Carceral spaces such as prisons are designed to restrict freedoms and keep inhabitants confined and under surveillance through various mechanisms. As a result, prisons are spaces where movement is restricted through confinement, while prisoners’ ability to move is conflated with freedom. We aim to move beyond this dichotomy and consider a complex rethinking of the body in criminological theory and practice through dance in carceral space. In doing so, we explore under what conditions movement represents agentic practices. Understanding these nuances (...) requires an interrogation of prisoner agency, including prisoners’ subtle maneuverability of power dynamics within the prison. We explore these dynamics using feminist and arts-based methods, specifically dance workshops delivered to twenty participants incarcerated in a Canadian provincial women’s prison. We find that movement and expression in prison may create moments of agentic freedom for incarcerated women under certain conditions. We argue that more nuanced understandings of incarcerated women’s agency can be found in their daily negotiations of time and space, and movement can provide numerous meanings. Our findings suggest arts-based approaches within prison environments create opportunities for women to express their identity and sexuality through movement in ways otherwise not permitted in prison. For many incarcerated women in this study, this sense of freedom may be associated with the ability to focus and take care of themselves while confined. (shrink)

The misleading and propagandistic tendencies in American news reporting have been a part of public discussion from its earliest days as a republic (Innis, 2007;Sheppard, 2007). “Fake news” is hardly new (McKernon, 1925), and the term has been applied to a variety of distinct phenomenon ranging from satire to news, which one may find disagreeable (Jankowski, 2018;Tandoc et al., 2018). However, this problem has become increasingly acute in recent years with the Macquarie Dictionary declaring “fake news” the word of (...) the year in 2016 (Lavoipierre, 2017). The international recognition of fake news as a problem (Pomerantsev and Weiss, 2014;Applebaum and Lucas, 2016) has led to a number of initiatives to mitigate perceived causes, with varying levels of success (Flanagin and Metzger, 2014;Horne and Adali, 2017;Sample et al., 2018). The inability to create a holistic solution continues to stymie researchers and vested parties. A significant contributor to the problem is the interdisciplinary nature of digital deception. While technology enables the rapid and wide dissemination of digitally deceptive data, the design and consumption of data rely on a mixture of psychology, sociology, political science, economics, linguistics, marketing, and fine arts. The authors for this effort discuss deception’s history, both old and new, from an interdisciplinary viewpoint and then proceed to discuss how various disciplines contribute to aiding in the detection and countering of fake news narratives. A discussion of various fake news types (printed, staged events, altered photographs, and deep fakes) ensues with the various technologies being used to identify these; the shortcomings of those technologies and finally the insights offered by the other disciplines can be incorporated to improve outcomes. A three-point evaluation model that focuses on contextual data evaluation, pattern spread, and archival analysis of both the author and publication archives is introduced. While the model put forth cannot determine fact from fiction, the ability to measure distance from fact across various domains provides a starting point for evaluating the veracity of a new story. Recent treatments of imagination have increasingly treated imagining as a skill. Insofar as imaginative accuracy is one of the factors that underwrites this skill, it is important to understand what it means to say that an imagining is accurate. This paper takes up that task. The discussion proceeds in four parts. First, I address two worries that may naturally arise about the coherence ofthe notion of imaginative accuracy. Second, with those worries addressed, I turn to an exploration of what is (...) meant by imaginative accuracy. My discussion relies on two key points: first, that accuracy is best understood in terms of aim; and second, that imaginings aim at the representation of fictional states of affairs. I call this line of thought _the fictionality approach_. Third, I look more closely at six different types of imaginings in an effort to develop and clarify the fictionality approach. Finally, I turn to what I call the calibration objection. Given the nature of imagination, there seems to be no way to calibrate one’s judgments of imaginative accuracy. After showing how much of the force of the calibration objection can be defused, I offer some brief concluding remarks. (shrink)

This article uses critical discourse analysis to investigate artificial intelligence (AI) generated images of aged care nurses and considers how perspectives and perceptions impact upon the recruitment and retention of nurses. The article demonstrates a recontextualization of aged care nursing, giving rise to hidden ideologies including harmful stereotypes which allow for discrimination and exploitation. It is argued that this may imply that nurses require fewer clinical skills in aged care, diminishing the value of working in this area. AI relies on (...) existing data sets, and thus represent existing stereotypes and biases. The discourse analysis has highlighted key issues which may further impact upon nursing recruitment and retention, and advocates for stronger ethical consideration, including the use of experts in data validation, for the way that aged care services and nurses are depicted and thus valued. Who should have the authority to shape the education of citizens in a democracy? This is the central question posed by Amy Gutmann in the first book-length study of the democratic theory of education. The author tackles a wide range of issues, from the democratic case against book banning to the role of teachers' unions in education, as well as the vexed questions of public support for private schools and affirmative action in college admissions.

