I begin my analysis of consent by agreeing with Professor Hurd that consent functions as a “moral transformative” by altering the obligations and permissions that determine the Tightness of others' actions. I further agree with her that consent is intimately related to the capacity for autonomous action; one who cannot alter others' obligations through consent is not fully autonomous. I cannot improve on her elaboration of these points.

This piece is a review essay on Victor Tadros’s The Ends of Harm. Tadros rejects retributive desert but believes punishment can be justified instrumentally without succumbing to the problems of thoroughgoing consequentialism and endorsing using people as means. He believes he can achieve these results through extension of the right of self-defense. I argue that Tadros fails in this endeavor: he has a defective account of the means principle; his rejection of desert leads to gross mismatches of punishment and culpability; (...) and he cannot account for punishment of inchoate crimes. Sexual lust – understood as a feeling of sexual attraction towards another – has traditionally been viewed as a sort of desire or at least as an appetite akin to hunger. I argue here that this view is, at best, significantly incomplete. Further insights can be gained into certain occurrences of lust by noticing how strongly they resemble occurrences of “attitudinal” (“object-directed”) emotion. At least in humans, the analogy between the object-directed appetites and attitudinal emotions goes well beyond their psychological (...) structure to include similar ways in which their occurrence can be introspectively recognized, resulting in similar extensions of their functionality and meaningfulness to the subject. I conclude that although further research is needed, given the strength of the analogy, the ability of lust to satisfy some general requirements for being an emotion, and perhaps certain neurological findings, lust may somewhat uniquely straddle the line between appetite and emotion. This chapter briefly discusses the history of the notion of "cure" in relation to serious mental illnesses from Pinel to the present day, including both theories on the nature of the illnesses and the nature of presumed therapeutic agents and mechanisms. The chapter then gives a brief overview of the notion of "recovery" in relation to serious mental illnesses, also from Pinel to the present day, and describes various definitions and forms of recovery as they have emerged over time. With (...) this historical and conceptual background in place, the chapter then takes up the present state-of-the-art in psychiatry in relation to both concepts of cure and recovery, considers the empirical and neuroscientific evidence available relative to each concept, and then suggests several directions for research and philosophical reflection as the field continues to evolve. Two guiding principles that shape this discussion are that mental illnesses are not one-dimensional phenomena, but may be made up of several loosely related components which each have their own natural course, and that mental illnesses do not typically take over the entirety of a person's functioning, but also leave other aspects of functioning relatively intact. The combination of these principles suggests that cure and recovery are not likely to be binary functions in relation to serious mental illnesses, but will more likely be more a matter of degree across multiple domains. The intelligent-seeming deeds of computers are what occasion philosophical debate about artificial intelligence (AI) in the first place. Since evidence of AI is not bad, arguments against seem called for. John Searle's Chinese Room Argument (1980a, 1984, 1990, 1994) is among the most famous and long-running would-be answers to the call. Surprisingly, both the original thought experiment (1980a) and Searle's later would-be formalizations of the embedding argument (1984, 1990) are quite unavailing against AI proper (claims that computers do or someday (...) will think ). Searle lately even styles it a "misunderstanding" (1994, p. 547) to think the argument was ever so directed! The Chinese room is now advertised to target Computationalism (claims that computation is what thought essentially is ) exclusively. Despite its renown, the Chinese Room Argument is totally ineffective even against this target. (shrink)

VAN STADEN'S PAPER, "Linguistic Markers of Recovery," takes on a formidable task. As he explains it, findings from a previously conducted empirical study suggest that recovery from a psychiatric condition can be predicted by certain (...) patterns of first person pronoun usage. His current paper explains how these patterns follow the mathematical logic of Gottlob Frege. van Staden's attempt to systematize the link between language and treatment outcome shows promise. We want to support his effort by raising a few caveats about the application of foundational systems in psychiatry and psychology, particularly the advisability of employing a logical system to explain recovery from mental illness. Along the way, we will be identifying related issues that the author may elect to take up in his future work.van Staden's proposal is inspired by Frege's logical system, but the paper is, at the very least, an innovative adaptation. There are various points where we are left to wonder just how much of this proposal is really Frege's. Nevertheless, the genesis of van Staden's ideas is so dependent that one would expect a fuller account of Frege's pivotal role in the development of modern logic, how his work precipitated what is known commonly as the linguistic turn, and why a logical system that was so well received when first articulated was eclipsed so quickly by Russell's Principia (1963) and Wittgenstein's Tractatus. (1981) These issues can be addressed separately and perhaps they should, because lacking an account of how Frege's philosophy developed and evolved makes the presentation appear somewhat sketchy and incomplete.Frege is portrayed in philosophical lore as the founder of modern logic and a pioneer of the movement that later became known as analytic philosophy. Dummett (1991) regards Frege's Foundations of Arithmetic (1968) as analytical philosophy's first work (p. 111). According to Quine (1955), "All modern logic owes an incalculable debt to Frege. If anyone can be singled out as the founder of mathematical logic, it is by all odds he" (p. 158). Rorty (1967) notes that analytic philosophy's tack of construing philosophical questions as turning on language use and construction challenges the entire tradition, from Parmenides forward. However, the challenge reaches fruition not in Frege, but in works of Moore, Wittgenstein, and Austin. This collection of essays brings together jus post bellum and transitional justice theorists to explore the legal and moral questions that arise at the end of war and in the transition to less oppressive regimes. Transitional justice and jus post bellum share in common many concepts that will be explored in this volume. In both transitional justice and jus post bellum, retribution is crucial. In some contexts criminal trials will need to be held, and in others truth commissions and other (...) hybrid trials will be considered more appropriate means for securing some form of retribution. But there is a difference between how jus post bellum is conceptualized, where the key is securing peace, and transitional justice, where the key is often greater democratization. The authors address problems with “compulsory” arbitration clauses in contracts. Specifically, they note that consumers are misguided about their rights in such cases. In addition, arbitration clauses do not allow the press to cover any proceedings that may result. The arbitration clauses in contracts are written in legalese that consumers do not understand. The authors found that even university students had difficulty understanding the information in such clauses. An example of an actual case is included.

The abject failure of Turing's first prediction (of computer success in playing the Imitation Game) confirms the aptness of the Imitation Game test as a test of human level intelligence. It especially belies fears that the test is too easy. At the same time, this failure disconfirms expectations that human level artificial intelligence will be forthcoming any time soon. On the other hand, the success of Turing's second prediction (that acknowledgment of computer thought processes would become commonplace) in practice amply (...) confirms the thought that computers think in some manner and are possessed of some level of intelligence already.
