The 2018 eligibility regulation for female competitors with differences of sexual development (DSD) issued by World Athletics requires competitors with DSD with blood testosterone levels at or above 5 nmol/L and sufficient androgen sensitivity to be excluded from competition in certain events unless they reduce the level of testosterone in their blood. This paper formalises and then critically assesses the fairness-based argument offered in support of this regulation by the federation. It argues that it is unclear how the biological advantage (...) singled out by the regulation as an appropriate target for diminishment, is relevantly different from other biological advantages that athletes may enjoy, and specifically that Sigmund Loland’s recent attempt to drive a wedge between heightened levels of blood testosterone and other biological advantages fails. The paper also suggests that even if heightened blood testosterone levels do differ relevantly from other types of biological advantage, the regulation is further challenged by studies indicating that athletes with blood testosterone at the high end of the normal range have a competitive advantage over athletes with blood testosterone levels at the low end of it. Finally, the paper contends that the premises of the fairness-based argument do not unequivocally support the conclusion that DSD athletes with heightened levels of testosterone should diminish those levels, since, just as powerfully, they support allowing athletes with normal levels of testosterone to use performance-enhancing drugs in the name of fairness. What is attention? Attention is often seen as a subject matter for the hard sciences of cognitive and brain processes, and is understood in terms of sub-personal mechanisms and processes. Correspondingly, there still is a stark contrast between the central role attention plays for the empirical investigation of the mind in psychology and the neurosciences, and its relative neglect in philosophy. Yet, over the past years, several philosophers have challenged the standard conception. A number of interesting philosophical questions concerning the (...) nature of attention arise. This article provides an introduction to contemporary debates concerning these questions. In particular, it discusses the question of how the pre-theoretic conception of attention might be reconciled with a scientific conception, arguments that provide support for an anti-reductivist theory of attention, and sketches several recent anti-reductivist theories and their inter-relations. I defend the Received View on scientific theories as developed by Carnap, Hempel, and Feigl against a number of criticisms based on misconceptions. First, I dispute the claim that the Received View demands axiomatizations in first order logic, and the further claim that these axiomatizations must include axioms for the mathematics used in the scientific theories. Next, I contend that models are important according to the Received View. Finally, I argue against the claim that the Received View is intended to (...) make the concept of a theory more precise. What is the philosophical significance of attention? The present article provides an overview of recent debates surrounding the connections between attention and other topics of philosophical interest. In particular, it discusses the interplay between attention and consciousness, attention and agency, and attention and reference. The article outlines the questions and contemporary positions concerning how attention shapes the phenomenal character of experience, whether it is necessary or sufficient for consciousness, and whether it plays a special role in the best philosophical theories (...) of action or conceptual reference. Various interdependencies between the answers to these questions are indicated, as well as how these answers might depend on the metaphysics of attention. Together with its companion piece this article serves as an introduction to the philosophy of attention. (shrink)

I show that extant attempts to capture and generalize empirical adequacy in terms of partial structures fail. Indeed, the motivations for the generalizations in the partial structures approach are better met by the generalizations via approximation sets developed in “Generalizing Empirical Adequacy I”. Approximation sets also generalize partial structures.

