The Draft Common Frame of Reference is just published. Now the creation of the final Common Frame of Reference is one of the most important issues in the field of European Private Law. The volume discusses the key question as to what extent the CFR can and should reflect existing EC Contract Law, and to what extent the DCFR has already incorporated the acquis communautaire. The rapidly increasing wealth of genomic data has driven the development of tools to assist in the task of representing and processing information about genes, their products and their functions. One of the most important of these tools is the Gene Ontology (GO), which is being developed in tandem with work on a variety of bioinformatics databases. An examination of the structure of GO, however, reveals a number of problems, which we believe can be resolved by taking account of certain (...) organizing principles drawn from philosophical ontology. We shall explore the results of applying such principles to GO with a view to improving GO’s consistency and coherence and thus its future applicability in the automated processing of biological data. BackgroundThe COVID-19 pandemic has created ethical challenges for intensive care unit (ICU) professionals, potentially causing moral distress. This study explored the levels and causes of moral distress and the ethical climate in Dutch ICUs during COVID-19.MethodsAn extended version of the Measurement of Moral Distress for Healthcare Professionals (MMD-HP) and Ethical Decision Making Climate Questionnaire (EDMCQ) were online distributed among all 84 ICUs. Moral distress scores in nurses and intensivists were compared with the historical control group one year before COVID-19. ResultsThree (...) hundred forty-five nurses (70.7%), 40 intensivists (8.2%), and 103 supporting staff (21.1%) completed the survey. Moral distress levels were higher for nurses than supporting staff. Moral distress levels in intensivists did not differ significantly from those of nurses and supporting staff. “Inadequate emotional support for patients and their families” was the highest-ranked cause of moral distress for all groups of professionals. Of all factors, all professions rated the ethical climate most positively regarding the culture of mutual respect, ethical awareness and support. “Culture of not avoiding end-of-life-decisions” and “Self-reflective and empowering leadership” received the lowest mean scores. Moral distress scores during COVID-19 were significantly lower for ICU nurses (p < 0.001) and intensivists (p < 0.05) compared to one year prior.ConclusionLevels and causes of moral distress vary between ICU professionals and differ from the historical control group. Targeted interventions that address moral distress during a crisis are desirable to improve the mental health and retention of ICU professionals and the quality of patient care. (shrink)

_Naturalism and Democracy_, first published in German in 2014, presents a long-awaited commentary on Spinoza’s _Political Treatise _. It gives a detailed analysis of Spinoza’s latest theory of State and Law, with special attention to his democratic approach.

This article develops theory on responsible leadership based on a model involving three leadership roles: an expert who displays organizational expertise, a facilitator who cares for and motivates employees and a citizen who considers the consequences of her or his decisions for society. It draws on previous responsible leadership research, stakeholder theory and theories of behavioral complexity to conceptualize the roles model of responsible leadership. Responsible leadership is positioned as a concept that requires leaders to show behavioral complexity in addressing (...) all three roles. In three studies, we provide a first empirical test of antecedents and outcomes of the roles model of responsible leadership. The results of the studies indicate that responsible leadership is positively related to the leader’s perceived effectiveness, favorable stakeholder evaluations and employee engagement with the organization and society. Responsible leadership behavior, in turn, seems to be facilitated by leader empathy, positive affect and universal value orientation. (shrink)

