Os princípios e objetivos fundamentais da Constituição Federal de 1988 serviram de bases para que os Direitos Humanos ocupassem grande relevância na sociedade Brasileira. Assim, esses direitos se alargaram internacionalmente através da Declaração Universal dos Direitos Humanos e demais documentos positivados para resguardar essa evolução histórica. Atualmente ocupam grande espaço na sociedade e são de responsabilidade do Estado, que deve propagá-los através de Políticas Publicas eficientes. A máxima kantiana sobre a liberdade trás estreita relação com os direitos fundamentais abrangidos em (...) nossa constituição federal, servindo como base para a criação do nosso ordenamento jurídico no que diz respeito aos direitos humanos, mais precisamente quanto aos princípios da dignidade da pessoa humana e cidadania. In a recent opinion paper, it was argued that individuals with multiple retractions or a record of academic misconduct should not serve as editors, including as editors-in-chief, on the editorial boards of scholarly or academic journals. As a first step towards appreciating how such a policy could be applied in practice, the presence of 30 individuals listed on the Retraction Watch Leaderboard on editorial boards was screened. Six cases are highlighted to gain an appreciation of the potential reputational risks that (...) journals and publishers might incur by including individuals with a tainted academic record on editorial boards. Given the reputational, legal and other risks associated with this type of assessment and decision, more formal positioning and guidance are needed by global ethics policy-related bodies such as COPE, the ICMJE, and the CSE, even more so in journals that claim to follow these organizations’ ethical guidelines. This paper explores that the topic of ethics dumping, its causes and potential remedies. In ED, the weaknesses or gaps in ethics policies and systems of lower income countries are intentionally exploited for intellectual or financial gains through research and publishing by higher income countries with a more stringent or complex ethical infrastructure in which such research and publishing practices would not be permitted. Several examples are provided. Possible ED needs to be evaluated before research takes place, and detected prior (...) to publication as an academic paper, because it might lead to a collaborative effort between a wealthier country with restrictive ethical policies and a less wealthy country with more permissive policies. Consequently, if that collaboration ultimately results in an academic paper, there are ethical ramifications of ED to scholarly communication. Institutional review board approval is central to avoid ED-based collaborations. Blind trust and goodwill alone cannot eliminate the exploitation of indigenous or “vulnerable” populations’ intellect and resources. Combining community-based participatory research using clear codes of research conduct and a simple but robust verification system in academic publishing may reduce the risks of ED-based research from being published. The text deals with the concept of representation in its relation to the concept and sovereignty, in Thomas Hobbes (1588-1679). The work studied is Leviathan, of 1651. The research presents that sovereignty is founded through the original legal act, which establishes an artificial person to represent everyone. This artificial thing is the State. The political society, however, is different from its government, although they are functionally the same.

Intuition-based accounts of the a priori are criticised for appealing to a “mysterious” faculty of rational intuition to explain how a priori knowledge is possible. Analyticity-based accounts are typically motivated by opposition to them, offering a purportedly “non-mysterious” account of the a priori. In this paper, I argue that analyticity-based accounts are in no better position to explain the a priori than intuition-based accounts, and that we have good reason to doubt the explanation they offer. To do this, I focus (...) on recent analyticity-based accounts of the a priori, which appeal to understanding alone to explain the a priori. First, I argue that the appeal to understanding as the source of the a priori is no less mysterious than the appeal to rational intuition. Second, I argue that analyticity-based accounts of the a priori do not provide an alternative to intuition-based accounts as the fundamental explanation they offer of the a priori is one that could equally be endorsed by a friend of rational intuition—and that they fail for reasons that do not undermine intuition-based accounts. Background Ethical decision making in intensive care is a demanding task. The need to proceed to ethical decision is considered to be a stress factor that may lead to burnout. The aim of this study is to explore the ethical problems that may increase burnout levels among physicians and nurses working in Portuguese intensive care units . A quantitative, multicentre, correlational study was conducted among 300 professionals.Results The most crucial ethical decisions made by professionals working in ICU were related to (...) communication, withholding or withdrawing treatments and terminal sedation. A positive relation was found between ethical decision making and burnout in nurses, namely, between burnout and the need to withdraw treatments , to withhold treatments and to proceed to terminal sedation . This did not apply to physicians. Emotional exhaustion was the burnout subdimension most affected by the ethical decision. The nurses' lack of involvement in ethical decision making was identified as a risk factor. Nevertheless, in comparison with nurses , it was the physicians who more keenly felt the need to proceed to ethical decisions in ICU.Conclusions Ethical problems were reported at different levels by physicians and nurses. The type of ethical decisions made by nurses working in Portuguese ICUs had an impact on burnout levels. This did not apply to physicians. This study highlights the need for education in the field of ethics in ICUs and the need to foster inter-disciplinary discussion so as to encourage ethical team deliberation in order to prevent burnout. There are very few (published) accounts of editorial misconduct, and those that do exist are almost exclusively focused on medicine-related areas. In the present article we detail a case of editorial misconduct in a rather underexplored domain, the social sciences. This case demonstrates that although legal systems provide different instruments of protection to avoid, compensate for, and punish misconduct on the part of journal editors, the social and economic power unbalance between authors and publishers suggests the importance of alternative solutions (...) before or instead of bringing a lawsuit to court. It puts forward strong arguments in favour of the need for effective regulatory bodies so as to achieve and maintain a culture of research integrity by all involved in the process. (shrink)

