In this paper, I present different ways in which transcendental argumentation has been used in contemporary debates in moral philosophy to justify the normative authority of morality. My aim is to defend strong “retorsive” transcendental argumentation as a way to ground a sort of critical realism in metaethics, comparing transcendental arguments proposed by Karl-Otto Apel, Christine Korsgaard and Alan Gewirth – which are sometimes referred to as “constitutivist” arguments. In particular, I endorse an argumentative strategy that considers the merits of (...) the respective positions while overcoming the limits of each. Such a strategy aims at grounding transcendentally the metaphysical fact of human value, making explicit the ontological implications of transcendental argumentation, and showing that a justification of fundamental values alone can ultimately make it possible to ground basic moral principles. While models of business ethics increasingly recognize that ethical behavior varies cross-culturally, scant attention has been given to understanding how culture affects the ethical reasoning process that predicates individuals' ethical actions. To address this gap, this paper illustrates how culture may affect the various components of individuals' ethical reasoning by integrating findings from the cross-cultural management literature with cognitive-developmental perspective. Implications for future research and transnational organizations are discussed.

In a recent article in this journal, James Christensen, Tom Parr and David Axelsen argue that millionaire salaries are unjust and women have no grounds of fairness to unjust salaries in parity with men. They accept that disrespect is expressed toward women when they are paid less than men because of their gender. Their argument largely replicates a similar argument developed earlier by Anca Gheaus. By drawing on the distinction between ideal and nonideal theory, we argue that Christensen et al. (...) and Gheaus hold women to unacceptably high standards of justice and arguably higher standards than men are held to. (shrink)

Although it is argued that social justice is a core concern for the discipline, nursing has not generally played a leadership role in the responses to many of the greatest social problems of our time. These include the accelerated rate of climate change, pandemic threats, systemic racism, growing health and social inequities, and the regulation of new technologies to ensure an equitable future ‘for all.’ In nursing codes of ethics, administration, education, policies, and practice, social justice is often claimed to (...) be a core value, yet it is rarely contextualized by philosophical or theoretical underpinnings. It appears that nurses’ commitment to social justice may stem more from a penchant for ‘doing good’ than an attempt to explore, understand, and enact what is meant by social justice from an ontological, epistemological, and methodological perspective. We contend that the dominance of a human science perspective in nursing contributes to a narrow definition of health and relegates many issues central to social justice to the margins of nurses’ care. In this article, we explore how the focus on ‘the human’ in the human science perspective may not only be limiting the capacity of nurses to develop strategies to adequately address social injustice, but in some instances, direct nurses to contribute to their very reproduction. We suggest that a critical interrogation of this human‐centric hegemony can identify avenues of rupture and introduce posthumanism as an additional philosophical perspective for consideration to help bridge the human‐social divide. Critics of Hannah Arendt's Lectures on Kant's Political Philosophy argue that Arendt fails to address the most important problem of political judgment, namely, validity. This essay shows that Arendt does indeed have an answer to the problem that preoccupies her critics, with one important caveat: she does not think that validity is the all-important problem of political judgment--the affirmation of human freedom is.

Abstract‘Cultural racism’ is central to understanding racism today yet has receded into the background behind the focus on attitudinal racism. Even the turn to structural racism is largely circumscribed to inclusion without substantive challenge to existing processes or profit margins. When portions of the racist public are targeted, it is often the least elite members of society. Without question, the concept of cultural racism requires some clarification, but it will help bring the continued influence of colonialism forward and reveal the (...) alibis given in mainstream and elite circles that justify exclusion, resource extraction, and domination. BackgroundInstitutions of higher learning are persistently struggling with issues of academic dishonesty such as plagiarism, despite the availability of university policies and guidelines for upholding academic integrity.MethodologyThis was a descriptive qualitative study conducted on 37 students of a Healthcare Ethics course at an Australian tertiary institution from February 2016 to October 2018. The purpose of the study was to explore the reasons for plagiarism detected the TurnitinR plagiarism checking software and extensive review of manuscripts. The interviews were conducted in private (...) rooms and in strict confidence. Thematic analysis was manually done.ResultsFour major themes namely, lack of interest; pressure of time with competing priorities; lack of understanding of the policy on academic honesty, and “the determined students” were identified. Sub themes under lack of interest were lack of preparation and effort, low self-efficacy, poor studying techniques, and convenience of internet sources. Under pressure of time, the subthemes were, misplaced priorities, procrastination, high workloads, poor planning, competing interests, and the perception of availability of time at the start of the semester. Regarding lack of understanding of the policy on academic honesty, the subthemes identified were, lake of awareness of plagiarism, lack of awareness of acceptable similarity, conflicting messages from tutors and confusion with high school learning. The determined students were those that either made all effort to reduce plagiarism but still remained high, used the another language at home other than English, had poor paraphrasing techniques or lacked resources for English language editing.ConclusionThere are varied and diverse reasons for plagiarism. There is a need to systematically reinforce and educate students on issues pertaining to academic dishonesty and their associated implications. (shrink)

