This article presents a model for regulating cognitive enhancement devices. Recently, it has become very easy for individuals to purchase devices which directly modulate brain function. For example, transcranial direct current stimulators are increasingly being produced and marketed online as devices for cognitive enhancement. Despite posing risks in a similar way to medical devices, devices that do not make any therapeutic claims do not have to meet anything more than basic product safety standards. We present the case for extending existing (...) medical device legislation to cover CEDs. Medical devices and CEDs operate by the same or similar mechanisms and pose the same or similar risks. This fact coupled with the arbitrariness of the line between treatment and enhancement count in favour of regulating these devices in the same way. In arguing for this regulatory model, the paper highlights potential challenges to its implementation, and suggests solutions. (shrink)

This article investigates the application of Philip Pettit's concept of freedom as non-domination to the issues of educational standards and the negotiated curriculum. The article will argue that freedom as non-domination shines a critical light on governmental practice in England over the past two decades. Joshua Cohen's proposal of an ideal deliberative procedure is offered as a potential mechanism for the facilitation of debating contestations between stakeholders over the curriculum. Cohen places particular importance on the participants being ‘formally (...) and substantively equal’ in the proceedings and being able to ‘recognize one another as having deliberative capacities’. It will be argued that formal and substantive equality between children and responsible adults is highly problematic due to the ‘considerable interference’ teachers and adults have to make in children's lives. However, the article does offer examples of children's deliberative capacities on the issue of the curriculum. (shrink)

Is there anything peculiarly "photographic" about photography—something which sets it apart from all other ways of making pictures? If there is, how important is it to our understanding of photographs? Are photographs so unlike other sorts of pictures as to require unique methods of interpretation and standards of evaluation? These questions may sound artificial, made up especially for the purpose of theorizing. But they have in fact been asked and answered not only by critics and photographers but by laymen. Furthermore, (...) for most of this century the majority of critics and laymen alike have tended to answer these questions in the same way: that photographs and paintings differ in an important way and require different methods in interpretation precisely because photographs and paintings come into being in different ways. These answers are interesting because, even within the rather restricted classes of critics, photographers, and theorists, they are held in common by a wide variety of people who otherwise disagree strongly with each other—by people who think that photographs are inferior to paintings and people who believe they are superior; by people who think that photographs ought to be "objective" and those who believe they should be "subjective"; by those who believe that it is impossible for photographers to "create" anything and by those who believe that they should at least try. Joel Snyder teaches criticism and history of photography at the University of Chicago and is presently compiling a book of his own photographs. His contributions to Critical Inquiry include "Picturing Vision" and "Reflexions on Las Meninas: Paradox Lost", written with Ted Cohen in the Winter 1980 issue. Surely [John R.] Searle must rely on a stable, formal conception of the point of view. He sets Las Meninas on a par with the antimony of the liar and the paradoxes of set theory. But nothing is an antimony or a paradox just because it seems so or just because it is confusing or difficult, even if it seems so to everyone. To deserve such a description, a thing must be, so to speak, intrinsically intractable, not merely resistant when (...) looked at in a particular way. If a man says "I do not believe I am alive," that would be odd, and it would be hard to understand just what he means, and it may even be hard or impossible to believe that he is telling the truth; but there is no antimony. If a man says "I am lying," then we have a primitive version of the antimony of the liar. Given the meaning of this utterance—and nothing else—there is no way to get a grip on it. If what the man says is true, then it's false; if what he says is false, then it's true. Power theorists are divided on the question of whether individual powers are single-track (for a single manifestation type) or are multi-track (capable of producing distinct manifestation types for distinct stimuli). EJ Lowe has recently defended single-tracking, arguing that the multi-tracker can provide no adequate reason for treating powers as capable of having multiple manifestation types, and claiming that putative instances of multi-track powers are either single-track powers in need of unifying descriptions or are merely several single-track powers. I respond to (...) Lowe on behalf of the multi-tracker, first by arguing that he overlooks the extra-empirical features of the debate, then by posing a dilemma for any single-track account of powers concerning the single-tracker’s ability to appropriately deal with fine-grained manifestation types. The diagnosis of attention-deficit hyperactivity disorder is a subject of controversy, for a host of reasons. This paper seeks to explore the manner in which children's interests may be subsumed to those of parents, teachers, and society as a whole in the course of diagnosis, treatment, and labeling, utilizing a framework for children's citizenship proposed by Elizabeth Cohen. Additionally, the paper explores aspects of discipline associated with the diagnosis, as well as distributional pathologies resulting from the application of the (...) diagnosis in potentially biased ways. The biobank consent debate is one with deeply held convictions on both the ‘broad’ and ‘specific’ side with little sign of resolution. Recently, Thomas Ploug and Soren Holm have developed an alternative to both specific and broad consent: a meta‐consent framework. The aim here is to consider whether meta‐consent provides a ‘solution’ to the biobank consent debate. We clarify what ‘meta‐consent’ actually is (arguing that the label is a misnomer and ‘consent à la carte’ is more accurate). We identify problems (...) with Ploug and Holm's arguments, and some challenges for meta‐consent. We focus on whether there is any ethical obligation to provide consent à la carte. There may seem to be so, especially if we draw upon an unclear appeal to the ethical significance of ‘respect for autonomy’. Similarly, there might seem to be an intuitive inference from the fact that ethically legitimate research requires informed consent to the conclusion that it thereby requires consent à la carte. It is shown that this line of inference is mistaken. (shrink)

