Traditional arguments for privacy in public suggest that intentionally public activities, such as political speech, do not deserve privacy protection. In this article, I develop a new argument for the view that surveillance of intentionally public activities should be limited to protect the specific good that this context provides, namely democratic legitimacy. Combining insights from Helen Nissenbaum’s contextualism and Jürgen Habermas’s theory of the public sphere, I argue that strategic surveillance of the public sphere can undermine the capacity of citizens (...) to freely deliberate in public and therefore conflicts with democratic self-determination. Dieser Schnitt erscheint aus der Perspektive des durch Hegel entfalteten Prinzips des Aufsteigens vom Abstrakten zum Konkreten gleichsam als ‚erledigt’. Eine solche Perspektive verdeckt jedoch den vollzogenen qualitativen Umbruch. This study investigates the ethical use of Big Data and Artificial Intelligence (AI) technologies (BD + AI)—using an empirical approach. The paper categorises the current literature and presents a multi-case study of 'on-the-ground' ethical issues that uses qualitative tools to analyse findings from ten targeted case-studies from a range of domains. The analysis coalesces identified singular ethical issues, (from the literature), into clusters to offer a comparison with the proposed classification in the literature. The results show that despite the variety (...) of different social domains, fields, and applications of AI, there is overlap and correlation between the organisations’ ethical concerns. This more detailed understanding of ethics in AI + BD is required to ensure that the multitude of suggested ways of addressing them can be targeted and succeed in mitigating the pertinent ethical issues that are often discussed in the literature. Recent disclosures suggest that many governments apply indiscriminate mass surveillance technologies that allow them to capture and store a massive amount of communications data belonging to citizens and non-citizens alike. This article argues that traditional liberal critiques of government surveillance that center on an individual right to privacy cannot completely capture the harm that is caused by such surveillance because they ignore its distinctive political dimension. As a complement to standard liberal approaches to privacy, the article develops a critique of (...) surveillance that focuses on the question of political power in the public sphere. (shrink)

According to Jürgen Habermas, his Theory of Communicative Action offers a new account of the normative foundations of critical theory. Habermas’ motivating insight is that neither a transcendental nor a metaphysical solution to the problem of normativity, nor a merely hermeneutic reconstruction of historically given norms, is sufficient to clarify the normative foundations of critical theory. In response to this insight, Habermas develops a novel account of normativity, which locates the normative demands of critical theory within the socially instituted practice (...) of communicative understanding. Although Habermas has claimed otherwise, this new foundation for critical theory constitutes a novel and innovative form of “immanent critique.” To argue for and to clarify this claim, I offer, in section 1, a formal account of immanent critique and distinguish between two different ways of carrying out such a critique. Critical theories often express scepticism towards the idea that social critique should draw on general normative principles, seeing such principles as bound to dominant conceptual frameworks. However, even the models of immanent critique developed in the Frankfurt School tradition seem to privilege principles over particular moral experiences. Discussing the place that particular moral experience has in the models of Honneth, Ferrara and Adorno, the article argues that experience can play an important negative role even for a critical theory that is (...) committed to the necessity of conceptual mediation, as moral experiences can undermine our confidence in the appropriateness of our moral concepts. Building on McDowell’s account of moral perception and Brandom’s interpretation of Hegel’s theory of experience, one can reconstruct Adorno as providing a “radically negativist” approach to immanent critique that takes particular moral experience seriously. When we criticize social institutions and practices, what kinds of reasons can we offer for such criticism? Political philosophers often assume that we must rely on universal moral principles that are not necessarily connected to the particular social practices of our communities. Traditionally,continental critical theory has rejected this claim through its endorsement of the method of immanent critique. Immanent critique is a critique of social practices that draws on norms already present within these practices to demand social change, rather than (...) merely conservatively reproducing them. This book defends the claim that such a critique is not only possible, but also has politically powerful potential. Taking up recent developments in analytic collective intentionality theory and in the philosophy of language, the book argues that all social practices rest on structures of mutual recognition between persons that allow social theorists to reconstruct hidden norms present within these practices. Starting from a comprehensive critique of contemporary critical theory, the book also spells out the consequences of this line of thought for the practice of social critique, for the social sciences and for political philosophy. This article offers reinterpretation of the current economic and political crisis through the lens of Gramsci’s concept of “interregnum,” departing from the model of “punctured equilibrium” to analyze the specific political dynamics of nonhegemonic periods between the breakdown of one ideological order and the emergence of a new one. Although political science has a range theories about periods of hegemony and paradigmatic stability, the periods between stable hegemonies remain distinctly undertheorized. A theoretical concept describing periods of interregnum is offered and (...) applied to the changes in economic ideology and political alignments that followed the breakdown of the liberal order in the interwar period and the postwar Keynesian consensus of the 1970s. The concept is then applied to the current juncture, in which the hegemony of neoliberalism has been shaken by the 2008 financial crisis but no clear successor has emerged. (shrink)

This paper discusses recent evidence that violations of core knowledge offer special learning opportunities for infants and young children. Children make predictions about the world from the youngest ages. When their fail to match observed data, they show an enhanced drive to seek and retain new information about entities that violated their expectations. Finally, the authors draw comparisons between children and adults, and with other species, to explore how surprise shapes thought more broadly.

