Triage situations and other occurrences in which rationing of medical care is necessary require careful distribution of medical equipment, services, or resources. However, the evolution of triage has failed to eliminate certain biases in the standards of care, particularly for groups already facing societal disenfranchisement and discrimination. This article explores the use of triage calculators and other systems of rationing care, their implicit biases, and how to avoid allowing those biases to influence care.

This article examines the implications of the escalation in institutional inves power and heterogeneity for two dominant theories of corporate governanceagency theory and stakeholder theory. From this analysis, a new view of the agency relationship between institutional investors and their portfolio firms emerges, which recognizes the institutions’ market power, complex role as financial intermediaries, and possible involvement in simultaneous and opposing agency contracts. We also conclude that stakeholder theorists should reconsider these newly empowered shareholders’moral standing in relation to their portfolio (...) firms, and they should reexamine the identities and goals of these modern investors. To that end, we demonstrate that a novel, intragroup application of Mitchell, Agle, and Wood’s stakeholder framework to heterogeneous institutional investors illuminates their varying levels of stakeholder salience. Very diverse societies pose real problems for Rawlsian models of public reason. This is for two reasons: first, public reason is unable accommodate diverse perspectives in determining a regulative ideal. Second, regulative ideals are unable to respond to social change. While models based on public reason focus on the justification of principles, this book suggests that we need to orient our normative theories more toward discovery and experimentation. The book develops a unique approach to social contract theory that focuses on (...) diverse perspectives. It offers a new moral stance that author Ryan Muldoon calls, "The View From Everywhere," which allows for substantive, fundamental moral disagreement. This stance is used to develop a bargaining model in which agents can cooperate despite seeing different perspectives. Rather than arguing for an ideal contract or particular principles of justice, Muldoon outlines a procedure for iterated revisions to the rules of a social contract. It expands Mill's conception of experiments in living to help form a foundational principle for social contract theory. By embracing this kind of experimentation, we move away from a conception of justice as an end state, and toward a conception of justice as a trajectory. (shrink)

All three corporate governance systems in North America are currently embroiled in fundamental transformations. Most of Mexico’s corporations are run by a small group of controlling shareholders and operate in an economic system rife with corruption. Recent political reforms and a desire to tap global equity markets have heightened their interest in improving corporate governance structures. United States corporations face a dispersed ownership base that has tended toward inattentiveness, allowing such infamous scandals as Enron to rock the global investing community. (...) A backlash against the ensuing, restrictive Sarbanes-Oxley legislation is now underway. Like Mexico’s, Canada’s major corporations are led by a handful of controlling shareholders, but corruption is uncommon. New corporate governance guidelines are under debate, and the Ontario Securities Commission is wresting control from the Toronto Stock Exchange. Although these three corporate governance systems vary in terms of ownership dispersion, level of corruption, and legislative intervention, they currently share a common focus on fundamental reform. Since the eighteenth century, the study of plants has reflected an increasingly mechanized and technological view of the natural world that divides the humanities and the natual sciences. In broad terms, this article proposes a context for research into flora through an interrogation of existing literature addressing a rapprochement between ways to knowledge. The natureculture dichotomy, and more specifically the plant-to-human sensory disjunction, follows a parallel course of resolution to the schism between objective and subjective forms of knowledge. The foundations (...) of taxonomic botany, as well as the allied fields of environmental studies, ethnobotany and economic botany, are undergirded by universalizing, sensorylimited visual structuring of the natural world. As the study of everyday embodied interactions of humans with flora, expanding upon the lens of cultural ecology, "cultural botany" provides a transdisciplinary research approach. Alternate embodied cultural engagements with flora emerge through a syncretic fusion of diverse methodologies. (shrink)

Antony Duff argues that the criminal law’s characteristic function is to hold people responsible. It only has the authority to do this when the person who is called to account, and those who call her to account, share some prior relationship. In systems of domestic criminal law, this relationship is co-citizenship. The polity is the relevant community. In international criminal law, the relevant community is simply the moral community of humanity. I am sympathetic to his community-based analysis, but argue that (...) the moral community must play a greater role in the domestic case and that the collection of individual political communities must play a greater role in the international case. Abstract:This essay follows the recent discourse on two phenomena: the tendency of hegemony to incorporate subversive cultures, and the digital reanimation of prominent dead people. At the intersection of these phenomena lies what we call “cultural necromancy,” a special case of hegemonic incorporation that aesthetically manipulates the physical presence of a deceased figure in the service of power. This essay explores historical analogues to cultural necromancy and how the digital age has accelerated the process through examples ranging from medieval saints (...) to Lenin’s mausoleum to the Tupac hologram. DNA sequencers, Twitter, MRIs, Facebook, particle accelerators, Google Books, radio telescopes, Tumblr: what do these things have in common? According to the evangelists of “data science,” all of these are instruments for observing reality at unprecedentedly large scales and fine granularities. This perspective ignores the social reality of these very different technological systems, ignoring how they are made, how they work, and what they mean in favor of an exclusive focus on what they generate: Big Data. But no data, big (...) or small, can be interpreted without an understanding of the process that generated them. Statistical data science is applicable to systems that have been designed as scientific instruments, but is likely to lead to confusion when applied to systems that have not. In those cases, a historical inquiry is preferable. (shrink)