How parents talk about social events shapes their children’s understanding of the social world and themselves. In this study, we show that parents in a society that more strongly values individualism and one that more strongly values collectivism differ in how they talk about negative social events, but not positive ones. An animal puppet show presented positive social events and negative social events. All shows contained two puppets, an actor and a recipient of the event. We asked parents to talk (...) to their 3- and 4-years old children about these events. A total of 26 parent–child dyads from the United States and Japan participated. The principal dependent measure was how much parent talk referred to the actor of each type of social event. There were no cultural differences observed in positive events – both the United States and Japanese parents discussed actors more than recipients. However, there were cultural differences observed in negative events – the United States parents talked mostly about the actor but Japanese parents talked equally about the actor and the recipient of the event. The potential influences of these differences on early cognitive and social development are discussed. (shrink)

This study explores both the negotiating styles and moral reasoning processes of business people and governmental officials in Taiwan, so as to provide a footing for outsiders when negotiating with Taiwanese over environmental concerns. Findings imply that Taiwanese business people and governmental officials can and will reason both at the conventional level and at the postconventional level of moral judgment. But, results of this study also indicate that Taiwanese negotiating styles do not necessarily match their levels of moral reasoning. With (...) respect to pollution concerns, Taiwanese seem unwillingly to accept responsibility as autonomous individuals. Instead, responsibility is accepted when mandated by the law. (shrink)

As in other fields, scholarly publication in sociology is not only the key to career success but also the route by which feminist analyses and perspectives become known to others in the discipline. A growing literature has analyzed women's and men's rates of publication, but the gender politics of the prepublication production of research and gender differences in reputation building after publication remain underexplored. This report reviews the current state of knowledge about sociological publishing at three phases: prepublication, the publication-seeking (...) phase, and postpublication. It concludes with critical questions to be addressed in developing a comprehensive model of gender effects on sociological publishing. (shrink)

This study investigates the relative attractiveness of production level jobs provided by multinational firms in Mexico's maquiladora industry. We take the position that workers themselves are an important and often overlooked source of information relevant to the controversy focusing on the responsibilities of multinational companies to their employees in the developing world. We conducted interviews with 59 maquila production level workers in the Mexican cities of Cd. Juárez and Chihuahua. Using a relative attractiveness framework that compared maquila jobs to other (...) employment available in the local economy, maquila line and technical workers responded to questions addressing why they were working at a maquila, their work history, the attractiveness of maquila jobs compared to both their prior jobs and the jobs held by friends and family, and whether they planned to continue working in the maquilas. While the responses from maquila workers are diverse, they suggest that maquila jobs provide attractive employment for the economically disadvantaged in Northern Mexico. (shrink)

In this paper I argue that epistemic authority can be justified in the same way as political authority in the tradition of political liberalism. I propose principles of epistemic authority modeled on the general principles of authority proposed by Joseph Raz. These include the Content-Independence thesis, the Pre-emption thesis, the Dependency thesis, and the Normal Justification thesis. The focus is on the authority of a person’s beliefs, although the principles can be applied to the authority of another person’s testimony and (...) the authority of epistemic communities. (shrink)