Many contemporary forms of oppression are not primarily the result of formally organized collective action nor are they an unintended outcome of a combination of individual actions. This raises the question of collective responsibility. I argue that we can only determine who is responsible for oppression if we understand oppression as a matter of social practices that create obstacles for social change. This social practice view of oppression enables two insights: First, that there is an unproblematic sense in which groups (...) can bear irreducible collective responsibility for oppression. Deep brain stimulation (DBS), a surgical procedure involving the implantation of electrodes in the brain, has rekindled the medical community’s interest in psychosurgery. Whereas many researchers argue DBS is substantially different from psychosurgery, we argue psychiatric DBS—though a much more precise and refined treatment than its predecessors—is nevertheless a form of psychosurgery, which raises both old and new ethical and legal concerns that have not been given proper attention. Learning from the ethical and regulatory failures of older forms of psychosurgery (...) can help shed light on how to address the regulatory gaps that exist currently in DBS research. To show why it is important to address the current regulatory gaps within psychiatric DBS, we draw on the motivations underlying the regulation of earlier forms of psychosurgery in the US. We begin by providing a brief history of psychosurgery and electrical brain stimulation in the US. Against this backdrop, we introduce psychiatric DBS, exploring current research and ongoing clinical trials. We then draw out the ethical and regulatory similarities between earlier forms of psychosurgery and psychiatric DBS. As we will show, the factors that motivated strict regulation of earlier psychosurgical procedures mirror concerns with psychiatric DBS today. We offer three recommendations for psychiatric DBS regulation, which echo earlier motivations for regulating psychosurgery, along with new considerations that reflect the novel technologies used in DBS. Although the critique of reification is a core commitment of critical theories, there is no widely accepted account of its normative foundation. In Lukács’s original analysis, this foundation is provided by a strong concept of practice which is, however, not acceptable from a contemporary point of view. I argue that the systematic character of reification theory can only be upheld if this concept is replaced by a more intersubjective notion of normative practices. Reification can then be analysed as a second-order (...) pathology of social practices, as an inhibition of reflexivity by their normative shape. The normative justification of such critique, however, turns out to be more context-dependent than it is usually imagined. (shrink)

