Document assembly and other substantive legal practice applications are the most knowledge-intense forms of software now widely available in the legal technology marketplace. This article provides an illustrative look at two contemporary practice system engines-CAPS and Scrivener-and examines their relevance for AI-and-law researchers.

This paper first conducts knowledge point association analysis on a large amount of data collected in practical applications. Data mining includes data collection, data preprocessing, actual mining, and result analysis, establishes knowledge point association rules table, and develops college English diagnostic practice system. Then, starting from the existing paper composition mode of the system, the knowledge point association rule table is introduced, and the knowledge point association relationship mining model is constructed using the association rule algorithm to explore the (...) potential influence relationship between different knowledge points that affect the improvement of learning quality. Finally, the data collected when the system is used is preprocessed, and the three dimensions of learning status evaluation, question-type association analysis, and college English score prediction are, respectively, modeled. Finally, after combining these submodels, a relatively complete and reliable diagnosis is obtained by evaluation model and related verification. (shrink)

In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. PurposeThe purpose of this paper is to explore a particular philosophical underpinning for Information Systems (IS) research – critical systemic thinking (CST). Drawing upon previous work, the authors highlight the principal features of CST within the tradition of critical research and attempt to relate it to trends in the Italian school of IS research in recent years, as exemplified by the work of Claudio Ciborra but also evident in work by, e.g. Resca, Jacucci and D'Atri.Design/methodology/approachThis is a conceptual paper (...) which explores CST, characterised by a focus on individual uniqueness, and socially‐constructed, individual worldviews as generators of human knowing.FindingsThe paper draws on work by Heinz Klein in which he elaborated three constitutive stages in critical research: interpretive, genealogical and constructive. The authors introduce a fourth, reflective stage and discuss five categories of critical research, reflecting different perspectives on emancipation, culminating in emergent expressionism, associated with Ciborra and the Italian school more generally.Research limitations/implicationsThis paper discusses approaches to CST and how they might have practical implications in IS development. The distinction between approaches founded in logical empiricism and those founded in hermeneutic dialectics are considered and the development of critical and systems strands are discussed.Practical implicationsThe paper addresses CST as an approach to development of information systems. Call a bit of scientific discourse a description of a missing system when (i) it has the surface appearance of an accurate description of an actual, concrete system (or kind of system) from the domain of inquiry, but (ii) there are no actual, concrete systems in the world around us fitting the description it contains, and (iii) that fact is recognised from the outset by competent practitioners of the scientific discipline in question. Scientific textbooks, classroom lectures, and journal articles (...) abound with such passages; and there is a widespread practice of talking and thinking as though there are systems which fit the descriptions they contain perfectly, despite the recognition that no actual, concrete systems do so—call this the face value practice. There are, furthermore, many instances in which philosophers engage in the face value practice whilst offering answers to epistemological and methodological questions about the sciences. Three questions, then: (1) How should we interpret descriptions of missing systems? (2) How should we make sense of the face value practice? (3) Is there a set of plausible answers to (1) and (2) which legitimates reliance on the face value practice in our philosophical work, and can support the weight of the accounts which are entangled with that practice? In this paper I address these questions by considering three answers to the first: that descriptions of missing systems are straightforward descriptions of abstract objects, that they are indirect descriptions of “property-containing” abstracta, and that they are (in a different way) indirect descriptions of mathematical structures. All three proposals are present in the literature, but I find them wanting. The result is to highlight the importance of developing a satisfactory understanding of descriptions of missing systems and the face value practice, to put pressure on philosophical accounts which rely on the practice, and to help us assess the viability of certain approaches to thinking about models, theory structure, and scientific representation. Rácz, Passmore, and Jordan explore hypotheses about such constraints from learning theories and social pressures, testing the impact of a community‐size driven learning bottleneck against the social coordination demands of different kinds of marriage and resource systems.

