Whereas many philosophers take backwards causation to be impossible, the few who maintain its possibility either take it to be absent from the actual world or else confined to theoretical physics. Here, however, I argue that backwards causation is not only actual, but common, though occurring in the context of our social institutions. After juxtaposing my cases with a few others in the literature and arguing that we should take seriously the reality of causal cases in these contexts, I consider (...) several objections. These objections involve whether the cases should be reinterpreted, whether they are properly within the institution, whether they involve necessitation or else Cambridge changes, whether and how they involve changing the past, and whether this should call us to question institutional reality. I end by suggesting that it is a virtue of our institutions that they allow backwards causation, that this is a kind of technology that they are often built to incorporate. (shrink)

Groups behave in a variety of ways. To show that this behavior amounts to action, it would be best to fit it into a general account of action. However, nearly every account from the philosophy of action requires the agent to have mental states such as beliefs, desires, and intentions. Unfortunately, theorists are divided over whether groups can instantiate these states—typically depending on whether or not they are willing to accept functionalism about the mind. But we can avoid this debate. (...) I show how a more general view of action captures what is central to action without mentioning mental states, and I argue that a group’s members can fulfill the role in group action that mental states play in our actions. Group behavior is explicable in terms of reasons, regardless of whether the group itself cognizes those reasons. After discussing the kind of reasons at issue and arguing that groups can act in light of them without minds, I assess how this account bears on the question of group responsibility. (shrink)

Most business ethicists maintain that corporate actors are subject to a variety of moral obligations. However, there is a persistent and underappreciated concern that the competitive pressures of the market somehow provide corporate actors with a far-reaching excuse from meeting these obligations. Here, we assess this concern. Blending resources from the history of philosophy and strategic management, we demonstrate the assumptions required for and limits of this excuse. Applying the idea of ‘the state of nature’ from Thomas Hobbes, we suggest (...) that corporate actors would be excused from duties if complying with them threatened their vital interests. We show how this excuse is not available for most individuals within firms; instead, it is an excuse perhaps available to firms themselves, but only given substantive assumptions about corporate personhood. For those willing to make these assumptions, we apply the competitive advantage construct to delimit the scope of this excuse. We suggest that firms are excused from fulfilling an obligation when complying leads to a competitive disadvantage, as this imperils the firm’s vital interests. After revealing why this excuse does not generalize, we conclude by considering when we should reform the market to avoid the legitimacy of this excuse. (shrink)

Respondeat superior is a legal doctrine conferring liability from one party onto another because the latter stands in some relationship of authority over the former. Though originally a doctrine of tort law, for the past century it has been used within the criminal law, especially to the end of securing criminal liability for corporations. Here, I argue that on at least one prominent conception of criminal responsibility, we are not justified in using this doctrine in this way. Firms are not (...) answerable for the crimes committed by their employees, because firms cannot answer as to why the crime was committed; they lack the authority to offer the employee’s reasons for action. Though this rules out respondeat superior as a general principle, I show contexts in which vicarious liability is still appropriate in the criminal law, and I respond to a number of other concerns raised by this picture. Much has been written about what corporations owe society and whether it is appropriate to hold them responsible. In contrast, little has been written about whether anything is owed to corporations apart from what is owed to their members. And when this question has been addressed, the answer has always been that corporations are not worthy of any distinct moral consideration. This is even claimed by proponents of corporate agency. In this paper, I argue that proponents of corporate agency should (...) recognize corporations as worthy of moral consideration. Though particular views of moral status are often taken for granted in the literature, corporations can satisfy many views of moral status given the capacities often ascribed to them. They can even meet the conditions of the views assumed. I conclude by suggesting that recognizing the moral status of corporations may not be as drastic or harmful as we might imagine. (shrink)

In his essay, “Negative and Positive Positivism,” Jules L. Coleman extends in two important ways the Legal Positivism of H. L. A. Hart. First, he shows that the “separability thesis”—the claim that no necessary or constitutive relationship exists between law and morality—to which Positivists are wedded does not entail the view, attributed by Ronald Dworkin to Legal Positivists, that law consists in “hard facts.” Instead, the separability thesis requires only the possibility of deciding the truth of propositions of law. This (...) weaker requirement can be met by rules of recognition that are semantically adequate but that fail to set out tests by means of which the legal status of rules and norms may be verified. Second, Coleman argues that one can subscribe to the separability thesis and still maintain that judges may have a legal duty to couch decisions in moral terms whenever the “content or proper formulation of [a] rule of recognition” is in dispute. Such a legal duty may exist in virtue of a convergent practice “among judges of resolving the controversy in a particular way”. (shrink)