Although there is increasing public criticism of intensive livestock production, the market share of meat with an animal welfare standard exceeding legal requirements remains small. Food retailers, in their role as gatekeepers, can influence changes in production and consumption patterns. Their strategic role between farmers and consumers allows them to control commodity, information and value flow and therefore places them into a key position when it comes to the distribution of meat with a higher animal welfare standard. The aim of (...) this explorative study is to identify factors which motivate food retailers to take on the marketing of products of increased animal welfare standards, in this case, pasture-based beef. Nine in depth-interviews were conducted with representatives of the food retail industry. The interviews took place in June 2018, followed a structured guideline and were transcribed verbatim. The transcripts were categorized and evaluated using qualitative content analysis. Results showed that food retailers are driven by both extrinsic and intrinsic motives. The main extrinsic motive is the perceived customer demand. Consciousness for animal welfare and the regional production cycles, including close connection between farmers and retailers are inherently intrinsic motives. Interestingly, the interviewed retailers show a high personal interest and moral obligation with regard to sourcing and marketing pasture-based beef. As such, this research finds innovative retailers, who take on a new role in sustainable food systems which exceed classical distribution functions and may have a considerable effect in transforming the food system. BackgroundA patient who fulfils the due diligence requirements for euthanasia, and is medically suitable, is able to donate his organs after euthanasia in Belgium, the Netherlands and Canada. Since 2012, more than 70 patients have undergone this combined procedure in the Netherlands. Even though all patients who undergo euthanasia are suffering hopelessly and unbearably, some of these patients are nevertheless willing to help others in need of an organ. Organ donation after euthanasia is a so-called donation after circulatory death (DCD), (...) Maastricht category III procedure, which takes place following cardiac arrest, comparable to donation after withdrawal of life sustaining therapy in critically ill patients. To minimize the period of organ ischemia, the patient is transported to the operating room immediately after the legally mandated no-touch period of 5 min following circulatory arrest. This means that the organ donation procedure following euthanasia must take place in the hospital, which appears to be insurmountable to many patients who are willing to donate, since they already spent a lot of time in the hospital. Case presentationThis article describes the procedure of organ donation after euthanasia starting at home (ODAEH) following anesthesia in a former health care professional suffering from multiple system atrophy. This case is unique for at least two reasons. He spent his last conscious hours surrounded by his family at home, after which he underwent general anaesthesia and was intubated, before being transported to the hospital for euthanasia and organ donation. In addition, the patient explicitly requested the euthanasia to be performed in the preparation room, next to the operating room, in order to limit the period of organ ischemia due to transport time from the intensive care unit to the operating room. The medical, legal and ethical considerations related to this illustrative case are subsequently discussed.ConclusionsOrgan donation after euthanasia is a pure act of altruism. This combined procedure can also be performed after the patient has been anesthetized at home and during transportation to the hospital. (shrink)

Europe’s affluent democracies adopted different policy strategies to buffer their labor markets from the effects of the worldwide recession that followed the financial crisis in 2007. This article offers a sociologically anchored historical institutionalist explanation to account for this divergence. Reviewing the politics of employment policymaking before, during, and after the crisis in the United Kingdom, Germany, and Denmark, the article traces partisan actors’ tactics of maneuvering within the constraints of institutionally embedded mass preferences to legitimate their policies and improve (...) their electoral performance. The analysis moves beyond contemporary treatments of path-dependent institutional evolution in two important ways. Rather than focusing on how arrangements at the work-welfare nexus provide actors with particular functional benefits and differential power resources, it examines institutions’ ideational effects on the construction of electorates’ interests. Moreover, it illuminates partisan politicians’ room for strategic agency, breaking with interpretations that view government responses as the product of particular producer group coalitions. The linguistic complexity of words has largely been studied on the behavioral level and in experimental settings. Only little is known about the neural processes underlying it in uninstructed, spontaneous conversations. We built up a multimodal neurolinguistic corpus composed of synchronized audio, video, and electrocorticographic (ECoG) recordings from the fronto-temporo-parietal cortex to address this phenomenon based on uninstructed, spontaneous speech production. We performed extensive linguistic annotations of the language material and calculated word complexity using several numeric parameters. We