Agenda Relevance is the first volume in the authors' omnibus investigation of the logic of practical reasoning, under the collective title, A Practical Logic of Cognitive Systems. In this highly original approach, practical reasoning is identified as reasoning performed with comparatively few cognitive assets, including resources such as information, time and computational capacity. Unlike what is proposed in optimization models of human cognition, a practical reasoner lacks perfect information, boundless time and unconstrained access to computational complexity. The practical reasoner (...) is therefore obliged to be a cognitive economizer and to achieve his cognitive ends with considerable efficiency. Accordingly, the practical reasoner avails himself of various scarce-resource compensation strategies. He also possesses neurocognitive traits that abet him in his reasoning tasks. Prominent among these is the practical agent's striking (though not perfect) adeptness at evading irrelevant information and staying on task. On the approach taken here, irrelevancies are impediments to the attainment of cognitive ends. Thus, in its most basic sense, relevant information is cognitively helpful information. Information can then be said to be relevant for a practical reasoner to the extent that it advances or closes some cognitive agenda of his. The book explores this idea with a conceptual detail and nuance not seen the standard semantic, probabilistic and pragmatic approaches to relevance; but wherever possible, the authors seek to integrate alternative conceptions rather than reject them outright. A further attraction of the agenda-relevance approach is the extent to which its principal conceptual findings lend themselves to technically sophisticated re-expression in formal models that marshal the resources of time and action logics and label led deductive systems. Agenda Relevance is necessary reading for researchers in logic, belief dynamics, computer science, AI, psychology and neuroscience, linguistics, argumentation theory, and legal reasoning and forensic science, and will repay study by graduate students and senior undergraduates in these same fields. Organisations increasingly use automated decision-making systems (ADMS) to inform decisions that affect humans and their environment. While the use of ADMS can improve the accuracy and efficiency of decision-making processes, it is also coupled with ethical challenges. Unfortunately, the governance mechanisms currently used to oversee human decision-making often fail when applied to ADMS. In previous work, we proposed that ethics-based auditing (EBA)—that is, a structured process by which ADMS are assessed for consistency with relevant principles or norms—can (a) help (...) organisations verify claims about their ADMS and (b) provide decision-subjects with justifications for the outputs produced by ADMS. In this article, we outline the conditions under which EBA procedures can be feasible and effective in practice. First, we argue that EBA is best understood as a ‘soft’ yet ‘formal’ governance mechanism. This implies that the main responsibility of auditors should be to spark ethical deliberation at key intervention points throughout the software development process and ensure that there is sufficient documentation to respond to potential inquiries. Second, we frame AMDS as parts of larger sociotechnical systems to demonstrate that to be feasible and effective, EBA procedures must link to intervention points that span all levels of organisational governance and all phases of the software lifecycle. The main function of EBA should, therefore, be to inform, formalise, assess, and interlink existing governance structures. Finally, we discuss the policy implications of our findings. To support the emergence of feasible and effective EBA procedures, policymakers and regulators could provide standardised reporting formats, facilitate knowledge exchange, provide guidance on how to resolve normative tensions, and create an independent body to oversee EBA of ADMS. In the context of technology development and systems engineering, knowledge is typically treated as a complex information structure. In this view, knowledge can be stored in highly sophisticated data systems and processed by explicitly intelligent, software-based technologies. This paper argues that the current emphasis upon knowledge as information (or even data) is based upon a form of rationalism which is inappropriate for any comprehensive treatment of knowledge in the context of human-centred systems thinking. A human-centred perspective requires (...) us to treat knowledge in human terms. The paper sets out the particular importance of tacit knowledge in this regard. ABSTRACT Ethics is receiving increased emphasis in civil and environmental engineering. However, despite the proliferation of college textbooks and courses encouraging ethical reasoning, engineers in practice often limit their understanding narrowly to their individual actions. Broader issues of global importance are usually addressed in an ad-hoc manner, if at all. Our goal is to present the topic of ethics in a way that appeals to engineers, especially those receptive to ‘systems thinking’. Our broader motivation is to encourage the (...) development of educated, virtuous and caring professionals who engage in contextual ethical reasoning about complex systems. To these ends, we summarise relevant theoretical and applied concepts for ethical analysis, building from a recent chapter that reflects on ethics from an engineering systems perspective (but applied to the healthcare industry). We emphasise virtue ethics and the ethics of care as crucial supplements to duty ethics and utilitarianism. Analytical methods we discuss include Value Sensitive Design, Design for Care, and