Medical legal partnerships address individual legal needs that can create impediments to health. Little is known about outcomes from medical legal partnerships and their relationship to access to justice. This paper reports outcomes from one medical legal partnership from the perspective of the client, with specific emphasis on impact on health and concepts related to access to justice. We suggest a conceptual model for incorporating medical legal partnerships into a broader framework about access to justice.

This research examines whether and how firms can meet both business goals and social needs through their innovation activities. We examine antecedents and consequences of innovation that addresses social needs, in addition to business goals, using data collected from European for-profit firms. We find that innovation including social intent is more likely under conditions of high market turbulence, which represents an important form of demand-driven threats. Meanwhile, we find no relationship with competitive intensity, a form (...) of pressure driven threats. Together, these findings suggest that customers and other stakeholders are more likely to drive firms to focus on the social dimension than competitors. The findings also indicate that innovation including social intent is positively related with customer acceptance, which supports the notion that innovation can meet both business goals and social needs. This relationship is partially mediated by perceived market turbulence, which highlights the importance of customers and their demands for social responsibility. This research advances both theory and practice as we add to existing discourses on innovation by providing a broader than common perspective that includes the social dimension as a potential part of innovation conducted to meet business goals. Furthermore, we shed light on how and when firms are likely to include intended social outcomes in their innovation and when they are less likely to do so, which highlights a potential untapped opportunity. The main goal of this study is to explore the drivers of meaningful sport consumption and its influence mechanism. In sports consumption, consumers not only seek hedonic value but also pursue to experience greater purpose and meaning in life, which is regarded as meaningful sports consumption. This study extends existing sports management literature by examining how social needs impact meaningful sports behavior with team affiliation, self-improvement, and self-esteem as mediators. Based on the questionnaire data collected from China, the (...) empirical analysis results show that social needs have a significant positive impact on meaningful sports consumption behavior through the mediating effect of team affiliation and self-esteem motivation. However, self-improvement motivation does not have a mediating effect on the relationship between social needs and meaningful sports consumption. This study enriches the research content of sports consumption, adds research object of social needs, and expands the research scope of meaningful consumption by introducing meaningful sports consumption into the above domain. The extent to which people identify with an organization is dependent on the attractiveness of the organizational identity, which helps individuals satisfy one or more important self-definitional needs. However, little is known about the antecedents of company identity attractiveness (IA) in a consumer–company context. Drawing on theories of social identity and organizational identification, a model of the antecedents of IA is developed and tested. The findings provide empirical validation of the relationship between IA and corporate associations perceived by (...) consumers. Our results demonstrate that the Corporate Social Responsibility (CSR) contribution to company IA is much stronger than that of Corporate Ability (CA). Despite 40-year-old evidence of childcare challenges limiting women’s participation in agriculture in the United States, it was not until a major societal crisis, COVID-19, that farm organizations and policy makers began to recognize that these challenges negatively impact the farm enterprise. Among farm persistence and farm transition scholars, farm households’ social and economic needs, including childcare, have also been underappreciated despite the constant exchange of time, money, and energy between the farm household and the enterprise. We use survey (...) responses from 729 U.S. farm families to understand how children and their childcare needs shape the farm enterprise and the extent to which childcare arrangements, farm individuals and households, and farm enterprise characteristics interact with these decisions. A high proportion of respondents made changes to adapt to the needs of children with the greatest impact on farm productivity, followed by impact on the structure of labor on- and off- the farm, and impact on the farm enterprise structure. These impacts likely have short- and long-term consequences on the trajectory of the farm enterprise and well-being of the household. Different decisions required a different calculus and the trade-offs that respondents considered were shaped by access to a support system, access to financial resources, and specific needs of the children. Last, the limited variations across the four decisions for a number of farm individual and household characteristics hint both at the universality of being a farm parent needing