This paper is about epistemic dilemmas, i.e., cases in which one is doomed to have a doxastic attitude that is rationally impermissible no matter what. My aim is to develop and defend a position according to which there can be genuine rational indeterminacy; that is, it can be indeterminate which principles of rationality one should satisfy and thus indeterminate which doxastic attitudes one is permitted or required to have. I am going to argue that this view can resolve epistemic dilemmas (...) in a systematic way while also enjoying some important advantages over its rivals. (shrink)

Solidarity is a fundamental social value in many European countries, though its precise practical and theoretical meaning is disputed. In a health care context, I agree with European writers who take solidarity normatively to mean roughly equal access to effective health care for all. That is, solidarity includes a sense of justice. Given that, I will argue that precision medicine represents a potential weakening of solidarity, albeit not a unique weakening. Precision medicine includes 150 targeted cancer therapies (mostly for metastatic (...) cancer), all of which are extraordinarily expensive. Our critical question: Must a commitment to solidarity as defined mean that all these targeted cancer therapies should be guaranteed to all within each country in the European Union, no matter the cost, no matter the degree of effectiveness? Such a commitment would imply that cancer was ethically special, rightfully commandeering unlimited resources. That in itself would undermine solidarity. I offer multiple examples of how current and future dissemination of these targeted cancer drugs threaten a commitment to solidarity. An alternative is to fund more cancer prevention efforts. However, that too proves a threat to solidarity. Solidarity, with or without a sense of justice, is too abstract a notion to address these challenges. Further, we need to accept that we can only hope to achieve “rough justice” and “supple solidarity.” The precise practical meaning of these notions needs to be worked out through a fair and inclusive process of rational democratic deliberation, which is the real and practical foundation of just solidarity. Say that mereological harmony is the view that there is at least some mirroring between the mereological structure of material objects and the mereological structure of their locations: each, in some way, mirrors the other. As it turns out, there is a confusing array of systems of harmony available to the substantivalist. In this paper, I attempt to bring some order to these systems. I explore some systems found in the literature, as well as some natural systems which haven’t been (...) discussed. I argue that racism is a form of necro-being entrapped in necro-tragedy. Necro-being, as I present it, is a condition that kills and prevents persons from being born. I defend a conception of tragedy: absolute necrotragedy; absolute irredeemable suffering in a non-moral universe. Explanations of racism are commonly subject to anomalies, for example, volitional accounts offer special desiderata to account for institutional racism; conversely for institutional accounts. I offer a way to see racism, given the existence of a vast array (...) of kinds of racism: a descriptive actuarial approach. The account is intended to avoid the quandaries and anomalies of ‘explanation.’ I use rational-intentional explanations (including accounts by Jorge Garcia and Charles Mills) and social kind racial realism as inadequate explanations and examples of explanations with anomalies. These accounts also help demonstrate that logical systems of racism are inadequate. All such accounts explain racism as a coherent system and offer correlative reasons for its wrongness. I consider death, mortality, morbidity, and irredeemable misery as primary indicators of racism across an array of types of racism globally: racial necro-being. (shrink)

The first reader to offer a comprehensive view of Maurice Merleau-Ponty’s work, this selection collects in one volume the foundational essays necessary for understanding the core of this critical twentieth-century philosopher’s thought. Arranged chronologically, the essays are grouped in three sections corresponding to the major periods of Merleau-Ponty’s work: First, the years prior to his appointment to the Sorbonne in 1949, the early, existentialist period during which he wrote important works on the phenomenology of perception and the primacy of perception; (...) second, the years of his work as professor of child psychology and pedagogy at the Sorbonne, a period especially concerned with language; and finally, his years as chair of modern philosophy at the Collège de France, a time devoted to the articulation of a new ontology and philosophy of nature. The editors, who provide an interpretive introduction, also include previously unpublished working notes found in Merleau-Ponty’s papers after his death. Translations of all selections have been updated and several appear here in English for the first time. By contextualizing Merleau-Ponty’s writings on the philosophy of art and politics within the overall development of his thought, this volume allows readers to see both the breadth of his contribution to twentieth-century philosophy and the convergence of the various strands of his reflection. Issues of academic integrity, specifically knowledge of, perceptions and attitudes toward plagiarism, are well documented in post-secondary settings using case studies for specific courses, recording discourse with focus groups, analyzing cross-cultural education philosophies, and reviewing the current literature. In this paper, the authors examine the perceptions of graduate students in science, technology, engineering, and mathematics disciplines at the University of Florida regarding misconduct and integrity issues. Results revealed students’ perceptions of the definition and seriousness of potential academic misconduct, knowledge of (...) institutional procedures, and views on faculty actions, all with a focus on divergences between US and internationally-educated students. The open-ended questions provide anecdotal evidence to highlight personal experiences, positive and negative, aimed at the faculty, international students and undergraduates. Combined, these findings outline an important part of the campus academic integrity culture at a major American university. Recommendations for local actions also are discussed. (shrink)

