In this paper, we present two proofs of the reciprocal butterfly theorem. The statement of the butterfly theorem is: Let us consider a chord PQ of midpoint M in the circle Ω(O). Through M, two other chords AB and CD are drawn, such that A and C are on the same side of PQ. We denote by X and U the intersection of AD respectively CB with PQ. Consequently, XM = YM. Violence is signaled by a mark of discontinuity, interruption, rupture. The tripartite temporality of violence, with its strong focus on the present, points to the originary violence. Moreover, the violent event is structuring the order of the action sequences in an actual violent (embodied) interaction. The interactional dynamics in violent encounters between co-present actors shapes the specific forms of the experiencing in (and of) the violent interaction. Based on how violence is experienced in an interactive situation, the phenomenon of violence (...) articulates itself according to three coordinates: directedness, co-performativity and de-capabilisation. The outlining of the structure of the lived experience of violence is revealing something irreducible in it. To understand the experience of violence as such, I propose that we accept the idea of violence per se and depart from the idea that the acts of violence are essentially moral actions. The core of the ethical-moral discussion concerning violence should be grounded instead on the moment of conversion identifiable when we take into account the reaction to violence. (shrink)

My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively speaking, in “the world (...) taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

ArgumentThis text is a reflection on the fate of a special kind of scientific object - anatomy collections - and their place in contemporary times. Though the phenomenon of keeping and displaying such collections is generally dying out, those specimens which survive continue to puzzle and fascinate us. To understand the current status of such collections, and the nostalgia evoked by the specimens within them, I argue, we should approach them as modern ruins. This allows us to think of them (...) as places of absence, pointing to unfinished lives and unfinished scientific projects. The paper begins with the story of a preserved human face from the Francis I. Rainer anatomical-anthropological collection (Bucharest), and continues by discussing the fate of that collection, and of anatomy collections more widely. Ultimately, the paper asks, what is it that we want to preserve: specimens, practices, or research philosophies? (shrink)

In this paper, we shall use the perspectival view on justice in an attempt to accommodate the transcendent view on justice with the adversarial practice of justice. Its main idea is that, before seeing justice as administration, it has to be seen in itself. The first section of the paper discusses the meaning of justice from a phenomenological point of view, which enables us to envision justice as transcendent. The second section of the paper describes the pluri-perspectivism of law and (...) justice on the procedural level. Through a series of reflections upon the procedural aspects as they are operating in the Romanian judiciary, we show how the plurality of perspectives tends to converge and finds its resolution in the rule of law and Modern democracy. Nature Exposed to our Method of Questioning explores how we create our cultural assumptions about personhood, culture and nature.

Cases of poor care have been documented across the world. Contrary to professional requirements, evidence indicates that these sometimes go unaddressed. For patients, the outcomes of this inaction are invariably negative. Previous work has either focused on why poor care occurs and what might be done to prevent it, or on the reasons why those who are witness to it find it difficult to raise their concerns. Here, we build on this work but specifically foreground the responsibilities of registrants and (...) students who witness poor care. Acknowledging the challenges associated with raising concerns, we make the case that failure to address poor care is a breach of moral expectation, professional requirement and, sometimes, legal frameworks. We argue that reporting will be more likely to take place if those who wish to enter the profession have a realistic view of the challenges they may encounter. When nurses are provided with robust and applied education on ethics, when “real‐world” cases and exemplars are used in practice and when steps are taken to develop and encourage individual moral courage, we may begin to see positive change. Ultimately however, significant change is only likely to take place where practice cultures invite and welcome feedback, promote critical reflection, and where strong, clear leadership support is shown by those in positions of influence across organisations. This paper tries to show that the naturalistic view of addiction is mired in contradictions that stem from reducing the addict to a weak-willed subject who loses control over his or her body. From a phenomenological perspective, addiction reveals itself to be a habit which eventually becomes harmful, but has its primary sources in the embodied needs of a worldly subject. The aim of this paper is to uncover the dimensions of the lived addiction that are neglected in the contemporary (...) naturalistic discourse: the lived-body and the worldly context of the addict. Firstly, we try to do justice to the variety of addictions by underlying that their new and surprising forms are determined by the intersubjective tissue wherein the subject operates. Secondly, the loss of control in addiction, how the subject deals with the tendency to satisfy a need, is experienced as powerlessness, as expressed in the accounts of ecstasy addicts regarding altered states of mind. The last section of this paper will argue that this sense of powerlessness cannot be equated with a weakness of the will because a strong, forceful will engenders the same vertigo of being prey to strange powers. The embodied aspect of addiction and the spontaneous, bodily need it saturates will clarify further this claim. (shrink)

