Paediatric research in low-income countries is essential to tackle high childhood mortality. As with all research, consent is an essential part of ethical practice for paediatric studies. Ethics guidelines recommend that parents or another proxy provide legal consent for children to participate, but that children should be involved in the decision through providing assent. However, there remain uncertainties about how to judge when children are ready to give assent and about appropriate assent processes. Malawi does not yet have detailed guidelines (...) on assent. Understanding perspectives among children and their parents can assist in developing contextually-appropriate assent guidance. Qualitative research was conducted with children and parents in three settings in Southern Malawi, to take account of any variations between socioeconomic and cultural contexts. In each setting, interviews were conducted with parents and their children who had participated in paediatric research to understand their experiences of assent and views on appropriate assent practice. Focus groups were also conducted with children and parents, to understand broader social perspectives. We found widespread support for involving children in decisions on research participation. Participants identified a range of factors that affect children’s capacity to give assent, including intellectual capacity, emotional development, life experience and cultural norms. Age was often mentioned as a consideration, but deemed an unreliable sole indicator of capacity to assent. In relation to appropriate assent processes, participants emphasised considerations such as supporting effective understanding and minimizing harms. Views on how to achieve these aims varied; for example, there were different ideas about the appropriate order in which to approach children and parents, and about whose decision to respect in the event of disagreement. Parents and children agreed about the value of involving children in decisions on research, and about the need to promote children’s decision-making capacity while respecting parents’ interests in children’s welfare. Developing practical guidance that meets these principles is challenging, particularly given the need for flexible approaches that suit different study types, children’s capacities and family environments. Further discussion within the Malawi research and ethics community will help develop contextually-appropriate guidelines. (shrink)

Life history theory aims to explain the relationship between life events, recognizing that the fertility and growth schedules of organisms are dependent on environmental conditions and an organism’s ability to extract resources from its environment. Using models from life history theory, we predict life expectancy to be positively correlated with educational investments and negatively correlated with adolescent reproduction and total fertility rates. Analyses of UN data from 193 countries support these predictions and demonstrate that, although variation is evident across world (...) regions, strong interactions exist among life expectancy, reproductive investments, and educational attainment, and these relationships occur independently of economic pressures and disease burdens. The interactions are strongest, however, in countries with a life expectancy of ≥60 years as these countries tend to have stable economies and a limited HIV/AIDS burden. These findings suggest that policies aimed at influencing education and reproductive decisions should consider environmental characteristics that drive people’s expectations about their longevity. Amidst growing global endorsements of new biomedical HIV prevention strategies, ARV-based pre-exposure prophylaxis (ARV PrEP) has garnered considerable attention as a potentially promising prevention strategy. Though it may offer more effective protection for certain at-risk groups than conventional prevention strategies (such as sexual partner reduction, condom use, and prevention of mother-to-child transmission), PrEP is more costly. PrEP requires more ongoing contact between individuals and providers, and a level of surveillance from the health system that is not necessary with other preventive (...) measures. In this sense, it represents a new bio-technology for HIV prevention that poses particular challenges for worldwide implementation, given developing countries’ struggling health systems and incomplete HIV treatment programs. Since the emergence of PrEP has stimulated ethical discussions premised on incomplete knowledge of efficacy and implementation, this paper explores the ethical parameters of a likely scenario for PrEP usage in a single, resource-poor country. We first develop a plausible model for PrEP deployment and utilization based on current PrEP research, while carefully considering the reigning institutional values of feasibility and effectiveness in global health approaches. Drawing on ethnographic research of HIV treatment and prevention approaches in Lesotho, we address ethical questions arising from this scenario of PrEP delivery. Lesotho presents a compelling and emblematic case study of PrEP's potential successes and pitfalls in a developing country, given the country's high HIV prevalence, struggles to achieve universal access to HIV treatment regimes, continued existence of stigma around the epidemic, and difficulties in addressing persistent social inequalities that fuel infections. What makes someone responsible for a crime and therefore liable to punishment under the criminal law? Modern lawyers will quickly and easily point to the criminal law's requirement of concurrent actus reus and mens rea, doctrines of the criminal law which ensure that someone will only be found criminally responsible if they have committed criminal conduct while possessing capacities of understanding, awareness, and self-control at the time of offense. Any notion of criminal responsibility based on the character of the offender, (...) meaning an implication of criminality based on reputation or the assumed disposition of the person, would seem to today's criminal lawyer a relic of the 18th Century. In this volume, Nicola Lacey demonstrates that the practice of character-based patterns of attribution was not laid to rest in 18th Century criminal law, but is alive and well in contemporary English criminal responsibility-attribution. Building upon the analysis of criminal responsibility in her previous book, Women, Crime, and Character, Lacey investigates the changing nature of criminal responsibility in English law from the mid-18th Century to the early 21st Century. Through a combined philosophical, historical, and socio-legal approach, this volume evidences how the theory behind criminal responsibility has shifted over time. The character and outcome responsibility which dominated criminal law in the 18th Century diminished in ideological importance in the following two centuries, when the idea of responsibility as founded in capacity was gradually established as the core of criminal law. Lacey traces the historical trajectory of responsibility into the 21st Century, arguing that ideas of character responsibility and the discourse of responsibility as founded in risk are enjoying a renaissance in the modern criminal law. These ideas of criminal responsibility are explored through an examination of the institutions through which they are produced, interpreted and executed; the interests which have shaped both doctrines and institutions; and the substantive social functions which criminal law and punishment have been expected to perform at different points in history. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. ABSTRACTSocial attentional biases are a core component of social anxiety disorder, but research has not yet determined their direction due to methodological limitations. Here we present preliminary findings from a novel, dynamic eye-tracking paradigm allowing spatial–temporal measurement of attention and gaze-following, a mechanism previously unexplored in social anxiety. 105 participants took part, with those high and low in social anxiety traits entered into the analyses. Participants watched a video of an emotionally-neutral social scene, where two actors periodically shifted their gaze (...) towards the periphery. HSA participants looked more at the actors’ faces during the initial 2s than the LSA group but there were no group differences in proportion of first fixations to the face or latency to first fixate the face, although HSA individuals’ first fixations to the face were shorter. We define and investigate Heyting-valued interpretations for Constructive Zermelo–Frankel set theory . These interpretations provide models for CZF that are analogous to Boolean-valued models for ZF and to Heyting-valued models for IZF. Heyting-valued interpretations are defined here using set-generated frames and formal topologies. As applications of Heyting-valued interpretations, we present a relative consistency result and an independence proof.

