Debate rages over whether Canadian provincial and territorial governments should allow healthcare institutions to conscientiously object to providing medical assistance in dying (MAiD). This issue is likely to end up in court soon through challenges from patients, clinicians, or advocacy groups such as Dying With Dignity Canada. When it does, one key question for the courts will be whether allowing institutional conscientious objection (ICO) to MAiD respects (i.e., shows due regard for) the consciences of the objecting healthcare institutions, understood as (...) unitary entities. This question has been thoroughly explored elsewhere in the academic literature. However, another key question has been underexplored. Specifically, precedent set by the Supreme Court of Canada’s decision in Loyola High School v. Quebec (Attorney General) suggests that the courts will consider whether allowing ICO to MAiD respects the consciences of the personnel within objecting healthcare institutions. My answer to this question is no, by which I mean that allowing ICO to MAiD shows undue disregard for some consciences and undue regard for others. To justify this answer, I analyze the arguments that hold that allowing ICO in healthcare respects the consciences of the personnel within objecting healthcare institutions. My conclusion is that none of these personnel-based arguments succeed in the case of ICO to MAiD. Some fail because they are wrong about the nature of conscience and complicity. Others fail because they contradict the arguments’ proponents’ positions on conscientious objection by individual healthcare providers. Still others fail because they are internally inconsistent. In the target article, Christie, Brusse, et al. argue that selected effect functions do not, in general, explain why a trait exists in a population and, therefore, theories of representational content should not rely on selected effect functions. This response focuses on the claim about functions-for-representation. The role of evolutionary functions in a theory of content is to pick out outcomes that have been systematically stabilized by natural selection. Correctness conditions are conditions involved in explaining how that happened. Selected effect (...) functions can play that role in the complex equilibria that Christie, Brusse, et al. identify. Many Global North contexts are experiencing conflict in feminist discourses between supporters of trans and gender diverse self-identification and self-proclaimed ‘gender critical’ feminists who consider this to undermine feminist goals. We argue that the channelling of contemporary feminist discourse into defensive and oppositional channels has foreclosed the space for more nuanced and future-oriented, utopian thought around freedom from sex/gender, limiting the prospect of developing a coalition of actors focused not on difference, but rather on commonality. Putting classic feminist works by (...) Simone de Beauvoir, Shulamith Firestone and Luce Irigaray into dialogue, we consider an alternative approach to freedom premised on an ontology of potentiality combined with acceptance of the materiality of the binary gender hierarchy, that nonetheless remains utopian and open-ended, demonstrating the capacity to transcend these impasses and potentially overcome these divides. Should the law punish the mere utterance of lies even if the listener has not been deceived? Seana Shiffrin has recently answered this question in the affirmative. She argues that pure lying as such harms the moral fabric of sincerity and distorts the testimonial warrants which underpin communication. The article begins with a discussion of Shiffrin’s account of lying as a moral wrong and the idea of impersonal harm to moral goods. Then I raise two objections to her theory. First, (...) it does not explain persuasively why the fabric of sincerity is so vulnerable to pure lying. Second, it underestimates the need for a causal link between the alleged harm and the speech the government suppresses. I explore the function of the causal inquiry in constitutional law and suggest that if Shiffrin’s theory were to become the standard for adjudication in freedom of expression cases, protection for speech would deteriorate. Resumen: Partiendo del texto clásico Vanguardia y kitsch, nos proponemos analizar la obra del crítico norteamericano Clement Greenberg. Después de la intervención del Estado norteamericano en el arte entre 1935 y 1943, Clement Greenberg surge como uno de los principales críticos que buscaron unificar el “arte elevado” de ese país. Para tanto, el crítico norteamericano busca justificar el nivel artístico de esa vanguardia acercando esa producción a las vanguardias europeas, especialmente el cubismo. Veremos los problemas de Greenberg al forjar una (...) “historicidad inmanente” a las obras de arte para justificar una posible convergencia de las vanguardias europeas en el nuevo contexto de la vanguardia norteamericana: el “expresionismo abstracto”. Greenberg, con ayuda del MoMA y del Estado norteamericano buscó fomentar una “pintura a la americana”, una vanguardia conocida como escuela de Nueva York. Buscamos analizar el contexto en que se forjó esa tendencia artificiosamente unificada y cómo el pop art emerge como una crítica performática de ese contexto. Más que vanagloriarse de sus métodos técnicos, el pop art busca subvertir el contexto de recepción del arte que hasta entonces era expectante del “arte serio y elevado” defendido por Greenberg.: Starting from the classic text Avant-garde and kitsch, we propose to analyze the work of the North American critic Clement Greenberg. After the US state intervention in the arts between 1935 and 1943, Clement Greenberg emerged as one of the main critics who sought to unify the “high art” of that country. The critic attempted to justify the artistic level of the American avant-garde by bringing it closer to the European avant-gardes, especially Cubism. We will see Greenberg’s problems in forging an “immanent historicity” of works of art in order to justify a possible convergence of the European avant-garde in the new context of an American avant-garde of “abstract expressionism”. Greenberg, with the help of the MoMA and the American government, sought to promote an “American painting”, a vanguard known as the New York school. We seek to analyze the context in which this artificially unified tendency was forged, and to analyze how pop art emerged as a performance critique of that context. More than boasting of its technical methods, pop art sought to subvert the context of the reception of art that until then expected the “serious and high art” defended by Greenberg. (shrink)