We take ourselves to be able to omit to perform certain actions and to be at times responsible for these omissions. Moreover, omissions seem to have effects and to be manifestations of our agency. So, it is natural to think that omissions must be events. However, very few people writing on this topic have been willing to argue that omissions are events. Such a view is taken to face three significant challenges: (i) omissions are thought to be somehow problematically negative, (...) (ii) it is unclear where the event of an omission would be located, and (iii) if we accept any omissions as events, it seems like there would be far too much causation involving them. In this paper, I develop a novel view of omissions as events and as actions that provides answers to these challenges. (shrink)

The standard case of weakness of will involves a strong temptation leading us to reconsider or act against our judgments. Here, however, I consider cases of what I call ‘habitual weakness', where we resolve to do one thing yet do another not to satisfy any grand desire, but out of habit. After giving several examples, I suggest that habitual weakness has been under-discussed in the literature and explore why. These cases are worth highlighting for their ubiquity, and I show three (...) further advantages of appreciating habitual weakness as a kind of weakness: It challenges purportedly necessary conditions on akrasia, it side-steps outstanding skeptical concerns, and it provides a new model for considering the weak-willed behavior of group agents. I conclude by arguing that cases of habitual weakness are genuine cases of akrasia and weakness of will. Rather than lacking strength of will, habitual weakness involves lacking diligence, vigilance, or fortitude. (shrink)

Whether the food movement is most likely to transform the food system through ‘alternative’ or ‘oppositional’ initiatives has been the focus of considerable scholarly debate. Alternative initiatives are widespread but risk reinforcing the conventional food system by supporting neoliberal discourse and governance mechanisms, including localism, consumer choice, entrepreneurialism and self-help. While oppositional initiatives such as political advocacy have the potential for system-wide change, the current neoliberal political and ideological context dominant in Canada poses difficulties for initiatives that explicitly oppose the (...) conventional food system. As such, some argue that the food movement requires convergence between alternative and oppositional initiatives. In this paper, we investigate convergence using survey results from 143 food movement organizations in four Canadian provinces. Results based on cluster analysis and descriptive statistics on organizational discourse, activities and visions of sustainable food systems demonstrate convergence around neoliberal discourse and governance mechanisms. Localism and consumer education characteristics are particularly prominent, with a majority of respondents describing their organizations as ‘local’, engaging in consumer education activities, and stating the importance of consumer education activities, indicating convergence around alternative, rather than oppositional, initiatives. While convergence around these discourse and strategies may limit the transformative potential of the food system when interpreted as neoliberalisation of the movement, such a reading does not demonstrate their full potential, as survey results also indicate trends of transformative visions of change and political engagement, particularly at the municipal level. This research demonstrates that the movement can work simultaneously within, and opposed to, the conventional food system, and provides understanding of both neoliberal leanings and the politics of the possible of the food movement. Proponents of corporate moral responsibility take certain corporations to be capable of being responsible in ways that do not reduce to the responsibility of their members. If correct, one follow-up question concerns what leads corporations to fail to meet their obligations. We often fail morally when we know what we should do and yet fail to do it, perhaps out of incontinence, akrasia, or weakness of will. However, this kind of failure is much less discussed in the corporate case. And, (...) where it is discussed, the view is that corporations are less prone to weakness. Here, I argue that proponents of corporate responsibility should say that corporations can and often do instantiate weakness of the will, and that this is important to recognize. Weakness of the will requires certain capacities that these proponents typically take corporations to have. And once this is appreciated, we can assess how corporate weakness might proceed differently than how it does for individuals. We can also begin a conversation about how best to meet the distinctive challenges for recognizing and correcting corporate weakness, using a number of resources from management scholarship. This paper argues that Wittgenstein opposed theories of meaning, and did so for good reasons. Theories of meaning, in the sense discussed here, are attempts to explain what makes it the case that certain sounds, shapes, or movements are meaningful linguistic expressions. It is widely believed that Wittgenstein made fundamental contributions to this explanatory project. I argue, by contrast, that in both his early and later works, Wittgenstein endorsed a disjunctivist conception of language which rejects the assumption underlying the question (...) that such theories seek to answer—namely, the assumption that the notion of a meaningful linguistic expression admits of non-circular analysis. Moreover, I give two arguments in favor of the view I ascribe to Wittgenstein: one based on later Wittgenstein's discussion of meaning skepticism and one based on considerations concerning the identity of linguistic expressions. Emergence is typically discussed in the context of mental properties or the properties of the natural sciences, and accounts of emergence within these contexts tend to look a certain way. The emergent property is taken to emerge instantaneously out of, or to be proximately caused by, complex interaction of colocated entities. Here, however, I focus on the properties instantiated by the elements of certain systems discussed in social ontology, such as being a five-dollar bill or a pawn-movement, and I suggest (...) that these properties emerge in a distinctive way. They emerge in part because of a system that is far beyond and typically before the object that instantiates them. I characterize how emergence occurs in these cases, juxtaposing it with how emergence is typically discussed. I then consider whether their emergence is best framed as weak or strong as these notions are characterized in the literature, and I reveal what debates are central to answering this question. Though I will not resolve these debates, I do show a collection of views that would vindicate these properties as strongly emergent and downwardly causing. (shrink)

