Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Human persons exist longer than a single moment in time; they persist through time. However, so far it has not been possible to make this natural and widespread assumption metaphysically comprehensible. The philosophical debate on personal identity is rather stuck in a dilemma: reductionist theories explain personal identity away, while non-reductionist theories fail to give any informative account at all. This chapter argues that this dilemma emerges from an underlying commitment, shared by both sides of in the debate, to an (...) ontology which that gives the priority to static unchanging things. The claim defended here is that the dilemma of personal identity can be overcome if we acknowledge the biological nature of human persons and switch to a process- ontological framework that takes process and change to be ontologically primary. Human persons are biological higher-order processes, rather than things, and their identity conditions can be scientifically investigated. (shrink)

This paper is about rewilding and the tensions it involves. Rewilding is a relatively novel approach to nature conservation, which seeks to be proactive and ambitious in the face of continuing environmental decline. Whilst definitions of rewilding place a strong emphasis on non-human agency, it is an inescapably human aspiration resulting in a range of social conflicts. The paper focuses on the case study of the Cambrian Wildwood project in Mid Wales (UK), evaluating the ways in which debate and strategic (...) action to advance rewilding is proceeding, assessing the extent to which compromise and learning has occurred amongst advocates. As such, we provide an important addition to the field, by detailing how conflicts play out over time and how actors’ positioning and approach shifts, and why. In this case, tempers have flared around the threat that rewilding is seen to pose to resident farming communities. Tensions discussed include the differing social constructions of landscape and nature involved; the distribution of impacts on different stakeholders; and the relative power of different actors to make decisions and gain representation. Responding to these, the paper outlines how rewilding advocates have sought to advance a more peopled and culturally responsive vision, which seeks to champion sustainable livelihood strategies. The changes in approach detailed demonstrate a reflexive stance from rewilders, which suggests that learning and adaptation can occur. Nonetheless, caution is expressed regarding the extent to which rewilding can truly advance inclusive opportunities for rural change, given a continued return amongst stakeholders to exclusionary narratives of belonging and authenticity, suggesting substantive difficulty in moving beyond longstanding concerns over identity and the re-imagination of place. Rewilding, it would seem, is about who we think we are and how we co-constitute our sense of self. We, therefore, close by arguing that tactics and politicking can only have so much bearing, tensions over rewilding are unavoidably emotional. (shrink)

Background The European Union aims to optimize patient protection and efficiency of health-care research by harmonizing procedures across Member States. Nonetheless, further improvements are required to increase multicenter research efficiency. We investigated IRB procedures in a large prospective European multicenter study on traumatic brain injury, aiming to inform and stimulate initiatives to improve efficiency. Methods We reviewed relevant documents regarding IRB submission and IRB approval from European neurotrauma centers participating in the Collaborative European NeuroTrauma Effectiveness Research in Traumatic Brain Injury. (...) Documents included detailed information on IRB procedures and the duration from IRB submission until approval. They were translated and analyzed to determine the level of harmonization of IRB procedures within Europe. Results From 18 countries, 66 centers provided the requested documents. The primary IRB review was conducted centrally or locally and primary IRB approval was obtained after one, two or three review rounds with a median duration of respectively 50 and 98 days until primary IRB approval. Additional IRB approval was required in 55% of countries and could increase duration to 535 days. Total duration from submission until required IRB approval was obtained was 114 days and appeared to be shorter after submission to local IRBs compared to central IRBs. Conclusion We found variation in IRB procedures between and within European countries. There were differences in submission and approval requirements, number of review rounds and total duration. Research collaborations could benefit from the implementation of more uniform legislation and regulation while acknowledging local cultural habits and moral values between countries. (shrink)

