The adversary professions--law, business, and government, among others--typically claim a moral permission to violate persons in ways that, if not for the professional role, would be morally wrong. Lawyers advance bad ends and deceive, business managers exploit and despoil, public officials enforce unjust laws, and doctors keep confidences that, if disclosed, would prevent harm. Ethics for Adversaries is a philosophical inquiry into arguments that are offered to defend seemingly wrongful actions performed by those who occupy what Montaigne called "necessary offices."Applbaum (...) begins by examining the career of Charles-Henri Sanson, who is appointed executioner of Paris by Louis XVI and serves the punitive needs of the ancien régime for decades. Come the French Revolution, the King's Executioner becomes the king's executioner, and he ministers with professional detachment to each defeated political faction throughout the Terror and its aftermath. By exploring one extraordinary role and the arguments that can be offered in its defense, Applbaum raises unsettling doubts about arguments in defense of less sanguinary professions and their practices.To justify harmful acts, adversaries appeal to arguments about the rules of the game, fair play, consent, the social construction of actions and actors, good outcomes in equilibrium, and the legitimate authority of institutions. Applbaum concludes that these arguments are weaker than supposed and do not morally justify much of the violation that professionals and public officials inflict. The aim of this article is to assess the impact of Big Data technologies for insurance ratemaking, with a special focus on motor products.The first part shows how statistics and insurance mechanisms adopted the same aggregate viewpoint. It made visible regularities that were invisible at the individual level, further supporting the classificatory approach of insurance and the assumption that all members of a class are identical risks. The second part focuses on the reversal of perspective currently occurring in data analysis (...) with predictive analytics, and how this conceptually contradicts the collective basis of insurance. The tremendous volume of data and the personalization promise through accurate individual prediction indeed deeply shakes the homogeneity hypothesis behind pooling. The third part attempts to assess the extent of this shift in motor insurance. Onboard devices that collect continuous driving behavioural data could import this new paradigm into these products. An examination of the current state of research on models with telematics data shows however that the epistemological leap, for now, has not happened. (shrink)

This paper addresses the “inefficiency loophole” in the Bell theorem. We examine factorizable stochastic models for the Bell inequalities, where we allow the detection efficiency to depend both on the “hidden” state of the measured system and also its passage through an analyzer. We show that, nevertheless, if the efficiency functions are symmetric between the two wings of the experiment, one can dispense with supplementary assumptions and derive new inequalities that enable the models to be tested even for highly inefficient (...) experiments. We show relative to strong hypotheses that patterns of compact cardinals in the universe, where a compact cardinal is one which is either strongly compact or supercompact, can be virtually arbitrary. Specifically, we prove if V “ZFC + Ω is the least inaccessible limit of measurable limits of supercompact cardinals + ƒ : Ω → 2 is a function”, then there is a partial ordering P V so that for , There is a proper class of compact cardinals + If (...) ƒ = 0, then the αth compact cardinal is not supercompact + If ƒ = 1, then the αth compact cardinal is supercompact”. We then prove a generalized version of this theorem assuming κ is a supercompact limit of supercompact cardinals and ƒ : κ → 2 is a function, and we derive as corollaries of the generalized version of the theorem the consistency of the least measurable limit of supercompact cardinals being the same as the least measurable limit of nonsupercompact strongly compact cardinals and the consistency of the least supercompact cardinal being a limit of strongly compact cardinals. In one of the few widely discussed passages in the Doctrine of Right, Kant makes the surprising claim that a shipwrecked sailor who dislodges another from a plank that will support only one of them is "culpable, but not punishable." Many commentators regard this passage as a sort of smoking gun that shows that, in extremis, Kant resorts to the very sort of empirical and consequentialist reasoning that he claims to do without.2 My aim in this paper is to defend (...) his analysis, by showing both that it can be generalized, and that it provides a satisfying account of the normative boundary between justification and excuse in the criminal law. After explaining Kant ’s remark in light of the context in which he makes it, my main strategy of defense will be to show how it applies not only to the specific example Kant considers, but also to cases in which a person responds to danger by damaging property, and those in which a person whose own life is not in danger breaks the law to save the life of another. I will also use his account to illustrate the difficulties with the leading alternatives. (shrink)

