Passing the CCRI would completely eliminate affirmative action, and thus have the same effect as "throwing the baby out with the bathwater." The "baby" —active and affirmative commitment to equal opportunity— is barely out of its infancy. We must not now abandon our commitment, just when we have taken our first steps towards creating a truly equal opportunity society.” -/- (This essay was written against the backdrop of legislative efforts in the mid 1990s, to overturn “affirmative action” policies at educational institutions, which had given more equal access to higher education for students from previously under-represented communities, particularly white women but also racialized communities. By mischaracterizing affirmative action programs as “gender or racial preferences”, opponents were able to pass the 1996 ballot measure, Proposition 209, the so-called “California Civil Rights Initiative” (CCRI). The ban on “preferences” gained the support of 54.6% of all California voters, including 58% of white women and 66% of white men voters. Use of language was key, as a slight majority of Americans approved of some affirmative actions but opposed racial preferences. The CCRI has had a huge toll on Latino and African American enrollment at UC Berkeley and UCLA, which has never recovered. ObjectivesThis pilot study sought to develop and evaluate a novel online group-based intervention to help breast cancer survivors make healthy lifestyle changes intended to yield not only beneficial physical outcomes but also greater behavioral, and psychosocial well-being.MethodsAn exploratory single-arm, mixed-method triangulation design was employed to evaluate the feasibility and preliminary effectiveness of the HLM-ABC intervention for overweight BCSs. Fourteen women participated in the 10-week intervention and completed quantitative measures of the above-mentioned outcomes at baseline, post-treatment, 6-month, and 12-month follow-up time (...) points. Qualitative data were obtained post-treatment via semi-structured interviews and a treatment satisfaction questionnaire.ResultsParticipants lost an average of 2.83% of their baseline weight by 1-year follow-up, equal to a small effect size. Despite achieving only modest weight loss, participants achieved meaningful gains in the form of increased physical activity, discovery of gratifying movement, more intuitive eating habits, greater bodily and emotional awareness, and positive shifts in beliefs about being able to make healthy choices regarding food and physical activity. Furthermore, they demonstrated a slight improvement in body image and described feeling more self-compassionate, empowered, and acknowledging of variables beyond control that can present barriers to change.ConclusionAfter completing a 10-week online program, participants achieved meaningful and lasting changes on a number of healthful indicators, even when this did not correspond with a significant reduction in weight. Findings highlight the complex, multifaceted nature of “health” and lend support for promotion of healthier lifestyle following cancer treatment that encompasses not only physical weight, but also behavior, psychosocial well-being, and circumstances such as life-preserving hormonal treatments. We examined the efficacy of including a research intermediary (RI) during the consent process in reducing participants' perceptions of coercion to enroll in a research study. Eighty-four drug court clients being recruited into an ongoing study were randomized to receive a standard informed consent process alone (standard condition) or with an RI (intermediary condition). Before obtaining consent, RIs met with clients individually to discuss remaining concerns. Findings provided preliminary evidence that RIs reduced client perceptions that their participation might influence how (...) clinical and judicial staff view them. This suggests that using RIs may improve participant autonomy in clinical studies. (shrink)

Alterations to cognitive function are often reported with depression and anxiety symptoms, yet few studies have examined the same associations with mental well-being. This study examined the association between mental well-being, depression and anxiety symptoms and cognitive function in 1502 healthy adult monozygotic and dizygotic twins, and the shared/unique contribution of genetic and environmental variance. Using linear mixed models, mental well-being was positively associated with sustained attention, inhibition, cognitive flexibility, motor coordination and working memory, whereas depression and anxiety symptoms were (...) associated with poorer sustained attention, inhibition, cognitive flexibility and executive function. Bivariate twin modelling showed well-being shared a small environmental correlation with motor coordination and a small genetic correlation with working memory. Trivariate twin modelling showed well-being shared a small genetic correlation with inhibition, whereas depression and anxiety symptoms shared a small environmental correlation with inhibition. The remaining variance was mostly driven by unique G and/or E variance. Overall, well-being and depression and anxiety symptoms show both independent and shared relationships