This chapter examines historical reconstruction and literary structures of rabbinic texts using the Leviticus Rabbah as an example. It explains that Leviticus Rabbah is a commentary on the Book of Leviticus which now forms part of Midrash Rabbah. It proposes ten theses about the special problems which the literary structures of rabbinic texts pose for the historian and analyses a section of the amoraic work of Leviticus Rabbah to describe some of those literary structures. The findings suggest that it is (...) impossible to explain how the textuality of rabbinic sources worked and that many rabbinic works fill the same functional position in a text more than once. The potential of the soil to hold plant nutrients is governed by the cation-exchange capacity of any soil. Estimating soil CEC aids in conventional soil management practices to replenish the soil solution that supports plant growth. In this study, a multiple model integration scheme supervised with a hybrid genetic algorithm-neural network was developed and employed to predict the accuracy of soil CEC in Tabriz plain, an arid region of Iran. The standalone models and extreme learning machine ) were implemented for (...) incorporation into the MM-GANN. In addition, it was tested to enhance the prediction accuracy of the standalone models. The soil parameters such as clay, silt, pH, carbonate calcium equivalent, and soil organic matter were used as model inputs to predict soil CEC. With the use of several evaluation criteria, the results showed that the MM-GANN model involving the predictions of ELM and ANN models calibrated by considering all the soil parameters as inputs provided superior soil CEC estimates with a Nash Sutcliffe Efficiency = 0.87, Root Mean Square Error = 2.885, Mean Absolute Error = 2.249, Mean Absolute Percentage Error = 12.072, and coefficient of determination = 0.884. The proposed MM-GANN model is a reliable intelligence-based approach for the assessment of soil quality parameters intended for sustainability and management prospects. (shrink)

The same-order representation theory of consciousness holds that conscious mental states represent both the world and themselves. This complex representational structure is posited in part to avoid a powerful objection to the more traditional higher-order representation theory of consciousness. The objection contends that the higher-order theory fails to account for the intimate relationship that holds between conscious states and our awareness of them--the theory 'divides the phenomenal labor' in an illicit fashion. This 'failure of intimacy' is exposed by the possibility (...) of misrepresentation by higher-order states. In this paper, I argue that despite appearances, the same-order theory fails to avoid the objection, and thus also has troubles with intimacy. (shrink)

This paper develops a criterion for sameness of Fregean senses. I consider three criteria: logical equivalence, intensional isomorphism, and epistemic equipollence. I reject the first two and argue for a version of the third.

In this book, which thoroughly revises and greatly expands his classic work Sameness and Substance, David Wiggins retrieves and refurbishes in the light of twentieth-century logic and logical theory certain conceptions of identity, of substance and of persistence through change that philosophy inherits from its past. In this new version, he vindicates the absoluteness, necessity, determinateness and all or nothing character of identity against rival conceptions. He defends a form of essentialism that he calls individuative essentialism, and then a (...) form of realism that he calls conceptualist realism. In a final chapter he advocates a human being-based conception of the identity and individuation of persons, arguing that any satisfactory account of personal memory must make reference to the life of the rememberer himself. In this paper I examine the concept of cross-temporal personal identity (diachronicity). This particular form of identity has vexed theorists for centuries -- e.g.,how can a person maintain a belief in the sameness of self over time in the face of continual psychological and physical change? I first discuss various forms of the sameness relation and the criteria that justify their application. I then examine philosophical and psychological treatments of personal diachronicity(for example,Locke's psychological connectedness theory; the role of (...) episodic memory) and find each lacking on logical grounds, empirical grounds, or both. I conclude that to achieve a successful resolution of the issue of the self as a temporal continuant we need to draw a sharp distinction between the feeling of the sameness of one's self and the evidence marshaled in support of that feeling. This book provides a philosophical examination of the extent to which legalizing same-sex marriage can contribute to ending the discrimination and social stigma faced by LGBT men and women in the Western world.