to constantly adapt amid high rates of childcare challenges and inadequate social safety nets. I argue against the idea (made popular by H.L.A. Hart) that the key to a legal system is its "rule of recognition." I argue that much of the work allegedly done by a rule of recognition is either done by a different kind of secondary rule (what Hart called "a rule of change") or it is not done at all (and doesn't have to be done). A rule of change tells us the procedures that must be followed and the substantive (...) conditions that must be satisfied if law is to be changed legislatively; and a judge "recognizes" changes simply by using this checklist. In common law, there is no clear rule of change (because we are profoundly ambivalent about judicial lawmaking). But we get by without one, and without a determinate rule of recognition that would tell us precisely how to infer rules from precedents. It is quite liberating, really, to abandon the idea of a rule of recognition. Apart from anything else, it relieves us from having to participate in endless debates about whether the US Constitution is (or contains) a rule of recognition for American law. This final chapter argues that the determination of public duties to our needs in African politics ought to be based on established social and political rights derived from recognised African customary norms. The argument is motivated by a basic limitation with two opposed approaches to African political theory of needs—realist and communitarian—which struggle with the naturalistic fallacy in determining objective public needs, since they dismiss the security of rights-based law as the basis for the legitimate determination (...) of public duties towards human needs by the state. On the basis of a critique of these two views, it is argued that duties to needs are not an alternative or substitute to rights, but, on the contrary, human rights legitimate public duties to needs, and African human needs are best served by rights interpreted through recognised African customary practices. Although some authors claim that deception requires intention, we argue that there can be deception in social robotics, whether or not it is intended. By focusing on the deceived rather than the deceiver, we propose that false beliefs can be created in the absence of intention. Supporting evidence is found in both human and animal examples. Instead of assuming that deception is wrong only when carried out to benefit the deceiver, we propose that deception in social robotics is (...) wrong when it leads to harmful impacts on individuals and society. The appearance and behaviour of a robot can lead to an overestimation of its functionality or to an illusion of sentience or cognition that can promote misplaced trust and inappropriate uses such as care and companionship of the vulnerable. We consider the allocation of responsibility for harmful deception. Finally, we make the suggestion that harmful impacts could be prevented by legislation, and by the development of an assessment framework for sensitive robot applications. (shrink)

Recent research indicates that social networking site addiction is positively associated with materialism. However, little attention has been paid to the potential mechanisms in this relationship. This study tested the mediating role of depression and the moderating role of need to belong in the relationships between SNS addiction and adolescents’ materialism. This research model was tested among 733 adolescents in China. The findings indicated that both SNS addiction and NTB were positively related to adolescents’ materialism. Mediation analyses showed that (...) depression mediated the association between SNS addiction and adolescents’ materialism. Moderated mediation indicated that the effect of SNS addiction on materialism and the effect of SNS addiction on depression were exacerbated by NTB. This study investigates the classroom climate in two settings of the 6th?grade class (a setting of children with special needs and a setting without children with special needs), focusing on aspects of satisfaction and cohesiveness on one side and friction, competitiveness and difficulties on the other. The study results indicate the existence of both positive and negative consequences of the integration of hearing?impaired pupils. Heterogeneity achieved by the presence of children with special needs included positive benefits for (...) all pupils in the mainstream classroom and helped to prevent friction and a competitive atmosphere, and provided opportunities for accepting exceptionalities, and developing social skills, ethical values and empathic abilities among school peers. On the other hand was concern related to difficulties of cognition, the only dimension on which comparative settings statistically and significantly differed concerning the classroom climate with integrated pupils. From unemployment to Brexit to climate change, capitalism is in trouble and ill-prepared to cope with the challenges of the coming decades. How did we get here? While contemporary economists and policymakers tend to ignore the political and social dimensions of capitalism, some of the great economists of the past - Adam Smith, Friedrich List, John Maynard Keynes, Joseph Schumpeter, Karl Polanyi and Albert Hirschman - did not make the same mistake. Leveraging their insights, sociologists John L. Campbell and (...) John A. Hall trace the historical development of capitalism as a