a multi-level classification of ethical issues into the micro (individual), meso (institutional), and macro (societal) levels. This work collects relevant considerations for designers of civil and environmental engineering systems and researchers interested in developing related design and analysis methods that include practical ethical reasoning. This narrative scoping review examines ethical practice in educational and school psychology from a bioecological systems’ perspective. A search of four databases yielded 34 articles in the final narrative synthesis. Informed by Bronfenbrenner and Morris’ bioecological systems theory, the ethical experiences of educational and school psychologists were analyzed using the concepts of Process, Person, Context and Time. The complexity, intensity and frequency of ethical dilemmas are reviewed in Process. The demand, resource, and force characteristics impacting on psychologists (...) as Person are reviewed. Within Context, studies identified dilemmas that arose for psychologists across systems. In Time, issues including implications of the Fourth Industrial Revolution on psychologists’ ethical practice with the emergence of Artificial Intelligence are examined. This paper demonstrates the synergies and the interrelated influences on psychologists’ ethical practices arising from a systematic review of their experiences and their professional training needs. Scholars and practitioners across domains are increasingly concerned with algorithmic transparency and opacity, interrogating the values and assumptions embedded in automated, black-boxed systems, particularly in user-generated content platforms. I report from an ethnography of infrastructure in Wikipedia to discuss an often understudied aspect of this topic: the local, contextual, learned expertise involved in participating in a highly automated social–technical environment. Today, the organizational culture of Wikipedia is deeply intertwined with various data-driven algorithmic systems, which Wikipedians rely on to (...) help manage and govern the “anyone can edit” encyclopedia at a massive scale. These bots, scripts, tools, plugins, and dashboards make Wikipedia more efficient for those who know how to work with them, but like all organizational culture, newcomers must learn them if they want to fully participate. I illustrate how cultural and organizational expertise is enacted around algorithmic agents by discussing two autoethnographic vignettes, which relate my personal experience as a veteran in Wikipedia. I present thick descriptions of how governance and gatekeeping practices are articulated through and in alignment with these automated infrastructures. Over the past 15 years, Wikipedian veterans and administrators have made specific decisions to support administrative and editorial workflows with automation in particular ways and not others. I use these cases of Wikipedia’s bot-supported bureaucracy to discuss several issues in the fields of critical algorithms studies; critical data studies; and fairness, accountability, and transparency in machine learning—most principally arguing that scholarship and practice must go beyond trying to “open up the black box” of such systems and also examine sociocultural processes like newcomer socialization. Social anxiety disorders (SAD) are among the most prevalent mental disorders (lifetime prevalence: 7–12%), with high impact on the life of an affected social system and its individual social system members. We developed a manualized disorder-specific integrative systemic and family therapy (ISFT) for SAD, and evaluated its feasibility in a pilot randomized controlled trial (RCT). The ISFT is inspired by Helm Stierlin’s concept of related individuation developed during the early 1980s, which has since continued to be refined. It integrates solution-focused (...) language, social network diagnostics, and genogram work, as well as resource- and problem orientation for both case conceptualization and therapy planning. Post-Milan symptom prescription to fluidize the presented symptoms is one of the core interventions in the ISFT. Theoretically, the IFST is grounded in radical constructivism and “Cybern-Ethics,” multi-directional partiality, and a both/and attitude toward a disorder-specific vs. non-disorder-specific therapy approach. SAD is understood from the viewpoint of social systems theory, especially in adaptation to a socio-psycho-biological explanatory model of social anxiety. In a prospective multicenter, assessor-blind pilot RCT, we included 38 clients with SAD (ICD F40.1; Liebowitz Social Anxiety Scale, LSAS-SR > 30): 18 patients participated in the ISFT, and 20 patients in Cognitive Behavioral Therapy (CBT; age:M = 36 years,SD = 14). Within-group, simple-effect intention-to-treat analyses showed significant reduction in social anxiety (LSAS-SR; ISFT:d = 1.67; CBT:d = 1.04), while intention-to-treat mixed-design ANOVA demonstrated the advantage of ISFT (d = 0.81). Per-protocol analyses supported these results. The remission rate based on blind diagnosticians’ ratings was good to satisfactory (Structured Clinical Interview, SCID; 78% in ST, 45% in CBT,p = 0.083); this has yet to be verified in a subsequent confirmatory RCT. The article will present the ISFT rationale and manual, including a special focus on multi-person settings, and the central findings from our pilot RCT. (shrink)

