When faced with the threat of negative reputation spillover from an alliance partner accused of environmental misconduct, the focal firm must decide whether to adopt a supportive or non-supportive response. We argue that this decision denotes a commitment escalation dilemma, but that factors previously found to increase escalation tendencies lead to de-escalation in our crisis contagion context. Specifically, we derive four hypotheses from this reverse effect proposition, and test these using a policy-capturing survey targeting Norwegian CEOs. We found that firms (...) are more likely to select an adversary response when the alliance is of high strategic importance and has high termination costs. Conversely, firms are more likely to select an advocacy response when the alliance is of low strategic importance and has low termination costs and when the CEO was not involved in the formation of the alliance. Overall, our study answers a call for a more nuanced understanding of commitment escalation and the theory’s boundary conditions by introducing reputation spillover crisis as a contextual influencer of escalation behavior. It also extends the reputation literature and provides new evidence that reputation concerns can instigate ethical decision-making. (shrink)

Public insurance is commonly assimilated with redistributive tools mobilized by the welfare state in the pursuit of an egalitarian ideal. This view contains some truth, since the result of insurance, at a given moment, is the redistribution of resources from the lucky to unlucky. However, Joseph Heath considers that the principle of efficiency provides a better normative explanation and justification of public insurance than the egalitarian account. According to this view, the fact that the state is involved in the provision (...) of specific insurance is explained and justified by the greater efficiency of the state, in comparison with markets, in addressing market failures such as moral hazard or adverse selection. Our argument is that while insurance, intrinsically and idealistically, may diverge from a redistributive scheme, it is nevertheless difficult to deny that insurance has nothing to do with equality. More precisely, we argue that insurance may be understood as an egalitarian tool if our understanding of equality is broadened to include relational equality. Our paper aims to briefly recap the debates surrounding public insurance as a redistributive tool, advancing the idea that public insurance may be a relational egalitarian tool. It then presents a number of relational arguments in favor of the involvement of the state in the provision of specific forms of insurance, arguments that have been overlooked given the domination of luck egalitarian approaches in these debates. After reviewing the literature on current knowledge about consciousness in humans, we present a state-of-the art discussion on consciousness and related key concepts in animals. Obviously much fewer publications are available on non-human species than on humans, most of them relating to laboratory or wild animal species, and only few to livestock species. Human consciousness is by definition subjective and private. Animal consciousness is usually assessed through behavioural performance. Behaviour involves a wide array of cognitive processes that have to be (...) assessed separately using specific experimental protocols. Accordingly, several processes indicative of the presence of consciousness are discussed: perception and cognition, awareness of the bodily-self, self-related knowledge of the environment (including social environment). When available, specific examples are given in livestock species. Next, we review the existing evidence regarding neuronal correlates of consciousness, and emphasize the difficulty of linking aspects of consciousness to specific neural structures across the phyla because high-level cognitive abilities may have evolved independently along evolution. Several mammalian brain structures (cortex and midbrain) are involved in the manifestations of consciousness, while the equivalent functional structures for birds and fishes would likely be the pallium/tectum and midbrain. Caution is required before excluding consciousness in species not having the same brain structures as the mammalian ones as different neural architectures may mediate comparable processes. Finally, specific neurophysiological mechanisms appear to be strongly linked to the emergence of consciousness, namely neural synchrony and neural feedback. Considering the limited amount of data available and the few animal species studied so far, we conclude that different manifestations of consciousness can be observed in animals but that further refinement is still needed to characterize their level and content in each species. Phenomenological, process-based and post-Marxist approaches have stressed the immanent nature of the ontogenesis of our world. The concept of performativity epitomizes these temporal, spatial and material views. Reality is always in movement itself: it is constantly materially and socially ‘performed’. Other views lead to a pre-defined world that would be mostly revealed through sensations (i.e. ‘representational perspectives’). These transcendental stances assume that a subject, although pre-existing experience, is the absolute condition of possibility of it. In this paper, we develop another (...) view of performativity (either complementary or interrelated to an immanent stance), one that re-introduces transcendence in the analysis but sees in it something dialogical to the process itself. We draw from the notions of visibility-invisibility and continuity-discontinuity (Merleau-Ponty 1945/2013, 1964) in order to show how everyday activity both performs and makes visible the world. From that perspective, modes of visibility appear as conditions of possibility of performativity itself. We draw some implications for the conceptualization of management practices. (shrink)

