Kierkegaard has no comprehensive or systematic aesthetics of his own. Despite this, his work contains numerous and abundant references to the aesthetics of his time; namely, the Hegelian inspired aesthetics of Johan Ludvig Heiberg. As a one‐time adherent of Heiberg, Kierkegaard was thoroughly steeped in Heiberg's philosophy of art, and often merely applies such aesthetics to his selected objects of interest, echoing the philosophy of art of his day. There are, however, other instances where Kierkegaard carries out a sometimes overt (...) and sometimes covert critique of Heibergian aesthetics, especially after Either/Or, challenging his predecessor's views and the dominant aesthetics of the day. One of the most common ways of morphological marking is affixation, morphemes are classified according to their position. In languages with affixal morphology, suffixes and prefixes are the most common types of affixes. Despite several proposals, it has been impossible to identify solid generalisations about the behaviour of prefixes, in opposition to suffixes. This article argues that the reason is that our traditional definitions of suffix and prefix are based on pre-theoretical, surface criteria that have been given up in other (...) areas of linguistics: defining a morpheme as a prefix does not tell us anything about its grammatical nature, as that label does not take into consideration the structural configuration underlying the morpheme. Once the structural configuration is taken into account, solid generalisations begin to emerge. Max Horkheimer is well known as the director of the Frankfurt Institute for Social Research and as a sometime collaborator with Theodor Adorno, especially on their classic Dialectic of Enlightenment. These essays reveal another side of Horkheimer, focusing on his remarkable contributions to critical theory in the 1930s.Included are Horkheimer's inaugural address as director of the Institute, in which he outlines the interdisciplinary research program that would dominate the initial phase of the Frankfurt School, his first full monograph, and a (...) number of other pieces published in the 1930s. The essays, most of which have not appeared in English before, are surprisingly relevant to current post-philosophy debates, notably "On the Problem of Truth," with its focus on pragmatism, and "The Rationalism Debate in Current Philosophy," a sustained critique of the post-Cartesian philosophy of consciousness. Horkheimer's 1933 critique of Kantian ethics, "Materialism and Morality," is of particular interest given the current reaction to the neo-Kantian aspect of Habermas's work. There are also essays relevant to the current foundations debate within Continental philosophy, and the rationality/relativism question is sustained throughout the volume. (shrink)

The use of genomic selection in agricultural animal breeding is in academic literature generally considered an ethically unproblematic development, but some critical views have been offered. Our paper shows that an important preliminary question for any ethical evaluation of genomic selection is how the scope of discussion should be set, that is, which ethical issues and perspectives ought to be considered. This scope is determined by three partly overlapping choices. The first choice is which ethical concepts to include: an ethical (...) discussion of genomic selection approaches may draw on concepts central to applied ethics, but some critical views have been based on concepts from critical animal studies and continental philosophy. A related choice is to what extent discussion should focus on new ethical issues raised or on existing ethical issues that will be ameliorated, perpetuated or aggravated by an innovation in genomic selection. The third choice is to treat an innovation in genomic selection either as a technique on itself or as a part of specific practices. We argue that ethical discussion should not limit attention to new issues or ignore the implications of particular ways of applying genomic selection in practice, and this has some consequences for which ethical concepts ought to be included. Limiting the scope of discussion may be defensible in some contexts, but broader ethical discussion remains necessary. (shrink)

Digital contact tracing is used in different countries to help contain the COVID-19 pandemic. It raises challenging empirical and ethical questions due to its complexity and widespread effects calling for a broader approach in ethical evaluation. However, existing approaches often fail to include all relevant value perspectives or lack reference to empirical data on the artifact in question. In this paper, we describe the development of an interdisciplinary framework to analyze digital contact tracing from an empirical and ethical perspective. Starting (...) with an analysis of methodological tensions in the attempt to analyze digital contact tracing, we, firstly, set out three methodological premises regarding (a) a specific view of technology, (b) a fruitful normative perspective, and (c) ways to gather empirical knowledge about the object under investigation. Secondly, we inspect consequences of these premises to develop our research methodology. In doing so, we argue for a postphenomenological perspective on technology, solidarity as an important concept to guide the ethical perspective, and an empirical approach based on qualitative social science research and the concept of affordances. We illustrate these considerations by referring to our analysis of the German Corona-Warn-App as an instance of contact tracing based on the Exposure Notification Framework by Google and Apple. We then discuss the implications of using such a framework, including considerations concerning future developments of technologies similar to or inspired by the current concepts of contact tracing. Legal positivism’s multi-faceted insistence on the separability of law and morality includes an insistence on the thoroughly conventional status of legal norms as legal norms. Yet the positivist affirmation of the conventionality of law may initially seem at odds with the mind-independence of the existence and contents and implications of legal norms. Mind-independence, a central aspect of legal objectivity, has been seen by some theorists as incompatible with the mind-dependence of conventions. Such a perception of incompatibility has led some anti-positivist (...) theorists to reject the notion of law’s conventionality, and has led some positivist theorists to query law’s mind-independence. In this paper, we examine how polycystic ovary syndrome is racialized in biomedical research. Drawing from Star’s seminal concept of triangulation, we analyze how the diagnostic criteria for PCOS combine two different biomarkers: body hair and testosterone. Hair and hormones are both haunted by their use in eugenic research, and as clinical measures, they can carry forward powerful narratives of biological difference. PCOS researchers circulate strong claims about racial difference in hirsutism as if they were established knowledge, sometimes calling for (...) race-specific diagnostic thresholds. Tracing the links between race and hirsutism, hirsutism and testosterone, and testosterone and race, we find that these connections are all conceptualized in ambiguous and inconsistent ways. Through triangulation, the uncertainty clouding each link is mitigated by the apparent strength of the chain as a whole. The logic linking race to disease is attenuated, allowing race to persist as a ghost variable. As PCOS is increasingly reframed as a risk factor for other conditions, racial stratification is submerged, implicit but actionable, at every stage of the life course cascade of risk. (shrink)