This paper argues in favor of the _end user thesis_, which holds that the fundamental goal of the firm is to create products and services that provide a benefit to _the people who ultimately use them._ The argument turns on the interest that employees have in work that is meaningful, in the sense that it is an activity worth spending time doing. I argue that a person’s life is diminished to the extent that work constitutes a central feature, but is (...) not meaningful in this way. I argue further that an employee’s work is fully worth doing only if her fundamental aim is to provide a benefit to the people who ultimately use what she produces, and that this is not possible within an organization that aims to maximize profits. The paper concludes by considering arguments that the efficiency gains generated by assigning the firm the goal of profit-maximization justify structuring the firm in a way that does not enable employees to have work that is fully worth doing. It is almost universally accepted that the Frege–Geach Point is necessary for explaining the inferential relations and compositional structure of truth-functionally complex propositions. I argue that this claim rests on a disputable view of propositional structure, which models truth-functionally complex propositions on atomic propositions. I propose an alternative view of propositional structure, based on a certain notion of simulation, which accounts for the relevant phenomena without accepting the Frege–Geach Point. The main contention is that truth-functionally complex propositions do not include (...) as their parts truth-evaluable propositions, but their simulations, which are neither forceful nor truth-evaluable. The view makes room for the idea that there is no such thing as the forceless expression of propositional contents and is attractive because it provides the resources for avoiding a fundamental problem generated by the Frege–Geach Point concerning the relation between forceless and forceful expressions of propositional contents. I further argue that the acceptance of the Frege–Geach Point mars Peter Hanks’ and François Recanati’s recent attempts to resist the widespread idea that assertoric force is extrinsic to the expression of propositional contents. Rejecting this idea, I maintain, requires a deeper break with the tradition than Hanks and Recanati have allowed for. (shrink)

The ‘limits of markets’ debate broadly concerns the question of when it is (im)permissible to have a market in some good. Markets can be of tremendous benefit to society, but many have felt that certain goods should not be for sale (e.g., sex, kidneys, bombs). Their sale is argued to be corrupting, exploitative, or to express a form of disrespect. InMarkets without Limits, Jason Brennan and Peter Jaworski have recently argued to the contrary: For any good, as long as it (...) is permissible to give it for free, then it is permissible to give it for money. Their thesis has led to a number of engaging objections, and I leverage recent work on the nature of feasibility within political philosophy to offer a new challenge.I argue that feasibility offers a constraint on which markets can be permissibly implemented. Though it may be possible to create a morally acceptable version of an otherwise repugnant market, some of these markets may be infeasible, and so we are not permitted to implement them. After laying out this challenge, I consider several replies. They concern the relevance of feasibility, and whether any markets really are infeasible. This provides an opportunity to explore the dangers of pursuing the infeasible and with markets generally. I conclude by considering what might lead us to pursue these markets despite their infeasibility, or how knowledge of infeasibility may prove useful regardless. (shrink)

