During history humans have developed a large variety of contemplative practices, in many different areas of life, and as part of many different traditions and contexts. Although some contemplative practices are very old, the research field of Contemplation Studies is young, and there are no agreed-upon definitions of central concepts such as contemplative practices and contemplative experiences. The present paper focuses on contemplative practices, defined as practices that are engaged in for the sake of the contemplative experiences they afford. The (...) purpose of the present paper is to discuss the potential of experimental phenomenology to contribute to the development of the research field of Contemplation Studies. Experimental phenomenology is defined as the investigation of phenomenological practices and their effects on experience. Phenomenological practices involve intentional variations of experiencing by means of changes in the direction of attention and the choice of attitude, typically as guided by verbal instructions or self-instructions. It is suggested that contemplative practices represent a subcategory of phenomenological practices. Two different varieties of experimental phenomenology are described and illustrated in the present paper: an informal variety which involves the development of new phenomenological practices by creative variation of procedures and observation of effects; and a more rigorously scientific variety, which involves the systematic variation of phenomenological practices in accordance with experimental designs to study their experiential effects. It is suggested that the development of contemplative practices during the ages is the result of an informal experimenting of the first kind; this variety of experimental phenomenology can also be used to develop personalized health interventions in a clinical setting. As to the more rigorously scientific experimental phenomenology, it is possible that it may lead not only to an improved understanding of general principles underlying contemplative practices, but also to a more systematic development of new contemplative practices. The experimental-phenomenological approach to contemplative practices is illustrated by various examples involving mindfulness, gratitude, receiving and giving. (shrink)

Det er en utbredt oppfatning at det økende prestasjonskravet i toppfotball fører til en svekkelse av moral og fair play-holdninger. Men hvordan tenker toppfotballspillere i forhold til ulike dilemmaer som oppstår på banen, og er det forskjeller mellom toppfotballspillere og spillere på lavere nivå? For å avklare dette gjennomførte vi en empirisk undersøkelse der vi intervjuet spillere og trener i én toppklubb og én breddeklubb. Vi var interessert i to hovedproblemstillinger: 1) Hva tenker fotballspillere på ulike prestasjonsnivå om etikk og (...) moralske dilemmaer i fotball? 2) Hvilke faktorer påvirker spillerne, direkte og indirekte, i deres vurderinger og handlinger? Resultatene fra undersøkelsen viser at det er store forskjeller mellom de to prestasjonsnivåene. Spillerne på breddenivået føler generelt et større ansvar for å opptre ærlig på banen enn hva som er tilfelle på toppnivået. Vi fant 4 spesifikke faktorer i toppfotballen som bidrar til umoralsk opptreden. For det første opplever spillerne en forventning om at de prioriterer resultat foran fair play. For det andre bidrar tilstedeværelsen av supportere på kamper til en slik prioritering. For det tredje vil handlinger som er i strid med fair play signaliseres som akseptable internt i miljøet, selv om de ofte signaliseres som uakseptable overfor media og omverdenen. For det fjerde kan spillere oppleve det som vanskelig å gå i mot trenerens oppfordringer til en pragmatisk og resultatfokusert opptreden.Nøkkelord: moral, etikk, fair play, footballEnglish summary: How morally do football players think? – an empirical study of moral dilemmas in elite footballIt is a common view that the increasing focus on achievement and success in elite football leads to a weakening of moral and fair play attitudes. But how do elite players think and what do they think about different dilemmas that appear on the field, and is there a difference between elite players and lower division players? To answer these questions we conducted an empirical investigation in which we interviewed the players and manager in an elite club and in a lower division club. We were interested in two main problems: 1) How do football players at different performance levels think about ethics and moral dilemmas in football? 2) Which factors influence the players, directly and indirectly, in their evaluations and actions? The results from the investigation show that there are important differences between the players at the two performance levels. The lower division players felt in general a higher responsibility to behave honestly on the field than the elite players. We identified four specific factors in elite football that contribute to unsportsmanlike behavior. First, elite players feel more pressure to prioritize results more than fair play. Second, the presence of the supporters contributes to the priority of results. Third, unsportsmanlike behavior is often signaled as unacceptable to the media and the surroundings. Internally, however, such behavior is considered acceptable among the manager and the players. Fourth, the players may find it hard to go against the manager’s insistence on a pragmatic and result-oriented focus.Keywords: morals, ethics, fair play, football. (shrink)