social, political, and economic system throughout the twentieth and early twenty-first centuries. They draw comparisons across eras and around the globe to show that there is no inevitable logic of capitalism. Rather, capitalism's performance depends on the strength of nation-states, the social cohesion of capitalist societies, and the stability of the international system - three things that are in short supply today. This research involves a review of the submissions to a 2005/06 Australian Government Inquiry into Corporate Social Responsibility. The Inquiry was established to investigate whether corporate social responsibilities and accountabilities should be regulated, or left to be determined by market forces. Our results show that the business community overwhelming favour an anti-regulation approach whereby corporations should be left with the flexibility to determine their social responsibilities and associated accountabilities and ‘enlightened self-interest’ should be retained as the guiding (...) mechanism for social responsibility initiatives. In stark contrast, the submissions from social and environmental organisations and individuals provided counter-arguments in favour of a pro-regulation view. Ultimately Government embraced the ‘free market perspective’ promoted by the business community and decided against the introduction of national legislation pertaining to corporate social responsibilities. Müller argues that the perceptual or “Axiological Receptivity” model of emotions is incoherent, because it requires an emotion to apprehend and respond to its formal object at the same time. He defends a contrasting view of emotions as “Position-Takings" towards “formal objects”, aspects of an emotion's target pertinent to the subject's concerns. I first cast doubt on the cogency of Müller's attack on AR as begging questions about the temporal characteristics (...) of perceptual events. I then argue that Müller's version of PT is not radical enough. On my attitudinal view, formal objects are not values but natural properties that justify specific affective or behavioral responses. In my dissertation, I argue that the enterprise of corrective justice requires answering questions about what is unjust and how we ought to set and pursue corrective justice goals. To answer these questions in a way that will allow us to correct for the persistent and entrenched injustices which result from processes of stratification in our society, I’ll put forward a two-tiered social contract theory, which will allow us to approach these questions in a way that will capture the (...) agreement we can have and allow us to structure the persistent disagreement that we cannot and ought not avoid. In the first tier—the cooperative position—the parties know only that they’re in what I’m calling the ten circumstances of cooperation—the circumstances in which modern cooperation takes place. These circumstances includes the social complexity and opacity inherent in complex cooperative arrangements which have epistemic effects on our social cognition in ways that make our view of our social arrangements at best partial, and work to obscure important features of our social reality, especially those affecting those at the bottom of our stratified social relations. This tier generates four cooperative ideals—proficient rationality, democratic equality, social understanding, and dignity—that function as a theory of justice which can gain an overlapping consensus in society but still allow for meaningful disagreement to take place. In the second tier—the corrective position—the parties have access to the circumstances of cooperation, four cooperative ideals, and a general and specific domination contract. These domination contracts model how stratified social relations operate to constrain people within social systems, including the ways that people think about those systems. I argue that the parties would affirm a principle of corrective justice as involving coalitions of differently-situated actors working together over time to dismantle unjust mechanisms, and five desiderata for applying that principle to circumstances as we confront them. They would do so because that is the only way to overcome the practical and epistemic barriers put in place by the domination contracts. (shrink)

According to both the traditional model of folk psychology and the social intelligence hypothesis, our folk psychological notions of belief and desire developed in order to make better predictions of behavior, and the fundamental role for our folk psychological notions of belief and desire are for making more accurate predictions of behavior (than predictions made without appeal to folk psychological notions). My strategy in this paper is to show that these claims are false. I argue that we need not (...) appeal to mental states to make predictions of many behaviors, and I will offer a positive account of how we might go about predicting intentional behavior. Finally, I suggest that taken together, the critique of traditional folk psychology along with the alternative account of our predictive practices leads to a new hypothesis. While it may be true that mental state concepts developed in response to social-environmental pressures, I suggest that this pressure was more likely the need to explain behavior, rather than the need to predict it. The ongoing debate on the ethics of self-driving cars typically focuses on two approaches to answering such questions: moral philosophy and social science. I argue that these two approaches are both lacking. We should neither deduce answers from individual moral theories nor should we expect social science to give us complete answers. To supplement these approaches, we should turn to political philosophy. The issues we face are collective decisions that we make together rather than individual decisions we make (...) in light of what we each have reason to value. Political philosophy adds three basic concerns to our conceptual toolkit: reasonable pluralism, human agency, and legitimacy. Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different (...) participating countries: Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. The role of negotiation in order to improve the level of the principal staff in higher education is the main objective of this research. This work was carried out through a scientific and technologic point of view based on a creative model which develop a formative process at Manuel Filix Lspez" polytechical school in Ecuador. This study examines the ways in which gendered definitions of social provision in Costa Rica have created gaps in national health care programs that women's organizations are currently addressing. More specifically, I highlight how women's organizations are key actors in the politics of needs interpretation, wherein definitions of health needs are contested by policy makers, doctors, and women themselves. I argue that women's health organizations have begun to broaden and politicize health needs by including domestic violence (...) in national debates. Using interviews and organizational histories of six grassroots health organizations, I find that these groups have been successful, in large part, because they framed their concerns in ways that were convincing to politicians and national health care bureaucrats. The link between corporate social responsibility (CSR) and competitiveness has been examined mainly at the business level. The purpose of this paper is to improve conceptual understanding and provide empirical evidence on the link between CSR and competitiveness at the national level. We draw on an eclectic-synthetic framework of international economics, strategic management and CSR literatures to explore conceptually whether and how CSR can impact on the competitiveness of nations, and test our hypotheses empirically with a sample of 19 (...) developed countries over a 6-year period. Our evidence suggests that CSR can make a significant positive contribution to national competitiveness, as measured by national living standards. We also find that countries with a relatively low innovation record can benefit more, as compared to highly innovative countries, by implementing nationwide CSR-based positioning strategies. Some of the most difficult clinical ethics consultations involve patients who have both medical and mental health needs, as these cases can result in considerable moral distress on the part of the bedside staff. In this article we examine the issues that such consults raise through the illustrative example of a particular case: several years ago our ethics consultation service received a request from a critical care attending physician who was considering a rarely performed psychosurgical intervention to address intractable (...) and life-threatening agitation and aggression in an adolescent patient for whom standard treatments had proven unsuccessful. We consider strategies that may be useful in addressing not only the ethical dilemmas or the clinical problems, but also the emotional, social, and moral distress that arise in delivering care in such complex cases, in which standard routine practices of care have been exhausted. In addition, we explore the processes that led to this situation and suggest ways to promote early recognition and intervention for similar cases in the future. (shrink)

Over the coming decades, Artificial Intelligence will profoundly impact the way we live, work, wage war, play, seek a mate, educate our young, and care for our elderly. It is likely to greatly increase our aggregate wealth, but it will also upend our labor markets, reshuffle our social order, and strain our private and public institutions. Eventually it may alter how we see our place in the universe, as machines pursue goals independent of their creators and outperform us in (...) domains previously believed to be the sole dominion of humans. Whether we regard them as conscious or unwitting, revere them as a new form of life or dismiss them as mere clever appliances, is beside the point. They are likely to play an increasingly critical and intimate role in many aspects of our lives. The emergence of systems capable of independent reasoning and action raises serious questions about just whose interests they are permitted to serve, and what limits our society should place on their creation and use. Deep ethical questions that have bedeviled philosophers for ages will suddenly arrive on the steps of our courthouses. Can a machine be held accountable for its actions? Should intelligent systems enjoy independent rights and responsibilities, or are they simple property? Who should be held responsible when a self-driving car kills a pedestrian? Can your personal robot hold your place in line, or be compelled to testify against you? If it turns out to be possible to upload your mind into a machine, is that still you? What must laypersons understand about science to allow