What makes someone responsible for a crime and therefore liable to punishment under the criminal law? Modern lawyers will quickly and easily point to the criminal law's requirement of concurrent actus reus and mens rea, doctrines of the criminal law which ensure that someone will only be found criminally responsible if they have committed criminal conduct while possessing capacities of understanding, awareness, and self-control at the time of offense. Any notion of criminal responsibility based on the character of the offender, (...) meaning an implication of criminality based on reputation or the assumed disposition of the person, would seem to today's criminal lawyer a relic of the 18th Century. In this volume, Nicola Lacey demonstrates that the practice of character-based patterns of attribution was not laid to rest in 18th Century criminal law, but is alive and well in contemporary English criminal responsibility-attribution. Building upon the analysis of criminal responsibility in her previous book, Women, Crime, and Character, Lacey investigates the changing nature of criminal responsibility in English law from the mid-18th Century to the early 21st Century. Through a combined philosophical, historical, and socio-legal approach, this volume evidences how the theory behind criminal responsibility has shifted over time. The character and outcome responsibility which dominated criminal law in the 18th Century diminished in ideological importance in the following two centuries, when the idea of responsibility as founded in capacity was gradually established as the core of criminal law. Lacey traces the historical trajectory of responsibility into the 21st Century, arguing that ideas of character responsibility and the discourse of responsibility as founded in risk are enjoying a renaissance in the modern criminal law. These ideas of criminal responsibility are explored through an examination of the institutions through which they are produced, interpreted and executed; the interests which have shaped both doctrines and institutions; and the substantive social functions which criminal law and punishment have been expected to perform at different points in history. ABSTRACTSocial attentional biases are a core component of social anxiety disorder, but research has not yet determined their direction due to methodological limitations. Here we present preliminary findings from a novel, dynamic eye-tracking paradigm allowing spatial–temporal measurement of attention and gaze-following, a mechanism previously unexplored in social anxiety. 105 participants took part, with those high and low in social anxiety traits entered into the analyses. Participants watched a video of an emotionally-neutral social scene, where two actors periodically shifted their gaze (...) towards the periphery. HSA participants looked more at the actors’ faces during the initial 2s than the LSA group but there were no group differences in proportion of first fixations to the face or latency to first fixate the face, although HSA individuals’ first fixations to the face were shorter. We define and investigate Heyting-valued interpretations for Constructive Zermelo–Frankel set theory . These interpretations provide models for CZF that are analogous to Boolean-valued models for ZF and to Heyting-valued models for IZF. Heyting-valued interpretations are defined here using set-generated frames and formal topologies. As applications of Heyting-valued interpretations, we present a relative consistency result and an independence proof.

The COVID-19 pandemic outbreak has led to a general reorganization of health services and an increase in outpatient telemedicine in mental healthcare for physically ill people. Current literature highlights facilitators and obstacles concerning the use of new technologies in psychotherapy, an underrated topic of research in the context of supportive expressive psychotherapy. More insight is needed to explore the characteristics of video in therapeutic alliance for treatment of specific mental disorders experienced in psychosomatics, particularly with people suffering from a disturbed (...) body- and self-image. Using two clinical vignettes, it is the authors’ intention to enrich the critical debate on current knowledge in psychosomatic remote psychotherapy, with special focus on mentalization deficits and their impact on therapeutic alliance in the consultation-liaison psychiatry setting. In particular, we will question the interpersonal processes at stake related to mirroring and the disruption caused by the use of videoconference applications. We will also reflect upon the relationship between the therapeutic alliance and the medical team, and that between patient and psychotherapist. The aim is to improve psychotherapeutic alliance maintained during the pandemic for specific mental disorders and to inform about possible clinical factors that could be the subject of future empirical studies or professional guidelines. Nicola Lacey presents a new approach to the question of the moral justification of punishment by the State. She focuses on the theory of punishments in context of other political questions, such as the nature of political obligation and the function and scope of criminal law. Arguing that no convincing set of justifying reasons has so far been produced, she puts forward a theory of punishments which places the values of the community at its centre.