The rise in the number of people on sick leave for common mental disorders is a growing concern, both from a societal and individual perspective. One common suggestion to improve the return-to-work process is increased cooperation between the relevant parties, including at least the employer, the social insurance agency and health care. This suggestion is often made on the presumption that all parties share the common goal of reintegrating the patient-employee back into the workplace. In this paper we investigate this (...) presumption by mapping out the ethical frameworks of these three key actors in any return-to-work process. We show that although the goals of these actors often, and to a large extent, overlap there are potential differences and tensions between their respective goals. Further, we emphasise that there may be other limitations to an actor’s participation in the process. In particular the health care system is required to respect patient autonomy and confidentiality. There is also an inherent tension in the dual roles of health care professionals as therapists and expert witnesses in work ability assessment. In conclusion, there are potential tensions between the key actors in the return-to-work process. These tensions need to be addressed in order to enable an increased cooperation between actors and to facilitate the development of a feasible plan of action for all parties, including the employee. Every year medical researchers make contact with a large number of cancer survivors with the aim of evaluating cancer treatment. For this reason we decided to investigate how Swedish cancer survivors perceived their participation in research studies focusing on the long-term consequences of being a survivor of gynaecological or urinary bladder cancer. Data were collected by means of two study-specific postal questionnaires, both consisting of questions covering physical symptoms, well-being and the experience of being a cancer survivor. Both questionnaires also (...) included questions evaluating the participants’ experience of being research subjects. The questionnaires were developed in close co-operation with cancer survivors. The study population consisted of 1068 cancer survivors. Of these, 95% (n=1003) reported that they thought the study was valuable and 54% (n=559) that they had been positively affected by participating. Four per cent (n=39) expressed that they had been negatively affected by their participation in the study. The vast majority of the cancer survivors thought that participating in their particular study was valuable. (shrink)

Many people who claim to genuinely care about nature still seem reluctant to ascribe intrinsic value to it. Environmentalists, nature friendly people in general, and even environmental activists, often hesitate at the idea that nature possesses value in its own right—value that is not reducible to its importance to human or other sentient beings. One crucial explanation of this reluctance is probably the thought that such value—at least when attached to nature—would be mysterious in one way or another, or at (...) least very difficult to account for. In addition, Bryan Norton’s influential convergence hypothesis states that, from a practical point of view, it makes no or little difference whether we ascribe intrinsic value to nature, given the depth and variety of instrumental value it possesses. In this paper, I argue that people who genuinely care about nature cannot avoid ascribing intrinsic value (in a certain sense) to it, if they want to be able to consistently defend the kind of claims about protecting nature they arguably want to make, i.e., claims to the effect that we ought to protect for instance nature areas and species. The cost of denying intrinsic value in nature is the cost of giving up a crucial resource to philosophically defend such claims. (shrink)

The Gricean paradigm in pragmatics has recently been attacked for its alleged lack of explanatory import, based on the claim that it does not seek accounts of how utterance interpretation actually works, but merely of how it might work. This article rebuts this line of attack by offering a clear and detailed account of the explanatory project of Gricean pragmatics according to which the latter aims for rationalizing explanations of utterance interpretation. It is shown that, on this view, Gricean pragmatics (...) seeks psychological explanations of utterance interpretation that are “cognitively real” in a perfectly clear and robust sense. (shrink)