The axiom of extensionality of set theory states that any two classes that have identical members are identical. Yet the class of persons age i at time t and the class of persons age i + 1 at t + l, both including same persons, possess different demographic attributes, and thus appear to be two different classes. The contradiction could be resolved by making a clear distinction between age groups and cohorts. Cohort is a multitude of individuals, which is constituted (...) within a time interval, and endures throughout part of the time continuum. Age group, on the other hand, is only a reference term to which empirical measurement relates, as in birth or death rates. Accordingly, the two concepts, age group i at t, and age group i + 1 at t + 1, are different. The standard population growth model of Leslie and Lotka, however, does not support such a distinction in age groups. An alternative model, proposed recently, implies precisely such a distinction. Feminist analyses address the way differences between the sexes are conceptualized and operationalized in society. In this paper, I discuss how violence by men and women is conceptualized as different in the psychological scientific discourses of forensic mental health. I suggest that these empirical discourses perpetuate assumptions of difference and discourage examination of similarities. Specifically, I will argue that neutralization techniques are frequently used that reduce women’s agency and responsibility for violence compared to their male counterparts, and compared to nonoffending (...) women. I discuss the implications for violence research and interventions for violence perpetrators. (shrink)

Some argue that same-sex marriage is not an equal rights issue because, where same-sex marriage is illegal, heterosexuals and homosexuals have the exact same right to marry—i.e., the right to marry one adult of the opposite sex. I dispute this argument by pointing out that while societies that prohibit same-sex marriage equally permit individual heterosexuals and homosexuals to marry one adult of the opposite sex, same-sex couples in such societies are denied an important right that opposite-sex couples enjoy—i.e., the right (...) to marry. I argue that the right to marry is fundamentally, not an individual right, but a couple’s collective right, analogous to assembly rights. (shrink)

Polls and election results show Americans sharply divided on same-sex marriage, and the controversy is unlikely to subside anytime soon. Debating Same-Sex Marriage provides an indispensable roadmap to the ongoing debate.

The Progressive favors extending the legal institution of marriage so as to include same-sex unions along with heterosexual ones. The Traditionalist opposes such an extension, preferring to retain the legal institution of marriage in its present form. I argue that the Progressive ought to broaden her position, endorsing instead the Liberal case for extending the current institution so as to include polygamous unions as well—for any consideration favoring Progressivism over Traditionalism likewise favors Liberalism over Progressivism. Progressives inclined to resist Liberalism (...) are invited to consider an alternative position: the Libertarian stance that favors instead the ‘disestablishment’ of marriage. (shrink)

Here I propose a coherent way of preserving the identity of material objects with the matter that constitutes them. The presentation is formal, and intended for RSL. An informal presentation is in preliminary draft! -/- Relative-sameness relations—such as being the same person as—are like David Lewis's "counterpart" relations in the following respects: (i) they may hold between objects that aren't identical (I propose), and (ii) there are a multiplicity of them, different ones of which may be variously invoked in (...) different contexts. They differ from counterpart relations, however, in that they are weak equivalence relations (transitive, symmetric and weakly reflexive). The likenesses to counterpart relations make them suitable for an analysis of de-re temporal and modal predications. The difference renders the resulting counterpart theory immune to standard criticisms of Lewis's Counterpart Theory (e.g., in Hazen 1979, and Fara and Williamson 2005). (shrink)

Here I present an analysis of what it is for an x and a y to be the same F. Unlike the Fregean Analysis (FRE), according to which ‘x is the same F as y’ is equivalent to ‘x is an F, y is an F, and x = y’, the analysis presented and defended here allows that there are possible cases in which x and y are the same F1 but not the same F2 even though x is an (...) F2 and y is an F2. The analysis offered here, FRE+, retains the conditions that FRE deems are necessary for being the same F while adding a further condition to allow that the same F1 can be a different F2. Although FRE+ is compatible with there being such cases, FRE+ shares with FRE that the identity mentioned in the analysis is nothing other than absolute identity. Thus, FRE+ offers a way to allow that the same F1 can be a different F2 while avoiding conflict with the traditionally accepted logic of identity, and I argue without conflict with the Indiscernibility of Identicals in particular. In this paper, we argue that same is fundamentally different from different, in that same imposes a discourse condition on eventualities, while different compares individuals. This difference has not been noted in previous literature. Furthermore, in the literature on same, there has been a persistent puzzle about the contribution of the definite article with which same must co-occur. We show that this puzzle is resolved once the contribution of same is adjusted to apply to eventualities: then the definite article can (...) be interpreted in the usual way, as generating a presupposition about individuals. One of the promising approaches to the problem of consciousness has been the Higher-Order Monitoring Theory of Consciousness. According to the Higher-Order Monitoring Theory, a mental state M of a subject S is conscious iff S has another mental state, M*, such that M* is an appropriate representation of M. Recently, several philosophers have developed a Higher-Order Monitoring theory with a twist. The twist is that M and M* are construed as entertaining some kind of constitutive relation, rather than being (...) logically independent of each other. We may call this the Same-Order Monitoring Theory of Consciousness. In this paper, I discuss the nature of the Same-Order Monitoring Theory and argue for its superiority over the more traditional Higher-Order Monitoring Theory. (shrink)

