This paper explores Bessie Head’s writing as a survival strategy through which she transformed her lived experience into imaginative literature, giving meaning and purpose to a life under permanent threat from the dominant group first in South Africa and later in Botswana. This threat included the destructive effect of the many fixed labels imposed upon her including: a ‘Coloured’ woman, the daughter of a woman designated mad, an exile, a psychotic, a tragic black woman, and a Third World woman writer. Her endeavours to avoid and defeat such limited, static definitions produced work characterised by contradiction and paradox, through which she asserted her right to survive and determined, like Makhaya in When Rain Clouds Gather , to establish ‘a living life’ in place of the ‘living death that a man could be born into’ (Head 1989, 136). Through a combination of Head’s personal letters and papers and her published work, it can be seen how her particular preoccupations and experiences including her life in exile, her beliefs about her origins, her relationship to her absent mother, her distress, her madness and her need for love and for work were transformed into writing which expresses not only the destructive circumstances of her life but also its life-affirming aspects. Her writing was also a means by which she could create identities to express the dangers she encountered from the all-pervasive power structures which influenced her life and her sense of self, as well as ways to transcend them, enabling her to say in the last years of her life ‘I am no failure’ (20.2.1986 KMM BHP). The invisibility of nursing work has been discussed in the international literature but not in relation to learning clinical skills. Evans and Guile's (Practice‐based education: Perspectives and strategies, Rotterdam: Sense, 2012) theory of recontextualisation is used to explore the ways in which invisible or unplanned and unrecognised learning takes place as newly qualified nurses learn to delegate to and supervise the work of the healthcare assistant. In the British context, delegation and supervision are thought of as skills which are learnt (...) “on the job.” We suggest that learning “on‐the‐job” is the invisible construction of knowledge in clinical practice and that delegation is a particularly telling area of nursing practice which illustrates invisible learning. Using an ethnographic case study approach in three hospital sites in England from 2011 to 2014, we undertook participant observation, interviews with newly qualified nurses, ward managers and healthcare assistants. We discuss the invisible ways newly qualified nurses learn in the practice environment and present the invisible steps to learning which encompass the embodied, affective and social, as much as the cognitive components to learning. We argue that there is a need for greater understanding of the “invisible learning” which occurs as newly qualified nurses learn to delegate and supervise. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

Tracing the impact of the 'memory wars' on science and culture, Relational Remembering offers a vigorous philosophical challenge to the contemporary skepticism about memory that is their legacy. Campbell's work provides a close conceptual analysis of the strategies used to challenge women's memories, particularly those meant to provoke a general social alarm about suggestibility. Sue Campbell argues that we cannot come to an adequate understanding of the nature and value of memory through a distorted view of rememberers. The harmful stereotypes (...) of women's passivity and instability that have repopulated discussions of abuse have led many theorists to regard the social dimensions of remembering only negatively, as a threat or contaminant to memory integrity. Such models of memory cannot help us grasp the nature of harms linked to oppression, as these models imply that changed group understandings of the past are incompatible with the integrity of personal memory. Campbell uses the false memory debates to defend a feminist reconceptualization of personal memory as relational, social, and subject to politics. Memory is analyzed as a complex of cognitive abilities and social/narrative activities where one's success or failure as a rememberer is both affected by one's social location and has profound ramifications for one's cultural status as a moral agent. Research only alluded to by Preston & de Waal (P&deW) indicates the disproportionate involvement of some brain regions in the perception and experience of certain emotions. This suggests that the neural substrate of primitive emotional contagion has some emotion-specific aspects, even if cognitively sophisticated forms of empathy do not. Goals for future research include determining the ways in which empathy is emotion-specific and dependent on overt or covert perception.

What makes us conscious? Many theories that attempt to answer this question have appeared recently in the context of widespread interest about consciousness in the cognitive neurosciences. Most of these proposals are formulated in terms of the information processing conducted by the brain. In this overview, we survey and contrast these models. We first delineate several notions of consciousness, addressing what it is that the various models are attempting to explain. Next, we describe a conceptual landscape that addresses how the (...) theories attempt to explain consciousness. We then situate each of several representative models in this landscape and indicate which aspect of consciousness they try to explain. We conclude that the search for the neural correlates of consciousness should be usefully complemented by a search for the computational correlates of consciousness. (shrink)

This book offers a feminist philosophical analysis of contemporary public skepticism about women's memories of past harm. It concentrates primarily on writings associated with the False Memory Syndrome Foundation, founded in 1992 as a lobby for parents whose adult children have accused them of some abuse after a period of having not remembered it.

For many people "animal rights" suggests campaigns against factory farms, vivisection or other aspects of our woeful treatment of animals. Zoopolis moves beyond this familiar terrain, focusing not on what we must stop doing to animals, but on how we can establish positive and just relationships with different types of animals.

