Professor Bryant’s article – which seeks to discover whether aspects of an anticruelty statute can be based directly on a call to virtuous conduct – is a provocative piece of scholarship that harbors a much larger question: Can a general principle mandating full respect for animals be developed out of the moral methodology inhering in virtue ethics? Insights garnered in this rejoinder are meant to stand alongside those in Professor Bryant’s article to lend deep moral grounding to animal-respect as well (...) as provide intimations of the way virtue ethics as a moral methodology might yield determinate answers to moral questions. Toward this end, this paper has several sections. The first section briefly outlines virtue ethics as a moral methodology with particular attention to its highly situated and somewhat ad hoc aspect. The second section explores efforts over the last several decades to rely first on utilitarianism and then on deontological approaches in pursuit of moral grounding for animal respect. The third section explores the particular challenges that utilitarianism or deontology must confront in attempting to provide moral grounding for any relationship between human beings and persons or creatures that are incapable of moral agency. Finally, I turn to the concept of fiduciary duty to see if it might be viewed as a type of virtue ethics – or perhaps an instance of virtue ethics in play. (shrink)

Judith Suissa and Alice Sullivan’s 2021 paper ‘The Gender Wars, Academic Freedom and Education’ holds that activism associated with the slogan ‘trans women are women’ harms progress towards the goals of shared learning and knowledge production. They hold that shared learning and knowledge production ground the value of the university. In response, we point out that academic freedom is not absolute, and that its contribution to learning and knowledge production is only part of a host of academic goods. Given the (...) hostile environment faced by trans people in the United Kingdom, absolute academic freedom in relation to questions about sex, gender and gender identity should not be taken for granted. The focus of this paper is on the following: (1) Academic freedom is not absolute and should be responsibly curtailed when it causes harm, or hinders other educational goods; (2) public perceptions of ‘gender debates’ in the United Kingdom cause harm and hinder other educational goods; (3) academic debates about sex, gender and gender identity could contribute to this harm and hindrance and should be undertaken only with care. This essay explores the value of oppositional, performative political action in the context of oppression, domination, and exclusionary political spheres. Rather than adopting Iris Marion Young's approach, Drexler turns to Hannah Arendt's theories of political action in order to emphasize the capacity of political action as action to intervene in and disrupt the constricting, politically devitalizing, necrophilic normalizations of proceduralism and routine, and thus to reorient the importance of contestatory action as enabling and enacting creativity, spontaneity, and resistance.

