Jeremy Waldron introduced the notion of rights supersession into the philosophical discussion about restitutive justice in cases of historic injustices. He refers to land claims by indigenous peoples as a real-world example and as an application of his theory of rights supersession. He implies that the changes that have taken place in settler states since the first years of colonialism are the kind of changes that lead to a supersession of land rights. The article proposes to unbundle property rights into (...) rights of benefit, control, use, and access and to distinguish between different forms of attachment. This strategy allows for a third option of restitution and supersession, namely partial restitution. Partial restitution grants current land holders those rights that they need to satisfy their attachments and basic distributive justice claims. At the same time, rights that are not needed for either purpose will revert back to indigenous peoples as the original owners. The article argues that the notion of partial restitution allows for far more extensive land rights than a less nuanced application of the supersession thesis. (shrink)

On the basis of an earlier contribution to the philosophy of computer science by Amnon Eden, this essay discusses to what extent Eden’s ‘paradigms’ of computer science can be transferred or applied to software engineering. This discussion implies an analysis of how software engineering and computer science are related to each other. The essay concludes that software engineering can neither be fully subsumed by computer science, nor vice versa. Consequently, also the philosophies of computer science and software engineering—though related to (...) each other—are not identical branches of a general philosophy of science. This also implies that not all of Eden’s earlier arguments can be directly mapped from the domain of computer science into the domain of software science. After the discussion of this main topic, the essay also points to some further problems and open issues for future studies in the philosophy of software science and engineering. (shrink)

Advocates for re-localizing food systems often encourage consumers to support local farmers and strengthen local food economies. Yet, local food systems hinge not only on consumers’ willingness to buy local food but also on whether farmers have the social support networks to address diverse challenges during food production and distribution. This study characterizes the challenges and support systems of farmers selling to local markets in Québec, Canada, across multiple growing seasons using a mixed-methods research design. We sent an online questionnaire (...) to 1046 farmers and conducted follow-up interviews with 15 of the 133 respondents. Our findings show that farmers relied on an average of four support actor groups, particularly employees, customers, and other farmers. Actors played distinct roles in terms of the importance, frequency, and formality of interactions, providing immediate and long-term support through formal and informal relationships across multiple spatial scales (farm, local community, and regional/international). Our thematic analysis showed that support actors helped farmers in four key domains: (1) Knowledge sharing and emotional support; (2) Labour and workforce; (3) Material and financial aid; and (4) Consumer education and business promotion. Farmer associations provided resources to tackle various challenges, acting as bridges across multiple support actor groups. Yet, our results suggest that political desires to encourage local food systems are in some cases poorly matched with resources to address specific types of challenges farmers face. Specifically, overlooking the role of diverse social support actors in helping farmers build food production and distribution capacity could undermine efforts to foster localization. (shrink)

This essay focuses on Günther Anders’s engagement with (political) poetry. I draw on published material and unpublished source texts from the Anders Nachlass to track how Anders arrives at his own writing style and mode of address through his sustained engagement with poetry. Anders’s philosophical prose and exoteric use of language is shaped by multifaceted reflections on (political) poetry and by the tension between ‘political poetry’ and ‘lyrical action’. I first elaborate on Anders's reading of Brecht in the early 1930s, (...) and then turn to the poetry and reflections on poetics that were written during his long exile in the US (1936–50). It is from this basis that I consider Anders’s categorical and programmatic turn away from poetry from the mid-1940s onwards. What emerges from my discussion is that engagements with literature, and with poetry in particular, were not a marginal activity for Anders but reflect a broad, life-long interest in (predominantly) classical and contemporary poetry, resulting in reflections on poetics and his own extensive poetic praxis. It is pointed out against the two critics (a) that an identity or partial identity of meanings and facts is logically impossible, (b) that the logical grammar of ?identify? and ?explain? is different from that of ?understand? and that hence understanding can never be an operation of identifying or explaining, and (c) that rational understanding does not involve a ?reproduction? of the subject matter in any controversial sense.

This paper deals with the question of whether and when it is appropriate or inappropriate to say that a social group performs an action. After some remarks on the concept of action three kinds of groups are distinguished, i.e. assemblies, institutions, and classes. It is found that in the first two of these cases predication of action is possible: an assembly can act in that all its members act, or some of them do who are interchangeable with any others; and (...) an institution can act because it has a structure and some individuals can act on its behalf. A class, however, cannot be said to act, for its concept may be freely formed, its members cannot be assembled, and it has no organs through which actions could be performed. (shrink)

This paper argues that land and resource rights are often essential in overcoming colonial inequality and devaluation of indigenous populations and cultures. It thereby criticizes global welfare egalitarians that promote the abolition of national sovereignty over resources in the name of increased equality. The paper discusses two ways in which land and resource rights contribute to decolonization and the eradication of the associated inequality. First, it proposes that land and resource rights have acquired a status-conferring function for colonized peoples so (...) that possession of full personhood and relational equality is partially expressed through the possession of land and resource rights. Second, it suggests that successful internal decolonization depends on access to and control over land and resources, especially for indigenous peoples. (shrink)

