The past year in bioethics in Australia has been relatively predictable. We continue to struggle with rising healthcare costs, though thankfully not on par with numerous other countries due to a relatively positive economic outlook. We are still fighting difficulties associated with higher medical indemnity costs, which have again caused many physicians to leave private practice, particularly in high-risk and specialty practice areas. In response, the federal government delayed the imposition of the medical indemnity levy for physicians until mid 2005. (...) In May, the Australian Law Reform Commission and the Australian Health Ethics Commission issued their final joint report on genetic testing entitled “Essentially Yours” and endorsed use of genetic tests by insurance companies, despite the concerns of some geneticists and many members of the public about their scientific reliability. However, they also advocated the establishment of the Human Genetics Commission of Australia to oversee such uses of genetic tests in terms of both scientific and actuarial reliability, and debates continue over the implementation of this and a number of their other recommendations. And state governments continue to phase in smoking bans in public places, with most implementing full bans in enclosed restaurants and cafes and planning to require provision of nonsmoking areas in all pubs within the next year. a. The coronavirus pandemic has necessitated extraordinary human resilience in order to preserve and prolong life and social order. Risks to health and even life are being confronted by workers in health and social care, as well as those in roles previously never defined as “frontline,” such as individuals working in community supply chain sectors. The strategy adopted by the United Kingdom government in facing the challenges of the pandemic was markedly different from other countries. The present study set out to (...) examine what variables were associated with resilience, burnout, and wellbeing in all sectors of frontline workers, and whether or not these differed between the UK and Republic of Ireland. Individuals were eligible if they were a frontline worker in the UK or RoI during the pandemic. Part of a larger, longitudinal study, the participants completed an online survey to assess various aspects of their daily and working lives, along with their attitudes toward their government’s handling of the crisis, and measurement of psychological variables associated with heroism. A total of 1,305 participants provided sufficient data for analysis. UK-based workers reported lower wellbeing than the RoI-based participants. In multivariate models, both psychological and pandemic-related variables were associated with levels of resilience, burnout, and wellbeing in these workers, but which pandemic-related variables were associated with outcomes differed depending on the country. The judgment of lower timeliness in their government’s response to the pandemic appeared to be a key driver of each outcome for the UK-based frontline workers. These findings provide initial evidence that the different strategies adopted by each country may be associated with the overall wellbeing of frontline workers, with higher detriment observed in the UK. The judgment of the relatively slow response of the UK government to instigate their pandemic measures appears to be associated with lower resilience, higher burnout, and lower wellbeing in frontline workers in the UK. Upon hearing a scalar adjective in a definite referring expression such as “the big…,” listeners typically make anticipatory eye movements to an item in a contrast set, such as a big glass in the context of a smaller glass. Recent studies have suggested that this rapid, contrastive interpretation of scalar adjectives is malleable and calibrated to the speaker's pragmatic competence. In a series of eye‐tracking experiments, we explore the nature of the evidence necessary for the modulation of pragmatic inferences in (...) language comprehension, focusing on the complementary roles of top–down information ‐ (knowledge about the particular speaker's pragmatic competence) and bottom‐up cues (distributional information about the use of scalar adjectives in the environment). We find that bottom‐up evidence alone (e.g., the speaker says “the big dog” in a context with one dog), in large quantities, can be sufficient to trigger modulation of the listener's contrastive inferences, with or without top‐down cues to support this adaptation. Further, these findings suggest that listeners track and flexibly combine multiple sources of information in service of efficient pragmatic communication. (shrink)

In this study, we examine investor and firm response to the California Transparency in Supply Chains Act of 2010. The CTSCA requires large retail and manufacturing firms to disclose efforts to eradicate slavery and human trafficking from their supply chains and is a rare example of mandated corporate social responsibility disclosure. Based on a sample of 105 retail companies subject to the CTSCA, we find a significant negative market reaction to the passing of the CTSCA. Furthermore, we find that the (...) reaction is significantly more negative for larger firms and companies facing greater supply chain risks, suggesting that investors place a negative value on exposure to legitimacy threats in the social domain. With respect to company disclosure response, we document relatively high compliance with the legislation, although we also find that the disclosure response appeared to be more symbolic than substantive in nature. Finally, our analysis indicates that both disclosure choice and disclosure extensiveness were significantly higher for the high-supply chain risk companies, suggesting that the response was influenced by concerns with strategic legitimation. Overall, the limited quality of disclosure suggests that, without additional rules and guidance, mandates alone may not lead to meaningful social disclosure. (shrink)