Robert Sparrow argues that several initially plausible arguments in favor of the deployment of autonomous weapons systems (AWS) in warfare fail, and that their deployment faces a serious moral objection: deploying AWS fails to express the respect for the casualties of war that morality requires. We critically discuss Sparrow’s argument from respect and respond on behalf of some objections he considers. Sparrow’s argument against AWS relies on the claim that they are distinct from accepted weapons of war in that they (...) either fail to transmit an attitude of respect or they transmit an attitude of disrespect. We argue that this distinction between AWS and widely accepted weapons is illusory, and so cannot ground a moral difference between AWS and existing methods of waging war. We also suggest that, if deploying conventional soldiers in some situation would be permissible, and if we could expect deploying AWS to cause fewer civilian casualties, then it would be consistent with an intuitive understanding of respect to deploy AWS in this situation. Hume believes that distinctively moral sentiments can only be felt from a disinterested perspective. While much scholarly attention has been paid to the question of how Hume believes we “correct” our moral sentiments to form a coherent moral language, less has been paid to the question of why we first adopt this disinterested vantage point. Answering this question involves determining what, for Hume, enables our disinterested point of view to influence us despite the fact that the sentiments produced by our (...) parochial vantage points are originally stronger. I term this the “influence question.” I contend that Hume has two answers to this question: one in the Treatise and one in the second Enquiry. While the former is based upon our ability to share sentiments with others via sympathy, the latter holds that our disinterested vantage point enables us to found the “party of humankind” upon the universal principle of humanity. I argue that Hume saw this latter answer as rectifying a certain deficiency in his Treatise explanation and that his later answer supports Hume’s aim of demonstrating that morality is a fundamentally social phenomenon. In this paper, I argue that cases of radical selftransformation (cases in which an agent willfully changes a foundational element of their motivational structure) constitute an important philosophical puzzle. Though our inclination to hold people responsible for such changes suggests that we regard radical transformation as (in some sense) self-determined, it is difficult to conceive how a transformation that extends to the heart of an agent’s practical life can be attributed to the agent at all. While I contend that the (...) best way to solve this puzzle is to deny that radical transformations are in fact self-determined, many maintain the opposite. The defense of my thesis involves showing how the conditions that must be met in order to coherently attribute transformation to an agent are not satisfied in cases of radical transformation. Radical transformation is, thus, something that happens to an agent, not something that is done by her. (shrink)

The purpose of this paper is to advance understanding of intellectually virtuous honesty, by examining the relationship between a recent account of intellectual honesty and a recent account of intellectual transparency. The account of intellectual honesty comes from Nathan King, who adapts the work of Christian Miller on moral honesty, while the account of intellectual transparency comes from T. Ryan Byerly. After introducing the respective accounts, I identify four potential differences between intellectual honesty and intellectual transparency as understood by (...) these accounts. I then turn to the question of how to think about the relationship between these traits in light of these potential differences. I make the case that intellectual transparency can either be regarded as an exceptionally strong or ideal variety of intellectual honesty, or it can be regarded as a distinct virtue from intellectual honesty which is a more cardinal virtue than the latter. Along the way, I also note some places where a case can be made that Miller's and King's accounts of honesty and intellectual honesty are in need of refinement or clarification. (shrink)

This paper addresses the potentially interactive effects of descriptive and injunctive norm perceptions on an unethical workplace behavior: counterproductive work behavior perpetration. We draw on the Focus Theory of Normative Conduct and its conceptual distinction between norm types to refine research on this topic. We also test a person-by-environment interaction to determine whether the interactive effects of these norms for CWB are enhanced among employees reporting a stronger need to belong to social groups. In two studies, predictors were assessed in (...) an initial survey and the dependent variable was assessed weeks later. Individuals employed across a range of industries served as participants. In Study 1, descriptive and injunctive norm perceptions of CWB interacted to predict CWB perpetration. This finding was replicated in Study 2. Additionally, Study 2 demonstrated that the interaction between the two norm types was especially strong among individuals high in NTB. Results suggest that to decrease CWB perpetration, organizations may profitably leverage the persuasive effects of “social norms marketing” to alter employee perceptions of the typicality and level of approval for CWBs. This is the first study to demonstrate that both descriptive and injunctive norm perceptions predict CWB perpetration. The demonstrated three-way interaction between the two norm types and NTB advances existing theory regarding the cognitive and motivational mechanisms underlying normative social influence. (shrink)