ABSTRACT:This article provides a normative justification for unions. It discusses three arguments. The argument from consent justifies unions in some circumstances, but if the employer prefers to not bargain with unions, it may provide very little justification. The argument from contestability takes as its starting point the fact that employment contracts are incomplete contracts, where authority takes the place of complete contractual terms. This theory of contracts implies that consent to authority has been given under ignorance, and, therefore, that authority (...) cannot be justified by consent. Contestability is a mechanism that can handle this problem for consent theory. It demands transparency, channels for voice, and a forum where contestations can be evaluated. This idea can be implemented in firms in different ways, but the argument from the separation of powers implies that unions are uniquely suited to implement contestability, since they are organized outside of the employer’s domain of authority. In the interpretive literature from the 1950's through the 1970's the term 'criterion' was thought to be a central key to the understanding of Wittgenstein's later philosophy. Later on, it was relegated from this place of honour to being one of a variety of expressions used by Wittgenstein in dealing with philosophical questions. This Element tries to account for the shifting fate of this concept. It discusses the various occurrences of the word “criteria” in the Philosophical Investigations, argues that the (...) post-Wittgensteinian debate about criteria was put on the wrong track by a problematic passage in Wittgenstein's early Blue Book, and finally gives an overview of the main contributions to this debate, trying to achieve a reconciliation between the rival conceptions. When considering the introduction of a new intervention in a budget constrained healthcare system, priority setting based on fair principles is fundamental. In many jurisdictions, a multi-criteria approach with several different considerations is employed, including severity and cost-effectiveness. Such multi-criteria approaches raise questions about how to balance different considerations against each other, and how to understand the logical or normative relations between them. For example, some jurisdictions make explicit reference to a large patient benefit as such a consideration. However, since (...) patient benefit is part of a cost-effectiveness assessment it is not clear how to balance considerations of greater patient benefit against considerations of severity and cost-effectiveness. The aim of this paper is to explore the role of a large patient benefit as an independent criterion for priority setting in a healthcare system also considering severity and cost-effectiveness. By taking the opportunity cost of new interventions (i.e., the health forgone in patients already receiving treatment) into account, we argue that patient benefit has a complex relationship to priority setting. More specifically, it cannot be reasonably concluded that large patient benefits should be given priority if severity, cost-effectiveness, and opportunity costs are held constant. Since we cannot find general support for taking patient benefit into account as an independent criterion from any of the most discussed theories about distributive justice: utilitarianism, prioritarianism, telic egalitarianism and sufficientarianism, it is reasonable to avoid doing so. Hence, given the complexity of the role of patient benefit, we conclude that in priority practice, a large patient benefit should not be considered as an independent criterion, on top of considerations of severity and cost-effectiveness. Dealing with ethical issues is a central aspect of many professions. Consequently, ethics is taught to diverse student groups in universities and colleges, alongside philosophy students. In this paper, we address the question of how ethics is best taught to such “non-philosophy” student groups. The standard way of introducing ethics to non-philosophy students is to present them with a set of moral theories. We refer to this approach as the “smorgasbord approach”, due to the impression it is likely to make (...) on non-philosophy students approaching ethics as an academic discipline for the first time. This approach invites the assumption that adopting an ethical position is mainly a matter of choosing from this smorgasbord of different theories. We argue that this approach is problematic for several reasons, both theoretical and practical, and we suggest a methodsbased approach – focusing on methods for moral reasoning – as a more fruitful alternative. The main purpose of this paper is to explain and defend this methods-based approach to teaching ethics to non-philosophy students. In so doing, we also consider and meet some expected objections to this approach. (shrink)