I WISH to defend the claim that imagining what it would be like to be in "someone else's shoes" can serve to explain that person's actions. This commonsense view has considerable plausibility, but requires clarification to be philosophically defensible; discussions of explanation often assume that understanding requires a theory of the thing understood. If understanding requires a theory, then however much imagining what it would be like to be in another person's situation might sooth one's curiosity, it cannot provide real (...) understanding. I shall argue that imagining oneself in someone else's situation does more than that: it allows actions to be explained without recourse to a theory of human behavior. The resulting explanations are real explanations, not just some reassuring facsimile thereof. (shrink)

In 1924, Bohr, Kramers and Slater tried to introduce into microphysics conservation principles that hold only on the average. This attempt was abandoned in the light of the Compton-Simon experiment. Since that time, except for a moment of doubt in 1936, it has been thought that the classical conservation laws hold in quantum theory for each individual interaction, in a way that yields the classical exchange-and-balance of momentum familiar from the laws of elastic collisions. It has been thought, that is, (...) that in each individual “collision” what one part of the total system loses in linear momentum another part gains, so as to maintain the same total amount afterwards as before. To those familiar with discussions of the interpretation of quantum theory, however, it will be apparent that the very concepts needed to express this idea of an elastic collision are generally not admitted in the theory. For one needs the idea that both before and after collision the total system has a well-defined value for the conserved quantity and, moreover, that the various component parts of the system have well-defined values for those quantities out of which the conserved one is composed. But in the case of spin, for example, it is customary to say that although total spin may be conserved in certain interactions one cannot attribute values to the separate components of spin because the associated operators do not commute. Moreover, one does not generally refer to the values of quantities except in eigenstates. Hence, in general, one would not refer to the value of the conserved quantity before and after interaction, except for interactions initiated in eigenstates. (shrink)

The world today is facing unprecedented challenges of governance far beyond what the United Nations, established more than 70 years ago, was designed to face. The grave effects of global climate change are already manifesting themselves, requiring rapid, far-reaching and unprecedented changes in all aspects of society if we are to arrest catastrophic and probably irreversible consequences. The rejection by some nations of the benefits of multilaterism and international cooperation, which have been at the center of the postwar global order, has heightened the risks of fundamental instabilities that could precipitate a range of major crises, disregarding the lessons of the past. Com base nestes critérios, Kant pensa que a aritmética não usa juízos analíticos. Em oposição, Frege defende, nos Fundamentos da aritmética (1884), que a teoria kantiana de analiticidade é equivocada e que juízos analíticos, incluindo os aritméticos, são lógicos. Pretende-se, portanto, com o uso da literatura secundária em (...) Hanna (2004), discutir as doutrinas de Kant e Frege acerca disso, sugerindo que a teoria de Kant não consegue se sustentar e que a teoria de Frege, embora problemática, possui um ponto promissor a partir da semântica de mundos possíveis de Plantinga (1974) e Kripke (2012). One variant of this question asks if κ is strongly compact and GCH fails at every regular cardinal δ < κ, then must GCH fail at some regular cardinal δ ≥ κ? Another variant asks if it is possible for GCH to fail at every limit cardinal less than or equal to a strongly compact cardinal κ. We get a negative (...) answer to the first of these questions and positive answers to the second of these questions for a supercompact cardinal κ in the context of the absence of the full Axiom of Choice. A proof method for automation of reasoning in a paraconsistent logic, the calculus C1* of da Costa, is presented. The method is analytical, using a specially designed tableau system. Actually two tableau systems were created. A first one, with a small number of rules in order to be mathematically convenient, is used to prove the soundness and the completeness of the method. The other one, which is equivalent to the former, is a system of derived rules designed to enhance computational (...) efficiency. A prototype based on this second system was effectively implemented. One is tempted to look upon the positive and the logical somewhat as one looks upon the quick and the dead. Yet the issue is hardly that sharp. Viability has strange possibilities and varied forms, and must often be appraised with an eye directed as much towards the environment as towards the claimant organism. Stretching the application of the word ‘viable’ to complexes of behavior such as the philosophies and theories of knowledge, we may ask: Is the combination of the (...) positive and the logical in logical positivism viable?