with cognitive functions but this is largely attributable to unique G or E variance and small shared G/E variance between pairs of variables. Moral distress is reported to be a critical force contributing to intensifying rates of anxiety, depression and burnout experienced by healthcare workers. In this paper, we examine the moral dilemmas and ensuing distress personally and collectively experienced by healthcare workers while caring for patients during the pandemic. Data are drawn from free-text responses from a cross-sectional national online survey of Australian healthcare workers about the patient care challenges they faced. Three themes were derived from qualitative content analysis that illuminated the (...) ways in which moral dilemmas and distress were relationally experienced by healthcare workers: (1) the moral ambiguity of how to care well for patients amid a rapidly changing work environment; (2) the distress of witnessing suffering shared between healthcare workers and patients; and (3) the distress of performing new forms of invisible work in the absence of institutional recognition. These findings reveal that moral distress was a strongly shared experience. Findings advance understandings of moral distress as a relational experience, collectively felt, constituted, and experienced by healthcare workers. Considering how to harness collective solidarity in effectively responding to moral distress experienced across the frontline healthcare workforce is critical. (shrink)

BackgroundCancer patients often suffer from psychological distress during or after cancer treatment, but the use of psycho-oncological care among cancer patients is limited. One of the reasons might be that the way psycho-oncological care is organized, does not fit patients’ preferences. This study aimed to obtain detailed insight into cancer patients’ preferences regarding the organization of psycho-oncological care.Methods18 semi-structured interviews were conducted among cancer patients. Patients completed psycho-oncological treatment between 2015 and 2020 at the psychology department in a general hospital (...) or a center specialized in psychological cancer care in the Netherlands. The interview comprised questions related to preferences regarding the institute where to receive treatment, the psychologist who provides treatment, and the type of treatment, as well as questions related to experienced barriers and facilitators to receive psycho-oncological care. Interviews were digitally recorded and transcribed verbatim. Data were analyzed individually by two coders into key issues and themes.ResultsRegarding the institute, easy accessibility and prompt availability of psychol-oncological care were considered important. Regarding the psychologist, most participants had a strong preference to be treated by a psychologist specialized in cancer or other somatic diseases. Individual face-to-face therapy was preferred above other types of treatment. Several barriers were mentioned to receive psycho-oncological treatment, among which poor accessibility to psycho-oncological care, lack of knowledge on the possibilities for psycho-oncological treatment, and stigma. Most frequently mentioned facilitators were being assertive to ask for help, having a good relationship with the healthcare professional, and the integration of psycho-oncological support within medical cancer care.ConclusionFrom the patient’s perspective, the organization of psycho-oncological care for cancer patients should focus on easy accessibility and availability, delivered by specialized psychologists, and integration in medical cancer care. Online and group therapy are acceptable, but individual face-to-face therapy is preferred. It is warranted to increase awareness on psycho-oncological care targeting both patients and healthcare providers. (shrink)

The authors focus on IVF technology to raise profound and disturbing questions about potentiality in the context of ex utero embryo. They explore different meanings of such notion. They suggest that the notion of potential is relatively clear in the context of naturally occuring process of pregnancy. But a laboratory embryo follows no “natural course”. It cannot become a person without the deliberate human act to transferring it to a uterus. Using an experience of animal perception and tracking as my guide, I track for the reader a recent sequence of readings and writings of mine, but not just my own. I want to show a map of an intellectual meander outward toward animality and toward the question of the ethical status of the non­human animal . With hindsight, we can spy the blind spots, blind corners, of a pursuit, intellectual or otherwise. Through this exercise, I want to try to illustrate (...) how that path of questions about the non-human animal in the first instance permits a suspension of attention to ourselves--the human animal--as contested moral subjects and an oblivion about that suspension. But, in the second instance, the questions posed by the animal, on the meander outward, lead to other questions which in turn make our oblivion so crystal clear that it calls our apparent naiveté and goodwill into question. The result is, literally, a sudden about-face