Le but de cet ouvrage n'est pas de présenter une généalogie conceptuelle du châtiment ni de brosser un panorama exhaustif des travaux en philosophie, en criminologie ou en droit sur les justifications de la peine. De façon plus modeste, nous avons voulu offrir au public un ensemble de travaux permettant de voir d'un peu plus près nos conceptions modernes de la justice pénale. De l'idée selon laquelle les peines sont infligées pour le propre bien des criminels à celle selon laquelle (...) tout crime mérite d'être réparé par le châtiment, en passant par le caractère préventif des peines, nos conceptions de la légitimité des peines reposent sur un certain nombre de postulats en apparence assez simples et que pour cette raison l'on hésite à remettre en cause : nécessité de l'ordre public, dette du criminel à l'égard de ses victimes et de la société, etc. L'ensemble de ces articles permet de jeter un regard critique sur la justice pénale sans prétendre pour autant vouloir la disqualifier. Ethical concepts are, or purport to be, normative. They make claims on us: they command, oblige, recommend, or guide. Or at least when we invoke them, we make claims on one another; but where does their authority over us - or ours over one another - come from? Christine Korsgaard identifies four accounts of the source of normativity that have been advocated by modern moral philosophers: voluntarism, realism, reflective endorsement, and the appeal to autonomy. She traces their history, showing how (...) each developed in response to the prior one and comparing their early versions with those on the contemporary philosophical scene. Kant's theory that normativity springs from our own autonomy emerges as a synthesis of the other three, and Korsgaard concludes with her own version of the Kantian account. Her discussion is followed by commentary from G. A. Cohen, Raymond Geuss, Thomas Nagel, and Bernard Williams, and a reply by Korsgaard. (shrink)

In her long-awaited Responsibility for Justice, Young discusses our responsibilities to address "structural" injustices in which we among many are implicated, often by virtue of participating in a market, such as buying goods produced in sweatshops, or participating in booming housing markets that leave many homeless.

The essay theorizes the responsibilities moral agents may be said to have in relation to global structural social processes that have unjust consequences. How ought moral agents, whether individual or institutional, conceptualize their responsibilities in relation to global injustice? I propose a model of responsibility from social connection as an interpretation of obligations of justice arising from structural social processes. I use the example of justice in transnational processes of production, distribution and marketing of clothing to illustrate operations of structural (...) social processes that extend widely across regions of the world. The social connection model of responsibility says that all agents who contribute by their actions to the structural processes that produce injustice have responsibilities to work to remedy these injustices. I distinguish this model from a more standard model of responsibility, which I call a liability model. I specify five features of the social connection model of responsibility that distinguish it from the liability model: it does not isolate perpetrators; it judges background conditions of action; it is more forward looking than backward looking; its responsibility is essentially shared; and it can be discharged only through collective action. Essays on a wide range of areas and topics in Asian studies for scholars looking to incorporate Asia into their worldview and teaching. Contributors give contemporary presence to Asian studies through a variety of themes and topics in this multidisciplined and interdisciplinary volume. Although rationing by clinical judgment is controversial, its acceptability partly depends on how it is practiced. In this paper, rationing by clinical judgment is defined in three different circumstances that represent increasingly wider circles of resource pools in which the rationing decision takes place: triage during acute shortage, comparison to other potential patients in a context of limited but not immediately strained resources, and determination of whether expected benefit of an intervention is deemed sufficient to warrant its cost by reference (...) to published population based thresholds. Notions of procedural justice are applied along with an analytical framework of six minimal requisites in order to facilitate fair bedside rationing: (1) a closed system that offers reciprocity, (2) attention to general concerns of justice, (3) respect for individual variations, (4) application of a consistent process, (5) explicitness, and (6) review of decisions. Frank Plumpton Ramsey (1903–30) made seminal contributions to philosophy, mathematics and economics. Whilst he was acknowledged as a genius by his contemporaries, some of his most important ideas were not appreciated until decades later; now better appreciated, they continue to bear an influence upon contemporary philosophy. His historic significance was to usher in a new phase of analytic philosophy, which initially built upon the logical atomist doctrines of Bertrand Russell and Ludwig Wittgenstein, raising their ideas to a new level of (...) sophistication, but ultimately he became their successor rather than remain a mere acolyte. Toril Moi has argued that recent deconstructive challenges to the concept of gender and to the viability of the sex/gender distinction have brought feminist and queer theory to a place of increasing theoretical abstraction. She suggests that we should abandon the category of gender once and for all, because it is founded on a nature–culture distinction and it tends incorrigibly to essentialize women’s lives. Moi argues that feminist and queer theories should replace the concept of gender with a concept of (...) the lived body derived from existential phenomenology. In this essay I take up and develop this suggestion, and argue that there are several advantages that a category of the lived body has over a category of gender for feminist and queer theories: (1) no nature–culture distinction is necessary but the body can be described as historically and socially specific; (2) it is not necessary to break out a gendered and “raced” part of identity with this category; (3) differences of sexual desire can be described without recourse to an “inner core” of identity or “sexual orientation.” I go on to argue, however, that it is important to retain a concept of gender for a theoretical purpose beyond that which Moi and those she criticizes conceive. In recent years feminist and queer theories have tended to conceive their theorizing as restricted to identity and subjectivity. How large scale social structures differentially position people in relations of privilege and disadvantage has been ignored, relatively. This essay argues then that theorizing structural processes and inequalities is crucial, and that a concept of gender is important for such theorizing. I propose three aspects of gendered social structure that are irreducible to one another: (1) a sexual division of labor (2) normative heterosexuality, and (3) hierarchies of power. In each case I illustrate the social theoretical work these categorizations of gendered structure can and should do. (shrink)

