In pornography, standard modelling contracts often require a performer to surrender rights over their public image and sexual media in perpetuity and across mediums. Under these contracts, performers are unable to determine who accesses, for what duration, and under what conditions, their sexual media. As a result, pornography has been described by some performers as a “life sentence” - a phrase which, if true, violates some strong intuitions we share about the importance of autonomy in sexual activity. Using the framework (...) of “affirmative consent,” I argue that these contracts violate performers' rights to sexual autonomy, and ought therefore to be considered objectionable. Overall, I argue that the legal regimes we create have a strong impact on people’s lives, and more important than legislating individual outcomes, the type of infrastructure we build around people’s decisions has the potential to radically empower - or disempower - those engaged in sex work. Who is feminism for? The question reverberates frightfully in feminist discourse. Despite decades of theorizing that the unified feminist subject is an impossibility (given differences in race, class, sexuality, etc.), the question remains all too relevant in praxis—much to the detriment of the movement as a whole. Or at least, so argues Éléonore Lépinard in her new book, Feminist Trouble: Intersectional Politics in Post-Secular Times.

Informed consent is a necessary component of the ethical practice of surgery. Ideally, consent is performed in a setting conducive to a robust patient-provider conversation, with careful consideration of risks, benefits, and outcomes. For patients with medical or surgical emergencies, navigating the consent process can be complicated and requires both careful and expedited assessment of decision-making capacity. Objectives To review the extant literature on HIV criminal laws, and to determine the impact of these laws on public health practice.Methods The available research on this topic was obtained and reviewed.Results The extant literature addressed three main topics: people's awareness of HIV criminal laws; people's perceptions of HIV criminal laws; and the potential effects of HIV criminal laws on people's sexual, HIV-status disclosure and healthcare-seeking practices. Within these categories, the literature demonstrated a high level of awareness of HIV criminal (...) laws, but a poor comprehension of these laws. For perceptions, on the whole, the quantitative research identified support for, while the qualitative literature indicated opposition to, these laws. Lastly, the behavioural effects of HIV criminal laws appear to be complex and non-linear.Conclusions A review of the extant literature from a public health perspective leads to the conclusion that HIV criminal laws undermine public health. Research has shown that individuals with high levels of psychopathic personality traits are likely to cause harm to others in the workplace. However, there is little academic literature on the potentially adaptive outcomes of corporate psychopathy, particularly because the “boldness” psychopathy domain has largely been under-acknowledged in this literature. This study aimed to elaborate on past findings by examining the associations between psychopathy, as operationalized using scales from the relatively new triarchic model of psychopathy, and both adaptive and maladaptive workplace (...) behaviors. Participants were 343 working community adults who completed a series of self-report questionnaires that measured psychopathy and various workplace behaviors, including counterproductive work behaviors, tactics of influence, unethical decision-making, leadership strategies, team play, and creativity. Structural equation modeling was used to estimate the associations between latent constructs of boldness, meanness, and disinhibition, and the eight different constructs related to workplace behaviors. It was found that boldness preferentially predicted the use of soft tactics of influence, adaptive leadership, and team play, and negatively predicted passive leadership. Meanness predicted unethical decision-making, poor team play, and hard tactics of influence. Disinhibition positively predicted CWB and passive leadership. Meanness also moderated the association between disinhibition and CWB, in that greater scores on both psychopathy domains indicated greater levels of CWB. These findings provide conceptual support for the triarchic model, including the “boldness” domain, which measures adaptive aspects of psychopathy in addition to maladaptive ones, as well as suggest that not all individuals high on psychopathy would be an overt menace to the workplace. The different psychopathy traits may also interact with each other to predict different types or levels of workplace behaviors. (shrink)

