The overall aim of this article is to discuss the organization of limit setting in healthcare in terms of legitimacy. We argue there is a strong ethical demand that such processes should be arranged to provide adversely affected people well-justified reasons to confer legitimacy to the processes despite favouring a different decision-making outcome. Two increasingly popular approaches, Accountability for Reasonableness (A4R) and Multi-Criteria Decision Analysis (MCDA), can both be applied to support legitimate decision-making processes. However, the role played by ‘fair-minded (...) people’ in the A4R framework can be shown to undermine an adequate conceptualization of legitimacy according to the ethical demand. We discuss and specify conditions enabling A4R to meet this ethical demand when being implemented in a real-world setting without having to renounce the aim of striving for ‘reasonableness’ and impartiality. The methodological approach MCDA describes how to arrange for transparent resource allocation. This approach does not encompass any normative guidance on how to shape limit settings in terms of ‘reasonableness’; it basically promotes ‘rational’ decisions. We discuss how this practical methodology can be integrated with the theoretical A4R framework to meet the ethical demand while at the same time promoting politically required impartiality of healthcare limit setting. We show that three fundamental information-theoretic constraints -- the impossibility of superluminal information transfer between two physical systems by performing measurements on one of them, the impossibility of broadcasting the information contained in an unknown physical state, and the impossibility of unconditionally secure bit commitment -- suffice to entail that the observables and state space of a physical theory are quantum-mechanical. Entanglement has long been the subject of discussion by philosophers of quantum theory, and has recently come to play an essential role for physicists in their development of quantum information theory. In this paper we show how the formalism of algebraic quantum field theory (AQFT) provides a rigorous framework within which to analyse entanglement in the context of a fully relativistic formulation of quantum theory. What emerges from the analysis are new practical and theoretical limitations on an experimenter's ability to (...) perform operations on a field in one spacetime region that can disentangle its state from the state of the field in other spacelike-separated regions. These limitations show just how deeply entrenched entanglement is in relativistic quantum field theory, and yield a fresh perspective on the ways in which the theory differs conceptually from both standard non-relativistic quantum theory and classical relativistic field theory. Philosophical reflection on quantum field theory has tended to focus on how it revises our conception of what a particle is. However, there has been relatively little discussion of the threat to the "reality" of particles posed by the possibility of inequivalent quantizations of a classical field theory, i.e., inequivalent representations of the algebra of observables of the field in terms of operators on a Hilbert space. The threat is that each representation embodies its own distinctive conception of what a (...) particle is, and how a "particle" will respond to a suitably operated detector. Our main goal is to clarify the subtle relationship between inequivalent representations of a field theory and their associated particle concepts. We also have a particular interest in the Minkowski versus Rindler quantizations of a free Boson field, because they respectively entail two radically different descriptions of the particle content of the field in the *very same* region of spacetime. We shall defend the idea that these representations provide *complementary descriptions* of the same state of the field against the claim that they embody completely *incommensurable theories* of the field. Aesthesis, the classical term for sensing and perceiving, is at the heart of innumerable problems that plague global society. The purpose of this article is to open a conversation on aesthesis. We survey the roots and relevance of aesthesis as a direct albeit contested relation and engagement with the world and with Others. From its pre-Socratic origins, aesthesis has been both a pragmatic, somatic concept, prompting a re-evaluation of the distinction between experience and abstraction. We trace its ongoing repression from (...) Plato through ‘western’ theories of formal Aesthetics. Drawing on a relational interpretation of Protagoras’ aesthesis, we argue that modern pragmatists and radical empiricists, as well as more contemporary critics of the ‘colonization’ of aesthesis (Mignolo and Vasquez) by formal Aesthetics recognize and develop the relational and ethical aspects of aesthesis. We consider the role of the body, affect, and of the intangible or virtual qualities of aesthesis. The ethics of obligations (Weil) in the polis (Arendt) shows how aesthesis informs politics despite its repression in favour of moral and legal norms. We argue this is relevant to contemporary crises such as xenophobia and ecocidal climate warming. (shrink)

Although the academic interest in ethical mutual fund performance has developed steadily, the evidence to date is mainly sample-specific. To tackle this critique, new research should extend to unexplored countries. Using this as a motivation, we examine the performance and risk sensitivities of Canadian ethical mutual funds vis-à-vis their conventional peers. In order to overcome the methodological deficiencies most prior papers suffered from, we use performance measurement approaches in the spirit of Carhart (1997, Journal of Finance 52(1): 57–82) and Ferson (...) and Schadt (1996, Journal of Finance 51(2): 425–461). In doing so, we investigate the aggregated performance and investment style of ethical and conventional mutual funds and allow for time variation in the funds’ systematic risk. Our␣Canadian evidence supports the conjecture that any␣performance differential between ethical mutual funds and their conventional peers is statistically insignificant. (shrink)

'Shades of Goodness' is aimed at readers interested in moral theories, and particularly those wishing to construct or defend a moral theory.