BackgroundObtaining consent has become a standard way of respecting the patient’s rights and autonomy in clinical research. Ethical guidelines recommend that the child’s parent/s or authorised legal guardian provides informed consent for their child’s participation. However, obtaining informed consent in paediatric research is challenging. Parents become vulnerable because of stress related to their child’s illness. Understanding the views held by guardians and researchers about the consent process in Malawi, where there are limitations in health care access and research literacy will (...) assist in developing appropriate consent guidelines.MethodsWe conducted 20 in-depth interviews with guardians of children and research staff who had participated in paediatric clinical trial and observational studies in acute and non-acute settings in the Southern Region of Malawi. Interviews were audio-recorded, transcribed verbatim, and thematically analysed. Interviews were compared across studies and settings to identify differences and similarities in participants’ views about informed consent processes. Data analysis was facilitated by NVIVO 11 software.ResultsAll participants across study types and settings reported that they associated participating in research with therapeutic benefits. Substantial differences were noted in the decision-making process across study settings. Guardians from acute studies felt that the role of their spouses was neglected during consenting, while staff reported that they had problems obtaining consent from guardians when their partners were not present. Across all study types and settings, research staff reported that they emphasised the benefits more than the risks of the study to participants, due to pressure to recruit. Participants from non-acute settings were more likely to recall information shared during the consent process than participants in the acute setting.ConclusionThe health care context, culture and research process influenced participants’ understanding of study information across study types and settings. We advise research managers or principal investigators to define minimum requirements that would not compromise the consent process and conduct study specific training for staff. The use of one size fits all consent process may not be ideal. More guidance is needed on how these differences can be incorporated during the consent process to improve understanding and delivery of consent.Trial registration Not applicable. (shrink)

The COVID-19 pandemic outbreak has led to a general reorganization of health services and an increase in outpatient telemedicine in mental healthcare for physically ill people. Current literature highlights facilitators and obstacles concerning the use of new technologies in psychotherapy, an underrated topic of research in the context of supportive expressive psychotherapy. More insight is needed to explore the characteristics of video in therapeutic alliance for treatment of specific mental disorders experienced in psychosomatics, particularly with people suffering from a disturbed (...) body- and self-image. Using two clinical vignettes, it is the authors’ intention to enrich the critical debate on current knowledge in psychosomatic remote psychotherapy, with special focus on mentalization deficits and their impact on therapeutic alliance in the consultation-liaison psychiatry setting. In particular, we will question the interpersonal processes at stake related to mirroring and the disruption caused by the use of videoconference applications. We will also reflect upon the relationship between the therapeutic alliance and the medical team, and that between patient and psychotherapist. The aim is to improve psychotherapeutic alliance maintained during the pandemic for specific mental disorders and to inform about possible clinical factors that could be the subject of future empirical studies or professional guidelines. Nicola Lacey presents a new approach to the question of the moral justification of punishment by the State. She focuses on the theory of punishments in context of other political questions, such as the nature of political obligation and the function and scope of criminal law. Arguing that no convincing set of justifying reasons has so far been produced, she puts forward a theory of punishments which places the values of the community at its centre.