them to make sound decisions on science-related issues? Relying on recent developments in social epistemology, this paper argues that scientific education should have the goal not of bringing laypersons' understanding of science closer to that of expert insiders, but rather of cultivating the kind of competence characteristic of “competent outsiders” (Feinstein 2011). Moreover, it argues that philosophers of science have an important role to play in attempts to promote this kind of (...) understanding, but that to successfully fulfill this role, they will have to approach central questions in the field differently. Abstract:This article sets out two central theses. Both theses primarily involve a fundamental criticism of current contractarian business ethics (CBE), but if these can be sustained, they also constitute two boundary conditions for any future contractarian theory of business ethics. The first, which I label the self-discipline thesis, claims that current CBE would gain considerably in focus if more attention were paid to the logic of the social contract argument. By this I mean the aims set by the theorist (...) and method of reasoning by which normative conclusions are drawn in the contract model. The second, to which I refer as the domain-specificity thesis, argues that current CBE needs to be better adapted to its field of application and the specific goals which it aims to establish. I will substantiate these two theses on the basis of a comparative analysis of CBE with two earlier families of social contract theories. (shrink)

Users have adopted a wide range of digital technologies into their communication repertoire. It remains unclear why they adopt multiple forms of communication instead of substituting one medium for another. It also raises the question: What type of need does each of these media fulfill? In the present article, the authors conduct comparative work that examines the gratifications obtained from Facebook with those from instant messaging. This comparison between media allows one to draw conclusions about how different social media (...) fulfill user needs. Data were collected from undergraduate students through a multimethod study based on 77 surveys and 21 interviews. A factor analysis of gratifications obtained from Facebook revealed six key dimensions: pastime, affection, fashion, share problems, sociability, and social information. Comparative analysis showed that Facebook is about having fun and knowing about the social activities occurring in one’s social network, whereas instant messaging is geared more toward relationship maintenance and development. The authors discuss differences in the two technologies and outline a framework based on uses and gratifications theory as to why young people integrate numerous media into their communication habits. Van de Vliert embraces a model of human needs, underplaying a model whereby individuals, motivated by psychological needs, develop coping strategies that help them meet their personal goals and collectively exert an influence on social and economic systems. Undesirable climates may inflate the value of financial capital, but they also boost the value of social capital.

This article is a response to Paul Thompson's recent claim that individual farmers cannot have obligations to practice sustainable methods unless a large number of other producers also use them. Using a moral rights framework, I explain the relation of human interests and needs to the duties of individuals to accomplish moral social goals; i.e., those moral goals whose accomplishment requires the cooperation of other persons. The purpose is to show that individual action to promote sustainability does have (...) moral value. Duties to practice sustainable methods are derived from the rights of all persons to adequate food and nutrition. These rights themselves are grounded, not in individual subjective desires or preferences, but in the genuine interests all persons (present and future) have in the satisfaction of basic biological needs to sustain life and health. The duty of each person is correlative to the rights of the others, and fulfillment of the duty requires social action, in this case practicing sustainable methods in farming. If others are unwilling or constrained from fulfilling their obligations, then duties to take other kinds of actions may be derived from the primary duty to attain the goal of sustainability. Actions to secure social cooperation may include, for example, exhorting others to participate and taking political action to force restructuring of agricultural policy, as well as practicing sustainable methods on one's own farm.While frameworks of individual responsibility have been attacked as failing to capture the moral importance of holistic outcomes, it is argued that such problems are related to human motivation rather than to the structure of our moral systems. I conclude that a properly elaborated system of moral rights and duties connected with an adequate moral psychology can account for our duties to other humans to accomplish the goal of a sustainable agriculture. IntroductionFrontline healthcare workers have faced significant plight during the ongoing Coronavirus disease 2019 pandemic. Studies have shown their vulnerabilities to depression, anxiety disorders, post-traumatic stress, and insomnia. In a developing country like India, with a rising caseload, resource limitations, and stigma, the adversities faced by the