There is evidence that asexual reproduction has a long-term disadvantage when compared to sexual reproduction. This disadvantage is usually assumed to arise from the more efficient incorporation of advantageous mutations by sexual populations. We consider here the effect on asexual and sexual populations of changes in the fitness of harmful mutations. It is shown that the re-establishment of equilibrium following environmental change is generally faster in sexual populations, and that the mutational load experienced by the sexual population can be significantly (...) less during this period than that experienced by an asexual one. Changes in the fitness of harmful mutations may therefore impose a greater long-term disadvantage on asexual populations than those which are sexual. (shrink)

Preference for partners with low fluctuating asymmetry (FA) may produce “good gene” benefits. However, Gangestad & Simpson's analysis does not exclude immediate benefits of fertility. Low FA is related to fertility in men and women. Short-term changes in FA are correlated with fertility in women. It is not known whether temporal fluctuations in the FA of men are related to short-term fertility status.

Rosso: Can you say something more about the differences between your work and Derrida’s?De Man: I’m not really the right person to ask where the difference is, because, as I feel in many respects close to Derrida, I don’t determine whether my work resembles or is different from of Derrida. My initial engagement with Derrida—which I think is typical and important for all that relationship which followed closely upon my first encounter with him in Baltimore at the colloquium on “The (...) Languages of Criticism and the Sciences of Man”—had not to do with Derrida nor with me, but with Rousseau. It happened that we were both working on Rousseau and basically on the same text, by sheer coincidence. It was in relation to Rousseau that I was anxious to define, to try to work out some … not discrepancies … but some change of emphasis between what Derrida does and what I’m doing. And there may be something in that difference between us that remained there, to the extent that in a very genuine sense—not as denegation or as false modesty —my starting point, as I think I already told you, is not philosophical but basically philological and for that reason didactical, text-oriented. Therefore I have a tendency to put upon texts an inherent authority, which is stronger, I think, than Derrida is willing to put on them. I assume, as a working hypothesis , that the text knows in an absolute way what it’s doing. I know this is not the case, but it is a necessary working hypothesis that Rousseau knows at any time what he is doing and as such there is no need to deconstruct Rousseau. In a complicated way, I would hold to that statement that “the text deconstructs itself, is self-deconstructive” rather than being deconstructed by a philosophical intervention from the outside of the text. The difference is that Derrida’s text is so brilliant, so incisive, so strong that whatever happens in Derrida, it happens between him and his own text. He doesn’t need Rousseau, he doesn’t need anybody else; I do need them very badly because I never had an idea of my own, it was always through a text, through the critical examination of a text … I am a philologist and not a philosopher: I guess there is a difference there … I think that, on the other hand, it is of some interest to see how the two different approaches can occasionally coincide, at the point that Gasché in the two articles he as written on this topic says that Derrida and myself are the closest when I do not use his terminology, and the most remote when I use terms such as deconstruction: I agree with that entirely. But, again, I am not the one to decide on this particular matter and I don’t claim to be on that level … Stephano Rosso teaches English literature at the University of Verona and is writing a dissertation in comparative literature at SUNY—Binghamton. The theories of Rousseau, Kant, Froebel, Hegel, Marx, Nietzsche contemporary English-speaking philosophers and schemes of education, Sartre, Helvetius and B.F. Skinner, are shown, in separate studies, to be variations upon the theme of man as a self-defining and self-legislating subject in a world that does nothing to present him with (...) any Law or Way. The author presents an ethical theory which, as he admits, has much in common with the theories of M. Cohen, R. Sellars, H. Feigl, C. Lamont, and G. Williams. His first task is to define the scientific world view on which his ethical conclusions will be based. It comprises the following suppositions, logically derived from and justified by scientific practice: there is a real world independent of the knower, natural events are uniform, every event is related to some other events, (...) everything is in constant change, all changes are orderly, causes are efficient not final. Before the good life can be defined, science must define human nature, i.e., man's basic and universal needs, which are: physical health, recognition, love, excitement and novelty, knowledge. The good life must satisfy all these needs, but since this may be done improperly, a condition must be added: that satisfaction must come from a real adjustment to the environment in the long run. Moral rules must be both happiness-producing and life-promoting. This framework allows for diversity in moral codes. Determinism does not conflict with morality, for the only freedom that morality presupposes is the absence of external or irrational causes. An act is free to the extent that it is determined by the agent's self-knowledge. The book ends with a brief discussion of the problems of overpopulation, pollution, and world-scale planning.--T. D. In Ai Ssu-ch'i is exemplified and substantiated the Soviet influence on the official definition of philosophy in the history of Communist Party of China, i.e., the assertion about and the method for knowledge of the world. Such a philosophical knowledge has as its formal object the most fundamental laws of the universe.In order to acquire such a genuine philosophical knowledge, one needs a desire to change the world and a proletarian point of view. For only by aiming at changing the (...) world is inevitability reflected; only in the proletarian viewpoint are the objective laws reflected. In order to substantiate these assertions, one has to point out that, first, man's thinking is determined by his social relations and, secondly, social relations are determined by practice. Since the proletariat is in the right kind of practice, it is both in the proper locus of social relations and, therefore, it perceives both inevitability and objectivity. Yet, due to man's subjective dynamism, it is possible for other classes to adopt the standpoint of the proletariat. (shrink)

Thomassin," providing much guidance to anyone who wishes to avail himself of the rich resources in Thomassin's writings. From the point of view of the history of philosophy, the most interesting aspects of Thomassin's thought seem to be (1) his "Cartesianism," that is, the extent to which he early imbibed Descartes' new ideas, (...) and played a role in the fusion of the views of Augustine, B6rulle, and Descartes that developed in the Oratory, (2) his attempt to find a viable theory of the nature of Grace somewhere between Arnauld and Malebranche, and (3) his efforts to formulate a philosophy of history within an Augustinian theology; a philosophy of history that would make historical research and understanding of genuine philosophical and religious value to man. Dr. Clair's too brief discussions indicate that Thomassin was definitely influenced by reading Descartes, but also that Thomassin was much too eclectic to be a Cartesian. With regard to the problem of Grace, where the Cartesian Arnauld fought with the semi-Cartesian Malebranche, Thomassin tried deftly to maintain an Augustinian position that was not quite as rigid as that of the Jansenists, nor as moderate as that of Malebranche (though Arnauld tried to use Thomassin's erudition and authority in his battles with Malebranche). Unfortunately Dr. Clair does not try to evaluate whether Thomassin really found a coherent and theologically acceptable middle-ground between the two antagonists. On the subject of the philosophy of