Agent causation presupposes that actions are behaviors under the causal control of the agent’s mental states, its beliefs and desires. Here the idea of conscious causation in causal explanations of actions is examined, specifically, actions said to be the result of conscious efforts. Causal–functionalist theories of consciousness purport to be naturalistic accounts of the causal efficacy of consciousness. Flanagan argues that his causal–functionalist theory of consciousness satisfies naturalistic constraints on causation and that his causal efficacy thesis is compatible with results (...) of Libet’s experiments on conscious causation. First, the notions of conscious effort and conscious causation are analyzed with respect to the project of naturalizing the mind, that is, the attempt to assimilate folk-psychological explanation to the causal model of explanation in the natural sciences. It is argued that a serious obstacle for any naturalist program is that mental states are individuated by their semantic content, not the mechanistic, physical properties of their neural state instantiations. In particular, it is argued that explanation by reference to mental state content yields not a causal but an interpretive or rationalizing account of action in which the question of causal efficacy is irrelevant. Then, Flanagan’s causal–functionalist theory of consciousness is critically assessed; specifically his interpretations of Libet’s negative experimental results on the causal efficacy of consciousness are diagnosed and disputed. It is contended that Flanagan misinterprets the results of Libet’s consciousness experiments and that his functionalist concept of consciousness fails to yield an adequate explanation of the alleged causal efficacy of consciousness. Finally, his thesis is countered with other experimental results that appear to favor an epiphenomenalist view over the causal efficacy account of consciousness. (shrink)

The “question of reasonable compliance” concerns how business firms should comply with morally reasonable laws that have been democratically enacted. This article argues that, out of respect for the governing authority of democratic citizens, firms should comply with the law in accordance with legislators’ normative expectations of compliance. It defends this view against arguments from the legal, economic and business ethics literatures that focus on the contentious nature of democracy and the competitive nature of the market. In response this article (...) argues that these adversarial features of democracy and capitalism do not limit the ability of democratic legislatures to set normative expectations of market actors, nor the duty of firms to comply with them. Complex systems are pervasive in the world around us. Making sense of a complex system should require that a person construct a network of concepts and principles about some domain that represents key (often dynamic) phenomena and their interrelationships. This raises the question of how expert understanding of complex systems differs from novice understanding. In this study we examined individuals' representations of an aquatic system from the perspective of structural (elements of a system), behavioral (mechanisms), and functional aspects of a (...) system. Structure–Behavior–Function (SBF) theory was used as a framework for analysis. The study included participants from middle school children to preservice teachers to aquarium experts. Individual interviews were conducted to elicit participants' mental models of aquaria. Their verbal responses and pictorial representations were analyzed using an SBF‐based coding scheme. The results indicated that representations ranged from focusing on structures with minimal understanding of behaviors and functions to representations that included behaviors and functions. Novices' representations focused on perceptually available, static components of the system, whereas experts integrated structural, functional, and behavioral elements. This study suggests that the SBF framework can be one useful formalism for understanding complex systems. (shrink)

This paper (i) offers an interpretation of some central aspects of Jeremy Bentham’s philosophy of language, (ii) challenges the received view of its relation to analytic philosophy, and (iii) seeks to show that this investigation into the prehistory of analytic philosophy sheds light on its history proper. It has been often maintained, most notably by Quine, that Bentham anticipated Frege’s context principle and the use of contextual definition. On these bases, Bentham has been presented as one of the initiators of (...) a tradition that shares a common commitment to the “semantic priority of sentences” and that includes authors as otherwise diverse as Frege, Russell, and Wittgenstein. In opposition to this narrative, I argue that Bentham did indeed anticipate the use of contextual definition, but was not a forerunner of Frege’s context principle. The two issues should be sharply distinguished. I show that Bentham’s philosophy of language is informed by a set of empiricist assumptions that Frege’s contextualism was centrally meant to oppose. I conclude that with respect to the question of the relation between propositional and sub-propositional meaning, we should distinguish two opposed strands in the history of analytic philosophy: an empiricist strand anticipated by Bentham, represented most notably by Russell, and an anti-empiricist strand, represented most notably by Frege and Wittgenstein. The Causal Exclusion Problem is raised in many domains, including in the metaphysics of macroscopic objects. If there is a complete explanation of macroscopic effects in terms of the microscopic entities that compose macroscopic objects, then the efficacy of the macroscopic will be threatened with exclusion. I argue that we can avoid the problem if we accept that macroscopic objects are ontically vague. Then, it is indeterminate which collection of microscopic entities compose them, and so information about microscopic entities is (...) insufficient to provide a complete explanation of certain properties of macroscopic objects. Frege appears to hold both that thoughts are internally articulated, in a way that mirrors the semantic articulation of the sentences that express them, and that the same thought can be analyzed in different ways, none of which has to be more fundamental than the others. Commentators have often taken these theses to be mutually incompatible and have tended to polarize into two camps, each of which attributes to Frege one of the theses, but maintains that he is only apparently (...) committed to the other. This paper argues that there are good exegetical and philosophical reasons for reconciling the two theses; that this reconciliation can be achieved by rejecting an assumption shared by the two opposite camps of the exegetical debate, i.e., the assumption that essential articulatedness implies unique articulation; and finally, that this crucial assumption can be resisted by appreciating Frege’s anti-atomistic and ‘organic’ conception of the internal complexity of thoughts. The themes explored include the relationship between education and the emergence of social science, the reputations of educationists, expectations of higher education in the twentieth century, the use of education against poverty and education as policy and case study.

