Stresses on healthcare systems and moral distress among clinicians are urgent, intertwined bioethical problems in contemporary healthcare. Yet conceptualizations of moral distress in bioethical inquiry often overlook a range of routine threats to professional integrity in healthcare work. Using examples from our research on frontline physicians working during the COVID-19 pandemic, this article clarifies conceptual distinctions between moral distress, moral injury, and moral stress and illustrates how these concepts operate together in healthcare work. Drawing from the philosophy of healthcare, we (...) explain how moral stress results from the normal operations of overstressed systems; unlike moral distress and moral injury, it may not involve a sense of powerlessness concerning patient care. The analysis of moral stress directs attention beyond the individual, to stress-generating systemic factors. We conclude by reflecting on how and why this conceptual clarity matters for improving clinicians’ professional wellbeing, and offer preliminary pathways for intervention. (shrink)

On 19 July 2016, three medical organisations filed a federal lawsuit against representatives from several Vermont agencies over the Patient Choice and Control at End of Life Act. The law is similar to aid-in-dying laws in four other US states, but the lawsuit hinges on a distinctive aspect of Vermont's law pertaining to patients' rights to information. The lawsuit raises questions about whether, and under what circumstances, there is an ethical obligation to inform terminally ill patients about AID as an (...) end-of-life option. Much of the literature on clinical communication about AID addresses how physicians should respond to patient requests for assisted dying, but neglects the question of how physicians should approach patients who may not know enough about AID to request it. In this article, I examine the possibility of an affirmative duty to inform terminally ill patients about AID in light of ethical concerns about professional responsibilities to patients and the maintenance of the patient–provider relationship. I suggest that we should not take for granted that communication about AID ought to be patient-initiated, and that there may be circumstances in which physicians have good reasons to introduce the topic themselves. By identifying ethical considerations that ought to inform such discussions, I aim to set an agenda for future bioethical research that adopts a broader perspective on clinical communication about AID. Today, in both theory and practice, the concepts of corporate social responsibility and ethics are not necessarily related. Organizations can demonstrate high levels of social proactivity in their CSR policies with or without having laudable levels of ethical quality or virtuousness. This article introduces the concepts of organizational ethical quality to evaluate the moral excellence of CSR actions and policies, identifying and categorizing varying levels ranging from the absence of ethical virtuousness, termed immoral CSR, to high levels of moral CSR, (...) or ethical virtuousness. In recent years, philosophers have looked to empirical findings about psychopaths to help determine whether moral agency is underwritten by reason, or by some affective capacity, such as empathy. Since one of psychopaths’ most glaring deficits is a lack of empathy, and they are widely considered to be amoral, psychopaths are often taken as a test case for the hypothesis that empathy is necessary for moral agency. However, people with autism also lack empathy, so it is reasonable to think that (...) any empirically-informed attempt to answer the question of whether empathy is necessary for moral agency should give due attention to autism as well as psychopathy. Jeanette Kennett’s thought-provoking paper ‘Autism, Empathy and Moral Agency’ (2002) is an early and arguably the most notable example of such an attempt. Kennett argues that although autistic people and psychopaths both lack empathy, autistic people possess a ‘reverence for reason’ that enables them to become capable moral agents. By contrast, psychopaths lack this rational capacity, and it is this defect of reason rather than an empathic impairment that explains why they are amoral. Kennett thus concludes that empathy is not necessary for moral agency. In this chapter, I challenge Kennett’s argument. First, I review the empirical evidence in order to demonstrate that there is a component of empathy called affective empathy that is impaired in psychopaths but largely preserved in autistics. As such, the claim that psychopaths and autistics share a common lack of empathy is unjustified. Second, I challenge Kennett’s claim that empathy plays no role in explaining the moral difference between psychopaths and autistics. Instead, I contend that the intact affective empathy of autistic people is a crucial component of their capacity to act from reverence for reason. (shrink)