To date, research examining the socio-spatial effects of smart city technologies have charted how they are reconfiguring the production of space, spatiality and mobility, and how urban space is governed, but have paid little attention to how the temporality of cities is being reshaped by systems and infrastructure that capture, process and act on real-time data. In this article, we map out the ways in which city-scale Internet of Things infrastructures, and their associated networks of sensors, meters, transponders, actuators and (...) algorithms, are used to measure, monitor and regulate the polymorphic temporal rhythms of urban life. Drawing on Lefebvre, and subsequent research, we employ rhythmanalysis in conjunction with Miyazaki’s notion of ‘algorhythm’ and nascent work on algorithmic governance, to develop a concept of ‘algorhythmic governance’. We then use this framing to make sense of two empirical case studies: a traffic management system and sound monitoring and modelling. Our analysis reveals: how smart city technologies computationally perform rhythmanalysis and undertake rhythm-making that intervenes in space-time processes; distinct forms of algorhythmic governance, varying on the basis of adaptiveness, immediacy of action, and whether humans are in-, on-, or, off-the-loop; and a number of factors that shape how algorhythmic governance works in practice. Maxims play a crucial role in Kant's ethical philosophy, but there is significant disagreement about what maxims are. In this two-part essay, I survey eight different views of Kantian maxims, presenting their strengths and their weaknesses. In Part II: New Approaches, I look at three more recent views in somewhat greater detail than I do the five treatments canvassed in 'Recent Works on Kantian Maxims I: Established Approaches'. First, there is Richard McCarty's Interpretation, which holds that Kant's understanding of maxims (...) can be illuminated by placing them in the context of the Wollfian tradition, according to which maxims are the major premises of practical syllogisms. The next subject Maria Schwartz, holds that careful attention to Kant's distinction between rules and maxims, as well as Kant's concept of happiness, allows us to make sense of almost all of Kant's remarks on maxims. It may be, however, that on Schwartz's view agents turn out to perform actions as opposed to thoughtlessly habitual behaviors much less often than is plausible. This leads to the final approach, exemplified by Jens Timmermann, which is that Kant understands maxims equivocally. I claim that something like Timmermann's approach is the only way to make sense of all of what Kant has to say on maxims. (shrink)

We are preoccupied with survival and gratification at the expense of human suffering and concern. This is the denial of the psyche: a levelling-out of meanings and values.

