Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

I address three topics. First, I argue that the issue of corporate moral responsibility is an important one for business ethics.Second, I examine a core argument for the claim that the corporate organization is a separate moral agent and show it is based on anunnoticed but elementary mistake deriving from the fallacy of division. Third, I examine the assumptions collectivists make about whatit means to say that organizations act and that they act intentionally and show that these assumptions are mistaken (...) in their failure to understand the nature of intentional causality and of “as-if” intentionality. In exposing these mistakes I set out my own view in the form oftwo theses, the first of which states that individual members of an organization are always causally responsible for any corporate act,and the second of which states that attributions of intentions to corporations are always either descriptive or prescriptive attributionsof “as if” intentionality. Understanding what motivates employees is essential to the success of organizational objectives. Therefore, properly capturing and explaining the full range of such motivations are important. However, the classical and most popular theories describing employee motives have neglected, if not omitted entirely, the importance of the ethical and spiritual dimensions of motivation. This has led to a model of a person as self-interested, amoral, and non-spiritual. In this paper, we attempt to expose this omission and offer a more complete taxonomy of (...) motivations which include these dimensions. Although more work will need to be done to fully develop the ethical and spiritual dimensions of motivation, the expanded taxonomy will provide the foundations and serve as a guide for such further research. Furthermore, this new categorization of motivations brings out the full dimensions of being human, which promises to lead to improved management practices with regard to employees and foster greater human flourishing in the workplace. The author sets out a realist defense of the claim that in the absence of an international enforcement agency, multinational corporations operating in a competitive international environment cannot be said to have a moral obligation to contribute to the international common good, provided that interactions are nonrepetitive and provided effective signals of agent reliability are not possible. Examples of international common goods that meet these conditions are support of the global ozone layer and avoidance of the global greenhouse effect. Er zeigt, dass Berkeley das Naturgeschehen als einen göttlichen Diskurs sieht; das visuell Wahrgenommene ist dabei die Sprache. Berkeley beharrt darauf, diese These der göttlichen Sprache wörtlich auszulegen, da sie Grundlage eines seiner Ansicht nach einzigartigen Gottesbeweises ist. Um Berkeleys Argumentation zu verstehen, muss man sich auch mit den (historischen) Umständen beschäftigen, in welchen er diese These entwickelt und verteidigt. Deshalb wird sie (...) im ersten Teil in ihren diachronen und synchronen historischen Kontext eingebettet. Die zweite Hälfte ist dann einer kritischen Rekonstruktion von Berkeleys These gewidmet. I argue that Plato was right in claiming that justice is more profitable, more rational, and more intrinsically valuable than injustice, and that this is particularly true for business organizations. The research on prisoners’ dilemmas and social dilemmas shows that ethical behavior is more profitable and more rational than unethical behavior in terms of both the negative sanctions on unethical behavior when interactions with stakeholders are iterated, and the positive rewards of habitually ethical behavior when stakeholders can identify those who (...) are predisposed to be ethical. In addition, the psychological research on justice shows that justice is intrinsically valued, both from an outcome and from a process perspective, and so crucial for business organizations, particularly in terms of organizational effectiveness. In this paper an alternative analysis that avoids ontological commitment to the self is proposed, based on the notion of de objecto attitudes. This proposal develops an idea from Hintikka’s second generation epistemic logic, which introduces a syntactic marker expressing independence relations between certain logical constants. En ces temps d’avenir perdu, les sociétés sont des sociétés spéculatives, qu’elles le veuillent ou non. Alors que la crise financière de 2007–2008 s’est transformée en une myriade de crises politiques dans les années qui ont suivies. En effet, l’esprit d’un âge néo-biedermeierien et les programmes politiques axés sur la stabilité sont devenus le modus operandi de l’Occident dans les contextes économiques et bien au-delà. Le désenchantement du néolibéralisme et son eschatologie politique dans un large éventail de domaines socioculturels perdurent (...) des deux côtés de l’Atlantique, tout autant que l’aporie des sociétés qui tentent de sauver le statu quo même si celui-ci avait perdu son chemin. En conséquence, les sociétés actuelles seraient, même sans le désirer, des sociétés