The aim of this work is to analyze the constitution of a new collective subject thanks to wearable computers. Wearable computers are emerging technologies which are supposed to become pervasively used in the near future. They are devices designed to be on us every single moment of our life and to capture every experience we have. Therefore, we need to be prepared to such intrusive devices and to analyze potential effect they will have on us and our society. Thanks to (...) a phenomenological and postphenomenological analysis, we will show how these technologies are able to generate a new collective subject with its different collective needs and appetites by merging the living body of many subjects into one. Questions concerning the epistemological status of computer science are, in this paper, answered from the point of view of the formal verification framework. State space reduction techniques adopted to simplify computational models in model checking are analysed in terms of Aristotelian abstractions and Galilean idealizations characterizing the inquiry of empirical systems. Methodological considerations drawn here are employed to argue in favour of the scientific understanding of computer science as a discipline. Specifically, reduced models gained by Dataion are acknowledged as Aristotelian (...) abstractions that include only data which are sufficient to examine the interested executions. The present study highlights how the need to maximize incompatible properties is at the basis of both Abstraction Refinement, the process of generating a cascade of computational models to achieve a balance between simplicity and informativeness, and the Multiple Model Idealization approach in biology. Finally, fairness constraints, imposed to computational models to allow fair behaviours only, are defined as ceteris paribus conditions under which temporal formulas, formalizing software requirements, acquire the status of law-like statements about the software systems executions. This paper aims to show a possible path to address the introduction of intimate digital technologies through a phenomenological and postphenomenological perspective in relation to Japanese and Chinese contexts. Digital technologies are becoming intimate, and, in Japan and China, there are already many advanced digital technologies that provide digital companions for love relationships. Phenomenology has extensive research on how love relationships and intimacy shape the subjects. At the same time, postphenomenology provides a sound framework on how technologies shape the values (...) and meanings we have. Thus, this paper introduces two digital technologies in Japan and China (_Love Plus_ and _XiaoIce_ chatbot), and it analyses according to the elements proposed by phenomenology and postphenomenology. In conclusion, this paper shows how digital companions like _Love Plus_ and _XiaoIce_ chatbot change who we are and the values and meanings we have according to the phenomenological and postphenomenological framework. In this paper the importance of public affairs management in multinational corporations in India will be examined. After briefly discussing the state of the art in international business and society literature, a conceptual framework for public affairs management in multinational corporations will be developed. This framework serves as the theoretical basis for an empirical study among German multinational corporations in India. A common view is that self-identity is essential to objects if anything is. Itself a substantive metaphysical view, this is a position of some import in wider debates, particularly in connection with such problems as physicalism and personal identity. In this article I challenge the view. I distinguish between two accounts of essence, the modal and the definitional, and argue that self-identity is essential to objects on the former but not on the latter. This paper takes part in the methodological debate concerning the nature and the justification of hypotheses about computational systems in software engineering by providing an epistemological analysis of Software Testing, the practice of observing the programs’ executions to examine whether they fulfil software requirements. Property specifications articulating such requirements are shown to involve falsifiable hypotheses about software systems that are evaluated by means of tests which are likely to falsify those hypotheses. Software Reliability metrics, used to measure the growth of (...) probability that given failures will occur at specified times as new executions are observed, is shown to involve a Bayesian confirmation of falsifiable hypotheses on programs. Coverage criteria, used to select those input values with which the system under test is to be launched, are understood as theory-laden principles guiding software tests, here compared to scientific experiments. Redundant computations, fault seeding models and formal methods used in software engineering to evaluate test results are taken to be instantiations of some epistemological strategies used in scientific experiments to distinguish between valid and non-valid experimental outcomes. The final