Background: The development of implicit tests for measuring biases and behavioral predispositions is a recent development within psychology. While such tests are usually researched within a social-cognitive paradigm, behavioral researchers have also begun to view these tests as potential tests of conditioning histories, including in the sexual domain. Objective: The objective of this paper is to illustrate the utility of a behavioral approach to implicit testing and means by which implicit tests can be built to the standards of behavioral psychologists. (...) Design: Research findings illustrating the short history of implicit testing within the experimental analysis of behavior are reviewed. Relevant parallel and overlapping research findings from the field of social cognition and on the Implicit Association Test are also outlined. Results: New preliminary data obtained with both normal and sex offender populations are described in order to illustrate how behavior-analytically conceived implicit tests may have potential as investigative tools for assessing histories of sexual arousal conditioning and derived stimulus associations. Conclusion: It is concluded that popular implicit tests are likely sensitive to conditioned and derived stimulus associations in the history of the test-taker rather than ‘unconscious cognitions’, per se. A similar myopia often afflicts legal minds as they approach deep-seated problems in global health, as every crisis is approached by first asking how it might be litigated away. In recent years, there has been a growing recognition of the limits of litigation as a tool for advancing equitable access to health — indeed of its potential, under some circumstances, to have a positively regressive impact. In this article, we describe a project in which philosophy, in combination with methods drawn from mental modeling, was used to structure dialogue among stakeholders in a region-scale climate adaptation process. The case study we discuss synthesizes the Toolbox dialogue method, a philosophically grounded approach to enhancing communication and collaboration in complex research and practice, with a mental modeling approach rooted in risk analysis, assessment, and communication to structure conversations among non-academic stakeholders who have a common interest in planning for (...) a sustainable future. We begin by describing the background of this project, including details about climate resiliency efforts in West Michigan and the Toolbox dialogue method, which was extended in this project from academic research into community organization involving the West Michigan Climate Resiliency Framework Initiative. This extension involved application of several methods, which are the focus of the Methods section. We then present and discuss preliminary results that suggest the potential for philosophical dialogue to enhance mutual understanding in complex community initiatives that focus on sustainable responses to climate change. Overall, the article supplies a detailed, instructive example of how philosophy can support policy-relevant decision-making processes at the community level. (shrink)

Controversy persists over the ethics of compensating research participants and providing posttrial benefits to communities in developing countries. Little is known about residents' views on these subjects. In this study, interviews about compensation and posttrial benefits from a hypothetical HIV vaccine trial were conducted in Uganda’s Rakai District. Most respondents said researchers owed the community posttrial benefits and research compensation, but opinions differed as to what these should be. Debates about posttrial benefits and compensation rarely include residents' views like these, (...) but future ones should. (shrink)