In this paper the importance of public affairs management in multinational corporations in India will be examined. After briefly discussing the state of the art in international business and society literature, a conceptual framework for public affairs management in multinational corporations will be developed. This framework serves as the theoretical basis for an empirical study among German multinational corporations in India. This article is a critical and appreciative interaction with Christopher Southgate's theodicy and theology of glory. I critique in particular his rejection of all dualist moves in theodicy. I question why Southgate can ascribe evil to some human actions, many of which are automatic and unconscious, but not to any other level or form of consciousness. I argue that he may rely too heavily on rational scientific categories, which are not sufficient in themselves to carry the weight of key theological (...) concepts. His use of poetry is powerful and suggestive, but in the end, he may not give it enough epistemic weight. (shrink)

The aim of this work is to analyze the constitution of a new collective subject thanks to wearable computers. Wearable computers are emerging technologies which are supposed to become pervasively used in the near future. They are devices designed to be on us every single moment of our life and to capture every experience we have. Therefore, we need to be prepared to such intrusive devices and to analyze potential effect they will have on us and our society. Thanks to (...) a phenomenological and postphenomenological analysis, we will show how these technologies are able to generate a new collective subject with its different collective needs and appetites by merging the living body of many subjects into one. Itself a substantive metaphysical view, this is a position of some import in wider debates, particularly in connection with such problems as physicalism and personal identity. Questions concerning the epistemological status of computer science are, in this paper, answered from the point of view of the formal verification framework. State space reduction techniques adopted to simplify computational models in model checking are analysed in terms of Aristotelian abstractions and Galilean idealizations characterizing the inquiry of empirical systems. Methodological considerations drawn here are employed to argue in favour of the scientific understanding of computer science as a discipline. Specifically, reduced models gained by Dataion are acknowledged as Aristotelian (...) abstractions that include only data which are sufficient to examine the interested executions. The present study highlights how the need to maximize incompatible properties is at the basis of both Abstraction Refinement, the process of generating a cascade of computational models to achieve a balance between simplicity and informativeness, and the Multiple Model Idealization approach in biology. Finally, fairness constraints, imposed to computational models to allow fair behaviours only, are defined as ceteris paribus conditions under which temporal formulas, formalizing software requirements, acquire the status of law-like statements about the software systems executions. This paper aims to show a possible path to address the introduction of intimate digital technologies through a phenomenological and postphenomenological perspective in relation to Japanese and Chinese contexts. Digital technologies are becoming intimate, and, in Japan and China, there are already many advanced digital technologies that provide digital companions for love relationships. Phenomenology has extensive research on how love relationships and intimacy shape the subjects. At the same time, postphenomenology provides a sound framework on how technologies shape the values (...) and meanings we have. Thus, this paper introduces two digital technologies in Japan and China (_Love Plus_ and _XiaoIce_ chatbot), and it analyses according to the elements proposed by phenomenology and postphenomenology. In conclusion, this paper shows how digital companions like _Love Plus_ and _XiaoIce_ chatbot change who we are and the values and meanings we have according to the phenomenological and postphenomenological framework. These entities might not be human, but they shape who we are as human beings and the meanings and value we give to love. (shrink)