Theories of distributive justice are often criticised for either excluding people with disabilities from the domain of justice altogether, or casting them as deficient in personal attributes. I argue that the capabilities approach to justice is largely immune to these flaws. It has the conceptual resources to locate most of the causes of disadvantage in the interaction between a person and her environment and in doing so can characterise the disadvantages of disability in a way that avoids the imputation of (...) natural deficiency. However, I also argue that the capabilities approach cannot accommodate some of the stronger claims advanced by some disability scholars. No plausible capabilities approach can guarantee that social change will always be the just or fair remedy for disadvantage, and there is a small number of severe cases of disability where capability shortfalls will be attributed to the person’s ‘deficient’ physical and mental impairments. In this paper I give a theological foundation to a radical type of virtue ethics I call motivation-based. In motivation-based virtue theory all moral concepts are derivative from the concept of a good motive, the most basic component of a virtue, where what I mean by a motive is an emotion that initiates and directs action towards an end. Here I give a foundation to motivation-based virtue theory by making the motivations of one person in particular the ultimate foundation of (...) all moral value, and that person is God. The theory is structurally parallel to Divine Command Theory, but has a number of advantages over DC theory without the well-known problems. In particular, DM theory does not face a dilemma parallel to the famous Euthyphro problem, nor does it have any difficulty answering the question whether God could make cruelty morally right. Unlike DC theory, it explains the importance of Christology in Christian ethics, and it has the advantage of providing a unitary account of all evaluative properties, divine and human. This article considers why truth-telling is so difficult in institutions, and deceit and paltering are so common. Drawing on recent examples of churches and charities exposed for covering up the truth about abuse, the article explores the institutional barriers to truthfulness and considers how they might be removed.

Based on in-depth interviews and fieldwork, this article examines mothers raising kids with invisible, social/emotional/behavioral disabilities to refine feminist theories of mother-blame. The mother-valor/mother-blame binary holds mothers responsible for families and future citizens, maintaining this “natural” care at the center of normative femininity. The author explores how mothers raising such burdensome children understand their experiences and makes three arguments: Fewer mothers are blamed for causing their child's troubles in an era of “brain-blame,” but more are blamed as proximate causes if (...) they do not make unrelenting efforts, paralleling “concerted cultivation,” to resolve them; such mothers often exceed concerted cultivation, as they seize authority, as vigilantes, within educational and medical systems in the midst of turf wars, cost containment, and a resulting proliferation of medication treatments; and this maternal speedup holds mothers accountable for feminizing ties to sons, for policing gender boundaries while policing their own feminine care. In sum, mothers raising invisibly disabled kids may represent the model of maternal valor for an era of public stinginess and extensive medicalization. (shrink)

This essay outlines an approach to virtue theory that makes the foundation of the theory direct reference to virtuous exemplars, modeled on the famous theory of direct reference, devised in the seventies by Hilary Putnam and Saul Kripke. The basic idea is that exemplars are persons like that, just as water is liquid like that, and humans are members of the same species as that, and so on. In this theory exemplars are picked out directly through the emotion of admiration (...) rather than through the satisfaction of a description. We discover the virtues empirically by investigating the qualities of exemplars in a way that parallels the discovery that water is H2O. It is also possible that although the virtues are discovered empirically, the connection between being admirable and having certain traits is necessary, just as Kripke claims that “water is H2O” is necessary, but known a posteriori. InBeing and Nothingness, Jean-Paul Sartre affirms a circle of relations between oneself and another. This circle moves between the relations of love and desire and results from the fact that both love and desire are attempts to capture the other who always remains out of reach. Sartre denies that there can be a dialectic of such relations with others: never can there be a motivated movement beyond the frustrations and failures of each of these attempts to relate to the other. (...) The only way out of this circle is, therefore, according to Sartre, a radical conversion.Like the master in Hegel'sPhenomenology of Mind, each individual caught in this circle wants what cannot be attained: the assimilation or the negation of the freedom of the other. He is thus, like Hegel's master, impervious to any reasons that could count against what he is seeking; his failures cannot in any way motivate him to want what can be. From the point of view of such desires, any negative evaluation of these desires must seem arbitrary. Therefore, to the extent that Sartre's earlier writings indicate no other possibilities of human existence except those premised on such impossible demands, Sartre's negative evaluations concerning the bad faith of these individuals must seem arbitrary.My conclusion is not, however, simply negative since I argue that inSaint Genet Sartre presents Genet's life as a dialectical movement beyond failure to triumph. This is not a dialectic of bad faith. Rather it is a dialectic based on a very different desire from the desire for what cannot be. If Sartre thus develops another level, another fundamental desire, from which the level of bad faith can be judged to be wrong, then at least from this level the judgment is not a merely arbitrary one. While the scientific discourse on astrobiology—the study of the origin, evolution, and distribution of life in the universe—leans toward optimism about the possibility of extraterrestrial life, optimistic thinking is tempered by the limits of evidence and observations gathered thus far. Most astrobiologists assume that “first contact” with extraterrestrial life, if it is ever to occur, will likely be the discovery of microbial life elsewhere in our solar system. But in popular culture, “first contact” tends to be characterized as contact with (...) extraterrestrial intelligence. This article will touch on theory and research relating to the origins and evolution of life and intelligence on Earth and speculation about extraterrestrial life and intelligence. (shrink)