Este artigo investiga as diferentes concepções de “Sujeito” de acordo com o corpus teórico do filósofo Paul B. Preciado. As categorias analisadas são: os processos subjetivos e técnicos de sujeição social e servidão maquínica na era farmacopornográfica; o sujeito Playboy e petrosexorracial; a Multidão, seus múltiplos devires e as micropolíticas de resistência à opressão; a metamorfose dos sujeitos em agentes revolucionários e os simbiontes políticos, postulados por Preciado em seu mais recente livro publicado, Dysphoria mundi. Como Preciado articula todas estas (...) concepções, considerando ainda as linhas de fuga da submissão, isto é, o horizonte filosófico de resistência onto-epístemo-política, metamorfose e até a possível superação da dominação capitalística? Os procedimentos metodológicos foram baseados na pesquisa bibliográfica (livros, artigos e crônicas), de modo a evidenciar o contraste, as semelhanças, diferenças e interstícios entre a teoria de Preciado e as suas principais referências. Os resultados obtidos indicam uma linearidade consistente entre-categorias, os desafios em materializar as teorias revolucionárias na realidade cotidiana, bem como estratégias práticas que contribuem para a organização ontopolítica proposta por Preciado. Pierre Bourdieu’s framework of habitus, field and doxa is useful in studying the world of such outsiders and exiles who shaped post-war sociology. Without an established canon of sociology, these students typically developed critical and creative perspectives on society. (...) In Britain the post-war welfare state was the foundation of this new breed of academics. John O’Neill is the classic example. In America ‘The Disobedient Generation’ were influenced by race, the Vietnam War, and the draft. William Connolly and Stephen Turner provide two case studies of highly successful academics who were often subjectively outsiders. ‘Event’ and ‘hazard’ imply that successful careers are in fact merely accidental. En el presente artículo realizamos un análisis del estatus ontológico de la noción de psicopatología que se deriva de cuatro aproximaciones metodológicas a su estudio, a saber: aproximación psiquiátrica, fenomenológico-existencial, constructivista-histórica y antipsiquiátrica. Por medio de una metodología de revisión bibliográfica sistematizada y siguiendo el marco de trabajo metaframework ReSiste-CHS (Revisiones Sistematizadas en Ciencias Humanas y Sociales), sostendremos que dicha noción presenta divergencias en al menos tres puntos: (i) la relevancia de la sintomatología como característica, (ii) la existencia o inexistencia (...) del sufrimiento psíquico y (iii) la relevancia de los factores sociales en su configuración. En el apartado introductorio abordaremos las consideraciones históricas generales relacionadas con el estudio de los trastornos mentales. En el segundo apartado nos referiremos a la metodología empleada para la realización del artículo. En el tercer apartado expondremos los rasgos fundamentales de las cuatro metodologías de estudio mencionadas anteriormente, dividiendo la descripción en los siguientes puntos: orientación, etiología, clasificación, diagnóstico y tratamiento. En el cuarto apartado contrastaremos los conceptos de psicopatología que pueden ser extraídos de ellas. A modo de conclusión, propondremos una sistematización de las condiciones mínimas que debe cumplir una noción de psicopatología que sea fructífera desde un punto de vista teórico y práctico. Estas condiciones incluyen un posicionamiento crítico ante los extremos reduccionista y relativista, la consideración del sufrimiento psíquico como rasgo constitutivo y núcleo fundamental de este género de experiencia, así como una dimensión ética relacionada con su abordaje. Nosso objetivo é tomar o pensamento de Schopenhauer como estudo de caso e ponto de partida para discutir em que medida o “pessimismo” pode ser fundamentado e reinterpretado segundo “razões objetivas”, conceitualmente filosóficas. Para intérpretes como Christopher Janaway e Frederick Beiser, a legitimidade filosófica do pessimismo schopenhaueriano, atribuído à tese de que a vida é um negócio que não cobre os custos do investimento, é garantida pelas implicações inferidas da metafísica da Vontade. Por outro lado, Kuno Fischer, acompanhado dentre outros (...) por Bryan Magee, reinterpreta tal pessimismo a partir de “razões subjetivas”, pautadas em certas disposições de espírito ou preferências, como a relação conflituosa de Schopenhauer com sua mãe, por exemplo. A dificuldade em determinar mais precisamente a fundamentação do pessimismo de Schopenhauer redobra se considerarmos estudos que seguem uma tendência oposta e classificam esse autor como um “otimista”; Heinz Gerd Ingenkamp pode ser apontado como representante dessa vertente interpretativa. Se tal dificuldade se deve, como supomos a princípio, ao inevitável anacronismo que permeia a maior parte das discussões sobre o suposto pessimismo de Schopenhauer acerca do valor da existência, propomos minimizá-lo mediante um procedimento exegético que indicamos aqui ainda em linhas gerais. This dissertation is an investigation of the philosophic psychology of Mengzi , a Chinese Confucian of the 4th century B.C. As such, it is concerned with the role of desires, emotions, and practical reasoning in Mengzi's conception of self-cultivation and ethical flourishing. In chapter 1, I discuss why Mengzi is still worth studying by philosophers, certain hermeneutic issues, and the historical factors that account for some of the characteristic differences between Chinese and Western philosophy. ;In chapter 2, I proceed to (...) problems of philosophic psychology, examining Mengzi's views on desire and its role in both the perfected and developing moral agent. I also contrast Mengzi's attitude toward the role of desires with that of Xunzi in order to bring out what is distinctive of both views. ;Chapter 3 discusses the role of practical reasoning in the Mengzi. I first critique one important interpretation of the role of practical reasoning in the Mengzi--that of Kwong-loi Shun. Shun, developing some ideas implicit in the work of David S. Nivison, argues that Mengzi emphasizes analogical reasoning and consistency in ethical deliberation, but I attempt to demonstrate that the text will not support Shun's reading. I then proceed to offer my own view of Mengzian practical reasoning. I conclude that Mengzi is a sort of intuitionist, but of an interestingly different kind from classic Western intuitionists such as Sidgwick, Moore, and Prichard. ;Finally, in my appendix, I translate and comment upon some quotations which are attributed to Mengzi, but which are not found in the text of the Mengzi as it has come down to us. nnas' article is the first of three in a "Symposium on Ancient Ethics." She begins with the observation that ancient ethics are "eudaemonist" in form. That is, they assume "that each of us has a vague and unarticulated idea of an overall or final goal in our life," which we label eudaimonia or happiness, "and the task of ethical theory is to give each person a clear, articulated, and correct account of this overall goal and how to achieve it" (p. (...) 241; Annas defends this generalization, which is controversial as applied to Stoic and Epicurean ethics, in her The Morality of Happiness [Oxford, 1993]). Furthermore, whereas modern ethical theories (e.g., those of Kant and Sidgwick) typically distinguish between "moral reasoning" and "prudential reasoning," ancient ethical theories do not. How come? One "widespread" and "traditional" view (pp. 244, 245) is that ancient ethics assimilate morality to prudence: "ethical theory guides the agent from an intuitive, restrictive view of what is in her interests (money, power) to a more expanded and elevated view (the virtues)" (p. 244). This interpretation is sometimes joined with the claim that the Greeks took for granted what Nicholas White terms "fusionism": the view that individual good is not ultimately distinct from social or collective good (p. 245). However, Annas notes, ancient Greek literature provides ample illustration that "fusionism" was not taken for granted. (shrink)

