The ethics of the Flexibility In duty hour Requirements for Surgical Trainees trial have been vehemently debated. Views on the ethics of the FIRST trial range from it being completely unethical to wholly unproblematic. The FIRST trial illustrates the complex ethical challenges posed by cluster randomised trials of policy interventions involving healthcare professionals. In what follows, we have three objectives. First, we critically review the FIRST trial controversy, finding that commentators have failed to sufficiently identify and address many of the (...) relevant ethical issues. The 2012 Ottawa Statement on the Ethical Design and Conduct of Cluster Randomized Trials provides researchers and research ethics committees with specific guidance for the ethical design and conduct of CRTs. Second, we aim to demonstrate how the Ottawa Statement provides much-needed clarity to the ethical issues in the FIRST trial, including: research participant identification; consent requirements; gatekeeper roles; benefit-harm analysis and identification of vulnerable participants. We nonetheless also find that the FIRST trial raises ethical issues not adequately addressed by the Ottawa Statement. Hence, third and finally, we raise important questions requiring further ethical analysis and guidance, including: Does clinical equipoise apply to policy interventions with little or no evidence-base? Do healthcare providers have an obligation to participate in research? Does the power-differential in certain healthcare settings render healthcare providers vulnerable to duress and coercion to participant in research? If so, what safeguards might be implemented to protect providers, while allowing important research to proceed? (shrink)

We present an account of the evolutionary development of the experiences of empathy that marked the beginning of morality and art. We argue that aesthetic and moral capacities provided an important foundation for later epistemic developments. The distinction between phenomenal consciousness and attention is discussed, and a role for phenomenology in cognitive archeology is justified-critical sources of evidence used in our analysis are based on the archeological record. We claim that what made our species unique was a form of meditative (...) and empathic thinking that made large-scale human cooperation possible through pre-linguistic, empathic communication. A critical aspect of this proposal is that the transformation that led to the dawn of our species was not initially driven by semantic or epistemic factors, although clearly, these factors increased the gap between us and other species dramatically later on. Our proposal suggests that recent philosophy of mind and psychology might have "epistemicized" phenomenal consciousness too much by construing it in terms of semantic content rather than by describing it in terms of empathic and meditative thinking. Instead of the prevailing approach, we favor the type of subjectivity that is fundamentally "other-involving" as essential, because on our account, a necessary condition for subjectivity is the empathic understanding of other individuals' psychology, not through inference or judgment, but through immediate conscious engagement. This volume brings together a collection of papers covering a wide range of topics in computer and cognitive science. Topics included are: the foundational relevance of logic to computer science, with particular reference to tense logic, constructive logic, and Horn clause logic; logic as the theoretical underpinnings of the engineering discipline of expert systems; a discussion of the evolution of computational linguistics into functionally distinct task levels; and current issues in the implementation of speech act theory.

This article engages with the work of Scotland-based artist Kate Davis (b.1977). The discussion begins to articulate a framework for understanding Davis's work within a feminist logic of re-visioning and re-citing, strategies that are explicated and suggested as paradigmatic to feminist art production since 1970. Fundamentally, the article explores Davis's complex strategies for adopting and adapting motifs from within the archives of art history, arguing that her work constitutes a mode of visual research and historiography.