The tension between reason and power has a long and illustrious history in political theory. In his magnum opus of legal and political theory, "Between Facts and Norms," Jürgen Habermas presents his most complex, sophisticated, and ambitious attempt to confront this tension. My thesis in this article is that though Habermas’s political theory thematizes the tension between reason and power in a way that is initially quite promising, he ultimately forecloses that tension in the direction of a rationality that has (...) been conceptually and methodologically purified of the strategic power relations that pervade social reality. His attempt to insulate his Arendtian notion of communicative power (which he conceptualizes in BFN as a force of legitimation) from strategic power is not only unattainable in practice, I argue, but conceptually incoherent. This should compel him not to abandon his normative theoretical and political agenda, I suggest, but to defend it in a more contextualist way than he has been willing to do up until now. (shrink)

While Okin's feminist appropriation of Rawls's theory of justice requires that principles of justice be applied directly to the family, Rawls seems to require only that the family be minimally just. Rawls's recent proposal dulls the critical edge of liberalism by capitulating too much to those holding sexist doctrines. Okin's proposal, however, is insufficiently flexible. An alternative account of the relation of the political and the nonpolitical is offered by Jürgen Habermas.

In modern pluralist societies, political disagreement often reflects moral disagreement, as citizens with conflicting perspectives on fundamental values debate the laws that govern their public life. Any satisfactory theory of democracy must provide a way of dealing with this moral disagreement. A fundamental problem confronting all democratic theorists is to find a morally justifiable way of making binding collective decisions in the face of continuing moral conflict.

Agamben’s potentiality, and Chinese dao, entail experiencing movement on being. This article presents our experiments with these movements in the context of pedagogy, putting at stake our mode of existence in thinking. We examine Agamben’s potentiality as an aporetic experience in pedagogy. We find echoes of dao movement in a controversial pedagogical event in China. Interlacing potentiality and dao with our experience of pedagogical thinking, each makes the other intelligible. We show that reasonings of pedagogy in the USA and China (...) repeat the very paradoxes and exclusions they seek to overcome. We also gesture towards a way that, suspending and holding pedagogical reasoning in being empty, welcomes what cannot be learned or taught. This way also offers an example for comparative education. Why do laws and regulations marking boundaries between humans and other animals proliferate amid widespread proclamations of the waning of the species concept and the consensus that life is a continuum? Here I consider a recent spate of new guidelines and regulations in the United Kingdom and United States that work to estrange human bodies from other animals in biomedicine. Using the idea of a bioconstitutional moment to understand how state institutions deliberate over “human–animal chimeras,” I address how nations differently (...) establish separations between humans and other animals. New chimeric entities, containing human hereditary material, have consecrated regulatory ground and signify increased attention to fields of research that have long used interspecies mixing. Regulators and policy makers now find themselves in a curious position. On the one hand, they continue to regulate the estrangement between humans and other animals, but on the other, they support the creation of chimeric life––a form of life that draws into question the very basis of such separations. Pandemic disruptions to schooling threw into sharper relief the entanglements of economy, gender norms, and education that had been there, and throughout the modern world, all along. The particular entanglement this paper aims to unravel is the reliance of education on a certain kind of attentiveness, historically provided by a feminized teaching force and mothers, that itself rests on the cultivation of particular sensibilities regarding time.

Moreover, we need to value expertise from experience so that autistic people have a voice and indeed a stake in research into autism.