This working paper examines the notion of "immanent critique", a central methodological commitment of critical theories of society. In the first part, I distinguish immanent critique - a critique which reconstructs norms immanent in a social practice which point beyond the normative self-understanding of its members - from both external and internal critique and examine three questions that a theory of immanent critique has to answer (a social ontological, an epistemological and a justificatory question). After surveying some of the classic (...) accounts of immanent critique in part two, I then distinguish two varieties of immanent critique, a hermeneutic and a practice-theoretic approach. Drawing on theories in recent analytic philosophy, I finally argue for a practice-theoretic approach to immanent critique that locates the relevant norms in a practice constituted by mutual recognition. The increasing use of information and communication technologies (ICT) to help facilitate neuroscience adds a new level of complexity to the question of how ethical issues of such research can be identified and addressed. Current research ethics practice, based on ethics reviews by institutional review boards (IRB) and underpinned by ethical principalism, has been widely criticised and even called ‘imperialist’. In this paper, we develop an alternative way of approaching ethics in neuro-ICT research, based on discourse ethics, which implements responsible (...) research and innovation through dialogues. There has been much debate whether computers can be responsible. This question is usually discussed in terms of personhood and personal characteristics, which a computer may or may not possess. If a computer fulfils the conditions required for agency or personhood, then it can be responsible; otherwise not. This paper suggests a different approach. An analysis of the concept of responsibility shows that it is a social construct of ascription which is only viable in certain social contexts and which serves (...) particular social aims. If this is the main aspect of responsibility then the question whether computers can be responsible no longer hinges on the difficult problem of agency but on the possibly simpler question whether responsibility ascriptions to computers can fulfil social goals. The suggested solution to the question whether computers can be subjects of responsibility is the introduction of a new concept, called “quasi-responsibility” which will emphasise the social aim of responsibility ascription and which can be applied to computers. Arthur C. Clarke once wrote that "any sufficiently advanced technology is indistinguish able from magic. " The language of magic is evident in much of popular discourse about computers. A content analysis of Time magazine reporting on computers and related technologies over a ten-year period revealed that 36 percent of all these stories used explicitly magical or religious language. Together with a qualitative analysis of implic itly magical themes, the patterns in Time's reporting reveal how magic language was used as (...) one strategy to stabilize and close the technological frame of personal computers in the mid-1980s. The role of power in healthcare can raise many ethical challenges. Power is ownership, whether given, ceded, or taken of another person’s autonomy. When a person has power over someone else, they can control or strongly influence the decision-making freedom of that person. From the principalist perspective1,2 of healthcare ethics, denying a person their freedom to choose, should only occur when justifying conditions related to beneficence and nonmaleficence are sufficiently satisfied. In healthcare, it is rare to be able to identify (...) situations where paternalism is justified. Der Konstruktionsbegriff erfuhr er unter dem Eindruck technischer Fortschritte wie soziokultureller Veränderungen vor allem im 19. Jahrhundert wesentliche Wandlungen. Mit dessen selbstverständlich erscheinender Nutzung ergibt sich die Frage nach seinem Bedeutungsfeld: Ist Konstruieren ein Prozess, der sich auf das Entwerfen, die Präsentation der äußerlichen Gestalt des zu erzeugenden Gegenstandes konzentriert oder sind in ihm wesentlich mehr Aspekte impliziert? Im 17./18. Jahrhundert war Konstruktion verbunden mit dem Maschinenbegriff und vom Anspruch getragen, das geschlossene Ganze der Maschine als Objekt zu erfassen. Im (...) Unterschied dazu wurde namentlich in der klassischen deutschen Philosophie der Konstruktionsgedanke in ganz anderer Weise ausgebildet. Insbesondere Fichte vollzog einen Paradigmawechsel, indem er die Konstruktion zur universellen Fähigkeit der Begriffsbildung erhob. Wissen galt ihm als ideale "Nachkonstruktion" des Seins unter der Form des Wissens. Es verbindet sich damit der Wechsel vom ordnenden zu einem entwerfenden Weltverhältnis. Das Wissen erscheint nun als ein Werdendes. Im Herausarbeiten der theoretischen-begrifflichen Fassung des Wesens eines Gegenstandes manifestiert sich der entwerfende, tätige Charakter des Subjektes. Der Artikel verfolgt zum einen Aspekte der philosophischen und zum anderen der technischen Entwicklung. The concept of construction underwent significant changes under the influence of technical advances and socio-cultural changes, especially in the 19th century. With its seemingly obvious use, the question of its field of meaning arises: Is construction a process that focuses on design, the presentation of the external shape of the object to be produced, or are significantly more aspects implied in it? In the 17th/18th In the 19th century, construction was associated with the concept of machine and supported by the claim to grasp the closed whole of the machine as an object. In contrast to this, the idea of ​​construction was developed in a completely different way, especially in classical German philosophy. Fichte in particular carried out a paradigm shift by elevating construction to the universal ability of concept formation. Knowledge was for him the ideal "reconstruction" of being under the form of knowledge. This is linked to the change from an ordering to a designing world relationship. Knowledge now appears as something in the making. The drafting, active character of the subject manifests itself in the working out of the theoretical-conceptual version of the essence of an object. It is sometimes argued that ideal theories in political philosophy are a form of ideology. This article examines arguments building on the work of Charles Mills and Raymond Geuss for the claim that ideal theories are cognitively distorting belief systems that have the effect of stabilizing unjust social arrangements. I argue that Mills and Geuss neither succeed in establishing that the content of ideal theories is necessarily cognitively defective in the way characteristic for ideologies, nor can they make plausible which (...) mechanisms ensure the alleged negative effects of the widespread acceptance of ideal theorizing. This does not mean that all hope is lost for the ideology objection, however. By turning to a second Marxian model of ideology, I argue that the ideological character of ideal theories is not so much a matter of their content, but rather of their form. Ideal theories falsely present the normative concepts that they use as semantically practice-independent and thereby block potential challenges from subordinate groups to dominant ideologies. It is therefore not the normative content of ideal theories which proves to be objectionable, but the particular role their concepts play in wider political discourse. (shrink)