history, Thomassin's views seem most interesting (at least to this reviewer). The short text that Dr. Clair includes on the difference of history from science reveals Thomassin trying to show that the investigation and comprehension of temporal particulars can have significant value for man's understanding of man and that there can be genuine certainty about past facts. Thomassin was writing in the period when modern historical method and outlook were born, when historical study changed from chronicles and ammunition in theological and political disputes to a basic way of understanding human nature. Those concerned with the role of Bayle, Hume, Gibbon, and Vico in developing an historical methodology and a rationale for art historical approach to human problems might well profit from considering Thomassin's writings in this area, and the influence they had on modern historiography and philosophies of history. Dr. Clair's short work certainly helps in filling a lacuna in our picture of the seventeenth century. It also makes one wish he had done more, and had provided a "complete" study of Thomassin's thought and influence. That, perhaps, is one of the major purposes of this new series, in that it will lead scholars to looking into the more hidden portions of the period, and will lead them to filling out in more detail and depth the history of the rise and fall of modern philosophy. It is to be hoped that future volumes in this series will continue to whet our appetites for further investigations, and will transform more of the names we run across into figures about whom we have some information and from whom we can still learn something. Armstrong's book is welcome for that reason, also for its freshness, clearness, and rich brevity. A1- 266 HISTORY OF PHILOSOPHY though a slim volume, it is packed with close yet lucid argumentation, conducted throughout with good manners, and throughout exploratory, clarifying problems, exposing logical and empirical difficulties, not grandly telling us what the truth is but leaving us in a better position to carry on the exploration ourselves. On the basis of analysis of Russian and foreign scholars, the work is aimed at studying the specificity of the transformation of antique stories and images, which is the desired model in the art of the 20th century thanks to its fluidity and unlimited variability. Actualization of antique stories and images in the works of German-language writers account for life-changing moments of social life, the periods of losing of constant moral landmarks and the periods of looking for new moral and (...) aesthetic ideals. The analysis of the reception and transformation of mythological stories and images in the contemporary literature proves the conception of its polysemy. The built-in contradiction of myths is realized through the transformation of mythological stories and images in the literary works of contemporary writers and is explained by the individuality of writers and theirs aesthetic aims. On the one side, the absence de facto in German drama of the 20th century of interpretations of the story about Achilles and of the image of Achilles, and numerous variations on the topic of moral strivings of fearless and peccant Ulysses, on the other side, are proving the statements of classic aesthetic that the tragedy is based on the conflict, which is close to lofty and linked with the idea of dignity of the man, which is ready and capable of promoting the views of his own by the real acts that are often lead to suffer and death. According to Aristotle, the sympathy for the character leads to catharsis - the basis of education of real civic-mindedness and humanness. (shrink)

Purpose of the article is to determine plagiarism as anthropological and social phenomenon. Theoretical basis. The author has analysed authentic historical-philosophical and literary texts to explicate the original meaning of the terms, by which the phenomenon of plagiarism was denoted. There were used methods and principles of socio-philosophical and philosophical-anthropological research, in particular: social determinism and anthropological interpretation of human life phenomena. Originality consists of: clarifying the terminological evolution in relation to designating the phenomenon of plagiarism; 2) the philosophical-anthropological description (...) of the motives and personal traits of the subject of plagiarism proposed by author. Conclusions. 1. Plagiarism as practice and plagiarism as a term existed separately for a long time. With the nominates, which denoted the practice, "Plagium" had as its predecessors the Greek "Λογοκλόπία" and the Latin "Furta". The modern semantics genesis of the term "plagiarism" took place as a process of changing the nominal values due to the complication of the semantic structure of the word before reintegration. 2. Analysis of historical-philosophical and literary sources from the "Empedocles Case" and "Fedentinus Case" allowed reconstructing the anthropological characteristics of the named persons as plagiarists: both of them were induced to plagiarize by vanity, either due to temporary limitation of abilities to intellectual creation or due to constant limited ability to the literary creativity. Plagiarism was also caused by the low moral qualities of both, that allows to consider plagiarism as one of the manifestations of the individual’s integral characteristics. 3. Vanity, that motivates the commission of plagiarism, is one of the manifestations of the esteem needs, sociogenic by its nature, but unlike the next, higher stage in the hierarchy of basic needs does not foresee the self-improvement of man. Therefore, the plagiarist does not pass to the level of the need for self-actualization, the means to satisfy which is creativity in its various forms, "trampling" on the previous level. 4. Plagiarism is an ambivalent phenomenon, because in spite of plagiarists’ anthropological peculiarities, the ontological foundations of plagiarism are rooted in the social nature of man. (shrink)

The central role played by Darwin's analogy between selection under domestication and that under nature has been adequately appreciated, but I have indicated how important the domesticated organisms also were to other elements of Darwin's theory of evolution-his recognition of “the constant principle of change,” for instance, of the imperfection of adaptation, and of the extent of variation in nature. The further development of his theory and its presentation to the public likewise hinged on frequent reference to domesticates.We have seen (...) that Darwin's reliance on the analogy between domesticated varieties and wild species was a bold and original step, in light of contemporary views on the nature of domesticates. However, as Darwin undoubtedly foresaw, his reliance on the analogy created difficulties as well as solving problems, and these began with his Malthusian codiscoverer of the principle of natural selection, Alfred Russel Wallace. Wallace's paper “On the Tendency of Varieties to Depart Indefinitely from the Original Type,” presented to the Linnean Scoiety along with the first public unveiling of Darwin's theory, states: We see, then, that no inferences as to varieties in a state of nature can be deduced from the observation of those occurring among domestic animals. The two are so much opposed to each other in every circumstance of their existence, that what applies to the one is almost sure not to apply to the other. Domestic animals are abnormal, irregular, artificial; they are subject to varieties which never occur and never can occur in a state of nature.62Much has been made of the similarity of views of Darwin and Wallace, but this quotation surely reveals how utterly different their views were on what to Darwin was an important matter. Several critics of the Origin saw Darwin's reliance on the domesticates as his Achilles heel. As Young has pointed out, Samuel Wilberforce included the following passage in his attack on the Origin: Nor must we pass over unnoticed the transference of the argument from the domesticated to the untamed animals. Assuming that man as the selector can do much in a limited time, Mr. Darwin argues that Nature, a more powerful, a more continuous power, working over vastly extended ranges of time, can do more. But why should Nature, so uniform and persistent in all her operations, tend