El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—. Recorrido breve por su obra, con motivo de su reciente fallecimiento.

Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, (...) surgió la oportunidad de volver a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. It filled me with pleasure to be asked by Problema editor-in-chief Sandra Gómora Juárez to lead a discussion on the theories and doctrine on precedent in our context alongside Prof. Marina Gascón Abellán. Besides the undeniable and recognized prestige of the Problema journal, there was also the possibility of working with Prof. Marina Gascón again and with Sandra Gómora for the first time. It was also an opportunity to discuss issues regarding precedent with old friends (...) like Flavia Carbonell, Fabio Pulido and Silvia Zorzetto, and exchange opinions with new ones like Rodrigo Camarena. On this occasion, I would like to comment specifically on the works of Prof. Fabio Pulido Ortiz and Prof. Silvia Zorzetto, both of which are of unquestionable quality. The article by Prof. Pulido Ortiz of the Universidad de la Sabana in Colombia is a work of analytical finesse and subtlety that discusses some fundamental problems of legal theory from the standpoint of the theory of precedent. Prof. Silvia Zorzetto from Università Statale di Milano has conducted an analytical and metalinguistic survey of the use of precedents in Italy, particularly at the Italian Sezioni Unite Civili della Corte di Cassazione. This work is priceless not only in terms of its value as a study of (internal) Italian legal culture, but also because the analysis can be generalized, at least in part, to explain how precedents are used in civil law systems. Recent calls to address racism in bioethics reflect a sense of urgency to mitigate the lethal effects of a lack of action. While the field was catalyzed largely in response to pivotal events deeply rooted in racism and other structures of oppression embedded in research and health care, it has failed to center racial justice in its scholarship, pedagogy, advocacy, and practice, and neglected to integrate anti-racism as a central consideration. Academic bioethics programs play a key role in determining the (...) field’s norms and practices, including methodologies, funding priorities, and professional networks that bear on equity, inclusion, and epistemic justice. This article describes recommendations from the Racial Equity, Diversity, and Inclusion (REDI) Task Force commissioned by the Association of Bioethics Program Directors to prioritize and strengthen anti-racist practices in bioethics programmatic endeavors and to evaluate and develop specific goals to advance REDI. By the start of the twenty-first century, the notion of ‘the sublime’ had come to seem incoherent. In the last ten years or so considerable light has been shed by empirical psychologists on a related notion of ‘awe’, and a fruitful dialogue between aestheticians and empirical psychologists has ensued. It is the aim of this paper to synthesize these advances and to offer what I call a ‘two-tiered’ theory of the sublime that shows it to be a coherent aesthetic category. (...) On this theory, sublime experiences begin in an ‘awe response’ (the ‘thin sublime’) and might, with the additional element of temporally-extended reflection, turn into a ‘thick sublime’ response. Building on accounts of the sublime as a species of ‘aesthetic awe’ (Clewis, 2019a and 2019b; Arcangeli, et al., 2020) I aim to show that this two-tiered theory helps to explain why sublime experiences seem to have a basic, primordial core, but also seem to be historically and culturally quite variable (as Nicolson, 1963 [1959]; Battersby, 2007; and McMahon, 2017 have stressed). On this model, the cultural and historical variability comes in largely at the point of the temporally-extended reflection characteristic of the thick sublime, due to the cognitive stock that the subject brings to the encounter. Thus, sublime experiences really lend themselves to being interpreted quite variously by the subject (as well as by the theorist) of these experiences, as, for example, affording insight into the Divine, our moral vocation, or our metaphysical unity with the entire universe, among other lofty thoughts. This authored book provides an innovative and systematic account of key debates within the social psychology of knowledge, using the theory of social representations as a guide. This account is then elaborated and integrated into a conceptually coherent theoretical framework to further the social psychological dimensions of the relationship between representations, knowledge and context. Jovchelovitch highlights the social psychological components of the process of knowledge formation and their impact in the constitution of communities, culture and public spheres. Whilst this exploration (...) contributes to an understanding of the genesis, logic and function of knowledge in social life, it also shows that context is essential to understanding the dynamics of representation and emphasises the fundamental unity between the two. This book offers a significant and stimulating contribution to the field of social representations and will make essential reading for those wanting to follow this debate at thecutting edge of social, cultural and developmental psychology as well as sociology, anthropology and cultural studies. I argue that activists have co-opted street art as a tool for addressing epistemic injustices, injustices that result from negative identity prejudices that silence certain groups of people unfairly. To defend this claim, I explore the special nature of street art that makes it an especially appropriate tool for activists to enlist in the fight against epistemic injustices. From there, I will examine in detail two case studies which illustrate how street art is used to respond to and correct for (...) these injustices: first, the street art series, “Stop Telling Women to Smile” by Tatyana Fazlalizadeh, and then Chris Metzger’s Inside Out Project in Baltimore. Drawing on these examples, I highlight the features in virtue of which street art constitutes a particularly effective tool for correcting epistemic injustices. (shrink)