spéculatives. Des éclaircissements sur la notion même de spéculation apparaissent alors nécessaires. Cet article vise à offrir ces éclaircissements. Pour cela, cet article s’appuie sur le cadre réglementaire d’après-crise de Bâle III. Cette analyse philosophique est d’autant plus éclairante si le « désarmement de la politique » (Habermas 2018, ma traduction) au nom de politiques prétendument inévitables, à vocation sécuritaire et stable, peut constituer l’objet de critique. Cet article est, par conséquent, une esquisse philosophique. Ce qui suit est une série de réflexions sur le concept de spéculation au-delà des frontières de la compréhension financière ou économique actuelle et, enfin, de minuscules manifestes sur la façon dont les études philosophiques et autres pourraient mobiliser et affiner ce concept. Tout d’abord cet article offre une histoire conceptuelle de la notion de spéculation (section deux). Dans un deuxième temps, les effets instables de l’aporie de stabilité concernant des régularisations financières sont analysés (section trois). Enfin, les bases pour un renouveau du concept de spéculation, utile pour la philosophie et qui maîtrise les apories des sociétés spéculatives, sont développées (section quatre). Si la philosophie ne peut prévenir la pensée d’être parfois large et incertaine, la philosophie peut sans doute être appréhendée comme un « hybride onto-épistémique-éthique », en recourant à la notion de spéculation. C’est ce que cet article suggère : offrir un langage qui pourrait permettre de penser la « spécularisation » des mondes sociaux en ce début du xxi e siècle. C’est à dire, le passage de la politique des classes à la politique identitaire (représentant les cultures plutôt que les classes), du capitalisme industriel à la politique culturelle (vendre des valeurs au détriment des fonctions) et des acteurs rationalisés au conservateur (choisir entre des identités à la place des préférences). We investigated the source of the visual search advantage of some emotional facial expressions. An emotional face target (happy, surprised, disgusted, fearful, angry, or sad) was presented in an array of neutral faces. A faster detection was found for happy targets, with angry and, especially, sad targets being detected more poorly. Physical image properties (e.g., luminance) were ruled out as a potential source of these differences in visual search. In contrast, the search advantage is partly due to the facilitated processing (...) of affective content, as shown by an emotion identification task. Happy expressions were identified faster than the other expressions and were less likely to be confounded with neutral faces, whereas misjudgements occurred more often for angry and sad expressions. Nevertheless, the distinctiveness of some local features (e.g., teeth) that are consistently associated with emotional expressions plays the strongest role in the search advantage pattern. When the contribution of these features to visual search was factored out statistically, the advantage disappeared. (shrink)

Commercial genetic testing offered over the internet, known as direct-to-consumer genetic testing (DTC GT), currently is under ethical attack. A common critique aims at the limited validation of the tests as well as the risk of psycho-social stress or adaption of incorrect behavior by users triggered by misleading health information. Here, we examine in detail the specific role of advertising communication of DTC GT companies from a medical ethical perspective. Our argumentative analysis departs from the starting point that DTC GT (...) operates at the intersection of two different contexts: medicine on the one hand and the market on the other. Both fields differ strongly with regard to their standards of communication practices and the underlying normative assumptions regarding autonomy and responsibility. Following a short review of the ethical contexts of medical and commercial communication, we provide case examples for persuasive messages of DTC GT websites and briefly analyze their design with a multi-modal approach to illustrate some of their problematic implications. We observe three main aspects in DTC GT advertising communication: (1) the use of material suggesting medical professional legitimacy as a trust-establishing tool, (2) the suggestion of empowerment as a benefit of using DTC GT services and (3) the narrative of responsibility as a persuasive appeal to a moral self-conception. While strengthening and respecting the autonomy of a patient is the focus in medical communication, specifically genetic counselling, persuasive communication is the normal mode in marketing of consumer goods, presuming an autonomous, rational, independent consumer. This creates tension in the context of DTC GT regarding the expectation and normative assessment of communication strategies. Our analysis can even the ground for a better understanding of ethical problems associated with intersections of medical and commercial communication and point to perspectives of analysis of DTC GT advertising. We describe the Catholic natural law tradition by examining its origins in the medieval penitentials, the papal decretals, the