This study examines the theory of planned behavior and the multidimensional ethics scale. Variables from both are included to determine which ones significantly correlate with student ethical behavioral intention in an academic setting. Using a survey, responses are collected from undergraduate business students from two southwestern universities in the United States using a scenario-based approach, looking at individual situations and group situations. SmartPLS was used to assess the results for four scenarios. From the theory of planned behavior, attitude was a (...) significant predictor of behavioral intention across all four scenarios while subjective norm was significant in one scenario. From the multidimensional ethics scale, moral equity and relativism were significant in one group scenario while moral equity and utilitarianism were each significant in an individual scenario. The findings indicate support for the use of the TPB and the MES when exploring ethics in an academic setting and for the need to study both individual and group situations. How should we determine who would have a just claim to access particular treatments, especially very expensive ones? This book educates whilst also challenging the contemporary schools of thought within philosophical and religious ethics. In addition, it underlines the fact that the substance of ethics in general and bioethics/healthcare ethics specifically, is much more expansive and inclusive than is usually thought. Bioethics is a relatively new academic discipline. However, ethics has existed informally since before the time of Hippocrates. The indigenous culture of African peoples has an ethical worldview which predates the western discourse. This indigenous ethical worldview has (...) been orally transmitted over centuries. The earliest known written African text containing some concepts and content of ethics is the “Declaration of Innocence” written in 1500 B.C., found in an Egyptian text. Ubuntu is an example of African culture that presents an ethical worldview. This work interprets the culture of Ubuntu to explain the contribution of a representative indigenous African ethics to global bioethics. Many modern scholars have written about the meaning of Ubuntu for African societies over centuries. Some scholars have viewed Ubuntu as the greatest contribution of African cultures to other world cultures. None of the scholars, however has explored the culture of Ubuntu as providing a representative indigenous ethics that can contribute to global bioethics as discussed in this book.​. (shrink)

It is also shown that an ontology like that of the "tractus" removes much of the conceptual puzzlement of modern particle physics and has implications for current debates about realism, Possible worlds and rigid designators.

This essay argues that our national efforts at health reform ought to be informed by eleven key lessons from Oregon. Specifically, we must learn that the need for health care rationing is inescapable, that any rationing process must be public and visible, and that fair rationing protocols must be self-imposed through a process of rational democratic deliberation. Part I of this essay notes that rationing is a ubiquitous feature of our health care system at present, but it is mostly hidden (...) rationing, which is presumptively unjust. Part II argues that the need for health care rationing is inescapable. Although Oregon is flawed as a model of health rationing, it gives us worthy moral lessons for health reform at the national level, which I analyze and defend in Part III. The most significant of these lessons is the importance of rational democratic deliberation in articulating fair rationing protocols for a community. In Part IV I sketch the philosophic justification for this approach and respond to some important criticisms from Daniels. Do terminally ill patients who have exhausted all other available, government-approved treatment options have a constitutional right to experimental treatment that may prolong their lives? On May 2, 2006, a divided panel of the U.S. Court of Appeals for the District of Columbia, in a startling opinion, Abigail Alliance for Better Access to Developmental Drugs v. Von Eschenbach, held “Yes.” The plaintiffs, Abigail Alliance for Better Access to Developmental Drugs and Washington Legal Foundation, sought to enjoin the Food and Drug (...) Administration from refusing to allow the sale of investigational new drugs that had not yet received FDA approval. The terminally ill plaintiffs contended that they quite literally could not wait that long for the drugs. With no other treatment options available, the plaintiffs urged the court to recognize a fundamental, constitutional right to take potentially life-saving or life-prolonging drugs, even though the treatment had not been fully tested through human trials for safety and effectiveness and could not be legally marketed to the public. Sortal terms, such as table or horse, are count nouns (akin to a basic-level terms). According to some theories, the meaning of sortals provides conditions for telling objects apart (individuating objects, e.g., telling one table from a second) and for identifying objects over time (e.g., determining that a particular horse at one time is the same horse at another). A number of psychologists have proposed that sortal concepts likewise provide psychologically real conditions for individuating and identifying things. However, this paper (...) reports five experiments that cast doubt on these psychological claims. Experiments 1-3 suggest that sortal concepts do not determine when an object ceases to exist and therefore do not decide when the object can no longer be identical to a later one. Experiments 4-5 similarly suggest that sortal concepts do not provide determinate conditions for individuating objects. Health reform must include health care rationing, both for reasons of fairness and efficiency. Few politicians are willing to accept this claim, including the Clinton Administration. Brown and others have argued that enormous waste and inefficiency must be wrung out of our health care system before morally problematic cost constraining options, such as rationing, can be justifiably adopted. However, I argue that most of the policies and practices that would diminish waste and inefficiency include implicit (and therefore morally problematic) rationing. (...) Critics of rationing see as its most morally and psychologically troubling feature that an identified individual is denied potentially beneficial care. That psychic anguish may not be eliminable, and perhaps ought not be eliminated. But if rationing protocols are fairly adopted through a process of free and informed rational democratic deliberation to which all have access, the moral objections are largely overcome. Such a process is possible only if implicit rationing is recognized and rejected. Whether or not there is a natural inclination to want freedom, and whether or not slaves (modern or ancient) are living in violation of such a natural inclination has been debated by scholars for centuries. David Walker’s APPEAL provides a starting point for an argument that settles the issue: given my interpretation of Walker’s naturalism and his approach to existential agency, slaves have a duty to insurrect even if there is no empirical evidence that a natural inclination exists. And they (...) have this duty even if they are likely to fail. Neither instrumentalist nor consequentialist reasoning provide a slave compelling reasons to rebel; all consequences of rebellion are almost certain to be deleterious and it is not unreasonable for persons to be subservient under conditions of slavery. I depict, and use Walker’s depiction of, slavery to defend his approach to naturalism and liberation; an approach arguably beneficial to how we should see contemporary slavery. (shrink)