Social context shapes negotiators’ actions, including their willingness to act unethically. We use a simulated negotiation to test how three dimensions of social context—dyadic gender composition, negotiation strategy, and trust—interact to influence one micro-ethical decision, the use of deception. Deception in all-male dyads was relatively unaffected by trust or the other negotiator’s strategy. In mixed-sex dyads, negotiators consistently increased their use of deception when three forms of trust were low and opponents used an accommodating strategy. However, in all-female dyads, negotiators (...) appeared to use multiple and shifting reference points in deciding when to deceive the other party. In these dyads, the use of deception increased when a competitive strategy combined with low benevolence-based trust or an accommodating strategy combined with high identity-based trust. Deception in all-female dyads decreased when a competitive strategy was used in the context of low deterrence-based trust. (shrink)

ABSTRACT‘Solidarity’ is a key concept in political movements and usually bears on matters of labour, health and social justice. As such, it is essential in the reproduction and transformation of communities that support their members and protect their interests. It is sometimes overlooked that interspecies solidarity already pertains with a number of domesticated animals, and that people are willing to carry substantial emotional, financial and social burdens to benefit them. There has been even more reluctance to acknowledge wild animals as (...) fellow members of our political communities with whom we might stand in solidarity. The purpose of this paper is to propose that solidaristic relations with certain wild animals are not only possible, but also already exist in some contexts. It explores three different understandings of solidarity, and in probing to what extent they can be applied to wild animals, it identifies some important different roles they can play in ‘animal politics’, and shows how they can help us reconceive our communities in less anthropocentric terms. This essay looks closely at metaphors and other figures of speech that often feature in how Americans talk about dementia, becoming part of cultural narratives: shared stories that convey ideas and values, and also worries and fears. It uses approaches from literary studies to analyze how cultural narratives about dementia may surface in conversations with family members or health care professionals. This essay also draws on research on a notable social effect of legalizing medical aid in dying: patients may find (...) it easier to bring up a range of concerns, regardless of whether they have any interest in hastening their own death. The essay proposes that health care professionals rethink an idea prominent within their own culture: that conversations about the end of a person's life are inherently difficult. This framing may make it hard for people facing dementia to bring up their concerns about what lies ahead. We suggest a different way to think about these conversations, using the metaphor of “opening the door” to represent inviting a patient to bring up issues of deepest concern. (shrink)

Das Thema des Artikels sind sprachliche Fehler, die bei der schriftlichen Übersetzung aus dem Deutschen ins Polnische und aus dem Polnischen ins Deutsche Vorkommen. Das Ziel des Artikels ist, ihre Vielschichtigkeit und Entstehungsmechanismen zu zeigen, die vor allem mit der sprachlichen Interferenz als einer der Hauptursachen für Übersetzungsfehler zusammenhän gen. Der Artikel stützt sich auf die Ergebnisse der Untersuchungen, die in den Jahren 2004-2006 in der Abteilung für Angewandte Sprachwissenschaft am Lehrstuhl für Deutsche und Angewandte Sprachwissenschaft der Universität Łódź durchgeführt (...) wurden. Die Basis für das empirische Material bildeten hierbei durch Germanislikstudenten angefertigte schriftliche Übersetzungen. Am Anfang des Artikels werden verschiedene Definitionen und Klassifizierungsmöglichkeiten des sprachlichen Fehlers präsentiert. Desweiteren konzentriert sich der Autor auf das Phänomen der sprachlichen Interferenz und führt ihre Definitionen von W. Bondzio und T. Lewandowski an. Im weiteren Teil des Artikels wird die Frage der Interferenzmechanismen erörtert, zu denen die von J. Czochralski beschriebene Automatisierung der sprachlichen Strukturen, „zwischensprachliche Zuordnung“, „Übertragung des muttersprachlichen Modells“, fehlerhafte Erweiterung des Geltungsbereiches einer Aussage oder die Vermeidung besiimmter Elemente im System der Fremdsprache gehören. Im zweiten Teil des Artikels werden Ergebnisse der Forschungen präsentiert, deren Korpus einige Hunderte von deutsch-polnischen und polnisch-deutschen Übersetzungen waren, die von Studenten gemacht wurden. Die Fehler wurden zunächst nach der Richtung der Interferenz klassifiziert, dann nach den Sprachebenen. Besondere Aufmerksamkeit bei der Fehlerbeschreibung wurde аиГ die möglichen Störungen der sprachlichen Kommunikation gelenkt. Die durchgeführten Untersuchungen untermauern und erweitern die Thesen aus der Fachliteratur: Die Fehler kommen auf verschiedenen Sprachebenen vor und stören in vielen Fällen die sprachliche Kommunikation, deren Herstellung der Hauptzweck einer jeden Übersetzung ist. Der Autor des Artikels postuliert, bei der Übersetzungsdidaktik mehr Aufmerksamkeit der sprachlichen Interferenz zu widmen, was seiner Meinung nach zu besseren Resultaten verhelfen würde. (shrink)