in this instance to change? Why should she become a selector of varieties?63Another critic, Fleeming Jenkin, found the analogy a weakness in Darwin's theory because of the limited extent of variation in any one direction in domestic animals and plants.64 We have already seen that Darwin had confided a similar view to his notebook thirty years earlier, but changed his mind as a result of his profound study of domesticates. De Beer's reference to “an English country gentleman's knowledge of domestic plants and animals and their breeding”65 fails totally to recognize the originality and depth of Darwin's knowledge of domesticates.Why did Darwin, against the currents of his time, rely so heavily on mankind's experience with domesticated organisms to shape his theory about species in nature? On reason is that only with domesticates was an approach that came close to experimental verification possible. Darwin fully realized the inadequacies of the experiment, as is emphasized by his repeated contrasting of selection under nature and selection by man. Yet the extensive experience and data of plant and animal breeders offered the only reliable base against which Darwin could continually challenge his views. As he wrote in the introduction to Variation, with domestication, “man ... may be said to have been trying an experiment on a gigantic scale.”66 Given Darwin's high opinion of the quantitative work of Malthus and Quetelet (as emphasized by Schweber),67 and his unremitting efforts to secure data by which to test his theories, it was inevitable that he should attach high significance to domesticated varieties. John Tyndall, in his Belfast address of 1874, said: “The strength of the doctrine of Evolution consists, not in experimental demonstration (for the subject is hardly accessible to this mode of proof), but in its general harmony with scientific thought.”68 Darwin would have agreed with the latter thought, but I think he would have challenged the preceding one on the grounds that long experience with domesticated varieties did provide an element of experimental demonstration. It gave him confidence in his theory, and he used his vast knowledge of artificial selection boldly and creatively. (shrink)

Colour has been shown to facilitate the recognition of scene images, but only when these images contain natural scenes, for which colour is ‘diagnostic’. Here we investigate whether colour can also facilitate memory for scene images, and whether this would hold for natural scenes in particular. In the first experiment participants first studied a set of colour and greyscale natural and man-made scene images. Next, the same images were presented, randomly mixed with a different set. Participants were asked to indicate (...) whether they had seen the images during the study phase. Surprisingly, performance was better for greyscale than for coloured images, and this difference is due to the higher false alarm rate for both natural and man-made coloured scenes. We hypothesized that this increase in false alarm rate was due to a shift from scrutinizing details of the image to recognition of the gist of the image. A second experiment, utilizing images without a nameable gist, confirmed this hypothesis as participants now performed equally on greyscale and coloured images. In the final experiment we specifically targeted the more detail-based perception and recognition for greyscale images versus the more gist-based perception and recognition for coloured images with a change detection paradigm. The results show that changes to images are detected faster when image-pairs were presented in greyscale than in colour. This counterintuitive result held for both natural and man-made scenes and thus corroborates the shift from more detailed processing of images in greyscale to more gist-based processing of coloured images. Purpose. The paper aims at examining the phenomenon of the rebirth of the Goddess in the contemporary world. The author has used the hermeneutic approach and cultural-historical method, as well as the anthropological integrative approach. Theoretical basis. The study is based on the ideas of Carol Christ, Margot Adler, Miriam Simos, and Jean Shinoda Bolen. Originality. The rebirth of the Goddess is not a deconstruction of the God. The face of the Goddess is one side of the binary opposition "Goddess (...) – God". Life on the earthly plane presupposes masculine and feminine dualism. However, these polarities are not mutually exclusive and mutually suppressive, but complementary to each other. The return of the Goddess to the throne and a profound appreciation of Femininity is a necessary step forward in establishing true equality and restoring lost harmony. As humanity returns to the Absolute that transcends duality, as divinity is revealed in feminine and masculine forms, and, finally, as humans get in touch with their true self, the two faces, feminine and masculine, will inevitably merge. Conclusions. Identifying herself with the images of the Goddesses, a woman develops self-awareness and self-acceptance that contribute greatly to her reintegration with a wider spiritual reality. The cult of the Goddess finds practical application in women’s lives. These are magical rituals, work with the archetypes, life-changing tours. Recognizing her right to the fullness of being, a woman overcomes rigid gender roles and stereotypes, ceases to be an object of manipulation and becomes the supreme arbiter of her own life. (shrink)

This article examines the notorious mid-nineteenth-century American trial of Amelia Norman, who was acquitted - very much against the weight of the evidence - of attempting to kill the man who seduced her. In particular, we explore the role in the trial and its aftermath of the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's "The Coquette" and Susanna Rowson's "Charlotte Temple." In Norman's case, once newspapers, defense lawyers, and reformers such as (...) Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, not attempted murder. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgments on her behalf. For example, Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. Going further, the common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer, David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Other women facing similar charges used the same legal strategy to gain acquittals in a substantial number of cases. Indeed, Norman's sentimental strategy proved so powerful that men on trial for killing their wives' seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms through the so-called honor defense. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Lydia Maria Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. In addition to its legal, literary, and historical insights that it provides, we also intend this article to contribute to debates on the nature of scholarship in law and literature. Scholars such as Wai Chee Dimock have argued for a focus on the historical and historically shifting relations between law and literature - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). We would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. This project, then, responds to Gregg Crane's call for attention to the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice. The extended story of Amelia Norman, in short, not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. Suppose a certain man, Dion, has his foot amputated, and lives to tell the tale. That tale involves a well-known metaphysical puzzle, for most of us assume that there was, before the operation, an object made up of all of Dion’s parts except those that overlapped with his foot-- ”all of Dion except for his foot”, we might say, or Dion’s “foot-complement”. Call that object Theon. (Anyone who doubts that there is such a thing as Dion’s undetached foot-complement may imagine (...) that ‘Theon’ is a name for Dion’s undetached head. Surely there is such a thing as Dion’s head? And surely Dion could, in principle, survive if his head were detached from the rest of him and kept alive?) It seems obvious that Theon, like Dion, continues to exist after the operation, for you cannot destroy an object merely by changing its surroundings--merely by removing something that was never a part of it. The puzzle, then (which might be called the problem of undetached parts), is