La pensée du jurisconsulte anglais Jeremy Bentham (1748-1832) se prête particulièrement bien à une approche interdisciplinaire telle que celle qui est menée dans le présent ouvrage. Si Bentham, en effet, a consacré l'essentiel de ses travaux à des projets de réforme de la société anglaise de son temps par le biais de la codification des lois, il n'a cessé d'enrichir cette réflexion par des emprunts faits à d'autres disciplines, dans lesquelles il était également passé maître, telles la morale, la psychologie, (...) la logique, la théorie du langage, l'économie ou la politique.Cette pensée, à la fois plurielle et ambiguë (est-elle conservatrice, réformiste, révolutionnaire ou utopique? Est-elle descriptive, explicative ou normative?), révèle aujourd'hui son étonnante actualité. Il est peu de thèmes juridiques contemporains qui ne trouvent en effet leur place dans l'oeuvre de Bentham : ainsi les questions de l'utilité, de la balance des intérêts, de la constitution d'une science du droit et d'une logique déontique ; ainsi les concepts de système juridique, de codification, de déontologie, de contrôle social, d'opinion publique et de majorité politique. L'intérêt de cette « relecture » de la pensée de Bentham réside dès lors sans doute moins dans l'exégèse de ses multiples détours que dans la mise en lumière de ses ambiguïtés et de ses limites qui, pour une large part, sont aussi les nôtres. Parmi celles-ci, l'oscillation constante, déjà inscrite dans les textes benthamiens, entre deux figures de l'État moderne (État libéral et État-providence), n'est sans doute pas la moins actuelle. Developing countries face numerous barriers to conducting effective and efficient ethics reviews of international collaborative research. In addition to potentially overlooking important scientific and ethical considerations, inadequate or insufficiently trained ethics committees may insist on unwarranted changes to protocols that can impair a study's scientific or ethical validity. Moreover, poorly functioning review systems can impose substantial delays on the commencement of research, which needlessly undermine the development of new interventions for urgent medical needs. In response to these concerns, the Drugs (...) for Neglected Diseases Initiative, an independent nonprofit organization founded by a coalition of public sector and international organizations, developed a mechanism to facilitate more effective and efficient host country ethics review for a study of the use of fexinidazole for the treatment of late stage African Trypanosomiasis. The project involved the implementation of a novel ‘pre-review’ process of ethical oversight, conducted by an ad hoc committee of ethics committee representatives from African and European countries, in collaboration with internationally recognized scientific experts. L'importance de Duns Scot (1265?-1308) pour l'histoire de la métaphysique et de l'éthique n'est plus à démontrer. En demandant à Olivier Boulnois de recueillir ces études, Philosophie tente de se faire l'écho de la floraison récente de travaux consacrés à cet auteur, aussi bien à l'étranger qu'en France. L'article de Stephen Dumont souligne la place fondamentale de Scot dans l'histoire de la métaphysique. Mais au lieu de se centrer sur la tradition moderne de la métaphysique transcendantale (de Suarez à (...) Kant), il insiste sur le fait que Scot résout l'énigme de la Métaphysique d'Aristote en réduisant sa dimension théologique de celle-ci à sa dimension ontologique. La philosophie scotiste apparaît ainsi comme l'aboutissement d'une exploration systématique des possibilités d'interprétation ouvertes par le texte aristotélicien. L'étude d'Olivier Boulnois fait la transition entre la métaphysique et l'éthique. Elle s'interroge sur le fondement métaphysique de l'éthique scotiste et montre comment le primat d'une volonté libre, et, dans le monde fini, la contingence de la loi morale, s'accompagnent d'une objectivité du bien. La rigueur de la liberté n'est précisément pas l'arbitraire. Gérard Sondag, quant à lui, pose, à partir d'un point très précis d'exégèse aristotélicienne - pour quelle raison le citoyen courageux expose-t-il sa vie quand la Cité est en danger? - la question du fondement éthique du sacrifice de soi. En rejetant, dans sa réponse, toute éthique de l'intérêt personnel, et en posant une objectivité de la norme éthique indépendante de notre propre avantage, Scot ouvre une voie qui conduit à la morale normative de Kant. Duns Scot apparaît ainsi à la fois comme le refondateur de la métaphysique comme discipline transcendantale et comme un penseur original de l'éthique. Unissant ces deux dimensions, il est l'auteur d'une véritable métaphysique de l'éthique. (shrink)

An attempt to bring Husserl’s phenomenology and psychopathology closer, based on the text of § 49 of the Ideen. What is an experience of annihilation of the world? How is a world undone? We will focus on the examples of the end of the world described in the stories of Gérard de Nerval and in the patients of Wolfgang Blankenburg.