Background: Compassion fatigue is recognized as impacting the health and effectiveness of healthcare providers, and consequently, patient care. Compassion fatigue is distinct from “burnout.” Reliable measurement tools, such as the Professional Quality of Life scale, have been developed to measure the prevalence, and predict risk of compassion fatigue. This study reviews the prevalence of compassion fatigue among healthcare practitioners, and relationships to demographic variables. Methods: A systematic review was conducted using key words in MEDLINE, PubMed, and Ovid databases. Data were (...) extracted from a total of 71 articles meeting inclusion criteria, from studies measuring compassion fatigue in healthcare providers using a validated instrument. Quantitative and qualitative data were extracted and compiled by three independent reviewers into an evidence table that included basic study characteristics, study strength and quality determination, measurements of compassion fatigue, and general findings. Meta-analysis, where data allowed, was stratified by Professional Quality of Life version, heterogeneity was quantified, and pooled means were reported with 95% confidence interval. A table of major study characteristics and results was created. Ethical consideration: This paper contains no primary data obtained directly from research participants. Data obtained from previously published resources have been acknowledged within references. Psychological distress, particularly compassion fatigue, can be insidious, no health profession is immune, and may significantly impact the ability to provide care. Results: A total of 71 studies were included. Compassion fatigue was reported across all practitioner groups studied. Relationships to most demographic variables such as years of experience and specialty were either not statistically significant or unclear. Variability in reporting of Professional Quality of Life results was found. Interpretation: Compassion fatigue exists across diverse practitioner groups. Prevalence is highly variable, and its relationship with demographic, personal, and/or professional variables is inconsistent. Questions are raised about how to mitigate compassion fatigue. (shrink)

This paper takes part in the methodological debate concerning the nature and the justification of hypotheses about computational systems in software engineering by providing an epistemological analysis of Software Testing, the practice of observing the programs’ executions to examine whether they fulfil software requirements. Property specifications articulating such requirements are shown to involve falsifiable hypotheses about software systems that are evaluated by means of tests which are likely to falsify those hypotheses. Software Reliability metrics, used to measure the growth of (...) probability that given failures will occur at specified times as new executions are observed, is shown to involve a Bayesian confirmation of falsifiable hypotheses on programs. Coverage criteria, used to select those input values with which the system under test is to be launched, are understood as theory-laden principles guiding software tests, here compared to scientific experiments. Redundant computations, fault seeding models and formal methods used in software engineering to evaluate test results are taken to be instantiations of some epistemological strategies used in scientific experiments to distinguish between valid and non-valid experimental outcomes. The final part of the paper explores the problem, advanced in the context of the philosophy of technology, of defining the epistemological status of software engineering by conceiving it as a scientifically attested technology. In this article, we discuss how we used institutional ethnography (Institutional ethnography as practice, Rowman & Littlefield, Lanham, MD and 2006) to map out powerful ruling relations that organize nurses’ wound care work. In recent years, the growing number of people living with wounds that heal slowly or not at all has presented substantial challenges for those managing the demands on Canada's publicly insured health‐care system. In efforts to address this burden, Canadian health‐care administrators and policy‐makers rely on scientific evidence (...) about how wounds heal and what treatments are most effective. Advanced wound care exemplifies the growing authorization of particular forms of evidence that change the ways in which nurses come to know about and conduct their work. The focus of this paper's nursing inquiry is a critique of registered nurses’ wound work as it arises within the established uptake of scientific evidence. (shrink)