how Dion and Theon are related after the operation. The most common answer to this question is that Dion and Theon come to occupy just the same region of space and to be made of just the same matter after the operation. The next-mostpopular answer is that Dion and Theon are made up of temporal parts, and while those of their temporal parts that “occur” before the operation only partly overlap, Dion and Theon have the very same post-operative temporal parts. Much as two roads can merge and have spatial parts in common, Dion and Theon merge and have temporal parts in common. Less popular accounts of the relation between Dion and Theon involve relativizing identity to concepts or times, and denying that there is such a thing as Theon. Michael Burke has recently proposed an intriguing new solution (or resurrected an ancient one) to the problem of undetached parts. Like Michael and the several other distinguished scholars who have written their endorsements (...) for this new reprint, this occasion gives me a long moment to reflect on how this little book has changed my life. The project has also given me a reason to go back and reread the review of this book written by my longtime friend and collaborator, Henry Rosemont, Jr., published almost 50 years ago in Philosophy East and West.My first memory is of Herb Fingarette himself. I met this gentleman, and gentle he was, early on in my tenure at the University of Hawai‘i when Herb, always accompanied by Leslie, would make regular visits to participate in our public lectures and conferences. I always marveled at how in his presentations he would begin from some seemingly simple and offhand fact about our everyday lives. He would then quite masterfully take this ordinary detail and, through a series of incrementally insightful reflections and then again through his sensitive responses to the questions raised by his audience, elevate the discussion to become an extraordinarily memorable event. I remember well how this seasoned teacher always began the question session by calling upon the graduate students, leaving his eager professional colleagues to wait their turn. And then, with the rigor and impeccable logic of the best kind of analytical philosopher, he would gently and always smilingly, win everyone over to his conclusions.When Herb retired from Santa Barbara, he was adamant that he was retired, and in spite of the many efforts we made to draw him back into the circuit, he would have none of it. Over the ensuing years that saw a clear-headed and always happy Herb carry on until a few years short of his centenary, I would sometimes accompany Rosemont in his regular pilgrimages to sojourn with his best Berkeley friends, which included, along with Herb, David Keightley, Huston Smith, and of course, Michael Nylan.Turning then from the large-souled man to the little book that changed the world of Confucian studies, to say that it was not well received is an understatement. When this monograph published by HarperCollins, a trade press, first appeared in the bookstores, whispers ran through the sinological community about how this pretender had the temerity to engage a canonical text well beyond his reach. Without proper philological training, he was actually challenging what we all know to be the proper translations of important Chinese terms. Again, Herb’s philosophical colleagues who were baffled by his efforts to engage Chinese philosophy as philosophy, also had his number, and it was not a high one.As Rosemont pointed out in both a critical, and to my knowledge, the first truly appreciative review of Fingarette’s commentary on the Analects (a feature review that in its pages would constitute a goodly portion of Fingarette’s 79-page book), what made this book an important inflection point for Confucian studies is that a rigorously trained philosopher was writing a philosophical and philological exegesis on what he deemed a philosophically profound text. Even for Fingarette who was himself initially nonplussed by the idea that the Analects was good philosophy, it took a careful reading and an open mind to fathom both the depth and the worth of the Analects for reflecting on our lives as they are lived today.It is a commonplace that we often do not appreciate those teachers who have influenced... In his Philosophical Inquiry concerning Human Liberty (1717), the English deist Anthony Collins proposed a complete determinist account of the human mind and action, partly inspired by his mentor Locke, but also by elements from Bayle, Leibniz and other Continental sources. It is a determinism which does not neglect the question of the specific status of the mind but rather seeks to provide a causal account of mental activity and volition in particular; it is a ‘volitional determinism’. Some decades later, (...) Diderot articulates a very similar determinism, which seeks to recognize the existence of “causes proper to man” (as he says in the Réfutation d’Helvétius). The difference with Collins is that now biological factors are being taken into account. Obviously both the ‘volitional’ and the ‘biological’ forms of determinism are noteworthy inasmuch as they change our picture of the nature of determinism itself, but my interest here is to compare these two determinist arguments, both of which are broadly Spinozist in nature – and as such belong to what Jonathan Israel called in his recent book “the radical Enlightenment,” i.e. a kind of underground Enlightenment constituted by Spinozism – and to see how Collins’ specifically psychological vision and Diderot’s specifically biological vision correspond to their two separate national contexts: determinism in France in the mid-1750s was a much more medico-biological affair than English determinism, which appears to be on a ‘path’ leading to Mill and associationist psychology. On his famous walk to Vincennes to visit the imprisoned Diderot, Rousseau had what he called an “illumination”—the realization that man was naturally good but becomes corrupted by the influence of society—a fundamental change in Rousseau’s perspective that would animate all of his subsequent works. At that moment, Rousseau “saw” something he had hitherto not seen, and he made it his mission to help his readers share that vision through an array of rhetorical and literary techniques. The call for the complete modernization of man is certainly bold, but transhumanism will not go far if it is too shocking and unconventional. However, transhumanists agree that the existence of a society of transhumans requires the introduction of new norms and rules of life. Transhumanists believe that we can talk about improving the situation of humanity if the situation of specific people has improved. And only a person can judge what is good for him or her. Therefore, transhumanists value the personal freedoms and rights of those who want to use technology to expand their mental and physical capabilities and increase control over their own lives. His body natural is a Body mortal, subject to all Infirmities that come by Nature or Accident... But his Body politic is a Body that cannot be seen or handled, consisting of Policy and Government..." In Professor Kantorwicz's sure hands the fiction of the king's two (...) bodies becomes a focal point for a wide-ranging study of medieval theology and political thought, and the center of a microcosm in which we can observe man's universal activity of borrowing concepts from one discipline to deal with changing situations in another.