writings of Thomas Aquinas, and seventeenth century casuistry. Catholic natural law emerges as a flexible ethic that conceives of human nature as rational and as oriented to certain basic goods that ought to be pursued and whose pursuit is made possible by the virtues. We then identify four approaches to natural law that have evolved within the United States during the twentieth (...) century, including the traditionalist, proportionalist, right reason, and historicist approaches. The normative implications of these approaches are discussed in relation to ethical issues in the tobacco industry, ITT under Geneen, the marketing of pharmaceuticals, affirmative action, and bribery. It is argued that Alasdair MacIntyre is correct in claiming that the natural law tradition is superior to the liberal ethics of modern deontology and utilitarianism. (shrink)

In this article, we put forward a new strategy for teaching the concept of energy. In the first section, we discuss how the concept is currently treated in educational programmes at primary and secondary level (taking the case of France), the learning difficulties that arise as well as the main teaching strategies presented in science education literature. In the second section, we argue that due to the complexity of the concept of energy, rethinking how it is taught should involve teacher (...) training specifically developed for the concept. In our view, Epistemology and the History of Science and Technology (EHST) is the best method for a full understanding of the concept of energy and should thus be included in the teacher training programme. In the third section, we provide a general framework for a teacher training programme on energy, based on the history and epistemology of the concept and structured on the following three questions: ‘What is the origin of the concept of energy?’, ‘What is energy?’ and ‘What purpose does the concept of energy serve?’. Proposals for the democratization of technology imply a necessary condition of universal emancipatory technological literacy. However, in the literature on the topic, people’s willingness to assume the cost in time and effort involved in acquiring that knowledge is often taken for granted. In this paper, we apply Anthony Downs’s economic theory of political action in democracy to analyze the cost-benefit ratio of this literacy from the perspective of the individual subject who should acquire it. Our conclusion is that the cost (...) does not rationally justify in an instrumental sense a benefit that, being mainly of an indivisible nature, motivates individuals to avoid their share of the cost to produce it. Este libro cuenta la historia de pensamiento filosófico y científico español e hispanoamericano desarrollado a lo largo del recién pasado siglo XX. Su propósito es ser un companion, una guía o compañero, que introduzca y oriente en esta materia de una manera eficaz, atractiva e interesante. La primera de sus cuatro partes se ocupa de la llamada Edad de Plata de la cultura española, que comienza en los últimos años del siglo XIX y termina con el estallido de la Guerra (...) Civil. La segunda abarca el cuarto de siglo comprendido entre el principio de la Guerra Civil y la década de los sesenta, el periodo que corresponde a la dictadura franquista y en el que resulta obligado contemplar separadamente el pensamiento de la España residente en el territorio nacional y en el exilio. La tercera parte se ocupa del estudio de los últimos cuarenta años del siglo XX, cuyas dos primeras décadas, fueron revolucionarias y rupturitas. La cuarta y última parte contiene una historia sintética del pensamiento hispanoamericano del siglo XX, escrita por filósofos hispanoamericanos interesados en comprender la historia intelectual de sus respectivos países. Hemos querido de esta forma renovar la memoria y profundizar en el recuerdo de que buena parte de los herederos culturales de la Edad de Plata española fueron exiliados en esos países para devenir ciudadanos suyos. Las herramientas teóricas destinadas a señalar las injusticias que sufren ciertos grupos socialmente oprimidos pueden acabar siendo utilizadas con propósitos completamente opuestos a los iniciales. Modificar el alcance de una herramienta teórica no es necesariamente problemático: la popularización de un concepto abre las puertas a que se utilice estratégicamente para diferentes fines. La tesis que defendemos en este artículo es que algunos personajes públicos cultivan una imagen particular de sí mismos que parece satisfacer los requisitos de la noción de injusticia (...) testimonial y utilizan esta situación como medio para obtener beneficio político de ella. Más concretamente, estos personajes públicos se benefician de esta condición para generar situaciones de desacuerdos cruzados, que están estrechamente relacionados con el aumento de la polarización. In _A Treatise of Human Nature_, Hume proposes a new philosophical method. This method results from integrating an empirically founded skepticism with an innovative study of the epistemic role of emotions. This combination of skepticism, empiricism, and moral psychology aims to establish a virtuous way of doing philosophy based on