Kant is often considered a key figure in a modern transition from social and political systems based on honour to those based on dignity, where “honour” is understood as a hierarchical measure of social value, and “dignity” is understood as the inherent and equal worth of every individual. The essay provides a richer account of Kant’s contribution to the “politics of equal dignity” by examining his understanding of dignity and honour, and the interaction between these concepts. The essay argues that (...) Kant appeals to multiple varieties of dignity and honour, that he does not reject honour in favour of dignity, and that he sees some versions of honour as conducive to respect for dignity. Furthermore, the complexity of Kant’s views on dignity and honour has implications for the theory and practice of human rights in the current day. (shrink)

This book derives from Annas’s 1997 Townsend Lectures at Cornell University, and it retains the invigorating clarity and fast pace of a first-rate lecture series. In it Annas discusses assorted topics in Plato’s ethics and their ancient interpretation: her unifying theme is that we have much to learn from ancient readings of Plato, and those of the Middle Platonists in particular.

This aricle discusses the similarity between the propagation of pathogens (viruses and worms) on computer networks and the proliferation of pathogens in cellular organisms (organisms with genetic material contained within a membrane-encased nucleus). It introduces several biological mechanisms which are used in these organisms to protect against such pathogens and presents security models for networked computers inspired by several biological paradigms, including genomics (RNA interference), proteomics (pathway mapping), and physiology (immune system). In addition, the study of epidemiological models for disease (...) control can inspire methods for controlling the spread of pathogens across multiple nodes of a network. In the Metaphysical Foundations of Natural Science, Kant claims that perception of force through touch is fundamental to our knowledge of substance in space. However, he also holds that perception cannot have modal content. Causation is a modal notion, so how can Kant allow perception of causal force? In response to this puzzle, I provide a new reading of Kant’s theory of touch. Touch does not involve perception of the necessity of a cause, but it does involve awareness of the (...) activity of our body in relation to other bodies. Human embodied activity has a hitherto unrecognized central role in Kant’s accounts of empirical cognition of substance in space, the science of such a substance, and the irreducibility of its causal forces. This article describes a new prenatal genetic test that is painless, early, and increasingly available. State legislatures have reacted by prohibiting abortion for reason of fetal sex or of fetal diagnosis and managing genetic counseling. This article explores these legislative responses and considers how physicians and genetic counselors currently communicate post-testing options. The article then examines the challenges ahead for genetic counseling, particularly in light of the troubling grip of abortion politics on conversations about prenatal diagnosis.

Background International collaborators face challenges in the design and implementation of ethical biomedical research. Evaluating community understanding of research and processes like informed consent may enable researchers to better protect research participants in a particular setting; however, there exist few studies examining community perspectives in health research, particularly in resource-limited settings, or strategies for engaging the community in research processes. Our goal was to inform ethical research practice in a biomedical research setting in western Kenya and similar resource-limited settings. Methods (...) We sought to use mabaraza , traditional East African community assemblies, in a qualitative study to understand community perspectives on biomedical research and informed consent within a collaborative, multinational research network in western Kenya. Analyses included manual, progressive coding of transcripts from mabaraza to identify emerging central concepts. Results Our findings from two mabaraza with 108 community members revealed that, while participants understood some principles of biomedical research, they emphasized perceived benefits from participation in research over potential risks. Many community members equated health research with HIV testing or care, which may be explained in part by the setting of this particular study. In addition to valuing informed consent as understanding and accepting a role in research activities, participants endorsed an increased role for the community in making decisions about research participation, especially in the case of children, through a process of community consent. Conclusions Our study suggests that international biomedical research must account for community understanding of research and informed consent, particularly when involving children. Moreover, traditional community forums, such as mabaraza in East Africa, can be used effectively to gather these data and may serve as a forum to further engage communities in community consent and other aspects of research. This paper explores ways in which experiential learning theories, in particular transformative learning theory, can inform farmer participatory research and extension (PR&E). I identify and discuss three key elements of experiential learning theory – second-order experiences, reflection, and dialogue – that are particularly pertinent to PR&E practice. I then turn to one experiential learning theorist – Mezirow, and examine his theory of transformative learning to assess how it may inform the PR&E process. I outline the basic components and stages of (...) transformative learning and summarize the main criticisms of the theory. Following this, parallels are drawn between transformative learning and what actually takes place in PR&E, and examples are given of the ways in which scientists and rural people may undergo transformative learning through the PR&E process. Ways in which transformative learning can be encouraged within the PR&E context are discussed. I conclude that Mezirow’s work can provide PR&E practitioners and theorists with additional insights into how adults learn and especially how they – researchers, extensionists and rural people – can transform their ways of thinking to accommodate a shift from conventional research and extension to PR&E. This essay considers how an “intimacy contract,” as a conceptual tool and a political reality, extends existing critiques of the social contract tradition by accounting for the privatized nature of the post-9/11 US empire. Examining critiques by Carole Pateman and Charles Mills, I argue that an intimacy contract uncovers the coercive power relations underlying neoliberal discourses of entrepreneurial freedom. Focusing on migrant labor on US military bases, I provide an overview of the racial, sexual, and settler contracts and the need (...) to extend Mills’s and Pateman’s critiques of embodiment and spatiality. Next, I suggest how the intimacy contract generates a transnational, embodied account of the labors upholding US empire; a lens into the shifting significance of these labors under neoliberal imperialism; and a chronicling of desire and workers’ interests. In conclusion, I suggest how the intimacy contract exposes multiple resistances to US empire and neoliberal capitalism. (shrink)

