In this paper we highlight the racialized effects of agricultural labor laws on Southeast Asian family farmers in California’s Central Valley. We show how agricultural labor laws intended to protect farmworkers on industrial farms discriminate against and challenge small Southeast Asian refugee farmers. Hmong, Iu-Mien and Lao family farmers rely on cultural practices of labor reciprocity and unpaid help from extended family and clan networks to sustain the economic viability of their farms. This kind of labor sharing, a central tenet (...) of their customary farming practices, and a cornerstone of the American family farm ideal, is illegal in California agriculture. We examine the historical context that gave rise to agricultural labor regulations in California and the ways in which these regulations are both under-enforced and unevenly enforced, differentially impacting immigrant family farms, while failing to protect those for whom the laws were originally intended. In highlighting how employment and labor laws and their enforcement or lack thereof discriminate against Southeast Asia farms, this study illustrates how other “small family farms” reliant on volunteerism or labor-sharing arrangements, part of the emergent “sharing economy,” may be confronting similar legal conundrums to those faced by Southeast Asian farms. Launched by the United Nations in 2000, the Global Compact (GC) promotes private sector compliance with 10 basic principles covering human rights, labour standards, the environment, and anti-corruption. Its sponsors aim to establish a global corporate social responsibility (CSR) network based on a pledge to observe the 10 principles adopted by companies across the range of company size and regional origin, backed by a modest reporting system and collaborative programmes. The author analyzes the GC's progress toward building a global network (...) from its launch through 2006 and finds that, while the GC's nominal membership base of nearly 3000 companies makes it the largest system among collective action institutions (CAIs) for corporate responsibility, the GC has not reached 'critical mass'. Deficiencies in its nascent global network include limited market penetration among the largest corporations, a membership heavily weighted toward Western European companies, and major weaknesses in compliance with its reporting system. The author concludes that the GC must improve both penetration and compliance if it is to succeed in building a global standard for CSR. (shrink)

Different notions of truth imply and encourage different ideals of thinking, knowledge, meaning, and learning. Thus, these concepts have fundamental importance for educational theory and practice. In this paper, I intend to draw out and clarify the notions of truth, knowledge and meaning that are implied by P4C's pedagogical ideals. There is some disagreement amongst P4C theorists and practitioners about whether the community of inquiry implies either relativism or absolutism. I will argue that both relativism and absolutism are incompatible with (...) P4C, as neither one of them can facilitate all of P4C's ideals of reflective thinking, community, fallibilism, care, open-mindedness, empathy, and meaningfulness. I will argue that P4C incorporates Dewey's middle ground position between relativism and absolutism. (shrink)

Insofar as lyric has been conceptualized as the subjective genre of poetry—invested in inner processes and states of feeling and thought in distinction to epic’s investment in external action—critical interest has revolved around the lyric I and especially questions of apostrophe and address. The implications of this investment range from Marxist critiques of lyric and bourgeois individuality to theoretical debates about the relation between the historical and lyric subject. What would it mean, however, to consider the presence of a lyric (...) it? In this essay I consider how it can disclose a diverse set of lyric conventions—conventions that begin at the intersection of grammar and rhetoric but come to bear on larger philosophical and literary questions. Rather than defining it, poets often withhold its meaning, mining the hyperflexibility of the pronoun, its ability to be referential or dummy, context-dependent or not. Poets do this to make affective claims on their reader. At the same time, it can track a process in which lyric speakers attempt to get outside themselves to grasp their own subjectivity. (shrink)