The authors of this book engage in essay form in a lively debate over the fundamental characteristics of legal and moral rights. They examine whether rights fundamentally protect individuals' interests or whether they instead fundamentally enable individuals to make choices. In the course of this debate the authors address many questions through which they clarify, though not finally resolve, a number of controversial present-day political debates, including those over abortion, euthanasia, and animal rights.

In 'The duty to miscegenate', I harness John Stuart Mill's 19th century theory of social freedom to explain and to dismantle contemporary racialised and gendered injustice. In the first chapter—Social stigmatisation: 'a social tyranny'—I argue that persons racialised-and-gendered-as-black-women were, in the past, unjustly stigmatised by legal penalties against 'miscegenation' and are still, today, unjustly stigmatised by white male avoidance of cross-racial marriage and companionship. In the second chapter—Encounters that count: 'a foundation for solid friendship'—I argue that we can dismantle this (...) stigmatisation, by engaging in regular and frequent cross-racial commensality with persons racialised-and-gendered-as-black-women. In the third chapter—White right: 'a right to avoid'—I argue that, although we have a right to avoid commensal encounters with others, we do not have a right to avoid persons we racialise as black. On the contrary, we have a duty to encounter them, on terms of equality and intimacy. (shrink)

All the above views are statements of or from the so-called emotive theory of value, or are closely related to that theory. Where causal primacy lies or whether all these theories and views are effects of a more deep-laid cause is difficult to determine. Nevertheless, the common bonds between the various views are evident; the views themselves are prevalent. Any work which challenges the current subjective intuitionism in matters of "right," "good," and the like stands out in illuminated relief. Francisco de Vitoria (c. 1485-1546) is well-known for his philosophical contributions to natural rights and international law. However, his extensive work on the conflict between civil authority and the authority of the Catholic Church has been largely neglected by political theorists and intellectual historians. While scholars have recently recognized the significant role played by natural law in the history of political secularism, they have focused almost exclusively on the “modern” natural law theories of Hobbes, Pufendorf, and Thomasius, as opposed to (...) the “scholastic” natural law of early modern Thomists like Vitoria. This essay undertakes an analysis of Vitoria’s use of natural law theory in his approach to civil-ecclesiastical conflict. Contrary to critiques from the “modern” natural lawyers, it argues that Vitoria’s idea of natural law spearheads a forceful defence of the autonomy of civil power from ecclesiastical power. Based on his sharp distinction between the natural and the supernatural spheres of human life, Vitoria argues for a “dualist” position in which civil and ecclesiastical powers are independent and equally binding on human consciences. The essay acknowledges that Vitoria’s dualism ultimately gives way to his endorsement of papal supremacy over all Christian princes. However, this papalist conclusion does not follow from Vitoria’s natural law theory but rather from an opposing political principle: the notion of the universal Christian commonwealth. (shrink)

What is required for an action to promote the satisfaction of a desire? We reject extant answers and propose an alternative. Our account differs from competing answers in two ways: first, it is contrastive, in that actions promote the satisfaction of desires only as contrasted with other possible actions. Second, it employs a notion of expected fit between desire and world, defined as the weighted sum of the fit between the desire and the world in all possible outcomes, where each (...) weight is given by the probability of the agent’s obtaining the relevant outcome. According to our proposal, then, an action promotes a desire when the expected fit for the desire given that the agent performs the action is greater than the expected fit of the desire given that the agent performs the contrasting action. We highlight this account’s attractive features and explain how it improves on its competitors. (shrink)