The goal of the debunking social constructionist is to reveal as social kinds that are widely held to be natural (or, in some cases, to reveal as more deeply social kinds that are already widely recognized to be social). The prominent approach to such debunking has been to make a case for thinking that the individuation conditions for membership in the kinds in question are in fact social (or in fact more deeply social than has previously been recognized). In this (...) paper, I argue that adopting the prominent approach to debunking prevents one from answering the implicit question being posed by the debunker, namely, the question of how a plausibly socially constituted kind can come to appear more natural than it in fact is. I then sketch an alternative way of understanding social kinds that enables us to answer the appearance question while remaining neutral on the nature of social kinds. In particular, I argue that the mechanism of covert normativity explains causally the persistence of the social kinds of interest to the debunker, and so also provides an answer to the appearance question. Serial issues closely marry the major anthropological questions that a society asks itself… or is about to ask itself; here unfolds “the infinite possibility of possibilities”, and we will see that the theme of the extended human gradually increases in power, often from the angle of a transhumanism gone mad. Anchoring the theme of technological increase in the sexual imagination makes it possible to immediately focus on the intimate fantasy of each reader/viewer; this “situated” motif also singles out the subject, (...) who is nevertheless doomed to the stereotypy of the gender product, post-fordist but necessarily subject to identifiable patterns. The dissensus between the obscure desirability of the process and the horror of the underlying ideologies will therefore form the framework of this statement; the dystopian colouring in fact affects the essence of the device, but without the absence of a form of shameful fascination for this technological, or even epistemocratic, « immortality » that science seems to promise—to the wealthiest in any case. Individual differences and polysemy have rich literatures in cognitive linguistics, but little is said about the prospect of individual differences in polysemy. This article reports an investigation that sought to establish whether people vary in the senses of a polysemous word that they find meaningful, and to develop a novel methodology to study polysemy. The methodology combined established tools: sentence-sorting tasks, a rarely used statistical model of inter-participant agreement, and network visualisation. Two hundred and five English-speaking participants completed one of (...) twelve sentence-sorting tasks on two occasions, separated by a delay of two months. Participants varied in how similarly they sorted the sentences as compared to other participants, and mean agreement across all 24 tasks did not meet an established threshold of acceptable agreement. Between the two test phases, inter-participant agreement varied to a significant but trivial degree. Networks generated for each dataset varied in the degree to which they captured all participants’ responses. This variation correlated with inter-participant agreement. The data collectively suggest that word senses may be subject to individual differences, as is the case in other linguistic phenomena. The methodology proved replicable and has a promise as a useful tool for studying polysemy. (shrink)