The logics BN4 and E4 can be considered as the 4-valued logics of the relevant conditional and (relevant) entailment, respectively. The logic BN4 was developed by Brady in 1982 and the logic E4 by Robles and Méndez in 2016. The aim of this paper is to investigate the implicative variants (of both systems) which contain Routley and Meyer’s logic B and endow them with a Belnap-Dunn type bivalent semantics.

Empoderar el inglés por medio del sistema dual y las diferentes especialidades, es una tarea que el área de idiomas ha tratado por mucho tiempo de llevar a cabo por medio de la inserción del inglés técnico al programa de inglés general que el MCCEMS oferta, aún sin éxito. Es por eso por lo que se elabora esta propuesta de reajuste para la materia de inglés, en cuanto a dosificación de temas (reestructuración al MCCEMS), en cuanto a número de horas (...) clase (derivado del acuerdo 653, se pretende un incremento de horas para el sexto semestre y por lo menos 1 para los semestres que ya cuentan con la materia), en cuanto a contenidos específicos (inserción del vocabulario técnico y desenvolvimiento en las áreas de especialidad con el uso del idioma), lo que es el saber hacer con el inglés dentro su entorno trabajando más a profundidad el trabajo por competencias. Para lograr dicho objetivo se requiere a docentes de inglés especializados en las distintas áreas que se ofertan, en los distintos centros educativos de los subsistemas de EMS, así mismo que brinden mayor tiempo dentro del aula para garantizar que dicho aprendizaje sea exitoso, iniciando primeramente con los alumnos de sistema Dual por estar más en contacto con las unidades económicas y en un segundo paso al resto de los alumnos. Todo esto para tener mayor número de egresados certificados en el idioma con dominio de su área de especialidad. (shrink)

This paper presents a novel analysis of Sluicing, an ellipsis construction first described by Ross (1969) and illustrated by the bracketed portion ofI want to do something, but I'm just not sure [what _]. Starting from the assumption that a sluice consists of a displaced Wh-constituent and an empty IP, we show how simple and general LF operations fill out the empty IP and thereby provide it with an interpretable Logical Form. The LF operations we appeal to rely on the (...) influential theory of indefinites developed by Irene Heim and Hans Kamp, and are in harmony with certain aspects of Chomsky's Minimalist Program for linguistic theory. The analysis accounts directly for the familiar properties of Sluicing, as well as some facts which have not previously been observed. (shrink)