A philosophical question divides the field of addiction research. Can a psychological disorder count as an addiction absent a common underlying physical basis (neurological or genetic) for every case of the disorder in the category? Or is it appropriate to categorize a disorder as an addiction if the symptoms of and diagnostic criteria for it are sufficiently similar to those of other disorders also classified as addictions—regardless of whether there is some underlying physical basis common to each case of the (...) disorder? The question concerns the scope and validity of the scientific concept of addiction and, more broadly, what is required for a psychological concept to count as scientific. The case of pathological gambling (PG) raises this question nicely. ‘‘Should pathological gambling be considered an addiction?’’ asks Howard Shaffer (2003, 176). He specifies the question further (2003, 177–178): ‘‘When clinicians and scientists identify a behavior pattern as an addiction, even if they can identify it reliably according to DSM criteria, how do they know that it is indeed an addiction?’’ He warns that, as it stands, ‘‘the concept of addiction represents a troublesome tautology’’ (2003, 178): a subject S is addicted if and only if S engages in repetitive behavior with negative consequences against S’s better judgment. The problem with this concept is that it provides no way to distinguish behavior that cannot be controlled from behavior that is merely in fact not controlled. This ‘‘lay’’ concept is of little scientific value, Shaffer (2003, 179) argues, saying that ‘‘for addiction to emerge as a viable scientific construct . . . investigators need to establish a ‘gold standard’ against which the presence or absence of the disorder can be judged.’’ PG has no such gold standard, says Shaffer. What would such a gold standard be? Shaffer suggests ‘‘neurogenetic or biobehavioral attributes’’ (ibid.).. (shrink)

ABSTRACT In A Metaphysics for Freedom and related papers, Helen Steward advances a new argument for incompatibilism. Though she concedes that the luck objection is persuasive with regard to existing versions of libertarianism, she claims that agency itself is incompatible with determinism: we are only agents at all if we are able to settle matters concerning our movements, where settling something requires that prior to our settling it lacked sufficient conditions. She argues that genuine agents settle very fine-grained aspects of (...) their movements: when and how they move, even when and how their neurons fire. In this paper, I advance two linked arguments against agency incompatibilism. I argue, first, that we do not exercise direct control over the fine-grained aspects of our movements. Rather, we control these movements indirectly, by intentionally engaging in broadly individuated action types. Second, I argue that these aspects of our movements are lucky for us and, since this is true, they cannot play the role of grounding our agency. (shrink)

_Jokes, Life after Death, and God _has two main tasks: to try to understand exactly what a joke is, and to see whether there are any connections between jokes, on the one hand, and life after death and God, on the other hand. But it pursues other tasks as well, tasks of an ancillary sort. This book devises a general and comprehensive, but brief, theory of jokes. The author begins with critiques of other writers’ views on the subject. 1) Ted (...) Cohen thinks that such a theory is impossible. 2) Ronald Berk, on the other hand, provides just such a theory. And 3) John Morreall provides a general theory of laughter, which may include some things which can be used in a general theory of jokes. 4) Neil Schaeffer, too, provides a general theory of laughter, which makes a big point out of what he calls the “ludicrous context”; but he does include a chapter on jokes. 5) Christopher Wilson offers a general theory of jokes in which he focuses on form and content. And 6) Thomas Werge, in reflecting on the comic, suggests a general theory of jokes which identifies their matter, form, agents, purposes, and beyond these, the underlying shared relational context, which makes it possible for jokes to arise. 7) Bill Fuller’s message is that there is more funniness coming out of two or more heads than out of one, just as Socrates’ message was that there is more clarity coming out of two or more heads than out of one. 8) Umberto Eco feels that monks should laugh, just as ordinary people do; for laughter not only refreshes our seeking spirits, it also illuminates the truth we seek. 9) Simon Critchley, in his reflections on humor, notes that jokes bring on a kind of everyday anamnesis, that they are anti-story stories, that they are like prayers, that they are like philosophy; and that they require a certain underlying context, which is implicitly recognized by both teller and listener, and which renders possible the tension needed to make the punch line work. 10) Martha Wolfenstein, pursuing a psychological analysis of children’s humor, proposes that the underlying motive for telling jokes remains the same from childhood to adulthood, i.e., to transform painful and frustrating experiences so as to extract pleasure from them; and that the agent or productive cause of jokes is the repressing unconscious, as suggested by Freud. As John Morreall has argued, neither the Superiority Theory, nor the Relief Theory, nor the Incongruity Theory appears to work as a general and comprehensive theory. Moreover, these writers talk more about humor and laughter than about jokes. To be sure, a joke is a type of humor. Thus, to say something about humor is to say something, though of a generic sort, about jokes. Similarly, to say something about the laughter caused by humor is to say something, though generic, about the laughter caused by jokes. Most of the authors considered in chapter one are concerned with jokes, and not only with humor as such. Section 11 of chapter one puts together, out of the combined contributions of these authors, what can be considered the beginnings of, some thoughts toward, a general and comprehensive theory of jokes. This task the author illustrates in a concrete way, by looking at individual jokes of different sorts; not, however, without inviting the reader to enjoy these jokes. The author looks particularly at Jewish jokes, Christian jokes, and Islamic jokes, jokes about philosophy and philosophers, yo mama jokes, Italian jokes and Slovak jokes, all of which makes for a clearer understanding of exactly what a joke is. The analysis of general theory is then followed by some views on the morality of jokes and joke-telling, and an analysis of the connection between jokes and life after death, on the one hand, and God, on the other.
