The paper addresses the issue of a relatively new institution of criminal procedural law in Latvia. The article is relevant due to the need for an effective mechanism for the objective possibility of realization of the right person for the completion of the criminal process in a reasonable time. Analysis of the European Court of Human Rights has allowed some conclusions that should be considered when investigating criminal cases.

In this paper I consider severalphilosophical accounts of scientific pluralismthat explain the persistence of bothcompetitive and compatible alternatives. PaulSherman's `Levels of Analysis' account suggeststhat in biology competition betweenexplanations can be partitioned by the type ofquestion being investigated. This view is based on taking seriously both thecomplexity and contingency of biologicalorganization and the idealized character ofbiological models. Where the old objectivity question asked, Objectivity or relativism: which side are you on?, the new one refuses this choice, seeking instead to bypass widely recognized problems with the conceptual framework that restricts the choices to these two. It asks, How can the notion of objectivity be updated and made useful for contemporary knowledge-seeking projects? One response to this question is the strong objectivity program that draws on feminist standpoint epistemology to provide a kind of logic of discovery for maximizing (...) our ability to block might makes right in the sciences. It does so by delinking the neutrality ideal from standards for maximizing objectivity, since neutrality is now widely recognized as not only not necessary, not only not helpful, but, worst of all, an obstacle to maximizing objectivity when knowledge-distorting interests and values have constituted a research project. Strong objectivity provides a method for correcting this kind of situation. However, standpoint approaches have their own limitations which are quite different from the misreadings of them upon which most critics have tended to focus. Unfortunately, historically limited epistemologies and philosophies of science are all we get to choose from at this moment in history. (shrink)

Recent calls to address racism in bioethics reflect a sense of urgency to mitigate the lethal effects of a lack of action. While the field was catalyzed largely in response to pivotal events deeply rooted in racism and other structures of oppression embedded in research and health care, it has failed to center racial justice in its scholarship, pedagogy, advocacy, and practice, and neglected to integrate anti-racism as a central consideration. Academic bioethics programs play a key role in determining the (...) field’s norms and practices, including methodologies, funding priorities, and professional networks that bear on equity, inclusion, and epistemic justice. This article describes recommendations from the Racial Equity, Diversity, and Inclusion (REDI) Task Force commissioned by the Association of Bioethics Program Directors to prioritize and strengthen anti-racist practices in bioethics programmatic endeavors and to evaluate and develop specific goals to advance REDI. Feminist standpoint theory remains highly controversial: it is widely advocated, used to guide research and justify its results, and yet is also vigorously denounced. This essay argues that three such sites of controversy reveal the value of engaging with standpoint theory as a way of reflecting on and debating some of the most anxiety-producing issues in contemporary Western intellectual and political life. Engaging with standpoint theory enables a socially relevant philosophy of science.

It has been claimed that ceteris paribus laws, rather than strict laws are the proper aim of the special sciences. This is so because the causal regularities found in these domains are exception-ridden, being contingent on the presence of the appropriate conditions and the absence of interfering factors. I argue that the ceteris paribus strategy obscures rather than illuminates the important similarities and differences between representations of causal regularities in the exact and inexact sciences. In this paper I discuss recent debates concerning etiological theories of functions. I defend an etiological theory against two criticisms, namely the ability to account for malfunction, and the problem of structural doubles. I then consider the arguments provided by Bigelow and Pargetter (1987) for a more forward looking account of functions as propensities or dispositions. I argue that their approach fails to address the explanatory problematic for which etiological theories were developed.