Is it possible for postmodernism to offer viable, coherent accounts of ethics? Or are our social and intellectual worlds too fragmented for any broad consensus about the moral life? These issues have emerged as some of the most contentious in literary and philosophical studies. In Renegotiating Ethics in Literature, Philosophy, and Theory a distinguished international gathering of philosophers and literary scholars address the reconceptualisations involved in this 'turn towards ethics'. An important feature of this has been a renewed interest in (...) the literary text as a focus for the exploration of ethical issues. Exponents of this trend include Charles Taylor, Bernard Williams, Iris Murdoch, Cora Diamond, Richard Rorty and Martha Nussbaum, the latter a contributor and a key figure in this volume. The first is the story of four friends who came up to Oxford together just before WWII. It is the story of their lives, loves, and intellectual preoccupations; it is a story about women trying to find a place in a man's world of academic philosophy. The second story is about these friends' shared philosophical project and (...) their unintentional creation of a school of thought that challenged the dominant way of doing ethics. That dominant school of thought envisioned the world as empty, value-free matter, on which humans impose meaning. This outlook treated statements such as “this is good” as mere expressions of feeling or preference, reflecting no objective standards. It emphasized human freedom and demanded an unflinching recognition of the value-free world. The four friends diagnosed this moral philosophy as an impoverishing intellectual fad. This style of thought, they believed, obscured the realities of human nature and left people without the resources to make difficult moral choices or to confront evil. As an alternative, the women proposed a naturalistic ethics, reviving a line of thought running through Plato, Aristotle, and Aquinas, and enriched by modern biologists like Jane Goodall and Charles Darwin. Similarities between pragmatist models of democracy and deliberative models have been explored over recent years, most notably in this journal ( Talisse 2004). However, the work of Iris Marion Young has, thus far, not figured in such comparative analyses and historical weighing of pragmatist antecedents in deliberativist work. In what follows, I wish to redress this oversight by placing Young in conversation with John Dewey and Jane Addams. Young's particular brand of deliberative theorizing focuses on the inclusion of (...) women and all those deemed Other in our democracies. She identifies a significant shortcoming in standard expositions of deliberative thought, pointing out that communicative style, structured by oppressive norms of gender, race, and class, to name but a few, may serve to undermine our full participation in political decision making. While this forms a valuable insight for those seeking to redress the exclusion of Others in democracies, it also draws attention to the centrality of differences of communication in deliberative settings. In what follows, I will highlight the integral role played by communication in Young's and Dewey's expositions of democracy while showing that Addams foreshadows Young's principal insight through an appreciation of communicative difference and its attendant political implications. In Gendered Readings of Change, Clara Fischer develops a unique theory of change by drawing on American philosophy and contemporary feminist thought. Via a select history of ancient Greek and Pragmatist philosophies of change, she argues for a reconstruction of transformation that is inclusive of women's experiences and thought. Recent research has investigated whether people think of their moral beliefs as objectively true facts about the world, or as subjective preferences. The present research examines variability in the perceived objectivity of different moral beliefs, with respect both to the content of moral beliefs themselves (what they are about), and to the social representation of those moral beliefs (whether other individuals are thought to hold them). It also examines the possible consequences of perceiving a moral belief as objective. With respect (...) to the content of moral beliefs, we find that beliefs about the moral properties of negatively valenced acts are seen as reliably more objective than beliefs about the moral properties of positively valenced acts. With respect to the social representation of moral beliefs, we find that the degree of perceived consensus regarding a moral belief positively influences its perceived objectivity. The present experiments also demonstrate that holding a moral belief to be objective is associated with a more ‘closed’ response in the face of disagreement about it, and with more morally pejorative attributions towards a disagreeing other person. _Disputed Subjects_ analyzes some of the assumptions behind the contemporary attraction to rationalistic notions of justice and knowledge and discusses why modernity cannot be emancipatory. The effects of gender relations in constituting modern political ideas and theories of knowledge are explored, while at the same time the author identifies problematic aspects of discourses such as psychoanalysis, postmodernism and feminist theorizing. Flax pays special attention to recurrent difficulties concerning maternity, sexuality and race within feminist theorizing, and she addresses the inadequacies of (...) postmodernist accounts of subjectivity and gender. This article will consider sound as a glue between internal and external experience, a link between sensing and cognition, memory and perception. In looking at research in neuroscience, specifically Eugene Izhikevich’s work with models of spiking neurons, parallels may be drawn with faulty source monitoring where a subject cannot differentiate between external and internal stimuli, and with a collapsing of present into the past. These ideas will be discussed through a number of sonic artworks that have neural plasticity, space and (...) location at their core. (shrink)

I explore two walks, one by Henry Thoreau on a hot day in 1851 and one by a line as it winds its way into a doodle today. Walks, I contend, generate circuits of energies and affects, some issuing from people, some from elsewhere. The goal is to accent how ahuman energies and affects inscribe themselves upon selves and inflect their positions and dispositions. Borrowing a term from Lorenz Engell, I call this inscriptive inflection an ›ontographic‹ procedure. Ontography will mark (...) the operations of a creative cosmos, of a more-than-human world continuously impressing itself upon us. At the end, I leave the ontographic to return to the linguistic, to human attempts to ›write up‹ the ahuman ontographies they experience. (shrink)