A multi-point temperature measurement system has been developed to measure temperature at different points simultaneously. This multi-channel system is designed specifically for measuring snow temperature at 28 different points In snow layers and this multi-point data is used in modeling of snow cover. The interfacing of such multi-channel system to Data acquisition system is one of the most critical design aspects, which affect (...) the overall performance of the system. The temperature sensor system and Data Acquisition System may be working satisfactorily when operated independently but total system integrity is absolutely important when these two sub-systems are interfaced together. Further operating conditions in snow causes many performance and reliability issues to be tackled through proper design. This paper discusses the design aspects involved in the interfacing of the multi-channel temperature measurement system with the Data Acquisition System specifically for Snow hydrological applications. Artificial intelligence (AI) systems are quickly gaining ground in healthcare and clinical decision-making. However, it is still unclear in what way AI can or should support decision-making that is based on incapacitated patients’ values and goals of care, which often requires input from clinicians and loved ones. Although the use of algorithms to predict patients’ most likely preferred treatment has been discussed in the medical ethics literature, no example has been realised in clinical practice. This is due, arguably, (...) to the lack of a structured approach to the epistemological, ethical and pragmatic challenges arising from the design and use of such algorithms. The present paper offers a new perspective on the problem by suggesting that preference predicting AIs be viewed as sociotechnical systems with distinctive life-cycles. We explore how both known and novel challenges map onto the different stages of development, highlighting interdisciplinary strategies for their resolution. (shrink)

In this article, network science is discussed from a methodological perspective, and two central theses are defended. The first is that network science exploits the very properties that make a system complex. Rather than using idealization techniques to strip those properties away, as is standard practice in other areas of science, network science brings them to the fore, and uses them to furnish new forms of explanation. The second thesis is that network representations are particularly helpful in explaining the (...) properties of non-decomposable systems. Where part-whole decomposition is not possible, network science provides a much-needed alternative method of compressing information about the behavior of complex systems, and does so without succumbing to problems associated with combinatorial explosion. The article concludes with a comparison between the uses of network representation analyzed in the main discussion, and an entirely distinct use of network representation that has recently been discussed in connection with mechanistic modeling. In this paper, I ask whether Francis Bacon constitutes a revealing exception to the modern predilection for ‘system.’ First, I consider evidence for reading Bacon as a philosopher strongly attracted toward the ideal of system. Second, I show how reflecting on Bacon’s philosophical practice can motivate an ‘anti- system‘ reading of his texts. In considering the small number of works in which Bacon explicitly discusses ‘system’ under that name (in particular, the Descriptio globi intellectualis), I clarify what is and (...) is not meant by ‘philosophical system’ as distinct from other ideas of system (e.g. ‘system of the heavens’). Third, I draw from the Temporis Masculus Partum and Novum Organum to argue that Bacon’s doctrine of the ‘idols of the mind’ amounts to a thoroughgoing critique of system in philosophy. Fourth, I show how and why Bacon deploys the aphoristic form in Novum Organum as an alternative to system. I conclude by suggesting some ways in which an ‘anti-system’ reading of Bacon has the power to enhance our appreciation of other early modern authors who write philosophy without pretensions to system. This article discusses the role of simplicity and the notion of a best balance of simplicity and strength within the best systems account (BSA) of laws of nature. The article explores whether there is anything in scientific practice that corresponds to the notion of simplicity or to the trade-off between simplicity and strength to which the BSA appeals. Research regarding the drivers of acceptance of clinical decision support systems by physicians is still rather limited. The literature that does exist, however, tends to focus on problems regarding the user-friendliness of CDSS. We have performed a thematic analysis of 24 interviews with physicians concerning specific clinical case vignettes, in order to explore their underlying opinions and attitudes regarding the introduction of CDSS in clinical practice, to allow a more in-depth analysis of factors underlying acceptance of CDSS. We (...) identified three general themes from the results. First, ‘the perceived role of the AI’, including items referring to the tasks that may properly be assigned to the CDSS according to the respondents. Second, ‘the perceived role of the physician’, referring to the aspects of clinical practice that were seen as being fundamentally ‘human’ or non-automatable. Third, ‘concerns regarding AI’, including items referring to more general issues that were raised by the respondents regarding the introduction of CDSS in general and/or in clinical medicine in particular. Apart from the overall concerns expressed by the respondents regarding user-friendliness, we will explain how our results indicate that our respondents were primarily occupied by distinguishing between parts of their job that should be automated and aspects that should be kept in human hands. We refer to this distinction as ‘the division of clinical labor.’ This division is not based on knowledge regarding AI or medicine, but rather on which parts of a physician’s job were seen by the respondents as being central to who they are as physicians and as human beings. Often the respondents’ view that certain core parts of their job ought to be shielded from automation was closely linked to claims concerning the uniqueness of medicine as a domain. Finally, although almost all respondents claimed that they highly value their final responsibility, a closer investigation of this concept suggests that their view of ‘final responsibility’ was not that demanding after all. What are the metaphysical commitments which best 'make sense' of our scientific practice? In this book, Andreas Hüttemann provides a minimal metaphysics for scientific practice, i.e. a metaphysics that refrains from postulating any structure that is explanatorily irrelevant. Hüttemann closely analyses paradigmatic aspects of scientific practice, such as prediction, explanation and manipulation, to consider the questions whether and what metaphysical presuppositions best account for these practices. He looks at the role which scientific generalisation play in predicting, testing, (...) and explaining the behaviour of systems. He also develops a theory of causation in terms of quasi-inertial processes and interfering factors, and he proposes an account of reductive practices that makes minimal metaphysical assumptions. His book will be valuable for scholars and advanced students working in both philosophy of science and metaphysics. (shrink)

J.G. Fichte’s 1798 System of Ethics is seldom read, despite the fact that it remains, after more than two centuries, one of the most original and insightful efforts at a systematic normative ethical theory on Kantian foundations. Part of the reason for its obscurity lies in the perceived implausibility of Fichte’s account of practical deliberation and of the authority of individual conscience. The view typically attributed to Fichte is a conjunction of four claims: that moral deliberation consists entirely in consultation (...) of one’s conscience; that conscience is a faculty that gives immediate epistemic access to substantive moral truths; that conformity with the verdict of conscience is the sole criterion of the moral worth of actions; and that an individual’s conscientious decision is therefore morally incorrigible. This set of views is indeed implausible; but Fichte in fact held none of them. Hegel was the first to attribute them to him and, incredibly, Hegel’s has remained for 200 years the dominant interpretation, even among scholars of Fichte. In this paper I explain how Fichte actually thought about practical deliberation and the role of conscience, and diagnose the sources of appeal of the Hegelian interpretation. (shrink)

BackgroundProfessional ethics refers to the use of logical and consistent communication, knowledge, clinical skills, emotions and values in nursing practice. This study aimed to explore and describe factors that affect professional ethics in nursing practice in Iran.MethodsThis qualitative study was conducted using conventional content analysis approach. Thirty nurses with at least 5 years of experience participated in the study; they were selected using purposive sampling. Data were collected through semi-structured interviews and analyzed using thematic analysis.ResultsAfter encoding and classifying (...) the data, five major categories were identified: individual character and responsibility, communication challenges, organizational preconditions, support systems, educational and cultural development.ConclusionsAwareness of professional ethics and its contributing factors could help nurses and healthcare professionals provide better services for patients. In the present context of intertwined and intensifying economic, environmental and climate challenges and crisis, we need to enlarge our thinking about food systems change. One way to do so is by considering intersections between our longstanding interdisciplinary interest in food and agriculture and new scholarship and practice centered on transitions to sustainability. The general idea of transition references change in a wide range of fields and contexts, and has gained prominence most recently as a way to discuss (...) and address sustainability challenges. To explore connections to food systems change, I highlight two broad approaches in the sustainability transitions research field. First is a multi-level perspective that examines sustainability innovation pathways and second is a social practices approach that illuminates the possibilities for shifts in normal everyday routines and practices. Taken together, these approaches offer different and useful ways to think about the dynamics, durability and significance of innovations in food and agriculture, and the part they play in transitions to sustainability. Numerous opportunities exist to forge more productive links between work on food systems change and the broad and growing sustainability transitions field. First, our research and practice insights about the importance of politics, governance, values and ethics in food and agriculture could help to strengthen the sustainability transitions field, which initially underplayed such questions. Second, the sustainability transitions field’s implicit systems sensibility and its futures orientation could help to widen the scope of inquiry and the contribution to policy and planning of research and practice on food systems change. Here, for the first time, development studies encounters the set of ideas popularly known as 'Chaos Theory'. Samir Rihani applies to the processes of economic development, ideas from complex adaptive systems like uncertainty, complexity, and unpredictability. Rihani examines various aspects of the development process - including the World Bank, debt, and the struggle against poverty - and demonstrates the limitations of fundamentally linear thinking in an essentially non-linear world.

