Questions concerning the epistemological status of computer science are, in this paper, answered from the point of view of the formal verification framework. State space reduction techniques adopted to simplify computational models in model checking are analysed in terms of Aristotelian abstractions and Galilean idealizations characterizing the inquiry of empirical systems. Methodological considerations drawn here are employed to argue in favour of the scientific understanding of computer science as a discipline. Specifically, reduced models gained by Dataion are acknowledged as Aristotelian (...) abstractions that include only data which are sufficient to examine the interested executions. The present study highlights how the need to maximize incompatible properties is at the basis of both Abstraction Refinement, the process of generating a cascade of computational models to achieve a balance between simplicity and informativeness, and the Multiple Model Idealization approach in biology. Finally, fairness constraints, imposed to computational models to allow fair behaviours only, are defined as ceteris paribus conditions under which temporal formulas, formalizing software requirements, acquire the status of law-like statements about the software systems executions. This research aims to examine access to medical treatment during the COVID-19 pandemic for people living with disabilities. During the COVID-19 pandemic, the practical and ethical problems of allocating limited medical resources such as intensive care unit beds and ventilators became critical. Although different countries have proposed different guidelines to manage this emergency, these proposed criteria do not sufficiently consider people living with disabilities. People living with disabilities are therefore at a higher risk of exclusion from medical treatments as physicians (...) tend to assume they have poor quality of life, whereas access to medical treatment should be based on several parameters, including clinical data and prognosis. However, the COVID-19 pandemic shifts the medical paradigm from person-centred medicine to community-centred medicine, challenging the main ethical theories. We reviewed the main guidelines and recommendations for resources allocation and examined their position toward persons with disabilities. Based on our findings, we propose criteria for not discriminating against people with disabilities in allocating resources. The shift from person-centred to community-centred medicine offers opportunities but also risks sacrificing the most vulnerable people. The principle of reasonable accommodation must always be considered to guarantee the rights of persons with disabilities. (shrink)

In its formlessness and potentiality, prime matter is a problematic entity of medieval metaphysics and its ontological limitations drastically affect human possibility of conceiving it. In this article, I analyse three influential strategies elaborated to justify an epistemic access to prime matter. They are incidental perception, negative abstraction, and analogy. Through a systematic and historical analysis of these procedures, the article shows the richness of interpretations and theoretical stakes implied by the conundrum of how prime matter can be known by (...) human beings. In particular, the reasons behind the later medieval acceptance of analogy as the main way to unveil prime matter become clearer by pointing out the correlation between the ontological and epistemological levels of the medieval examination of prime matter. The essay addresses Heidegger’s language in two distinct yet interrelated ways: in terms of his understanding of language as well his own jargon. The analysis is based on a close reading of the preamble to ›Being and Time‹ (›Sein und Zeit‹), which serves as an exemplar and is representative of the suggestive language-games that are characteristic of Heidegger’s philosophy. Therefore, the analysis focuses on the use of a single word, the adverb ›eigentlich‹. In a second step, the article examines the (...) nominalized form of inauthenticity and questions its source and shows to which extent Husserl’s understanding of language serves as a contrast to Heidegger’s own understanding of language. In conclusion, it is demonstrated how Heidegger employed two distinct exoteric languages and why ›Being and Time‹ can be regarded as a critique of language. (shrink)

Digital technologies are pervasively used, and they are becoming part of our everyday actions by being designed to be connected to every aspect of our private life like emotions. However, it is not very clear how they are going to change who we are through their tight intertwinement. Especially in relation to emotions, it is not clear at all what happens when they become digitalized and visualized through these digital devices. Usually, the research focusses on the effect on the privacy (...) of the intrusion of digital devices in our lives as if this process of digitalization leaves the meanings human beings give to their emotions untouched. This article does not focus on the privacy related to the personal information captured by the devices, but it aims to open an analysis of the effects of this digitalization on the emotions in order to highlight the fact the introduction of these digital technologies change what emotions are. This paper takes part in the methodological debate concerning the nature and the justification of hypotheses about computational systems in software engineering by providing an epistemological analysis