This study links corporate reputation, as measured byFortune magazine's Most Admired list, with firm financial performance. Seven measures of financial risk and return were collected for a sample of 149 firms from two time periods, 1981 and 1986. The mean score of four attributes from the 1993Fortune Most Admired list for the sample was then analyzed with the financial data through regression analysis. Two financial variables, Standard Deviation of the Market Return of the Firm and Return on Sales, explained between (...) 0.12 and 0.14 of subsequent reputation. The implication for management is that they can affect a firm's subsequent reputation by lowering financial risk and controlling costs. (shrink)

In this paper we describe the impact that Walton’s conception of argumentation schemes had on AI and Law research. We will discuss developments in argumentation in AI and Law before Walton’s schemes became known in that community, and the issues that were current in that work. We will then show how Walton’s schemes provided a means of addressing all of those issues, and so supplied a unifying perspective from which to view argumentation in AI and Law.

An infinite number of elastically colliding balls is considered in a classical, and then in a relativistic setting. Energy and momentum are not necessarily conserved globally, even though each collision does separately conserve them. This result holds in particular when the total mass of all the balls is finite, and even when the spatial extent and temporal duration of the process are also finite. Further, the process is shown to be indeterministic: there is an arbitrary parameter in the general solution (...) that corresponds to the injection of an arbitrary amount of energy (classically), or energy-momentum (relativistically), into the system at the point of accumulation of the locations of the balls. Specific examples are given that illustrate these counter-intuitive results, including one in which all the balls move with the same velocity after every collision has taken place. (shrink)

When we consider the issue of linguistic justice, we must define what we mean by language. Standardisation of languages is closely associated with the development of the nation state, and the de Saussurian conception of language as system is in concert with nationalism and its divisions. In the early twenty-first century, however, this view of the world as a mosaic of stable national monolingualisms is outdated. In a globalising world, much of the political, social and economic structure that is developing (...) is transnational and patterns of contact, both real and virtual, have become extraordinarily complex. In the resulting communities of communication of this superdiverse world, much language practice is more function driven than in the recent past. New practices mean that we cannot consider questions of linguistic justice in this new world order using the linguistic toolkit of the old. The flows, exchanges and networks of globalisation present us with a new paradigm and we need to recalibrate concepts. (shrink)

As befits an emerging field of enquiry, there is on-going discussion about the scope, role and future of the medical humanities. One relatively recent contribution to this debate proposes a differentiation of the field into two distinct terrains, ‘medical humanities’ and ‘health humanities,’ and calls for a supersession of the former by the latter. In this paper, we revisit the conceptual underpinnings for a distinction between ‘the medical’ and ‘health’ by looking at the history of an analogous debate between ‘medical (...) geography’ and ‘the geographies of health’ that has, over the last few years, witnessed a re-blurring of the distinction. Highlighting the value of this debate within the social sciences for the future development of the medical humanities, we call for scholars to take seriously the challenges of critical and cultural theory, community-based arts and health, and the counter-cultural creative practices and strategies of activist movements in order to meet the new research challenges and fulfill the radical potential of a critical medical humanities. In this paper, I discuss whether different interpretations of the ‘aim’ of belief—both the teleological and normative interpretations—have the resources to explain certain descriptive and normative features of suspended belief (suspension). I argue that, despite the recent efforts of theorists to extend these theories to account for suspension, they ultimately fail. The implication is that we must either develop alternative theories of belief that can account for suspension, or we must abandon the assumption that these theories ought to be able (...) to account for suspension. To close, I briefly consider some of the reasons we have in favour of pursing each of these options, and I suggest that it is worth exploring the possibility that suspension is best understood as its own attitude, independently of theories of belief’s ‘aim’. In this paper we describe an approach to practical reasoning, reasoning about what it is best for a particular agent to do in a given situation, based on presumptive justifications of action through the instantiation of an argument scheme, which is then subject to examination through a series of critical questions. We identify three particular aspects of practical reasoning which distinguish it from theoretical reasoning. We next provide an argument scheme and an associated set of critical questions which is able (...) to capture these features. In order that both the argument scheme and the critical questions can be given precise interpretations we use the semantic structure of an Action-Based Alternating Transition System as the basis for their definition. We then work through a detailed example to show how this approach to practical reasoning can be applied to a problem solving situation, and briefly describe some other previous applications of the general approach. In a second example we relate our account to the social laws paradigm for co-ordinating multi-agent systems. The contribution of the paper is to provide firm foundations for an approach to practical reasoning based on presumptive argument in terms of a well-known model for representing the effects of actions of a group of agents. Doug Walton, who died in January 2020, was a prolific author whose work in informal logic and argumentation had a profound influence on Artificial Intelligence, including Artificial Intelligence and Law. He was also very interested in interdisciplinary work, and a frequent and generous collaborator. In this paper seven leading researchers in AI and Law, all past programme chairs of the International Conference on AI and Law who have worked with him, describe his influence on their work.
