We link the corporate governance literature in financial economics to the agency cost perspective of corporate social responsibility to derive theoretical predictions about the relationship between corporate governance and the existence of executive compensation incentives for CSR. We test our predictions using novel executive compensation contract data, and find that firms with more shareholder-friendly corporate governance are more likely to provide compensation to executives linked to firm social performance outcomes. Also, providing executives with direct incentives for CSR is an effective (...) tool to increase firm social performance. The findings provide evidence identifying corporate governance as a determinant of managerial incentives for social performance, and suggest that CSR activities are more likely to be beneficial to shareholders, as opposed to an agency cost. This paper builds on previous work that investigated anticancer drugs as ‘informed materials’, i.e., substances that undergo an informational enrichment that situates them in a dense relational web of qualifications and measurements generated by clinical experiments and clinical trials. The paper analyzes the recent transformation of anticancer drugs from ‘informed’ to ‘informing material’. Briefly put: in the post-genomic era, anti-cancer drugs have become instruments for the production of new biological, pathological, and therapeutic insights into the underlying etiology and evolution of (...) cancer. Genomic platforms characterize individual patients’ tumors based on their mutational landscapes. As part of this new approach, drugs targeting specific mutations transcend informational enrichment to become tools for informing their targets, while also problematizing the very notion of a ‘target’. In other words, they have become tools for the exploration of cancer pathways and mechanisms. While several studies in the philosophy and history of biomedicine have called attention to the heuristic relevance and experimental use of drugs, few have investigated concrete instances of this role of drugs in clinical research. I contrast two roles for environmental philosophers—“applied philosophy” and “practical philosophy”—and show that the strategy of applied philosophy encourages an axiological and monistic approach to theory building. I argue that the mission of applied philosophy, and the monistic theory defended by J. Baird Callicott, in particular, tends to separate philosophers and their problems from real management issues because applied philosophers and moral monists insist that theoretical exploration occurs independent of, and prior to, applications in particular situations. This separation of theory (...) and practice suggests that philosophers are likely to be effective in policy discussions only to the degree that they can offer unquestioned theories that adjudicate real problems. Callicott offers his monistic, ontological approach as universal guidance to environmental activists and decision makers, arguing that ecosystems and communities are moral subjects that can “own” their own inherent value. Callicott’s theory, however, faces a crucial, unanswered theoretical dilemma which illustrates the impossibility of the dual task Callicott has set for his theory—to provide a single, ontological unification of ethics under nonanthropocentric holism and to capture the fine nuances of ethical obligations as experienced in varied communities. I also show that monistic assumptions have led to an unfortunate interpretation ofAldo Leopold’s land ethic and that a pluralist and pragmatist direction is likely to provide a more efficacious and theoretically defensible direction for further study of environmental philosophy in a more practical mode. Background In an increasingly globalized world, legal protocols related to health care that are both effective and culturally sensitive are paramount in providing excellent quality of care as well as protection for physicians tasked with decision making. Here, we analyze the current medicolegal status of brain death diagnosis with regard to end-of-life care in Japan, China, and South Korea from the perspectives of front-line health care workers. Main body Japan has legally wrestled with the concept of brain death for decades. (...) An inability to declare brain death without consent from family coupled with cultural expectations of family involvement in medical care is mirrored in other Confucian-based cultures and may complicate care for patients from these countries when traveling or working overseas. Within Japan, China, and South Korea, medicolegal shortcomings in the diagnosis of brain death act as a great source of stress for physicians and expose them to potential public and legal scorn. Here, we detail the medicolegal status of brain death diagnosis within Japan and compare it to China and South Korea to find common ground and elucidate the impact of legal ambiguity on health care workers. Conclusion The Confucian cultural foundation of multiple Asian countries raises common issues of family involvement with diagnosis and cultural considerations that must be met. Leveraging public education systems may increase awareness of brain death issues and lead to evolving laws that clarify such end-of-life issues while protecting physicians from sociocultural backlash. According to a widely credited model in the business ethics literature, ethical decisions are a function of two kinds of factors, personal(individual) and situational, and these factors interact with each other. According to a contrary view of decision making that is widely held in some areas of business research, individuals’ decisions about ethical issues (and subsequent actions) are purely a function of their self-interest.The laboratory experiment reported in this paper provides a test of the person-situation interactionist model, using the general (...) theoretical and experimental framework used in the experimental economics literature. One individual and two situational factors relating to moral intensity were examined which may influence decisions to misrepresent information in the course of business activities.The individual and one situational variable were significantly related to participants’ actions. The interactions among individual andsituation variables were not individually significant, although the model including interactions had a much higher level of statistical significance. Gender was significant, both directly and in interaction with moral development, suggesting that it may be worthy of further examination. (shrink)