part of the paper explores the problem, advanced in the context of the philosophy of technology, of defining the epistemological status of software engineering by conceiving it as a scientifically attested technology. In this article, we discuss how we used institutional ethnography (Institutional ethnography as practice, Rowman & Littlefield, Lanham, MD and 2006) to map out powerful ruling relations that organize nurses’ wound care work. In recent years, the growing number of people living with wounds that heal slowly or not at all has presented substantial challenges for those managing the demands on Canada's publicly insured health‐care system. In efforts to address this burden, Canadian health‐care administrators and policy‐makers rely on scientific evidence (...) about how wounds heal and what treatments are most effective. Advanced wound care exemplifies the growing authorization of particular forms of evidence that change the ways in which nurses come to know about and conduct their work. The focus of this paper's nursing inquiry is a critique of registered nurses’ wound work as it arises within the established uptake of scientific evidence. (shrink)

Model checking, a prominent formal method used to predict and explain the behaviour of software and hardware systems, is examined on the basis of reflective work in the philosophy of science concerning the ontology of scientific theories and model-based reasoning. The empirical theories of computational systems that model checking techniques enable one to build are identified, in the light of the semantic conception of scientific theories, with families of models that are interconnected by simulation relations. And the mappings between these (...) scientific theories and computational systems in their scope are analyzed in terms of suitable specializations of the notions of model of experiment and model of data. Furthermore, the extensively mechanized character of model-based reasoning in model checking is highlighted by a comparison with proof procedures adopted by other formal methods in computer science. Finally, potential epistemic benefits flowing from the application of model checking in other areas of scientific inquiry are emphasized in the context of computer simulation studies of biological information processing. The problem of artificial intelligence and human being has always raised questions about possible interactions among them and possible effects yielded by the introduction of such un-human subject. Dreyfus deeply connects intelligence and body based on a phenomenological viewpoint. Thanks to his reading of Merleau-Ponty, he clearly stated that an intelligence must be embodied into a body to function. According to his suggestion, any AI designed to be human-like is doom to failure if there is no tight bound with a (...) human-like body. Today, we are facing the pervasive introduction of robots into our everyday life, and the problem of this co-existence raises again with new vigor since they are not mere speculations, but there are already products sold to the public. We will highlight how vulnerability has to be taken into consideration in the design of robots to create entities which are able to relate to human beings taking into consideration mainly the positions of Sartre, Habermas, Levinas, and Marleau-Ponty. A first part will focus on the vulnerability of the robots. Robots are going to be among us, but a real interaction is possible only the moment they have a “same” body of ours. Therefore, only through the realization of a “fragile” body we can achieve a cohabitation between equals. Thanks to Merleau-Ponty we will show how the vulnerability of a body is one of the most important element to found any social interaction. The second part will focus on how the robots will affect the vulnerability of the human subjects. To produce vulnerable robots is not a mere neutral introduction, but it shapes how the subjects are constituted. Thanks to Levinas, we will study how the vulnerable robots will shape the subjects. Thanks to Sartre, we will show how the creation of a different gaze in the robot changes the vulnerabilities of the human subjects. Introducing vulnerable robots is a way to shape ourselves. Husserl’s official account of essence is modal. It is also, I submit, incompatible with the role that essence is supposed to play, especially relative to necessity, in his overall philosophy. In the Husserlian framework, essence should rather be treated as a non-modal notion. The point, while not generally acknowledged, has been made before (by Kevin Mulligan for one); yet the arguments given for it, though perhaps sound, are not Husserlian. In this paper I present a thoroughly Husserlian argument for that (...) claim, as well as a Husserlian essentialist account of necessity. I also discuss the role of grounding within the account. In the present article, I introduce Husserl’s analyses of ‘natural causality’ and ‘volitional causality’, which are collected in the volume ‘Wille und Handlung’ of the Husserliana edition Studien zur Struktur des Bewußtseins. My aim is to show that Husserl’s insight into these phenomena enables us to understand