Philosophical interest in disability is rapidly expanding. Philosophers are beginning to grasp the complexity of disability--as a category, with respect to well-being and as a marker of identity. However, the philosophical literature on justice and human rights has often been limited in scope and somewhat abstract. Not enough sustained attention has been paid to the concrete claims made by people with disabilities, concerning their human rights, their legal entitlements and their access to important goods, services and resources. This book discusses (...) how effectively philosophical approaches to distributive justice and human rights can support these concrete claims. It argues that these approaches often fail to lend clear support to common disability demands, revealing both the limitations of existing philosophical theories and the inflated nature of some of these demands. Moving beyond entitlements, the author also develops a unique conception of dignity, which she argues illuminates the specific indignities experienced by people with disabilities in the allocation of goods, in the common experience of discrimination and in a wide range of interpersonal interactions. Disability with Dignity offers an accessible and extended philosophical discussion of disability, justice and human rights. It provides a comprehensive assessment of the benefits and pitfalls of theories of human rights and justice for advancing justice for the disabled. Recent political philosophers have argued that criteria of social justice that defend distributing resources to individuals on the basis of the disadvantages of their natural endowments are disrespectful and disparaging. Clearly influenced by the social model of disability, Elizabeth Anderson and Thomas Pogge have recently defended criteria of social justice that distribute resources to people with disabilities on the basis of eliminating discrimination, not making up for so-called natural disadvantage. I argue that it is implausible to suggest that just entitlements (...) for people with disability can be secured solely by eliminating discrimination. Resources for people with disabilities must sometimes be justified on the grounds that some natural endowments pose disadvantages even in societies that do not discriminate. I argue further that there need be nothing at all disrespectful about this way of explaining disadvantage; nor have proponents of the social model of disability or political philosophers provided any compelling reasons for supposing that it is disrespectful. There is thus no motivation for Anderson's and Pogge's attempts to secure justice for people with disabilities by appealing solely to the imperative to eliminate discrimination. (shrink)

How parents talk about social events shapes their children’s understanding of the social world and themselves. In this study, we show that parents in a society that more strongly values individualism and one that more strongly values collectivism differ in how they talk about negative social events, but not positive ones. An animal puppet show presented positive social events and negative social events. All shows contained two puppets, an actor and a recipient of the event. We asked parents to talk (...) to their 3- and 4-years old children about these events. A total of 26 parent–child dyads from the United States and Japan participated. The principal dependent measure was how much parent talk referred to the actor of each type of social event. There were no cultural differences observed in positive events – both the United States and Japanese parents discussed actors more than recipients. However, there were cultural differences observed in negative events – the United States parents talked mostly about the actor but Japanese parents talked equally about the actor and the recipient of the event. The potential influences of these differences on early cognitive and social development are discussed. (shrink)

In this paper I make a preliminary analysis of Western (or global North) discourses on sexual violence, focusing on the important concepts of “consent” and “victim.” The concept of “consent” is widely used to determine whether sexual violence has occurred, and it is the focal point of debates over the legitimacy of statutory offenses and over the way we characterize sex work done under conditions involving economic desperation. The concept of “victim” is shunned by many feminists and nonfeminists alike for (...) its apparent eclipse of agency. Putting these concepts into a global framework sheds light on their limitations. Bringing in the debate over the concept “honor crime” reveals contrasting assumptions about the nature of sexual violence. The comparative analysis used in this paper shows how we can avoid universalizing from specific frameworks, but also how we can learn from the discourses elsewhere toward developing an account of commonalities across contexts. Ultimately I argue that in applications to sexual violence, “consent” has intrinsic limitations, “victim” has context-based dangers, and “honor crime” makes both correct as well as incorrect assumptions. As in other fields, scholarly publication in sociology is not only the key to career success but also the route by which feminist analyses and perspectives become known to others in the discipline. A growing literature has analyzed women's and men's rates of publication, but the gender politics of the prepublication production of research and gender differences in reputation building after publication remain underexplored. This report reviews the current state of knowledge about sociological publishing at three phases: prepublication, the publication-seeking (...) phase, and postpublication. It concludes with critical questions to be addressed in developing a comprehensive model of gender effects on sociological publishing. (shrink)