physicians are more significant. We attempted to hear their “voices” to understand their adversities and conceptualize their resilience framework.MethodsA qualitative approach was used with a constructivist paradigm. After an initial pilot, a socio-demographically heterogeneous population (...) of 172 physicians working in COVID-designated centers were purposively sampled from all over India. Following in-depth virtual interviews using a pre-formed semi-structured guide, the data was transcribed and translated verbatim. The interview was focused on their challenges, needs, and processes of coping and support. Charmaz’s grounded theory was used for analysis supplemented by NVivo 10 software.ResultsFear of infection, uncertainty, stigma, guilt, and social isolation emerged as the main challenges. Simultaneously, their “unmet needs” were flexible work policies, administrative measures for better medical protection, the sensitivity of media toward the image of HCW, effective risk communication for their health, and finally, social inclusion. Their resilience “framework” emerged as a process while navigating these adversities and consisted of three facets: forming a “resilient identity,” managing the resilience, and working through the socio-occupational distress. The role of mental well-being, social network, peer support, problem negotiation, and self-care emerged as the key coping strategies.ConclusionThe study findings support the global call for better psychosocial health and quality of life of the frontline HCWs. Their “unheard voices” explored in the study can anchor subsequent resilience-enhancing interventions and policies. Guidelines focusing on the psychological wellbeing of frontline HCWs need to be grounded in their unmet needs and lived experiences. (shrink)

Historians are now generally agreed that the Darwinian recognition and institutionalization of the polygenist position was more than merely nominal.194 Wallace, Vogt, and Huxley had led the way, and we may add Galton (1869) to the list of those leading Darwinians who incorporated a good deal of polygenist thinking into their interpretions of human history and racial differences.195 Eventually “Mr. Darwin himself,” as Hunt had suggested he might, consolidated the Darwinian endorsement of many features of polygenism. Darwin's Descent of Man (...) was published in the same year that the Anthropological Institute was founded, and it was no coincidence that it was broadly congruent with Knoxian/ Anthropological race science. Recent scholarship has stressed the derivative character of the Descent, and Darwin's views on race were clearly influenced by the earlier interpretations of the abovecited Darwinians.196However, although the Descent was written in the light of the anthropological struggles of the 1860s, it is essential to acknowledge its origins in Darwin's notebooks of the late 1830s and early 1840s. A good deal of the congruence between Darwinian and Knoxian conceptions of race may be traced back to these early notebook constructions. As these document, Darwin, like Knox, brought to his very earliest conceptions of human evolution a “commitment to the idea of human races as discrete biological units with distinct moral and mental traits.”197 The young Darwin had been concerned with the same sorts of questions on racial biological and cultural differences that preoccupied Knox around the same time, and he was committed to as ruthless a naturalism. Apart from their individual and independent debts to Quetelet's “moral statistics,” both Darwin and Knox drew heavily on the general themes of struggle and adaptation in the contemporary “common context” of biological and social thought.198 Given their common context, the broad general similarities between the Knoxian laws of race antagonism and subordination and the Darwinian struggle for existence between races need occasion no strained historical explanation of direct influence.199Nevertheless, in more explicit ways, the Descent does show the conflation of Knoxian/Anthropological and Darwinian racial views, and Darwin located his discussion of these issues squarely within the dispute “of late years” between polygenists and monogenists.200 His mature views on race were shaped by the contemporaneous confrontations and negotiations between the Darwinians and the Anthropologicals. It is within this context that the minor historical puzzle of Darwin's failure to acknowledge Knox's “generic descent” may be explained. Apart from the difficulties of integration and interpretation of his scattered theoretical writings, Knox, through his adoption by Hunt and the Anthropologicals, became identified with anti-Darwinism and therefore with antievolutionism.201 Moreover, Knox, the disreputable and marginal “savage radical” and lately resurrected and equally unsavory “Anthropological,” was hardly an acceptable “precursor.” Yet, paradoxically, it was via the antithetical medium of the Anthropological platform that Knox's race science made an indirect and unacknowledged, but lasting, impact on the Darwinian anthropological model.In the Descent, Darwin argued that racial traits arose very early in the prehistory of man, were not biologically adaptive, and were therefore relatively fixed in character. By viewing race formation as a distant and closed episode of human history, Darwin endorsed the Knoxian categories of race as fixed and unalterable types. Although he thought it irrelevant whether human races were called