Context shapes negotiators’ actions, including their willingness to act unethically. Focusing on negotiators use of deception, we used a simulated two-party negotiation to test how three contextual variables—regulatory focus, power, and trustworthiness—interacted to shift negotiators’ ethical thresholds. We demonstrated that these three variables interact to either inhibit or activate deception, providing support for an interactionist model of ethical decision-making. Three patterns emerged from our analyses. First, low power inhibited and high power activated deception. Second, promotion-focused negotiators favored sins of omission, (...) whereas prevention-focused negotiators favored sins of commission. Third, low cognition-based trust influenced deception when negotiators experience fit between power and regulatory focus, whereas affect-based trust influenced deception when negotiators experience misfit between these structural context variables. We conclude that regulatory focus primes different moral templates: promotion-focused negotiators’ decision to deceive is determined by moral pragmatism, whereas prevention-focused negotiators’ decision to deceive is determined by opportunism. Because each combination of power and regulatory focus was tied to a specific subcomponent of trust, we further conclude that negotiators engage in motivated information search to determine whether they should deceive their opponents. While feelings of disgust and repulsion are experienced and accepted as part of care practices of nurses who work in palliative care, they are often silenced. Working alongside two palliative care nurses in a hospice setting, we engaged in a narrative inquiry to inquire into their experiences of disgust. The study took place in a palliative care setting in a large urban city in Germany. We understand care practices as actions that follow a logic of care. According to a logic (...) of care, actions are situated within a social context, given by specific relationships including power, and individual needs. Various aspects of disgust are visible in the experiences of the participants and highlighted in the narrative threads of disgust and silence, disgust and protection, and disgust and boundaries. Embedded in the experience of disgust of nurses working in palliative care, we see that there are borderlands of care that challenge who we are and are becoming. Opening discussion about disgust in nursing makes visible the complexity of care. (shrink)

In doing so, the analysis and comparison is based on two basic types of rationality that we encounter here: critical and an-archic rationality. Despite certain non-negligible similarities that are manifested in these forms of rationality, the conclusion inevitably leads in the direction of highlighting their essential differences, which at decisive points in the end prove to be (...) unavoidable and insurmountable. This paper emphasizes the place and the role of the aesthetic quality and the role of the erotic in Levinas?s project that deals with ethical an-archaeology. Despite Levinas?s categorical statements that there are irreconcilable differences between ethics and aesthetics, i.e. between ethics and the erotic, above all, it is emphasized here that these differences do not represent a stark or sharp contrast, but quite contrary, they often constitute a subversive ontological element. In Karol Wojtyla’s philosophy of the Human Person, he interprets man as not being solely as a “rational animal.” He offers instead an understanding of man viewing his innerness as a person manifested not only by his existence, but more importantly through (...) his actions. In this paper, the fundamental concepts of Wojtyla’s Human Person are precisely enumerated for a clear understanding of who a Human Person is. This paper aims to interpret man in his two-fold character, as a Person and as a Subject using Karol Wojtyla’s Personalism. In this task, one must be noted that Wojtyla employs Thomism and Phenomenology in his thought. In the discussion, I will lay down the primary distinction between these two concepts for a better understanding of the anthropological structure of man, his innerness and exteriority. The discussion has three divisions, the first part discusses the two different ways of understanding Human Being; the second part discusses the concept of Person; and the third part discusses the Human Subject. Rosenzweig's Bible examines the high stakes, both theological and political, of Franz Rosenzweig's attempt to revivify the Hebrew Bible and use it as the basis for a Jewish textual identity. Mara Benjamin's innovative reading of The Star of Redemption places Rosenzweig's best-known work at the beginning of an intellectual trajectory that culminated in a monumental translation of the Bible, thus overturning fundamental assumptions that have long guided the appraisal of this titan of modern Jewish thought. She argues that Rosenzweig's (...) response to modernity was paradoxical: he challenged his readers to encounter the biblical text as revelation, reinventing scripture – both the Bible itself and the very notion of a scriptural text – in order to invigorate Jewish intellectual and social life, but did so in a distinctly modern key, ultimately reinforcing the foundations of German-Jewish post-Enlightenment liberal thought. Rosenzweig's Bible illuminates the complex interactions that arise when modern readers engage the sacred texts of ancient religious traditions. (shrink)