Using emotional film clips is one of the most popular and effective methods of emotion elicitation. The main goal of the present study was to develop and test the effectiveness of a new and comprehensive set of emotional film excerpts. Fifty film experts were asked to remember specific film scenes that elicited fear, anger, sadness, disgust, amusement, tenderness, as well as emotionally neutral scenes. For each emotion, the 10 most frequently mentioned scenes were selected and cut into film clips. Next, (...) 364 participants viewed the film clips in individual laboratory sessions and rated each film on multiple dimensions. Results showed that the film clips were effective with regard to several criteria such as emotional discreteness, arousal, positive and negative affect. Finally, ranking scores were computed for 24 classification criteria: Subjective arousal, positive and negative affect (derived from the PANAS; Watson & Tellegen, 1988), a positive and a negative affect scores derived from the Differential Emotions Scale (DES; Izard et al., 1974), six emotional discreteness scores (for anger, disgust, sadness, fear, amusement and tenderness), and 15 “mixed feelings” scores assessing the effectiveness of each film excerpt to produce blends of specific emotions. In addition, a number of emotionally neutral film clips were also validated. The database and editing instructions to construct the film clips have been made freely available in a website. (shrink)

Son analyse mérite certainement d'être étudiée de nouveau, à la fois dans la perspective de la cohérence propre de sa propre philosophie, dans celle de l'héritage (Machiavel, Naudé, Hobbes, Pascal, Spinoza) et dans celle de la réception (Locke, Leibniz, Montesquieu, l'Encyclopédie, Gottsched, Wolff et les Lumières allemandes).

On sait que sur la question des pensées imperceptibles, Nicole, bientôt suivi par le bénédictin François Lamy, heurte l’opinion d’Arnauld. L’opposition d’Arnauld à Nicole touchant la question de la grâce est bien connue. C’est plutôt de l’originalité philosophique de Nicole qu’il s’agira dans ce travail. Cet article comprend deux parties nettement distinctes. La première retrace l’histoire, de 1925 à 1955, de ce que Henri-Xavier Arquillière a cru bon d’appeler l’« augustinisme politique ». Cette théorie ne prolonge nullement les travaux de Pierre Mandonnet et d’Étienne Gilson ; elle est tissée de nombreuses contradictions ; elle procède d’une erreur sur les idées augustiniennes de nature et de justice. Comme l’avait déjà montré Henri de Lubac en 1984, le prétendu « augustinisme politique » n’est qu’un (...) mythe. La seconde partie relit la façon dont Augustin a critiqué la définition cicéronienne du populus et la définition qu’il en a proposée à son tour : une définition neutre, libérée des connotations religieuses, en pleine cohérence avec son idée de la concorde possible entre les deux cités. Augustin n’est donc pas seulement libre de toute tendance théocratique ; il se situe même aux antipodes de ce que l’on n’aurait jamais dû appeler « augustinisme politique ». (shrink)

Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Simone de Beauvoir's novel She Came to Stay follows Françoise and her partner Pierre as their intimacy becomes increasingly entangled with the young and tempestuous Xavière. Many readings of the novel explain Françoise's bad feeling and eventual violence as symptoms of sexual jealousy. The book has also been read as a veiled autobiography of Beauvoir and Sartre's similar entanglement with Olga Kosakiewicz, so that, very often, Françoise's jealousy is assumed to stand in for Beauvoir's own. This article is about (...) misreading in two ways. First, I argue that the common view that this is a story in part or in whole about sexual jealousy reflects a radical simplification of the emotional and interpersonal dynamics of the “trio.” Second, I argue that this interpretive simplification is in fact common in mainstream readings of nonmonogamous relationships, where “jealousy” is used to name any and all bad feelings in the vicinity of the nonmonogamous relationship, and where that bad feeling is interpreted as caused by the nonmonogamy itself. To conclude, I suggest that She Came to Stay, and particularly its notorious ending, can be seen as Beauvoir's depiction—and refusal—of the misreadings that constitute the “situation” of nonmonogamy in everyday life. Les études interdisciplinaires dans les domaines des études amérindiennes et indigènes (NAIS), de l’ethnographie, de l’anthropologie et de l’histoire ont largement débattu de l’importante biographie de sainte Catherine Tekakwitha, la première sainte indigène. Cet article propose une lecture attentive des récits de vie de Tekakwitha et sur Tekakwitha, qui sont tellement centrés sur la mort qu’on peut les qualifier d’« écrits sur la mort ». Les écrits sur la mort documentent les relations entre les vivants et les morts. Cet article (...) examine les documents autochtones parallèlement à un texte colonial : d’abord la participation de Tekakwitha à la tradition du wampum, puis la notice nécrologique de l’explorateur et auteur jésuite Pierre François Xavier de Charlevoix, annexée à son Histoire et description de la Nouvelle-France (1744). Cette double approche offre deux perspectives sur le pouvoir de la mémoire de Tekakwitha : Tekakwitha et Charlevoix ont tous deux contribué à l’émergence de formes modernes de récits de vie au dix-huitième siècle. Je présente le texte monumental de Charlevoix, à un niveau macro, comme une nécrologie de l’ordre colonial français et jésuite en déclin ; et, à un niveau micro, comme un recueil de nécrologies d’individus indigènes, dont la plus importante est celle de Tekakwitha. Je soutiens que la Nouvelle-France sert à affirmer l’importance de la France, des Jésuites et de Charlevoix lui-même, en les alignant sur le projet européen de colonisation et en invoquant le pouvoir des personnes autochtones décédées, en particulier Tekakwitha. Simultanément, l’écriture de la mort qu’illustre Tekakwitha a fonctionné comme un imaginaire de l’énergie, renforcé par la controverse suscitée par sa caractérisation en tant que femme indigène exemplaire. L’article conclut en affirmant que Tekakwitha est une « présence active » qui continue à façonner le discours sur son héritage. (shrink)

Que l'on songe a l'ethique de la discussion, a la theorie de la justice, a la philosophie des relations internationales, au probleme des arguments dits transcendantaux ou encore a la theorie de l'experience esthetique, la pensee de Kant temoigne aujourd'hui d'une incontestable vigueur et d'une etonnante jeunesse. Cette contemporaneite de Kant se traduit par de multiples tentatives de dialogue avec cette oeuvre afin d'en degager la pertinence pour le debat actuel. L'oeuvre de (...) class='Hi'>Pierre Laberge a su repondre de maniere exemplaire a ses ordres de preoccupations dans l'etude de Kant. Les auteurs sollicites ont eu l'occasion de collaborer avec Pierre Laberge et lui rendent ici un hommage posthume. Ce recueil reflete ainsi cette double exigence d'actualiser le kantisme et d'en analyser les textes. (shrink)

In this article we defend the inferential view of scientific models and idealisation. Models are seen as “inferential prostheses” (instruments for surrogative reasoning) construed by means of an idealisation-concretisation process, which we essentially understand as a kind of counterfactual deformation procedure (also analysed in inferential terms). The value of scientific representation is understood in terms not only of the success of the inferential outcomes arrived at with its help, but also of the heuristic power of representation and their capacity to (...) correct and improve our models. This provides us with an argument against Sugden’s account of credible models: the likelihood or realisticness (their “credibility”) is not always a good measure of their acceptability. As opposed to “credibility” we propose the notion of “enlightening”, which is the capacity of giving us understanding in the sense of an inferential ability. (shrink)

An English translation of Pierre Bayle's posthumous last book, Entretiens de Maxime et de Themiste (1707), in which Bayle defends his skeptical position on the problem of the evil. This book is often cited and attacked by G.W. Leibniz in his Theodicy (1710). Over one hundred pages of original philosophical and historical material introduce the translation, providing it with context and establishing the work's importance.