Polish translation of an article by Gérard Chazal, devoted to the relationship of François Dagognet’s philosophy to the work of Gaston Bachelard. The author shows the complexity of this relationship, analyzing it in relation to the philosophy of science, the philosophy of technology and the philosophy of art. In many dimensions Chazal shows that Dagognet was inspired not so much by the letter of Bachelard’s texts as by their spirit, using his methods and concepts in areas that Bachelard (...) was not or only marginally interested in. The article is also an interesting voice in the discussion about the essence of the reception of philosophical concepts and currents. In this aspect author asks about the negation of the source theory in its continuations at the same time asking whether it is not this kind of negative inspiration that best testifies to the vitality of the theory — alive due to constant creative transformations. Research on employees’ responses to corporate social responsibility has recently accelerated and begun appearing in top-tier academic journals. However, existing findings are still largely fragmented, and this stream of research lacks theoretical consolidation. This article integrates the diffuse and multi-disciplinary literature on CSR micro-level influences in a theoretically driven conceptual framework that contributes to explain and predict when, why, and how employees might react to CSR activity in a way that influences organizations’ economic and social performance. Drawing on social identity (...) theory and social exchange theory, we delineate the different but interdependent psychological mechanisms that explain how CSR can strengthen the employee–organization relationship and subsequently foster employee-related, micro-level outcomes. Contributions of our framework to extant literature and potential extensions for future research are then discussed. (shrink)

For the contemporary reader of Psychoanalysis: Its Image and Its Public the analyses of communicative systems in the book provides a challenging occasion for reconsidering current social psychological thinking about the character of social groups. In Moscovici's careful delineation of the communicative systems of diffusion, propagation and propaganda through his content analysis of the French press, one can also see the description of different types of group structured through distinctive social psychological organisations. Moscovici himself suggests that the genres of diffusion, (...) propagation and propaganda are each linked to the construction of a specific type of social-psychological object, opinion, attitude and stereotype respectively. But one can also identify different forms of affiliation corresponding to each communicative genre, and consequently also different representations of the people who constitute both the in-group and the out-group in each instance. The affiliative bonds might be described as forms of sympathy, communion and solidarity. (shrink)