Nowadays, managing change in complex services requires that middle management re-designs its objects and professional practices, in order to cope with new needs. It seems therefore crucial to activate training settings that allow managers to: develop research and analytical skills on their own work practices and professional objects; face and manage conflict, related to every change, that represents an opportunity to reflect and review one's own practices; and build new and shared repertories of managerial practices, able to support a better (...) form of living and working together within the management community. Moving from these hypotheses, inside the setting of a training intervention conducted in an educational service, the article discusses a specific tool used to generate opportunity of exchange, and reflection, within a challenging framework of change. This paper argues against the possibility of presenting a consistent version of the Copenhagen Interpretation of Quantum Physics, characterizing its founders' philosophical pronouncements including those on the realism-antirealism issue, as a contingent collection of local, often contradictory, moves in changing theoretical and sociopolitical circumstances. The paper analyzes the fundamental differences of opinion between Bohr and the mathematical physicists, Heisenberg and Born, concerning the foundational doctrine of the "indispensability of classical concepts", and their related disagreements on "quantum reality." The paper concludes (...) with an explanation of how the appearance of consensus was achieved despite fundamental disagreements among the proponents. The paper undermines the adequacy of the notion of a general conceptual framework to describe the philosophical endeavors of working scientists. (shrink)

The ArgumentThis paper analyzes the complex and many-layered interrelation between the realization of the inevitable limits of precision in the experimental domain, the emerging quantum theory, and empirically oriented philosophy in the years 1925–1935. In contrast to the usual historical presentation of Heisenberg's uncertainty principle as a purely theoretical achievement, this work discloses the experimental roots of Heisenberg's contribution. In addition, this paper argues that the positivistic philosophy of elimination of unobservables was not used as a guiding principle in the (...) emergence of the new quantum theory, but rather mostly as a post facto justification. The case of P. W. Bridgman, analyzed in this paper, demonstrates how inconclusive operationalistic arguments are, when used as a possible heuristic aid for future discoveries. A large part of this paper is devoted to the evolution of Bridgman's views, and his skeptical reassessment of operationalism and of the very notion of scientific truth. (shrink)

“It's almost like putting salt in a wound, for this person who's already made a very difficult decision,” suggested Meghan Patterson, a licensed obstetrician-gynecologist whom we interviewed in our qualitative study of the experiences of North Carolina abortion providers practicing under the state's Woman's Right to Know Act. The act requires that women receive counseling with state-mandated information at least twenty-four hours prior to obtaining an abortion. After the law was passed, Patterson worked with clinic administrators, in consultation with a (...) lawyer, to write a script to be used in the state-mandated counseling procedure. She and her colleagues took particular steps to mitigate the effects of what she described as HB 854's “forced language”—such as referring to the “father of the child.” While HB 854 stipulated that patients must be informed of the medical risks associated with the particular abortion procedure as well as those of carrying the child to term, Patterson's script made explicit the magnitude of comparative risks, emphasizing that the risks of carrying a pregnancy to term are substantially greater than the risks of an early-term abortion. She felt that these contextualization strategies helped to facilitate trust and rapport in a clinical care situation that proved relationally and morally challenging. In this article, we take up and expand on this point by elucidating an empirically grounded approach to ethically justified care when health care providers face legal or institutional policy mandates that raise possible moral conflicts. Our approach builds on recent bioethics discourse addressing conscience in the practice of medicine. While the concept of conscience has broad philosophical underpinnings relating to moral judgment, agency, and discernments of right and wrong, debates in bioethics have tended to engage the concept primarily vis-à-vis rights of conscientious objection or refusal. Here, we suggest a broader frame for thinking about claims of conscience in health care. Our approach draws on the feminist bioethics and the ethics of care literatures to highlight how providers may be motivated by matters of conscience, including relational concerns, in the active provision of certain forms of care. What emerges are two possibilities: not only conscientious refusal to comply with a policy mandate but also conscientious compliance—working conscientiously within a mandate's confines. (shrink)