This article examines how the availability of Big Data, coupled with new data analytics, challenges established epistemologies across the sciences, social sciences and humanities, and assesses the extent to which they are engendering paradigm shifts across multiple disciplines. In particular, it critically explores new forms of empiricism that declare ‘the end of theory’, the creation of data-driven rather than knowledge-driven science, and the development of digital humanities and computational social sciences that propose radically different ways to make sense of culture, (...) history, economy and society. It is argued that: Big Data and new data analytics are disruptive innovations which are reconfiguring in many instances how research is conducted; and there is an urgent need for wider critical reflection within the academy on the epistemological implications of the unfolding data revolution, a task that has barely begun to be tackled despite the rapid changes in research practices presently taking place. After critically reviewing emerging epistemological positions, it is contended that a potentially fruitful approach would be the development of a situated, reflexive and contextually nuanced epistemology. Aristotle's Heirs explores the development of Peripatetic thought from Theophrastus and Strato to the work of the commentator Alexander of Aphrodisias. The book examines whether the internal dynamics of this philosophical school allowed for a unity of Peripatetic thought, or whether there was a fundamental tension between philosophical creativity and the notions of core teachings and canonisation. The book discusses the major philosophical preoccupations of the Peripatetics, interactions with Hellenistic schools of thought, and the shift in focus among Greek philosophers (...) in a changing political landscape. Rob Clifton was one of the most brilliant and productive researchers in the foundations and philosophy of quantum theory, who died tragically at the age of 38. Jeremy Butterfield and Hans Halvorson collect fourteen of his finest papers here, drawn from the latter part of his career (1995-2002), all of which combine exciting philosophical discussion with rigorous mathematical results. Many of these papers break wholly new ground, either conceptually or technically. Others resolve a vague controversy intoa precise technical problem, which (...) is then solved; still others solve an open problem that had been in the air for soem time. All of them show scientific and philosophical creativity of a high order, genuinely among the very best work in the field. The papers are grouped into four Parts. First come four papers about the modal interpretation of quantum mechanics. Part II comprises three papers on the foundations of algebraic quantum field theory, with an emphasis on entanglement and nonlocality. The two papers in Part III concern the concept of a particle in relativistic quantum theories. One paper analyses localization; the other analyses the Unruh effect (Rindler quanta) using the algebraic approach to quantum theory. Finally, Part IV contains striking new results about such central issues as complementarity, Bohr's reply to the EPR argument, and no hidden variables theorems; and ends with a philosophical survey of the field of quantum information. The volume includes a full bibliography of Clifton's publications. This paper develops and explores a pedagogical innovation for integrating virtue theory into business students' basicunderstanding of general management. Eighty-seven students, in 20 groups, classified three managers' real-time videotaped activitiesaccording to an elaboration of Aristotle's cardinal virtues, Fayol's management functions, and Mintzberg's managerial roles. The study's empirical evidence suggests that, akin to Fayol's functions and Mintzberg's roles, Aristotle's virtues are also amenable to operationalization, reliable observation, and meaningful description of managerial behavior. The study provides an oft-called-for empirical basis for further (...) work in virtue theory as an appropriate conceptual framework for the study and practice of management. The results indicate that virtue theory may be used to re-conceive our fundamental understanding of management, alongside its capacity to weigh moral judgment upon it. implications and suggestions for future research are discussed. The troubling ethics and politics of philanthropy Is philanthropy, by its very nature, a threat to today’s democracy? Though we may laud wealthy individuals who give away their money for society’s benefit, Just Giving shows how such generosity not only isn’t the unassailable good we think it to be but might also undermine democratic values and set back aspirations of justice. Big philanthropy is often an exercise of power, the conversion of private assets into public influence. And it is a (...) form of power that is largely unaccountable, often perpetual, and lavishly tax-advantaged. The affluent—and their foundations—reap vast benefits even as they influence policy without accountability. And small philanthropy, or ordinary charitable giving, can be problematic as well. Charity, it turns out, does surprisingly little to provide for those in need and sometimes worsens inequality. These outcomes are shaped by the policies that define and structure philanthropy. When, how much, and to whom people give is influenced by laws governing everything from the creation of foundations and nonprofits to generous tax exemptions for donations of money and property. Rob Reich asks: What attitude and what policies should democracies have concerning individuals who give money away for public purposes? Philanthropy currently fails democracy in many ways, but Reich argues that it can be redeemed. Differentiating between individual philanthropy and private foundations, the aims of mass giving should be the decentralization of power in the production of public goods, such as the arts, education, and science. For foundations, the goal should be what Reich terms “discovery,” or long-time-horizon innovations that enhance democratic experimentalism. Philanthropy, when properly structured, can play a crucial role in supporting a strong liberal democracy. Just Giving investigates the ethical and political dimensions of philanthropy and considers how giving might better support democratic values and promote justice. (shrink)

And then Rob began to think about how he hoped he'd have the chance to talk with all his grandchildren as they grew. He imagined them coming into his study, settling into one of the two comfy armchairs in front of the fire and opening up about the challenges (...) they were facing. Perhaps it would be when they were beginning their first job, buying their first house, getting married or starting a family. Or perhaps they'd talk long into the night, when their hearts were broken or friends had betrayed them. Perhaps he would have the chance to help them rebuild the dream that somebody had trodden on. In his recent article On Relativity Theory and Openness of the Future (1991), Howard Stein proves not only that one can define an objective becoming relation in Minkowski spacetime, but that there is only one possible definition available if one accepts certain natural assumptions about what it is for becoming to occur and for it to be objective. Stein uses the definition supplied by his proof to refute an argument due to Rietdijk (1966, 1976), Putnam (1967) and Maxwell (1985, 1988) (...) that Minkowski spacetime leaves no room for objective becoming whatsoever. However, Stein's proof does not seem to go far enough. By considering only what events have become from the standpoint of any given event, Stein's uniqueness proof fails from the outset to allow for a more general kind of becoming whereby it is understood to occur from the standpoint of events on the particular worldlines followed by observers. This suggests that there may, after all, be more than one way to define objective becoming in Minkowski spacetime once each observer's worldline is allowed to figure in the definition. This suspicion is further aroused by two recent proposals for objective, worldline-dependent becoming due to Peacock (1992) and Muller (1992) who advocate ways of defining becoming that are not equivalent to the definition Stein's uniqueness proof delivers. Nevertheless, we show that Stein's uniqueness proofcan be extended in a natural way to cover this more general kind of becoming, provided one does not enrich standard Minkowski spacetime by privileging certain sets of worldlines over others in an unwarranted manner. Thus we aim to reinforce Stein's point that standard Minkowski spacetime does make room for objective becoming, but in essentially only one way, despite arguments and proposals to the contrary. It has been estimated that three species on the planet now go extinct every hour and that this rate is orders of magnitude higher than the planet has seen in previous catastrophic extinction events. We clearly are in the midst of a sixth extinction, and this one is different from the previous five. Why? This sixth extinction is caused by the activity of a single species—us. If there is any hope of ameliorating this extinction, it will entirely be up to (...) us, as the current stewards of this planet, to change the course. There are many challenges, though, to marshaling this effort. Two primary ones immediately come to mind. The first is that we simply haven't found the right biological tools to address this crisis. The second is that many humans on this planet don't even admit we have a problem. These are two very different problems. The first is primarily technological. Only recently has some of the more advanced biologically focused technology been available to conservation biology and extinction science. Humans are enthralled by cutting‐edge technology for the most part, and for the public, one of the more exciting possibilities in the realm of conservation biology is that some of the more charismatic species that have gone extinct might be resurrected through next‐generation technologies. While our discussion will articulate some weaknesses with the de‐extinction approach to conservation biology, we suggest that the “sexiness” of the technologies used in de‐extinction may simultaneously provide a definition of the techniques viable in conservation biology and afford a teachable moment. Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

