In this article, we present findings from a participatory action research program in France on the exercise of human rights and supported and substitute decision-making, inspired by the United Nations Convention on the Rights of Persons with Disabilities (“CRPD”). Bringing together persons with the lived experience of disability, academics, and health and social care and support professionals, the project used the method of “experience-based construction of public problem” to transform experience into collective expertise. This enabled the exploration of support that (...) persons in vulnerable situations, whose capacity to exercise their human rights has weakened, need to make decisions in their lives and participate meaningfully in public debate. The relationship between the awareness of rights and exercise of rights is discussed. We argue for the need to balance out the positions of different contributors in participatory action research, in a reasoned manner, by recognizing the scientific and citizen-based participation of all partners. Reprenant l'œuvre d'Aristote et la poursuivant, il a fait de la rhétorique et de l'argumentation la nouvelle matrice des sciences humaines après la mort du structuralisme. A l'occasion du centenaire de sa naissance, les auteurs réunis ici lui rendent hommage, mais aussi poursuivent, par leurs propres recherches, l'idée que la rhétorique comme l'argumentation sont (...) centrales. Mucoidy and cytotoxicity arise from two independent modifications of the phenotype of the bacterium Pseudomonas aeruginosa that contribute to the mortality and morbidity of cystic fibrosis. We show that, even though the transcriptional regulatory networks controlling both processes are quite different from a molecular or mechanistic point of view, they may be identical from a dynamic point of view: epigenesis may in both cases be the cause of the acquisition of these new phenotypes. This was highlighted by the identity of (...) formal graphs modelling these networks. A mathematical framework based on formal methods from computer science was defined and implemented with a software environment. It allows an easy and rigorous validation and certification of these models and of the experimental methods that can be proposed to falsify or validate the underlying hypothesis. (shrink)

Les réseaux personnels sont des ensembles de relations interpersonnelles dans lesquelles les personnes sont engagées. Toutes les études sur ces réseaux montrent l’existence de variations dans leur taille et leur composition selon les indicateurs de hiérarchie sociale, le niveau d’études, la profession ou le revenu. Ces variations peuvent être interprétées comme des « inégalités relationnelles » dans la mesure où les relations sont des ressources essentielles pour de nombreux aspects de la vie sociale. Ces ressources jouent un rôle particulièrement important (...) pour les personnes âgées lorsqu’elles sont confrontées aux diverses difficultés liées au vieillissement. À partir d’une étude sur les parcours et les réseaux de 342 personnes de soixante ans et plus, cet article évalue l’évolution de ces inégalités relationnelles selon différents types de contenus relationnels associés aux questions sur les relations. Au-delà de ces variations, les inégalités tendent à s’accroître avec l’âge, notamment entre les personnes les moins diplômées et les autres, ce qui fait apparaître des temporalités différentes du « vieillissement relationnel ». On nomme ici « un sexe » une manière singulière d’envisager une pratique sexuelle et de s’y engager. Michel Leiris est exemplaire dans sa manière d’exposer une pratique que l’on pourrait qualifier, en usant d’un de ses propres termes de « timoré ». Loin d’être naturelle ou immédiatement exaltante, l’acte sexuel se présente plutôt pour lui comme une épreuve, certes sans violence ni dimension sacrale, mais qui peut néanmoins être comparée, comme l’écriture elle-même, à une sorte de corrida intime.

La polémique qui a suivi le discours du pape Benoît XVI à Ratisbonne, le 12 septembre 2006, a porté non sur le thème lui-même qu’il abordait, à savoir la nécessité d’un dialogue de la foi et de la raison, mais sur l’exemple qu’il a choisi pour illustrer son propos. L’exemple choisi pour illustrer le propos, à savoir la citation d’un dialogue entre l’empereur byzantin chrétien Manuel II et un interlocuteur persan musulman en 1391, voulait dénoncer la violence que peut générer (...) une religion, en l’occurrence l’islam, qui ne se conforme pas à la raison. Malheureusement la polémique qui a éclaté au sujet de l’exemple a occulté le contenu du discours. Dans le débat, on n’a pas suffisamment pris en compte les éléments de contextualité ni de genre littéraire. Cette controverse révèle que le pape Benoît XVI privilégie un genre littéraire dans son ministère d’enseignement, qui est la conférence académique. Les exégètes de la parole pontificale doivent prendre en compte ce fait nouveau. (shrink)