Traditional historical scholarship struggles to keep up with the rapid pace of modern scientific publication trends. Even focusing on a particular scientific field, the rate of new publications far outpaces even the most studious historian’s research capacity. This essay summarizes an approach to this problem that uses computational techniques of network analysis. As a complement to close analysis of particular documents, network analysis can give a large-scale perspective on the history of science, identifying relational patterns across a vast number of (...) documents that might otherwise require an entire career to digest. To demonstrate the power of the approach, the essay applies network theory to a corpus of publications in evolutionary medicine. Four distinct networks, including those focused on authors, keywords, and citations, quickly unearth a range of relevant historical information. The essay illustrates how interpretable historical conclusions are drawn from a variety of quantitative metrics. The aim is to provide an overview of network techniques for historians looking to add robust network analysis to their research repertoire. (shrink)

Philosophers have paid little attention to the distinction between conservation and preservation, apparently because they have accepted John Passmore’s suggestion that conservationism is an expression of anthropocentric motives and that “true” preservationism is an expression of nonanthropocentric motives. Philosophers have therefore concentrated their efforts on this distinction in motives. This reduction,however, is insensitive to important nuances of environmentalist objectives: there are a wide variety of human reasons for preserving natural ecosystems and wild species. Preservationist policies represent a concem to protect (...) biological diversity from the simplifying effects of human management and are motivated by the full range of values (consumptive, aesthetic, scientific, and moral) attached to a diverse biota.Conservationists and preservationists differ mainly in their emphasis on resilience measures versus predictability measures of stability, respectively. The distinction between anthropocentric and nonanthropocentric motives loses importance as emphasis is placed on the longest term values humans place on the proteetion of biological diversity. Renewed worries about the unity of the proposition have been taken as a crucial stumbling block for any traditional conception of propositions. These worries are often framed in terms of how entities independent of mind and language can have truth conditions: why is the proposition that Desdemona loves Cassio true if and only if she loves him? I argue that the best understanding of these worries shows that they should be solved by our theory of truth and not our theory (...) of content. Specifically, I propose a version of the redundancy theory according to which ‘it is true that Desdemona loves Cassio’ expresses the same proposition as ‘Desdemona loves Cassio’. Surprisingly, this variant of the redundancy theory treats ‘is true’ as an ordinary predicate of the language, thereby defusing many standard criticisms of the redundancy theory. (shrink)

The human body has been a potent and persistent metaphor for social and political relations throughout human history. For example, different parts of the body have traditionally represented different social functions. We refer to the ‘head of state’ without really recognizing the metaphor, and the heart has been a rich source of ideas about life, imagination and emotions. The heart is the house of the soul and the book of life, and the ‘tables of the heart’ provided an insight into (...) the whole of Nature. The hand also plays an important role in conventional imagination regarding things that are beautiful (handsome) or damaged and incomplete (handicap). We can generalize from these diverse examples to argue that the fluids flowing from the inside of the body to the outside are regarded as socially dangerous and contaminating, because these fluids on the outside of the body directly challenge our sense of order and orderliness. This inside/outside division of the body combines with a wet/dry dichotomy to delineate these risky borders. Although leaking bodies have been a source of ancient metaphors of disorder, the modern world, that sociologists increasingly characterize by its liquidity, is peculiarly fascinated by flow as an image of global flexibility. The more our world is economically and militarily interconnected, the more we fear social fluidity. In political terms, asylum seekers and terrorists are thought not to respect our bodies or our borders; we are especially sensitive to their capacity to disrupt the solidity of sovereignty. In short, metaphors of the human body, even in an age of high technology, continue to shape the social and political imagination, but they are challenged by emerging metaphors of liquidity, that is by liquid modernity. This dissertation is about the sense in which the laws of quantum theory distinguish between the past and the future. I begin with an account of what it means for quantum theory to make such a distinction, by providing a novel derivation of the meaning of "time reversal." I then show that if Galilei invariant quantum theory does distinguish a preferred direction in time, then this has consequences for the ontology of the theory. In particular, it requires matter to admit (...) "internal" degrees of freedom, in that the position observable generates a maximal abelian algebra. I proceed to show that this is not a purely quantum phenomenon, but can be expressed in classical mechanics as well. I then illustrate three routes for generating quantum systems that distinguish a preferred temporal direction in this way. (shrink)