In common with much of the Western world, agrarianism—valuing farmers and agricultural activity as intrinsically worthwhile, noble, and contributing to the strength of the national character—runs through Australian culture and politics. Agrarian sentiments and attitudes have been identified through empirical research and by inference from analysis of political debate, policy content, and studies of media and popular culture. Empirical studies have, however, been largely confined to the US, with little in the way of recent re-evaluations of, or developments from, early (...) work. This paper reports on research that seeks quantitative empirical evidence for the existence of agrarianism in the Australian community and seeks to identify its core characteristics. Using a purpose-designed sub-set of items within a large, omnibus-style survey of regional and rural Australia, we demonstrate that agrarianism exists as a scientifically quantifiable concept identifiable through responses to four key propositions: that Australians should support policies aimed at improving the position of the agricultural industries; that working in agriculture and associated industries brings out the best in people; that agricultural producers make a major contribution to environmental protection and biodiversity conservation; and that the development of agriculture in Australia contributed to the development of the national character. We found very little variation in the degree to which different demographic groupings agree with agrarianism. Older people, farmers, and non-Indigenous Australian-born respondents were among those who were statistically significantly more likely to agree with the defining propositions of agrarianism, but their scores were only very slightly higher than those of other sub-populations in the sample. The category of jus post bellum is a welcome addition to discussions of the justice of war. But, despite its handy Latin label, we will argue that it cannot be properly understood merely as a set of corollaries from jus ad bellum and jus in bello. Instead, an acceptable theory of justice in the postwar period will have to draw on a broader set of normative ideas than those that have been the focus of the just war tradition. In her article, Alcoff argues for the need to examine the reality of race philosophically. According to Alcoff, liberal notions of universality as well as the postmodern critique of essentialism make it difficult to address race and its ongoing significance in social life. By engaging with authors like Charles W. Mills and Paul Gilroy, Alcoff aims to show that it is possible to develop an account of race as social and historical reality without essentializing the category of race.

Although tissue plasminogen activator (tPA) is the only medication approved by the United States Food and Drug Administration (FDA) for acute ischemic stroke, there is no consensus about the need for informed consent for its use. As a result, hospitals throughout the U.S. have varying requirements regarding obtaining informed consent from patients for the use of tPA, ranging from no requirement for informed consent to a requirement for verbal or written informed consent. We conducted a study to (1) determine current (...) beliefs about obtaining patients’ informed consent for tPA among a large group of stroke clinicians and (2) identify the ethical, clinical, and organizational factors that influence tPA consent practices. Semi-structured interviews were conducted by trained and experienced investigators and research staff to identify key barriers to implementing acute stroke services. Part of the interview explored current beliefs and practices around informed consent for tPA.This was a multicenter study that included 38 Veterans Health Administration (VHA) hospital locations. Participants were 68 stroke team clinicians, serving primarily on the neurology (35 percent) or emergency medicine (41 percent) service. We conducted thematic analysis based on principles of grounded theory to identify codes about consent for tPA. We used interpretive convergence to ensure consistency among the individual investigators’ codes and to ensure that all of the investigators agreed on coding and themes.We found that 38 percent of the stroke clinicians did not believe any form of consent was necessary for tPA, 47 percent thought that some form of consent was necessary, and 15 percent were unsure. Clinicians who believed tPA required informed consent were divided on whether consent should be written (40 percent) or verbal (60 percent). We identified three factors describing clinicians’ attitudes about consent: (1) legal and policy factors, (2) ethical factors, and (3) medical factors.The lack of consensus regarding consent for tPA creates the potential for delays in treatment, uneasiness among clinicians, and legal liability. The identified factors provide a potential framework to guide discussions about developing a standard of care for acquiring the informed consent of patients for the administration of tPA. (shrink)

Is ethics all about rights and duties, or is it about living a happy, flourishing life? For millennia in the West, ethics was about the way to flourish as an individual and a community. The qualities that enable people to live that way are the virtues, and that style of ethics is called Virtue Ethics. In the early modern period, Virtue Ethics went out of fashion and ethics began to focus on right and duties, where rights and duties are demands (...) made against others. In this article I argue that the language of rights and duties has made it almost impossible for people on opposing sides of public policy issues to come to agreement. I defend the return of Virtue Ethics in philosophy, and propose that if it can be adopted by ordinary people, we will have a better chance at overcoming our deep divisions. (shrink)