This study investigates the relative attractiveness of production level jobs provided by multinational firms in Mexico's maquiladora industry. We take the position that workers themselves are an important and often overlooked source of information relevant to the controversy focusing on the responsibilities of multinational companies to their employees in the developing world. We conducted interviews with 59 maquila production level workers in the Mexican cities of Cd. Juárez and Chihuahua. Using a relative attractiveness framework that compared maquila jobs to other (...) employment available in the local economy, maquila line and technical workers responded to questions addressing why they were working at a maquila, their work history, the attractiveness of maquila jobs compared to both their prior jobs and the jobs held by friends and family, and whether they planned to continue working in the maquilas. While the responses from maquila workers are diverse, they suggest that maquila jobs provide attractive employment for the economically disadvantaged in Northern Mexico. (shrink)

This paper aims to contribute toward coalitionbuilding by showing that, even if we try tobuild coalition around what might look like ourmost obvious common concern – reducing racism –the dominant discourse of racial politics inthe United States inhibits an understanding ofhow racism operates vis-à-vis Latino/as andAsian Americans, and thus proves more of anobstacle to coalition building than an aid. Theblack/white paradigm, which operates to governracial classifications and racial politics inthe U.S., takes race in the U.S. to consist ofonly two racial (...) groups, Black and White,with others understood in relation to one ofthese categories.I summarize and discuss the strongestcriticisms of the paradigm and then develop twofurther arguments. Together these argumentsshow that continuing to theorize race in theU.S. as operating exclusively through theblack/white paradigm is actuallydisadvantageous for all people of color in theU.S., and in many respects for whites as well(or at least for white union households and thewhite poor). This article analyzes Nancy Fraser's account of the contrasting social movements for recognition versus those for redistribution. In her most recent analysis, only those forms of recognition struggles that she equates with identity politics are subject to critique. I argue that identity politics does not have an inevitable logic to it that destines it to fracture, border patrol, internal conservatism, etc., and further that the very redistribution claims she proposes require identity politics.

This study explores both the negotiating styles and moral reasoning processes of business people and governmental officials in Taiwan, so as to provide a footing for outsiders when negotiating with Taiwanese over environmental concerns. Findings imply that Taiwanese business people and governmental officials can and will reason both at the conventional level and at the postconventional level of moral judgment. But, results of this study also indicate that Taiwanese negotiating styles do not necessarily match their levels of moral reasoning. With (...) respect to pollution concerns, Taiwanese seem unwillingly to accept responsibility as autonomous individuals. Instead, responsibility is accepted when mandated by the law. (shrink)