There are three ways to refer to a fact from the complement of afactive verb: (1) Via abstract object anaphoric reference, or, witha full sentential complement that will be interpreted either (2) asa bound presupposition or (3) as triggering a presupposition of afact that will have to be accommodated. Spoken corpus examplesreveal that these three possibilities differ in relation to thetype of information they tend to contribute, and this has twoeffects. First, the information status of the fact and its role (...) inthe discourse seem to affect the preference for one constructionover another in a particular context. Second, presupposed factivecomplements that need to be accommodated tend to be hearer-new andthe focus of the utterance, meaning that information structureseems to contribute to the felicity of accommodation ofpresupposed facts. What virtues do good stewards typically have and can these virtues move people to be good stewards of nature? Why focus on the virtues of stewards rather than on trying to construct and defend morally obligatory rules to govern human behavior? I argue that benevolence and loyalty are crucial for good stewardship and these virtues can and do motivate people to act as good stewards of nature. Moreover,since it is a matter of dispute whether rational considerations can move us to (...) perform a given act in the absence of disposition to do so, I argue we should try to determine which moral dispositions (if any) will motivate people to be concerned for the environment so that the development of environmentally sensitive character may be encouraged. Only two articles in the past century have attempted reconstructions of this play: Gilbert Norwood in 1930 conjectured a basis in tragic burlesque, specifically a parody of Aeschylus’Edoni, due largely to the presence of Dionysus and a chorus of Babylonians. An entirely different plot was proposed in 1983 by David Welsh, who took as his starting point Herodotus’ account of the fall of Babylon; he thought that the chorus, envisioned as a group of refugees from the Persian empire, reflected the (...) recent arrival in Athens of the grandson of the Persian primarily credited with the capture of Babylon. Though commentators on Aristophanic comedy and politics often affect to be on firm footing about this play, the total dissimilarity of these two reconstructions actually highlights our ignorance. Book synopsis: The latest volume of the critically acclaimed Library of Living Philosophers series is devoted to the work of analytic philosopher Donald Davidson. Following the standard LLP format, Davidson discusses his life and philosophical development in an intellectual autobiography. This is followed by 31 critical essays by distinguished scholars; Davidson replies to each of these essays. Although Donald Davidson is considered an analytic philosopher, his thought straddles many areas of philosophy. One of his greatest contributions is the development of (...) a philosophical system based on his theory of mind and language, but he has also worked on theory of action, philosophy of language, decision theory, psychology, epistemology, ethics, the concept of truth, and the concept of objectivity. Davidson is a former Carus Lecturer who has held more than twenty distinguished lectureships and research fellowships at universities in this country and abroad, including Queens College, Stanford, Princeton, and the University of Peru. The passing of the Patient Protection and Affordable Care Act is a triumph for the field of public health. Its inclusion of many provisions intended to prevent illness and promote health endorses the core belief of public health as expressed by Dr. Georges Benjamin, the long-time executive director of the American Public Health Association, in a Washington Post opinion piece praising ACA for “provid[ing] care as far upstream as possible… [in order to] reduce costs by identifying problems early and then (...) managing them to reduce or eliminate the need for more costly care in the future.” In this article, I consider the conflict between ACA’s adoption of public health goals seeing population health and societal interests in protecting individuals from discrimination based on their health. The article focuses on one aspect of ACA which seeks to lower the costs to employers who provide health insurance for their employees by making it easier for them to offer their employees substantial incentives for participating in and meeting the goals of employer-sponsored Wellness Programs. The molecular mechanism of temperature‐dependent sex determination (TSD) is a long‐standing mystery. How is the thermal signal sensed, captured and transduced to regulate key sex genes? Although there is compelling evidence for pathways via which cells capture the temperature signal, there is no known mechanism by which cells transduce those thermal signals to affect gene expression. Here we propose a novel hypothesis we call 3D‐TSD (the three dimensions of thermolabile sex determination). We postulate that the genome has capacity to remodel (...) in response to temperature by changing 3D chromatin conformation, perhaps via temperature‐sensitive transcriptional condensates. This could rewire enhancer–promoter interactions to alter the expression of key sex‐determining genes. This hypothesis can accommodate monogenic or multigenic thermolabile sex‐determining systems, and could be combined with upstream thermal sensing and transduction to the epigenome to commit gonadal fate. a few months into the covid-19 pandemic, Marilyn Fischer and Judy Whipps were commiserating about an isolated future that seemed to stretch out with no end in sight. They came up with the idea of starting their own Scholars Circle, inspired by the November 2019 Feminist Pragmatist Colloquium in Rochester, New York. At that conference, participants could submit abstracts of work at any stage of development. Participants were grouped in small circles of three or four, with each person sharing their (...) work and giving feedback and suggestions to the others. Pickering & Garrod's (P&G's) mechanistic theory of dialogue attempts to detail the psychological processes involved in communication that are lacking in Clark's theory. By relying on automatic priming and alignment processes, however, the theory falters when it comes to explaining much of dialogic interaction. We argue for the inclusion of less automatic, though not completely conscious and deliberate, processes to explain such phenomena.