Sameness and alterity: Alterity as the hope of education. – The contribution introduces questions that originate from the very nature of the dynamics of education, where change happens. In the dynamics of education, what is ‘identical’, is formed in the environment of the other; it also creates a new form, which, compared to the original form, is different/dissimilar. At the same time, what is ‘identical’, maintains the core, out of which each of the other forms are formed. As an (...) intentional human activity, education should reflect the relations between ‘same’ and ‘other’. This means, above all, enquiring about their origins and purpose as well as reflecting upon their raison d’être. Following such a reflection, the otherness of the environment, in which education takes place, can become both a challenge and hope for education. (shrink)

The first section provides the standard understanding of the concept of ‘đồng bào’ (hereinafter ‘đồng bào’). This understanding is widely shared by the Vietnamese populace for it to stand robustly and independently from any controversies. Then, implications of ‘đồng bào’ for two areas of bioethics—transplantation and ethics in crises—are provided. Finally, ‘đồng bào’ shall be developed for the purpose of global health. In English, ‘fellow citizens’ or ‘compatriots’ are the terms used to describe people of the same ‘community’. ‘Compatriots’ defines (...) the ‘community’ by virtue of soil (its etymology has the Latin term ‘patria’—‘fatherland’). ‘Fellow citizens’ defines the ‘community’ in terms of citizenship and links to the concepts of ‘polis’ or ‘state’. ‘Đồng bào’ is a Vietnamese word conveying the notion of ‘people of the same ‘community’ which occupies a decent position in the Vietnamese public-politic life.1 Though ‘đồng bào’ in Vietnamese is generally considered comparable to, translatable into and has been translated into ‘compatriots’ and ‘fellow citizens’, ‘đồng bào’ neither delineates the ‘community’ in terms of ‘soil’ or ‘citizenship’. ‘Đồng bào’ literally means ‘from the same fetus’ (‘bào’ is ‘bào thai’—fetus). ‘Đồng bào’s’ original metaphorical meaning derives from the Âu Cơ creation myth. The Vietnamese Âu Cơ myth stands out from certain other creation myths because, according to it, people are considered not only to have the same mother but to ‘have been conceived and born simultaneously from one fetus’ as opposed to ‘were born from the same womb’ as in certain other creation myths. People are not only siblings of each other. Rather, people share bones, flesh, blood and a bond forged in the common destiny …. (shrink)

Homology is a biological sameness relation that is purported to hold in the face of changes in form, composition, and function. In spite of the centrality and importance of homology, there is no consensus on how we should understand this concept. The two leading views of homology, the genealogical and developmental accounts, have significant shortcomings. We propose a new account, the hierarchical-dependency account of homology, which avoids these shortcomings. Furthermore, our account provides for continuity between special, general, and serial (...) homology. (shrink)

I formulate an apparent inconsistency between some claims Aristotle makes in his Metaphysics about the sameness and non-sameness relations which obtain between an object and its essence: while a object is not the same as its essence, an essence is thought as being the same as its essence. I discuss different ways in which one may propose to overcome this apparent inconsistency and show that they are problematic. My diagnosis of the problem is that all these putative solutions (...) share the assumption that Aristotle is operating exclusively with the notion of strict numerical identity between an object and its essence, or between definiendum and definiens. I introduce the notion of sameness in nature which holds between an object and its essence, understood as the metaphysical counterpart to the relation of 'being defined as': two items are the same in nature just in case the answer to the 'what is it?' or 'what is its nature/essence?' question is common to both. I argue that the notions of sameness in nature and 'being defined as' need not entail strict identity. Further, they are compatible with, indeed require, the idea that an essence is prior to its essence-bearer, or that a definiens is prior to the relevant definiendum. I conclude that the twin notions of sameness in nature and 'being defined as' successfully defuse the apparent inconsistency formulated at the outset. (shrink)

The kinds of real or natural kinds that support explanation and prediction in the social sciences are difficult to identify and track because they change through time, intersect with one another, and they do not always exhibit their properties when one encounters them. As a result, conceptual practices directed at these kinds will often refer in ways that are partial, equivocal, or redundant. To improve this epistemic situation, it is important to employ open-ended classificatory concepts, to understand when different research (...) programs are tracking the same real kind, and to maintain an ongoing commitment to interact causally with real kinds to focus reference on those kinds. A tempting view of these non-idealized epistemic conditions should be avoided: that they signal an ontological structure of the social world so plentiful that it would permit ameliorated classificatory schemes to achieve their normative aims regardless of whether they defer to real-kind classificatory schemes. To ground these discussions, the essay appeals to an overlooked convergence in the systematic naturalistic frameworks of Richard Boyd and Ruth Millikan. (shrink)

A response to James S. Spiegel's article in THINK 43 in which he argues that same-sex marriage is unjust.