Este ensaio tem como objetivo afirmar a leitura e a escrita enquanto processo ativo tradutório, por meio da reimaginação do Texto de Partida As cidades invisíveis, redigido em 1972 pelo autor italiano Ítalo Calvino. O ensaio é tecido mediante a noção de fragmentos, tal como entendido por Tavares, em que a escrita se constitui como uma experimentação do pensamento. Toma como ponto de partida as pistas deixadas pelo viajante Marco Polo, na obra de Calvino, a qual foi lida e reinventada (...) pelos acadêmicos do Curso de Pedagogia de uma Instituição de Ensino Superior localizada no interior do Rio Grande do Sul. Um Roteiro de Procedimentos Escrileitores – escritura e leitura – das Cidades de Calvino foi disponibilizado aos estudantes, tendo como proposição mostrar nove regras, cujo objetivo consistiu em servir à operação tradutório-inventiva. A partir delas, os estudantes arriscaram uma leitura ativa e uma escritura viva, ou seja, uma escritura tradutória, que não visa à recuperação literal do texto, mas privilegia uma escrileitura inventiva e traduções-reinvenções. Como aporte teórico, o texto aproxima-se do pensamento da diferença, de Roland Barthes, de Gilles Deleuze, além das teorizações da tradução literária propostas por Haroldo de Campos. Trata-se de experimentar a prática da leitura e o ensaio da escrita gerando novas interpretações ao Texto de Partida. Nesse sentido, ler-e-escrever configuram-se como uma prática aberta, jamais definitiva e tampouco estática. Em síntese, o texto propõe defender que os Textos de Partida são sempre fisgados pelos processos tradutórios e, por isso, novamente reinventados via leitura e escrita em Textos de Chegada. We prove a number of results on the determinacy of σ-projective sets of reals, i.e., those belonging to the smallest pointclass containing the open sets and closed under complements, countable unions, and projections. We first prove the equivalence between σ-projective determinacy and the determinacy of certain classes of games of variable length <ω^2 (Theorem 2.4). We then give an elementary proof of the determinacy of σ-projective sets from optimal large-cardinal hypotheses (Theorem 4.4). Finally, we show how to generalize the proof (...) to obtain proofs of the determinacy of σ-projective games of a given countable length and of games with payoff in the smallest σ-algebra containing the projective sets, from corresponding assumptions (Theorem 5.1, Theorem 5.4). This paper is aimed at understanding one central aspect of Bolzano's views on deductive knowledge: what it means for a proposition and for a term to be known a priori. I argue that, for Bolzano, a priori knowledge is knowledge by virtue of meaning and that Bolzano has substantial views about meaning and what it is to know the latter. In particular, Bolzano believes that meaning is determined by implicit definition, i.e. the fundamental propositions in a deductive system. I go (...) into some detail in presenting and discussing Bolzano's views on grounding, a priori knowledge and implicit definition. I explain why other aspects of Bolzano's theory and, in particular, his peculiar understanding of analyticity and the related notion of Ableitbarkeit might, as it has invariably in the past, mislead one to believe that Bolzano lacks a significant account oï a priori knowledge. Throughout the paper, I point out to the ways in which, in this respect, Bolzano's antagonistic relationship to Kant directly shaped his own views. (shrink)

I argue that recognizing a human right to adequate food and enforcing it as a legal right is an important way to promote and ensure sustainable food security. I consider objections that have been raised against subsistence rights and socio-economic rights, including the argument that such rights are not feasible, that they are not justiciable, and that they are too amorphous—that it is not clear what is required to fulfill these rights and by whom. I defend the right to adequate (...) food against these objections by considering how this right has been interpreted and applied in international law and how it has been protected in other domestic legal systems. I analyze different dimensions of the right to adequate food and I apply these to recent issues concerning sustainable food security in the United States, such as food deserts. (shrink)