Prior to her tenure in the Church of Sweden as Bishop of the Diocese of Lund and now the Archbishop of the Church of Sweden, Jackelén served as professor of Systematic Theology, Director of the Zygon Center and President of European Society for the Study of Science and Religion (ESSSAT). While each essay intentionally embraces the theological and ministerial work of Jackelén during her academic tenure, they also venture into areas as diverse as climate change, media studies, human uniqueness, hermeneutics, time, ethics, Christian theological tradition and history, traumatology, politics and society. As the first diverse explication of the theological thinking of Archbishop Jackelén by her theological colleagues, this text provides scholars with an expansion of the scope of Archbishop Jackelén's theological thinking and initiates laity into the impact of Jackelén thinking that combines with grace and precision the traditions of the Church, the challenges and gifts of the sciences, and the needs and longings of society and the world. Hegel’s “Absolute Knowing” and Shakespeare’s Troilus and Cressida are tragi-comic consternations. They are theatres of ethical panentheism: they present dramatic “absolute” ethical interpretations and actions, each of which is at once ungrounded and completely seeded. I start with the etymology of “consternation.” Then I discuss the comic vs. tragic interpretations of Hegel’s Phenomenology of Spirit, arguing it is a consternating tragi-comedy. I analyze the predicate “absolute” in terms of consternations, in a few passages of the book. I elaborate especially upon (...) phenomenological reasoning’s Sache selbst. In the Phenomenology, reason develops by thinking the absolute thing through culture, politics, morality, and religion, reaching completion in “Absolute Knowing.” That absolute is reason’s comprehensive insight into its phenomenological absolutes, and its own absolute sublating. Northrop Frye’s cited claim about myth can be understood in this phenomenological way. With all this in hand, Hegel’s science of experience is formally complete. But the experience of Absolute Knowing is still consternation. To capture the consternating essence of sublation – a consternation by which experience becomes something it was not before – I season this formal science with Shakespeare’s “comedy” Troilus and Cressida, revealing its structural roots to be consternations. Given the importance of imagination for Kant, Fichte and Schelling, it is significant that the word only comes up once in Hegel's Phenomenology of Spirit, and that it is not a chapter heading alongside "Sense-Certainty," "Perception," "Understanding" and "Reason." ;Part I. "Imagination in Theory" looks at the development in Hegel's theory of imagination from the Differenzschrift and Faith and Knowledge, through three different versions of the Philosophy of Spirit . Part II. "Imagination in Practice," focuses on the final moment of (...) the imagination according to the 1830 Philosophy of Spirit--Sign-making Phantasie. I discuss two examples--the artist's activity as described in the Aesthetics, and the 'religion of imagination'--Hinduism as Hegel understood it in the Lectures on the Philosophy of Religion. Part III synthesizes the two previous parts, showing that the Phenomenology of Spirit is the culmination of the imagination's theoretical and practical activity: while in theory imagination is the middle moment of Vorstellen, practically it is at the heart of Aufhebung and thus of Spirit's inception and development. The Phenomenology is the story of consciousness' progress through its self-presentations. Imagination is therefore present throughout the entire book. I do not engage the moments of the Phenomenology, but focus instead on the single appearance of the word imagination in the Preface, and on how Hegel reinterprets Fichte's wavering imagination as a moment within the reflection--the "medium" of this 'Science of Experience.' ;Between 1801-1807 language becomes an increasingly important moment of imagination; by 1830 the externalizing of representations in communication is a moment of imagination. Hegel's psychology of the genesis of imagination and its moments reveals Spirit to be the community of interpreters. In the thesis Hegel's imagination is thought through to the Phenomenology, however, it is in the final transition of the Phenomenology--from Religion to Absolute Knowing, from picture thinking to knowing according to the Concept--that Hegel thinks the imagination through to its end. Recent scandals such as those involving Enron and WorldCom (USA), Nortel and Crocus (Canada), and Parmalat and Royal Ahold (EU) exposed failures in corporate governance that shook the capital markets in developed countries and put the spotlight on weak corporate governance in developing, emerging and transitional economies. Companies from developing economies with weak financial transparency and governance will find it difficult to raise capital and attract foreign investors. We investigate the challenges and evaluate the progress of corporate governance in Egypt. (...) Using historical, empirical and interview data, we review the development of stock markets and accounting and financial reporting standards. We analyse the structure of capital markets, major players in the economy, the privatisation policy, board structure and the cultural and legal environment of corporate governance. We review initiatives and impediments for improving corporate governance, including the establishment of the Egyptian Institute of Directors. The implications of this study are important for Egypt, developing countries and global investors seeking international diversification. (shrink)