Syntactic approaches in the philosophy of science, which are based on formalizations in predicate logic, are often considered in principle inferior to semantic approaches, which are based on formalizations with the help of structures. To compare the two kinds of approach, I identify some ambiguities in common semantic accounts and explicate the concept of a structure in a way that avoids hidden references to a specific vocabulary. From there, I argue that contrary to common opinion (i) unintended models do not (...) pose a significant problem for syntactic approaches to scientific theories, (ii) syntactic approaches can be at least as language-independent as semantic ones, and (iii) in syntactic approaches, scientific theories can be as well connected to the world as in semantic ones. Based on these results, I argue that syntactic and semantic approaches fare equally well when it comes to (iv) ease of application, (v) accommodating the use of models in the sciences, and (vi) capturing the theory-observation relation. This dissertation investigates the nature, the phenomenal character and the philosophical significance of attention. According to its central thesis, attention is the ongoing mental activity of structuring the stream of consciousness or phenomenal field. The dissertation connects the scientific study of attention in psychology and the neurosciences with central discussions in the philosophy of mind. Once we get clear on the nature and the phenomenal character of attention, we can make progress toward understanding foundational issues concerning the nature and the (...) structure of conscious mentality itself. We understand better how consciousness is connected to self-awareness and to agency, and we get a better grip on the nature of perceptual experience, the unity of consciousness, and its subjective character. The dissertation also aims at showing that the current empirical investigation of attention should be complemented with work at the level of generality that a philosophical analysis can provide; it shows how such an analysis is relevant for the scientific study of attention by providing a new conceptual framework and suggesting several new areas of research. There has been much interest in group judgment and the so-called 'wisdom of crowds'. In many real world contexts, members of groups not only share a dependence on external sources of information, but they also communicate with one another, thus introducing correlations among their responses that can diminish collective accuracy. This has long been known, but it has-to date-not been examined to what extent different kinds of communication networks may give rise to systematically different effects on accuracy. We argue that (...) equations that relate group accuracy, individual accuracy, and group diversity are useful theoretical tools for understanding group performance in the context of research on group structure. In particular, these equations may serve to identify the kind of group structures that improve individual accuracy without thereby excessively diminishing diversity so that the net positive effect is an improvement even on the level of collective accuracy. Two experiments are reported where two structures are investigated from this perspective. It is demonstrated that the more constrained network outperforms the network with a free flow of information. Perceptual illusions have often served as an important tool in the study of perceptual experience. In this paper I argue that a recently discovered set of visual illusions sheds new light on the nature of time consciousness. I suggest the study of these silencing illusions as a tool kit for any philosopher interested in the experience of time and show how to better understand time consciousness by combining detailed empirical investigations with a detailed philosophical analysis. In addition, and more specifically, (...) I argue against an initially plausible range of views that assume a close match between the temporal content of visual experience and the temporal layout of experience itself. Against such a widely held structural matching thesis I argue that which temporal changes we are experiencing bears no close relation to how our experience itself is changing over time. Explanations of the silencing illusions that are compatible with the structural matching thesis fail. (shrink)

Why do we seek out and enjoy uncertain success in playing games? Game designers and researchers suggest that games whose challenges match player skills afford engaging experiences of achievement, competence, or effectance—ofdoing well. Yet, current models struggle to explain why such balanced challenges best afford these experiences and do not straightforwardly account for the appeal of high- and low-challenge game genres like Idle and Soulslike games. In this article, we show that Predictive Processing (PP) provides a coherent formal cognitive framework (...) which can explain the fun in tackling game challenges with uncertain success as the dynamic process of reducing uncertainty surprisingly efficiently. In gameplay as elsewhere, people enjoydoing better than expected, which can track learning progress. In different forms, balanced, Idle, and Soulslike games alike afford regular accelerations of uncertainty reduction. We argue that this model also aligns with a popular practitioner model, Raph Koster’sTheory of Fun for Game Design, and can unify currently differentially modelled gameplay motives around competence and curiosity. Abstract Artificial language philosophy (also called ‘ideal language philosophy’) is the position that philosophical problems are best solved or dissolved through a reform of language. Its underlying methodology—the development of languages for specific purposes—leads to a conventionalist view of language in general and of concepts in particular. I argue that many philosophical practices can be reinterpreted as applications of artificial language philosophy. Gordon shows in this marvelous new book how memory has shaped the event into something much larger than anyone could have foreseen. It is, Gordon claims, the silent work of memory that has made this debate, rather innocuous at the time, into what can be retrospectively be considered the truly earth-shattering philosophical event of the twentieth century.In hindsight, the symbolism of the debate between a German who became a leading Nazi philosopher in 1933 and a Jew who, in the same year, was dismissed from his professorship and forced to flee Germany, could not be greater. It only grows if one connects the historic events with their respective philosophies: on the one side the liberal modern Cassirer, whose philosophy allegedly glorified the Weimar stalemate, and on the other side the radical Heidegger, whose call for “authentic existence” took on a bone-chilling reality as he embraced Hitler in 1933 as the führer to lead Germany back to its authentic roots.Two volumes—the 1999 collection, 70 Jahre Davoser Disputation, edited by E. Rudolph and D. Kaegi, and, in 2000, A Parting of the Ways by Michael Friedman—were the first to delve into the debate’s symbolic meaning. It was Friedman’s thesis that the fateful “parting of the ways” between Continental and Analytic philosophy could be traced to this meeting, which was also attended by Rudolf Carnap. Despite these studies, there has until now not been a comprehensive treatment that pulls together all threads into one narrative, covering the entire intellectual, historical, cultural, and philosophical landscape of the time. Gordon’s book achieves just that and will be, for years to come, the landmark work on this encounter.The book begins from the background in post-World War I philosophy in Germany, which was perceived, along with culture, as being in crisis (ch. 1), to “set the stage” on the “Magic Mountain” (ch. 2). It proceeds to summarize the individual lectures by Cassirer and Heidegger, giving a detailed interpretation of the protocol prepared by students of the interlocutors (chs. 3–4). The author then takes a deep breath in chapter 5 to place the debate in the larger context of Cassirer’s and Heidegger’s philosophies. But the story does not end there, as chapter 6 examines the relation between both thinkers after the debate. Finally, in chapter 7, Gordon assesses the newer debates concerning this dispute up to the debate between Bourdieu and Habermas concerning Heidegger’s Nazi involvement, though it does not re-engage with Friedman’s thesis, as might have been desired.Regarding his interpretation, Gordon juxtaposes Cassirer’s and Heidegger’s philosophies along the Kantian distinction between spontaneity and receptivity, where both paradigms make different claims on the “normative image of humanity” (5 ff.). Whether humanity is interpreted as spontaneous and world-creating, in optimistic Enlightenment terms (Cassirer), or as receptive and open to the world, i.e. as the “shepherd” rather than the “lord of being” (Heidegger), both are answering the fourth of Kant’s questions, “What is man?” While this distinction is useful for understanding the basic relation between them, it is also—as the author would concede—somewhat too coarse to do justice to their mutual differences and commonalities. Were one to assert a systematic critique, Gordon does not really make up his mind as to the true significance of these paradigms: are they mutually exclusive oppositions or, as he implies elsewhere, two alternative versions of philosophical modernism with a common ground? Research on value congruence rests on the assumption that values denote desirable behaviors and ideals that employees and organizations strive to approach. In the present study, we develop and test the argument that a more complete understanding of value congruence can be achieved by considering a second type of congruence based on employees’ and organizations’ counter-ideal values. We examined this proposition in a time-lagged study of 672 employees from various occupational and organizational backgrounds. We used difference scores as well as (...) polynomial regression and response surface analyses to test our hypotheses. Consistent with our hypotheses, results reveal that counter-ideal value congruence has unique relations to employees’ trust in the organization that go beyond the effects of ideal value congruence. We discuss theoretical and practical implications of this expanded perspective on value congruence. (shrink)