the regulation of our epistemic emotions. In this paper, I present the operating principles of this virtuous way of doing philosophy. The paper has three parts. I firstly claim that four (...) principles compose Hume’s philosophical methodology. I contend that the moderation of curiosity plays the central role among them. Secondly, I claim that that is the case because of the pernicious effects resulting when this passion becomes excessive and misplaced. Finally, I show the role of curiosity’s moderation in the Conclusion of Book 1 of the _Treatise_, to substantiate the claim that the crisis Hume there depicts illustrates his virtuous way of doing philosophy. Identifying the determinants of human behavior is useful to adjust interventions and lead the civil society toward a stronger commitment to climate change mitigation and adaptation objectives, achieving greater support for successfully implementing environmental policies. Existing research has largely focused on case studies of pro-environmental behaviors in developed economies but there is very little evidence for developing countries. This study provides estimations of the effect of internal factors, such as sociodemographic variables, and four psychological dimensions on PEBs. Data were obtained (...) through a survey applied with future decision makers – university students – from Colombia and Nicaragua. Indices were generated for PEBs and the psychological dimensions using z-scores and Principal Component Analysis. Partial correlations were evaluated through the Ordinary Least Squares method. Our results suggest that, in order to reach the planned emission reduction targets, policy approaches should more strongly focus on educating and motivating citizens and prepare them for contributing to the environmental cause, as well as provide individual solutions to combat CC, rather than providing only information on its causes and consequences. Radical enactivism supports radical embodied cognition (REC), which is the idea that basic or fundamental cognition (perception and action) does not need to be understood in representational, contentful terms. REC departs from the idea that the mind can be naturalized through biological functions, but rejects the idea that mental content, which is understood as having a representational nature, can be naturalized. For REC, the natural origins of content (or NOC) is a program based on the following hypothesis: first, we depart (...) from basic cognitive processes that are target-based and guided by an Ur-intentionality or directedness toward the world, and then sociality enters in the picture when language appears into the scene, allowing for establishing full-blown semantic content in which that content is about worldly states of affairs. Here, we are going to focus on the phenomenon of directedness since there are blind spots in this picture: as many authors claim, REC takes Ur-intentionality as the starting point, but there is simply no explanation to date of how this directedness or Ur-intentionality is established. Therefore, how could we account for Ur-intentionality? How does this kind of intentionality emerge? We believe that we can answer this question if we invoke the best scientific evidence from ecological perceptual learning especially in regard to the role of the environment and the information for perceiving affordances in our learning processes. This allows us to offer an answer to the question of how the most basic form of cognition (Ur-intentionality or directedness) emerges in nature. (shrink)

Hier wird hingegen versucht, diese Position als Tatsachen-Ontologie kohärent zu entwickeln. Vorzüge diese Position wären u.a. eine elegante Deutung der Vielheit verschiedener wahrer Aussagen, eine gute Basis fur eine Korrespondenztheorie der Wahrheit, Referenz auf strukturierte Raum-Zeit-Bereiche, sie wäre Baustein einer (...) realistischen Situationslogik und könnte eine Lösung für David Lewis' Problem der Einermengen liefern. The aim of this paper is to focus on the phenomenon of selective attention as pointing out important psychological cases where it is arguable that we can have practical reasons without the capacity to carry out any relevant inference. Selective attention also would serve to show the possibility to have very basic demonstrative references to particular perceptual items without the possession of any concept. I will argue that if we assume 1) that believing can be taken as a kind of (...) action and 2) that demonstrative references to particular empirical items in that so basic sense have an important epistemological role in all of our knowledge, then our conclusions would have a very large application. There would be reasons without inferences not only for acting but also for believing, anddemonstrative reference without concepts would be an uneliminable component of our knowledge. (shrink)