Although high-performance human resource practices do not directly affect corporate social performance strengths, they do positively affect CSP strengths in companies that are highly innovative or have high levels of slack. High-performance human resource management practices also directly and negatively affect CSP concerns. Drawing on the resource-based view and using secondary data from an objective, third-party database, the authors develop and test hypotheses about how high-performance HRM affects a company’s CSP strengths and concerns. The convergence of increasingly efficient high throughput sequencing technology and ubiquitous Internet use by the public has fueled the proliferation of companies that provide personal genetic information (PGI) direct-to-consumers. Companies such as 23andme (Mountain View, CA) and Navigenics (Foster City, CA) are emblematic of a growing market for PGI that some argue represents a paradigm shift in how the public values this information and incorporates it into how they behave and plan for their futures. This new class of social networking (...) business ventures that market the science of the personal genome illustrates the new trend in collaborative science. In addition to fostering a consumer empowerment movement, it promotes the trend of democratizing information—openly sharing of data with all interested parties, not just the biomedical researcher—for the purposes of pooling data (increasing statistical power) and escalating the innovation process. This target article discusses the need for new approaches to studying DTC genomics using social network analysis to identify the impact of obtaining, sharing, and using PGI. As a locus of biosociality, DTC personal genomics forges social relationships based on beliefs of common genetic susceptibility that links risk, disease, and group identity. Ethical issues related to the reframing of DTC personal genomic consumers as advocates and research subjects and the creation of new social formations around health research may be identified through social network analysis. The Kiki-Bouba effect comprises a relation between two abstract figures and two non-words: the star-shaped figure is called 'Kiki' and the rounded figure 'Bouba'. The effect is explained by a sound-vision synaesthesia: certain sounds are associated with certain shapes in a non-arbitrary manner.When we asked the participants to decide which of the two figures, the star-shaped or the rounded one, to call yin and which yang, some 85% choose the star-shaped figure as yin. There are previous cases of synaesthesia where (...) personality is attributed to numbers or letters. In our results, the word Kiki is overall happy, clever, small, thin, young, unpleasant, and nervous. The starshaped figure is overall clever, tall, small, slim, nervous, unpleasant, and upper-class. That is, the correspondence above all concerns the qualifying adjectives clever, unpleasant, and nervous, as well as the physical appearance small and thin. This brings us to the fat-thin effect. Cinema, literature, comics, and children's programmes are full of contrasting figures: Don Quixote and Sancho Panza, Laurel and Hardy , Asterix and Obelix, Tintin and Captain Haddock, Bert and Ernie , or the Spanish comic about very naughty twin boys called Zipi and Zape . Our main conclusion is that first names and last names are not entirely arbitrary. There is a correspondence between names and physical characteristics and concepts . The Kiki-Bouba effect is a semantic one. (shrink)

This paper is aimed at understanding one central aspect of Bolzano's views on deductive knowledge: what it means for a proposition and for a term to be known a priori. I argue that, for Bolzano, a priori knowledge is knowledge by virtue of meaning and that Bolzano has substantial views about meaning and what it is to know the latter. In particular, Bolzano believes that meaning is determined by implicit definition, i.e. the fundamental propositions in a deductive system. I go (...) into some detail in presenting and discussing Bolzano's views on grounding, a priori knowledge and implicit definition. I explain why other aspects of Bolzano's theory and, in particular, his peculiar understanding of analyticity and the related notion of Ableitbarkeit might, as it has invariably in the past, mislead one to believe that Bolzano lacks a significant account oï a priori knowledge. Throughout the paper, I point out to the ways in which, in this respect, Bolzano's antagonistic relationship to Kant directly shaped his own views. (shrink)

The importance of public confidence in scientific findings and trust in scientists cannot be overstated. Thus, it becomes critical for the scientific community to focus on enhancing the strategies used to educate future scientists on ethical research behaviors. What we are lacking is knowledge on how faculty members shape and develop ethical research standards with their students. We are presenting the results of a survey with 3,500 research faculty members. We believe this is the first report on how faculty work (...) with and educate their PhD students on basic research standards. Specifically, we wanted to determine whether individual faculty members, who are advisors or mentors, differ in how they implemented components of responsible conduct of research (RCR) with their PhD students. Mentors were more likely than advisors or supervisors to report working with all of their PhDs, who graduated in the last 5 years, on the 17 recognized critical components of RCR training and research skill development. We also found about half of the faculty members believe RCR is an institutional responsibility versus a faculty responsibility. Less than a quarter have had opportunities to participate in faculty training to be a better mentor, advisor, or research teacher, and about one third of faculty did not or could not remember whether they had guidelines related to their responsibilities to PhD students. We discuss the implications of our findings and focus on ways that PhD research mentoring can be enhanced. (shrink)