Dabei fungieren antike und mittelalterliche Diskurse um Gotteserkenntnis als historisch-konzeptionelle Vorläufer neuzeitlichmoderner Erklärungsfolien zwischenmenschlicher Alterität, mithin als semantische Vorform der zeitgenössischen Einfühlungs-Idee. In diesem Kontext ist eine ethisch-epistemologische Asymmetrie zu konstatieren, die Gott einerseits als den All-Empathischen beschreibt und zugleich die Erkenntnisbemühungen des Menschen als unabgeschlossen und prozessual vorstellt. Einfühlung produziert sich als regulative Idee im doppelten Sinne: Während Gott als empathische Transzendenz erscheint, bedarf (...) es unendlicher Annäherungsbewegungen, damit der Mensch sich in einem Akt transzendenter Empathie in Gott einfühlen kann. Basic concepts in Ricouer such as discourse, metaphor and symbol, and tradition are examined, and texts by Derrida including “White Mythology,” Introduction to Husserl’s The Origin of Geometry, and “The Double Session” are analyzed. The book also includes a previously untranslated round table discussion between Ricoeur and Derrida.

This article probes the relationship among constitutionalism, extra-legal prerogative power, and citizen judgment. While much has been written about the nature of Lockean prerogative, and while his theory serves as a direct inspiration for contemporary "normative extra-legalists," key participants in the debate over emergency powers, less attention has been paid to how the people judge prerogative. Attention to this issue is useful because an examination of the process of political judgment of extra-legalism in Locke leads to a complication of the (...) current extra-legalist vision of democratic mechanisms of accountability. The author argues that the extra-legal approach is right to consider the role of democratic publics in potentially constraining the exercise of emergency powers but wrong to formulate that role as one extra-constitutional power checking another extra-constitutional power. The author situates both prerogative power and citizen judgment of it at the threshold of the constitutional order. (shrink)

Contrary to what seems to be predicted by a Strawson-inspired view, in presupposition denials the presupposition triggered by, e.g., ‘the king of France’ seems to be cancelled. To explain this puzzling instance of the projection problem, defenders of a Strawson-inspired view have proposed various ad hoc ambiguities. I develop a version of Segmented Discourse Representation Theory that explains the puzzling presupposition-cancelling phenomenon relying only on independently motivated pragmatic processes. Appealing to Kripke’s “test” for the adequacy of ambiguity motivating counterexamples, I (...) argue that my analysis is to be preferred over proposals that posit ad hoc ambiguities. Two key insights of my analysis are, first, that the “cancellation” of presuppositions in presupposition denials depends upon the illocutionary effects of rejection and correction, and, second, that the process of presupposition accommodation often involves the speaker performing an ancillary sort of speech act, viz. the speech act of presupposing. When one speaks duplicitously one performs a (risky) speech act and at the same time intends that one have deniability regarding that speech act. What is it for a speaker who performs an illocutionary act to have deniability regarding that act? I first review an answer to this question proposed by Alexander Dinges and Julia Zakkou. According to them, deniability is “an epistemic notion. A speaker has deniability if she can make it epistemically irrational for her audience to reason in (...) certain ways” (2023, p. 373). I argue, however, that the epistemic account is refuted by a counterexample, and informed by the counterexample, I propose an alternative. According to my alternative account, deniability concerns illocutionary norms: a speaker has deniability regarding an illocutionary action iff (i) she is permitted to deny having performed the action, and (ii) if she denies having performed the action, she thereby avoids being responsible for it. I conclude by considering the implications of illocutionary norms account of deniability for the vexed issue of the determinants of illocutionary force; I argue that the illocutionary norms account of deniability provides evidence in support of McDonald’s (2021) “collaboration” view.