Kensinger (2009) and Mather (2007) both argue that intrinsic features of emotional items are remembered better than intrinsic features of non-emotional items. However, Kensinger attributes these effects to negative valence whereas Mather attributes them to arousal. In this paper, we note several reasons why arousal may be the driving factor even when a study reveals more detailed memory for negative items than for positive items. We also reanalyze previous data (Mather & Nesmith, 2008) to show that although both arousal and (...) negative valence were correlated with memory accuracy, enhanced memory accuracy was accounted for by arousal rather than valence. The global crisis of COVID-19 pandemic has considerably accelerated the use of teleconsultation (consultation between the patient and the doctor via video platforms). While it has some obvious benefits and drawbacks for both the patient and the doctor, it is important to consider—how teleconsultation impacts the quality of the patient-doctor relationship? I will approach this question through the lens of phenomenology of the body, focusing on the question—what happens to the patient objectification in teleconsultation? To answer this question I will (...) adopt a phenomenological approach combining both insights drawn from the phenomenological tradition, i.e., the concepts of the lived body and the object body, and the results from the phenomenologically informed qualitative research study on the patient experience of teleconsultation. The theoretical background against which I have developed this study comprises discussions within the field of phenomenology of medicine regarding the different sources of patient objectification within clinical encounter and the arguments concerning the negative impact that objectification has on the quality of care. I will argue that a factor that has frequently been identified within phenomenology of medicine as the main source of patient objectification in clinical encounters, namely, the internalized gaze of the clinician, is diminished during teleconsultation, increasing patient’s sense of agency, decreasing her sense of alienation and opening up the possibility for a closer relationship between the patient and the health care provider, all of which lead to the transformation of the hierarchical patient-health care professional relationship. This study aims to further investigate the convergent validity of the recently-proposed metapersonal model and measure of self-construal, and to emphasize the discriminant validity of the metapersonal self-construal as a distinct construct, capturing a unique aspect of self-construal separate from either interdependent or independent aspects. The study looked at two questions: Does the metapersonal self-construal predict higher emotional intelligence? Do those who have higher metapersonal self-construal scores also report greater well-being? A group of 212 undergraduate students was assessed using a (...) self-construal scale that includes the new measure of metapersonal self-construal, along with scales measuring emotional intelligence and well-being. The metapersonal self-construal predicted higher emotional intelligence scores and greater well-being than either the independent or interdependent self-construals. (shrink)

