In «Naturalized Epistemology and the Law of Evidence Revisited», the original target article for the various refutations that I comment on here, I revisited through a slightly different lens the subject of the article that I coauthored with Brian Leiter close to twenty years ago. That article has prompted four responses from Professors Pardo, Spellman, Muffato, and Enoch. Professors Pardo and Spellman basically accept the implications of the original article and offer useful but friendly amendments. Prof. Muffato apparently does not (...) want to dispute over my ground and so changes the subject, and in doing so offers a number of interesting points. Only the fourth, Prof. Enoch, has the same doubts about the utility of my original article as I do of the genre that gave rise to it. I can thus be quite brief in discussing professors Pardo, Spellman, and Muffato, but it will take bit more effort to lay out the limits of Prof. Enoch’s analysis. (shrink)

We revisit Naturalized Epistemology and the Law of Evidence, published twenty years ago. The evolution of the relative plausibility theory of juridical proof is offered as evidence of the advantage of a naturalized approach to the study of the field and law evidence. Various alternative explanations of aspects of juridical proof from other disciplines are examined and their shortcomings described. These competing explanations are similar in their reductive, a priori approaches that are at odds with an empirically oriented naturalized approach. (...) The shortcomings of the various a priori approaches are driven by their common methodological commitments to employing weird hypotheticals to engage in intuition mining about the American legal systems that in turn ignore important aspects of the actual legal systems and consistently make impossible epistemological demands. As a result, both their descriptions of and prescriptions for American legal systems are implausible, unlike the relative plausibility theory. (shrink)

The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

In Dangerous Minds, Ronald Beiner traces the deeper philosophical roots of such far-right ideologues as Richard Spencer, Aleksandr Dugin, and Steve Bannon, to the writings of Nietzsche and Heidegger—and specifically to the aspects of their thought that express revulsion for the liberal-democratic view of life.

In October of 2009, Trevor Keezer was terminated by Home Depot for refusing to remove a pin from his uniform declaring “One Nation under God, Indivisible.” Mr. Keezer, a cashier with Home Depot, contended that the button he had worn for over one year before any action was taken by his employer expressed his support for American troops and his Christian faith. Were the actions taken by his employer warranted or was Mr. Keezer the victim of arbitrary religious discrimination unrelated (...) to job performance? Religion is becoming an increasingly polarizing issue in the workplace, forcing retail managers to balance the respective interests of employees, coworkers, and patrons of retail establishments. And from all indications, if legislation pending in Congress is enacted, maintaining the balance will become more problematic. (shrink)

Following a series of national protests in support of an increase in the federal minimum wage, many fast food workers faced retaliation by their employers when they returned to work; schedules were changed, wages and hours were reduced, and some employees were terminated. These retaliatory actions resulted in a number of complaints being filed with the National Labor Relations Board alleging violations of the National Labor Relations Act. Several of the complaints were found to have merit and, additionally, in several (...) instances both the immediate employer, the franchisee, and the corporate organization of which it was a part, the franchisor, were named as co‐defendants. This ruling—that franchisors like McDonald’s USA—could be held jointly responsible for the labor violations of independent franchisees reversed a long‐standing precedent, whereby franchisees were regarded as independent contractors solely responsible for day‐to‐day labor practices, including compliance with federal and state labor statutes. Critics of the ruling argue that it will open the door to unionization and may well spell the end of the service‐sponsor franchising format. Supporters of the NLRB argue that the ruling is just and reflects new “industrial realities” in retail labor markets. Further, a case can be made that the NLRB’s position represents a step in the direction of the restoration of more equitable balance of power between labor and management. (shrink)

A poet in his own right, the friend of Virgil and of Pollio, Gallus is enshrined for ever in literature—and in literary legend, for the inept fictions of Servius and his tribe will survive the most damaging of revelations, remembered even when refuted. Not only that—Gallus is a conspicuous figure in the social and political history of the revolutionary age.