species or subspecies, he conceded more to the Knoxian view than Huxley by granting that a naturalist confronted for the first time by specimens of Negro and European man “might feel himself fully justified in ranking the races of man as distinct species.”202 Consistent with the Knoxian interpretation, struggle, competition, and survival occurred between racial units rather than between individuals and, in Darwin's view, accounted for the superiority of the Anglo-Saxon and the inevitable triumph of the more intellectual and moral races over the lower and more degraded ones.Darwin was as insistent as Knox on the biological basis of intellectual and moral differences, and, through his tendency to reduce social and cultural differences to biology, he maintained the essential Knoxian/Anthropological link between race and culture.203 For above all, the Descent did much more than offer a naturalistic explanation of human evolution: it proffered social interpretation, justification, and prescription, and its timely appearance gave a powerful boost to the “moralizing naturalism” of Huxley and Galton, and to Spencer's “Social Darwinism.”204 We may draw a straight line from Knox's “moral anatomy,” through Hunt's “anthropology,” and on to “Social Darwinism” and the “social surgeons” of the eugenics movement.The Darwinians did not, of course, we their tendency to naturalize existing economic and social relations to Knox or Hunt and the Anthropologicals—they were simply reflecting the same general intellectual trend that had affected Knox and the Anthropologicals as well. And in the larger context, the forces that had created a climate receptive to Knox's racism had intensified: in the seventies, the need to justify white imperialism and class and racial inequalities was greater than ever. Scientific racism no longer appeared an aberration but the very essence of the scientific study of man, taking on a newfound respectability in the “new” evolutionary anthropology. But in more specific ways, through the struggle between the Darwinians and Anthropologicals for scientific and ideological hegemony, Knox's “moral anatomy” was institutionalized and perpetuated in late Victorian scientific racism. In the process, the delicate balance that Knox had maintained between his radicalism and his racism was outweighed by conservative institutional and social needs, and his “moral anatomy” was retooled — first by Hunt, and then by the Darwinians — to fit those needs. Despite the welfare of the child being afforded special legal and moral importance, it appears that the law is currently not objective in its application to children. There is an undeniable link between healthy child development and education, with the latter greatly impacting on mental health and general well-being. Drawing on the example of the differential treatment of gifted children in an educational context, I argue that the legal framework with regard to learning disabilities and cognitive impairments operates contrary to (...) the proclaimed goal of protecting and promoting the welfare of the child. This, I argue, constitutes unjustified discrimination, especially since there is a case to be made that highly cognitively able children could be considered disabled under a social model of disability. Whilst the group of affected children is small at present, developments in cognitive enhancement technologies mean that many more children might in the future be affected. Since the law currently fails gifted children, it will by analogy also likely fail cognitively enhanced children. (shrink)

Human dignity: social movements invoke it, several national constitutions enshrine it, and it features prominently in international human rights documents. But what is it, why is it important, and what is its relationship to human rights and social justice? Pablo Gilabert offers a systematic defence of the view that human dignity is the moral heart of justice. In Human Dignity and Human Rights (OUP 2019), he advanced an account of human dignity for the context of human rights discourse, (...) which covers the most urgent, basic claims of dignity. This book extends the dignitarian approach to more ambitious claims of maximal dignity of the kind encoded in democratic socialist conceptions of social justice. In particular, this book focuses on the just organization of working practices. It recasts in a dignitarian format the critique of capitalist society as involving exploitation, alienation, and domination of workers, and revamps a neglected but inspiring socialist principle. In its dignitarian interpretation, the Abilities/Needs Principle (‘From each according to their ability, to each according to their needs!’) yields reasonable and feasible requirements on social cooperation geared to empowering each human being to lead a flourishing life. While Human Dignity and Human Rights offered the first systematic philosophical account of human dignity in human rights discourse, Human Dignity and Social Justice presents the first systematic application of the dignitarian framework to the core ideals of democratic socialism. Catholic Social Teaching takes a rather cautious view toward the value of the ideas of Adam Smith, due to his emphasis on negative political and economic liberty. Detractors of Smith within CST point to what they consider to be deficiencies within his works: an impoverished moral anthropology, a lack of concern for the common good, and markets untethered to human