Recently, some philosophers have argued that we should take quantification of any (finite) order to be a legitimate and irreducible, sui generis kind of quantification. In particular, they hold that a semantic theory for higher-order quantification must itself be couched in higher-order terms. Øystein Linnebo has criticized such views on the grounds that they are committed to general claims about the semantic values of expressions that are by their own lights inexpressible. I show that Linnebo’s objection rests on the assumption (...) of a notion of semantic value or contribution which both applies to expressions of any order, and picks out, for each expression, an extra-linguistic correlate of that expression. I go on to argue that higher-orderists can plausibly reject this assumption, by means of a hierarchy of notions they can use to describe the extra-lingustic correlates of expressions of different orders. Fictionalists about a kind of disputed entity aim to give a face-value interpretation of our discourse about those entities without affirming their existence. The fictionalist’s commitment to non-realism leaves open three options regarding their ontological position: they may deny the existence of the disputed entities (anti-realism), remain agnostic regarding their existence (agnosticism), or deny that there are ontological facts of the matter (ontological anti-realism). This paper outlines a method of adjudicating between these options and argues that fictionalists may be expected (...) to hold preferences between them. The typical arguments and motivations for fictionalism lead naturally to a practice-based metaontological framework under which our practices regarding a kind of disputed entity might inform our ontological beliefs about those entities. When that framework is applied to fictionalism, it is found that the usual motivations for fictionalism lead naturally, though not decisively, to ontological anti-realism. And, where there are reasons against ontological anti-realism, fictionalism leans more toward anti-realism than agnosticism. (shrink)

The moral of Buridan's Ass is that it can sometimes be rational to perform one action rather than another even though one lacks stronger reason to do so. Yet it is also commonly believed that it cannot ever be rational to believe one proposition rather than another if one lacks stronger reason to do so. This asymmetry has been taken to indicate a deep difference between epistemic and practical rationality. According to the view articulated here, the asymmetry should instead be (...) explained by the difference between rational intentions and rational actions. Thus, it turns out, Buridan's Ass-style cases do not indicate an asymmetry between epistemic and practical rationality as such. (shrink)

In several articles, Mumma has presented a formal diagrammatic system Eu meant to give an account of one way in which Euclid's use of diagrams in the Elements could be formalized. However, largely because of the way in which it tries to limit case analysis, this system ends up being inconsistent, as shown here. Eu also suffers from several other problems: it is unable to prove several wide classes of correct geometric claims and contains a construction rule that is probably (...) computationally intractable and that may not even be decidable. In a military-sponsored research project begun during the Second World War, inmates of the Stateville Penitentiary in Illinois were infected with malaria and treated with experimental drugs that sometimes had vicious side effects. They were made into reservoirs for the disease and they provided a food supply for the mosquito cultures. They acted as secretaries and technicians, recording data on one another, administering malarious mosquito bites and experimental drugs to one another, and helping decide who was admitted to the project (...) and who became eligible for early parole as a result of his participation. Thus, the prisoners were not simply research subjects; they were deeply constitutive of the research project. Because a prisoner’s time on the project was counted as part of his sentence, and because serving on the project could shorten one’s sentence, the project must be seen as simultaneously serving the functions of research and punishment. Michel Foucault wrote about such ‘mixed mechanisms’ in his Discipline and punish. His shining example of such a ‘transparent’ and subtle style of punishment was the panopticon, Jeremy Bentham’s architectural invention of prison cellblocks arrayed around a central guard tower. Stateville prison was designed on Bentham’s model; Foucault featured it in his own discussion. This paper, then, explores the power relations in this highly idiosyncratic experimental system, in which the various roles of model organism, reagent, and technician are all occupied by sentient beings who move among them fluidly. This, I argue, created an environment in the Stateville hospital wing more panoptic than that in the cellblocks. Research and punishment were completely interpenetrating, and mutually reinforcing. Nathaniel J.P. Barron offers the first book length account in English of Ernst Bloch's contribution to a Marxist philosophy of language. It is ambitious both in situating Bloch's ideas in the broader Marxist engagement with language as it currently exists, and in using Bloch's utopian categories to challenge that engagement. In particular, Barron reads Voloshinov's insights into language through Bloch's categories, and argues that Bloch advances on Voloshinov by offering an understanding of the social materiality of language which is (...) more useful for challenging fascist forms of utterance. Recent defenders of metaethical constructivism (like Christine Korsgaard, Sharon Street, Aaron James, and Carla Bagnoli) argue that this view can be shown to represent a new, free-standing alternative to familiar approaches in metaethics. If they are correct, traditional discussions in metaethics have overlooked an important position, one that is supposed to adequately explain the nature of our ethical thinking and practice while avoiding the kinds of objections that traditional views struggle with. However, what form constructivism should take and whether constructivists (...) can make good on this ambitious claim remains extremely controversial. This article starts out with a brief account of the origins of contemporary discussions of constructivism. It then moves on to canvass the main motivations and arguments for constructivism along with the various ways in which the view has been interpreted. In the second half of the article, it introduces a serious challenge to the ambitious claim that constructivism represents a new, free-standing approach in metaethics and concludes by entertaining a very recent proposal that this challenge might overlook.