Michel Foucault’s formative years included the study not only of history and philosophy but also of psychology: two years after he took license in philosophy at the Sorbonne in 1948, he took another in psychology, and then obtained, in 1952, a Diplôme de Psycho Pathologie . From his earliest years at the Ecole Normale Superieur he had taken courses on general and social psychology with one of most influential psychologists of the time, Daniel Lagache, who was attempting to integrate psychoanalysis (...) with clinical methods.(Eribon 1991, 42) Foucault’s studies included experimentation and clinical instruction in which patients were presented in an amphitheatre just as in the days of Charcot. For several years after he had received his Diplôme, Foucault continued research in psychopathology, observing practices in mental hospitals, reportedly sometimes volunteering in experiments himself. He purchased the material required to administer Roschach tests, subjecting numerous friends to the inkblots, and became, when it was founded, the honorary president of the French Rorschach organization. Foucault’s first books were on the topic of the psychological characterization of madness and the development of clinical medicine, and his last books addressed the development of psychological norms within the establishment of modern prisons as well as within an increasingly scientific approach to sex. Thus, he worked at the intersections of philosophy and psychology throughout his life. Nonetheless, Foucault reported feeling an intense aversion to psychology no less than to philosophy.(Sheridan 1980, 5) Foucault’s oeuvre is almost exclusively focused on particular knowledges in the human sciences, especially those aspects which pertained to psychological theories of human behavior, capacity, and normative functioning. His historical approach to these, and his emphasis on the role of discourse, is readily reminiscent of Thomas Kuhn’s similarly historical approach to scientific method with its emphasis on the role of paradigms and the untranslatability of paradigm dependent objects.. This article reflects on the worlds that María Lugones has made and has transformed, particularly for the doing of feminist theory. Thus this article will be more exploratory than argumentative: to explore the lessons that Lugones's work holds, especially her work on pluralist feminism, world-traveling, the uses of anger, boomerang perception, and the multiplicitousness of both our selves and our communities, for our twenty-first-century challenges. This chapter suggests an approach to decolonial feminism drawing from Latina feminist theory and practice. Rejecting an imperial feminism involves something else besides “going local”: it requires a genuine reorientation of feminist theory toward the everyday. This chapter considers how this affects the central debates about gender identities and gender liberation. How might we approach gender questions in the context of learning from, rather than teaching, lo cotidiano of the impoverished? This would counter the popular accounts of identity formation that (...) view it as necessarily involving either authoritarianism from above, or irrationality from below. The chapter then explores the late theologian Ada-María Isasi-Díaz’s development of a mujerista theology, which adapted certain aspects of liberation theology’s “preference for the poor” to US Latinas. Caring to Know by Vrinda Dalmiya is a remarkable, and remarkably original, work. It develops a significant extension of the care-ethical framework for epistemology, builds on as well as critiques Western feminist philosophy, and offers an original interpretation of the Mahābhārata's implication for epistemic norms. But perhaps most importantly, it invents an entirely original epistemology unlike anything, really, in English. I argue here that first person speech on sexual violence remains an important dimension of the movement for social change in regard to sexual violence, and that the public speech of survivors faces at least three groups of obstacles: 1) the problem of epistemic injustice, that is, injustice in the sphere of knowledge 2) the problem of language and power, and 3) the problem of dominant discourses. In the current scientific and political discourse surrounding the transformation of the scientific publication system, significant attention is focused on Diamond Open Access (OA). Diamond OA is characterized by no charges for readers or authors and relies on monetary allowances and voluntary work. This article explores the potential and challenges of Diamond OA journals, using Germany as a case study. Two key questions are addressed: first, the current role of such journals in the scientific publication system is determined through bibliometric (...) analysis across various disciplines. Second, an investigation is conducted to assess the sustainability of Diamond OA journals and identify associated structural problems or potential breaking points. This investigation includes an in-depth expert interview study involving 20 editors of Diamond OA journals. The empirical results are presented using a landscape map that considers two dimensions: 'monetized and gift-based completion of tasks' and 'journal team size.' The bibliometric analysis reveals a substantial number of Diamond OA journals in the social sciences and humanities, but limited adoption in other fields. The model proves effective for small to mid-sized journals, but not for larger ones. Additionally, it was found that 23 Diamond OA journals have recently discontinued their operations. The expert interviews demonstrate the diversity within the landscape and the usefulness of the two dimensions in understanding key differences. Journals in two of the four quadrants of the map exemplify sustainable conditions, while the other two quadrants raise concerns about long-term stability. These concerns include limited funding leading to a lack of division of labor and an excessive burden on highly committed members. Gift-like contributions, while appealing, also present challenges as potential donors not only decide whether to contribute but also how to contribute, potentially creating friction between the gift and the journal's requirements. Furthermore, journals in the lower right quadrant often rely on third-party funding, necessitating a transformation once the funding expires. Common pathways for sustaining operations include lobbying for funding at the journal's home institution or increasing reliance on gift-based completion of tasks. These findings underscore the need for the development of more sustainable funding models to ensure the success of Diamond OA journals. (shrink)

The category of jus post bellum is a welcome addition to discussions of the justice of war. But, despite its handy Latin label, we will argue that it cannot be properly understood merely as a set of corollaries from jus ad bellum and jus in bello. Instead, an acceptable theory of justice in the postwar period will have to draw on a broader set of normative ideas than those that have been the focus of the just war tradition. Most of the world's religions hold a belief in some form of life after death. The editors of this major anthology seek a global perspective on the importance of these beliefs, based on religion, psychical research, and the natural sciences. Eleven chapters explore the afterlife teachings of religions around the world. In order to emphasize the diversity beliefs - even across particular belief systems - some contributors write from within the traditions, while others offer critical and alternate views. The chapters (...) cover afterlife beliefs in African religions, Judaism, Christianity, Islam, Hinduism, and Buddhism while raising a number of important questions. Is a belief in an afterlife necessary to provide meaning to the here and now? Can science provide the means of affirming such beliefs? A further four contributions address these questions directly, and critique the belief systems from the perspectives of philosophy and psychical research. The final chapter highlights the importance of research into states of consciousness during near-death and other mystical experiences. Taken as a whole, the book constitutes the most valuable resource on the subject to date. The editors conclude that in some respects, a global perspective does emerge - particularly that human beings are more than just our bodies, but are "composed of a physical and nonphysical element."