We argue that the majority of the current approaches in research on corporate sustainability are inconsistent with the notion of sustainable development. By defining the notion of instrumentality in the context of corporate sustainability through three conceptual principles we show that current approaches are rooted in a bounded notion of instrumentality which establishes a systematic a priori predominance of economic organizational outcomes over environmental and social aspects. We propose an inclusive notion of profitability that reflects the return on all forms (...) of environmental, social, and economic capital used by a firm. This inclusive notion of corporate profitability helps to redefine corporate profitability as if sustainability matters in that it overcomes the bounded instrumentality that impairs current research on corporate sustainability. We apply this notion to different car manufacturers and develop conceptual implications for future research on corporate sustainability. (shrink)

Leibniz repeatedly states that there is a very close connection between reflection and rationality. In his view, reflective acts somehow lead to self-consciousness, reason, the knowledge of necessary truths, and even to the moral liability of the respective substances. Whereas it might be relatively easy to see how reflective acts lead to self-consciousness, it is much harder to understand how they are connected to rationality. Why should a substance which is able to produce reflective acts therefore be rational? How can (...) the having of reflective acts be responsible for the substance’s ability to reason correctly and to acquire knowledge of necessary and eternal truths? The aim of my paper is to understand better the required mechanisms and to make thus conceivable Leibniz’s bold claim that reflective acts lead to rationality. In order to accomplish this, I will proceed in three steps. First, I will specify what kind of self-consciousness is, according to Leibniz, produced by reflective acts. A substance must recognize itself as a unitary substance bearing perceptions. Second, I will argue that this type of self- consciousness can be seen as the basis for the ability to form judgments. This is possible because the subject-predicate structure of judgments is mirrored by the ontology of substances and their modifications. Third, I will point out that, together with the idea of identity (which we also acquire by reflection), the combination of judgments allows us to make inferences. This ability, in turn, is sufficient for rationality. Thus, I can explain how reflective acts and rationality are connected with each other. (shrink)