of Software Testing, the practice of observing the programs’ executions to examine whether they fulfil software requirements. Property specifications articulating such requirements are shown to involve falsifiable hypotheses about software systems that are evaluated by means of tests which are likely to falsify those hypotheses. Software Reliability metrics, used to measure the growth of (...) probability that given failures will occur at specified times as new executions are observed, is shown to involve a Bayesian confirmation of falsifiable hypotheses on programs. Coverage criteria, used to select those input values with which the system under test is to be launched, are understood as theory-laden principles guiding software tests, here compared to scientific experiments. Redundant computations, fault seeding models and formal methods used in software engineering to evaluate test results are taken to be instantiations of some epistemological strategies used in scientific experiments to distinguish between valid and non-valid experimental outcomes. The final part of the paper explores the problem, advanced in the context of the philosophy of technology, of defining the epistemological status of software engineering by conceiving it as a scientifically attested technology. Husserl’s official account of essence is modal. It is also, I submit, incompatible with the role that essence is supposed to play, especially relative to necessity, in his overall philosophy. In the Husserlian framework, essence should rather be treated as a non-modal notion. The point, while not generally acknowledged, has been made before (by Kevin Mulligan for one); yet the arguments given for it, though perhaps sound, are not Husserlian. In this paper I present a thoroughly Husserlian argument for that (...) claim, as well as a Husserlian essentialist account of necessity. I also discuss the role of grounding within the account. During the thirteenth century, Aristotelian hylomorphism became the cornerstone of scholastic natural philosophy. However, this theory was fragmented into a plurality of interpretations and reformulations, sparking a rich philosophical debate. This article focuses on Robert Grosseteste (d. 1253), one of the earliest Latin philosophers to directly engage with Aristotle’s natural philosophy. Specifically, it delves into Grosseteste’s perspective on hylomorphism, emphasizing two controversial doctrines that characterized British scholasticism in the late thirteenth century: universal hylomorphism and formal pluralism. The former claims that (...) all substances, whether bodily or spiritual, are hylomorphic compounds, that is, they are made of matter and form. Formal pluralism, in turn, maintains that hylomorphic substances possess more than one substantial form simultaneously. After a brief introduction, the paper proceeds, first, to examine the type of hylomorphism endorsed by Grosseteste, shedding light on an obscure passage that seems to suggest universal hylomorphism. Second, the examination expands on Grosseteste’s theory of bodily form and emphasizes the apparent contradiction of this theory with universal hylomorphism. The discussion then turns to Grosseteste’s endorsement of formal pluralism and the functionality he envisioned being expressed by the bodily form. Finally, the paper draws conclusions about Grosseteste’s revised hylomorphic account. (shrink)

In 2005, IOS Press published the first issue of applied Ontology. At the time, we argued that, at the core of the journal, there was “a desire to understand the nature of reality and how people construe their world”. We declared that ontology was both “fundamental to human thought” and “to translating our thoughts into computational artifacts” (Guarino & Musen,2005). With an editorial board of distinguished scholars representing the fields of computer science, informatics, information science, philosophy, linguistics, psychology, and social (...) science, we had the firm belief that applied Ontologywould fulfill an important academic niche, becoming an essential forum for discussion on topics such as ontological analysis, conceptual modeling, and the role of domain models in building and managing information systems. This paper sheds light on the shift that is taking place from the practice of ‘coding’, namely developing programs as conventional in the software community, to the practice of ‘curing’, an activity that has emerged in the last few years in Deep Learning (DL) and that amounts to curing the data regime to which a DL model is exposed during training. Initially, the curing paradigm is illustrated by means of a study-case on autonomous vehicles. Subsequently, the shift from coding to (...) curing is analysed taking into consideration the epistemological notions, central in the philosophy of computer science, of function, implementation, and correctness. First, it is illustrated how, in the curing paradigm, the functions performed by the trained model depend much more on dataset curation rather than on the model algorithms which, in contrast with the coding paradigm, do not comply with requested specifications. Second, it is highlighted how DL models cannot be considered implementations according to any of the available definitions of implementation that follow an intentional theory of functions. Finally, it is argued that DL models cannot be evaluated in terms of their correctness but rather in their experimental computational validity. (shrink)