--R. The author is a historian of religion, one accustomed to trying to understand the meaning of sentences in religions which appear in cultures different from our own. From this perspective he attacks linguistic philosophy, arguing that it does not take adequate account of the systems within which sentences in religion are used, that it fails to understand the personal dimension of religious utterances, and that the tendency to treat religious utterances as propositions to be believed is the result of a (...) narrowness of vision resulting from a development in western culture in which we have come to look to the sciences for our models of understanding and speaking. Faith, not belief, Smith argues in these Richard Lectures delivered at the University of Virginia, is the central religious category and statements which arise from faith are personal statements, statements about man and his relations to the world and God. That the modern era talks so much about religious belief rather than faith is said to be the result of a turn which has taken place in our uses of "faith" and "belief" and this turn, which is indicative of a change in the world view of western culture, is held to have been aided and abetted by theologians. In this article, I provide a historical and philosophical discussion of the so-called “science wars”. The term “science wars” refers to a series of debates which took place in the second half of the 1990s and which centered on the status of science and the nature of scientific knowledge. On the one hand, a group of authors reacted against what they perceived as a “postmodern” attack on science. This in turn led to several reactions from those who were labeled as (...) “postmodernists”. Among these, some authors in turn claimed that it were the scientists and their epigones who were the real aggressors, using the authority of science to attack any form of critical thinking and even democracy itself. I first provide a short historical overview and analysis of the science wars. The aim of this overview is to show how critics of postmodernism ignored differences between different approaches in science studies and in this way constructed the idea of the existence of a homogeneous postmodern attack on science. This resulted in an intellectual trench war, in which more nuanced positions got overlooked, being trapped in the no man’s land between two extreme positions. After this historical overview, I explore this no man’s land. I discuss several scholars and approaches within science studies that had been grouped together by critics of postmodernism. I will focus on the differences between these approaches, thus providing a more nuanced picture of science studies. Finally, I argue for the relevance of revisiting the science wars. Blindly labelling (certain approaches in) science studies as “anti science” disables us from using important insights from these studies, insights which could be relevant in dealing with complex societal issues in which scientific knowledge plays a role such as climate change. Our paper explores how the affective energies and cultural expectations set in motion by best-selling American sentimental novels like Hannah Foster's The Coquette and Susanna Rowson's Charlotte Temple informed the notorious mid-nineteenth-century American trial of Amelia Norman, who attempted to kill the man who seduced her. Once newspapers, defense lawyers, and reformers such as Lydia Maria Child recast the defendant as a sentimental heroine, the trial became about seduction, and Norman was acquitted against the weight of the evidence. Sentimental novels (...) turn on the contrast between the passive victim status of the heroine and the active libidinal quest of the rake-villain. As Cathy Davidson points out, this fiction is "about silence, subservience, stasis (the accepted attributes of women as traditionally defined) in contradistinction to conflicting impulses toward independence, action, and self expression (the ideals of the new American nation)." The seduction plot diverts attention from this disparity by establishing an affective solidarity between heroine and reader and elevating the ruined woman to a tragic status. The sentimental emplotment of Norman's life marshaled a powerful set of emotional responses and moral judgements on her behalf. Norman claimed insanity. And since sentimental heroines are supposed to go mad when they are seduced and abandoned, the jury was prepared to interpret her symptoms according to her lawyers' very strategy for establishing her innocence. Ultimately, however, Norman embodied the plight of the sentimental heroine at the same time that she contested her fictional counterpart's fate. In this way, her trial spectacularized the disparity which the sentimental novel conjures up and displaces but never resolves. The common law theory of coverture, which severely limited the legal personhood of married women, has received a great deal of scholarly attention. Cases like Norman's remind us that unmarried women were also subject to draconian constraints on their legal personhood. The tort of seduction is a key example. Legal historians trace the development of the seduction tort from its common-law origins, when men's property interest in women's bodies formed the basis of the cause of action, to 1851, when Field Code authors (including Norman's lawyer David Graham) persuaded several states to grant seduced women standing to bring their own cause of action. Consequently, courts were forced to reckon with the seduced woman as a moral agent capable of consenting to sex. As trials like Norman's demonstrate, sentimental novels helped lay the groundwork for this shift in the law by elucidating a subjectivity for the seduced woman. Yet the doctrinal implications of Norman's precedent-setting trial had a second, more ambiguous strain. Norman's sentimental strategy proved so powerful that men on trial for killing their wive's seducers appropriated it to bring their own stories before juries and to reinforce male sexual norms. In the end, then, Norman's trial fostered legal reform, but it also suggested - as Child's fictionalization of the case in "Rosenglory" recognized - that only sustained and multifaceted efforts to change cultural as well as legal norms could improve the sexual status of women. Scholars such as Wai Chee Dimock have argued for a focus "on the historical and historically shifting relations between law and literature" - a view we endorse. Where we differ from Dimock is in our diversion of attention away from abstract ideas of law laid out by treatise writers and philosophers in favor of law experienced and manipulated by individuals. So, too, we are interested less in representations of concepts such as justice in legal and literary texts than we are in the ways in which literature (broadly conceived) can create provisional and fragile opportunities for concrete instantiations of justice and even generate legal change (for good or ill). Going further, we would argue that to the extent legal change motivates rather than simply mirrors cultural change, it needs literature to be effective. Thus, we see no need to characterize - and indeed reject the depiction of - law as "a limited arena" in which ideas of morality have little place. This project, then, responds to Gregg Crane's call for attention to "the complex and slippery historical interactions of law and literature that shape and are shaped by an ever changing cultural idiom of justice." The extended story of Amelia Norman not only constitutes a case study in the inescapable interaction between the overlapping and interdependent discourses of law and literature, but also reveals the literary and legal consequences of that interaction. For years, phenomenological psychiatry has proposed that distortions of the temporal structure of consciousness contribute to the abnormal experiences described before schizophrenia emerges, and may relate to basic disturbances in consciousness of the self. However, considering that temporality refers mainly to an implicit aspect of our relationship with the world, disturbances in the temporal structure of consciousness remain difficult to access. Nonetheless, previous studies have shown a correlation between self disorders and the automatic ability to expect an event in time, (...) suggesting timing is a key issue for the psychopathology of schizophrenia. Timing disorders may represent a target for cognitive remediation, but this requires that disorders can be demonstrated at an individual level. Since cognitive impairments in patients with schizophrenia are discrete, and there is no standardized timing exploration, we focused on timing impairments suggested to be related to self disorders. We present the case report of AF, a 22 year old man suffering from schizophrenia, with no antipsychotic intake. Although AF shows few positive and negative symptoms and has a normal neurocognitive assessment, he shows a high level of disturbance of Minimal Self Disorders (SDs) (assessed with the EASE scale). Moreover, AF has a rare ability to describe his self and time difficulties. An objective assessment of timing ability (variable foreperiod task) confirmed that AF had temporal impairments similar to those previously described in patients, i.e., a preserved ability to distinguish time intervals, but a difficulty to benefit from the passage of time to expect a visual stimulus. He presents additional difficulties in benefitting from temporal cues and adapting to changes in time delays. The impairments were ample enough to yield significant effects with analyses at the individual level. Although causal relationships between subjective and objective impairments cannot be established, the results show that exploring timing deficits at the individual level is possible in patients with schizophrenia. Besides, the results are consistent with hypotheses relating minimal self disorders (SDs) to timing difficulties. They suggest that both subjective and objective timing investigations should be developed further so that their use at an individual level can be generalized in clinical practice. (shrink)