How are Christians to understand God’s grace for individuals in the midst of severe trauma, particularly in light of a global epidemic of sexual violence against so many women and children? How does the call to witness to the good news of Christ’s love translate into specific obligations that respond to the needs of sexual abuse survivors? The purpose of this article is to explore these questions in the context of Karl Rahner’s theology of grace. When seeking to understand God’s (...) gracious presence in the midst of sexual violation, it is particularly helpful to explore Rahner’s insight that God’s grace is mediated through acts of neighbour-love both within and beyond Christian communities. Such insight into the social mediation of grace has exciting potential to transform perceptions of what is at stake in loving our neighbour and the forms that neighbour-love can take, mobilising Christians for greater social justice in the service of God. In [2], we showed that the cellularity of the pseudo-tree algebra Treealg(T) was the maximum of four cardinals cT, lT, ϕT, and μT: roughly, cT is the "tallness" of T; lT is the "width" of T; ϕ is the number of "points of finite branching" in T; and μ is the number of "sections of no branching" in T. Here we ask: which inequalities among these four cardinals may be satisfied, in some sense, by (...) a pseudo-tree? We argue that theory-of-mind understanding has developed to facilitate joint thinking and planning, defined as the creation of new mental objects that could not have been created by one mind. Three components of this ability are proposed: the mental architecture indexed by false belief understanding, domain-specific knowledge, and the prioritization of the joint mind over the individual mind.

Questions regarding the nature of moral judgment loom large in moral philosophy. Perhaps the most basic of these questions asks how, exactly, moral judgments and moral rules are to be defined; what features distinguish them from other sorts of rules and judgments? A related question concerns the extent to which emotion and reason guide moral judgment. Are moral judgments made mainly on the basis of reason, or are they primarily the products of emotion? As an example of the former view, (...) Kant held all moral requirements to be derived from a principle of rationality (the categorical imperative). As an example of the latter, Hume famously claimed that reason is “the slave of the passions” and that moral judgments stem from the moral emotions. When addressing these issues, philosophers have largely relied on the traditional tools of philosophical analysis, along with introspection, anecdotal evidence and armchair speculation. In recent years, however, a rich body experimental psychology has emerged which, in the view of a growing number of philosophers, casts important new light on these venerable questions. Our aim, in this chapter, is to illustrate how empirical methods can help move traditional philosophical debates forward in interesting and important ways. Since space does not permit an exhaustive survey of the relevant experimental work, we will focus on a few of the most compelling examples. (shrink)