The use of rights based arguments to justify claims that donor offspring should have access to information identifying their gamete donor has become increasingly widespread. In this paper, I do not intend to revisit the debate about the validity of such rights. Rather, the purpose is to examine the way that such alleged rights have been implemented by those legislatures that have allowed access to identifying information. I will argue that serious inconsistencies exist between the claim that donor offspring have (...) a right to know the identity of their gamete donor and the way such a right is currently met in practice. I hope to show that in systems where non‐anonymous donation is practised, an understanding of the proclaimed right of donor offspring to know their genetic identity is one composed of two different rights – the right to know the circumstances of their conception and the right to information identifying the gamete donor – can provide important insights into this important area of public policy. Definition of the problemQuality of care also includes a professional approach to ethical challenges. This involves the moral interpretation of an issue and the management of intra- and interpersonal reflection processes. Combining both is the central task of clinical ethics consultation (CEC). The main methods such as clarification of mandates and handling complexity are presented, and their impact on dealing with ethical challenges is shown through the discussion of two cases.ConclusionThe paper provides insight into systems thinking. It discusses the influence that systemic tools have on dealing with typical challenges within clinical ethics counselling. It also shows how specific counselling methods impact a normative level. The neuropsychology of religious activity in normal and selected clinical populations is reviewed. Religious activity includes beliefs, experiences, and practice. Neuropsychological and functional imaging findings, many of which have derived from studies of experienced meditators, point to a ventral cortical axis for religious behavior, involving primarily the ventromedial temporal and frontal regions. Neuropharmacological studies generally point to dopaminergic activation as the leading neurochemical feature associated with religious activity. The ventral dopaminergic pathways involved in religious behavior most closely align with (...) the action-extrapersonal system in the model of 3-D perceptual–motor interactions proposed by Previc . These pathways are biased toward distant space and also mediate related extrapersonally dominated brain functions such as dreaming and hallucinations. Hyperreligiosity is a major feature of mania, obsessive-compulsive disorder, schizophrenia, temporal-lobe epilepsy and related disorders, in which the ventromedial dopaminergic systems are highly activated and exaggerated attentional or goal-directed behavior toward extrapersonal space occurs. In their contribution ‘Ethics of the algorithmic prediction of goal of care preferences’1 Ferrario et al elaborate a from theory to practice contribution concerning the realisation of artificial intelligence (AI)-based patient preference prediction (PPP) systems. Such systems are intended to help find the treatment that the patient would have chosen in clinical situations—especially in the intensive care or emergency units—where the patient is no longer capable of making that decision herself. The authors identify several challenges that complicate (...) their effective development, application and evaluation—and offer solutions to them. One of these issues is the question of who should ultimately use said systems. While it is undisputed that clinicians should use these AI systems for their decision-making process, there is an ongoing debate about whether next of kin should use them as well. The authors advocate that ‘’access should be provided to both clinicians and loved ones with due explanations and as desired’. We will disagree with this assessment and explain in our commentary why it is important that surrogates provide their own assessments with as little external (AI) influence as possible. This article discusses ‘Notes on Language Games’, written by Harold Garfinkel in 1960 and never before published, one of three distinct versions of his famous ‘Trust’ argument, i.e., that constitutive criteria define shared events, objects, and meanings. The argument stands in contrast to an approach to cultural anthropology that was becoming popular in 1960 called ‘ethnoscience’. In this previously unknown manuscript, Garfinkel proposes that cultural events and language events are the same, in that both are created through constitutive commitments to (...) interactional systems. The best-known version of the Trust argument (Garfinkel, 1963) emphasizes Schutz, while other versions build on Parsons (Garfinkel 2019). In this third version, the Trust conditions are elaborated in terms of Wittgenstein’s language games. Various strands of Garfinkel’s thinking about culture, language and interaction are interwoven. That Garfinkel was working with Parsons in 1960 to document a contractual basis for social events and their assembly practices in ‘systems of interaction’, a constitutive practice argument with roots in Durkheim’s work, is yet another strand. The article highlights how the Trust argument is the key to everything, not only ethnomethodology, but also Garfinkel’s attempt to develop a general sociology of culture, language and interaction. In recent years there has been a boom in the study of the Yi Jing (the Book of Changes) and ancient Chinese forms of physical exercise in European countries such as Germany, Belgium and France, with research themes focusing on psychotherapeutic and medical clinical experimental studies, such as a study conducted at the Institute of Psychology at the University of Tübingen in Germany that emphasised that moderate general physiological activation, exercise-dependent regulation of the heart rhythm ANS