needs. Defenders of Smith within CST tend to emphasize the material benefits that derive from Smithian institutions, such as (...) economic growth, improvements in standards of living, and the new opportunities that arise from cultures focused on innovation. This paper argues that Smith’s ideas have real value for CST. However, this value primarily lies in his moral psychology. While not denying the dangers of business activity for our moral lives, Smith also helps us to understand the possibility of the moral corruption of those who wield political power, thus providing an indirect defense of political and economic liberty that coheres with important Christian ethical notions found in CST. This is the case even though CST does not consistently recognize concerns surrounding the dangers of wielding political power—and thus Smith’s arguments offer real challenges to CST as well. This paper further suggests that these basic insights are relevant regardless of one’s favored institutional arrangements. (shrink)

The “gift exchange theory” articulated by Marcel Mauss, along with his core concept of a threefold obligation, is the dominant theoretical framework used to explain the majority of gift issues in marketing. This perspective assumes that some interest always lies behind gifts, such that a gift always implies a counterpart of receiving something in return. Despite the relevance of this approach in understanding the day-to-day consumer behavior, this paper presents empirical cases where the consumer is also able to give freely, (...) that is to say without implying a counterpart or even expecting it. To explain those empirical cases, we mobilize a key teaching of the Catholic Church: the “gratuitous gift” and then introduce the concept of the “need to give.” We show that gratuitousness is a relevant concept to understand most of gifts made by consumers, and we develop the normative aspect of gratuitous gift for ethical marketers. We also show that Catholic Social Teaching offers an appropriate anthropology to understand consumer behaviors motivated by this need for gratuitousness. This study examines the impact of board diversity on firms’ corporate social responsibility performance. Using seven different measures of board diversity across 1,489 U.S. firms from 1999 to 2011, the study finds that board diversity is positively associated with CSR performance. Board diversity is associated with a greater number of areas in which CSR is strong and a fewer number of areas in which CSR is a concern. These findings support the stakeholder theory and are consistent with the view (...) that board diversity enhances firms’ ability to satisfy the needs of their broader groups of stakeholders. We find that gender, tenure, and expertise diversities seem to be the driving factors of firms’ CSR activities. Furthermore, we find that board diversity significantly increases CSR performance by increasing CSR strengths and reducing CSR concerns for firms producing consumer-oriented products and firms operating in more competitive industries. Our results remain robust using different measures of CSR performance, different estimation methods, and different samples. (shrink)

It has been commonplace to equate Foucault’s 1979 series of lectures at the Collège de France with the claim that for neoliberalism, unlike for classical liberalism, the market needs to be artificially constructed. The article expands this claim to its full expression, taking it beyond what otherwise would be a simple divulgation of a basic neoliberal tenet. It zeroes in on Foucault’s own insight: that neoliberal constructivism is not directed at the market as such, but, in principle, at society, (...) arguing that the value of this insight goes beyond the critique of a neoliberal present. The neoliberal rationale rather helps him to reveal a unique historical architecture, a latent approach to the social dissimilar to the one that has long predominated in the human sciences. The inversion of homo œconomicus in neoliberal theory amounted to the unearthing of a ‘social subject of interest’ within civil society. Such a subject, barely recognized by neoliberals who simply instrumentalize it for the sake of the market, demonstrates that the social is not necessarily the natural product of ethical subjects; that society may also need to be constructed. Truth and Reconciliation Commissions (TRCs) have become a widely used tool to reconcile societies in the aftermath of widespread injustice or social and political conflict in a state. This article focuses on TRCs that take place in non-transitional societies in which the political and social structures, institutions, and power relations have largely remained in place since the time of injustice. Furthermore, it will focus on one particular injustice that TRCs try to address through the practice of truth-telling, namely (...) the eradication of epistemic injustice. The article takes the Canadian and Norwegian TRCs as two examples to show that under conditions of enduring injustice, willful ignorance of the majority, and power inequality, TRCs might create a double bind for victims which makes them choose between epistemic exploitation and continued injustices based on the majority's ignorance. The article argues that the set-up and accompanying measures of TRCs are of the utmost importance if TRCs in non-transitional societies are to overcome epistemic injustice, instead of creating new relations of exploitation.