As Japan marks the 75th anniversary of World War II in 2020, Prime Minister Shinzo Abe did not offer a fresh apology and maintained that future generations should not have to keep apologizing for past mistakes. This paper uses the unresolved war issue of the military comfort women system as a context to discuss what it means for political apologies to be more than mere political gestures founded on political interests and discusses what it takes to facilitate forgiveness. It will (...) examine the features of a repentant wrongdoer who deserves forgiveness based on how one relates to one’s past wrongdoing in order to distinguish political apologies that are genuine from those that are mere gestures aimed at hasty reconciliation. This will be discussed through the works of Jacques Derrida and Vladimir Jankélévitch. Next, through Jankélévitch’s and Paul Ricoeur’s ideas of forgiveness, it will be discussed how matters of justice and forgiveness should be understood as well as how the history of past wrongs and injustice is necessary for a genuine apology and makes forgiveness possible. It is also a moral responsibility for both perpetrators and victims to remember history in order to achieve personal forgiveness as well as begin social and political reconciliation. (shrink)

The social conservatism of evangelical and fundamentalist groups includes their support for premarital sexual restraint, husband leadership, and father involvement. The authors explore whether religious conservatism affects work–family outcomes of men using the National Survey of Families and Households, 1988 and 1993 waves. The authors hypothesize that men from conservative households will make earlier transitions to adulthood, work fewer hours, and earn less money. Moreover, the belief in strong paternal involvement should lead religiously conservative men to spend more time in (...) housework and child care. Results show that conservative religious affiliation does not hasten the transition to adulthood among men. Current religious conservatism results in lower wages but not reduced work hours, and religious affiliation does not affect housework or child care. (shrink)

Against the historical backdrop of early Christian–Muslim apologetics in the Middle East, an apologetics that was overwhelmingly polemical in its scope, I consider the contribution of the mystics, in providing a dialogical model that would overcome the state of impasse that inter-religious debate had reached. Dialogue moves beyond the established polemical binaries of two rival belief systems, towards the clarification of defensible difference, in which the other is allowed to speak in all its polyvocality and even to impinge on the (...) truth claims of one’s own tradition. This paper claims that how economists actually treat the consumption function, both theoretically and empirically, seems to be at odds with traditional structural realism. While economics aims to find out the way the world actually is, economic theory – including theoretical staples such as the consumption Euler equation – do not always state literal truths. Yet, such methods persist. Our investigation will reveal that the Euler equation is deployed as part of a realist methodology to identify scale-dominant behaviors. These analyses (...) permit the economist to conduct counterfactual reasoning and sometimes (via policy) to intervene on the world itself; the implication is when this is successful, the economist has uncovered real structure. These issues include the violation of the presumption of innocence, privacy interests, humiliation, extortion, and sensationalizing crime. These websites lend comparison to Bedlam asylum, which allowed visitors to mock and humiliate the patients. The popularity of these websites renders it essential that the legality and ethics of these websites be reevaluated. The deontological and utilitarian perspectives offer converging assessments regarding (...) the need to regulate the industry and to modify the practices of law enforcement agencies and news organizations. Does Dietrich Bonhoeffer's Ethics have any affinities with what we have now come to call virtue ethics? If so, what is the relationship between those affinities and the more widely recognized influence of Karl Barth? Moberly seeks to answer these questions through close analysis of the Ethics and engagement with other interpreters of Bonhoeffer, while discussing the nature of virtue ethics in a Christian context. The answers may be surprising, but they are certainly rewarding for anyone wanting to better understand (...) Bonhoeffer and to see how his work could be helpful for current ethical debates. We consider whether given a simple, finite description of a group in the form of an algorithm, it is possible to algorithmically determine if the corresponding group has some specified property or not. When there is such an algorithm, we say the property is recursively recognizable within some class of descriptions. When there is not, we ask how difficult it is to detect the property in an algorithmic sense. We consider descriptions of two sorts: first, recursive presentations in terms of (...) generators and relators, and second, algorithms for computing the group operation. For both classes of descriptions, we show that a large class of natural algebraic properties, Markov properties, are not recursively recognizable, indeed they are \-hard to detect in recursively presented groups and \-hard to detect in computable groups. These theorems suffice to give a sharp complexity measure for the detection problem of a number of typical group properties, for example, being abelian, torsion-free, orderable. Some properties, like being cyclic, nilpotent, or solvable, are much harder to detect, and we give sharp characterizations of the corresponding detection problems from a number of them. We give special attention to orderability properties, as this was a main motivation at the beginning of this project. (shrink)