orthogonalized the (...) parameters with the help of a linear regression model. Then, we correlated the spectral components of neural activity with the individual linguistic parameters and with the residuals of the linear regression model, and compared the results. The proportional relation between the number of consonants and vowels, which was the most informative parameter with regard to the neural representation of word complexity, showed effects in two areas: the frontal one was at the junction of the premotor cortex, the prefrontal cortex, and Brodmann area 44. The postcentral one lay directly above the lateral sulcus and comprised the ventral central sulcus, the parietal operculum and the adjacent inferior parietal cortex. Beyond the physiological findings summarized here, our methods may be useful for those interested in ways of studying neural effects related to natural language production and in surmounting the intrinsic problem of collinearity between multiple features of spontaneously spoken material. The existence of child soldiers is a problem of the ages, and there are no positive signs that it is abating. The difference now is that, with the development of modern weapons technology, children can be involved in large scale and horrific acts during conflicts. The circumstances surrounding the use of children to wage war will vary from situation to situation. Yet, it has been suggested that many people seem to have a ‘single focussed’ view of what child soldiers look (...) like, what their motivations are, and why they are engaged in activities associated with conflict. This article reflects on the recent views expressed by Mark A. Drumbl, who argues that we should ‘reimagine’ child soldiers, and offers some further views as to how this issue should best be addressed. (shrink)

A human mission to Mars is technologically feasible, but hugely expensive requiring enormous financial and political commitments. A creative solution to this dilemma would be a one way human mission to Mars in place of the manned return mission that remains stuck on the drawing board. Our proposal would cut the costs several fold but ensure at the same time a continuous commitment to the exploration of Mars in particular and space in general. It would also obviate the need for (...) years of rehabilitation for returning astronauts, which would not be an issue if the astronauts were to remain in the low gravity environment of Mars. We envision that Mars exploration would begin and proceed for a long time on the basis of outbound journeys only. A mission to Mars could use some of the hardware that has been developed for the Moon program. One approach could be to send four astronauts initially, two on each of two space craft, each with a lander and sufficient supplies, to stake a single outpost on Mars. A one way human mission to Mars would not be a fixed duration project as in the Apollo program, but the first step in establishing a permanent human presence on the planet. The astronauts would be re supplied on a periodic basis from Earth with basic necessities, but otherwise would be expected to become increasingly proficient at harvesting and utilizing resources available on Mars. Eventually the outpost would reach self sufficiency, and then it could serve as a hub for a greatly expanded colonization program. There are many reasons why a human colony on Mars is a desirable goal, scientifically and politically. The strategy of one way missions brings this goal within technological and financial feasibility. Nevertheless, to attain it would require not only major international cooperation, but a return to the exploration spirit and risk taking ethos of the great period of Earth exploration, from Columbus to Amundsen, but which has nowadays being replaced with a culture of safety and political correctness.. BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. ZusammenfassungDer Begriff „Ethik“ wurde vor kurzem sowohl in die zahnmedizinische Musterberufsordnung 2014 als auch in den aktuellen „Nationalen Kompetenzbasierten Lernzielkatalog Zahnmedizin“ aufgenommen. Die hier vorgelegte Studie widmet sich der Frage, welche Bedeutung dies für die zahnmedizinische Profession und die Gesellschaft hat. Zu diesem Zweck werden die gesellschaftlichen Prozesse erörtert, die durch den autonom handhabbaren Handlungsspielraum der zahnmedizinischen Profession bedingt sind. Die sozialwissenschaftlichen Diskursfelder Profession, Vertrauen, Bildung, Expertise, Handlungspraxis und Sanktion werden hierzu in ihrer Anschlussfähigkeit zueinander und als struktureller Bedeutungsrahmen professionsethisch (...) reflektierten Handelns aufgearbeitet. Basis des professionellen Handlungsspielraums ist ein gesellschaftlicher Vertrauensvorschuss, der dem professionell Handelnden seitens der Gesellschaft und seitens des einzelnen Patienten entgegengebracht wird. Die Studie kommt zu dem Ergebnis, dass das jahrzehntelange Fehlen einer institutionell etablierten Vermittlung der ethischen Grundlagen des zahnmedizinischen Handelns ein schweres Versäumnis darstellt, da junge Zahnärzte nicht angeleitet werden, ihre fachliche Expertise in Bezug auf die zu lösenden Problemstellungen permanent zu reflektieren. Dieses Defizit ist nunmehr benannt worden. Eine institutionell getragene Struktur zur Bearbeitung ethischer Fragen im Rahmen der Zahnheilkunde ist hiernach zu fordern und sollte nunmehr dringend implementiert und umgesetzt werden. (shrink)