What kind of evidence will lead people to revise their moral beliefs? Moral beliefs are often strongly held convictions, and existing research has shown that morality is rooted in emotion and socialization rather than deliberative reasoning. In addition, more general issues—such as confirmation bias—further impede coherent belief revision. Here, we explored a unique means for inducing belief revision. In two experiments, participants considered a moral dilemma in which an overwhelming majority of people judged that it was inappropriate to take action (...) to maximize utility. Their judgments contradicted a utilitarian principle they otherwise strongly endorsed. Exposure to this scenario led participants to revise their belief in the utilitarian principle, and this revision persisted over several hours. Many hold that distributing healthcare according to medical need is a requirement of equality. Most egalitarians believe, however, that people ought to be equal on the whole, by some overall measure of well-being or life-prospects; it would be a massive coincidence if distributing healthcare according to medical need turned out to be an effective way of promoting equality overall. I argue that distributing healthcare according to medical need is important for reducing individuals' uncertainty surrounding their future medical needs. Citizens in wealthy liberal democracies are typically expected to see to basic needs like food, clothing, and shelter out of their own income, and those without the means to do so usually receive assistance in the form of cash transfers. Things are different with health care. Most liberal societies provide their citizens with health care or health care insurance in kind, either directly from the state or through private insurance companies that are regulated like public utilities. Except perhaps for small (...) co-pays or deductibles, citizens are not expected to see to their health needs out-of-pocket, at least for some basic level of care. Louis Charland has argued that the Cluster B personality disorders, including borderline personality disorder, are primarily moral rather than clinical conditions. Part of his argument stems from reflections on effective treatment of borderline personality disorder. In the argument from treatment, he claims that successful treatment of all Cluster B personality disorders requires a positive change in a patient’s moral character. Based on this claim, he concludes (1) that these disorders are, at root, deficits in moral character, and (2) that effective (...) treatment of these disorders requires a sort of moral education rather than clinical intervention. In this paper, I evaluate the argument from treatment through a critical analysis of two psychotherapeutic interventions that have shown recent effectiveness against borderline personality disorder. I suggest that both Dialectical Behaviour Therapy and Mentalization-Based Treatment indicate that borderline personality disorder is, at root, a deficit in non-moral cognitive and emotional capacities. I suggest that these non-moral deficits obscure the expression of an otherwise intact moral character. In light of this, I conclude that effective treatment of borderline personality disorder requires primarily clinical intervention rather than moral edification. (shrink)

It has become customary among philosophers and biologists to claim that folk racial classification has no biological basis. This paper attempts to debunk that view. In this paper, I show that ‘race’, as used in current U.S. race talk, picks out a biologically real entity. I do this by, first, showing that ‘race’, in this use, is not a kind term, but a proper name for a set of human population groups. Next, using recent human genetic clustering results, I show (...) that this set of human population groups is a partition of human populations that I call ‘the Blumenbach partition’. (shrink)

Theorists of the welfare state increasingly recognize that social insurance programs are not well-justified by distributive egalitarianism—meaning concern for equality considered as a pattern in the distribution of some good. However, recent work by several relational egalitarian theorists suggests that these programs may be justified on relational egalitarian grounds. Relational egalitarians hold that the proper object of egalitarian concern is the way that citizens relate to one another. In this paper, I review the problems facing a distributive egalitarian justification for (...) social insurance before considering and rejecting three relational egalitarian justifications. I close by offering a justification for these programs grounded in efficiency, not equality. (shrink)

Perhaps there has been no greater opportunity than in this “VOLUME FIFTEEN of our Death And Anti-Death set of anthologies” to write about how might think about life and how to avoid death. There are two reasons to discuss “life”, the first being enhancing our understanding of who we are and why we may be here in the Universe. The second is more practical: how humans meet the physical challenges brought about by the way they have interacted with their environment. (...) Many persons discussing “life” beg the question about what “life” is. Surely, when one discusses how to overcome its opposite, death, they are not referring to another “living” thing such as a plant. There seems to be a commonality, though, and it is this commonality is one needing elaboration. It ostensibly seems to be the boundary condition separating what is completely passive (inert) from what attempts to maintain its integrity, as well as fulfilling other conditions we think “life” has. In our present discussion, there will be a reminder that it by no means has been unequivocally established what life really is by placing quotes around the word, namely, “life”. Angel's declared purpose is to “demystify” mysticism by approaching it as we do ordinary phenomena, and his eventual conclusion is that mystical experiences are very similar to some of our everyday experiences. To demonstrate that, he provides us with three closely-argued chapters on, successively, the typology of mysticism, the reasons for mystical silence, and the relationship of mysticism to other experiences. Ultimately, he claims that mysticism need not be mysterious because all of us have quasi-mystical experiences.

This article argues that the recent growth of interest in the body in Western social science has been largely based on Western assumptions of social development. In particular, studies of sport and body culture more generally have either ignored non-Western societies, such as Japan, or sustained stereotypical views of Japanese culture. As a small amount of research being developed by anthropologists suggests, the study of sport and body culture in Japan reveals similarities and differences with the West. The pattern of (...) Japanese social development is both a route to modernity and one of the roots of modernity. According to a widely held principle—the poss-ability principle—an agent, S, is able to only if it is metaphysically possible for S to. I argue against the poss-ability principle by developing a novel class of counterexamples. I then argue that the consequences of rejecting the poss-ability principle are interesting and far-reaching.