Robert Veatch was a notable and prolific author in a variety of areas in philosophy, health care practice, and policy. However, it is evident by the sheer number of case study in ethics books, eighteen editions of case collections in all, that this approach to teaching ethics in the health sciences was especially important to him. A few of these case study collections he wrote alone, but the majority were written with co-authors from nursing, dentistry, pharmacy, allied health, and medicine, (...) drawing on their respective areas of disciplinary expertise and experience as educators. The aim of this article is to focus on the pedagogy and framework Veatch developed to expose students to the rudiments of philosophical ethics so they could understand the conflicts between values, principles, and ethical theories. Authentic clinical cases, he believed, were a useful way to engage students. Putting the two ideas together, Veatch argued the best method of structuring cases is “bootlegging theory in a topical structure” (Veatch, Robert M., Case analysis in ethics instruction. In: Amy Haddad (ed) Teaching and learning strategies in pharmacy ethics, Creighton University, Omaha, 85–97, 1992). Veatch’s rationale for this carefully planned systematic arrangement between case topics and philosophical ethics content are presented. The influence and input of co-authors from different disciplines are explored regarding case development and commentary content. The COVID-19 pandemic has brought the live music industry to an abrupt halt; subsequently, musicians are looking for ways to replicate the live concert experience virtually. The present study sought to investigate differences in aesthetic judgments of a live concert vs. a recorded concert, and whether these responses vary based on congruence between musical artist and piece. Participants made continuous ratings of their felt pleasure either during a live concert or while viewing an audiovisual recorded version of the same joint (...) concert given by a university band and a United States Army band. Each band played two pieces: a United States patriotic piece and a non-patriotic piece. Results indicate that, on average, participants reported more pleasure while listening to pieces that were congruent, which did not vary based on live vs. lab listening context: listeners preferred patriotic music when played by the army band and non-patriotic music when played by the university band. Overall, these results indicate that felt pleasure in response to music may vary based on listener expectations of the musical artist, such that listeners prefer musical pieces that “fit” with the particular artist. When considering implications for concerts during the COVID-19 pandemic, our results indicate that listeners may experience similar degrees of pleasure even while viewing a recorded concert, suggesting that virtual concerts are a reasonable way to elicit pleasure from audiences when live performances are not possible. A survey of periodical indexes for the past ten years shows that references to purity occur predominantly in metallurgy. Purity is an increasingly important topic in anthropology, religious studies, and history, but it is a decidedly rare concern in philosophy. In my most recent search I found three references.Yet “purity” (...) was once a recurrent term in the philosophical tradition ranging from Plato through Augustine and Kant to Kierkegaard. Today when we encounter the many references to purity in the history of philosophy we too often filter them out. We assume either that “pure” is a generic term for good, or, in what seems a more knowing and sophisticated response, we read “pure” as a code term for chastity or sexual morality, the elimination, suppression or control of sexual desire. In both cases purity is written off either as a generic or as an old fashioned and rather embarrassing virtue. Hence it seems there is little reason for contemporary philosophical investigation into the rhetorical use of the language of purity and pollution.Three assumptions account for the lack of contemporary philosophical interest in the topic. First, it is assumed that purity is no longer a concern in twentieth-century philosophy. Second, purity in historical discourse is considered to be limited to a prudish or downright misogynist hostility to sex. Third and finally, it is assumed that the work historians and anthropologists have done recently into connections between purity beliefs and practices and social cohesion is irrelevant for philosophy. This is because purity in philosophy is supposed to be a resolutely individualist virtue, having little or nothing to do with unified and coherent communities.There are elements of truth to all three beliefs, but they also contain important distortions of the truth. As regards the first assumption, purity remains a concern in contemporary aesthetics, where it often means roughly something like a priori and apolitical; but I am interested in whether the concern with purity has survived in philosophies with ethical implications. [End Page 509] Here it is my contention that authenticity is the twentieth-century descendant of the virtue of purity.Second, there is much more to the rhetoric and practices of purity than concern with the sexual dimension of life, though this is a key aspect of most, and the beliefs and practices are often misogynist. There have been numerous anthropological documentations of ways in which purity beliefs, particularly an emphasis on sexual purity, are used to control women. Santi Rozario’s work, for instance, makes this point in her analysis of contemporary Bengali village life. 1 The connection between the language of purity and the practice of female circumcision, which I will not discuss in this paper, is in itself evidence enough of connections between purity beliefs and practices harmful to women. 