When are two tokens of a name tokens of the same name? According to this paper, the answer is a matter of the historical connections between the tokens. For each name, there is a unique originating event, and subsequent tokens are tokens of that name only if they derive in an appropriate way from that originating event. The conditions for a token being a token of a given name are distinct from the conditions for preservation of the reference of a (...) name. Hence a name may change its reference. Defending the theory requires considerations about the identity of acts, and about empty names and disagreement. The upshot is a causal theory of the identity of names, but not what would normally be counted as a causal theory of the reference of names. Although reference is often transmitted causally, what determines semantic reference is conventionalized speaker-reference. (shrink)

The purpose of the current paper is to introduce the theoretical arguments of optimal distinctiveness literature in studying the relationship between CEO narcissism and corporate social responsibility. We focus on CSR scope conformity and CSR emphasis differentiation and introduce CEO narcissism as an important determinant of the extent to which the firm responds to these two types of strategic pressures. Our analysis is based on a sample of 509 firm-year observations over the 2006–2013 period. Fixed effects regression technique is used (...) to test our hypotheses. Our findings provide evidence that CEO narcissism is negatively related to CSR conformity and positively related to CSR differentiation strategies. We also find evidence that firm prior performance will moderate the relationship between CEO narcissism and CSR conformity but not CSR differentiation. (shrink)

However liberalism is best understood, liberals typically seek to defend a wide range of liberty. Since same-sex marriage [henceforth: SSM] prohibitions limit the liberty of citizens, there is at least some reason to suppose that they are inconsistent with liberal commitments. But some have argued that it is the recognition of SSM—not its prohibition—that conflicts with liberalism’s commitments. I refer to the thesis that recognition of SSM is illiberal as “The Charge.” As a sympathetic liberal, I take The Charge seriously (...) enough to consider and ultimately reject it. Ultimately, I contend that The Charge is simply misguided and that arguments for it either fail to find support in some liberal principle or else find support from some illiberal principle. (shrink)

What is the relationship between the epistemic norms of assertion and the epistemic norms of action/practical reasoning? Brown argues that the standards for practical reasoning and assertion are distinct (Brown 2012). In contrast, Montminy argues that practical reasoning and assertion must be governed by the same norm (Montminy 2012). Likewise, McKinnon has articulated an argument for a unified account from cases of isolated second-hand knowledge (McKinnon 2012). To clarify the issue, I articulate a distinction between Equivalence Commonality and Structural Commonality. (...) I then argue against the former by counterexamples that doubly dissociate the standards for assertion and action. Furthermore, I argue that such a double dissociation compromises knowledge accounts of both assertion and action/practical reasoning. To provide a more accurate diagnosis, I consider speech act theory and argue that principled differences between the norms of action and assertion compromise Equivalence Commonality. In contrast, a qualified version of Structural Commonality may be preserved. (shrink)

In this paper, I present an Aristotelian solution to the problem of material constitution. The problem of material constitution arises whenever it appears that an object a and an object b share all of the same parts and yet are essentially related to their parts in different ways. (A familiar example: A lump of bronze constitutes a statue of Athena. The lump and the statue share all of the same parts, but it appears that the lump can, whereas the statue (...) cannot, survive radical rearrangements of those parts.) I argue that if we are prepared to follow Aristotle in making a distinction between numerical sameness and identity, we can solve the problem of material constitution without recourse to co-location or contingent identity and without repudiating any of the familiar objects of common sense (such as lumps and statues) or denying that these objects have the essential properties we ordinarily think that they have. Some critics of same-sex marriage allege that this kind of union not only betrays the nature of marriage but that it also opens children to various kinds of harm. Same-sex marriage is objectionable, on this view, in its nature and in its effects. A view of marriage as requiring an unassisted capacity to conceive children may be respect as one idea of marriage, but this view need not be understood as marriage itself. It is not clear, in any case, why (...) government should prefer this one idealized view of marriage over other others, so long as recognition of other kinds of marriage do not stand in the way of government carrying out its core interests, such as the protection of children. The idea that children are necessarily harmed when conceived by and for same-sex couples cannot be sustained as a matter of psychological evidence or moral argument. No research shows that such children are routinely harmed or rarely-but-catastrophically. Comparative accounts of the welfare of children of same-sex couples cannot show either that children must be brought into existence only under ideal circumstances. (shrink)