ABSTRACT Genevieve Lloyd argues that when we follow Spinoza in understanding reason as a part of nature, we gain new insights into the human condition. Specifically, we gain a new political insight: we should respond to cultural difference with a pluralist ethos. This is because there is no pure universal reason; human minds find their reason shaped differently by their various embodied social contexts. Furthermore, we can use the resources of the imagination to bring this ethos about. In my response, (...) I offer a friendly challenge to Lloyd’s characterisation of the lessons of Spinoza’s philosophy. I argue that Lloyd’s Spinoza remains excessively unpolitical, even in the moment that he is brought to bear on contemporary politics. An unpluralistic attitude may well be rationally inferior, but is it really explained by insufficient or inappropriate imagination? To the contrary, a properly Spinozist account of reason must include an account of the concrete determinants of reason’s imperfect realisation in the world. In Spinoza’s own oeuvre, this is carried out through an ever-increasing—and ever more sociological—interest in the political structures within which individual reason flourishes or withers. (shrink)

This paper aims at elucidating the present strength of the social and political ideas one can draw from Wittgenstein’ later work, rooting in it his conception of the subjectivity of language and of the speakers’ authority and voice; of the I and the us. The article uses the concept of forms of life – understood, following Stanley Cavell and Veena Das, not only in the social sense but also in the natural sense, as life forms. – in order to rearticulate (...) the natural and conventional and to perceive, as Cavell puts it, “the mutual implication of the natural and the social” in the constitution of us – and in a renewed, ordinary conception of democracy. The ethics of care has contributed to modifying a dominant conception of ethics and changed the way we conceive vulnerability. It has introduced ethical stakes into politics, weakening, through its critique of theories of justice, the seemingly obvious link between an ethics of justice and political liberalism. However, care corresponds to a quite ordinary reality: the fact that people look after one another, take care of one another and thus are responsible. A continuing concern of many feminists and non-feminists alike has been to identify a distinctive feminist method of inquiry. This essay argues that this method question is misguided and should be abandoned. In doing so it takes up the distinctions between and relationships among methods, methodologies and epistemologies; proposes that the concern to identify sources of the power of feminist analyses motivates the method question; and suggests how to pursue this project.

Peirce’s pragmatic stress on meaning in terms of habits of response is, of course, well known. However, the language in which it is usually expressed tends too often to conflate its epistemic and ontological dimensions, thereby hiding from view its full systematic significance. The following discussion will focus on the emergence of such meanings as epistemic relational structures which embody the characteristics of the dynamics of organism-environment interaction in their very internal structure and which lead outward toward the universe, providing (...) an experienced content which is at once epistemic and ontological. Recent reflection on the professional knowledge of teachers has been marked by a shift away from more reductive competence and skill-focused models of teaching towards a view of teacher expertise as involving complex context-sensitive deliberation and judgement. Much of this shift has been inspired by an Aristotelian conception of practical wisdom (phronesis) also linked by Aristotle to the development of virtue and character. This has in turn led recent educational philosophers and theorists – inspired by latter-day developments in virtue ethics (...) and virtue epistemology – to investigate the contribution of various forms of virtue to the effective practice of teaching. In this light, the present paper undertakes further exploration of the logical geography of virtue, character and practical deliberation in teaching. (shrink)

Abstract:The new push to move political issue activity from the federal to the state and local levels—a new New Federalism—has implications for the ethical and political legitimacy of business political activity. While business political activity at the federal level may be both less costly and less risky than when action shifts to states or localities, at the state or local level it is likely to be more visible, and individual firms may be perceived to have more power. Increased corporate power (...) raises questions about the legitimacy of firm involvement in the political process at the state and local levels. Children and adolescents are not indifferent to the dramatic impact of the COVID-19 pandemic, and the need to be forced to live in confinement. The change in life to which they have been abruptly subjected forces us to understand the state of their mental health in order to adequately address both their present and future needs. The present study was carried out with the intention of studying the consequences of confinement on anxiety, sleep routines and executive functioning of 1,028 children (...) and adolescents, aged from 6 to 18 years, residing in Spain to; assess if there are differences regarding these consequences in terms of sex and age; how anxiety affects executive functioning in males and females; and to examine the possible correlations between the measured variables. For this purpose, an online questionnaire containing five sections was designed: the first section gathers information on sociodemographic and health data, while the following sections gather information from different standardized scales which measure anxiety, sleep and executive functions, whose items were adapted in order to be completed by parents, and/or legal guardians. The statistical analyzes carried out highlights significant differences in executive functioning between males and females. In turn, in regards to age, greater difficulties were detected in anxiety in the 9 to 12 age group and greater sleep disturbances between 13 and 18 year olds. On the other hand, significant differences were found in intra-sexual executive functioning depending on whether they presented greater or lesser anxiety, with executive functioning being more tendentiously maladjusted in males than in females, revealing a significantly relevant effect size. Positive correlations are obtained between state anxiety and sleep and executive functioning alterations. Finally, through Path Analysis, it is verified that state anxiety is the variable with the greatest weight within the model that would explain the alteration in the executive functioning of the present sample. It is common to assimilate Marx’s and Spinoza’s conceptions of democracy. In this chapter, I assess the relation between Marx’s early idea of “true democracy” and Spinozist democracy, both the historical influence and the theoretical affinity. Drawing on Marx’s student notebooks on Spinoza’s Theological-Political Treatise, I show there was a historical influence. However, at the theoretical level, I argue that a sharp distinction must be drawn. Philosophically, Spinoza’s commitment to understanding politics through real concrete powers does not support with Marx’s (...) anti-institutional conception of true democracy. And as a matter of social theory, the gap between civil society and the state which so troubles Marx is a development of modernity that has not entered Spinoza's premodern field of view. Marx’s true democracy was also influenced by his study of Rousseau, and theoretically, it is just as close if not closer to Rousseau as to Spinoza. (shrink)