Retractions of COVID-19 literature in both preprints and the peer-reviewed literature serve as a reminder that there are still challenging issues underlying the integrity of the biomedical literature. The risks to academia become larger when such retractions take place in high-ranking biomedical journals. In some cases, retractions result from unreliable or nonexistent data, an issue that could easily be avoided by having open data policies, but there have also been retractions due to oversight in peer review and editorial verification. As (...) COVID-19 continues to affect academics and societies around the world, failures in peer review might also constitute a public health risk. The effectiveness by which COVID-19 literature is corrected, including through retractions, depends on the stringency of measures in place to detect errors and to correct erroneous literature. It is nowadays standard to distinguish between epistemic and metaphysical analyticity. Metaphysical analyticity has been widely rejected, while epistemic analyticity has been widely endorsed. I argue that we also have good reason to reject epistemic analyticity. I do so by considering all the plausible ways of characterizing epistemic analyticity and of drawing the epistemic analytic–synthetic distinction. I argue that on all of them, the distinction fails to carve at the semantic joints. I conclude that there is good reason to think (...) that there is no semantic distinction to be drawn between analytic and synthetic sentences. (shrink)

Given the need to explore the factors that can account for a better understanding of the intention-behavior gap in exercise practice in health club settings, and considering the emergence of hedonic assumptions related to exercise adherence, this cross-sectional study aimed to test the moderation effect of the intensity traits agreement/disagreement in three relevant outcomes of exercise enjoyment: exercise habit, intention to continue exercising, and exercise frequency. A sample consisted of 273 exercisers (male = 127; Mage = 36.21; SD = 11.29) (...) enrolled in nine health clubs who voluntarily fulfilled a battery of questionnaires. All analyses were performed using SPSS v. 23.0/PROCESS v. 3.5. The results of the study presented a moderation effect of exercise intensity traits agreement on three relevant enjoyment outcomes: exercise habit, intention to continue exercising, and exercise frequency. No relevant results emerged from intensity traits disagreement. The results suggest that assessing and tailoring exercise prescription and supervision in order to customize exercise intensity may influence future exercise participation. (shrink)

W. V. Quine famously claimed that no statement is immune to revision. This thesis has had a profound impact on twentieth century philosophy, and it still occupies centre stage in many contemporary debates. However, despite its importance it is not clear how it should be interpreted. I show that the thesis is in fact ambiguous between three substantially different theses. I illustrate the importance of clarifying it by assessing its use in the debate against the existence of a priori knowledge. (...) I show how the three different readings of the thesis can be used to generate three substantially different and philosophically significant arguments against the a priori. The blogosphere is full of personalities with masks, or pseudonyms. Although not a desired state of public communication, one could excuse the use of pseudonyms in blogs and social media, which are generally unregulated or weakly regulated. However, in science publishing, there are increasingly strict rules regarding the use of false identities for authors, the lack of institutional or contact details, and the lack of conflicts of interest, and such instances are generally considered to be misconduct. This is because these (...) violations of publishing protocol decrease trust and confidence in science and bring disrepute to those scientists who conform to the rules set out by journals and publishers and abide by them. Thus, when cases are encountered where trust and protocol in publishing are breached, these deserve to be highlighted. In this letter, I focus on Neuroskeptic, a highly prominent science critic, primarily on the blogosphere and in social media, highlighting the dangers associated with the use of pseudonyms in academic publishing. A surge in post-publication activity related to editing, including by technical editors and copyeditors, is worthy of some discussion. One of these issues involves the issue of 'tortured phrases', which are bizarre terms and phrases in academic papers that replace standard English expressions or jargon. This phenomenon may reveal an attempt to avoid the detection of textual similarity or to masquerade plagiarism, and yet remain undetected by editors, peer reviewers and text editors. Potentially thousands of cases have already been discovered (...) and reported publicly on the post-publication platform PubPeer. In this opinion paper, 35 cases from ranked scholarly journals are presented, mainly the fields of materials, computer and engineering sciences. This collation serves to expand discussion about this integrity-related phenomenon and to increase educational awareness of the topic. (shrink)