Can we maintain that purple seems composed of red and blue without giving up the impenetrability of the red and blue parts that compose it? Brentano thinks we can. Purple, according to him, is a chessboard of red and blue tiles which, although individually too small to be perceived, are together indistinctly perceived within the purple. After a presentation of Brentano’s solution, we raise two objections to it. First, Brentano’s solution commits him to unperceivable intentional objects (the chessboard’s tiles). Second, (...) his chessboard account fails in the end to explain the phenomenal spatial continuity of compound colours. We then sketch an alternative account, which, while holding fast to the phenomenal compoundedness of the purple and to the impenetrability of component colours, avoids introducing inaccessible intentional objects and compromising on the continuity of the purple. According to our proposal, instead of being indistinctly perceived spatial parts of the purple, red and blue are distinctly perceived non- spatial parts of it. (shrink)

The poor performances of typically developing children younger than 4 in the first-order false-belief task “Maxi and the chocolate” is analyzed from the perspective of conversational pragmatics. An ambiguous question asked by an adult experimenter (perceived as a teacher) can receive different interpretations based on a search for relevance, by which children according to their age attribute different intentions to the questioner, within the limits of their own meta-cognitive knowledge. The adult experimenter tells the child the following story of object-transfer: (...) “Maxi puts his chocolate into the green cupboard before going out to play. In his absence, his mother moves the chocolate from the green cupboard to the blue one.” The child must then predict where Maxi will pick up the chocolate when he returns. To the child, the question from an adult (a knowledgeable person) may seem surprising and can be understood as a question of his own knowledge of the world, rather than on Maxi's mental representations. In our study, without any modification of the initial task, we disambiguate the context of the question by (1) replacing the adult experimenter with a humanoid robot presented as “ignorant” and “slow” but trying to learn and (2) placing the child in the role of a “mentor” (the knowledgeable person). Sixty-two typical children of 3 years-old completed the first-order false belief task “Maxi and the chocolate,” either with a human or with a robot. Results revealed a significantly higher success rate in the robot condition than in the human condition. Thus, young children seem to fail because of the pragmatic difficulty of the first-order task, which causes a difference of interpretation between the young child and the experimenter. (shrink)

Theory of mind competence and knowledge of emotions were studied longitudinally in a sample of preschoolers aged 3 (n=263) and 4 (n=244) years. Children were assessed using standard measures of theory of mind and emotion knowledge. Three competing hypotheses were tested regarding the developmental associations between children's theory of mind abilities and their knowledge of emotions. First, that an understanding of emotion develops early and informs children's understanding of others’ thinking. Alternatively, having a basic theory of mind may help children (...) learn about emotions. Third, that the two domains are separate aspects of children's social cognitive skills such that each area develops independently. Results of hierarchical regressions supported the first hypothesis that early emotion understanding predicts later theory-of-mind performance, and not the reverse. (shrink)