Ought parents, in general, to value being biologically tied to their children? Is it important, in particular, that both parents be biologically tied to their children? I will address these fundamental questions by looking at a fairly new practice within IVF treatments, so-called IVF-with-ROPA ( Reception of Oocytes from Partner ), which allows lesbian couples to „share motherhood‟ with one partner providing the eggs while the other becomes pregnant. I believe that IVF-with-ROPA is, just like other IVF treatments, morally permissible; (...) but here I argue that the increased biological ties which IVF-with-ROPA allows for do not have any particular value beside the satisfaction of a legitimate wish, because there is no intrinsic value in a biological tie between parents and children; further, I argue that equality within parental projects cannot be achieved by redistributing biological ties. He says it is the latest expression of concocted rights under the Court’s “substantive-due-process” doctrine. Locke thought that it was impossible for there to be two things of the same kind in the same place at the same time. I offer (what looks to me like) a counterexample to that principle, involving two ships in the same place at the same time. I then consider two ways of explaining away, and one way of denying, the apparent counterexample of Locke's principle, and I argue that none is successful. I conclude that, although the case under discussion (...) does not refute Locke's principle, it constitutes a serious challenge to it. (shrink)

Parfit’s Branch Line argument is intended to show that the relation of survival is possibly a one-many relation and thus different from numerical identity. I offer a detailed reconstruction of Parfit’s notions of survival and personal identity, and show the argument cannot be coherently formulated within Parfit’s own setting. More specifically, I argue that Parfit’s own specifications imply that the “R-relation”, i.e., the relation claimed to capture of “what matters in survival,” turns out to hold not only along but also (...) across the branches representing the development of a reduplicated person. This curious fact of ‘interbranch survival,’ as I call it, has gone unnoticed so far. The fact that the R-relation also holds across branches creates a trilemma for Parfit’s approach. Either the envisaged notion of personal identity is circular, or the R-relation fails as a reconstruction of the common sense notion of survival, or talk about persons ‘branching’ (being reduplicated etc.) remains semantically empty. In the paper’s last section I suggest that my criticism does not detract from the larger systematic significance of Parfit’s argument. The argument is simply terminologically miscalibrated. Even though Parfit’s branch line argument fails to establish the conceptual separability of survival and identity, it can be used to show the separability of sameness and numerical identity, which should have similar implications for meta-ethics as the original argument. The jus ad bellum doctrine of legitimate authority, conceived by St. Augustine and evolved by St. Thomas Aquinas, that a sovereign might identify a just cause and declare war without reference to the nation’s soldiers or citizens, continues to inform thinking about just war. Contesting this claim, the present paper reasons that without the moral confidence of the soldiers who serve, no conflict can be justified. The paper claims that soldiers have relevant and important ideas about the justice of the (...) cause. Soldiers, who enlist in order to advance justice by just means, deserve the chance to fight and perhaps to die with the fully formed moral assurance that their cause is right. (shrink)

In dialogue with the most famous myth for the origin of different languages - The Tower of Babel - A Psychoanalytic Exploration on Sameness and Otherness: Beyond Babel provides a series of timely reflections on the themes of sameness and otherness from a contemporary psychoanalytic perspective. How are we dealing with communication and its difficulties, the confusion of tongues and loss of common ground within a European context today? Can we move beyond Babel? Confusion and feared loss of (...) shared values and identity are a major part of the daily work of psychoanalytic psychotherapists. Bringing together an international range psychoanalytic practitioners and researchers, the book is divided into six parts and covers an array of resonant topics, including: language and translation; cultural identity; families and children; the cyber world; the psychotherapeutic process; and migration. Whereas the quest for unity, which underpins the myth of Babel, leads to mystification, simplification and the exclusion of people or things, multilingual communities necessitate mutual understanding through dialogue. This book examines those factors which further or threaten communication, aiming not to reduce but to gain complexity. It suggests that diversification enriches communication and that, by relating to others, we can create something new. As opposed to cultural and linguistic homogeneity, Babel is not only a metaphor for mangled communication, alienation, and distraction, it is also about the acceptance or rejection of differences between self and other.
