In this paper, I demonstrate how the Passover Haggadah exploits certain features of conversational interaction in both the production formats of its texts and in its performance formats (or ways it indicates it should be performed) during the Passover Seder. Some conversational methods used include the use of dispreferred second pair parts which creates an impression that at least part of the Haggadah's text resembles a kind of conversational argument. Furthermore, as a recitable text, the Haggadah exploits the use of (...) and changes in footings in a manner reminiscent of how reported speech is used in ordinary conversation to introduce participant roles and virtual participants with their own commitments, orientations and positions which may not represent those of the animators of the recited text. While the Haggadah is not an actual argument in conventional terms, it is a script of ritual texts organized according to a logic similar to the one by which certain kinds of conversational arguments are organized. Participants are able to animate participatory roles and assess the positions, orientations and commitments such roles represent in a manner that rehearses how such positions, orientations and commitments might be accomplished in actual argumentation. Examining a fragment of interaction that occurred during a surgery at a teaching hospital, we explore how particular instructed experiences are produced for two trainees, a surgeon in the residency program and a medical student in a surgical clerkship. We are concerned with what is produced as learnable in each case. Stated slightly differently, we are interested in the ways in which the attending surgeon uses demonstrations as instruction and the ways in which recipients of that instruction, in this case (...) the resident and the clerk, respond with enactments of those demonstrated actions. The recipients of this kind of instruction participate in a form of experiential learning in which they enact their own versions of the instructor’s demonstrated actions to be observed and assessed by the instructor. These enactments provide learners with experiential access to the instructor’s demonstrated actions. They are designed to be experiences that learners may draw upon to make experientially warranted claims at some later time. (shrink)

Republicans are divided on the question of whether domination is best understood in terms of capacities to act intentionally or of certain structural aspects of society. I offer a model combining each aspect derived from Frederick Douglass’s philosophy. Douglass referred to slavery in both interpersonal terms (to individuals) and structural (to the community), focussing on the unique and pervasive role played by social prejudice which distorts public reason thereby disabling the functioning of republican institutions. While Douglass’s insights constitute a significant (...) contribution to neo-republican theory in their own right, they also offer a slave’s perspective on the central republican concept of domination and shows how historic African American writers made innovative theoretical contributions to republicanism. Much of the discussion on business ethics is philosophical in nature. There is no lack of theories and ideals on moral reasoning. What is missing is translating these moral theories and principles into specific, operational procedures that can indicate a proper course of action. Although most business actions are routine and do not raise serious ethical questions, many people experience difficulty in applying their personal moral principles to specific business decisions in ethically-dilemmatic situations.This study seeks to develop a framework that (...) can be utilized to implement personal moral reasoning based on the teleological theory of Utilitarianism and the deontological theory of Ross''s Prima Facie Duties in the business decision-making process. The central feature in the framework is a point-system that quantities the ethical worth of a proposed business action and determines whether the action would be ethically desirable if taken. It provides an objective element in an otherwise qualitative ethical inquiry process. This study also illustrates practical applications of the system by analyzing the ethical implications of a proposed action where foreign bribery is involved. (shrink)

This book aims to distil the essentials of liberal constitutionalism from the jurisprudence and practice of contemporary liberal-democratic states. It argues that the model liberal-democratic constitution is best understood as a unity of three constitutional frameworks: libertarian, egalitarian, and communitarian. When viewed in this light, the liberal constitution embodies a surprising synthesis. It reconciles a commitment to individual liberty and freedom of conscience with the perfectionist idea that the state ought to cultivate a type of personality whose fundamental ends are (...) the goods essential to dignity. The Groningen Protocol allows active euthanasia of severely ill newborns with unbearable suffering. Defenders of the protocol insist that the protocol refers to terminally ill infants and that quality of life should not be a factor in the decision to euthanize an infant. They also argue that there should be no ethical difference between active and passive euthanasia of these infants. However, nowhere in the protocol does it refer to terminally ill infants; on the contrary, the developers of the protocol (...) take into account the future quality of life of the infant. We also note how the Nazi Euthanasie Programm started with the premise that there is some life not worthy of living. Therefore, in our opinion, the protocol violates the traditional ethical codes of physicians and the moral values of the overwhelming majority of the citizens of the world. (shrink)