We will discuss a mathematical proof found in Wittgenstein’s Nachlass, a constructive version of Euler’s proof of the infinity of prime numbers. Although it does not amount to much, this proof allows us to see that Wittgenstein had at least some mathematical skills. At the very last, the proof shows that Wittgenstein was concerned with mathematical practice and it also gives further evidence in support of the claim that, after all, he held a constructivist stance, at least during the transitional (...) period of his thought (1929-33). Meet Tega. Blue, fluffy, and AI-enabled, Tega is a relational robot: a robot designed to form relationships with humans. Created to aid in early childhood education, Tega talks with children, plays educational games with them, solves puzzles, and helps in creative activities like making up stories and drawing. Children are drawn to Tega, describing him as a friend, and attributing thoughts and feelings to him ("he's kind," "if you just left him here and nobody came to play with him, he (...) might be sad"). Scholars and members of the public alike have raised the alarm about relational robots, worrying that the relationships that people, and especially children, form with such robots are objectionably inauthentic. We, members of an interdisciplinary team that developed and studies Tega, make this inauthenticity worry precise and offer practical recommendations for addressing it. We distinguish two kinds of (in)authenticity -- inauthenticity as unreality, and inauthenticity as deception -- arguing that neither is just what others have thought it is. With our distinction in hand, we argue that the authenticity concern can be met only through co-design methods -- methods that give stakeholders of all kinds (e.g. parents, educators, and children themselves) a genuine say in how relational robots are built. The commentaries on Evolution in Four Dimensions reflect views ranging from total adherence to gene-centered neo-Darwinism, to the acceptance of non-genetic and Lamarckian processes in evolution. We maintain that genetic, epigenetic, behavioral, and cultural variations have all been significant, and that the developmental aspects of heredity and evolution are an important bridge that can unite seemingly conflicting research programs and different disciplines.

The relation between logic and knowledge has been at the heart of a lively debate since the 1960s. On the one hand, the epistemic approaches based their formal arguments in the mathematics of Brouwer and intuitionistic logic. Following Michael Dummett, they started to call themselves `antirealists'. Others persisted with the formal background of the Frege-Tarski tradition, where Cantorian set theory is linked via model theory to classical logic. Jaakko Hintikka tried to unify both traditions by means of what is now (...) known as `explicit epistemic logic'. Under this view, epistemic contents are introduced into the object language as operators yielding propositions from propositions, rather than as metalogical constraints on the notion of inference. The Realism-Antirealism debate has thus had three players: classical logicians, intuitionists and explicit epistemic logicians. The editors of the present volume believe that in the age of Alternative Logics, where manifold developments in logic happen at a breathtaking pace, this debate should be revisited. Contributors to this volume happily took on this challenge and responded with new approaches to the debate from both the explicit and the implicit epistemic point of view. (shrink)

Young’s essay draws attention to practices of citizenship that can arise under a government at war and explores the logic of the masculine role of protector. A government at war, which Young calls a “security regime,” protects its members in an overly aggressive fashion from external dangers as well as from internal dissension. A state acting as a security regime, however, threatens to undermine democratic practice by expecting uncritical obedience and submissiveness from its population. This role toward its citizens is (...) analogous to the role a protective family patriarch plays toward the women and children of his family. Young argues that, even from a protective government, what adult citizens want instead are relationships that respect their autonomy and equality. (shrink)

We argue that the proper context for understanding Collingwood’s The Principles of Art is his claim that it has bearing “upon the condition of art in England in 1937”. We thus argue that he formulated a philosophical argument that underpins avant-garde dramatic poetry and theatrical practices (Eliot, Auden and the Group Theatre), taking his interpretation of Spinoza’s Ethics 5 prop. 3 to be the book’s central thesis: it is through art that one knows, against the ‘corruption of consciousness’, what emotions (...) one feels and recognizes them as one’s own. Collingwood further believed that this could only be achieved through collaboration between the artist and the community, validating new theatrical practices involving interaction with the audience. We analyse these views in the context of England in 1937: in an era marked by the rise of Fascism and Nazism, Collingwood believed that art thus conceived could help restoring emotional support for the defense of liberal democracies. We conclude with an exploration of parallels with and divergences from the Spinozist idea of ‘mobilizing affects’ in contemporary ‘left populism’ (Mouffe). (shrink)