In recent years, supported by new scientific evidence, the conceptualization of cognitive reserve has been progressively enriched and now encompasses not only cognitive stimulating activities or educational level, but also lifestyle activities, such as leisure physical activity and socialization. In this context, there is increasing interest in understanding the role of psychological factors in brain health and cognitive functioning. In a previous study, we have found that these factors mediated the relationship between CR and self-reported cognitive functioning. In this study, (...) we have confirmed an association between two important constructs included in the psychological wellbeing and salutogenic models, “purpose in life” and “sense of coherence,” CR, as assessed using a questionnaire, and cognitive functioning, as evaluated using a comprehensive neuropsychological battery. Results from 888 middle-aged healthy participants from the Barcelona Brain Health Initiative indicate that both sense of coherence and CR were positively associated with verbal memory, reasoning and attention, working memory, and global cognition. Moreover, the relation between CR and cognitive functioning in the different domains is partially mediated by SoC. When we controlled for brain integrity, introducing into the model neurofilament light chain measures, the mediator role of SoC was confirmed for reasoning and attention and global cognition. However, purpose in life was not associated with cognitive functioning. These results reveal the central role of the SoC construct, which mediates the association between classic CR estimates and cognitive functions, potentially representing a modifiable target for interventions that aim to promote brain health. This introduction outlines the threefold contribution that this Focus section on research film offers. First, it introduces the vast collection of films from the former Institute for Scientific Film (Institut für den Wissenschaftlichen Film [IWF]), arguably the most ambitious endeavor ever undertaken to manage the distribution, production, and archiving of research films. At the same time, the institute’s questionable roots in the National Socialist education system and in war research are addressed. Second, the introduction points out that the Focus section (...) enters largely uncharted terrain in the history of research films. Third, it argues that a focus on the multiple reuses of research films, as this section attempts, not only suits the medium specificity of film but helps us to map the aesthetic, intermedial, and cultural-political practices of disseminating knowledge. In this vein, the organizers asked established scholars working on film and science to share with us a short story of a reused research film. Scott Curtis, Vinzenz Hediger, Anja Laukötter, and Hanna Rose Shell responded. Their contributions can be found in the supplementary materials to the online edition. (shrink)

Propositional dynamic logic (PDL) is one of the most successful variants of modal logic. To make it even more useful for applications, many extensions of PDL have been considered in the literature. A very natural and useful such extension is with negation of programs. Unfortunately, as long-known, reasoning with the resulting logic is undecidable. In this paper, we consider the extension of PDL with negation of atomic programs, only. We argue that this logic is still useful, e.g. in the context (...) of description logics, and prove that satisfiability is decidable and EXPTIME-complete using an approach based on Büchi tree automata. In 1933, the Prussian Academy of Sciences and Humanities was an exclusive learned society, out of touch with modern methods and funding, which had also failed to re-establish itself as a ‘centre of research’. During the Nazi regime, it was at best peripherally involved in the restructuring of German academia. While some of its members played a political role, the Academy itself retained its status as a learned society, even an academic club. Primary progressive multiple sclerosis (PPMS) shows a highly variable disease progression with poor prognosis and a characteristic accumulation of disabilities in patients. These hallmarks of PPMS make it difficult to diagnose and currently impossible to efficiently treat. This study aimed to identify plasma metabolite profiles that allow diagnosis of PPMS and its