The study of organizational ethics continues to be the focus of significant academic attention, however it is a discourse that remains largely informed by a form of morality that is perhaps best described as ordered and cognitive. Traditional approaches to questions of organizational ethics emphasize a fundamentally static view of organizations and the people within them, reinforcing notions of mind/body dualism and reifying ethics as an outcome of human agency, choice, and deliberate intention (see MacKay and Chia). We challenge this (...) approach and instead argue in favor of ethics research that adopts an ontology grounded in process metaphysics. Escaping the confines of Cartesian dualism, we reconceptualize organizational ethics as something that is in fact not held constant, is not a static termination point or an outcome of events, but is rather an input into the continually reconstituting context of the organization over time (see Langley, et al.). The process ethics we articulate provides a grounding for moral critique in diverse communities that is not undermined by relativism. Moreover, it provides guidance to managers and employees facing moral problems without forcing them to face a tyranny of principles. We consider how a process ethics would be enacted in organizations through managerial decision-making and in the treatment of employees. (shrink)

This article argues against the view put forward by Margaret Archer that there is an irreconcilable divide between realist social theory and structuration theory. Instead, it argues for the systematic articulation of the two theories at both the ontological and the methodological levels. Each has developed a range of insightful and commensurable conceptualizations either missing or underdeveloped in the other. Archer's contention that structuration theory rejects the notion of `analytical dualism' central to the realist approach is shown to be mistaken; (...) Giddens's rejection of `dualism' refers to a different conceptualization of the term. Similarly, Archer's critique of structuration's notion of a `duality' involving structure and agency is rejected by showing that Archer's own morphogenetic approach itself relies upon such a notion. A final section distinguishes between six key problematics of social analysis. It is clear that, for a large number of possible questions within the majority of these problematics, it is a combination of both ontologies that would facilitate the most adequate substantive account. In this paper, we argue that the professional engineering institutions ought to develop a Declaration of Climate Action. Climate change is a serious global problem, and the majority of greenhouse gas emissions come from industries that are enabled by engineers and represented by the engineering professional institutions. If the professional institutions take seriously the claim that a profession should be self-regulating, with codes of ethics that go beyond mere obedience to the law, and if they take their own ethical codes (...) seriously, recognising their responsibility to the public and to future generations, the professional institutions ought to develop a declaration for engineers, addressing climate change. Our argument here is largely inspired by the history of the Declaration of Helsinki. The Declaration of Helsinki was created by the medical profession for the profession, and it held physicians to a higher standard of ethical conduct than was found in the legal framework of individual countries. Although it was not originally a legal document, the influence of the Declaration can be seen in the fact that it is now enshrined in law in a number of different countries. Thus, we argue that the engineering profession could, and should, play a significant role in the abatement of climate change by making changes within the profession. If the engineering profession sets strict standards for professional engineers, with sanctions for those who refuse to comply, this could have a significant impact in relation to our efforts to develop a coordinated response to climate change. John Broome and Duncan Foley have argued that it is a ‘misperception’ that the ‘control of global warming is costly’ and that we can make ‘sacrifices unnecessary’. There are a number of assumptions that are essential for this idea to work. These assumptions can be challenged. Furthermore, my claim is not merely that the Broome/Foley argument is flawed, and therefore unlikely to be successful. In his paper, “Should the Numbers Count?" John Taurek imagines that we are in a position such that we can either save a group of five people, or we can save one individual, David. We cannot save David and the five. This is because they each require a life-saving drug. However, David needs all of the drug if he is to survive, while the other five need only a fifth each.Typically, people have argued as if there was a choice to (...) be made: either numbers matter, in which case we should save the greater number, or numbers don't matter, but rather there is moral value in giving each person an equal chance of survival, and therefore we should toss a coin. My claim is that we do not have to make a choice in this way. Rather, numbers do matter, but it doesn't follow that we should always save the greater number.