Visual comparison is a key process in everyday learning and reasoning. Recent research has discovered the spatial alignment principle, based on the broader framework of structure‐mapping theory in comparison. According to the spatial alignment principle, visual comparison is more efficient when the figures being compared are arranged in direct placement—that is, juxtaposed with parallel structural axes. In this placement, (1) the intended relational correspondences are readily apparent, and (2) the influence of potential competing correspondences is minimized. There is evidence for (...) the spatial alignment principle in adults’ visual comparison (Matlen et al., 2020). Here, we test whether it holds for children. Six‐ and eight‐year‐old children performed a same‐different task over visual pairs. The results indicated that direct placement led to faster and more accurate comparison, both for concrete same‐different matches (matches of both objects and relations) and for purely relational matches—evidence that the same structural alignment process holds for visual comparison in 6‐ and 8‐year‐olds as in adults. Benjamin Constant's famous lecture comparing ancient and modern liberty can be better understood if it is read alongside a set of unpublished lectures on ancient religion that he delivered one year earlier. Those lectures suggest that Constant's commitment to modern liberty was based in part on his deep anxieties about religious freedom, and that he valued religious freedom because he thought the "religious sentiment" was an important manifestation of a natural human capacity for self-development. In putting religion and self-development at (...) the heart of his vision, he tried to show that modern liberty could have a positive moral or spiritual purpose beyond merely assuring people freedom from interference in the pursuit of their interests. Since 9/11, the possibilities for pluralism and tolerance have been severely tested by a discourse of terrorism and security. The development of an intelligent and cosmopolitan understanding between religious communities in Europe and America has been compromised by a range of legal and political responses to terrorism. While the debate about the berqa has clearly indicated the problems relating to Muslim cultural differences, we argue that legal pluralism and in particular the question of Shari’a tribunals may prove to be a (...) more decisive test of Western multiculturalism. This article examines the many criticisms raised against religious arbitration in domestic affairs and considers the presence of the Shari’a at various levels of society, claiming that the evolution of Sharia-mindedness is compatible both with a faith-based life and with liberal ideals. However, the problem with religious courts lies elsewhere, namely with the fragmentation of social life and the erosion of citizenship. The article concludes by examining the prospects and problems of Turkish entry into the European Union with special reference to the domestic policies of the Justice and Development Party. (shrink)

This paper is an analysis of the relationship of social ethics and bioethics in Roman Catholic theology. The argument of the paper is that the character of both Catholic moral theology and ecclesiology shape the broadly defined interest of the church in bioethics. The paper examines the common elements of social ethics and bioethics in Catholic teaching, describes how ecclesiology shapes Catholic public policy and uses the examples of abortion and health care to illustrate the relationship of Catholic social thought (...) and bioethics. In developing the relationship of these two dimensions of Catholic moral argument the article highlights how the appeal to natural law categories differs in social ethics and bioethics and how the two topics are received differently in the theological community. It also seeks to illustrate how the premises of Catholic social ethics remain central to public positions taken on bioethics. This article provides practitioners’ perspectives on preservation of the Irish web space by the National Library of Ireland. The context of this work is outlined including the history of Ireland’s national library, its role, resources and place in library, archive, cultural and digital preservation networks. The development of the NLI Web Archive is discussed within the wider context of the Library’s mission and digital collecting and preservation policies, as well as international approaches to preserving the web. The article looks at (...) how the NLI has developed its selective web archive over the past decade, and has grown the content and access to it as a way to mitigate against the absence of at-scale solutions. The unusual legal context in Ireland regarding legislative barriers to archiving the Irish web space at scale and the NLI’s work for over a decade to change this situation are discussed as are the significant implications of the current legal situation for data loss and long-term access to Ireland’s contemporary record. Distinctive Irish aspects of digital cultural heritage preserved in the NLI Web Archive collections are highlighted. The opportunities and challenges in developing outreach and access for the Web Archive are considered together with its relationship with the collecting activities of the Library’s Born Digital Pilot Projects. This article will also discuss types of usage and user groups in relation to archived Irish web data. Potential for creative and imaginative uses of Irish web archive collections and data are also considered in relation to the Library’s broader public learning and outreach programmes. (shrink)