Objective The establishment of patient-centered measures capable of empirically determining meaningful cognitive change after surgery can significantly improve the medical care of epilepsy patients. Thus, this study aimed to develop reliable change indices (RCIs) and standardized regression-based (SRB) change norms for a comprehensive neuropsychological test battery in the German language. Methods Forty-seven consecutive patients with temporal lobe epilepsy underwent neuropsychological assessments, both before and 12 months after surgery. Practice-effect-adjusted RCIs and SRB change norms for each test score were computed. To (...) assess their usefulness, the presented methods were applied to a clinical sample, and binary logistic regression analyses were conducted to model the odds of achieving improvement in quality of life (QOL) after surgery. Results The determined RCIs at 90% confidence intervals and the SRB equations for each test score included in the test battery are provided. Cohen’s kappa analyses revealed a moderate mean agreement between the two measures, varying from slight to almost perfect agreement across test scores. Using these measures, a negative association between improvement in QOL and decline in verbal memory functions after surgery was detected (adjusted odds ratio = 0.09, p = 0.006). Significance To the best of our knowledge, this study is the first to develop RCIs and SRB change norms necessary for the objective determination of neuropsychological change in a comprehensive test battery in the German language, facilitating the individual monitoring of improvement and decline in each patients’ cognitive functioning and psychosocial situations after epilepsy surgery. The application of the described measures revealed a strong negative association between improvement in QOL and decline in verbal memory functions after surgery. (shrink)

This paper examines some of the philosophical issues underlying disputes about the siting of hazardous industrial facilities. The case the paper focuses on involves the siting of a hazardous waste treatment plant, but many of the same issues and arguments arise in the siting of other potentially dangerous and controversial facilities, such as nuclear power plants. Because the siting of such facilities always poses risks to residents nearby, questions of justice immediately arise in such siting proposals. In the case I (...) examine here, residents of a community proposed as the site of a hazardous waste treatment plant raise the question of decision making structure and community control as a primary question of justice. It is a basic and intuitive assumption that the relation of moral preference must be transitive—if A is overall morally preferable to B; and B is overall morally preferably to C; then, if our views are coherent, it better be the case that A is overall morally preferable to C. However, recent work by Temkin and Rachels has undermined that assumption by showing that common-sense ethical distributive principles that we are unlikely to give up generate intransitive sets of moral preferences. (...) The consequences of this for resource allocation are profound—how can we come up with a just way of rationing limited resources if whatever course of action we adopt, there will be other alternatives that are morally preferable to it? However, regardless of the theoretical challenges, practical resource allocation decisions must be made every day! We explore an approach to dealing with some of the pragmatic aspects of the problem, even though the theoretical problem of intransitivity remains unsolved. We begin by considering whether the ways in which counterexamples to transitivity have (of necessity) been oversimplified actually contribute to the intractability of the problem by taking the possibilities of cost sharing, benefit splitting, and compensation (which are often available in real-life tradeoff situations) off the table. The proposal we end up suggesting does not rely on any assumptions or judgments about interpersonal aggregation, and so has a chance of allowing us to work around the most troubling kind of intransitivity. Ranging from miniaturized biological robots to organoids, multi-cellular engineered living systems (M-CELS) pose complex ethical and societal challenges. Some of these challenges, such as how to best distribute risks and benefits, are likely to arise in the development of any new technology. Other challenges arise specifically because of the particular characteristics of M-CELS. For example, as an engineered living system becomes increasingly complex, it may provoke societal debate about its moral considerability, perhaps necessitating protection from harm or recognition of positive (...) moral and legal rights, particularly if derived from cells of human origin. The use of emergence-based principles in M-CELS development may also create unique challenges, making the technology difficult to fully control or predict in the laboratory as well as in applied medical or environmental settings. In response to these challenges, we argue that the M-CELS community has an obligation to systematically address the ethical and societal aspects of research and to seek input from and accountability to a broad range of stakeholders and publics. As a newly developing field, M-CELS has a significant opportunity to integrate ethically responsible norms and standards into its research and development practices from the start. With the aim of seizing this opportunity, we identify two general kinds of salient ethical issues arising from M-CELS research, and then present a set of commitments to and strategies for addressing these issues. If adopted, these commitments and strategies would help define M-CELS as not only an innovative field, but also as a model for responsible research and engineering. (shrink)