Responsibilist epistemic virtues, such as intellectual humility, thoroughness, and inquisitiveness, motivate and inform behaviour to acquire, assess, and share epistemic goods. While existing accounts primarily emphasise the virtues' role in knowledge acquisition, I argue for casting a wider net by redefining responsibilist virtues in their connection to wisdom. I draw upon Sosa's AAA structure of competence – which he employs to support the direct and constitutive relation between reliabilist virtues (e.g., memory and perception) and knowledge – proposing that the same (...) structure can be applied to responsibilist virtues, establishing their direct and constitutive relation to wisdom. The resulting framework provides us with an account of how epistemic agents can responsibly engage with our current sociotechnical environment. The first half of the thesis establishes this framework, arguing for its implementation. The value of this framework is, in part, its ability to uphold the claim that responsibilist virtues are admirable traits of character that aid one’s epistemically responsible engagement with the environment. The AAA structure of competence entails that a performance is Adroit, i.e., resulting from a reliable competence, Accurate, whereby the performance hits the intended target or the functional goal given the competence, and Apt, whereby it is Accurate as it is Adroit. Applying this to responsibilist virtue, an act is adroit when it results from an acquired, admirable, epistemically motivated, and stable disposition to perform behaviour characteristic of the relevant intellectual virtue. This act is accurate when it is successfully virtuous, i.e., admirable. Within this framework, an act from an admirable, virtuous disposition (i.e., an adroit act) can fail to be virtuous by undermining another virtue, or successfully virtuous when it does not. An apt act of intellectual virtue is thereby an act performed from an intellectual virtue (e.g., attentiveness or intellectual humility), that is admirable because it is adroit (e.g., as it was performed from a virtuous disposition to be attentive or intellectually humble, without the act undermining another virtue). The second half of the thesis applies this framework to various phenomena within the digital epistemic environment. It explores how increasingly prevalent epistemic emotions, such as an epistemic fear of missing out (epistemic FOMO) and morbid curiosity, can shape epistemic behaviour to be unwise, despite the knowledge one may acquire through acts motivated by these emotions. For example, ‘doombehaviour’ – entailing the frequent or long-lasting consumption of distressing news – is examined in light of its impact on mental health and other prudential concerns. Moreover, our digital environment supplies us with novel epistemic responsibilities in relation to consuming attention-grabbing information, as well as inadvertently distributing misinformation. By applying the framework of apt intellectually virtuous action on these and similar phenomena, we can give an account of wise engagement with our sociotechnical environment. (shrink)

This article draws attention to a form of injustice in intimate relationships of care that is largely ignored in discussions about the legal rights and obligations of intimate partners. This form of injustice is connected to a feature of caregiving I call “flexibility,” in virtue of which caregiving requires “skills of flexibility.” I argue that the demands placed by these skills on caregivers create constraints that amount to “vulnerability to oppression.” To lift these constraints, caregivers are entitled to open-ended responses (...) to their work, responses that would enable them to pursue their own projects while providing care. Instead of protecting individual choice of intimate relationships, marriage law should protect these entitlements. (shrink)

Foucauldian discourse analysis (FDA) is a methodology that is well suited to inquiring into nursing knowledge and its organization. It is a critical analytic approach derived from Foucault's histories of science, madness, medicine, incarceration and sexuality, all of which serve to exteriorize or make visible the ‘positive unconscious of knowledge’ penetrating bodies and minds. Foucauldian discourse analysis (FDA) holds the potential to reveal who we are today as nurses and as a profession of nursing by facilitating our ability to identify (...) and trace the effects of the discourses that determine the conditions of possibility for nursing practice that are continuously shaping and (re)shaping the knowledge of nursing and the profession of nursing as we know it. In making visible the chain of knowledge that orders the spaces nurses occupy, no less than their subjectivities, FDA is a powerful methodology for inquiring into nursing knowledge based on its provocation of deep critical reflection on the normalizing power of discourse. Anorexia Nervosa (AN) is a psychiatric illness that presents a complex variety of perceptual alterations and somatic sensations. These alterations occur at the level of (1) bodily representations and (2) bodily experiences. The alterations are widespread, and they involve multiple cognitive functions. We reviewed the current literature linking the psychiatric literature on AN with the philosophical debate on the Cognitive Penetrability of Perception (CPP). We describe the alterations in perception, starting from the most widespread and studied, i.e., those concerning distortions (...) in the estimation of the dimensions of one's body (“dysmorphophobia” or “body image disturbance”) to then describe those of more recent analysis involving alterations in bodily experiences. Body image disturbances in AN have been linked to alexithymia, emotional dysregulation, and altered interoceptive awareness, highlighting the complex interaction between emotion, cognition, and perception in AN. We show how the recent debate on CPP can benefit from the empirical investigations in AN, and can, in turn, serve to outline new lines of research. (shrink)

A key topic within the field of the phenomenology of medicine has been the relationship between body and self in illness, including discussions about the otherness and mineness of the body. The aim of this article is to distinguish between different meanings of bodily otherness and mineness in illness with reference to the interpretation of the body as “saturated phenomenon,” inspired by the phenomenology of Jean-Luc Marion. With the help of Marion’s ideas it is possible to distinguish between two meanings (...) of bodily otherness and of mineness (objective and non-objective forms).