The challenge of understanding our existence and our place in the universe has perplexed humans for centuries. What we must remember, according to Ronald Dufty, is that the environment of the earth is a very small region of the universe, and that it is continually evolving. From this basis, Dufty assesses commonly held scientific and philosophical beliefs, and seeks to correct the misconceptions they lead to. Dufty considers topical issues such as global warming, religious terrorism and anti-social behaviour with (...) a constant awareness of the bigger picture and a desire to expand our knowledge of the nature of the universe and our role in it. This article explores the issue of rebuilding an organization’s reputation following an ethical scandal. We divide our discussion into four parts. First, we discuss the concept of reputation. We note its relevance to today’s organizations, offer several contemporary definitions along with highlighting its benefits and downsides. In the second section, we offer the work of anthropologist, Victor Turner, on social drama along with other views on organizational efforts to rebuild their reputation to include reputation management routines. In the third section, (...) Turner’s redressive actions are integrated with Edgar Schein’s leadership mechanisms for building or changing culture to provide further understanding of organizational efforts to rebuild reputation following ethical scandals. Finally, in the fourth section of the article, we extend the integration of the Turner and Schein work with single- and double-loop redressive actions for rebuilding reputation. (shrink)

What is political philosophy? Ronald Beiner makes the case that it is centrally defined by supremely ambitious reflection on the ends of life. We pursue this reflection by exposing ourselves to, and participating in, a perennial dialogue among epic theorists who articulate grand visions of what constitutes the authentic good for human beings. Who are these epic theorists, and what are their strengths and weaknesses? Beiner selects a dozen leading candidates: Arendt, Oakeshott, Strauss, Löwith, Voegelin, Weil, Gadamer, Habermas, Foucault, (...) MacIntyre, Rawls, and Rorty. In each case, he shows both why the political philosophies continue to be intellectually compelling and why they are problematic or can be challenged in various ways. In this sense, Political Philosophy attempts to draw up a balance sheet for political philosophy in the twentieth century, by identifying a canon of towering contributions and reviewing the extent to which they fulfil their intellectual aspirations. The election of Donald Trump has exposed American society’s profound crisis of hope. By 2016 a generation of shrinking employment, rising inequality, the attack on public education, and the shredding of the social safety net, had set the stage for stunning insurgencies at opposite ends of the political spectrum. Against this dire background, Ronald Aronson offers an answer. He argues for a unique conception of social hope, one with the power for understanding and acting upon the present situation. Hope, (...) he argues, is far more than a mood or feeling—it is the very basis of social will and political action. It is this kind of hope that Aronson sees brewing in the supporters of Bernie Sanders, who advocated the tough-minded and inspired disposition to act collectively to make the world more equal, more democratic, more peaceful, and more just. And it was directly contrasted by Trump’s supporters who showed a cynical and nostalgic faith in an authoritarian strongman replete with bigotry and misogyny. Beneath today’s crisis Aronson examines our heartbreaking story: a century of catastrophic violence and the bewildering ambiguity of progress—all of which have contributed to the evaporation of social hope. As he shows, we are now in a time when hope is increasingly privatized, when—despite all the ways we are connected to each other—we are desperately alone, struggling to weather the maelstrom around us, demoralized by the cynicism that permeates our culture and politics, and burdened with finding personal solutions to social problems. Yet, Aronson argues, even at a time when false hopes are rife, social hope still persists. Carefully exploring what we mean when we say we “hope” and teasing hope apart from its dangerously misconstrued sibling, “progress,” he locates seeds of real change. He argues that always underlying our experience—even if we completely ignore it—is the fact of our social belonging, and that this can be reactivated into a powerful collective force, an active we. He looks to various political movements, from the massive collective force of environmentalists to the movements around Sanders and Jeremy Corbyn, as powerful examples of socially energized, politically determined, and actionably engaged forms of hope. Even in this age of Donald Trump, the result is an illuminating and inspiring call that anyone can clearly hear: we can still create a better future for everyone, but only if we resist false hopes and act together. One can learn a great deal about the relative priorities in any moral theory by understanding how these priorities are conveyed in the perpetually vexing challenge of moral education. Rousseau and Kant are two thinkers whose distinctly modern retrieval of classical virtue was animated by overlapping yet diverging grievances with classical philosophy. One common enemy of Rousseauian and Kantian virtue found in classical thought is the moral vice of envy. This essay argues that whereas Rousseau chastises the vice of envy, (...) replacing it with the central virtue of pity, Kant redirects the vice of envy towards the more salutary virtue of magnanimity during adolescence and beneficence in the adult. The consideration of sympathy in its full moral and educational context in Kant-over and against Rousseau’s emphasis on pity as the central corrective to the vice of envy-underscores the extent of the differences between Rousseau and Kant on this issue. The common criticism of Rousseau and Kant on the problem of envy is animated by some common concerns, but their understandings of it as a problem require responses that are deceptively different in their substance. Renowned in the disciplines of political theory and philosophy, Hannah Arendt’s searing critiques of modernity continue to resonate in other fields of thought decades after she wrote them.