The place of man in Darwin's development of a theory of transmutation has been obscured by his manner of disclosure. Comparing the 1837–1839 period to his entire career as a theorist suggests that it was Darwin's practice to present himself and his work only before the most select scientific audiences, and then in accordance with their expectations. The negative implications of this rule for his publication on man are clear enough: finding no general invitation in science to publish as a (...) theorist and no contemporary scientific audience for the sorts of inquiries he was making on man, he was silent, at least until such time as he could publish on the strength of reputation alone. Now, with the availability of manuscripts from the early period, what was once hidden stands revealed. It is clear from Darwin's notebooks that man played a dual role in the formation of his theory: as a zoological species to be incorporated into the theory and as the primary vehicle for the study of behavior. On the first score, integrating man into the theory provoked Darwin to break with the traditional view of man's place in nature and to reject a major element in the scientific notion of progressive development. On the second score, the study of behavior led Darwin outside natural history and thence, unexpectedly, to Malthus and natural selection.One is left with the certainty that the subject of man was a central element in Darwin's formulation of his species theory. To an extent, then, the public judgment of Darwin was right all along, for the public had always sensed that Darwin spoke to a larger audience than that formed around science. On the basis of new evidence, we can add that Darwin drew from that larger audience as well. There are of course ironies to this conclusion: that Darwin the professional drew so heavily from fields where he was the amateur, that as a transparent man his inner life should prove so at odds with the manner in which he presented himself, and that his arrival at a strong sense of himself—the revolutionary “I” of his notebooks—should occur just as he stepped beyond science to engage the general culture. But when one considers the inherent difficulties of Darwin's subject and the magnitude of his claims respecting man, these ironies are perhaps not surprising at all but those of a kind which might be anticipated. However, the ethical issues surrounding the use of data and data collection methods are challenging research review boards at many institutions. This article illuminates some of the obstacles facing researchers who wish to take advantage of the Internet's flexibility. The applications of the APA ethical codes for conducting research on human participants on the Internet are reviewed. Résumé Les discussions contemporaines du concept fécond de forme de vie ont permis de mettre en évidence à quel point le concept de forme lui-même est essentiel chez Wittgenstein, structurant la continuité entre le premier et le second Wittgenstein. En passant de la « forme logique » au concept de forme de vie, Wittgenstein entend renoncer à une unité « de forme » pour passer à une « famille » de structures apparentées. Mais la logique ne disparaît pas – au (...) contraire. Le point sur lequel s’appuie sa recherche reste bien la forme, entendue désormais comme pluralité de façons pour le langage de décrire le réel. Must We Mean What We Say? is Stanley Cavell's first book, and, in a sense, it is his most important. It contains all the themes that Cavell continues to develop masterfully throughout his philosophy. There is a renewed usage of J. L. Austin's theory of speech acts, and, in the classic essay “The Availability of Wittgenstein's Later Philosophy,” he establishes the foundations of a radical reading of Ludwig Wittgenstein , the connections among skepticism, acknowledgement, and Shakespearean tragedy ; there is (...) the reflection on the ordinary that runs throughout his later works ; and, finally, there is the original aesthetic approach that defines Cavell's work, through his objects—which range from William Shakespeare to Samuel Beckett and pass through Hollywood comedies and melodrama, and opera—and, above all, through his style and method. Pierre Hadot, professor of ancient philosophy at the Collège de France, published, in the late 1950s and early 1960s, some of the earliest work on Wittgenstein to appear in French. Hadot conceived of philosophy as an activity rather than a body of doctrines and found in Wittgenstein a fruitful point of departure for ethical reflection. Hadot's understanding of philosophy as a spiritual exercise — articulated through his reading of ancient philosophy but also the American transcendentalists Henry David Thoreau and Ralph (...) Waldo Emerson — will find an echo in Wittgenstinian thinkers such as Stanley Cavell and Cora Diamond. Ultimately philosophy for Hadot is a call to personal and political transformation. (shrink)

The contemporary world faces a number of problems that are both deep-seated and interrelated, since they arise from the very nature of technological society. The environment upon which all life depends is seriously threatened by climate change, rising sea levels, pollution, overpopulation, resource depletion and increased risks of droughts, forest fires, floods and other extreme weather events. Environmental degradation is intimately connected to the consumer lifestyle of developed countries. This lifestyle promotes materialism, entertainment and hedonistic superficiality that ultimately lead to (...) moral corruption. Our insensitive and destructive attitude towards nature is not isolated, or unrelated to other problems of social justice. The environmental crisis reflects human structures of domination that include political and economic exploitation, racism, sexism and ageism. These challenges are immense, and solutions to them will require a renewed dedication to moral reflection and a commitment to social justice. This book discusses the challenges in connection with topics such as human rights, economic exploitation and inequality, environmental protection, globalization, global food justice, technology, gender equality and ageism. It provides a plurality of moral and spiritual perspectives including Hinduism, Buddhism, Daoism and Christianity that offer guidance in finding responses that are both possible and reasonable. hiCLIP (RNA hybrid and individual‐nucleotide resolution ultraviolet cross‐linking and immunoprecipitation), is a novel technique developed by Sugimoto et al. (2015). Here, the use of different adaptors permits a controlled ligation of the two strands of a RNA duplex allowing the identification of each arm in the duplex upon sequencing. The authors chose a notoriously difficult to study double‐stranded RNA‐binding protein (dsRBP) termed Staufen1, a mammalian homolog of Drosophila Staufen involved in mRNA localization and translational control. Using hiCLIP, they discovered a (...) dominance of intramolecular RNA duplexes compared to the total RNA duplexes identified. Importantly, the authors discovered two different types of intramolecular duplexes in the cell: highly translated mRNAs with long‐range duplexes in their 3′‐UTRs and poorly translated mRNAs with duplexes in their coding region. In conclusion, the authors establish hiCLIP as an important novel technique for the identification of RNA secondary structures that serve as in vivo binding sites for dsRBPs. (shrink)

This article has two objectives: the first, to analyze the professionalization process of assisted reproduction (AR) in order to see how AR is consolidating into an independent field within medicine, and the second, to see how AR arrived and was assimilated into Mexican culture. As opposed to other projects that have traced back the story of a particular specialty to see how it emerged as such, this article looks at an ongoing process: specialization in action. By analyzing the data collected (...) through three years of multisited ethnography using tools offered by the sociology of professions and the history of medical specialization, I identify specific moments in which AR is gaining cognitive, normative, and evaluative consolidation, structure, and independence. This leads me to suggest that AR might separate from gynecology and become an independent specialty within medicine. I offer examples to support this argument and show how AR has developed into a biomedical service, a professional biomedical field, and a biomedical business. (shrink)