The paper will develop in three parts: first, an exposition of the Stagirite doctrine; second, an overview of the problems and threats to the traditional family and finally an evaluation of the doctrine. Através da análise qualitativa dos planos de ensino de 11 universidades gaúchas, pode-se inferir que a concepção de homem predominante na Psicologia Clínica, como disciplina acadêmica, (...) é a concepção própria da Psicanálise.This article aims to know the concepts of man that can be found in the bibliography used in courses of clinical psychology in universities of Rio Grande do Sul. As a first step, we went through a bibliographical survey about the ways man has been comprehended along history up to Modern Age and the advent of Psychology as science. From the qualitative analysis of the teaching plans of eleven universities of Rio Grande do Sul, it is possible to infer that the psychoanalytical concept of man is the predominant conception found in clinical psychology as an academic discipline. Reading Stephen Owen's new book, All Mine!: Happiness, Ownership, and Naming in Eleventh-Century China (hereafter All Mine!), many readers will find that the perspectives of eleventh-century Song scholar-officials on finding (...) happiness in material things are still highly relevant to the increasingly materialistic culture in China and the world in the present day. Under the Song dynasty, the pursuit of happiness through material objects is "what contemporaries themselves recognized as uncomfortable topics" (p. 14). In writing this book, Owen attempts to survey a literary phenomenon in which material-contingent happiness permeated Song literature despite the moral surveillance of classical ideology on happiness and ownership that stretched back to the Lunyu (Analects of Confucius). At the same time, the author elucidates how material-contingent happiness in literature drove and was driven by the sociocultural changes and the growth of commercialization in the Song. All Mine! is a fine balance between literary study and intellectual history. Owen's approach tends to be all-inclusive, as he covers a diverse range of genres (including prose, poetry, miscellany, and biography) and texts with which readers generally have different levels of familiarity. For every text, Owen provides thorough explanation on its background, allusions, and references, while also offering in-depth cultural, aesthetic, and structural analysis. He calls our attention to the subtle differences between similar texts, such as the biographies of Ouyang Xiu 歐陽脩 and Tao Yuanming 陶淵明, to show how they deliver entirely different ideas about happiness and ownership and signal a radical transition from the old to a new world of values. Regarding intellectual history, the book studies the conflicts between different discourses on happiness. Owen reveals different forces of censorship against happiness of acquisition and ownership, presenting them especially clearly with Ouyang Xiu's stories in Chapter 1 ("The Biography of the Retired Layman Six") and Chapter 2 ("The Magistrate of Peach Blossom Spring"). The author also pays close attention to the act of naming as a form of ownership. As he points out, the process of Song literati trying to "get the right name" for objects and sites often converged with the process of elaborating different [End Page 1] person-thing relationships based on the social status of the owner and the characteristics of the object of ownership, thereby grounding the principles for judging the morality of material-contingent happiness. Readers can also see the happiness-ownership paradox in literature as closely related to the commercialization of elite-praised goods that was flourishing in Song society. This validates Owen's choice "to think of cultural and historical phenomena as ecosystems or solar systems in constant change, each particular changed by and changing the whole" (p. 13). Perhaps the most impressive chapters in the book are 3 and 5, which deal with the Song's perspective on ownership as transient and unstable, and its relationship with happiness. Chapter 3 explores the pervasive awareness that "things are held by power, not by right" (p. 67). The source of "power" could be financial, social, political, and military advantage, or something humans can't control, like death. Owen relates many sad Song stories of elites whose things were taken by someone with greater power. The most interesting one is perhaps that of Su Dongpo 苏東坡 and his "Nine Blossoms Mountain in a Jug," in which Su was not willing to give up the little world that he attached to this rock mountain, despite being very conscious about the dangers of possession. "It is alright if the superior man lets his interests be temporarily invested in things, but it is not alright if he lets his interest remain in those things," the author writes (p. 72). INTRODUCTION BY NANCY FUMERO What is a translation that stalls comprehension? That, when read, parsed, obfuscates comprehension through any language – English, Portuguese. It is inevitable that readers expect fidelity from translations. That language mirror with a sort of precision that enables the reader to become of another location, condition, to grasp in English in a similar vein as readers of Portuguese might from João Guimarães Rosa’s GRANDE SERTÃO: VEREDAS. There is the expectation that translations enable mobility. That what was (...) written in one language be accessible in another. And that a translator is to serve as a mediator, acting ultimately in service to ideas within the source text. To disperse them. However, this notion of translation is partly antithetical to the ideas in Rosa’s work. Or, alternately, to convey the despair of terrain slipping beneath one’s feet, and to encounter the heightened suspense of magic, the translation, as part of its strategy, cannot devotedly rely on its original language, not as its source text. The work undertaken by Felipe W.Martinez is a new form of translation that risks everything in order to encounter the same treacherous knowing Rosa had traversed. And it takes its risks by not taking risks: by being, almost word for word, a literal translation. This is an approach that reductively converts, as opposed to translates. The idiomatic differences between English and Portuguese are not accented. The syntax is not finessed. Liberties are not assumed on account of improving readability. What stands, resoundingly amid such absences, is the awakened challenge of reading. The genuine peril of not knowing. That is, this translation, one that purports to know nothing, creates access into the guileful world Rosa had created in Portuguese. But not by translating. If anything, GRANDE SERTÃO: VEREDAS is speaking a cosmic language through a linguistic one. And W.Martinez does us the service of recognizing this, as what configures the shapes of words and sentences is not as simple as neologisms, portmanteaus, and digressions, but as terrifying as the path the fool traverses: all paths. As such, this translation doesn’t speak English, just as the original does not speak Portuguese. It is the assemblage of paradox as a new logic that can be navigated, if only one could suspend the comfort of readability, of expectation. If one could descend a mountain in the pitch dark of night, each step shocking the body, unable to acclimate to the unleveled heights. Without a doubt, the translation is incongruous to the Portuguese. Taking a small excerpt to compare: Eh, well, thereafter, the rest the Sir provide: comes the bread, comes the hand, comes the god, comes the dog. What is striking is the interplay between “god” and “dog”. To most English speakers, this anagram is a familiar one. But in Portuguese the words god (“deus”) and dog (“cão”) are not so closely linked. In fact, there is no direct mention of “deus” in Rosa’s text: Eh, pois, empós, o resto o senhor prove: vem o pão, vem a mão, vem o são, vem o cão. Both are fascinating. In Rosa’s excerpt, the rhythm is unmistakable and precise, despite, of course, the indices of hesitation: the commas, the Eh, the uncomfortable way of searching through prolongation and wait. This is the sort of paradox Rosa can engage within a sentence. W.Martinez’s does this as well, at a scale that reverberates beyond the sentence, and with one noticeable addition: deus. What may appear to be an overstep, to add such a weighted word that draws out wordplay but is, nevertheless, not in the source text, is exemplary of risk. The translation buzzes because of it. This is because throughout the text we encounter dogs frequently, as some primal beast on par with humans. The dog is one that masters and can be mastered. A creature that is at times its face, and at others a mask. It is a powerful presence. For the translator to be attuned to the reverent undercurrent attributed to this animal, and create within the translation such charged play in English from what was only an implication in Portuguese, is in tribute to the grand beauty within dissonance. What aberrant modes of writing and translation can teach us most assuredly, is that things, words, are not in states of rightness or wrongness, but of oscillation. This isn’t so different from what Rosa says himself: The Sir look…see: the most important and beautiful, of the world, is this: that the people are not always same, still were not completed — but that they go always shifting. They tune or detune. We find this so readily in W.Martinez’s translation, this tuning and detuning. Sustained attention, a key cognitive skill that improves during childhood and adolescence, tends to be worse in some emotional and behavioural disorders. Sustained attention is typically studied in non-affective task contexts; here, we used a novel task to index performance in affective versus neutral contexts across adolescence (N = 465; ages 11–18). We asked whether: (i) performance would be worse in negative versus neutral task contexts; (ii) performance would improve with age; (iii) affective interference would be greater in younger adolescents; (...) (iv) adolescents at risk for depression and higher in anxiety would show overall worse performance; and (v) would show differential performance in negative contexts. Results indicated that participants performed more poorly in negative contexts and showed age-related performance improvements. Those at risk of depression performed more poorly than those at lower risk. However, there was no difference between groups as a result of affective context. For anxiety there was no difference in performance as a function of severity. However, those with higher anxiety showed less variance in their reaction times to negative stimuli than those with lower anxiety. One interpretation is that moderate levels of emotional arousal associated with anxiety make individuals less susceptible to the distracting effects of negative stimuli. (shrink)

In the beginning of the 20 th century, the discussion of the anthropological theme across the field of French philosophical debate. It also implies a redefinition of philosophy and politics at different levels. This is about the second episode of great anthropological questioning that took place in the 20th century, since the first had to do with the great German philosophical works which draws on the writings of Max Scheler, Martin Heidegger, Helmuth Plessner, Arnold Gehlen, and Ernst Cassirer, among others. (...) In the early 1960, the issues of the debate are of a different order. What is at the heart of this reflection is both a radical discussion issue of anthropology as an attempt to define the role and status of criticism in contemporary thought. Foucault makes the anthropological critique the point of departure, at the same time, in his review of the role and function of the Humanities on the device knowledge-power of modern and contemporary societies and the whole philosophical trajectory in which he will involve his searches during the duration of his life. He tries to understand what the meaning of the field of empirical knowledge that comes to emerge at this time with the claim to be a science, anthropology. Anthropology ends up wanting to resume human experience and philosophy in a move where the man gives his truth as the soul of truth. It is at this movement that Nietzsche put an end, when he showed that the death of God accompanies the death of man; that death of God is the end of metaphysics, and the place left free isn't absolutely the man who takes. The death of George Floyd in May 2020 sparked an unprecedented global wave of protests that appeared to mark a turning point in the battle against racial injustice. But protests against racism are not new; each comes and soon passes into the archives of history, leaving few lasting changes in its wake. What was different about the death of Floyd was that the graphic manner of its unfolding was captured on film: the slow act of wilful suffocation, and how the (...) entire world was seemingly invited to witness the torment and the execution of this man, in broad daylight, even as he cried I can't breathe. However, this discussion attempts to move beyond that moment of death, the protests that followed and the distracting debate about statues and monuments to argue that the death of Floyd must be seen as the culmination of the process of systemic and structural racism. It aims to show how racism shifted from the black body as the visible and material target of racial oppression to air/breath, and how suffocation became the characteristic feature as well as the weapon of contemporary racial injustice. The period of the end of the twentieth — the beginning of the twenty-first century can be called the heyday of human rights movements that advocate the inclusion of new agencies in the political, ethical, social and other fields. Among them arose the animal rights movement, which later developed into a philosophical turn called animal turn, which is now one of the most popular in the Western philosophical and anthropological discourse. Being mostly a media and popular science project, animal turn (...) has been little studied and criticized from an academic point of view. In this article, it is proposed to explore the history of the turn, its development and, most importantly, how the ideas about man, animal and their relationships changed within the framework of animal turn. The new anthropology, which also includes the turn under discussion, inextricably links the concept of man with the concept of boundary, stating it as a necessary element for the constitution of the human self. As a part of a general philosophical trend to expand the discourse of the Other, animal turn suggests to consider the animal as a universal example of Otherness, which can not only coexist with a human, but also be an integral part of his self-perception. The article proposes to consider how the transition from the recognition of animals as "also feeling" was gradually made to the idea of maximum inclusiveness, openness and hospitality. It is also proposed to critically comprehend the new concept of man as a being who strives for maximum positive harmony with himself and the material world. As examples, the texts of the most famous representatives of animal turn are analyzed: P. Singer, T. Regan, J. Derrida, B. Massumi, P. Godfrey-Smith and V. Despre. (shrink)