In the course of the last few decades, Bolzano has emerged as an important player in accounts of the history of philosophy. This should be no surprise. Few authors stand at a more central junction in the development of modern thought. Bolzano's contributions to logic and the theory of knowledge alone straddle three of the most important philosophical traditions of the 19th and 20th centuries: the Kantian school, the early phenomenological movement and what has come to be known as analytical (...) philosophy. This paper identifies three Bolzanian theoretical innovations that warrant his inclusion in the analytical tradition: the commitment to ‘logical realism’, the adoption of a substitutional procedure for the purpose of defining logical properties and a new theory of a priori cognition that presents itself as an alternative to Kant's. All three innovations concur to deliver what counts as the most important development of logic and its philosophy between Aristotle and Frege. In the final part of the paper, I defend Bolzano against a common objection and explain that these theoretical innovations are also supported by views on syntax, which though marginal are both workable and philosophically interesting. The Internet appears to offer psychologists doing research unrestricted access to infinite amounts and types of data. However, the ethical issues surrounding the use of data and data collection methods are challenging research review boards at many institutions. This article illuminates some of the obstacles facing researchers who wish to take advantage of the Internet's flexibility. The applications of the APA ethical codes for conducting research on human participants on the Internet are reviewed. The principle of beneficence, as well as (...) privacy and confidentiality, informed consent, deception, and avoiding harm are all illustrated through the use of a hypothetical online study. Drawing on her pioneering work in feminist standpoint theory, Harding articulates and defends the “strong objectivity” program, which she subsequently tests against recent discussions of objectivity and against postcolonialist science and technology studies. Strong objectivity starts with an examination of the experiences of individuals, such as women and minorities, who have traditionally been excluded from knowledge production in order to criticize prevailing standards of objectivity - especially the “weak objectivity” of allegedly value-neutral science - and to articulate stronger standards of (...) objectivity. This stance assumes that by adopting a standpoint outside of a discipline, one can achieve the distance required to critically assess the values, interests, and assumptions of that discipline. As Harding makes clear, this program is not merely interested in criticizing dominant research practices to improve the reliability and validity of science, but it is an inherently social and political project aimed at articulating standards that can produce science for social justice movements. After identifying various ways in which the strong objectivity program is consonant with major themes in recent science and technology studies research (e.g., historical work on the concept of objectivity, the dynamic co-evolution of science and society, theoretical pluralism), Harding responds to some potential objections to strong objectivity, e.g., accusations of relativism. By way of conclusion, Harding outlines her vision of a “new unification of multiple sciences” as a possible fruit of the strong objectivity program, wherein the global sciences are unified and harmonized by common goals of obtaining knowledge and developing more socially responsible societies. The concept of organizational justice is important to understanding and predicting organizational behavior. A significant development in the research literature has been the separation of distributive and procedural justice. While much of the research has focused on negative outcomes, this research attempted to verify the presence of both forms of justice in the context of positive outcomes. Subjects completed an instrument designed to measure their perceptions of distributive and procedural justice. The subjects also reported their satisfaction and sense of fairness (...) with their salary increases, their belief that the procedures to award the increases had been followed, and their level of information and agreement regarding the salary program. These measures, along with size of salary increase and gender were examined to determine their impact on the subjects' perceived level of justice. The data support the existence of the two distinct forms of justice, but suggest that procedural justice may, in turn, branch out into two aspects. One category involves being informed, and a second appears to deal with acceptance of procedures. A series of relationships are then considered. Significant gender effects were non-existent. Must We Mean What We Say? is Stanley Cavell's first book, and, in a sense, it is his most important. It contains all the themes that Cavell continues to develop masterfully throughout his philosophy. There is a renewed usage of J. L. Austin's theory of speech acts, and, in the classic essay “The Availability of Wittgenstein's Later Philosophy,” he establishes the foundations of a radical reading of Ludwig Wittgenstein , the connections among skepticism, acknowledgement, and Shakespearean tragedy ; there is (...) the reflection on the ordinary that runs throughout his later works ; and, finally, there is the original aesthetic approach that defines Cavell's work, through his objects—which range from William Shakespeare to Samuel Beckett and pass through Hollywood comedies and melodrama, and opera—and, above all, through his style and method. Burnout is a phenomenon characterized by fatigue and frustration, usually related to work stress and dedication to a cause, a way of life that does not match the person’s expectations. Although it seems to be associated with risk factors stemming from a professional environment, this problem may affect any person. Palliative care is provided in a challenging environment, where professionals often have to make demanding ethical decisions and deal with death and dying. This article reports on the findings of a (...) systematic review aimed at identifying described burnout levels in palliative care nurses and physicians, and the related risks and protective factors. The main findings indicate that burnout levels in palliative care, or in health care settings related to this field, do not seem to be higher than in other contexts. (shrink)