In this paper, we analyze a way of valuing positively something which rarely has been taking into account in the literature: to value positively something because it could be valued positively by someone else. The main features of that way of valuing something are really very suggesting. Here, we would not have instrumental valuations, nor valuations directly sensitive to intrinsic values either. However, there would be cases in which valuations made in that way would make us able to detect things (...) that can be valued in an inconditional way. When we imagine or conceive what could be value positively, our motivational structures face us with something that is valued without evaluative conditions and, therefore, with something that is a good candidate to have an intrinsic value. El artículo trata sobre la negación estoica y su crítica a la fórmula aristotélica según los testimonios de Apuleyo, Alejandro de Afrodisias y Boecio. La crítica se divide en tres aspectos: (i) sistematicidad (ya que una misma regla no se aplica a todo tipo de proposición); (ii) universalidad (ya que todo par contradictorio no divide la verdad y la falsedad sin excepción alguna); y (iii) rigurosidad (ya que el sujeto de la proposición puede no existir o no ser lo que (...) creemos que es). Se concluye que el fondo de la crítica no se relaciona con que una fórmula es inconsistente o hace imposible la lógica y sus operaciones, sino que tiene relación con cuál fórmula es más ambigua y menos preferible. AI (ethics) initiatives are essential in bringing about fairer, safer, and more trustworthy AI systems. Yet, they also come with various drawbacks, including a lack of effective governance mechanisms, window-dressing, and ‘ethics shopping.’ To address those concerns, hard laws are necessary, and more and more countries are moving in this direction. Two of the most notable recent legislations include the Biden Administration’s Executive Order (EO) on AI and the E.U.’s AI Act (AIA). While several scholarly articles have evaluated the strengths (...) and weaknesses of the AIA and proposed reform measures that could help strengthen the Act, only a couple of papers do the same for the EO or compare the two regulatory initiatives. The following sections try to close this research gap by providing an in-depth comparative analysis of the EO and AIA. They offer, in particular, a critical computer-ethical evaluation of the EO’s and AIA’s pros and cons and similarities and differences and discuss possible ways to improve both legislations. Este artículo analiza el papel de la escritura en la consultoría filosófica desde una perspectiva nietzscheana, proponiendo que esta facilita la expresión y reconfiguración de las interpretaciones del consultante sobre su vida. Se parte de la premisa de la «voluntad de poder» como principio explicativo de la realidad, que impulsa a los individuos a buscar comprensión y transformación. Así, la actividad filosófica se concibe como una constante interpretación, donde la escritura emerge como herramienta crucial de manifestación de estas interpretaciones preexistentes, (...) para luego ser reinterpretadas. Por su parte, la consultoría filosófica se constituye como un espacio propicio para este acto interpretativo, utilizando la escritura como medio. Este proceso permite a los consultantes examinar y reconfigurar sus percepciones e interpretaciones, conduciendo a nuevas comprensiones de sí mismos. En síntesis, el artículo argumenta que la escritura en la consultoría filosófica no solo es un medio de expresión, sino una actividad filosófica que permite el autoconocimiento a través de la reinterpretación constante de la propia vida. This book explores the phenomenon of creativity and creation from a psychoanalytic point of view, focusing on understanding the psycho-emotional dynamics underlying the artistic creative activities, such as theatre, literature, and painting. Throughout, Delgado considers these works of art through a Bionian, Kleinian and Freudian lens. He uses three major psychoanalytic models of the creative process, two of them classic: the first, Freudian, based on the theory of conflict between impulse and defense, the result of the effort to manage an (...) excessive drive activity, and in which the concept of sublimation is central; the second, Kleinian, based on the attachment theory, in which creative effort corresponds to an attempt to repair the damage done to the object or to the self; and the third, more recent, affiliated with the more expanded attachment relationship theory, based on W. Bion's theory of thinking, and emphasising the continent's capacity for psyche and the oscillation between schizo-paranoid and depressive positions. Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

I present an epistemological puzzle about perceptual knowledge and its relation to the evaluation of probabilities. It involves cases, concerning a given subject S and a proposition P in a determinate context, where apparently: S has perceptual knowledge of P; the epistemic justification S has for believing Not-P is much greater than her epistemic justification for believing P. If those two theses were true, the following very plausible epistemological principle would fail: If S knows P, then the epistemic justification S (...) has for believing Not-P is not greater than her epistemic justification for believing P. I offer a solution to the puzzle, which is compatible with basic intuitions and theses of orthodox Bayesianism. (shrink)