more clearly both the specificity of, and the relation between, the motivational nexus belonging to the sphere of the will in contrast with the causal laws of nature. In light of this understanding, in (...) the last part of the article I reflect on whether and to what extent there is, in fact, an ontological and epistemological compatibility between volitional causality and natural causality. This paper addresses the methodological problem of analysing what it is to explain observed behaviours of engineered computing systems, focusing on the crucial role that abstraction and idealization play in explanations of both correct and incorrect BECS. First, it is argued that an understanding of explanatory requests about observed miscomputations crucially involves reference to the rich background afforded by hierarchies of functional specifications. Second, many explanations concerning incorrect BECS are found to abstract away from descriptions of physical components and processes (...) of computing systems that one finds below the logic circuit and gate layer of functional specification hierarchies. Third, model-based explanations of both correct and incorrect BECS that are provided in the framework of formal verification methods often involve idealizations. Moreover, a distinction between restrictive and permissive idealizations is introduced and their roles in BECS explanations are analysed. (shrink)

The Turing Test is best regarded as a model to test for intelligence, where an entity’s intelligence is inferred from its ability to be attributed with ‘human-likeness’ during a text-based conversation. The problem with this model, however, is that it does not care if or how well an entity produces a meaningful conversation, as long as its interactions are humanlike enough. As a consequence, the TT attracts projects that concentrate on how best to fool the judges. In light of this, (...) I propose a new version of the TT: the Questioning Turing Test. Here, the entity has to produce an enquiry rather than a conversation; and it is parametrised along two further dimensions in addition to ‘human-likeness’: ‘correctness’, evaluating if the entity accomplishes the enquiry; and ‘strategicness’, evaluating how well the entity accomplishes the enquiry, in terms of the number of questions asked. This paper contributes to the computer ethics debate on software ownership protection by examining the ontological, methodological, and ethical problems related to property right infringement that should come prior to any legal discussion. The ontological problem consists in determining precisely what it is for a computer program to be a copy of another one, a largely neglected problem in computer ethics. The methodological problem is defined as the difficulty of deciding whether a given software system is a copy of another (...) system. And the ethical problem corresponds to establishing when a copy constitutes, or does not constitute, a property right infringement. The ontological problem is solved on the logical analysis of abstract machines, and the latter are argued to be the appropriate level of abstraction for software at which the methodological and the ethical problems can be successfully addressed. Over the last twenty years there has been an explosion of interest in ‘criminal justice’, generating a wealth of research incorporating law, philosophy, political theory, sociology and other disciplines. The fascination of criminal justice flows from the cultural prominence of criminalization as a form of social control. The news media in Australia, Britain or the United States provide plentiful evidence of the extent to which crime, fear of crime, government criminal justice policy and the activities of the more visible enforcement (...) agencies such as the police preoccupy many contemporary Western societies. At the international level, too, criminal justice is increasingly salient. Moreover, the status of criminal justice as a particularly coercive and costly governmental repertoire claims our attention. Yet the diversity of practices encompassed within the notion of ‘criminal justice’, and the variety of practical, philosophical and political questions which they raise, make criminal justice an elusive subject. All too often, the general ‘theories of criminal justice’ which purport to make sense of the concrete practices illuminated by empirical research turn out to be too abstract and/or too narrow in focus to fulfil that promise. The purpose of this chapter is to provide a framework which might enable us to make sense of criminal justice without imposing an unrealistically rigid or unduly circumscribed model on the complicated processes with which we are concerned. Within contemporary penal philosophy, the view that punishment can only be justified if the offender is a moral agent who is responsible and hence blameworthy for their offence is one of the few areas on which a consensus prevails. In recent literature, this precept is associated with the retributive tradition, in the modern form of ‘just deserts’. Turning its back on the rehabilitative ideal, this tradition forges a strong association between the justification