Douglas Husak contends that both criminalization and punishment can serve preventive goals, so long as they respect retributive culpability constraints. This Essay draws on Husak’s work to argue that, while Husak is right to defend the legitimacy of criminal law as a preventive endeavor, preventive coercion is also permissible on consequentialist grounds alone, outside the culpability constraints of the criminal law. The Essay presents a unified consequentialist theory of preventive coercion, addresses deontological objections to ‘pure’ preventive detention, and argues that (...) a consequentialist approach to prevention might ultimately be more protective of liberty and equality interests than the deontological ‘mad or bad’ approach that currently dominates Anglo-American jurisprudence and legal theory. By combining a flanker task and a cuing task into a single paradigm, the authors assessed the effects of orienting and alerting on conflict resolution and explored how normal aging and Alzheimer’s disease (AD) modulate these attentional functions. Orienting failed to enhance conflict resolution; alerting was most beneficial for trials without conflict, as if acting on response criterion rather than on information processing. Alerting cues were most effective in the older groups— healthy aging and AD. Conflict resolution was impaired only (...) in AD. Orienting remained unchanged across groups. These findings provide evidence of different life span developmental and clinical trajectories for each attentional network. (shrink)

This essay focuses on Schopenhauer’s aesthetics and philosophy of art, areas of his philosophy which have attracted the most philosophical attention in recent years. After discussing the subjective and objective aspects of aesthetic experience on his account, I shall offer interpretations of Schopenhauer’s theory of the sublime and solution to the problem of tragedy. In addition, I shall touch upon the liveliest interpretive debates concerning his aesthetic theory: the intelligibility of the “Platonic Ideas” as the objects of aesthetic experience and (...) the very possibility of aesthetic experience within Schopenhauer’s system. Another aim of this essay is to suggest how some of Schopenhauer’s aesthetic doctrines may be interpreted in a less metaphysically extravagant way. When understood in this manner, contemporary aestheticians might be inclined to take a closer look at Schopenhauer’s aesthetic theory and philosophy of art, for it is distinctive in the tradition of Western philosophical aesthetics in its attempt to highlight and balance the hedonic and cognitive importance of aesthetic experiences; in its sensitivity both to the aesthetic experience of nature as well as of art; in the high value placed on the experience of music ; and in the innovative solution to the problem of tragedy it offers.