La théorie de Darwin est considérée par de nombreux historiens comme une véritable révolution scientifique, raison pour laquelle l’objectif de cet article est précisément de rendre compte des caractères révolutionnaires de cette théorie, dans le cadre d’une conception des révolutions scientifiques empruntée à l’œuvre de Thomas Kuhn. Cela implique, notamment, la définition d’un « paradigme darwinien », à la fois comme matrice disciplinaire et comme solution exemplaire à un problème donné. Dans un tel but, nous définirons la structure et le (...) contenu de la théorie de Darwin, afin de mettre au jour la problématique qui pourrait être à la base d’un « paradigme darwinien », c’est-à-dire le problème de la complexité adaptative du vivant. Nous identifierons ensuite ce qui distinguerait ce paradigme des autres, si bien que le problème de la complexité ne saurait être posé et résolu que dans son cadre. Pour ce faire, nous nous concentrerons sur deux dichotomies : d’une part, celle entre fonctionnalisme et formalisme, d’autre part, celle entre naturalisme et idéalisme. En conclusion, nous mettrons au jour les limites de l’épistémologie kuhnienne pour l’analyse de la théorie de l’évolution, ce qui nous amènera à equisser les contours d’une approche alternative, que nous appellerons « ontologie historique ». Dignity plays a crucial role as both a fundamental value and as an end state in the process of humanizing organizational cultures, workplaces and relationships. However, despite its significance, it has yet to be addressed properly in the growing discourse on humanistic capitalism and management, and indeed in business ethics as a whole. This symposium seeks to inform and inspire emerging research and approaches towards human dignity (...) through the lens of artistic expression and explores how arts may promote human dignity in organizational life. Technology always provides a new perception of the world. However, it is not clear when technology produces “mere” new informations and when it provides something more such as a production of new objects in our world which start to “live” around us. The aim of this paper is to study how technology shapes our surrounding world. The questions which we are going to answer are: Is it really adding new objects to our world? If yes, does every technology have this (...) potentiality? We are going to tackle the problem using a phenomenological and post-phenomenological approach focussing our attention on the perceptual level. Using Husserl’s philosophy we will study how technology are deeply involved in our perception and, thanks to post-phenomenology and its concept of “embodiment relations,” we will be able to determine which kind of technologies have the potentiality to change our surrounding world introducing and producing new objects in it. What makes someone responsible for a crime and therefore liable to punishment under the criminal law? Modern lawyers will quickly and easily point to the criminal law's requirement of concurrent actus reus and mens rea, doctrines of the criminal law which ensure that someone will only be found criminally responsible if they have committed criminal conduct while possessing capacities of understanding, awareness, and self-control at the time of offense. Any notion of criminal responsibility based on the character of the offender, (...) meaning an implication of criminality based on reputation or the assumed disposition of the person, would seem to today's criminal lawyer a relic of the 18th Century. In this volume, Nicola Lacey demonstrates that the practice of character-based patterns of attribution was not laid to rest in 18th Century criminal law, but is alive and well in contemporary English criminal responsibility-attribution. Building upon the analysis of criminal responsibility in her previous book, Women, Crime, and Character, Lacey investigates the changing nature of criminal responsibility in English law from the mid-18th Century to the early 21st Century. Through a combined philosophical, historical, and socio-legal approach, this volume evidences how the theory behind criminal responsibility has shifted over time. The character and outcome responsibility which dominated criminal law in the 18th Century diminished in ideological importance in the following two centuries, when the idea of responsibility as founded in capacity was gradually established as the core of criminal law. Lacey traces the historical trajectory of responsibility into the 21st Century, arguing that ideas of character responsibility and the discourse of responsibility as founded in risk are enjoying a renaissance in the modern criminal law. These ideas of criminal responsibility are explored through an examination of the institutions through which they are produced, interpreted and executed; the interests which have shaped both doctrines and institutions; and the substantive social functions which criminal law and punishment have been expected to perform at different points in history. A new approach to sentencing Not Just Deserts inaugurates a radical shift in the research agenda of criminology. The authors attack currently fashionable retributivist theories of punishment, arguing that the criminal justice system is so integrated that sentencing policy has to be considered in the system-wide context. They offer a comprehensive theory of criminal justice which draws on a philosophical view of the good and the right, and which points the way to practical intervention in the real world of incremental (...) reform. The problem of artificial intelligence and human being has always raised questions about