A renewed focus on the role of interpersonal relationships in the cultivation of religious sensibilities is emerging in the study of religion. Matthew Ryan Robinson addresses this question in his study of Friedrich Schleiermacher's notion of "free sociability." In Schleiermacher's ethics, the human person is formed in and consists of intimate, tightly interconnecting relationships with others. Schleiermacher describes this sociability as a natural tendency prompted by experiences of physical and existential limitation that lead one to look to others to (...) complete one's experience. But this experience of incompleteness and orientation to "the completion of humanity" also constitute the fundamental structure of religion in Schleiermacher's theory of religion as orientation to "the universe and the relationship of humanity to it." Thus, Schleiermacher not only presents sociability as basic to human nature, but also as inherently religious - and, potentially, redemptive. What making such a claim means and the implications it raises are central considerations of this study of Schleiermacher's ethics, theory of religion and ecclesiology. (shrink)

The rise of populism and nationalism in the West have raised concerns about the fragility of liberal political values, chief among them tolerance. But what alternative social resources exist for cultivating the interpersonal relationships and mutual goodwill necessary for sustainable peace? And how might the lived practices of religious communities carry potential to reinterpret or re-circuit these interpersonal tensions and transform the relationship with the cultural "other" (Fremde) from "foe" (Feind) to "friend" (Freund)? This volume contributes a unique analysis of (...) this shifting discourse by viewing the contemporary socio-political upheaval through the lens of Friedrich Schleiermacher's theology, with a focus on the themes of friendship, interpersonal subjectivity, and sociability as a path beyond mere tolerance. Each of the essays of the volume is written by an internationally recognized scholar in the field, and the volume examines Schleiermacher's novel reflections across multiple social contexts, including North America, Great Britain, western Europe, and South Africa. In June 2020, representatives of eight photography organizations addressed ongoing challenges to the industry by introducing the “Photo Bill of Rights,” asserting “the rights of all lens-based workers and defining actions that build a safer, healthier, more inclusive, and transparent industry.” The bill centers what “lens-based workers” are owed by the media organizations that employ them. This study analyzes the bill’s contents and the explicit and implicit values within it, finding that the bill presents a normative view of the work (...) environment lens-based workers should expect as a baseline. In so doing, the bill connects what lens-based workers owe their respective publics to what their employers owe those same workers. The bill highlights the enabling environment that these workers need to satisfy their obligations to the public. The bill reminds employers of their duty to create an equitable environment that can enable the fulfillment of public responsibility. (shrink)

In this paper I explore how three seemingly incompatible Kantian theses–a libertarian notion of freedom, the inscrutability of one’s fundamental moral maxim, and the ubiquity of evil–can each be maintained without contradiction. I do this by arguing against the popular notion that in his 'Religion within the Bounds of Mere Reason,' Kant attributes 'radical evil' to all human beings.

I examine the role that Descartes’ theory of optics shapes the entire Cartesian methodology. After explaining the importance of methodology in Descartes’ project, I his method in terms of the three dimensions of time. I put this method to work by describing Descartes’ search for the elusive hyperbolic lens, a lens that would offer the type of perfect vision that is necessary for the Cartesian scientific process. It will soon become clear that this lens is the mind itself. The task (...) of this project is thus to sculpt the mind so as to achieve the highest clarity and distinctness of scientific vision. Thus, by focusing on how the eye works and how seeing can be improved, the subject and the objects it sees both radically transform in structure, content, and kind. The Cartesian corpus thus initiates a sort of specular regime that produces a new subjectivity and a new world. (shrink)

These religions have approximately 6.9 billion adherents. Recent meta-analysis of a range of surveys into non-belief in 'God' has reported that between 7% and 10% of the world's population identifies as non-theistic . Out of the top fifty countries with the largest percentage of self-professed atheists, , close to 80% are developed, democratic, mostly (...) Ryan, Tom Perhaps the most neuralgic issue shaping the Catholic Church's relationship to wider contemporary society is abortion. In Australia, the Church's efforts to counter abortion's increasing incidence and after-effects are evident in Bishops' statements, websites such as Walking with Love, and, from lay-inspired movements such as the Rachel's' Vineyard Retreat. Further, research is bringing a greater appreciation of the trauma and long-term effects of the abortion experience. Given that, it is reasonable to assume its influence, in some instances, (...) on marital consent. Investigating this question, then, is a timely exercise. At the same time, it can provide an insight into a ministry that is somewhat specialised, and, of its nature, sensitive and confidential, namely, the marriage annulment process. Ryan, Tom The year 2012 was characterized by extensive re-appraisal, nationally and internationally, of the Second Vatican Council occasioned by the fiftieth anniversary of its opening in 1962. One aspect discussed by Ann N.C. Nolan is the language of the Council documents. In her investigation of John O'Malley SJ's work, she points out how he detects in them a clear shift from the scholastic and logical style to a literary and rhetorical mode aimed at persuasion and a deepening of (...) conviction.