History would be the most profound social, political, and economic points of contention behind the daily lives of a population under siege. Not simply those talked about (...) while people travel in public transportation (Haitians talk a lot while in public transportation), but also the interpretive matrices mobilized to speak about these problems. As for current events, they are the province of newspaper headlines, those front pages and editorial pages most often read and shared, the public opinion machine.Of course, a few snippets of news come to me: the rise of kidnapping, political instability, the opposition declaring that the presidential mandate has ended, a government sponsored referendum to change the constitution, upcoming elections. As I write this piece (summer 2021), armed banditry is rife in many working-class neighborhoods. There are victims by the dozens nearly every day.As I was asking myself how best to express the bicentennial dyspnea of the Haitian people, I learned about the assassination of the president of the Republic in his private residence.Haiti could not breathe. Now it is suffocating.I recently published a novel entitled Combats (March 2021) in which the characters live in a nineteenth-century rural setting. They experience the full force of the first consequences provoked by the infamous independence debt, well understood by Haitians and analyzed by international specialists such as David Graeber and Thomas Piketty.After its independence in 1804, Haiti was not accepted into the concert of nations. The country, founded by hordes of previously enslaved Blacks and by freed Mulattos, was a bad example, a model not to be emulated so geographically near a slave society, the United States, and the Antilles belonging to France. No economic power, that is, no white country defining itself as such, recognized the independence of the new Black, abolitionist, and egalitarian population. The isolation of Haiti thus began at the very moment of its foundation. [End Page 165]In a vain attempt to escape the embargo and to construct a collective destiny at the international level, Haiti accepted a colossal debt imposed on it by France. Charles X, king of France and Navarre, forced Jean-Pierre Boyer, supreme leader of the Haitian nation, to assume the responsibility for a ransom of 120 million francs. The economist Thomas Piketty calculates that this was equivalent to 28 billion euros in today's currency. David Graeber, in his Debt: The First 500 Years, considers it to be the most egregious debt in history. In truth, for Haitians, this strange transaction consisted in buying lands they had already conquered in their independence struggle, having taken them from the previous colonial settlers representing the French state.Since the previously emancipated ancestors were considered the colonial settlers' property, Haitians, under threat from the French army, assumed the weight of this debt, which really consisted in purchasing—from their previous torturers—their very persons and those of their grandparents. In other words, after the war of independence, begun by Black Maroons as soon as they arrived on the island of Haiti, pursued by Toussaint Louverture against slavery, brought successfully to a conclusion by Jean Jacques Dessalines through victorious military battles (November 1803 at Vertières, for example), after this long road toward emancipation, France, supported by all the foreign powers of the period, extracted from Haiti recognition of the debt in 1826, that is, during the first half of the nineteenth century, at the very moment when the independent countries of the world were beginning to undergo a massive industrialization.Haiti clearly missed out on this entrance into the industrial age of the steam engine. Janet Broughton In the introduction to the Treatise, Hume cautions the reader that the scientist of man cannot "go beyond experience" and "discover the ultimate original qualities of human nature."1 "[T]he only solid foundation we can give to this science," tie says, "must be laid on experience and observation" (Txvi). This methodological principle is a familiar Newtonian one; indeed Hume makes a (...) point of saying it applies to "all the sciences" (T xviii), not just to the science of man. Although the principle is familiar, just what it enjoins is not clear. We are to renounce investigations that go "beyond experience," and we are not to seek "ultimate" qualities. But exactly which investigations and qualities are these? The question is a difficult one for Newton as well as for Hume. But Hume's invocation of the familiar methodological principle raises two additional questions, ones that need not especially trouble Newton. When the scientist of man goes about his task ofgathering "experience and observation," what sort ofthing is he to observe? And how is he to make his observations? My mainaimin this paperisto answerthose two questionsas they arise for the early stages ofHume's investigation ofhuman nature in the Treatise. For one thing, when Kemp Smith calls Hume a naive realist, he means that Hume begins by assuming that the Lockean is right about this much: when we see, hear, remember, and so on, we are "immediately" or "directly" aware of something—albeit objects, not ideas. But I do not think that Hume's account of the early phases of his investigation requires us to impute that assumption to him. I also see the choice Kemp Smith offers us as limiting in another way. The purpose of the patent system is to provide incentives for the development of new and useful products and processes. Such products and processes are generally referred to as ‘inventions’. Whilst patents have historically been sought and granted for mechanical and chemical inventions only, the biotechnology revolution of the last 30 years has radically changed this by precipitating a mass of patent applications in respect of living and biological matter. Applications of this nature have forced a re-examination by courts and (...) policy makers of traditional understandings of what can be patented. In particular, they have forced consideration of the extent (if any) to which life and nature can be viewed as ‘inventions’ so as to be capable of supporting a patent. In considering this question the central guiding principle has been the distinction, on which all of patent law is said to rest, between man-made inventions on the one hand and discoveries of nature on the other. Resumen: El corpus, siendo una herramienta eficaz, se está empleando en múltiples ámbitos, entre los que se encuentran los estudios de traducción. Sin embargo, dicho recurso no se utiliza con mucha frecuencia en las investigaciones traductológicas cuando una de las lenguas en cuestión es chino clásico (la lengua escrita empleada antiguamente en China), y autores que sí hacen estas investigaciones suelen no mencionar los pasos a seguir cuando se trata un corpus paralelo ad hoc. El objetivo del presente artículo es (...) presentar cómo se elabora un corpus paralelo chino clásico-español tomando como ejemplo la novela histórica Romance de los Tres Reinos y sus traducciones al español. Para ello, hemos descrito la problemática de creación y explotación de este tipo de corpus, siguiendo el orden de las fases del proceso. Resulta que algunas fases del proceso son universales, mientras que otras son propias de lenguas clásicas y de la combinación lingüística chino-otra lengua, en cuyo caso sí faltan aplicaciones eficaces. Con el trabajo, esperamos deparar información a los estudiosos que quieran realizar y profundizar las investigaciones basadas en corpus paralelo y en las obras clásicas de China. Abstract: The corpus, being an effective tool, is utilized in multiple fields. One of them is the Translation. However, this resource isn´t used frequently in translation studies when one of the languages in question is classical chinese (written language used anciently in China). And when it comes to an ad hoc parallel corpus, the steps of how to create it are usually omitted by researchers who make such investigations. The objective of this article is to present how to elaborate a classic Chinese-Spanish parallel corpus taking as example the historic novel Romance of the Three Kingdoms and its two translations into Spanish. To reach the objective, we have described the problem of creation and exploitation of this type of corpus, following the order of the phases of the process. We’ve found that some of the phases are universal while other phases are unique for old languages and for the linguistic combination Chinese-other language. And in this latter case, there’s a lack of effective applications. With the current work, we hope to offer useful information to those scholars who are willing to carry out their own investigations based on self-built parallel corpus and at the same time related to the classic Chinese works.