Mitchell Greenʼs conception of the thesis of Literary Cognitivism states that literary fiction can be a source of knowledge that depends crucially on its being fictional. By a modal argument the authors show that the criterion of fictionality cannot be crucial to the epistemic value of literary fiction. Rather, it lays in a certain kind of distance, e.g. a temporal, cultural, or interpersonal one. This will be motivated by drawing parallels to Gadamerʼs hermeneutics, especially his conception of fusion of horizons. (...) In doing so, we agree with Green’s characterisation of knowledge that can be gained from engaging with literary fiction, but present a different approach to the source of this knowledge. At the same time, this approach enables us to extend the epistemic value of literary fiction both quantitatively and qualitatively. (shrink)

This paper develops a model of political consensus in order to explain the missing link between inequality and political redistribution. Political consensus is an implicit agreement not to vote for extreme policy proposals. We show that such an agreement may play an efficiency-enhancing role. Voters anticipate that voting for extremist parties increases policy uncertainty in the future. A political consensus among voters reduces policy uncertainty because self-interested politicians propose non-discriminatory policies. We study how much inequality can be sustained in a (...) democracy and how the limits to redistribution vary with initial inequality. The bounds of the set of political equilibria may react in a fundamentally different manner to changes in exogenous variables than do the policy variables in the one-dimensional, one-shot game. More initial inequality need not lead to more redistribution from the rich to the poor. The maximum amount of redistribution decreases with inequality if (and only if) agents are sufficiently patient. In this case inequality is politically self-sustaining. (shrink)

In modern and contemporary physics, on the other hand, novel notions comparable to Hegel's "aether" have become interesting again with the rise of quantum physics. In this essay we recapitulate and explain the notion of "Aether" in Hegel's works and compare it to novel aether concepts which might be appropriate in the context of contemporary quantum physics. Such a juxtaposition would well have matched Hegel's own intentions, since he had always been a keen observer of the latest developments in the natural sciences during his own lifetime. In conclusion we can say that, in spite of a number of differences, both notions of aether can be speculatively characterised by the paradoxical term "reality of possibility". (shrink)

This article deals with the International Criminal Court (ICC) as a point of contention in US relations with Germany and Japan. Both countries rank among America's closest allies, but they have also been supporting the establishment and operation of the ICC, although each to a different extent. The article analyzes the reasons for the three countries-vis the US. It suggests that Berlin's idealistic position and full ICC support on the one hand, as well as Japan's cautious and pragmatic approach on (...) the other, are both rooted not only in their individual evaluations of the ICC's institutional design, but also the varying degrees of their bi/multilateral orientation and the extent of their on US security commitments. In this paper I argue that evidence based medicine (EBM) offers a more transparent system of knowledge and medical care than complementary medicine (CM). While an individual’s choice to use CM should be respected, users of this form of medicine, nevertheless, risk loss of autonomy. This loss of autonomy is an outcome of CM’s offering fewer transparent possibilities for informed patient consent In both EBM and CM patients risk physical harm(s) but science gives EBM patients the benefit of being able (...) to factor known side effects into their health care decisions. Business Ethics: A European Review, EarlyView.

Within Western European countries the number of women and girls already genitally mutilated or at risk, is rising due to increasing rates of migration of Africans. The article compares legislative and ethical practices within the medical profession concerning female genital mutilation (FGM) in these countries. There are considerable differences in the number of affected women and in legislation and guidelines. For example, in France, Great Britain and Austria FGM is included in the criminal code as elements of crime, whereas in (...) Germany and Switzerland FGM is brought to trial as bodily injury. So far trials only in France and Switzerland in connection with FGM resulted in convictions. France and Great Britain as former Colonial countries serve as an example of countries with a comparably great number of African immigrants. These countries have the best possibilities to intervene preventatively, due to legislation and detailed medical guidelines. For instance, an obligation exists in France to inform administrative and medical authorities if FGM is suspected. FGM so far is not explicitly part of the curriculum for medical training in any of the examined countries. (shrink)