Since its inception philosophical thought has been fixated by death. Death, as much as life, has been the unrelenting driving force behind some of history’s greatest thinkers. Yet, for Emil Cioran, a Romanian-French philosopher, even philosophy cannot attempt to understand nor contain the inevitable unknown. Considered to be an anti-philosopher, Cioran approached and reflected on the human experience with a despairing pessimism. His works are characterised by a brooding, fatalistic temperament that reveals and defines itself in his irony, black humour (...) and inimitable style. Although Cioran’s later works have received much scholarly recognition, little attention has been paid to the texts he wrote in his adolescent. Grounded in the historical context of interwar Romania, this book presents for the first time an analysis of the little-known works of this pioneering Romanian thinker. Deeply affected by his upbringing, this book offers a glimpse into Cioran’s first attempts to delve into philosophical enterprise, before turning its attention to his later works, On the Heights of Despair (1934), The Transfiguration of Romania (1936) and Twilight of thoughts (1940; written in France). Using both the French and Romanian editions of these works, but also their original manuscripts, this volume seeks to provide a re-reading that takes language rather than a social or political critique as its focal point. As an important and provocative contribution to the existing literature on Cioran, this book will be an essential point of reference for students and researchers, alike. (shrink)

The present study aims to carry out an analysis of the relation between the Bibles of Samuil Micu and Andrei Șaguna from an isagogic perspective, with a particular focus on the canon and canonicity of the books of the Holy Scripture. We believe that, through such an analysis, we can observe what they have in common, but also what differentiates the two Transylvanian editions of the Holy Scripture so that we can help those interested in understanding the reasons behind the (...) current controversies as to the relation between them. Although these controversies refer to the biblical text of the two Scriptural editions, the fact that the attitude towards it was caused by denominational factors, whose doctrinal background is represented by two different traditions of understanding the biblical canon, has been overlooked. This is why we find that the evaluation of how the two Romanian editions of the Holy Scripture (the Bible of Samuil Micu, 1795, and the Bible of Andrei Șaguna, 1856-1858) relate to the canonical tradition of each Church and cultivate their isagogics is fundamental for the establishment and understanding of the relation between them. As an artist I admittedly scrutinize all of the theories related to the arts closely. I do this for a number of reasons. The obvious one is that I have a deeply felt personal relationship with the subject matter. Less obvious is my experience in general. My early research was motivated by a desire to discover the historical circumstances that led to the difficulty in fitting visual art into the discussions I encountered. Generally, it seemed that the dominant framework trivialized (...) what I considered the most important aspects of the creative process. Over time I concluded that developing an interdisciplinary approach offered the best option for expanding views, although it is not an easy task. Establishing areas of commonality across a range of disciplines must somehow accommodate the ways in which each has developed a research agenda that seems to serve its core needs. In consciousness studies, for example, we have a field that relies heavily on scientific research and humanistic methodologies when building the philosophical models scholars use to structure theories. This methodology is not only removed from the nuts and bolts of art, it is also easily manipulated in discourse on art due to the ease with which we can fit aspects of art into the philosophical framework. Clearly this approach fits nicely with philosophically defined concepts such as meaning, emotion, and other elusive modes. In addition, using the well-honed categories aids in bracketing themes such as metaphor, interpretation, subjectivity, language and history. Nonetheless, in reading through the studies, I repeatedly conclude that the voices of practitioners need to be included to a greater degree. (shrink)