This paper takes up the question as to what has primacy within Merleau-Ponty’s existential phenomenology as a way to provide insight into the relation between empirical science and transcendental philosophy within his account of embodiment. Contending that this primacy necessarily pertains to methodology, I show how Kurt Goldstein’s conception of biology provided Merleau-Ponty with a scientific model for approaching human existence holistically in which primacy pertains to the transcendental practice of productive imagination that generates the eidetic organismic Gestalt in terms (...) of which sense is made of empirical facts. Considering the analogous role played by imagination in Merleau-Ponty’s account of perceptual synthesis in the form of what he called projection, I argue that his account of embodiment is, parallel to Goldstein, grounded methodologically on the projection of an organismic Gestalt, and that as a form of operative-intentional praxis projection is the site of primacy in his phenomenology overall. In terms of the relation between natural science and transcendental philosophy in Merleau-Ponty’s account of embodiment, while the theoretical dimension of the latter—the eidetic apriority of the organismic Gestalt—is coupled dialectically with empirical facts on an epistemically coeval basis, these are jointly subordinated to the normative commitments implied by the imaginative projection of that Gestalt. The primacy of the latter is transcendental but in a distinctly practical sense, such that any substantive discrepancy between natural science and Merleau-Pontian phenomenology reflects metaphilosophical, not theoretical, disagreement. Many philosophers have used premises about concepts and rationality to argue that the protagonists in the various Twin Earth thought experiments do not have the concepts that content externalists say they have. This essay argues that this popular internalist argument is flawed in many different ways, and more importantly it cannot be repaired in order to cast doubt on externalism.

nnas' article is the first of three in a "Symposium on Ancient Ethics." She begins with the observation that ancient ethics are "eudaemonist" in form. That is, they assume "that each of us has a vague and unarticulated idea of an overall or final goal in our life," which we label eudaimonia or happiness, "and the task of ethical theory is to give each person a clear, articulated, and correct account of this overall goal and how to achieve it" (p. (...) 241; Annas defends this generalization, which is controversial as applied to Stoic and Epicurean ethics, in her The Morality of Happiness [Oxford, 1993]). Furthermore, whereas modern ethical theories (e.g., those of Kant and Sidgwick) typically distinguish between "moral reasoning" and "prudential reasoning," ancient ethical theories do not. How come? One "widespread" and "traditional" view (pp. 244, 245) is that ancient ethics assimilate morality to prudence: "ethical theory guides the agent from an intuitive, restrictive view of what is in her interests (money, power) to a more expanded and elevated view (the virtues)" (p. 244). This interpretation is sometimes joined with the claim that the Greeks took for granted what Nicholas White terms "fusionism": the view that individual good is not ultimately distinct from social or collective good (p. 245). However, Annas notes, ancient Greek literature provides ample illustration that "fusionism" was not taken for granted. (shrink)

The concept of health is not only a specific criterion for evaluation of water quality delivered by a distribution system but also a suitable paradigm for overall functioning of the hydraulic and structural components of the system. This article views health, despite its complexities, as the only criterion with suitable depth and breadth to allow a holistic assessment of system performance. Although many decisions relating to the planning and design of water distribution systems do implicitly consider human health, engineers and (...) planners seldom explicitly adopt a “health mindset” overall and, thus, miss the richness and possibilities of a health framework for a wider range of system evaluations, considerations, and trade-offs. This article argues why a breakdown in a healthy system will so frequently result in stresses experienced by humans and briefly reviews the concepts of human health and system health and provides specific examples of a significant interaction between the two. Zen Masters of Japan is the second book in a series that traces Zen's profoundly historic journey as it spread eastward from China and Japan, toward the United States.
