This paper describes the automated classification of legal norms in German statutes with regard to their semantic type. We propose a semantic type taxonomy for norms in the German civil law domain consisting of nine different types focusing on functional aspects, such as Duties, Prohibitions, Permissions, etc. We performed four iterations in classifying legal norms with a rule-based approach using a manually labeled dataset, i.e., tenancy law, of the German Civil Code ). During this experiment the \ score continuously improved (...) from 0.52 to 0.78. In contrast, a machine learning based approach for the classification was implemented. A performance of \ was reached. Traditionally, machine learning classifiers lack of transparency with regard to their decisions. We extended our approach using so-called local linear approximations, which is a novel technique to analyze and inspect a trained classifier’s behavior. We can show that there are significant similarities of manually crafted knowledge, i.e., rules and pattern definitions, and the trained decision structures of machine learning approaches. (shrink)

For decades there has been a controversial debate over how far religious faith communities are specifically engaged in ecological practices (EP). Therefore we studied four Austrian and two German Benedictine monasteries religious ethics and spirituality as a means of a driving force for initiating EP. We draw upon theories of organizational learning processes and capacity-building of sustainability to interpret our empirical findings. The majority of monasteries are highly engaged in EP, initiated either as an outcome of individual activities or through (...) a specific mostly informally acting group, but rarely an organizationally or systematically integrated goal of the monasteries, or a focus of capacity building. Monasteries follow a technical and economic decision-making process in implementing EP. Spirituality plays a limited role in the initiation of EP. The environment of monasteries–acceptance or critique against ecological practices–influences the monasteries decisions. Institutionalization of ecological practices into the monasteries organizational structure is rare. (shrink)

Sequential action makes up the bulk of human daily activity, and yet much remains unknown about how people learn such actions. In one motor learning paradigm, the serial reaction time (SRT) task, people are taught a consistent sequence of button presses by cueing them with the next target response. However, the SRT task only records keypress response times to a cued target, and thus it cannot reveal the full time‐course of motion, including predictive movements. This paper describes a mouse movement (...) trajectory SRT task in which the cursor must be moved to a cued location. We replicated keypress SRT results, but also found that predictive movement—before the next cue appears—increased during the experiment. Moreover, trajectory analyses revealed that people developed a centering strategy under uncertainty. In a second experiment, we made prediction explicit, no longer cueing targets. Thus, participants had to explore the response alternatives and learn via reinforcement, receiving rewards and penalties for correct and incorrect actions, respectively. Participants were not told whether the sequence of stimuli was deterministic, nor if it would repeat, nor how long it was. Given the difficulty of the task, it is unsurprising that some learners performed poorly. However, many learners performed remarkably well, and some acquired the full 10‐item sequence within 10 repetitions. Comparing the high‐ and low‐performers’ detailed results in this reinforcement learning (RL) task with the first experiment's cued trajectory SRT task, we found similarities between the two tasks, suggesting that the effects in Experiment 1 are due to predictive, rather than reactive processes. Finally, we found that two standard model‐free reinforcement learning models fit the high‐performing participants, while the four low‐performing participants provide better fit with a simple negative recency bias model. The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Die Autoren berichten über die erste kontrollierte Psychotherapiestudie, die psychoanalytische und kognitiv-verhaltenstherapeutische Langzeitpsychotherapien mit randomisierter und präferierter Zuweisung mit­einander vergleicht. In vier Behandlungszentren wurden 554 chronisch depressive Patienten interviewt, von denen 252 in die Studie aufgenommen werden konnten. In den Selbsteinschätzungen der Patienten zeigten sich große und stabile Veränderungen. Die vollständige Remissionsrate (für BDI) lag nach einem Jahr bei 34 % und stieg auf 45 % nach drei Jahren. Analoge Ergebnisse zeigten sich in den Einschätzungen der unabhängigen, bezogen auf die (...) Therapieverfahren verblindeten Rater (QIDS). Entgegen ihrer Hypothesen fanden die Autoren aber keinen statistisch signifikanten Unterschied zwischen den Verfahren und auch keine Effektunterschiede zwischen randomisierter Therapiezuweisung und Behandlung mit der präferierten Psychotherapie. Besser als in anderen Studien sind die erzielten Remissionsraten, die zeigten, dass chronisch depressive Patienten von Langzeitpsychotherapien profitieren. (shrink)