Since the 1970s, the concepts of “lifeworld” and “everyday life” have been part of the discourse of social pedagogy and social and educational work in general. Xavier Úcar's objective in this article is to generate and communicate socio-pedagogical knowledge that helps social pedagogues to build socio-educational relationships that are more effective, more sustainable, more satisfactory, and ultimately richer in terms of both experiences and learning for participants. A conceptually oriented, nonsystematic analysis procedure was used to conduct this research. The (...) procedure involved an in-depth investigation of documents that focus on the two target areas of this study: (1) social pedagogy, and (2) lifeworld and everyday life. The results describe the theoretical background of lifeworld and everyday life, discuss the development of the perspective of “lifeworld orientation” within the framework of social pedagogy in Germany, and analyze how everyday life is understood through actions undertaken by social pedagogues. These results provide ideas for mapping the essential dimensions of everyday life from the perspective of social pedagogy. (shrink)

The past decade has seen a burgeoning of scholarly interest in conscientious objection in health care. Specifically, several commentators have discussed the implications that conscientious objection has for the delivery of timely, efficient, and nondiscriminatory medical care. In this paper, I discuss the main argument put forward by the most prominent critics of conscientious objection—what I call the Professional Duty Argument or PDA. According to proponents of PDA, doctors should place patients’ well-being and rights at the center of their professional (...) practice. Doctors should be prepared to set their personal moral or religious beliefs aside where these beliefs conflict with what is legal and considered good medical practice by relevant professional associations. Conscientious objection, on this account, should be heavily restricted, if even allowed at all. I discuss two powerful objections against PDA. The first objection, which I call the fallibility objection, notes that law and professional codes of conduct are fallible guides for ethical conduct and that conscientious objection has in the past and continues today to provide a check on aberrations in law and professional convention. The second, which I call the professional discretion objection, states that restrictions on conscientious objection undermine one of the cornerstones of good medical practice, namely, a practitioner’s right to independent professional judgment. I argue that these two objections give us reason to retain conscience clauses in professional codes of conduct. (shrink)

The past decade has seen a burgeoning of scholarly interest in conscientious objection in healthcare. While the literature to date has focused primarily on individual healthcare practitioners who object to participation in morally controversial procedures, in this article we consider a different albeit related issue, namely, whether publicly funded healthcare institutions should be required to provide morally controversial services such as abortions, emergency contraception, voluntary sterilizations, and voluntary euthanasia. Substantive debates about institutional responsibility have remained largely at the level of (...) first-order ethical debate over medical practices which institutions have refused to offer; in this article, we argue that more fundamental questions about the metaphysics of institutions provide a neglected avenue for understanding the basis of institutional conscientious objection. To do so, we articulate a metaphysical model of institutional conscience, and consider three well-known arguments for undermining institutional conscientious objection in light of this model. We show how our metaphysical analysis of institutions creates difficulties for justifying sanctions on institutions that conscientiously object. Thus, we argue, questions about the metaphysics of institutions are deserving of serious attention from both critics and defenders of institutional conscientious objection. (shrink)