ABSTRACT Meritocracy, in which success depends on ability and effort, is a desirable goal for sport, even if sport does not achieve this goal perfectly. However, even in a meritocracy whether athletes deserve praise is questionable, given that a determinant of success, genetic endowments, is beyond their control. From a hard determinist perspective, even the elements of athletes’ actions that appear to be within their control—their diligence in developing their skill and strategy and their good sportsmanship—are themselves a function of (...) other environmental and genetic factors for which they deserve no credit. However, a more plausible approach is the compatibilist view that enables us to combine moral evaluation of athletes’ actions with recognizing the causal influences on human behavior. In contrast with manipulation, which really does negate control over our actions, causation that operates via our rational agency is benign and perfectly consistent with our deserving praise for our achievements. A step towards a theory of consciousness would be to characterise the effect of consciousness on information processing. One set of results suggests that the effect of consciousness is to interfere with computations that are optimally performed non-consciously. Another set of results suggests that conscious, system 2 processing is the home of norm-compliant computation. This is contrasted with system 1 processing, thought to be typically unconscious, which operates with useful but error-prone heuristics. -/- These results can be reconciled by separating (...) out two different distinctions: between conscious and non-conscious representations, on the one hand, and between automatic and deliberate processes, on the other. This pair of distinctions is used to illuminate some existing experimental results and to resolve the puzzle about whether consciousness helps or hinders accurate information processing. This way of resolving the puzzle shows the importance of another category, which we label ‘type 0 cognition’, characterised by automatic computational processes operating on non-conscious representations. In this entertaining and provocative introduction, Royle offers lucid explanations of various key ideas, including deconstruction, undecidability, iterability, differance, aporia, the pharmakon, the supplement, a new enlightenment, and the democracy to come. He also gives attention, however, to a range of less obvious key ideas of Derrida, such as earthquakes, animals and animality, ghosts, monstrosity, the poematic, drugs, gifts, secrets, war, and mourning. Derrida is seen as an extraordinarily inventive thinker, as well as a brilliantly imaginative and often very funny (...) writer. Other critical introductions tend to highlight the specifically philosophical nature and genealogy of his work. Royle's book proceeds in a new and different way, in particular by focusing on the crucial but strange place of literature in Derrida's writings. He thus provides an appreciation and understanding based on detailed reference to Derrida's texts, interwoven with close readings of such writers as Shakespeare, Coleridge, P.B. Shelley, Poe, Emily Brontë, Franz Kafka and Elizabeth Bowen. In doing so, he explores Derrida's consistent view that deconstruction is "a coming-to-terms with literature". He emphasizes the ways in which "literature", for Derrida, is indissociably bound up with other concerns, such as philosophy and psychoanalysis, politics and ethics, responsibility and justice, law and democracy. ABSTRACT McCabe is right on one thing and wrong on another. She is right to draw our attention to the different aspects that a verb might have—and not only because attention to aspect helps us understand what is going on in Plato’s Euthydemus. Getting straight on aspect promises benefits for our philosophy of action, and for our metaphysics more generally, comparable to those of getting straight about modality and about excuses. The same is true of getting straight on the active, (...) middle, and passive voices. She is wrong to suggest that we need a properly developed theory of inference before we can be confident in detecting fallacy. Such a suggestion is like saying that we may not dismiss a conjuror’s tricks unless we can say how they are done. (shrink)