Certain properties of great interest to philosophers—e.g., blameworthiness, praiseworthiness, desirability, etc.—appear on the basis of their standard English forms of designation to have relation-response structure. In other words, each such property appears on the basis of its standard English forms of designation to be a relational property of a certain sort, namely, the property of standing in a given relation to a given type of response. This presents a question: When we set out to theorize any such property, how seriously (...) ought we to take the linguistic appearances? This paper defends an answer, namely: “Seriously.” In other words, we ought only to provide analyses of such properties that are faithful to their standard English forms of designation. This thesis is controversial: a number of philosophers of blameworthiness, for instance, seem to violate it outright, whereas other such philosophers—most notably, Justin D’Arms and Daniel Jacobson and David Shoemaker—have argued that its violation follows from a popular combination of views about the natures of certain such properties. In the paper, I defend faithfulness against these latter arguments, and I endeavor to clarify the role that faithfulness plays (and ought to play) in recent debates about the natures of certain value properties. The crucial premise of the standard argument for two-boxing in Newcomb's problem, a causal dominance principle, is false. We present some counterexamples. We then offer a metaethical explanation for why the counterexamples arise. Our explanation reveals a new and superior argument for two-boxing, one that eschews the causal dominance principle in favor of a principle linking rational choice to guidance and actual value maximization.

People tend to be repulsed by the idea of cash markets in kidneys, but support the trading of kidneys through paired exchanges or chains. We reject anti-commodification accounts of this reaction and offer an egalitarian one. We argue that the morally significant difference between cash markets and kidney chains is that the former allow the wealthy greater access to kidneys, while the latter do not. The only problem with kidney chains is that they do not go far enough in addressing (...) equality concerns, and we show how the introduction of cash payments by the state could remedy this. In order to graduate, Florida's high school students by law must learn that Communism is evil, dangerous, and fallacious. All students must learn that the U.S. produces the highest standard of living and more freedom than any other economic system on earth. State universities in Florida are creating a curriculum to implement the Americanism versus Communism Act of 1961 and the Free Enterprise and Consumer Education Act of 1975. ;The Florida Department of Education says that ideology, noncritical thinking, is superior (...) to critical thinking and that the superiority of the U.S. political economy and the dignity of the individual rest in part on peoples' being able to express themselves freely. ;Florida's A.V.C. and F.E.C.E.A. proponents have a special way of convincing audiences that they will develop loyalty while at the same time imposing a set of ideas not open to question. ;This work argues that, intentionally or not, Florida's legislature and Department of Education have set up an official ideology and the mechanism to purvey it. This ideological approach defeats the aim of comparing systems objectively. While the stated aim is to promote critical thinking, the D.O.E.'s special philosophy underscoring words like "democracy" results in indoctrinating students with a questionable description of the U.S. system. Scholars have long recognized that hypothêkai, or instructional wisdom sayings, served as building blocks for larger structures of Greek wisdom poetry. Yet the mechanism that gets from saying to poem has never been traced in detail. If the transition involves more than piling sayings on top of each other, what intervenes? Focusing on the archaic hexametrical tradition of Homer and Hesiod, the paper develops a repertory of variations and expansions by which the primary genre, the hypothêkê speech-act, is transformed into (...) a secondary genre—the larger-scale wisdom constructions we find in various Homeric speeches and much if not all of the Works and Days. The paper first argues for a precise formal description of the hypothêkê saying in the archaic hexameter; it then develops a toolbox of variations on the saying's basic form. Finally, the toolbox is put to work in order to read a forty-verse excerpt of Hesiod's Almanac. (shrink)

This article is Part II in a pair of articles on racial realism. In Part I, I defined “racial realism” and discussed the major attempts in the past twenty years among metaphysicians of race and biologists to defend racial realism from the viewpoint of what biologists mean by “race.” In this article, I continue discussing and critiquing how metaphysicians of race have conceived of and defended racial realism, but with a focus on how ordinary people use “race.” I focus on (...) two broad groups of racial realisms in this article: biological racial realism and social racial realism. After defining each one, I summarize a representative sample of recent attempts from metaphysicians of race to defend both types of racial realism. I also discuss major criticisms against each attempt. I end by sketching a new, radical pluralist way of being a racial realist, and I provide some empirical motivation for why it's promising.