El presente volumen recoge el texto de las tres conferencias, más la versión escrita de la última de ellas. La tesis que Zubiri desarrolla en estas lecciones es que el ser humano es (...) a la vez y necesariamente individual, social e histórico, y que estas dimensiones vienen exigidas por su propia realidad específica, que es pluralizante, continuante y prospectiva. Le Pere Xavier Tilliette est l'un des plus grands historiens contemporains de la philosophie. Il est l'auteur d'une monumentale etude en deux volumes sur Schelling... qui il avait d'ailleurs consacre plusieurs autres ouvrages. Il a egalement ecrit d'excellents livres sur d'autres grandes figures de la philosophie occidentale notamment Fichte, Merleau-Ponty, Lequier. Il est aussi et surtout le representant le plus connu d'un genre unique de la philosophie de la religion, celui qui traite des grands themes de la theologie chretienne (...) selon leurs dimensions proprement philosophiques. Rappelons simplement plusieurs travaux tres novateurs sur le Christ et la philosophie, mais aussi sur la philosophie et l'Eglise ou encore la philosophie et l'Eucharistie. Toutefois, Xavier Tilliette n'est pas seulement philosophe, il est aussi un grand erudit de l'histoire litteraire francaise, notamment de l'oeuvre de Paul Claudel. Apres deux Festschrift anterieures parues respectivement en Allemagne et en Italie, ce troisieme recueil publie en l'honneur du Pere Tilliette est edite en Belgique. Il contient trente contributions, plus de la moitie consacrees... l'histoire de la philosophie, avec un nombre eleve de textes sur Schelling. Les autres etudes, tres variees, tres originales, relevent de la philosophie de la religion, de la theologie philosophique et de l'histoire de la litterature. Ces travaux dont les auteurs, en provenance de huit pays et de trois continents, vont de jeunes erudits... peine trentenaires jusqu'aux contemporains de l'illustre jesuite, sont rediges en Francais, en Italien, en Allemand et en Anglais. Ils manifestent et illustrent la fecondite de l'oeuvre de ce disciple fervent des Peres de Lubac et Danielou, son rayonnement extraordinaire, les richesses multivalentes de ses deux-mille publications. We prove strong completeness of the □-version and the ◊-version of a Gödel modal logic based on Kripke models where propositions at each world and the accessibility relation are both infinitely valued in the standard Gödel algebra [0,1]. Some asymmetries are revealed: validity in the first logic is reducible to the class of frames having two-valued accessibility relation and this logic does not enjoy the finite model property, while validity in the second logic requires truly fuzzy accessibility relations and this (...) logic has the finite model property. Analogues of the classical modal systems D, T, S4 and S5 are considered also, and the completeness results are extended to languages enriched with a discrete well ordered set of truth constants. Insurance is pervasive in many social settings. As a cooperative device based on risk pooling, it serves to attenuate the adverse consequences of various risks by offering policyholders coverage against the losses implied by adverse events in exchange for the payment of premiums. In the insurance industry, the concept of actuarial fairness serves to establish what could be adequate, fair premiums. Accordingly, premiums paid by policyholders should match as closely as possible their risk exposure. Such premiums are the product of (...) the probabilities of losses and the expected losses. This article presents a discussion of the fairness of actuarial fairness through three steps: defining the concept based on its formulation within the insurance industry; determining in which sense it may be about fairness; and raising some objections to the actual fairness of actuarial fairness. The necessity of a normative evaluation of actuarial fairness is justified by the influence of the concept on the current reforms of public insurance systems and the fact that it highlights the question of the repartition of the gains and burdens of social cooperation. Xavier Landes | : Happiness has become a central theme in public debates. Happiness indicators illustrate this importance. This article offers a typology of the main challenges conveyed by the elaboration of happiness indicators, where happiness can be understood as hedonia, subjective well-being, or eudaimonia. The typology is structured around four questions: what to measure?—i.e., the difficulties linked to the choice of a particular understanding of happiness for building an indicator; whom to include?—i.e., the limits of the community monitored (...) by such an indicator; how to collect the data?—i.e., the difficulties stemming from objective and subjective reporting; what to do?