differentiation from the relapsing-remitting subtype (RRMS), primary neurodegenerative disease (Parkinson’s disease, PD), and healthy controls (HCs) and that significantly change during the disease course and could serve as surrogate (...) markers of multiple sclerosis (MS)-associated neurodegeneration over time. We applied untargeted high-resolution metabolomics to plasma samples to identify PPMS-specific signatures, validated our findings in independent sex- and age-matched PPMS and HC cohorts and built discriminatory models by partial least square discriminant analysis (PLS-DA). This signature was compared to sex- and age-matched RRMS patients, to patients with PD and HC. Finally, we investigated these metabolites in a longitudinal cohort of PPMS patients over a 24-month period. PLS-DA yielded predictive models for classification along with a set of 20 PPMS-specific informative metabolite markers. These metabolites suggest disease-specific alterations in glycerophospholipid and linoleic acid pathways. Notably, the glycerophospholipid LysoPC(20:0) significantly decreased during the observation period. These findings show potential for diagnosis and disease course monitoring, and might serve as biomarkers to assess treatment efficacy in future clinical trials for neuroprotective MS therapies. BackgroundNonverbal social perception is the ability to interpret the intentions and dispositions of others by evaluating cues such as facial expressions, body movements, and emotional prosody. Nonverbal social perception plays a key role in social cognition and is fundamental for successful social interactions. Patients with schizophrenia have severe impairments in nonverbal social perception leading to social isolation and withdrawal. Collectively, these aforementioned deficits affect patients’ quality of life. Here, we compare nonverbal social perception in patients with schizophrenia and controls and (...) examine how nonverbal social perception relates to daily functioning.MethodsWe compared nonverbal social perception in 41 stable outpatients with schizophrenia and 30 healthy controls using the Mini Profile of Nonverbal Sensitivity. The participants evaluated 64 video clips showing a female actor demonstrating various nonverbal social cues. Participants were asked to choose one of two options that best described the observed scenario. We correlated clinical ratings, Self-report of Negative Symptoms, and functional assessments with Mini-PONS scores.ResultsPatients performed significantly poorer in the Mini-PONS compared to controls, suggesting deficits in nonverbal social perception. These deficits were not associated with either positive symptoms or negative symptoms. However, impaired nonverbal social perception correlated with distinctive domains of BNSS, as well as functional capacity and functional outcome in patients.ConclusionWe demonstrate that nonverbal social perception is impaired in stable outpatients with schizophrenia. Nonverbal social perception is directly related to specific negative symptom domains, functional capacity and functional outcome. These findings underline the importance of nonverbal social perception for patients’ everyday life and call for novel therapeutic approaches to alleviate nonverbal social perception deficits. IntroductionThe prefrontal cortex plays a crucial role in cognition, particularly in executive functions. Cortical reactivity measured with Transcranial Magnetic Stimulation combined with Electroencephalography is altered in pathological conditions, and it may also be a marker of cognitive status in middle-aged adults. In this study, we investigated the associations between cognitive measures and TMS evoked EEG reactivity and explored whether the effects of this relationship were related to neurofilament light chain levels, a marker of neuroaxonal damage.MethodsFifty two healthy middle-aged adults from (...) the Barcelona Brain Health Initiative cohort underwent TMS-EEG, a comprehensive neuropsychological assessment, and a blood test for NfL levels. Global and Local Mean-Field Power, two measures of cortical reactivity, were quantified after left prefrontal cortex stimulation, and cognition was set as the outcome of the regression analysis. The left inferior parietal lobe was used as a control stimulation condition.ResultsLocal reactivity was significantly associated with working memory and reasoning only after L-PFC stimulation. No associations were found between NfL and cognition. These specific associations were independent of the status of neuroaxonal damage indexed by the NfL biomarker and remained after adjusting for age, biological sex, and education.ConclusionOur results demonstrate that TMS evoked EEG reactivity at the L-PFC, but not the L-IPL, is related to the cognitive status of middle-aged individuals and independent of NfL levels, and may become a valuable biomarker of frontal lobe-associated cognitive function.