If your philosophical edifice rests on the idea of the Good, and you believe that wisdom consists in knowing and doing the Good, then it is incumbent upon you at some point to explain what it means to know the Good. In order to do that, you probably need to explain what it means to know anything at all. You need to answer the question, "what is knowledge?". Plato asks that question in the Theaetetus. If answering it requires giving a (...) definition of knowledge in general, he fails to give an answer. Worse, the dialogue suggests that it is impossible to define knowledge. The result is a failure not only for epistemology, but for any politics or ethics based on knowledge of the Forms. The pursuit of wisdom falls by the wayside, unmasked as quixotry. ;I argue that there are several long and important passages in the Theaetetus which are centrally concerned with the question of how the pursuit of wisdom can be rescued from the failure of epistemology. To that end, I focus on the definition of knowledge as perception, and argue that Plato means its failure to reveal problems which will plague any attempt to define knowledge. I then analyse two passages which make wisdom their central concern, namely the "Apology of Protagoras" and the "Digression" . Finally, I suggest that Plato provides a model for understanding the rationally inaccessible nature of knowledge and its relation to wisdom. The model is given in Theaetetus' definition of irrational square roots, which is offered at the outset of the discussion as a paradigm for defining knowledge. Theaetetus defines irrational roots in terms of their productive powers; this provides a model for wisdom, insofar as wisdom is a kind of knowledge which produces practical activity, i.e., insofar as to know the Good is to do the Good. If the knowledge contained in wisdom cannot be defined in itself, it can be defined through its productive power. (shrink)

A recent focus on philosophical methodology has reinvigorated ordinary language philosophy with the contention that philosophical inquiry is better served by attending to the ordinary use of language. Taking cues from findings in the social sciences that deploy methods utilizing language, various ordinary language philosophers embrace a guiding mandate: that ordinary language usage is more reflective of our linguistic and conceptual competencies than standard philosophical methods. We analyze two hypotheses that are implicit in the research from which ordinary language approaches (...) take their cues. This pair of optimistic assumptions (a) bind word meanings to properties of their corresponding concepts and (b) regard language as a direct reflection of our underlying cognitive processes and competencies. Polysemy and pragmatics complicate each assumption. Because the ordinary language philosopher’s methodological mandate compels us to consider how individuals process the utterances they encounter in deciphering the communicative intentions of speakers, failing to attend to the import of polysemy and pragmatics in philosophical and empirical methods has the potential to frustrate the aims of their insightful mandate. The significance of those two complications is worked out with the case study of knowledge. (shrink)

An important virtue of Emotion and Virtue is its careful and sophisticated discussion of the central yet ill-understood virtue of courage. However, Sreenivasan’s treatment of courage raises as many questions as it answers; several of these can be brought into sharper focus by comparison with the argument of Plato and Aristotle on the topic.

This paper presents the case of a young man with a diagnosis of schizophrenia, who agreed to inpatient treatment primarily to avoid being formally detained. I draw on Peter Breggin's early critique of coercion of informal patients to supply an updated discussion of the ethical issues raised. Central questions are whether the admission was coercive, and if so, whether unethical. Whether or not involuntary admission would be justified, moral discomfort surrounds its appearance as a threat. This arises in part from (...) ambivalence about autonomy: although a ‘choice’ is made, the threat of detention impinges on the patient's choice. Recent legal developments provide some experience of safeguarding those whose consent is not obtained. This highlights the lack of safeguards in this ‘gap’ and suggests that we have the tools with which to begin to deal with the problem. (shrink)

Derrida questions what takes place between the paper and the machine inscribing it. He examines what becomes of the archive when the world of paper is subsumed in new machines for virtualization, and whether there can be a virtual event or a virtual archive. Derrida continues his long-standing investigation of these issues, and ties them into the new themes that governed (...) his teaching and thinking in the past few years: the secret, pardon, perjury, state sovereignty, hospitality, the university, animal rights, capital punishment, the question of what sort of mediatized world is replacing the print epoch, and the question of the “wholly other.” Derrida is remarkable at making seemingly occasional pieces into part of a complexly interconnected trajectory of thought. Why do some people still choose psychoanalysis-Freud's so-called talking cure-when numerous medications are available that treat the symptoms of psychic distress so much faster? Elisabeth Roudinesco tackles this difficult question, exploring what she sees as a "depressive society": an epidemic of distress addressed only by an increasing reliance on prescription drugs. Far from contesting the efficacy of new medications like Prozac, Zoloft, and Viagra in alleviating the symptoms of any number of mental or nervous conditions, Roudinesco argues that the use (...) of such drugs fails to solve patients' real problems. In the man who takes Viagra without ever wondering why he is suffering from impotence and the woman who is given antidepressants to deal with the loss of a loved one, Roudinesco sees a society obsessed with efficiency and desperate for the quick fix. She argues that "the talking cure" and pharmacology represent not just different approaches to psychiatry, but different worldviews. The rush to treat symptoms is itself symptomatic of an antiseptic and depressive culture in which thought is reduced to the firing of neurons and desire is just a chemical secretion. In contrast, psychoanalysis testifies to human freedom and the power of language. (shrink)