can induce a typical (...) state of calm to regulate Qi. There are few theoretical studies on the metaphysical aspects of the existence of such healthful and beneficial underlying psychophysiological mechanisms of mind-body exercise Florens（2021）, so this paper chooses to use the practice of Qi as a case study, where Qi practice refers to the classical and systematic use in Chinese martial arts’ internal styles and systems such as Taijiquan (Taichi), Qigong and shaolinquan(Shaolin Boxing). A primarily documentary research approach is adopted, this paper using classical theories from the Yi Jing to analyse a metaphysical analysis of the physical exercises associated with Qi. The conclusions of the study show that: Firstly, Chinese traditional methods and practical experience can be drawn upon. Secondly, the classical theory of the Yi Jing, which uses Qi as the core of practice, enriches the ontology of human life perception in the field of philosophy. Thirdly, the ultimate pursuit of life through the practice of Qi is a concrete manifestation of the metaphysical holistic view of life in traditional Chinese physical exercises. (shrink)

As concern over the use of questionable research practices in academic science has increased over the last couple of decades, some reforms have been implemented and many others have been debated and recommended. While many of these proposals have merit, efforts to improve scientific practices are more likely to succeed when they are responsive to the prevailing views and concerns of scientists themselves. To date, there have been few efforts to solicit wide-ranging input from researchers on the topic of needed (...) reforms. This article is a qualitative report of responses from federally funded scientists to the question of what should be done to address the problem of QRPs in their disciplines. Overall, participants were concerned about how institutional and career-oriented incentives encourage the use of QRPs. Compared to previous recommendations, participants had surprisingly little confidence in the ability of ethics training to improve research integrity. (shrink)

IntroductionAcademic integrity policy that is inaccessible, ambiguous or confusing is likely to result in inconsistent policy enactment. Additionally, policy analysis and development are often undertaken as top down processes requiring passive acceptance by users of policy that has been developed outside the context in which it is enacted. Both these factors can result in poor policy uptake, particularly where policy users are overworked, intellectually critical and capable, not prone to passive acceptance and hold valuable grass roots intelligence about policy enactment.Case (...) descriptionThe case study presented in this paper describes the actions of a community of practice at a regional Australian university to deconstruct and translate ambiguous academic integrity policy into a suite of accessible academic integrity resources that were intelligible to staff and students, and which assisted academic staff to consistently enact policy. The paper narrates the formation of the CoP, the tangible and intangible value it created, the social learning practices enacted by its members, its grassroots policy work and the material resources produced from that work.Discussion and evaluationAn evaluation of the CoP was conducted using a value creation framework to explore its immediate value, potential value, applied value, realised value, and reframing value. These values were considered at each stages of the CoP’s lifespan. The evaluation was a useful process that demonstrated the wide-ranging value created by the CoP. Six insights were drawn from the evaluation which promote understanding of the value created for a university by a CoP, particularly in contributing to academic integrity culture over a sustained period of time.ConclusionsThis paper contributes to a research gap on specific examples of discretion within rule-based systems. It illustrates how academics and members of the CoP used their discretion to interpret and enact academic integrity policy within a higher education setting. Drawing from the evaluation of the CoP we argue for greater understanding of the grass-roots contribution of academic and professional staff to academic integrity policy translation and enactment. The Humean best systems account identifies laws of nature with the regularities in a system of truths that, as a whole, best conforms to scientific standards for theory-choice. A principled problem for the BSA is that it returns the wrong verdicts about laws in cases where multiple systems, containing different regularities, satisfy these standards equally well. This problem affects every version of the BSA because it arises regardless of which standards for theory-choice Humeans adopt. In this paper, we (...) propose a Humean response to the problem. The study investigated influence of cultural values and home on child-rearing practices in Nigeria. Value systems are embedded in the culture of people. Culture is a set of shared values, attributes, customs and physical objects that are maintained by people in a specific setting. Cross-sectional design and qualitative technique was employed to obtain information from participants. Participants were sixteen adults (8 men, 8 women) from four ethnic groups: Igbo, Ogoni, Tiv and Yala. Findings showed that different cultures have their (...) value systems and these values were inculcated to generations of the members through child-rearing practices. At the age of 5 years, each culture initiates the young ones into her way of life, such as the behavioural pattern expected of the child at the home or farm. Yala Queen dancing/greeting pattern, Ogonis and her yaa/koo rites of passage into adulthood; Tivs and the sacredness of her land; Igbos and their importance of kolanut. These values are transmitted to generations of human beings through child-rearing practices. The home is the miniature society which nurtures value system. (shrink)