In July 2019, Stella Creasy MP and her team succeeded in attaching an amendment to a largely administrative bill which would require the UK government to liberalise abortion laws in Northern Ireland by 21 October 2019, provided the Northern Ireland government does not resume before that date.1 The amendment succeeded in the Commons, 332 votes to 99 and later, with some adjustments, in the Lords, 182 votes to 37. The Bill received Royal Assent on 24 July 2019. In Northern Ireland, (...) abortion remains a criminal offence punishable by up to life imprisonment in all except exceptional circumstances, that is, where it is ‘necessary to preserve the life of the woman’ or where there is a ‘risk of serious adverse effect which is either long term or permanent’.2 The law makes no provision for women who are pregnant as a result of rape, incest or in the case of fatal fetal abnormality. Because there is a lack of clarity around which circumstances or conditions would have a sufficiently ‘serious and long-term adverse effect’, it has been argued that the law has had a ‘chilling effect’ on service provision.3 As a result, only 13 abortions were performed in Northern Ireland in 2018/2019.4 Instead, more than 1000 women travelled from Northern Ireland to England to access legal abortion services.5 A recent review of the law in Northern Ireland concluded that this situation disadvantages women who cannot afford to or are unable to travel.3 Women are also reportedly purchasing abortifacients unlawfully online, exposing them to the risk of prosecution as well as to risks where the pills are unsafe or lead to complications. Affective disposition theory explains well the process of enjoying hero narratives but not the appeal of narratives featuring antiheroes. Recent antihero studies suggest that character identification and moral disengagement might be important factors in the enjoyment of such fare. The current study builds on this work. A sample of 101 self-identified fans and nonfans of the television series 24 viewed a condensed version of Season 1, providing evaluation of various protagonist perceptions, moral judgments, and emotional responses to the narrative, as (...) well as overall enjoyment. As expected, fans reported greater liking of the protagonist and greater enjoyment. But more importantly, regression analyses illuminated key differences between the groups in terms of the factors predicting enjoyment, providing a clearer picture of how we enjoy antihero narratives. The NHS is an institution of great importance to everybody in the UK - not only doctors, nurses and other health professionals, but also to patients, carers and their families. However, problems within the NHS are regularly reported in the media and we are all anxious about waiting lists, about whether potential illnesses will be identified treated in time, about bleeding to death on trollies in corridors or being struck down by antibiotic-resistant superbugs. Freges Werk gilt heute als Klassiker der Philosophie und Philosophiegeschichte. Dessen Einfluss auf unterschiedlichste Bereiche der Philosophie, von der Logik und Mathematik bis hin zur Ontologie, Epistemologie und Sprachphilosophie, ist unbestritten. Vor diesem Hintergrund scheint die Annahme naheliegend, dass Freges Wirkungsgeschichte umfassend erforscht ist. Tatsächlich gilt dies nicht für die komplexe Rezeptionsgeschichte Freges, auch wenn es dazu durchaus eine Reihe von neuen, lehrreichen und detaillierten Studien gibt. 1 Der vorliegende Beitrag befasst sich mit zwei bisher kaum bekannten und unbeachtet gebliebenen (...) Frege-Rezeptionen aus den 30er und 40er Jahren des 20. Jahrhunderts. Es handelt sich dabei zum einen um Wilma Papsts Studie Gottlob Frege als Philosoph (1932), zum anderen um Editha Krenzs Doktorarbeit Der Zahlbegriff bei Frege (1942). In der Literatur werden die Namen der Autorinnen zwar wiederholt in Fußnoten oder im Literaturverzeichnis genannt, doch bis auf wenige Ausnahmen nicht diskutiert. Im Folgenden soll anhand einer problemgeschichtlichen Kontextualisierung gezeigt werden, dass beide Arbeiten interessante Aspekte zu Frege und seiner Rezeption beleuchten. (shrink)

This commentary focuses on evidence from autism concerning the relation between metacognition and mindreading. We support Carruthers' rejection of models 1 (independent systems) and 3 (metacognition before mindreading), and provide evidence to strengthen his critique. However, we also present evidence from autism that we believe supports model 2 (one mechanism, two modes of access) over model 4 (mindreading is prior).