The capacity to treat pain has never been greater; but, as you will read in the articles that follow, the problem of undertreated and neglected pain in the United States persists. Deep-seated perceptions and practices undergird this strong and well-documented pattern of neglect. Among the reasons frequently noted for the inadequacy of treatment for pain, however, is that the legal system actually penalizes effective interventions to relieve pain while it leaves neglect of pain unthreatened. It is the mission of the (...) American Society of Law, Medicine & Ethics to explore areas, such as this one, where developments in medicine directly encounter the law and, in turn, create ethical issues for clinicians, regulators, patients, and lawyers.This special issue of the Journal of Law, Medicine & Ethics is part of a multi-year project in which ASLME, with the wonderful support of the Mayday Fund, has worked to address legal and regulatory barriers to effective pain relief. In this paper I argue that two domains of uncertainty should inform our strategies for making social policy on new genetic technologies. The first is biological complexity, which includes both unknown consequences on known variables and unknown unknowns. The second is value pluralism, which includes both moral conflict and moral pluralism. Little attention has focused on the reporting of ethical research practices in journal articles. In Study 1, published articles in 2 psychopathology journals were reviewed to ascertain the types of ethical research information that were reported. In Study 2, a survey was sent to authors in Study 1 to determine which ethical practices they engaged in, if they reported this information, and reasons for not including this information in their article. In general, there is a great variability regarding the types (...) of ethical research practices reported in journal articles. Commonly cited reasons for not including ethical research practice information in the articles included the need for brevity, belief that it was common practice, and lack of relevance for the project. These results suggest that there is no standard practice for reporting research practices in journal articles and great variability in the implementation of procedures that are generally considered standard. O ensaio aproxima estudos em torno da dimensão poética da linguagem para abordar a relação entre docência na educação infantil e experiência de estar à escuta como modo estésico de coexistir no mundo. A aproximação entre filosofia, artes e educação infantil, desde o encontro entre e música e educação, sublinha que a escuta é o som do sentido e não o sentido do som a ser interpretado. A interlocução com o pensamento de Jean-Luc Nancy, ao permitir afirmar que o sentido (...) sensível suscita o sentido sensato ou inteligível e o faz num movimento constante que não se completa ou finaliza produzindo uma significação ou uma informação, emerge como resistência filosófica ao privilégio do registro teórico fundado na primazia ocidental do modelo óptico. Estar à escuta implica a ressonância como o som do sentido, como profundidade primeira ou última do corpo. A música como jogo entre som e ruído, como produção poética de ordenação de sentidos sonoros provocados pela ressonância – como gesto de escutar a escuta, contribui para interrogar a educação de bebês e crianças pequenas a partir de um corpo que pode brincar com a sonoridade do mundo para viver a poética do barulhar como potência musical de jogar com sons e ruídos. O apetite sonoro das crianças as convocam a barulhar pela estesia de escutar o mundo na pluralidade da coexistência. O gesto de estar à escuta na docência com bebês e crianças pequenas aponta para ações educativas que consideram a experiência constituinte de ressonâncias e reverberações de sentidos imbricamos no som, um sentir se sentir (aisthesis), como partição e partilha das vozes, dos signos, dos gestos, das formas, do sentido sentido e do sentido sensato que nos situam sendo-uns-com-os-outros na coexistência mundana. This article aims at putting in context and at pursuing the concept elaborated by the later Putnam of an ethics without ontology, which I associate with certain other contemporary philosophers like Stanley Cavell and Cora Diamond; and in general of a philosophy without ontology. Putnam’s ambition is to get rid of ontology by refocusing reflection on ethics in a realistic spirit. This calls for a reappraisal of the entirety of Putnam’s evolution after the 1980s, especially his “Wittgensteinian turn,” which has (...) sometimes been underappreciated. To say that ethics has nothing to do with ontology is to make a claim not only about ethics, but also about realism. That is why Putnam’s later work matters today, especially his radical break with the fact/value distinction. This does not only concern ethics, for as Diamond has said and as Putnam reiterates in his own style and culture, we must refocus reflection on ethics and on the place of ethics in our forms of life and of language. This paper explores the growing array of initiatives aimed at creating corporate accountability with the goal of attempting to uncover the foundation principles that underlie them and create a floor below which practices are ethically questionable. Using the Global Compact's nine principles and the work of Transparency International as guides, foundational principles seem to exist in the areas of human rights, labor standards, environment, and anti-corruption initiatives.