possible interactions among them and possible effects yielded by the introduction of such un-human subject. Dreyfus deeply connects intelligence and body based on a phenomenological viewpoint. Thanks to his reading of Merleau-Ponty, he clearly stated that an intelligence must be embodied into a body to function. According to his suggestion, any AI designed to be human-like is doom to failure if there is no tight bound with a (...) human-like body. Today, we are facing the pervasive introduction of robots into our everyday life, and the problem of this co-existence raises again with new vigor since they are not mere speculations, but there are already products sold to the public. We will highlight how vulnerability has to be taken into consideration in the design of robots to create entities which are able to relate to human beings taking into consideration mainly the positions of Sartre, Habermas, Levinas, and Marleau-Ponty. A first part will focus on the vulnerability of the robots. Robots are going to be among us, but a real interaction is possible only the moment they have a “same” body of ours. Therefore, only through the realization of a “fragile” body we can achieve a cohabitation between equals. Thanks to Merleau-Ponty we will show how the vulnerability of a body is one of the most important element to found any social interaction. The second part will focus on how the robots will affect the vulnerability of the human subjects. To produce vulnerable robots is not a mere neutral introduction, but it shapes how the subjects are constituted. Thanks to Levinas, we will study how the vulnerable robots will shape the subjects. Thanks to Sartre, we will show how the creation of a different gaze in the robot changes the vulnerabilities of the human subjects. Introducing vulnerable robots is a way to shape ourselves. This study evaluates the editorial policies of a randomized sample of English language peer-reviewed journals that publish original research involving the use of animals. The aim is to identify whether journals have editorial policies relating to the use of animals in the research that they are prepared to publish and whether any policies are likely to promote animal welfare and dissemination of information on the 3Rs within the scientific community. The results demonstrate that a significant proportion of journals publishing original (...) research involving animals do not have any editorial policy relating to the use of animals. Of those journals that do have policies the majority simply request that the research be carried out in accordance with standard regulatory requirements. This paper aims to provide editors and publishers with the information they need to review their own editorial policies to ensure they are fulfilling their potential to promote animal welfare and dissemination of the 3Rs. Within contemporary penal philosophy, the view that punishment can only be justified if the offender is a moral agent who is responsible and hence blameworthy for their offence is one of the few areas on which a consensus prevails. In recent literature, this precept is associated with the retributive tradition, in the modern form of ‘just deserts’. Turning its back on the rehabilitative ideal, this tradition forges a strong association between the justification of punishment, the attribution of responsible agency in (...) relation to the offence, and the appropriateness of blame. By contrast, effective clinical treatment of disorders of agency employs a conceptual framework in which ideas of responsibility and blameworthiness are clearly separated from what we call ‘affective blame’: the range of hostile, negative attitudes and emotions that are typical human responses to criminal or immoral conduct. We argue that taking this clinical model of ‘responsibility without blame’ into the legal realm offers new possibilities. Theoretically, it allows for the reconciliation of the idea of ‘just deserts’ with a rehabilitative ideal in penal philosophy. Punishment can be reconceived as consequences—typically negative but occasionally not, so long as they are serious and appropriate to the crime and the context—imposed in response to, by reason of, and in proportion to responsibility and blameworthiness, but without the hard treatment and stigma typical of affective blame. Practically, it suggests how sentencing and punishment can better avoid affective blame and instead further rehabilitative and related ends, while yet serving the demands of justice. (shrink)

In recent years much research has been undertaken regarding the feasibility of the human uterine transplant as a treatment for absolute uterine factor infertility. Should it reach clinical application this procedure would allow such individuals what is often a much-desired opportunity to become not only social mothers, or genetic and social mothers but mothers in a social, genetic and gestational sense. Like many experimental transplantation procedures such as face, hand, corneal and larynx transplants, UTx as a therapeutic option falls firmly (...) into the camp of the quality of life transplant, undertaken with the aim, not to save a life, but to enrich one. However, unlike most of these novel procedures – where one would be unlikely to find a willing living donor or an ethics committee that would sanction such a donation – the organs to be transplanted in UTx are potentially available from both living and deceased donors. In this article, in the light of the recent nine-case research trial in Sweden which used uteri obtained from