2 However, I hope to show that there is more to purity than misogyny. Purity most basically is about order, both social and personal. 3My response to the second assumption, that purity masks an obsession with sexual control, indicates the source of my disagreement with the third, the contention that purity in philosophy is exclusively an individual virtue. Communal beliefs and practices associated with the language of purity and pollution are relevant to the philosophical treatment of purity because of the presence in both the practices and the philosophies of an interplay between social and personal order. As a result I believe an understanding of the dynamics of beliefs about purity in social practice can inform a philosophical concern with purity.First I investigate shifts in beliefs and practices concerning purity and pollution. I will concentrate on three models: ancient Greek (from the eighth to the third century BC), biblical to Talmudic Judaism (from the third century BC to the third century AD), and early Christian (from the first to the fifth century AD). I investigate Jean-Luc Marion's phenomenology of love and its relation to ethics. I argue that his phenomenology of love provides a possibility for developing ethics. I rely on the saturated phenomenon of the icon and his phenomenology of love. I establish that the icon provides a rich sense of relation, a need to modify certain appraisals of justice, and provides a descriptive account of the virtue of receptivity. In chapter one, I give an exegesis of Marion's phenomenology of the icon. (...) He argues that the icon moves toward charity, yet does not relate to ethics. Experience of the icon gives transformed vision that voids universal laws and frees the beholder to experience communion. In chapter two, I provide three examples of iconic experience that emphasize the importance of justice for the icon in contrast to Marion's formulation that justice is equivalent to revenge. I argue that Marion attacks justice because of its link to a deontological definition; yet, freed from deontology, Marion makes room for an apophatic way that moves toward a virtue ethic. In chapter three, I look at Marion's reasons for leaving ethics out of the icon. His critique of Kantian ethics, as well as his use and critique of the Levinas suggest that he opposes modern metaphysical ethics. In discussion of the receptivity to the call of the Other, he relies on the virtues. This reliance shows that Marion has room for a descriptive account of ethics, and that ignoring ethics undermines his overall project. I investigate Marion's claim that the icon opens up to charity by reading the apophatic doctrine of the icon in concert with the erotic reduction. I conclude that Marion’s phenomenology can be viewed as a counter-ethics a way to see phenomenology as a virtue practice, to unify reason and love in ethics, to remove the ego from the central concern of ethics, and to see the need for openness and vulnerability to the iconic other. In this paper, by analyzing the Chalmers-Searle debate about Chalmers’ zombie thought experiment, I attempt to determine the implications that the irreducibility of consciousness has for the truth of materialism. While Chalmers claims that the irreducibility of consciousness forces us to embrace dualism, Searle claims that it has no deep metaphysical import and, in particular, that it is fully consistent with his materialist theory of mind. I argue that this disagreement hinges on the notion of physical identity in play in (...) the discussion. Clarifying this notion in turn helps to clarify what it means to claim that consciousness is irreducible, and provides insight into the implications that the truth of this claim would have for the dualism-materialism debate. Ultimately, I suggest that the sort of irreducibility that can be motivated by the zombie thought experiment is not sufficient to require the rejection of materialism. (shrink)

Much of the most substantive and in‐depth experience with formal cost‐benefit analysis in the public policy realm has occurred in the context of federal environmental regulation in the United States. This experience has many important lessons to teach in the realm of synthetic biology. Indeed, many of the dangers and pitfalls that arise when decision‐makers use formal CBA to evaluate environmental regulation seem likely to arise in the synthetic biology context as well, sometimes in particularly troubling forms. Unfortunately, while in (...) many instances these concerns may well point toward a rejection of formal CBA for synthetic biology, the experience from environmental regulation turns out to be far less helpful in identifying alternative decision‐making tools. Because the decisions that arise in the synthetic biology context have a fundamentally different structure from decisions about environmental regulation, the most useful alternatives from that context do not map easily onto this new context.It may well be generally true that in the search for decision‐making tools, we should not be looking for a single silver bullet that will work in all public policy realms. Perhaps, instead, different kinds of decision‐making call for different tools. This may be true even within the realm of synthetic biology. I am not entirely sure what the “right” tool is for synthetic biology applications, or even whether a “right” tool exists. But at the end of this essay, I offer a few tentative thoughts about why scenario analysis—a strategic planning tool first developed in the context of military planning following World War II—might be one alternative worth considering.