of punishment, the attribution of responsible agency in (...) relation to the offence, and the appropriateness of blame. By contrast, effective clinical treatment of disorders of agency employs a conceptual framework in which ideas of responsibility and blameworthiness are clearly separated from what we call ‘affective blame’: the range of hostile, negative attitudes and emotions that are typical human responses to criminal or immoral conduct. We argue that taking this clinical model of ‘responsibility without blame’ into the legal realm offers new possibilities. Theoretically, it allows for the reconciliation of the idea of ‘just deserts’ with a rehabilitative ideal in penal philosophy. Punishment can be reconceived as consequences—typically negative but occasionally not, so long as they are serious and appropriate to the crime and the context—imposed in response to, by reason of, and in proportion to responsibility and blameworthiness, but without the hard treatment and stigma typical of affective blame. Practically, it suggests how sentencing and punishment can better avoid affective blame and instead further rehabilitative and related ends, while yet serving the demands of justice. (shrink)

In the present article I aim to make a new contribution to our phenomenological understanding of the foundation between intentional experiences. In order to accomplish this goal, I discuss Husserl’s effort to avoid the conflation of the class of non-objectifying acts, i.e., evaluations and volitions, with the class of objectifying acts, i.e., cognitions. Through the analysis of the transition from his early to his mature account, I explore how Husserl, by readdressing the idea of foundation in relation to the shift (...) from the practical-evaluative to the theoretical attitude, clarifies how evaluations and volitions can exert their intentionality only on the basis of a foundation on cognitions without thereby being reduced to a mere special case of founded representations. This research aims to examine access to medical treatment during the COVID-19 pandemic for people living with disabilities. During the COVID-19 pandemic, the practical and ethical problems of allocating limited medical resources such as intensive care unit beds and ventilators became critical. Although different countries have proposed different guidelines to manage this emergency, these proposed criteria do not sufficiently consider people living with disabilities. People living with disabilities are therefore at a higher risk of exclusion from medical treatments as physicians (...) tend to assume they have poor quality of life, whereas access to medical treatment should be based on several parameters, including clinical data and prognosis. However, the COVID-19 pandemic shifts the medical paradigm from person-centred medicine to community-centred medicine, challenging the main ethical theories. We reviewed the main guidelines and recommendations for resources allocation and examined their position toward persons with disabilities. Based on our findings, we propose criteria for not discriminating against people with disabilities in allocating resources. The shift from person-centred to community-centred medicine offers opportunities but also risks sacrificing the most vulnerable people. The principle of reasonable accommodation must always be considered to guarantee the rights of persons with disabilities. (shrink)

This paper is about a certain view of intentionality, a problem faced by the view, and two ways in which, it has been proposed, the problem might be solved. The view is that every intentional state has an intentional object. The problem is that the putative intentional objects of some intentional states do not, or even cannot, exist. The two strategies to solve the problem and secure the view are those implemented by Tim Crane in his article “Intentional Objects”. However, despite its significance, it has yet to be addressed properly in the growing discourse on humanistic capitalism and management, and indeed in business ethics as a whole. Ontology as a branch of philosophy is the science of what is, of the kinds and structures of objects, properties, events, processes and relations in every area of reality. ‘Ontology’ is often used by philosophers as a synonym for ‘metaphysics’ (literally: ‘what comes after the Physics’), a term which was used by early students of Aristotle to refer to what Aristotle himself called ‘first philosophy’. The term ‘ontology’ (or ontologia) was itself coined in 1613, independently, by two philosophers, Rudolf Göckel (...) (Goclenius), in his Lexicon philosophicum and Jacob Lorhard (Lorhardus), in his Theatrum philosophicum. The first occurrence in English recorded by the OED appears in Bailey’s dictionary of 1721, which defines ontology as ‘an Account of being in the Abstract’. (shrink)