Liberalism, in any of its forms, places a strong emphasis on the individual---it prioritizes equal rights and liberties, and measures are taken to assure for all citizens the opportunity to make full use of their freedoms and entitlements. Many conceptions of human rights are objected to on the grounds that they are based on liberal premises, and insufficiently sensitive to the fact of reasonable cultural pluralism. ;Using as a foil recent work in this area by John Rawls, I argue in (...) chapter one for a justificatory basis of human rights that advances values---in particular values of minimal democracy including the right to political participation---that may have emerged historically alongside liberalism but that we ought not consider specifically liberal. My account diverges form Rawls' at this point: he does not believe that such values can be defended from premises that are not specifically liberal. ;Since a group is, after all, merely a collection of individuals, liberalism appears to be committed, unsatisfactorily, to a permissive right to secede in the sense that, other things being equal, groups always ought to be permitted to secede voluntarily. I show in my second chapter that liberalism is not committed to this permissive view. Though liberalism implies that no one has a duty to refrain from secession, it does not support the stronger thesis that states must permit groups to secede if they wish. My treatment of secession argues for a more general framework in which those liberties whose protection is of basic importance to liberalism are distinguished from those whose protection is not so guaranteed. ;Derek Parfit has put forth a general difficulty regarding our obligations to future generations to which I respond in chapter three. Parfit claims, plausibly, that we may suppose a major public policy decision to have sufficiently broad ramifications that in about two hundred years there would be nobody alive who would have been alive had some different policy been selected. But then the choice of such a policy would not make those people worse off, since they would not otherwise have been born. This would remain so even in the case of policies that cause the lives of future generations to be of a very low quality. Parfit's "Non-Identity Problem" challenges us to provide plausible moral reasons against such public policies. ;I argue that the only adequate response to this problem comes from a liberal focus on the rights of future generations, and the moral status that this confers on them. Taking such seriously, many public polices can be shown to be objectionable despite the fact that such policies may not harm the interests of those affected by them. (shrink)

The prominence of the island city of Corcyra in Thucydides’ history of the Peloponnesian War presents a puzzle. It appears in the opening of the work in a conflict with its mother city Corinth, after which representatives of both Corinth and Corcyra deliver speeches at Athens. Further conflict between the two cities follows, with Athens supporting Corcyra. Later on, Thucydides depicts two unusually graphic episodes ofstasisat Corcyra. This prominence is surprising, given that the historian himself explicitly states that the initial (...) set of events involving the island does not in fact represent the beginning of the war, and that the Corcyreanstasisis not the first in the war, and that, as has been often observed, it is not even particularly remarkable or influential in it. In what follows, I seek to clarify Thucydides’ use of the island first by exploring ancient views of Corcyra's ‘predecessor’, Homer's Phaeacia, and by arguing that perceptions of the mythical place mirror and reinforce beliefs about its successor Corcyra. An interpretation of Phaeacia as a representative of excess luxury, weakness and friendlessness requires an aggressive reading of Homer. As Rose and others have made clear, however, this position is defensible even if not all readers may choose to accede to it. A significant strand of ancient opinion seems to have adopted a similar attitude as well, perhaps projecting a fifth-century prejudice identified by Rusten back onto Corcyra's Homeric forerunner. In the second part of this paper, I argue that this background influences Thucydides’ presentation of Corcyra, and that the historian emphasizes the story of the island in order to illustrate a pattern of extravagant wealth followed by civic collapse that would have been readily recognizable to an ancient audience. The fact that Thucydides’ Corcyra-story traces all the stages of this process, from a nod to Homeric opulence through pre-war selfishness to wartime collapse, effectively explains his conspicuous use of the city.