Foundations of Relational Realism: A Topological Approach to Quantum Mechanics and the Philosophy of Nature by Michael Epperson and Elias Zafiris sets out to achieve three goals: to develop a version of Whiteheadian metaphysics that the authors call “relational realism”; to formalize relational realism in terms of category theory, in particular sheaf theory; and to use relational realism to solve the interpretative problems of quantum mechanics. These goals are ambitious, to say the least, and all this is leaving aside those (...) sections of FRR which argue that relational realism yields the key to understanding quantum gravity!The text is 388 pages long and comprises two parts. Part I, by Epperson, introduces relational realism and its application to quantum mechanics. Part II, by Zafiris, develops the sheaf theory formalism for relational realism. Within the last decade or so several philosophers have argued against handgun prohibition on the ground that it violates the right to self-defense. However, even these philosophers grant that the right to own handguns is not absolute and could be overridden if doing so would bring about an enormous social good. Analysis of intra-United States empirical data cited by gun rights advocates indicates that guns do not make us safer, while international data lends powerful support to the thesis that guns (...) do indeed increase homicide. If handguns do not make us safer, then appealing to the right to self-defense as an objection to prohibition is moot. Prohibition neither violates the right to self-defense nor sacrifices anyone’s interests for the common good, since it makes each person less likely to be murderedthan the current permissive handgun laws. Moreover, we also must take into account the right to life of victims of handgun crimes made possible by liberal handgun laws. Consequently, invoking the right to self-defense does not provide any sound reason against handgun prohibition over and above familiar utilitarian objections, which are themselves refuted by the empirical evidence. We report evidence further supporting homology between proteins in the F1FO‐ATP synthetase and the bacterial flagellar motor (BFM). BFM proteins FliH, FliI, and FliJ have been hypothesized to be homologous to FO‐b + F1‐δ, F1‐α/β, and F1‐γ, with similar structure and interactions. We conduct a further test by constructing a gene order dataset, examining the order offliH,fliI, andfliJgenes across the phylogenetic breadth of flagellar and nonflagellar type 3 secretion systems, and comparing this to published surveys of gene order in the (...) F1FO‐ATP synthetase, its N‐ATPase relatives, and the bacterial/archaeal V‐ and A‐type ATPases. Strikingly, thefliHIJgene order was deeply conserved, with the few exceptions appearing derived, and exactly matching the widely conserved F‐ATPase gene orderatpFHAG, coding for subunits b‐δ‐α‐γ. The V/A‐type ATPases have a similar conserved gene order. Our results confirm homology between these systems, and suggest a rare case of synteny conserved over billions of years, predating the Last Universal Common Ancestor (LUCA). (shrink)