living donors, and the assertions on the part of a number of other research teams currently preparing trials that they will only be using deceased donors, I explore the question of whether, in the case of UTx, there exist compelling moral reasons to prefer the use of deceased donors despite the benefits that may be associated with the use of organs obtained from the living. The Turing Test is best regarded as a model to test for intelligence, where an entity’s intelligence is inferred from its ability to be attributed with ‘human-likeness’ during a text-based conversation. The problem with this model, however, is that it does not care if or how well an entity produces a meaningful conversation, as long as its interactions are humanlike enough. As a consequence, the TT attracts projects that concentrate on how best to fool the judges. In light of this, (...) I propose a new version of the TT: the Questioning Turing Test. Here, the entity has to produce an enquiry rather than a conversation; and it is parametrised along two further dimensions in addition to ‘human-likeness’: ‘correctness’, evaluating if the entity accomplishes the enquiry; and ‘strategicness’, evaluating how well the entity accomplishes the enquiry, in terms of the number of questions asked. In this article we argue that the social value of health research should be conceptualized as a function of both the expected benefits of the research and the priority that the beneficiaries deserve. People deserve greater priority the worse off they are. This conception of social value can be applied for at least two important purposes: in health research priority setting when research funders, policy-makers, or researchers decide between alternative research projects; and in evaluating the ethics of proposed research proposals (...) when research ethics committees assess whether the social value of the research is sufficient to justify the risks and burdens to research participants and others. In assessing how far a proposed research project will advance the interests of people who are more disadvantaged, research priority setters and RECs should examine the diseases that the research targets and the type of research. Just as certain diseases impose a greater burden on people who are more disadvantaged, so certain types of intervention and forms of research are more likely to benefit people who are more disadvantaged. We outline which populations are likely to be representative of the global worst off and identify what types of health research, and which disease categories, are priorities for these populations. My aim in this article is to briefly reconstruct the reception of Dewey's _Art as Experience_ and more generally of his aesthetics in Italy. In order to do so, my contribution will be divided into three parts, corresponding to the three editions that Dewey's book has had in Italy. In the first part, I will trace the early influences and the debate with Benedetto Croce, showing the "idealistic encirclement" suffered by Dewey's aesthetics, which led to the first Italian translation of (...) Dewey's book in 1951. In the second part, I will trace the influence of Dewey's aesthetics from 1951 to 2006, showing first the Marxist and Catholic critiques, then the first tentative attempts at a reinterpretation outside the idealist domain, and finally the second edition of _Art as Experience_ in Italy 1995. The third part considers the renaissance of Dewey's aesthetics in Italy after Giovanni Matteucci's new translation in 2006 and Luigi Russo's work in 2007. The article concludes with a brief consideration of Dewey's significance for the contemporary Italian aesthetic debate and an attempt to identify a specific Italian interpretation of Dewey's aesthetics that can be traced in the effort to bring Dewey into dialogue with other authors of the modern aesthetic tradition. According to The Evidentialist problem of Evil, the existence of disproportionate, prima facie gratuitous evil and suffering in the world is enough evidence against the existence of the Omnipotent, Perfectly Loving, Omniscient God of Classical Theism. A contemporary way of dealing with this argument is Skeptical Theism, for which the very fact that there is an huge amount of evil that looks gratuitous to us does not mean that we can reasonably believe whether this evil is indeed gratuitous or not. In this paper, I present and discuss a number of influential criticisms against this view according to which a proponent of Skeptical Theism will be forced to accept a number of unpalatable skeptical conclusions. After being discussed in 1929 with Husserl as referent and Heidegger as co-referent, Eugen Fink’s Dissertation “Vergegenwärtigung und Bild” has been published in 1930 on the “Jahrbuch für Philosophie und phänomenologische Forschung”. In his study, Fink works out a careful and methodic inquiry of basic notions of Husserlian thought regarding the time-consciousness. The paper analyzes the main theses of Dissertation, paying particular attention to the fist and wider part devoted to presentification, a concept that means all mental processes, which make (...) present what belongs to the sphere of the past, the future, or the possible: memory, expectation, imagination, and dream. Through a comparison with the investigations that Husserl himself addressed to the topic of not-presence and unreality, we aim at casting light on the radical detailed analyses introduced by Fink, with special focus on the original changes concerning the phenomenological status of dreaming.