The development of a biological notion of “population” over the first century of the theory of evolution has been commented upon by a number of historians and philosophers of biology. Somewhat less commonly discussed, however, is the parallel development of the statistical concept of a population over precisely the same period, in some cases driven by the same historical actors (such as Francis Galton and R. A. Fisher). We explore here these parallel developments, first from the perspective of a reconstruction (...) of the historical development of each concept, then with the aid of a digital analysis of a corpus of literature drawn from the journals Biometrika and Journal of Genetics, between 1900 and 1960. These twin analyses show both points of interesting overlap between these two historical trends as well as points of important divergence. The biological and statistical notions of “population” seem to be relatively clearly distinguishable over these six decades, in spite of the fact that a number of authors contributed clearly to both traditions. The complex interplay of continuity and discontinuity across these two notions of “population” makes them a particularly interesting case study of scientific conceptual change. (shrink)

Problems of climate change present new challenges for social theory. In this article we focus on the task of understanding and analyzing car dependence, using this as a case through which to introduce and explore what we take to be central but underdeveloped questions about how infrastructures and complexes of social practice connect across space and time. In taking this approach we work with the proposition that forms of energy consumption, including those associated with automobility, are usefully understood as outcomes (...) of interconnected patterns of social practices, including working, shopping, visiting friends and family, going to school, and so forth. We also acknowledge that social practices are partly constituted by, and always embedded in material arrangements. Linking these two features together, we suggest that forms of car dependence emerge through the intersection of infrastructural arrangements that are integral to the conduct of many practices at once. We consequently explore the significance of professional – and not only ‘ordinary’ – practices, especially those of planners and designers who are involved in reconfiguring infrastructures of different scales, and in the practice dynamics that follow. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. A new approach to sentencing Not Just Deserts inaugurates a radical shift in the research agenda of criminology. The authors attack currently fashionable retributivist theories of punishment, arguing that the criminal justice system is so integrated that sentencing policy has to be considered in the system-wide context. They offer a comprehensive theory of criminal justice which draws on a philosophical view of the good and the right, and which points the way to practical intervention in the real world of incremental (...) reform. They put the case for a criminal justice system which maximizes freedom in the old republican sense of the term, and which they call `dominion'. (shrink)

Rosenzweig tenta di sviluppare una nuova fenomenologia, idealmente contrapposta a quella hegeliana: un metodo filosofico, o meglio, un orientamento del pensiero che dia ad esso la possibilità di elaborare un pensato che non sia un suo proprio prodotto, un suo proprio logos che per ciò stesso si appropria di ogni fenomeno, sì da renderlo, da rivelazione o datità altra ed eteronoma qual è, rispetto al pensiero, epifenomeno del sapere, che è solo sapere di sé. Tale fenomenologia può essere anche detta (...) grammaticale, una fenomenologia della parola, poiché è un orientamento del pensiero che quest’ultimo impara da altro: un orientamento, da Rosenzweig fatto coincidere con l’esperienza , che considera il fenomeno come autenticamente altro, senza appropriarsene, ed è insegnato al pensiero dalla grammatica, dal linguaggio. Husserlian Essentialism is the view, maintained byEdmundHusserl throughout his career, that necessary truths obtain because essentialist truths obtain. In this thesis I have two goals. First, to reconstruct and flesh out Husserlian Essentialism and its connections with surrounding areas of Husserl's philosophy in full detail – something which has not been done yet. Second, to assess the theoretical solidity of the view. As regards the second point, after having presented Husserlian Essentialism in the first two chapters, I raise a serious (...) problem for it in Chapter 3. In the remainder of the thesis I endeavour to solve the problem. In order to do so, I propose to amend both Husserl's theory of essence and his theory of predication. The bulk of the emendation consists in working out an account of essence and an account of predication that do not presuppose, or in any way imply, the claims that: 1) for a universal to be in the essence of an object, either the object or one of its parts must instantiate the universal; 2) for a universal to be truly predicated of an object, either the object or one of its parts must instantiate the universal. These claims, notice, apart from being what gets Husserl in trouble, are well entrenched not only in Husserl's, but in most theories of essence and predication. It is thus interesting to see what an alternative option may be – even regardless of the Husserlian setting in which I work it out. (shrink)