The sociological debate about globalization has often neglected the place of religion in a global age. This absence is problematic, given the creative role of the world religions in the shaping of the modernization and globalization processes. This article treats globalization as a particular phase of the general process of modernity, and considers religion in terms of four paradoxes. The first (the Nietzsche paradox) argues that, against the received wisdom, fundamentalism is a form of modernization. Although religious fundamentalism may be (...) a reaction to the hybridity brought about by globalization, it is not a traditional reaction. The second (the Parsonian paradox) argues that modernization and globalization constitute religion as a special and separate institutional sphere of society, and hence transform religion into a problem of modernity. Fundamentalism attempts to reverse this pattern and, in the marginal societies of the global system, fundamentalist religion challenges this western version of modernized religion. The third (the McLuhan paradox) is that religious values in a global village expose the incommensurability of cultural systems, but relativism is not easily sustained in practice and globalization paradoxically increases the need for human rights universalism. While nationalism as a framework for cultures conflicts with attempts to develop general systems of rights discourse, it is not evident that the creation of alternative rights systems (such as Confucian codes) appears to be immediately viable. The final (the Montaigne paradox) explores the contradiction between Orientalism as a necessary consequence of the discovery of Otherness and Otherness as a necessary experience of cosmopolitan humanism. The article concludes with a discussion of the possibilities of cosmopolitan virtue in the context of these paradoxes of globalization and religion. (shrink)

Since 9/11, the possibilities for pluralism and tolerance have been severely tested by a discourse of terrorism and security. The development of an intelligent and cosmopolitan understanding between religious communities in Europe and America has been compromised by a range of legal and political responses to terrorism. While the debate about the berqa has clearly indicated the problems relating to Muslim cultural differences, we argue that legal pluralism and in particular the question of Shari’a tribunals may prove to be a (...) more decisive test of Western multiculturalism. This article examines the many criticisms raised against religious arbitration in domestic affairs and considers the presence of the Shari’a at various levels of society, claiming that the evolution of Sharia-mindedness is compatible both with a faith-based life and with liberal ideals. However, the problem with religious courts lies elsewhere, namely with the fragmentation of social life and the erosion of citizenship. The article concludes by examining the prospects and problems of Turkish entry into the European Union with special reference to the domestic policies of the Justice and Development Party. (shrink)

Wilderness Search and Rescue is the process of finding and assisting persons who are lost in remote wilderness areas. Because such areas are often rugged or relatively inaccessible, searching for missing persons can take huge amounts of time and resources. Camera-equipped mini-Unmanned Aerial Vehicles have the potential for speeding up the search process by enabling searchers to view aerial video of an area of interest while closely coordinating with nearby ground searchers. In this paper, we report on lessons learned by (...) trying to use UAVs to support WiSAR. Our research methodology has relied heavily on field trials involving searches conducted under the direction of practicing search and rescue personnel but using simulated missing persons. Lessons from these field trials include the immediate importance of seeing things well in the video, the field need for defining and supporting various roles in the search team, role-specific needs like supporting systematic search by providing a visualization tool to represent the quality of the search, and the on-going need to better support interactions between ground and video searchers. Surprisingly to us, sophisticated autonomous search patterns were less critical than we anticipated, though advances in video enhancement and visualizing search progress, as well as ongoing work to model the likely location of a missing person, open up the possibility of closing the loop between UAV path-planning, search quality, and the likely location of a moving missing person. This article argues that the 2010 short film Pumzi is an exploration of post-crisis, ecological rehabilitation that asks for a rethinking of narratives modes for representing climate change. Employing seeds and sowing as ecological tropes, Pumzi explores how we create and carry narrative in relation to a rapidly changing earth. Both the multi-scalar geographical expanses as well as the deep geological timelines of Anthropocene discourse mean that placing the human in relation to its post-crisis environment requires more collective notions of (...) what narrative production and world building mean. This article argues that Pumzi cultivates a sympoietic—making together—mode of storytelling in an age of environmental crisis and planet-death as a well to both tell new stories and to think future worlds. In this way, Pumzi offers us a vision of an afrofuturist eco-ethics based in narrative practice. (shrink)