It has been proposed that the design of robots might benefit from interactions that are similar to caregiver–child interactions, which is tailored to children’s respective capacities to a high degree. However, so far little is known about how people adapt their tutoring behaviour to robots and whether robots can evoke input that is similar to child-directed interaction. The paper presents detailed analyses of speakers’ linguistic behaviour and non-linguistic behaviour, such as action demonstration, in two comparable situations: In one experiment, parents (...) described and explained to their nonverbal infants the use of certain everyday objects; in the other experiment, participants tutored a simulated robot on the same objects. The results, which show considerable differences between the two situations on almost all measures, are discussed in the light of the computer-as-social-actor paradigm and the register hypothesis. The visual behaviour of consumers buying products in a supermarket was measured and used to analyse the stages of their decision process. Traditionally metrics used to trace decision-making processes are difficult to use in natural environments that often contain many options and unstructured information. Unlike previous attempts in this direction, our methodology reveals differences between a decision-making task and a search task. In particular the second stage of a decision task contains more re-dwells than the second stage of a comparable (...) search task. This study addresses the growing concern of taking eye movement research from the laboratory into the ‘real-world’, so findings can be better generalised to natural situations. (shrink)

Advance care planning (ACP) is promoted as beneficial practice internationally. This article critically examines different ways of understanding and measuring success in ACP. It has been 50 years since Luis Kutner first published his original idea of the Living Will, which was thought to be a contract between health carers and patients to provide for instructions about treatment choices in cases of mental incapacity. Its purpose was to extend a patient's right to autonomy and protect health carers from charges of (...) wrong-doing. Yet, it can be doubtful whether different types of ACP achieve these goals rather than aiming at secondary gains. My discussion suggests that the current promotion of ACP is not always engaging critically with the original ACP intentions and may even pursue notions of success that may run contrary to respecting autonomy. The risk of this may especially be the case when high participation rates are taken as indicators of success for institutional ACP programs. I further suggest that Kutner's two original aims of protecting patient autonomy and preventing charges of wrong-doing are near impossible to achieve in conjunction, because their simultaneous pursuit fails to acknowledge that patients and carers have opposing needs for reassurance about possible judgment errors. I conclude that the most realistic idea of success of modern ACP is an acknowledgement of the importance of ongoing dialogue about what constitutes appropriate care and a diversity of aims rather than any kind of advance, contractual insurance in the face of controversy. Este artigo apresenta duas teses sobre as vantagens do uso de obras de arte para o ensino de Filosofia no Ensino Médio: a primeira é a de que obras de arte podem servir de introdução ao filosofar na escola - indo além das questões estéticas e chegando a interrogações da filosofia política, metafísica, moral e epistemológica. Num primeiro momento, apresenta-se exemplos de obras e casos ricos para esse intuito. Num segundo momento, parte desses particulares para uma compreensão mais ampla, explicando, (...) a partir das teses de Arthur Danto, Ronald Moore e Ronai Rocha, o valor didático e filosófico daquelas no Ensino Médio. Ainda quanto à primeira tese, sustenta-se que a arte também serve ao exercício de uma das principais competências filosóficas: a argumentação. A segunda tese é a de que as artes podem servir de ponto de partida para uma proposta curricular interdisciplinar: no presente caso, entre a Filosofia e as demais disciplinas escolares. Apresenta-se possíveis cruzamentos conceituais e temáticos entre as disciplinas em questão, fornecidos por obras de arte e outros fenômenos estéticos. Nossa conclusão é a de que abordar a arte no Ensino Médio, sob o ponto de vista filosófico, é uma oportunidade didática e cognitiva que não deve ser menosprezada. (shrink)

Parcels, Sales and Gifts: Hans Sauter's Entomological Practices between Formosa and Europe, 1902–1914. The exploration of global biodiversity is a form of knowledge production that is necessarily specimen‐based. In the endeavor to chart the natural world, not only ideas and writings travelled across the oceans, but also a flood of scientific objects. The German entomologist Hans Sauter (1871–1943) spent most of his life in Formosa, then a Japanese colony. His pronounced aim was to complete an inventory of the entire fauna (...) of Formosa. He aimed for the mass production of knowledge, becoming a collecting‐entrepreneur who employed scores of local collectors. Between 1902 and 1914, they amassed large quantities of insects, which required specialized practices in collecting, preserving, documenting, and packaging. Sauter sent these insects, but also hundreds of reptiles, mammals, birds, fish etc., to zoologists all over Europe who identified and published hitherto undescribed species. At first, Sauter sold his finds. Later, he stopped asking for money – pushing instead for speed in publication and making demands about the content and naming of these articles. His demands were met, especially by the Deutsches Entomologisches Museum in Dahlem. Despite almost no publications to his name, Sauter quickly gained considerable influence in the world of entomological research. In this paper, the circulation of these scientific objects serves as a focal point in order to embed local circumstances in the process of knowledge production in a global context. The practices associated with the specimens illustrate the economic, political and social dimensions of the formation of knowledge. Hans Sauter's case defies traditional dichotomies as it illustrates the interdependence of practical and theoretical knowledge, of science and trade and of center and periphery. Practical knowledge gained in a local setting in Formosa allowed Sauter to amass large amounts of insect specimens, a resource he used to steer the course of scientific practice in Europe. (shrink)