The goal of this essay is to analyse the influence of Johann Bernhard Basedow and Rousseau on Kant’s cosmopolitanism and concept of cosmopolitan education. It argues that both Basedow and Kant defined cosmopolitan education as non-denominational moral formation or Bildung, encompassing—in different forms—a thin version of moral religion following the core tenets of Christianity. Kant’s encounter with Basedow and the Philanthropinum in Dessau helps to understand the development of Kant’s concept of cosmopolitanism and educational theory ‘in weltbürgerlicher Absicht’. Rousseau’s (...) role is more complex: he clearly influenced Kant; he is usually considered a precursor of modern nationalism and national education; and recent studies have stressed the cosmopolitan dimension of his educational programme. I claim that the dilemma of education according to Rousseau is that one has to choose between education of homme or education of citoyen, and that there is no way to avoid or go beyond this stark alternative. Kant’s reinterpretation of Rousseau is favourable and creative and has found many followers up to the present, but is misleading, as he ignores the dilemma and imposes his own conception of cosmopolitanism, of cosmopolitan education and of (possible) progress in history on Rousseau while claiming that this was actually Rousseau’s message. The article analyzes volume 19, 1793, of Neueste Critische Nachrichten, in which an anonymous review of Kant’s Religion within the boundaries of mere reason was published. Evidence is presented to establish that the review was authored by Samuel Bernhard Wilcke, a young lecturer at the University of Greifswald, who passed away the following year. After examining Wilcke’s Essay of invitation to his lectures on Kantian philosophy, the review itself is commented upon. Finally, the reviewer’s critique is related to Kant’s (...) reply in the Preface to the second edition of the Religion. (shrink)

Der Philosoph und Historiker Bernhard Groethuysen gehört zu den herausragenden Gestalten des deutsch-französischen Kulturtransfers der Zwischenkriegszeit. Zugleich gilt er aufgrund seiner historischen Schriften als einer der Wegbereiter der modernen Kultur- und Mentalitätsgeschichte. Erstmals liegt nun eine umfassende intellektuelle Biographie des Berliner Gelehrten und Pariser homme de lettres vor, die Groethuysens Leben und Werk miteinander in Verbindung setzt und im Kontext der europäischen Geistesgeschichte des 20. Jahrhunderts verortet. Ausgehend von seinem Studium bei Wilhelm Dilthey und Georg Simmel wird Groethuysens (...) Lebensweg, der ihn von der Berliner Universität in die Intellektuellenmilieus von Paris führte, nachgezeichnet. Bereits seit den frühen 1920er Jahren war die französische Hauptstadt zu Groethuysens Wahlheimat geworden. Hier verbrachte er den Großteil des Jahres, lebte im Freundeskreis von André Gide und machte als Lektor des bekannten französischen Verlags Gallimard Kafka und Musil in Frankreich bekannt. Zugleich war er bis 1933 während der Sommersemester als Professor für Philosophie an der Berliner Universität tätig. 1927 legte er mit seinem Werk über die Entstehung der bürgerlichen Welt- und Lebensanschauung in Frankreich einen Klassiker moderner Kulturgeschichtsschreibung vor, der sich als ein methodischer Brückenschlag zwischen französischer Mentalitätsgeschichte und deutscher Geistes- und Ideengeschichte lesen läßt. The monograph Drei Wurzeln des Krieges. Und warum nur eine nicht ins Verderben führt by Bernhard Taureck was published in 2019. It is one of the few current philosophical contributions on the theory of war that is not limited to the question of the moral justification of war (such as Michael Walzer’s work). Instead, the book contains not only various references to the war discourses of antiquity and their multiple references to actuality, but also a detailed examination of the (...) question of how radically war determines our history, present and future. In this book, interdisciplinary statements on Taureck’s concisely summarised approach make critical reference to this question in the common interest of finding ways out of this situation. Following the murder of George Floyd, the Black Lives Matter-movement (BLM) took to the streets to protest against institutional racism. In these protests, one could often hear the slogan “No Justice, No Peace”. Drawing on legal theory, speech act theory and phenomenology, this article investigates what kind of justice and peace are called upon and how the slogan functions as a claim addressed to the legal order. First, the article shows that the rule of law provides a comprehensive normative framework (...) to evaluate what went wrong during the arrest of George Floyd. Second, the article maintains that the slogan should be understood as a passionate utterance in the sense of Stanley Cavell. Finally, drawing on a responsive phenomenology of legal order inspired by the work of Bernhard Waldenfels, the article concludes that the slogan is an extraordinary claim questioning the legal order, showing its contingent origins. The concept of a Mannigfaltigkeit in Husserl has been given various interpretations, due to its shifting role in his works. Many authors have been misled by this term, placing it in the context of Husserl’s early period in Halle, while writing the Philosophy of Arithmetic, as a friend and colleague of Georg Cantor.Yet at the time, Husserl distanced himself explicitly from Cantor’s definition and rather took Bernhard Riemann as example, having studied and lectured extensively on Riemann’s theories of (...) space. Husserl’s Mannigfaltigkeitslehre would then not be a Cantorian set-theory, but come rather closer to topology. Then, in the Prolegomena, Husserl introduces the idea of a pure Mannigfaltigkeitslehre as a meta-theoretical enterprise which studies the relations among theories, e.g. how to derive or found one upon another. When Husserl announces that in fact the best example of such a pure theory of manifolds is what is actually practiced in mathematics, this sounds slightly misleading. The pure theory of theories cannot simply be the mathematics underlying topology, but should rather be considered as a mathesis universalis. Indeed, while this might not have been fully clear yet in 1900/1901, Husserl will explicitly tie together the notions of pure theory of manifolds and mathesis universalis. The mathesis universalis in this sense is formal, a priori and analytic, as theory of theory in general. It is an analysis of the highest categories of meaning and their correlative categories of objects. In my paper I try to understand the development of the notion of Mannigfaltigkeit in Husserl’s thought from its mathematical beginnings to its later central philosophical role, taking into account the mathematical background and context of Husserl’s own development. Based on the argument that violence has a parasitic quality rather than an essence of its own, this article seeks to bring to light the conversion processes through which violence crystallises out of, as well as into, various phenomena. Violence is first examined in terms of the relation between perpetrator and victim with, however, an emphasis on the fact that violence cannot be reduced to the intention or the act of the perpetrator. On the contrary, violence is shown to have (...) the character of pathos and to open up a dimension of which the act itself is only a part. Further, the author argues that in being directed towards the other, violence harbours a performative contradiction: by turning the addressee into a thing to be destroyed, the addressing act cancels itself. The paper also sets out to identify the breeding grounds of violence, which, due to its capacity for conversion, can be detected in various phenomena that are not necessarily linked to violence. This means that violence can resort to various mechanisms and can emerge in multiple fields of activity: in bureaucracy, economics, medicine, politics, war, and most importantly, in everyday life, hidden under inconspicuous but sometimes pervasive forms. Finally, the metamorphoses of violence are shown to ultimately rest on the temporal character of violence, which implies that violence has a time of preparation and an aftermath. (shrink)