Die aus der Kulturphilosophie, Kunst- und Bildwissenschaft, Theologie, Medizin, Psychiatrie, Psychologie und Kognitionswissenschaft stammenden Beitrage des Bandes vereint jedoch das gemeinsame Ziel, einen umfassenden Begriff von Verkorperung zu entwickeln, der die Grenzziehung zwischen kulturalistischen und naturalistischen Ansatzen uberwindet.".

We investigate the relationship between three-valued Kripke/Kleene semantics and stratified semantics for stratifiable logic programs. We first show these are compatible, in the sense that if the three-valued semantics assigns a classical truth value, the stratified approach will assign the same value. Next, the familiar fixed point semantics for pure Horn clause programs gives both smallest and biggest fixed points fundamental roles. We show how to extend this idea to the family of stratifiable logic programs, producing a semantics we call (...) weak stratified. Finally, we show weak stratified semantics coincides exactly with the three-valued approach on stratifiable programs, though the three-valued version is generally applicable, and does not require stratification assumptions. This volume is a collation of original contributions from the key actors of a new trend in the contemporary theory of knowledge and belief, that we call “dynamic epistemology”. It brings the works of these researchers under a single umbrella by highlighting the coherence of their current themes, and by establishing connections between topics that, up until now, have been investigated independently. It also illustrates how the new analytical toolbox unveils questions about the theory of knowledge, belief, preference, action, and (...) rationality, in a number of central axes in dynamic epistemology: temporal, social, probabilistic and even deontic dynamics. The attitude of biologists to the history of their discipline varies. For some, a hazy knowledge of the recent past is all that is necessary to provide an explanatory basis for their work. They take it for granted that everything of value from the less recent past has been appropriately incorporated into present-day thinking. Other biologists see history as an integral part of their research: the historical roots of accepted facts and theories help in the evaluation of present positions. These (...) biologists bring to history their specialized knowledge, which can be an advantage, but often they also bring an agenda that biases what they investigate and how they present it. We illustrate this by describing our own foray into history, which was motivated by findings in cell biology that suggested that some accepted views about heredity and evolution were wrong. (shrink)

Masterson, Marian Tolpin, and Peter E. Sifneos compare and contrast developmental, self, and object relations.

Friedrich Waismann (1896–1959) was one of the most gifted students and collaborators of Moritz Schlick. Accepted as a discussion partner by Wittgenstein from 1927 on, he functioned as spokesman for the latter’s ideas in the Schlick Circle, until Wittgenstein’s contact with this most faithful interpreter was broken off in 1935 and not renewed when exile took Waismann to Cambridge. Nonetheless, at Oxford, where he went in 1939, and eventually became Reader in Philosophy of Mathematics (changing later to Philosophy of Science), (...) Waismann made important and independent contributions to analytic philosophy and philosophy of science (for example in relation to probability, causality and linguistic analysis). The full extent of these only became evident later when the larger (unpublished) part of his writings could be studied. His first posthumous work The Principles of Linguistic Philosophy (1965, 2nd edn.1997; German 1976) and his earlier Einführung in das mathematische Denken (1936) have recently proved of fresh interest to the scientific community. This late flowering and new understanding of Waismann’s position is connected with the fact that he somewhat unfairly fell under the shadow of Wittgenstein, his mentor and predecessor. Central to this book about a life and work familiar to few is unpublished and unknown works on causality and probability. These are commented on in this volume, which will also include a publication of new or previously scattered material and an overview of Waismann’s life. (shrink)