Philosophers of mathematics have become increasingly interested in the explanatory role of mathematics in empirical science, in the context of new versions of the Quinean ‘Indispensability Argument’ which employ inference to the best explanation for the existence of abstract mathematical objects. However, little attention has been paid to analysing the nature of the explanatory relation involved in these mathematical explanations in science (MES). In this paper, I attack the only articulated account of MES in the literature (an account sketched by (...) Mark Steiner), according to which a genuine MES incorporates an explanatory proof of the mathematical result being used. The central case study involves an explanation for why bees build the cells of their honeycombs in the shape of hexagons. I make a distinction between two kinds of MES, mathematics-driven explanation in science and science-driven mathematical explanation, and argue that it is the second category which is both scientifically and philosophical more central. I conclude that the explanatory relation involved in MES is genuinely scientific and hence that the phenomenon of MES poses a challenge to general accounts of scientific explanation. (shrink)

Illness creates a range of negative emotions in patients including anxiety, fear, powerlessness, and vulnerability. There is much debate on the ‘therapeutic’ or ‘helping’ nurse–patient relationship. However, despite the current agenda regarding patient-centred care, the literature concerning the development of good interpersonal responses and the view that a satisfactory nursing ethics should focus on persons and character traits rather than actions, nursing ethics is dominated by the traditional obligation, act-centred theories such as consequentialism and deontology. I critically examine these theories (...) and the role of duty-based notions in both general ethics and nursing practice. Because of well-established flaws, I conclude that obligation-based moral theories are incomplete and inadequate for nursing practice. I examine the work of Hursthouse on virtue ethics’ action guidance and the v-rules. I argue that the moral virtues and a strong (action-guiding) version of virtue ethics provide a plausible and viable alternative for nursing practice. I develop an account of a virtue-based helping relationship and a virtue-based approach to nursing. The latter is characterized by three features: (1) exercising the moral virtues such as compassion; (2) using judgement; and (3) using moral wisdom, understood to include at least moral perception, moral sensitivity, and moral imagination. Merits and problems of the virtue-based approach are examined. I relate the work of MacIntyre to nursing and I conceive nursing as a practice: nurses who exercise the virtues and seek the internal goods help to sustain the practice of nursing and thus prevent the marginalization of the virtues. The strong practice-based version of virtue ethics proposed is context-dependent, particularist, and relational. Several areas for future philosophical inquiry and empirical nursing research are suggested to develop this account yet further. (shrink)

Evolutionary developmental biology (or developmental evolution) is in the middle stages of its “development.” Its early ontogeny cannot be traced back to fertilization but pivotal developmental events included Gould’s (1977) treatment of heterochrony, Riedl’s (1978) analysis of “burden”, the Dahlem conference of 1981, a British Society of Developmental Biologists Symposium, as well as books that incorporated developmental genetics into older comparative themes. A major inductive process began with the discovery of widespread phylogenetic conservation in homeobox-containing genes. One interpretation of these (...) early developmental dynamics holds that an increasingly prominent problem agenda (e.g., how do novel structures and functions originate?), inherited from long-standing research programs in comparative embryology, morphology, and paleontology, was handed a powerful set of experimental tools from the lineage of experimental embryology. This allowed for an experimental probing of development and its evolution in an unprecedented fashion. Although the relationship between evolution and development has exhibited a protracted and complex history, we are still in the process of comprehending these early stages of “modern” EvoDevo’s ontogeny. K. C. Klauer, J. Musch, and B. Naumer (2000) presented a general multinomial model of belief bias effects in syllogistic reasoning. They claimed to map a particular mental model account of belief bias (J. V. Oakhill, P. N. Johnson-Laird, & A. Garnham, 1989) onto this model and to show empirically that it is incorrect. The authors argue that this mental model account does not map onto the multinomial model and that it can account for the data presented by Klauer et (...) al. (Experiments 1–4). The authors further argue that additional data Klauer et al. presented in support of a new model of their own (Experiments 5– 8) are explained by this mental model account. The mental model account is, therefore, refuted neither by Klauer et al.’s theoretical analysis nor by any of the results they presented. Furthermore, the account can accommodate more recent findings on belief bias in a more satisfactory way than can alternative models that have been proposed. (shrink)

Wittgenstein, in his later writings, gave an account of the meaning of expressions in terms of criteria for their application. As with many of Wittgenstein's later ideas the notion of a criterion have proved difficult to explicate. A recent account, which ties criteria to the philosophical doctrine of constructivism, provides a link between the concept of a criterion and a series of ideas about language understanding which have emerged in the past few years. It is shown that these ideas can (...) be made of cohere within a general constructivist framework, and that an alternative realist framework is inadequate in this respect. (shrink)

