essay of this volume not only undertakes a careful and original interpretation of Kant's theses, but also offers a critical assessment. (shrink)

Kant nimmt in der Einleitung zur Metaphysik der Sitten eine Einteilung in innere und äußere Gesetzgebung vor. Beide leitet er aus demselben in der Grundlegung zur Metaphysik der Sitten formulierten kategorischen Imperativ ab, und fügt Letzterem weitere Elemente einer Grundanthropologie hinzu, die das Material für die einzelnen Teile der Rechts- und Tugendlehre darstellen. Die Zusammenhänge zwischen Rechts- und Tugendlehre sind aber komplexer als die Einteilung in äußere und innere Gesetzgebung es nahelegt. Sie teilen etwa dieselben Anwendungsmethoden und Metaphern, und bei (...) einer näheren Untersuchung der einzelnen Teile erweist sich diese Einteilung als entweder problematisch oder unscharf. In der Textinterpretation der einzelnen Beiträge kommen die genannten Zusammenhänge und Beziehungen zum Vorschein – insbesondere weil ein Teil der Autoren dieses Bandes zum Kommentar beider Werken beiträgt. Ein weiterer Schwerpunkt dieser Textinterpretationen liegt bei der kritischen Untersuchung des Ertrags dieser Werke für die entsprechenden heutigen Debatten und die Auseinandersetzung mit heutigen im weiten Sinne „Kantischen“ Positionen. La « reprise » de Diderot accompagne la résurrection du roman que Grimm avait enterré, sans se soucier des affirmations contradictoires qui en résultent. La philosophie antique et, spécialement, les différentes versions du néoplatonisme ont fourni à la spéculation trinitaire de nombreux instruments théoriques. Parmi eux, le concept d’existence occupe une place éminente, notamment dans le De Trinitate de Richard de Saint-Victor. Après avoir pris acte des difficultés liées à l’emploi du concept de personne, Richard utilise avec une lucidité inégalée les ressources théoriques qu’offre la structure singulière du terme « ex-sistentia », et le mobilise pour penser l’être du Christ, comme ce qui, tout (...) à la fois, provient du Père et subsiste en tant que personne autonome. En Dieu, l’existence s’avère seule en mesure de penser la singularité des personnes sans compromettre leur égalité et l’unité de son essence. C’est donc grâce à la théologie trinitaire que l’existence accède tout d’abord à son propre destin en métaphysique. (shrink)

Contrariamente à visão tradicional de Kant como um puro retributivista, as interpretações recentes da teoria kantiana da pena propõem uma teoria mista da retribuição e prevenção geral. Embora ambos elementos sejam literalmente corretos, tentarei mostrar os limites de cada um deles. Sustentarei que a teoria kantiana da pena não é consistente com seu próprio conceito de lei. Proponho, então, uma outra justificação para a pena: especial e reabilitação. A crítica kantiana do utilitarismo não afeta essa alternativa, que tem, outrossim, apoio (...) em Kant e é totalmente consistente com sua própria concepção de lei. (shrink)

Nul ne disconvient de l’existence d’un malaise dans la médecine contemporaine, mais les points de vue divergent concernant ses causes. Notre analyse prend comme point de départ le discord entre l’expérience vécue du malade et le statut de patient inauguré par la rencontre médicale, pour suggérer l’existence d’un motif de basse continue à une dysharmonie qui n’est pas la seule conséquence du contexte actuel, mais qui tient à un hiatus irréductible. Les mouvements tendanciels destinés à « corriger le tir » (...) risquent de manquer leur but, faute d’avoir pris en considération le caractère inévitablement bancal de la pratique médicale. Faisant retour sur ce qui « a lieu » dans la consultation, la question initiale en vient à être déplacée : conviendrait-il, tout bien considéré, de ne pas trop (chercher à) comprendre le malade? Le livre d’Anatole Lucet, issu de sa thèse de doctorat, soutenue en 2018 à l’ENS de Lyon, constitue la première monographie consacrée à la pensée du socialiste anarchiste allemand Gustav Landauer (1870-1919). Le fait qu’il s’agisse là d’un travail sans équivalent, y compris dans le pays d’origine de cet auteur, suffirait à lui seul à justifier l’existence d’un tel ouvrage. En se basant sur le cours consacré à Fichte par Bergson en 1898, l’auteur commente l’image médiatrice par laquelle en 1907, dans L’évolution créatrice, le philosophe français exprime l’intuition philosophique du fichtéanisme. Il en ressort que Bergson décèle dans la philosophie de Fichte la présence de deux philosophies : une philosophie originale, idéaliste et subjectiviste, et une philosophie opposée, d’essence mystique, moins originale parce que commune à l’ensemble de la pensée « alexandrine ». Ces deux philosophies définissent pour Bergson deux (...) aspects d’une même pensée prise soit à l’état de contraction soit à l’état de détente ; et l’auteur suggère de voir dans cette distinction entre un alexandrinisme « contracté » et un alexandrinisme « en détente » un principe de l’interprétation bergsonienne de l’histoire dé la philosophie.On the basis of the lecture that Bergson gave in 1898 on Fichte, the author comments the mediating image by which in 1907, in L’évolution créatrice, the French philosopher expresses the philosophical intuition of the Fichteanism. From this study emerges the fact that Bergson discerned two philosophies in the Fichtean philosophy : an original philosophy, idealist and subjectivist, and an opposite philosophy, mystic, but less original for the reason that it is common to the whole Alexandrian thinking. According to Bergson, these two philosophies characterize two faces of an identical thinking, considered whether in a contracted state or in a relaxed one ; in this distinction between a « contracted » Alexandrinism and a « relaxed » Alexandrinism the author suggests seeing a principle that Bergson employed for interpreting the history of philosophy.