It is often assumed that the concept of 'alētheia', or ‘truth’, in Gorgias of Leontini belongs to the art of rhetoric. Along these lines, it is usually understood as an aesthetic concept or even a mere ‘adornment’ of speech. In this paper, it is argued, by contrast, that Gorgianic alētheia is a definable criterion of speech figuring in the practice of moral educa­tion. While the ‘truth’ of a logos indeed has to be assessed on aesthetic grounds, the underlying concept of (...) alētheia is predominantly ethical. For Gorgias, speech is ‘true’ when it promotes virtue (aretē) by being expressive of virtue. The principle stated in the opening passage of the Encomium of Helen, that a speaker has ‘to praise what is praiseworthy and to blame what is blameworthy’, explains precisely this understand­ing of alētheia. Children of prisoners are often negatively affected by their parents’ incarceration, which raises issues of justice. A common view is that the many negative effects associated with parental imprisonment are unjust, simply because children of prisoners are impermissibly harmed or unjustly punished by their parents’ incarceration. We argue that proposals of this kind have problems with accounting for cases where it is intuitive that prison might create social injustices for children of prisoners. Therefore, we suggest that in addition to the (...) question of whether children of prisoners are impermissibly harmed, we should ask whether the inequalities that these children endure because of their parent’s incarceration are objectionable from a social justice perspective. To answer this latter question, we examine the negative effects associated with parental imprisonment from the perspective of luck egalitarianism. We develop a luck egalitarian account that incorporates insights from the philosophy of childhood. On our account, children of prisoners might endure two different types of objectionable inequalities, since they are often deprived of resources that are important for ensuring fair equality of opportunity in adulthood, but also because they are likely to suffer inequalities in terms of childhood welfare. After defending this account, we explore its implications for policy. (shrink)

Background Healthcare systems are increasingly struggling with resource constraints, given demographic changes, technological development, and citizen expectations. The aim of this article is to normatively analyze different suggestions regarding how publicly financed plastic surgery should be delineated in order to identify a well-considered, normative rationale. The scope of the article is to discuss general principles and not define specific conditions or domains of plastic surgery that should be treated within the publicly financed system. Methods This analysis uses a reflective equilibrium (...) approach, according to which considered normative judgements in one area should be logically and argumentatively coherent with considered normative judgements and background theories at large within a system. Results and conclusions In exploring functional versus non-function conditions, we argue that it is difficult to find a principled reason for an absolute priority of functional conditions over non-functional conditions. Nevertheless, functional conditions are relatively easier to establish objectively, and surgical intervention has a clear causal effect on treating a functional condition. Considering non-functional conditions that require plastic surgery [i.e., those related to appearance or symptomatic conditions ], we argue that the patient needs to experience some degree of suffering, which must be ‘validated’ in some form by the healthcare system. This validation is required for both functional and non-functional conditions. Functional conditions are validated by distinguishing between statistically normal and abnormal functioning. Similarly, for non-functional conditions, statistical normality represents a potential method for distinguishing between what should and should not be publicly funded. However, we acknowledge that such a concept requires further development. (shrink)

The book works out new perspectives for a philosophy of religion that aims beyond the internal questions of rationality within a theological tradition, on the one hand, and the outer criticism of religion from naturalistic quaters, on the other. Instead it places itself within a wider philosophical view in line with groundbreaking thoughts about culture and a basic human 'conditionality' among interwar philosophers such as Ernst Cassirer, Ludwig Wittgenstein, Walter Benjamin, and Martin Heidegger. The book also offers a concrete interpretation (...) of examples of religious phenomena displaying a human world-relation that centers on issues of 'truth', 'name', and 'habitation'. In this article, I respond to David McIvor’s and Lars Rensmann’s discussion of my recent book, The Politics of Repressed Guilt: The Tragedy of Austrian Silence (2018, Edinburgh University Press). Both invited me to clarify my use of Arendt in my conception of embodied reflective judgment. I argue for a stronger connection between judgment and emotions than Arendt because one can effectively shut down critical thinking if one uses defense mechanisms to repress feelings of guilt. In response to McIvor, (...) I discuss the idea of the “subject-in-outline” and “embodied reflective spaces” to overcome the guilt/defense complex to engender a reparative politics of justice. Finally, in response to Rensmann, I point out that the lingering culture of repressed guilt helps us explain the general conditions that contributed to the rise of the far and extremist right in Austria, which I develop further in my new book Analyzing the Far Right.