For years as an award-winning war reporter, Sebastian Junger traveled to many front lines and frequently put his life at risk. And yet the closest he ever came to death was the summer of 2020 while spending a quiet afternoon at the New England home he shared with his wife and two young children. Crippled by abdominal pain, Junger was rushed to the hospital by ambulance. Once there, he began slipping away. As blackness encroached, he was visited by his (...) dead father, inviting Junger to join him. "It's okay," his father said. "There's nothing to be scared of. I'll take care of you." That was the last thing Junger remembered until he came to the next day when he was told he had suffered a ruptured aneurysm that he should not have survived. This experience spurred Junger--a confirmed atheist raised by his physicist father to respect the empirical--to undertake a scientific, philosophical, and deeply personal examination of mortality and what happens after we die. How do we begin to process the brutal fact that any of us might perish unexpectedly on what begins as an ordinary day? How do we grapple with phenomena that science may be unable to explain? And what happens to a person, emotionally and spiritually, when forced to reckon with such existential questions? (shrink)

Informatics and the Foundations of Legal Reasoning represents a close collaboration between a wide range of disciplines and countries. Fourteen papers, together with a long analytical introduction by the editors, were selected from the contributions of legal theorists, computer scientists, philosophers and logicians who were members of an International Working Group supported by the European Commission. The Group was mandated to work towards determining how far the law is amenable to formal modeling, and in what ways computers might assist legal (...) thinking and practice. The book is the result of discussions held by the Group over two and half years. It will help students and researchers from different backgrounds to focus on a common set of topics of increasing general interest. It embodies the results of work in progress and suggests many issues for further discussion. A stimulating text for undergraduate and graduate courses in law, philosophy and computer science departments, as well as for those interested in the place of computers in legal practice, especially at the international level. Some of Catherine Malabou’s recent work has developed her conception of plasticity (originally deployed in a reading of Hegelian Aufhebung ) in relation to neuroscience. This development clarifies and advances her attempt to bring contemporary theory into dialogue with the natural sciences, while indirectly indicating her engagement with the French tradition in philosophy of science and philosophy of medicine, especially the work of Georges Canguilhem. I argue that we can see her development of plasticity as an answer to some specific (...) shortcomings in Canguilhem’s conception of organic or biological normativity as advanced in The Normal and the Pathological . Such a view of plasticity shows its potential to provide the basis for a powerful critical engagement with contemporary conceptions of selfhood, self-transformation, subjectivation, and the general theory of norms. in UndeterminedInterrogative belief revision is a relatively recent framework for belief revision theory, in which the epistemic state of an agent includes a representation of that agent's research agenda, i.e. the set of questions the agent wants to have answers to. This added structure opens new possibilites for various types of epistemic change that cannot be distinguished in traditional belief revision. In this article I use the so-called 'action model' approach known from the literature on dynamic epistemic logic to provide (...) a unified framework in which we can reason about these various types of epistemic changes. I show how to model some natural examples of epistemic changes involving change of the research agenda in this framework. We address the considerations of the European Commission Expert Group on the ethics of connected and automated vehicles regarding data provision in the event of collisions. While human drivers’ appropriate post-collision behavior is clearly defined, regulations for automated driving do not provide for collision detection. We agree it is important to systematically incorporate citizens’ intuitions into the discourse on the ethics of automated vehicles. Therefore, we investigate whether people expect automated vehicles to behave like humans after an accident, even if (...) this behavior does not directly affect the consequences of the accident. We find that appropriate post-collision behavior substantially influences people’s evaluation of the underlying crash scenario. Moreover, people clearly think that automated vehicles can and should record the accident, stop at the site, and call the police. They are even willing to pay for technological features that enable post-collision behavior. Our study might begin a research program on post-collision behavior, enriching the empirically informed study of automated driving ethics that so far exclusively focuses on pre-collision behavior. In this essay, I first present Husserl's project of phenomenology as first philosophy, its meaning and its scope. My second intention in this text is to lay out the project of the »science of the lifeworld«. But my intention is not merely exegetical; instead, I want to show how both projects hang together systematically. Clarifying this project is a special lacuna in Husserl scholarship as well as in phenomenology and in the reception of Husserl's thought in general. Scholars typically either (...) see the science of the lifeworld as a »hermeneutical« project, disregarding its transcendental underpinnings; or they stick to Husserl's transcendental considerations in conjunction with his focus on subjectivity, ignoring the lifeworld. By showing how both projects belong together I rectify an erroneous Husserl image, and demonstrate how the lifeworld can be a topic within transcendental philosophy. (shrink)