which (re)contests ourselves--the human animal--as moral subjects. An implication of this paper is to call into question our adequacy, as epistemic agents, to the task of what feminist epistemologists call "critical self-reflection"; that is, knowing oneself more fully by perceiving what one is up to in ones line of questioning, catching oneself unawares in particular. My experience of tracking an animal and then finding myself suddenly being tracked by that animal casts what I hope is a useful doubt on the capacity of the isolated rational agent to accomplish a making-visible of what is invisible about her own perceptions; that is, reveals the very real limits of her evidence-gathering capacities. I want above all to argue that our own blind spots are disabled and critical self-reflexivity becomes possible, not by a willing and able isolated self but by a strange-making encounter wit h a non-self who stops us in our tracks. The final section of the paper focuses on two kinds of non-selfs who 'summons' us, and our capacities to hear one of these summons more readily than the other. It asks whether the question of the fetus is perhaps like the question of the animal, yet, even more than that of the animal, one that still cannot be heard or seen. (shrink)

There are resources in Heidegger’s work for identifying and mitigating pervasive modes of misrecognition that are characteristic of modern society, and, by identifying them, we become capable of attending to “supplementary” aspects of authenticity: terms of identity should apply to all in the same way, and, because these terms are a product of all, they are the responsibility of each individual. The first section analyses Being-guilty, Dasein-with, and Being-with to emphasise Dasein’s dependence on others, arguing that the dynamic of recognition (...) characteristic of Dasein implies a responsibility for recognising the other adequately. The second identifies common modes of misrecognition, arguing that these modes imply a shared responsibility for the contexts of recognition in which we participate. The third turns to Sartre’s work, arguing that our interpersonal relations offer resources for correcting our inadequate ways of recognizing one another and for recognizing the fundamental place of communication in the realization of human freedom. Unfortunately, those arguments demonstrate flawed reasoning—jumping to unfounded conclusions, using value laden language rather than careful argument, and ignoring morally relevant aspects of the situation. The influence of flawed abortion arguments on the stem cell debate results in failures of moral reasoning and in lack of attention to important morally relevant differences between abortion and human embryonic stem cells. The extraction of a pecuniary penalty for the recusancy of married women was a heavily contested issue in the Parliament of Elizabeth. Under the rules of coverture, married women controlled no property. It was thus ineffective to fine them, for they were unable to pay the penalty. As a result, the government attempted to hold husbands responsible for the penalties of their wives through the use of recognizances under the auspices of the Commissions for Causes Ecclesiastical, a prerogative court. Research (...) into the York Commission’s use of recognizances indicated that it had indeed been possible legitimately and legally to obtain a pecuniary penalty for the recusancy of a married woman by the 1570s. This was generally believed to have been legally impossible until they became obtainable by statute in 1593. Detailed examination of the records of the Commission indicates clearly that the depiction in the scholarly literature of the levying of these penalties as somehow improper or even illegal is erroneous. These forfeitures might have seemed irregular, but were indeed legitimate and obtained by proper and legal means in the context of contemporary standards of authority and control, both governmental and familial. This study demonstrates how respect for the standards of coverture, patriarchy, and marital obligations incorporated in the use of the recognizance provided a highly effective and legal means to penalise and correct both recusant wives and their husbands. Although the Doubts and Solutions belongs to the commentary tradi- tion on Plato's Parmenides, its structure and method make it in many ways unique among such exegetical works. The treatise positions itself, at least in part, as a response to Proclus' metaphysical system. (...) Thus the first principles alluded to in its title refer to a metaphysical structure consisting of five central elements, the Ineffable, the One, and the Noetic Triad, which Damascius both adumbrates in opposition to Proclus' as well as subjects to his own, internal critique. In this article, I will be asking whether or not Damascius' critique of Neoplatonic metaphysics is informed or inspired by ancient Scepticism. Damascius was head of the Neoplatonist academy in Athens when the Emperor Justinian shut its doors forever in 529. His work, Problems and Solutions Concerning First Principles, is the last surviving independent philosophical treatise from the Late Academy. It has never before been translated into English.