Le rôle de Fernand Braudel dans l’invention des aires culturelles à la française et sa promotion des échanges Est-Ouest sont contextualisés par l’histoire du dialogue asymétrique et politisé entre historiens français et soviétiques. L’article montre que son analyse de l’économie-monde russe des 16e-18e siècles et de la civilisation russe a amené Braudel à proposer un décentrement original de l’analyse spatiale, loin du regard occidental traditionnellement (...) porté de l’Ouest vers l’Est. What is metaphysics? And what do we need it for? In this paper I argue that if we answer the first question appropriately, the second question becomes pointless. To understand what metaphysics is means to understand what it is for. I shall propose that metaphysics, as a philosophical discipline, is the addressing of reality with respect to the intelligibility of reality as a whole and, i.e., the addressing of reality's being-addressed in various contexts (everyday and scientific). Insofar as reason is (...) that which performs this ubiquitous addressing of reality, metaphysics – the addressing of the addressing of reality – turns out to be a self-addressal of reason. I shall rebut sceptical objections to this proposal, which are nourished by realist convictions, by emphasising an interesting and constructive metaphysical thesis entailed in the proposed understanding of metaphysics. At the same time, I shall oppose to idealist simplifications of the proposal by means of some reflections on the only legitimate source of a general (as opposed to special) critique of metaphysics: the questionability of the belief in a perfect intelligibility of reality. Many views rely on the idea that it can never be rational to have high confidence in something like, “P, but my evidence doesn’t support P.” Call this idea the “Non-Akrasia Constraint”. Just as an akratic agent acts in a way she believes she ought not act, an epistemically akratic agent believes something that she believes is unsupported by her evidence. The Non-Akrasia Constraint says that ideally rational agents will never be epistemically akratic. In a number of recent papers, the (...) Non-Akrasia Constraint has been called into question. A bodily self is characterized by pre-reflective bodily self-consciousness that is.

This paper is about one of the puzzles of bodily self-consciousness: can an experience be both and at the same time an experience of one′s physicality and of one′s subjectivity ? We will answer this question positively by determining a form of experience where the body′s physicality is experienced in a non-reifying manner. We will consider a form of experience of oneself as bodily which is different from both “prenoetic embodiment” and “pre-reflective bodily consciousness” and rather corresponds to a form (...) of reflective access to subjectivity at the bodily level. In particular, we argue that subjectivity is bodily expressed, thereby allowing the experience of the body′s subjectivity directly during perceptual experiences of the body. We use an interweaving of phenomenological explorations and ethnographical methods which allows validating this proposal by considering the experience of body experts (dancers). (shrink)

We discuss the justification of Bickle's “ruthless” reductionism. Bickle intends to show that we know enough about neurons to draw conclusions about the “whole” brain and about the mind. However, his reductionism does not take into account the complexity of the nervous system and the fact that new properties emerge at each significant level of integration from the coupled functioning of elementary components. From a methodological point of view, we argue that neuronal and cognitive models have to exert a mutual (...) constraint(MC) on each other. This approach would refuse to award any priority of cognitive approaches over neuroscience, and reciprocally, to refuse any priority of neuroscience over cognitive approaches. MC thus argues against radicalreductionism at the methodological level. (shrink)

Nous verrons alors que la sotériologie tillichienne se caractérise par trois signes de la création nouvelle : la réconciliation, la réunion avec le fondement de notre être et la résurrection. In the first part of this paper I characterize a minimal form of self-consciousness, namely pre-reflective self-consciousness. It is a constant structural feature of conscious experience, and corresponds to the consciousness of the self-as-subject that is not taken as an intentional object. In the second part, I argue that contemporary cognitive neuroscience has by and large missed this fundamental form of self-consciousness in its investigation of various forms of self-experience. In the third part, I exemplify how the notion of pre-reflective (...) self-awareness can be of relevance for empirical research. In particular, I propose to interpret processes of sensorimotor integration in light of the phenomenological approach that allows the definition of pre-reflective self-consciousness. (shrink)