"Poststructuralism and Critical Theory's Second Generation" analyses the major themes and developments in a period that brought continental philosophy to the forefront of scholarship in a variety of humanities and social science disciplines and that set the agenda for philosophical thought on the continent and elsewhere from the 1960s to the present. Focusing on the years 1960-1984, the volume examines the major figures associated with poststructuralism and the second generation of critical theory, the two dominant movements that emerged in the (...) 1960s: Althusser, Foucault, Deleuze, Derrida, Lyotard, Irigaray, and Habermas. Influential thinkers such as Serres, Bourdieu, and Rorty, who are not easily placed in "standard" histories of the period, are also covered. Beyond this, thematic essays engage with issues as diverse as the Nietzschean legacy, the linguistic turn in continental thinking, the phenomenological inheritance of Gadamer and Ricoeur, the influence of psychoanalysis, the emergence of feminist thought and a philosophy of sexual difference, the renewal of the critical theory tradition, and the importation of continental philosophy into literary theory. An exploration of Chinese during a time of monumental change, The period after the fall of the Han dynasty.

This paper examines moral problems that arise when assigning liability in causally problematic mass exposure tort cases. It examines the relevance of different conceptions of corrective justice for such assignments of liability. It explores an analogy between the expressive role of punishment and the expressive role of tort, and argues that the imposition of liability in causally problematic mass exposure cases can be justified by appeal to expressive considerations.

Expressions like _two novels_ are traditionally taken to convey information about cardinality and are analyzed using a cardinality function. Salmon (Philosop Perspect 11:1–15, 1997), Liebesman (Australasian J Philos 93:21–42, 2015; Philos’ Impr 16:1–25, 2016; In D. W. Zimmerman (ed.), Oxford studies in metaphysics, Oxford University Press, Oxford, forthcoming), and Haida and Trinh (in: Dočekal, Wagiel (eds) Formal approaches to number in Slavic and beyond, Language Science Press, Berlin, 2001) argue against this traditional account, claiming that it can’t explain our use (...) of expressions like _two and a half novels_. According to them, the proper analysis of such expressions requires a partiality measure, which maps entities to rational numbers such as 2.5. In this paper, we set out to defend the traditional account. To do so, we demonstrate that an analysis based on a partiality measure is inconsistent with the truth conditions of plural comparatives and equatives. We also show that such an account doesn’t provide an adequate analysis for expressions like _two novels and a half_, nor for their French counterparts (e.g., _deux romans et demi_). Critically, such expressions contain no constituent that could refer to the number 2.5. We provide an alternative analysis for all these expressions, based on cardinality and an operation of non-overlapping summation. (shrink)

Humanity’s desire for change but not instability is explored. In this context, it is proposed that a key ‘balancing aid’ of society is openness. Converse attributes, such as secrecy, reserve and tact, are also discussed, following the ideas of Sissela Bok. A particular interest in openness can be traced to the thought and advocacy of Niels Bohr, at the beginning of the nuclear age, when the problems were thought about mainly in terms of security. His ideas and efforts to promote (...) an open world are reviewed in the light of subsequent developments. These developments are not restricted to nuclear matters. The qualitative proliferation of kinds of instability (perhaps combining into John Beddington’s ‘perfect storm’) is relevant. This proliferation justifies extension of Bohr’s concerns with security to the wider realm of stability. It is also proposed in this paper that Bohr’s use of the term confidence, which was an important element of his argument for an open world, requires refinement, with a distinction between confidence in others (trust) and self-confidence (necessary for openness). Expressivism's problem in solving the Frege/Geach problem concerning unasserted contexts is evaluated in the light of Blackburn's own methodological commitment to assessing philosophical theories in terms of costs and benefits, notably quasi-realism's aim of minimising the ontological commitments of a broadly naturalistic worldview. The problem emerges when a competitor theory can explain the same phenomena at lower cost: the minimalist about truth has no problem with unasserted contexts whereas the quasi-realist/expressivist package does. However, this form of projectivism is supposed to (...) be a local and contrastive thesis or the central metaphor of projection makes no sense. So in competition with minimalism, projectivism must - at least for non-contested areas of thought and language - presuppose non-minimal truth. This casts new light on Blackburn's proposal globally to revise the relations between logic and truth so as to model ethical discourse as tracking a notion of commitment to contents that can be either attitudinal or truh evaluable. Why globally revise logic, in order solely to explain the problem of unasserted contexts, when a rival view can do so much better according to the standards set by the quasi-realist? Why do so when a notion of non-minimal truth and a classical explanation of logic are already available to you, given the local and contrastive claims of quasi-realism? (shrink)