An increase in the number of companies that publish corporate social responsibility (CSR) statements, and a rise in their ‘sustainability’ research, reflects a growing acceptance that broad ethical considerations are key for any type of company. However, little is known about how companies consider moral objectives for their research and development (R&D) activities, or the basis upon which these activities are chosen. This research involves qualitative investigation into Responsible Research and Innovation (RRI) in the Information and Communication Technology (ICT) industry, (...) comprising 30 in-depth, pan-European interviews with key personnel in the industry, and focus groups with employees at 14 different companies. Through investigation of the ‘responsible’ activities these companies currently undertake, we shed light on the types of moral goals they set and their underlying ethical standpoints. By reviewing both the responsible innovation and sustainability discourses, and presenting phenomenological evidence, we demonstrate that companies have adopted some aspects of RRI, even though it might not be recognised as such. Our findings indicate that these innovators recognise some of the ethical and societal concerns associated with their activities but their approach is often piecemeal; primary focus is upon the most immediate issues and on legal compliance, to the detriment of broader societal issues and wider challenges. We recommend explicit mechanisms that draw upon established ethical thought and practical academic work to improve companies' abilities to carry out their sustainability activities, and incorporate them into a responsible business strategy. We conclude with recommendations for innovators, corporate research and development, and policy. (shrink)

Если Платон несомненно указывает на историческое происхождение диэрезис, то у Фихте нет прямого указания на его концептуальную дифференциацию. Таким образом, в эссе исследуется, какие современные научные и философские проблемы привели к возобновлению и новому формированию диэрезиса. Далее показано, как Фихте развил диэрезис в особый трансцендентально-философский метод и таким образом обозначил решающий поворот в философии. Разнообразные методологические и гносеологические размышления о понимании единства и многообразия явлений природы и (...) истории составляют современный фон для разработки Фихте нового аналитико-синтетического метода: взятия за основу основной формы, которая сама по себе содержит возможность дифференцированного образования философское развитие понятия становится прослеживаемым в его генезисе. Таким образом, концепция Фихте превосходит современные таксономические подходы и их пространственно-статическую наслоенность терминов. То же самое относится и к подходам, формирующим гибридизацию с их латентной темпорализацией цепи понятий. В противоположность этому концепция Фихте образует разрыв в мышлении о цепи видов, поскольку мысль об опосредовании видов (понятий) между собой становится идеей, направляющей познание. In the development of his analytical-synthetic method Fichte sought recourse to diaeresis, which reflects back methodically to Plato. While Plato indisputably provides the historical origin of diaeresis, very little is given as a direct reference for Fichte’s decision of terms. Therefore, the essay examines which contemporary scientific and philosophical problems led to the reference point for the resumption and reformation of diaeresis. It also shows how Fichte developed the diaeresis into a special transcendental philosophical method as well as tracking how it marks a turning point in philosophy. The multifaceted methodological and epistemological considerations for formulating the unity and diversity of appearances in nature and history form the contemporary background for Fichte’s development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception transcends the contemporary taxonomic approaches and their spatially-static stratification of concepts. The same applies to the approaches that shape hybridization with their latent temporalization of the conceptual chain. It forms a rupture in thinking related to the linking of species, in that the idea of the mediation of the species (of concepts) among themselves becomes the idea guiding the knowledge. Genetic reconstruction follows the path of the transformation of the absolute I and thus the subject involved in these changes in the process of cognition as a kind of ›unwrapping‹ into other modes of appearance up to ›reality‹ as a representational existence. Ethical issues of information and communication technologies (ICTs) are important because they can have significant effects on human liberty, happiness, their ability to lead a good life. They are also of functional interest because they can determine whether technologies are used and whether their positive potential can unfold. For these reasons policy makers are interested in finding out what these issues are and how they can be addressed. The best way of creating ICT policy that is sensitive to ethical issues (...) would be to be proactive and address such issues at early stages of the technology life cycle. The present paper uses this position as a starting point and discusses how knowledge of ethical aspects of emerging ICTs can be gained. It develops a methodology that goes beyond established futures methodologies to cater for the difficult nature of ethical issues. The paper goes on to outline some of the preliminary findings of a European research project that has applied this method. (shrink)

The work of the Hungarian Marxist Georg Lukács is a constant source of controversy in the history of the Frankfurt School. All leading thinkers of that theoretical tradition have struggled with Lukács’s theory. On the one hand, it was an inspiration for their attempts to come to terms with the oppressive features of capitalist modernity. On the other hand, both its political conclusions and Lukács’s actual philosophical submission to Soviet orthodoxy seemed to show that his theoretical framework was deeply flawed (...) in one aspect or another. Hegels Werk ist durchzogen von "falschen" oder irrtumlichen Vorstellungen, die sich Subjekte und Kollektive von Freiheit machen konnen, so dass man sagen kann, Hegel habe mehr Zeit und Muhe in die Kritik zu kurz greifender Freiheitsbegriffe als auf die Ausarbeitung eines positiven Begriffs moderner Freiheit verwandt. Dies nicht (...) einfach nur deshalb, weil Kritik eine wesentliche Aufgabe der Arbeit des Negativen und damit des Begriffs darstellt, sondern weil diese Irrtumer auch wesentliche Momente der modernen Idee der Freiheit sind.