This book provides an innovative way to revisit the depth and scope of our moral/post-moral worldviews, while undertaking an ontic reflection about organizational life. The ontic dimension of life refers to existing entities’ lived experiences. It has nothing to do with psychological and relational processes. The ontic level of analysis mirrors a philosophical outlook on organizational life. Unlike moral worldviews, post-moral worldviews oppose the existence of Truth-itself. Post-moral worldviews rather imply that dialogical relationships allow people to express their own truth-claims (...) and welcome others’ truth-claims. The purpose of this book is to explain the philosophical implications of moral and post-moral worldviews and the way to move from a moral to a post-moral worldview. Moreover, this book explores the possibility to transcend the moral/post-moral dualism, through moral deliberation processes and a reinterpretation of the Presence of the Infinite in all dimensions of human life. This biography of Jacques Derrida tells the story of a Jewish boy from Algiers, excluded from school at the age of twelve, who went on to become the most widely translated French philosopher in the world – a vulnerable, tormented man who, throughout his life, continued to see himself as unwelcome in the French university system. He is also the first person to make use of the huge personal archive built up by Derrida throughout his life and of his extensive correspondence. Although many small businesses and a great number of large enterprises have environmental policies, the contents of such policies vary widely according to their emphases either on technical rationality and technocentrism/technocracy or on ecological rationality and ecocentrism/ecocracy. I present them in four categories: with regard to strong anthropocentrism, (1) the neo-technocratic enterprise and (2) the techno-environmentalist enterprise; and with regard to weak anthropocentrism, (3) the pseudo-environmentalist enterprise and (4) the quasi-environmentalist enterprise. Such a typology can be useful for business managers (...) to write and/or review their environmental policies. Cette vision heracliteenne de la totalite s'est estompee, transformee qu'elle fut deja des les premiers siecles de notre ere dans sa postulation religieuse, puis dans la modernite, et s'est perdue dans un monde ou, science et technique prenant leur envol, l'homme avait comme horizon de " devenir comme maitre et possesseur de la (...) Nature ". It is commonly thought that authors can make anything whatsoever true in their fictions by artistic fiat. Harry Deutsch originally called this position the Principle of Poetic License. If true, PPL sets an important constraint on accounts of fictional truth: they must be such as to allow that, for any x, one can write a story in which it is true that x. I argue that PPL is far too strong: it requires us to abandon the law of non-contradiction and (...) entails a radical revision of otherwise ordinary commitments about truth in fiction. (shrink)

This book’s basic argument is that the Freudian unconscious, far from constituting a radical break with the philosophy of consciousness, is merely the latest exemplar in a heritage of philosophical misunderstanding of the Cartesian cogito that interprets “I think, therefore I am” as “I represent myself, therefore I am” (in the classic interpretation of Heidegger, one of the targets of the book).

Having served for a long time under Ostrogothic kings, then removed from office, Cassiodorus (vith century) designed his writings for the members of the famous monastery that he founded at Vivarium. In his monumental Expositio Psalmorum, meant for the novices, he wanted to give his readers not only an exegesis of the biblical text, but rudiments of Liberal Arts too, especially of dialectics and logic. This paper intends to show Cassiodorus’ conception of an orthodox study of dialectics, and his pedagogical (...) devices. Then is considered the way in which Cassiodorus applies in his commentary categorical and hypothetical syllogistics. Finally, special attention is given to Cassiodorus’ rigorous demonstration about the famous Three Chapters controversy. In the dialectical passages of the Expositio appears the artificial cha­racter of this attempt to reconcile secular culture and biblical exegesis. The best in Cassiodo­rus’ enterprise is his enthusiasm. (shrink)

Depuis Droit, mythe et raison (1980) écrit avec Jacques Lenoble jusqu’aux récents À quoi sert le droit? Usages, fonctions et finalités (2016) ou Le droit, objet de passions (2018), François Ost ne cesse de questionner les rapports de nos sociétés au droit et la place de celui-ci dans nos sociétés contemporaines. Avec Le droit malgré tout, il s’agit de rendre hommage à l’œuvre et à la carrière d’une figure centrale de la théorie du droit contemporaine et aussi au fondateur, avec (...) le regretté Michel van de Kerchove, de ce que l’on appelle parfois « l’école de Saint-Louis ». Abordant les deux pôles de la dialectique à laquelle François Ost est si attaché - la critique et la reconstruction -, l’ouvrage propose un regard interdisciplinaire sur le droit, à travers les principaux thèmes qui ont nourri la pensée de l’auteur. Du statut épistémologique de la science du droit à un questionnement sur les fondements et l’avenir du droit et de la justice, des liens qu’entretiennent le droit et la littérature jusqu’à l’environnement saisi par le droit en passant par les « communs », les approches de ses collègues et amis sont toutes réflexives et critiques. En ce qu’elles sont soucieuses de soumettre le droit au regard des sciences sociales et, inversement, les normativités extra-juridiques au regard du droit, elles sont fidèles à la démarche de François Ost. Ce Liber Amicorum propose aussi un retour réflexif sur son œuvre par l’auteur lui-même, dans un entretien avec Manuel Atienza.