What drives much of the current philosophical interest in the idea of group cognition is its appeal to the manifestation of psychological properties—understood broadly to include states, processes, and dispositions—that are in some important yet elusive sense emergent with respect to the minds of individual group members. Our goal in this paper is to address a set of related, conditional questions: If human mentality is real yet emergent in a modest metaphysical sense only, then: (i) What would it mean for (...) a group to have emergent cognitive states? (ii) Is this even a metaphysically coherent view? (iii) Relative to which notion of emergence do we have reason to believe that certain groups in fact have emergent cognitive states? We shall argue that evidence from a wide variety of social science domains makes it plausible that there are group cognitive states and processes no less metaphysically emergent than human cognitive (and other special science) states and processes. Activism undertaken by CEOs has been on the rise in recent years. Research on this practice has been primarily concerned with determining the conditions under which a CEO’s public statements on sociopolitical issues are beneficial or detrimental to her firm’s business performance. We complement this instrumental perspective on CEO activism with an ethical investigation of the implications of CEO activism for the democratic process. Drawing on political philosophy, we show that the answer to the question of whether CEO activism is (...) conducive to the democratic process depends on the view of democracy that is adopted. From the perspective of liberalism, the sole requirement that an instance of CEO activism must fulfill is that it is lawful, provided that the applicable law sufficiently protects people’s essential rights. However, from the viewpoint of republicanism, this is not a sufficient condition. Besides being law-abiding, CEOs should be “civic-minded” when intervening in public debates, i.e., concerned with the quality and fairness with which those debates are conducted. Based on the literature on republicanism, we suggest four possible criteria that civic-minded CEOs can apply to gauge the democratic conduciveness of a possible public intervention: added insight, timeliness, constructiveness, and transparency. Our article complements the predominantly instrumentally oriented literature on CEO activism and contributes, more broadly, to the literature that explores the normative dimensions of corporate political involvement, as well as to a growing strand of research that draws on philosophical theory to inform business leaders’ ethical decision-making.