Although the application of mindfulness appears straightforward and its effectiveness is well supported, the concept may easily be misunderstood. This misunderstanding may severely limit the benefit of mindfulness-based interventions. It is therefore necessary to understand that the characteristics of mindfulness are based on a set of seemingly paradoxical structures. This article discusses the underlying paradox by disentangling it into five dialectical (...) positions - activity vs. passivity, wanting vs. non-wanting, changing vs. non-changing, non-judging vs. non-reacting, and active acceptance vs. passive acceptance, respectively. During the COVID-19 epidemic, draconian countermeasures forbidding nonessential human activities have been adopted in several countries worldwide, providing an unprecedented setup for testing and quantifying the current impact of humankind on climate and for driving potential sustainability policies in the postpandemic era from a perspective of complex systems. In this study, we consider heterogeneous sources of environmental and human activity observables, considered as components of a complex socioenvironmental system, and apply information theory, network science, and Bayesian inference to analyze their (...) structural relations and nonlinear dynamics between January 2019 and August 2020 in northern Italy, i.e., before, during, and after the national lockdown. The topological structure of a complex system strongly impacts its collective behavior; therefore, mapping this structure is essential to fully understand the functions of the system as a whole and its fragility to unexpected disruptions or shocks. To this aim, we unravel the causal relationships between the 16 environmental conditions and human activity variables, mapping the backbone of the complex interplay between intervening physical observables—such as NO2 emissions, energy consumption, intervening climate variables, and different flavors of human mobility flows—to a causal network model. To identify a tipping point during the period of observation, denoting the presence of a regime shift between distinct network states, we introduce a novel information-theoretic method based on statistical divergence widely used in statistical physics. We find that despite a measurable decrease in NO2 concentration, due to an overall decrease in human activities, locking down a region as a climate change mitigation is an insufficient remedy to reduce emissions. Our results provide a functional characterization of socioenvironmental interdependent systems, and our analytical framework can be used, more generally, to characterize environmental changes and their interdependencies using statistical physics. The article discusses the relevance of sensor-technologies as media. Beyond technical affordances sensors act as agents of implementing and activating a more-than-human sensorium within encompassing technoecologies of sensation. Outlining the onto-epistemological implications of being ‘in touch with’ sensor-media, the contribution raises questions of what it means to be included in an infrastructure of sensorial interfaces - not only of tech-assisted human-to-human or human-to-machine communication, but of unmanageable processes of machine-to-machine exchange. Delineating sensors as media necessitates reflections on the temporal relations (...) that define the ‘contemporary condition’ of intensified global computation, technological interconnectedness and the ontogenesis of sensor-media milieus, their respective temporalities and concomitant aesthetics of experienced time. El representacionismo es una teoría muy atractiva dentro del proyecto de naturalizar la consciencia según la hipótesis de que la relación de representación puede a su vez ser naturalizada. Para este propósito, los representacionistas con inquietudes naturalistas acuden normalmente a teorías teleosemánticas del contenido mental. No se ha prestado, sin embargo, demasiada atención a la interacción entre el representacionismo y las teorías teleosemánticas del (...) contenido mental. Este artículo da razones para pensar que tal interacción no es venturosa. En particular, argumentaré que aquellos que abrazan la conjunción de ambas teorías están comprometidos con la existencia de experiencias imposibles. (shrink)

Though Indian courts at present are riddled with issues concerning music on the copyright front, significance of another aspect of music based on its essence is largely lost and unexplored. Though courts refer to popular songs in judgments, they are few and far in between. The understanding is that law today is neither poetic nor musical. Music, however, expresses mankind’s faith, hope and aspiration. The use of popular music by Indian courts to write creatively, though not necessarily improve the judgment (...) is restricted and largely unexplored. This paper proposes to explore the dimensions of labour movement through music and the role of law in the making of India as a nation. The association of political dissent through music and the determination of the nation state to procure a stake in the management of the popular music that is sought to belong to itself will be the key theme for understanding the songs that make a nation. Beginning from the struggle for India’s independence to modern day labour movements using music for critique and promoting the vernacular culture are the essence of the paper. Historically, the role of music is central for workers in any labour movement worldwide and is now explored in the Indian context, beginning from the early years of struggle in the nineteenth century to the year of independence in 1947. Recent movements including the protests against profiteering and displacement of persons will also form part of the discussions in this paper. The roles of music and the law have periodically been addressed in the scholarly legal arena but the topic has seldom been explored in-depth from a labour perspective, as paper ventures to do.