Understanding the link between brain evolution and the evolution of distinctive features of modern human cognition is a fundamental challenge. A still unresolved question concerns the co-evolution of tool behavior (i.e., tool use or tool making) and language. The shared neurocognitive processes hypothesis suggests that the emergence of the combinatorial component of language skills within the frontal lobe/Broca's area made possible the complexification of tool-making skills. The importance of the frontal lobe/Broca's area in tool behavior is somewhat surprising with regard (...) to the literature on neuropsychology and cognitive neuroscience, which has instead stressed the critical role of the left inferior parietal lobe. Therefore, to be complete, any version of the shared neurocognitive processes hypothesis needs to integrate the potential interactions between the frontal lobe/Broca's area and the left inferior parietal lobe as well as their co-evolution at a phylogenetic level. Here, we sought to provide the first elements of answer through the use of the massive deployment framework, which posits that evolutionarily older brain areas are deployed in more cognitive functions (i.e., they are less specific). We focused on the left parietal cortex, and particularly the left areas PF, PGI, and anterior intraparietal (AIP), which are known to be involved in tool use, language, and motor control, respectively. The deployment of each brain area in different cognitive functions was measured by conducting a meta-analysis of neuroimaging studies. Our results confirmed the pattern of specificity for each brain area and also showed that the left area PGI was far less specific than the left areas PF and AIP. From these findings, we discuss the different evolutionary scenarios depicting the potential co-evolution of the combinatorial and generative components of language and tool behavior in our lineage. At times decisions are made in the field of genetics that are presented as if the ethical debates have been adequately treated and so all moral considerations have been addressed, when the truth is very different. Nor is it always easy or desirable to separate the ethical, legal and social questions posed by new developments. The impact of developments in genetic science upon communities is one field of enquiry that envelops each of these areas.This paper explores the impact of genetics (...) upon communities through focusing, in particular, upon certain developments in reproductive science. After introducing core issues and technologies, it discusses particular ethical concerns in relation to the ‘shadow’ of eugenics over such developments, before exploring the role of legislative debates and procedures in transforming social attitudes, values and hence norms. It then turns to consider debates concerning the ‘quality of life ethic’ now prevalent in healthcare, and moves on to discuss the issue of genetic discrimination – focusing, in particular, upon discrimination against disabled persons as a representative instance of the actual ethical and social/communitarian implications of the foregoing. It ends by highlighting the need to discern the ways in which the ethics of genetics is presently shaped and practised in order to discern better the particular social and communitarian implications of certain technological advances. Quand on compare l' Optique d'Ibn al-Haytham à celle de Ptolémée, on rencontre des innovations à coup sûr capitales, et qui chacune mériterait une analyse particulière: étude expérimentale de la propagation rectiligne de la lumière, nouvelle théorie de la vision fondée sur la réception dans l'œil de rayons lumineux, recherche du lien entre l'anatomie de 1'œil et sa fonction optique, preuve expérimentale que la réfraction joue un rôle important dans la vision, et j'en passe: les dimensions d'un article de revue (...) n'y suffiraient pas. Aussi bien mon but est-il plus global et plus synthétique. Il consiste à tenter de faire le point sur ce qu'est devenue, après Ibn al-Haytham, l'insertion de l'optique dans le système des savoirs qui lui sont connectès, en comparant cette insertion à ce qu'elle était au temps de Ptolémée, c'est-à-dire dans l'œuvre de référence reçae et travaillée par lui. The blood oxygen level dependent effect that provides the contrast in functional magnetic resonance imaging has been demonstrated to affect the linewidth of spectral peaks as measured with magnetic resonance spectroscopy and through this, may be used as an indirect measure of cerebral blood flow related to neural activity. By acquiring MR-spectra interleaved with frames without water suppression, it may be possible to image the BOLD effect and associated metabolic changes simultaneously through changes in the linewidth of the unsuppressed water (...) peak. The purpose of this study was to implement this approach with the MEGA-PRESS sequence, widely considered to be the standard sequence for quantitative measurement of GABA at field strengths of 3 T and lower, to observe how changes in both glutamate and GABA levels may relate to changes due to the BOLD effect. MR-spectra and fMRI were acquired from the occipital cortex of 20 healthy participants whilst undergoing intrascanner visual stimulation in the form of a red and black radial checkerboard, alternating at 8 Hz, in 90 s blocks comprising 30 s of visual stimulation followed by 60 s of rest. Results show very strong agreement between the changes in the linewidth of the unsuppressed water signal and the canonical haemodynamic response function as well as a strong, negative, but not statistically significant, correlation with the Glx signal as measured from the OFF spectra in MEGA-PRESS pairs. Findings from this experiment suggest that the unsuppressed water signal provides a reliable measure of the BOLD effect and that correlations with associated changes in GABA and Glx levels may also be measured. However, discrepancies between metabolite levels as measured from the difference and OFF spectra raise questions regarding the reliability of the respective methods. (shrink)

This the first part of a study (in two parts) devoted to Piketty’s theses on the history of capitalism. A summary of Pikety’s analysis is first presented, concerning the dynamics of total wealth (measured as a ratio to national income) and its components, and the tendency of wealth and income inequalities within major capitalist countries. The amplitude of the fall of total wealth in the United-Kingdom and France during World War I is questioned. Piketty explains the profile of these variables (...) concerning wealth and wealth inequalities in reference to historical mechanisms in which the rate of growth of output, the rate of savings, and the return on wealth are considered. The relevance of these mechanisms is basically questioned. We interpret the third component of wealth, other domestic capital, as a form of the capital of enterprises and substitute an alternative, more performing, model to account for the profile of this variable. In his lecture course, The Fundamental Concepts of Metaphysics, Heidegger discusses three different forms of poverty and deprivation. First of all, the poverty in world of the non-human animal, second, the poverty in the being of contemporary Dasein, and, third, the deprivation of world in the fundamental attunement of profound boredom. This essay discusses these three forms of poverty or deprivation, with the goal to offer a preliminary analysis of Heidegger’s distinction between the human and the non-human animal.

Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, (...) avec le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». In “Rothbard as a philosopher” Edward Feser harshly criticises the philosophical abilities of Murray Rothbard. According to Feser, Rothbard seems unable to produce arguments that don’t commit obvious fallacies or produces arguments that fail to address certain obvious objections. His criticism centres on what he regards as Rothbard’s principal argument for the thesis of self-ownership. In this paper, I attempt to show that Feser’s criticism fails of its purpose and that Rothbard is very far from being the epitome of philosophical (...) ineptitude that Feser takes him to be.