Nonreductive naturalism holds that we can preserve the (scientifically valued) metaphysical truth of physicalism while averting the methodological mistakes of reductionism. Acceptable scientificexplanation need not (in some cases cannot and in many cases, should not) be formulated in the language of physical science. Persuasive arguments about the properties of phenomenal consciousnesspurport to show that physicalism is false, namely that phenomenal experience is a nonphysical fact. I examine two recent, comprehensive efforts to naturalize phenomenal consciousness and argue thatnonreductive naturalism yields a (...) dilemma of reductionism or panpsychism. (shrink)

Ratonalist Pragmatism argues that our interest in truth—our rational nature as practical and theoretical beings—forms us as a community of mutually recognizing truth seekers and creates the possibility of objective moral knowledge.

To some students with disabilities who take philosophy classes, and even to some professors with disabilities who teach philosophy, the discipline is not welcoming. Philosophical theory traditionally recognizes so-called normal people and common modes of functioning but seems to ignore or disparage biologically anomalous individuals. The adequacy of our epistemological and ethical philosophies is a pressing reason for us to acknowledge disability in philosophical theorizing. And there are equally pressing reasons to acknowledge that students with various kinds of disabilities are (...) members of our classes. In this special issue of Teaching Philosophy the authors reflect on how disability is engaged with in their philosophy classrooms for and by their students, and in the philosophy they teach. Shareholders assume risk by investing. Sollars and Tuluca (2018) argue that while this does not justify a managerial policy of shareholder wealth maximization, it does justify compensating shareholders at the oftencalculated cost of equity—the cost that investors require given the level of risk they assume. Here, I show that this can be unfair if the cost of equity is unfair. I then show how shareholder wealth maximization as a managerial imperative is better justified on other grounds.

There are many historical concerns about freedom that have come to be deemphasized in the free will literature itself—for instance, worries around the tyranny of government or the alienation of capitalism. It is hard to see how the current free will literature respects these, or indeed how they could even find expression. This paper seeks to show how these and other concerns can be reintegrated into the debate by appealing to a levels ontology. Recently, Christian List and others have considered (...) how the notion of levels could be relevant to the free will debate. Invariably, however, the focus is on the significance of facts at lower levels. The threats come from below, from fundamental physics or neuroscience. Here, I aim to show how we can frame many interesting concerns about free will in terms of threats from above. After arguing that determination from above is no less threatening, I catalogue such concerns that might constitute threats to our freedom. Doing this not only allows us to show how these concerns relate to those standardly discussed, but it pushes us to expand our conception of freedom. (shrink)

Friederike Moltmann has recently proposed an account of truth-bearers that draws on Kazimierz Twardowski’s action/product distinction. Her account is meant to provide a third way between the dominant view of primary truth-bearers as mind-independent entities and the recently revived construal of them as mental or linguistic acts. This paper argues that there is no room for Twardowskian accounts because they are based on a notion of “nonenduring product” that defies comprehension, and no need for them because the linguistic data that (...) Twardowskians take to refute the act-theoretic approach can, in fact, be handled by that approach. (shrink)

The discovery, more than 60 years ago, of a mutant mouse with a short tail led to the birth of the new field of developmental genetics. Over the years since, numerous investigators have probed the biology of the original short‐tail mutation at the T locus, as well the naturally‐occurring t haplotypes that were uncovered as a result of their interaction with this mutation. Although the T locus ranks among the best characterized developmental loci in the mouse, it was not among (...) the first to be cloned. This situation has now been rectified with two recent reports from Herrmann, Lehrach and their colleagues. While the T locus is expressed uniquely in the embryonic tissues predicted from the mutant phenotype, the gene itself, as well as the predicted amino acid sequence of the T product, show no strong homology to any known sequence. For the moment, at least, the mystery behind the function of the T locus still awaits definitive resolution. (shrink)