Neuronal information processing depends on converting membrane depolarizations into compartmentalized biochemical signals that can modify neuronal activity and structure. However, our understanding of how neurons translate electrical signals into specific biochemical responses remains limited, especially in the soma where gene expression and ion channel function are crucial for neuronal activity. Here, I emphasize the importance of physically compartmentalizing action potential‐triggered biochemical reactions within the soma. Emerging evidence suggests that somatic endoplasmic reticulum–plasma membrane (ER‐PM) junctions are specialized organelles that coordinate electrical (...) and biochemical signaling. The juxtaposition of ion channels and signaling proteins at a prominent subset of these sites enables compartmentalized calcium and cAMP‐dependent protein kinase (PKA) signaling. I explore the hypothesis that these PKA‐containing ER‐PM junctions serve as critical sites for translating membrane depolarizations into PKA signals and identify key gaps in knowledge of the assembly, regulation, and neurobiological functions of this somatic signaling system. Debate continues regarding the purpose and practice of music in relation to participation, cultural origin, and education internationally. A Darwinian approach that sees musical vocalization as the adaptive bridge between animal communication and human language remains hotly disputed where such a model does not suit the prevailing political or social agenda. The two books under review present contrasting viewpoints and evidence, while their concurrent publication illustrates the rich potential for developments in this field. Friedmann’s edited book presents separate chapters by (...) sixteen independent authors cover­ing a range of specialisms and topics. Wood’s monograph is, by contrast, an encyclopaedic exploration of the earliest writings on musical theory from China, Greece, and India and their influence on the world’s music over the last 4,000 years. Read both separately and comparatively, these two publications offer a valuable contribution to our understanding of the phenomenon of music and its practice today. (shrink)

This article advances a dialogue between the philosophical hermeneutics of Hans-Georg Gadamer and the ontological hermeneutics of Chung-ying Cheng. This discussion draws into relief a question of whether or not these respective theories provide us with decision-making procedures for determining appropriate or right action in any given situation. In other words, we are inquiring into whether or not these respective hermeneutical theories incorporate forms of ethics. Following this line of questioning, we turn to Cheng’s philosophy of the Yijing and Gadamer’s (...) analysis of Aristotle’s ethics. (shrink)

Its key thesis is that these two enterprises can and should be seen as complementary in addressing different albeit interrelated questions: on the one side the nature of the natural world and our place in it, and on the other how we should proceed and act so as to capitalize on the opportunities that our place in the (...) world affords to us for shaping our lives in a meaningful and satisfying way. Since Rescher's earliest publication of the middle 1950's in this field, the philosophy of science has constituted one focus of his interest and preoccupation. Some dozen of Rescher's contributions to the field are published in the present volume, and they combine to convey his favored way of blending empirical data with philosophical theorizing.

In modern societies entrepreneurship and innovation are widely seen as key sources of economic growth and welfare increases. Yet entrepreneurial innovation has also meant losses and hardships for some members of society: it is destructive of some stakeholders’ wellbeing even as it creates new wellbeing among other stakeholders. Both the positive benefits and negative externalities of innovation are problematic because entrepreneurs initiate new ventures before their private profitability and/or social costs can be fully recognized. In this paper we consider three (...) analytical frameworks within which these issues might be examined: pre-commitments, contractarianism, and an entrepreneurial framework. We conclude that the intersection of stakeholder theory and entrepreneurial innovation is a potentially rich arena for research. (shrink)

In a matter of mere milliseconds, conversational partners can transform their expectations about the world in a way that accords with another person's perspective. At the same time, in similar situations, the exact opposite also appears to be true. Rather than being at odds, these findings suggest that there are multiple contextual and processing constraints that may guide when and how people consider perspective. These constraints are shaped by a host of factors, including the availability of social and environmental cues, (...) and intrinsic biases and cognitive abilities. To explain how these might be integrated in a new way forward, we turn to an adaptive account of interpersonal interaction. This account draws from basic principles of dynamical systems, principles that we argue are already expressed, both implicitly and explicitly, within a broad landscape of existing research. We then showcase an initial attempt to develop a computational framework to instantiate some of these principles. This framework, consisting of what we argue to be important mechanistic insights rendered by neural network models, is based on a promising and long-standing approach that has yet to take hold in the current domain. We argue that by bridging this gap, new insights into other theoretical accounts, such as the connections between memory and common ground information, might be revealed. (shrink)