The phenomenon of cheating in higher education is of overwhelming importance in that the students engaging in these acts are unlikely to have the skills necessary for their future professional life. Despite its relevance, the empirical evaluation of cheating in universities has been almost exclusively focused on the US context. Little is known about cheating at the European level, let alone in Portugal. Even less is explored at the regional level. In this paper we present evidence on the perception of (...) cheating by Portuguese undergraduate students of economics/business degrees. We undertake a large-scale survey, involving 2675 students from all Portuguese mainland public universities. We found that copying-favourable environments are associated with a higher propensity to cheat. Moreover, in universities where ‘codes of honour’ exist, this propensity tends to be lower. Finally, the propensity to copy seems to be highly influenced by the cultural systems and socially-related factors of different regions. (shrink)

Georg Lukács was one of the most important philosophers of the twentieth century, his early Marxist work History and Class Consciousness (HCC) of 1923 being considered a hallmark of Critical Theory. But does it still offer, one century after its first publication, productive tools to analyze capitalist societies? To answer this question, we must first untangle the conceptual labyrinth in which the book’s main categories have been enmeshed. To contribute to this end, this paper examines the cogency of Lukács’s later (...) self-criticism (implicit in The Young Hegel and explicit in his 1967 critical preface to HCC) that his early concept of reification conflates the phenomena of alienation and objectification and thereby leads to an acritical and idealist view of capitalism. Our conclusion is that the self-criticism does not hold insofar as the theoretical framework developed in HCC involves an approach to the relation between subject and object that is much more sophisticated than understanding reification merely as the former turning into the latter. In the academic world, despite their corrective nature, there is still a negative stigma attached to retractions, even more so if they are based on ethical infractions. Editors-in-chief and editors are role models in academic and scholarly communities. Thus, if they have multiple retractions or a record of academic misconduct, this viewpoint argues that they should not serve on journals’ editorial boards. There has been some degree of scepticism regarding the intelligibility of the notion of truth in virtue of meaning – which has come to be known as metaphysical notion of analyticity – ever since W. V. Quine’s famous attack. Such scepticism has been forcefully reinforced by Paul Boghossian, and more recently by Timothy Williamson. My main aim is to defend this sceptical stance. I argue that, understood literally, we are right to repudiate this notion of analyticity. But understood less literally, (...) we might find it less objectionable. Drawing from two-dimensional approaches to semantics, I offer what could be a new way of understanding the metaphysical notion of analyticity, one that does not suffer from the problems associated with the old notion of metaphysical analyticity. I argue that despite its intelligibility, this new notion does not seem to capture a semantic phenomenon deserving of the name ‘analytic’ or if it does it fails to capture the kind of semantic phenomenon necessary for the empiricist account of the a priori. Quine “Dois Dogmas do empirismo” (1951), a noção passou a ser vista com grande cepticismo. Mais recentemente, Paul Boghossian, no artigo “Analiticidade Reconsiderada” (1996), propôs uma forma de compreender a noção que é, putativamente, imune às críticas de Quine. O interesse na noção de analiticidade ficou desta forma renovado, assim como a (...) sua centralidade no debate acerca da possibilidade do conhecimento a priori. The aim of this paper is to show to what extent Descartes can be situated within the Augustinian metaphysical tradition and to what extent he has departed from it. To this end, we will argue that Descartes has borrowed his main Meditations’ arguments from Augustine’s philosophy. However, in spite of all factual and textual evidence we will provide against the originality of Descartes’ metaphysical discussions, it will be stressed, on the other hand, that in borrowing not only the cogito argument, (...) but also some general features of his philosophy from Augustine’s works, Descartes intends to frame a metaphysics which will be the ground on his new mechanistic physics. Having this in mind, we will hold that no claim can be put forward against the originality and far-reaching scope of Descartes’ philosophical intentions. Indeed, Descartes’ purpose is to build a new science under a metaphysics, even though this metaphysics is the Augustianian one. (shrink)