Model checking, a prominent formal method used to predict and explain the behaviour of software and hardware systems, is examined on the basis of reflective work in the philosophy of science concerning the ontology of scientific theories and model-based reasoning. The empirical theories of computational systems that model checking techniques enable one to build are identified, in the light of the semantic conception of scientific theories, with families of models that are interconnected by simulation relations. And the mappings between these (...) scientific theories and computational systems in their scope are analyzed in terms of suitable specializations of the notions of model of experiment and model of data. Furthermore, the extensively mechanized character of model-based reasoning in model checking is highlighted by a comparison with proof procedures adopted by other formal methods in computer science. Finally, potential epistemic benefits flowing from the application of model checking in other areas of scientific inquiry are emphasized in the context of computer simulation studies of biological information processing. The problem of artificial intelligence and human being has always raised questions about possible interactions among them and possible effects yielded by the introduction of such un-human subject. Dreyfus deeply connects intelligence and body based on a phenomenological viewpoint. Thanks to his reading of Merleau-Ponty, he clearly stated that an intelligence must be embodied into a body to function. According to his suggestion, any AI designed to be human-like is doom to failure if there is no tight bound with a (...) human-like body. Today, we are facing the pervasive introduction of robots into our everyday life, and the problem of this co-existence raises again with new vigor since they are not mere speculations, but there are already products sold to the public. We will highlight how vulnerability has to be taken into consideration in the design of robots to create entities which are able to relate to human beings taking into consideration mainly the positions of Sartre, Habermas, Levinas, and Marleau-Ponty. A first part will focus on the vulnerability of the robots. Robots are going to be among us, but a real interaction is possible only the moment they have a “same” body of ours. Therefore, only through the realization of a “fragile” body we can achieve a cohabitation between equals. Thanks to Merleau-Ponty we will show how the vulnerability of a body is one of the most important element to found any social interaction. The second part will focus on how the robots will affect the vulnerability of the human subjects. To produce vulnerable robots is not a mere neutral introduction, but it shapes how the subjects are constituted. Thanks to Levinas, we will study how the vulnerable robots will shape the subjects. Thanks to Sartre, we will show how the creation of a different gaze in the robot changes the vulnerabilities of the human subjects. Introducing vulnerable robots is a way to shape ourselves. Husserl’s official account of essence is modal. It is also, I submit, incompatible with the role that essence is supposed to play, especially relative to necessity, in his overall philosophy. In the Husserlian framework, essence should rather be treated as a non-modal notion. The point, while not generally acknowledged, has been made before (by Kevin Mulligan for one); yet the arguments given for it, though perhaps sound, are not Husserlian. In this paper I present a thoroughly Husserlian argument for that (...) claim, as well as a Husserlian essentialist account of necessity. I also discuss the role of grounding within the account. TC is the claim that human freedom to act otherwise and God’s essential omniscience are compatible, while E is the claim that every individual entity whatsoever has a modal profile consisting in having both essential and accidental properties. I purport to show that, if E is assumed in the argument for TC, then the latter leads to a very puzzling upshot. In the present article, I introduce Husserl’s analyses of ‘natural causality’ and ‘volitional causality’, which are collected in the volume ‘Wille und Handlung’ of the Husserliana edition Studien zur Struktur des Bewußtseins. My aim is to show that Husserl’s insight into these phenomena enables us to understand more clearly both the specificity of, and the relation between, the motivational nexus belonging to the sphere of the will in contrast with the causal laws of nature. In light of this understanding, in (...) the last part of the article I reflect on whether and to what extent there is, in fact, an ontological and epistemological compatibility between volitional causality and natural causality. This paper addresses the methodological problem of analysing what it is to explain observed behaviours of engineered computing systems, focusing on the crucial role that abstraction and idealization play in explanations of both correct and incorrect BECS. First, it is argued that an understanding of explanatory requests about observed miscomputations crucially involves reference to the rich background afforded by hierarchies of functional specifications. Second, many explanations concerning incorrect BECS are found to abstract away from descriptions of physical components and processes (...) of computing systems that one finds below the logic circuit and gate layer of functional specification hierarchies. Third, model-based explanations of both correct and incorrect BECS that are provided in the framework of formal verification methods often involve idealizations. Moreover, a distinction between restrictive and permissive idealizations is introduced and their roles in BECS explanations are analysed. (shrink)

The Turing Test is best regarded as a model to test for intelligence, where an entity’s intelligence is inferred from its ability to be attributed with ‘human-likeness’ during a text-based conversation. The problem with this model, however, is that it does not care if or how well an entity produces a meaningful conversation, as long as its interactions are humanlike enough. As a consequence, the TT attracts projects that concentrate on how best to fool the judges. In light of this, (...) I propose a new version of the TT: the Questioning Turing Test. Here, the entity has to produce an enquiry rather than a conversation; and it is parametrised along two further dimensions in addition to ‘human-likeness’: ‘correctness’, evaluating if the entity accomplishes the enquiry; and ‘strategicness’, evaluating how well the entity accomplishes the enquiry, in terms of the number of questions asked. Over the last twenty years there has been an explosion of interest in ‘criminal justice’, generating a wealth of research incorporating law, philosophy, political theory, sociology and other disciplines. The fascination of criminal justice flows from the cultural prominence of criminalization as a form of social control. The news media in Australia, Britain or the United States provide plentiful evidence of the extent to which crime, fear of crime, government criminal justice policy and the activities of the more visible enforcement (...) agencies such as the police preoccupy many contemporary Western societies. At the international level, too, criminal justice is increasingly salient. Moreover, the status of criminal justice as a particularly coercive and costly governmental repertoire claims our attention. Yet the diversity of practices encompassed within the notion of ‘criminal justice’, and the variety of practical, philosophical and political questions which they raise, make criminal justice an elusive subject. All too often, the general ‘theories of criminal justice’ which purport to make sense of the concrete practices illuminated by empirical research turn out to be too abstract and/or too narrow in focus to fulfil that promise. The purpose of this chapter is to provide a framework which might enable us to make sense of criminal justice without imposing an unrealistically rigid or unduly circumscribed model on the complicated processes with which we are concerned. Wellner’s article aims at changing an essential element within phenomenology by introducing the idea of digital imagination. Assuming her thesis, I aim to raise two possible kinds of questions generated by the introduction of a technologically embedded imagination which is externalized.