—i.e., the concerns about the use of happiness indicators in public policy. The major points of normative contention are discussed for each of these dimensions. The purpose of this article is to contribute in a constructive manner to happiness research by offering an overview of some major philosophical and political challenges of building happiness indicators. The conclusion underlines the importance of the strategy of diversification- hybridization, which consists in setting a variety of indicators or composite indicators that articulate different understandings of happiness. It is stressed that happiness indicators raise democratic and institutional issues with which normative thinkers should deal. | : Le bonheur est devenu un thème central dans les débats publics. Les indicateurs de bonheur illustrent cette importance. Cet article offre une typologie des principaux enjeux contenus dans le travail d’élaboration d’indicateurs de bonheur quand ce dernier est compris comme hedonia, bien-être subjectif ou eudaimonia. La typologie est structurée autour de quatre questions : 1) que mesurer?, où sont en jeu les difficultés liées au choix d’une compréhension particulière du bonheur pour construire un indicateur; 2) qui inclure?, c’est-à-dire comment tracer les limites de la communauté morale qui est l’objet d’un tel indicateur; 3) comment collecter les données?, où on interroge les difficultés propres aux techniques subjectives et objectives de collecte de données; 4) que faire?, où on soulève l’enjeu des craintes quant à l’usage d’indicateurs de bonheur dans les politiques publiques. Les points majeurs de dispute normative sont discutés pour chaque dimension. Nous espérons ainsi contribuer de manière constructive à la recherche sur le bonheur en offrant un aperçu de quelques défis philosophiques et politiques majeurs relatifs à la construction d’indicateurs de bonheur. Nous concluons en soulignant l’importance de la stratégie de diversification-hybridation qui consiste à mettre en place des indicateurs variés ou composites articulant différentes compréhensions du bonheur. Conscience is an idea that has significant currency in liberal democratic societies. Yet contemporary moral philosophical scholarship on conscience is surprisingly sparse. This paper seeks to offer a rigorous philosophical account of the role of conscience in moral life with a view to informing debates about the ethics of conscientious objection in medicine. I argue that conscience is concerned with a commitment to moral integrity and that restrictions on freedom of conscience prevent agents from living a moral life. In section (...) one I argue that conscience is a principle of moral awareness in rational agents, and that it yields an awareness of the personal nature of moral obligation. Conscience also monitors the coherence between an agent’s identity-conferring beliefs and intentions and their practical actions. In section two I consider how human beings are harmed when they are forced to violate their conscience. Restrictions on the exercise of conscience prevent people from living in accord with their own considered understanding of the requirements of morality and undermine one’s capacity for moral agency. This article concludes with a consideration of how a robust theory of conscience can inform our understanding of conscientious objection in medicine. I argue that it is in the interest of individual practitioners and the medical profession generally to foster moral agency among doctors. This provides a prima facie justification for permitting at least some kinds of conscientious objection. (shrink)

It is shown that axiomatic extensions of intuitionistic propositional calculus defining univocally new connectives, including those proposed by Gabbay, are strongly complete with respect to valuations in Heyting algebras with additional operations. In all cases, the double negation of such a connective is equivalent to a formula of intuitionistic calculus. Thus, under the excluded third law it collapses to a classical formula, showing that this condition in Gabbay's definition is redundant. Moreover, such connectives can not be interpreted in all Heyting (...) algebras, unless they are already equivalent to a formula of intuitionistic calculus. These facts relativize to connectives over intermediate logics. In particular, the intermediate logic with values in the chain of length n may be "completed" conservatively by adding a single unary connective, so that the expanded system does not allow further axiomatic extensions by new connectives. Résumé Le présent article analyse d’un point de vue sémiotique les rapports entre la /lumière/ et l’/obscurité/ et les catégories discursives au sein d’un corpus de quatre textes de la littérature du dix-neuvième et vingtième siècle. Il s’agit de montrer que les propriétés physiques et sensibles fondent les structures sémio-narratives et orientent les catégories axiologiques, thymiques, spatiales et temporelles.