This work aims to present the meaning of the distributions of the sensible in Jacques Rancière's theory. In order to understand the genesis of the distributions of the sensible – especially at this particular moment –, we will start from Rancier's definition of political subjectivization, which is inherent to the contribution of the distribution of places promoted by instances of domination. After all, for the author, politics is not the distribution of power. The distribution of the sensible would be a (...) political and policy process that is sometimes mediated by instances of conflict, and sometimes interceded by instances of power, and this tends to affect the way in which subjects occupy the sensible community by verifying the ways in which reality is taken and ordered following the order of domination. Nosso objetivo foi discutir a análise do estatuto das armas e do armamento no quadro de uma reflexão sobre a tecnologia como apresentada por Gilles Deleuze e Félix Guattari na obra Mil Platôs. Os autores oferecem uma interpretação sobre a especificidade desses elementos técnicos a partir de sua ligação com o processo de inovação das sociedades guerreiras nômades. Esse processo é indissociável de certo modo de operação da metalurgia artesanal e itinerante sobre o phylum maquínico, definido como matéria-movimento composta por (...) singularidades e manifesta em traços de expressão determinados. Porém, o phylum maquínico e a linhagem tecnológica do armamento também podem ser capturados por um aparelho de Estado, passando a funcionar de maneira distinta daquela em que operavam quando conexos ao espaço nômade. Essa captura está na gênese de uma indústria armamentista, cerne problemático da relação entre guerra, técnica e capital para o qual se direciona nossa reflexão final. (shrink)

O conceito tardio de plano de imanência na filosofia de Gilles Deleuze diz respeito não apenas à recusa de um segundo mundo transcendente, mas também de um campo transcendental organizado sob a determinação recíproca entre sujeito universal e forma geral de objeto. A construção desse conceito passa, portanto, pela crítica do fundamento transcendental kantiano desenvolvida por Deleuze através de um resgate original do empirismo de Hume. A discussão gira em torno do estatuto da subjetividade: segundo a crítica empírica, o sujeito (...) não pode ser entendido como um pressuposto a _priori_, mas deve, sim, ser compreendido como um produto _a_ _posteriori_ cuja emergência remete, em última instância, a um princípio de repetição. Assim, buscando compreender a amplitude da noção de imanência na filosofia deleuziana, analisamos a leitura do filósofo francês a respeito do problema do fundamento transcendental, sobretudo em _Empirismo e Subjetividade_. Por fim, indicamos brevemente de que maneira o conjunto dessa problemática reaparece em _Diferença e Repetição_. (shrink)