The paper presents a novel method for the verification of security protocols’ time properties. The new method uses a translation to satisfiability modulo theories problem. In our approach, we model protocol users’ behaviours using networks of synchronized timed automata. Suitably specified correctness properties are defined as a reachability property of some chosen states in an automata network. Then, the network of timed automata and the property are translated to an SMT problem and checked using an SMT-solver and a BMC algorithm. (...) We consider the most important time properties of protocol executions using specially constructed time conditions. The new method was also implemented and experimentally evaluated for six well-known SPs. We also compared our new SMT-based technique with the corresponding SAT-based approach. (shrink)

One striking feature of the contemporary modelling practice is its interdisciplinary nature. The same equation forms, and mathematical and computational methods, are used across different disciplines, as well as within the same discipline. Are there, then, differences between intra- and interdisciplinary transfer, and can the comparison between the two provide more insight on the challenges of interdisciplinary theoretical work? We will study the development and various uses of the Ising model within physics, contrasting them to its applications to socio-economic (...) systems. While the renormalization group methods justify the transfer of the Ising model within physics – by ascribing them to the same universality class – its application to socio-economic phenomena has no such theoretical grounding. As a result, the insights gained by modelling socio-economic phenomena by the Ising model may remain limited. (shrink)

This study aims to look at the role of the practice of excellence strategies in education in achieving sustainable competitive advantage for the Higher educational institutions of the faculty of Engineering and Information Technology at Al-Azhar University in Gaza, a model, and the study considered the competitive advantage of educational institutions stems from the impact on the level of each student, employee, and the institution. The study was based on the premise that the development of strategies for excellence in (...) education, and its implementation is a vital important prerequisite to achieve sustainable competitive advantage in higher educational institutions. The study followed a systematic exploratory descriptive methodology through review of the theoretical literature, and the adoption of the experience of the Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as a model for its unique experience in the field of excellence in education. The study results showed that the most important are: There is a strong correlation between the level of exercising excellence strategies in education and the achievement of higher educational institutions to the sustainable competitive advantage. The results include a general required number of important sub results on the subject of the model - Faculty of Engineering and Information Technology at Al-Azhar University in Gaza as follows: - The student considered the academic focus of the operation in the development process of the workers’ skills, particularly academics at the university helps to distinguish students and increase the employment rate after graduation. - The existence of consistency in development efforts and quality improvement for all three levels (student, employee, and the university), and this contributes to the Faculty excellence. - The Faculty has been able to achieve competitive advantages by offering excellent services without harming the efficiency, and this alone is a great success because improving service properties requires great investments, which negatively affect the continued institutional development. The study also reached a set of recommendations as follows: - The need to exercise excellence strategies in education, excellence reward at the national level, and those higher educational institutions follow the criteria for measuring the competitive advantages of its institutions always. - There is a need to increase efforts to implement programs of excellence, the allocation of adequate time, reward outstanding efforts as well. There is a necessity for each faculty to achieve competitive advantage and sustainability, using the general philosophies of competitive advantage, but with a different strategically content from what is in the private commercial sector, it reflects the Faculties mission and objectives, depending on making improvements and excellence in processes that ensure the safety of its outputs. As well as the need to find a balance between the work of teaching and research work of the faculty members, this has important implications regarding the criteria used in the process of excellence evaluation. The study recommended the adoption of strategies for excellence in education on a national public policy level mainly in the processes of change in higher education institutions. The need to support the existence of a common understanding of the efforts of excellence to create a general culture that appreciates excellence in faculties and universities. This underlines the need for transparent, fair rewards systems, to encourage innovation in education. The need to conduct a comprehensive surveys on the graduates of faculties and universities including the areas of employment and skills, because that will give accurate indications of the graduates and will help to establish a link to a more precise about the relationship of excellence strategies with the competitive advantages. The domain of nonlinear dynamical systems and its mathematical underpinnings has been developing exponentially for a century, the last 35 years seeing an outpouring of new ideas and applications and a concomitant confluence with ideas of complex systems and their applications from irreversible thermodynamics.