This paper draws on insights from Jacques Rancière's writing on politics and aesthetics to offer new perspectives on debates in education and the arts. The paper addresses three debates in turn; the place of contemporary art in schools and gallery education, the role of art in democratic education and the blurring of boundaries between participatory art and community education. I argue that Rancière's work helps to illuminate some essentialist assumptions behind dichotomous arguments about contemporary art in the classroom—both over-hyped claims (...) about its value, and exaggerated fears about its threat to educational values alike. On democratic education I argue that his work highlights the importance of the aesthetic dimensions of democratic learning and, on art and community education, I issue caution against readings of Rancière's work that frame his contribution as a ‘rehabilitation‘ of the aesthetic. Although each debate is tackled discretely, the paper advances the overall argument that attention to equality in Rancière's work—both aesthetic and political—is vital when applying his philosophy to debates that occupy the boundaries of education, politics and art. Moral patients deserve moral consideration and concern – they have moral standing. What factors drive attributions of moral standing? Understanding these factors is important because it indicates how broadly individuals conceptualize the moral world, and suggests how they will treat various entities, both human and non-human. This understanding has recently been advanced by a series of studies conducted by both psychologists and philosophers, which have revealed three main drivers of moral standing: the capacity to suffer, intelligence or autonomy, and the (...) nature of an entity's disposition. These studies have also revealed causal links between moral standing and other variables of interest, namely, mental state attributions and moral behavior. In this review, I consider this recent research, aiming to clarify what the balance of evidence indicates about how moral standing is judged and about its links to mind perception and behavior. I conclude by suggesting open questions for future research on this exciting topic. (shrink)

In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. In this paper, Tarskis notion of Logical Consequence is viewed as a special case of the more general notion of being a theorem of an axiomatic theory. As was recognized by Tarski, the material adequacy of his definition depends on having the distinction between logical and non logical constants right, but we find Tarskis analysis persuasive even if we dont agree on what constants are logical. This accords with the view put forward in this paper that Tarski indeed captures the (...) more inclusive notion of theoremhood in an axiomatic theory. The approach to logical consequence via axiomatic theories leads us to grant centrality to inference schemas rather than to full-fledged arguments and to view the logically valid schemas as a subclass of generally valid schemas. An analysis of the specific yogurt and phone microcredit schemes in Bangladesh is made along three lines of argument. It is important to note that these schemes are pulled together by NGO’s (non-governmental organizations) to assist women and children in developing areas to attain financial independence—the first line employs leftist criticism of the corporate constructs, and an additional line of inquiry compares some of the programs to those in other nations. A final line of argument analyzes the specific cultural views (...) of Bengali Islam and the long tradition of Bengali literacy. The banner of deliberative democracy is attracting increasing numbers of supporters, in both the world's older and newer democracies. This effort to renew democratic politics is widely seen as a reaction to the dominance of liberal constitutionalism. But many questions surround this new project. What does deliberative democracy stand for? What difference would deliberative practices make in the real world of political conflict and public policy design? What is the relationship between deliberative politics and liberal constitutional arrangements? The 1996 publication (...) of Amy Gutmann and Dennis F. The essays discuss the value and limits of moral deliberation in politics, and take up practical policy issues such as abortion, affirmative action, and health care reform. Among the impressive roster of contributors are Norman Daniels, Stanley Fish, William A. Galston, Jane Mansbridge, Cass R. Sunstein, Michael Walzer, and Iris Marion Young, and the editor of the volume, Stephen Macedo. The book concludes with a thoughtful response from Gutmann and Thompson to their esteemed critics. This article examines the ways that managers in a rapidly globalizing industry use gendered discourses of skill to justify and frame their search for inexperienced workers in low-wage regions, using a case of a U.S.-based apparel firm that relocated and subcontracted its sewing operations in the 1990s. It uses feminist theory to examine managers' claims that women's sewing skills in the United States were disappearing and that they needed to seek out these skills in parts of the world where women (...) were not yet active participants in labor markets. Feminist researchers have long understood the ways that naturalization of skill cheapens women's labor. The case presented here highlights the way in which the portrayal of certain skills as naturally occurring resources justifies the movement of capital in search of new pools of workers without labor market experience or union representation. Using material taken from contemporary feminist theory and also from work on human rights, it is argued that rape is a form of torture, and that it operates on powerful levels, both literally and metaphorically. Part of the argument is that rape has achieved the status it has as political force for exploitation because of strong beliefs about cultural reproduction and about the roles that women play in cultural reproduction.

Abstract Ten years ago, Clark Nardinelli shocked conventional historians by reinterpreting child labor as a sensible response to the Industrial Revolution. Nardinelli's exculpation of child labor follows front the way in which he deploys neoclassical economic theory. How relevant is his neoclassical model to the early industrial economy, and how realistic is methodological individualism to the decisions that sent young children into the appalling work places of early industrial Britain? Rather than seeing neoclassical economics as a substitute for historical judgment, (...) as Nardinelli suggests, I propose that we use it critically to probe the meaning and implications of child labor in its historical context.