Angesichts der angeblichen axiologischen Neutralität des Wissens, die in Teilen der Wissenschaft proklamiert wird, bieten seit langem mehrere philosophische Strömungen verschiedene Darstellungen der internen Verbindung zwischen Wissen und Machtverhältnissen. Diese reiche Geschichte umfasst Beiträge u. a. aus dem Poststrukturalismus, dem Marxismus, der Kritischen Theorie, den Decolonial und Critical Race Studies, dem Feminismus und den Theorien der epistemischen Ungerechtigkeit. Trotz ihrer vielen theoretischen Divergenzen stimmen sie alle mit der grundlegenden diagnostischen Prämisse überein, dass Machtungleichheiten eine bedeutsame Rolle bei der Definition dessen (...) spielen, was als „Wissen“ zählt, und dass infolgedessen sozial und politisch unterdrückte Gruppen dazu neigen, auch im Bereich der epistemischen Praktiken wie der Systematisierung, Legitimierung und Übertragung von Wissen unterdrückt zu werden. Diese Kritiker:innen einer positivistischen Objektivität des Wissens haben jedoch sehr unterschiedliche Ansichten über die Wurzeln, die Auswirkungen und das Funktionieren der Verbindung zwischen epistemischen Praktiken und Machtungleichheiten. In diesem Beitrag wird eine dieser Differenzen untersucht, nämlich in Bezug auf die Frage: Bedeutet soziale und politische Unterdrückung notwendigerweise, dass die betroffenen Subjekte im Vergleich zu privilegierten Gruppen in einer schlechteren Position sind, um ihre Unterdrückung zu verstehen und ihr Widerstand zu leisten? Zwei möglichen Antworten auf diese Frage werden hier unter Rekurs auf eine Gegenüberstellung von Miranda Frickers Theorie der epistemischen Ungerechtigkeit einerseits und der feministischen Standpunkttheorie von Dorothy Smith andererseits untersucht. Während der erstgenannte Ansatz Unterdrückung vor allem als epistemisch und politisch schwächend ansieht, betrachtet der letztere die einzigartige Position der Unterdrückten als potenzielle Quelle von Wissen und politischem Handeln. Diese Gegenüberstellung wird eine Kritik einseitiger Darstellungen der Erfahrung von Unterdrückung ermöglichen. Eine Vermittlung zwischen den Polen dieses Gegensatzes wird anschließend durch das Konzept der Verwundbarkeit versucht. Um angesichts der Mehrdeutigkeit des Konzepts genauer zu bestimmen, was mit „Verwundbarkeit“ gemeint ist, wird eine analytische Unterscheidung zwischen Verwundbarkeit als einerseits konstitutiv und andererseits kontingent getroffen. Die Hypothese ist, dass ein vielschichtiges Verständnis von Verwundbarkeit – zeitgleich als kontingentes Risiko der Unterwerfung unter die Fremdheit und als konstitutive Öffnung zum Anderssein – ein wichtiges konzeptionelles Instrument sein kann, um die epistemischen und politischen Ambiguitäten sozialer Ungerechtigkeiten zu erfassen. ABSTRACT The aim of this article was to develop an interpretation of the relation between Deleuzian transcendental empiricism and Deleuze-Guattarian political philosophy in the “Treatise on Nomadology,” which focuses on the concept of the nomadic war machine. To understand this concept, it is necessary to keep in mind that this is a transcendental Idea or virtual multiplicity, correlated of an effondement (‘ungrounding’), which sustains a difference by right in relation to the State apparatus and the military institution. On the basis (...) of this premise, the three aspects of the nomadic war machine are analyzed: a spatial-geographical one (the smooth space), a numerical one (the numbering number), and an affective one (the weapons). Finally, we conclude with an examination of the authors’ critical reading of the notion of absolute war in Clausewitz, which allows us to strengthen the interpretation of the concept of nomadic war machine as transcendental Idea. According to the most popular account of the a priori, which we might call Analytic Account of the A Priori, we can explain the a priori in terms of the notion of analyticity. According to the least popular account of the a priori, the explanation of the a priori proceeds by appealing to the faculties used in the acquisition of a priori knowledge, such as the faculty of rational intuition – call this Rationalist Account of the A Priori. The main (...) aim of this paper is to challenge the analytic account of the a priori to motivate a return to rationalism. To achieve this aim, I discuss and challenge two very different analytic accounts of the a priori: a concept-based account that relies on meaning-justification links, and an understanding-based account that does not rely on such links. I argue that the former is both extensionally inadequate and explanatorily deficient, and the latter can be made to work but only by employing such a rich notion of understanding that renders it a form of rationalism in disguise. I conclude by motivating a rationalist faculty-based account of the a priori. (shrink)

Para construir seu próprio edifício filosófico em _Diferença e Repetição_, Deleuze dedicou-se no início de sua trajetória à pesquisa sistemática daquilo que chamou de “linhagem menor” em história da filosofia. Neste artigo buscamos explorar especificamente o embate deleuziano com o pensamento de Leibniz, situado no limiar dessa linhagem. Embora uma monografia mais extensiva tenha sido publicada por Deleuze apenas décadas mais tarde, seguimos a hipótese de que seus primeiros esboços críticos sobre o pensamento leibniziano aparecem já no seminário _O que (...) é fundar?_, endereçado ao problema do fundamento. À luz desse texto, abre-se uma perspectiva produtiva para a compreensão da relação entre as filosofias dos dois pensadores. (shrink)

Ayant ce but en vue, on va d’abord discuter l’attaque que Leibniz a déclenchée contre la méthodologie cartésienne.