What are epiphanies, and why do so many people so frequently experience them? Are they just transient phenomena in our brains, or are they the revelations of objective value that they very often seem to be? What do they tell us about the world, and about ourselves? How, if at all, do epiphanies fit in with our moral systems and our theories of (...) how to live? And how do epiphanic experiences fit in with the rest of our lives? These are Sophie Grace Chappell's questions in this ground-breaking new study of an area of inquiry that has always been right under our noses, but remains surprisingly under-explored in contemporary philosophy. We explore the idea that a testimony is always constituted by at least three parts—the word of the witness, the listening of the one to whom it is addressed, and language as a symbolic register where speaking and listening are inscribed. Thus, the structure of testimony would not be captured only by the subjective formula “I was there”—a subject designates himself in reference to a past experience—, nor by the intersubjective formula “I am speaking to you”—a subject designates himself and (...) his listener in the synchrony of the word addressing the other. What is also necessary to consider, in order to capture the structure of testimony, is that “there is language”—the testimony transcends diachronically the speaker and the hearer by inscribing them inseparably in the symbolic register that they share, namely language. Empirical and experiential investigations allow the distinction between observational and non-observational forms of subjective bodily experiences. From a first-person perspective, the biological body can be (1) an "opaque body" taken as an intentional object of observational consciousness, (2) a "performative body" pre-reflectively experienced as a subject/agent, (3) a "transparent body" pre-reflectively experienced as the bodily mode of givenness of objects in the external world, or (4) an "invisible body" absent from experience. It is proposed that pre-reflective bodily experiences rely on (...) sensori-motor integrative mechanisms that process information on the external world in a self relative way. These processes are identification-free in that the self is not identified as an object of observation. Moreover, it is defended that observational self-consciousness must be grounded on such identification-free processes and pre-reflective forms of bodily experience. (shrink)

Philosophical considerations as well as several recent studies from neurophysiology, neuropsychology, and psychophysics converged in showing that the peripersonal space is structured in a body-centred manner and represented through integrated sensory inputs. Multisensory representations may deserve the function of coding peripersonal space for avoiding or interacting with objects. Neuropsychological evidence is reviewed for dynamic interactions between space representations and action execution, as revealed by the behavioural effects that the use of a tool, as a physical extension of the reachable space, (...) produces on visual–tactile extinction. In particular, tool-use transiently modifies action space representation in a functionally effective way. The possibility is discussed that the investigation of multisensory space representations for action provides an empirical way to consider in its specificity pre-reflexive self-consciousness by considering the intertwining of self-relatedness and object-directness of spatial experience shaped by multisensory and sensorimotor integrations. Believing rationally is epistemically valuable, or so we tend to think. It’s something we strive for in our own beliefs, and we criticize others for falling short of it. We theorize about rationality, in part, because we want to be rational. But why? I argue that how we answer this question depends on how permissive our theory of rationality is. Impermissive and extremely permissive views can give good answers; moderately permissive views cannot.

While scientific pluralism enjoys widespread popularity within the philosophy of science, a related position, epistemic relativism, does not have much traction. Defenders of scientific pluralism, however, dread the question of whether scientific pluralism entails epistemic relativism. It is often argued that if a scientific pluralist accepts epistemic relativism, she will be unable to pass judgment because she believes that “anything goes”. In this article, I will show this concern to be unnecessary. I will also argue that common strategies to differentiate (...) relativism and pluralism fail. Building upon this analysis, I will propose a new way of looking at both positions’ relations. This article aims to understand what explains the friction between scientific pluralism and epistemic relativism. I will demonstrate that conceptualizing both epistemic relativism and scientific pluralism as “stances” sheds better light on their relation and demonstrates that it is, in principle, possible to support both positions at the same time. Preferred policies and levels of analysis, however, cause friction in practice. (shrink)
